Washington St., Iowa City, IA 52240 (319) 356-5145 RESOLUTION NO. 04-248 RESOLUTION AUTHORIZING MAILING AND PUBLICATION OF NOTICE OF INTENT TO COMMENCE PUBLIC IMPROVEMENT PROJECT TO CONSTRUCT THE SOUTH SYCAMORE SANITARY TRUNK SEWER EXTENSION PROJECT AND TO ACQUIRE PROPERTY FOR THE PROJECT; AND SETTING DATE OF PUBLIC HEARING. WHEREAS, under the provisions of Sections 6B.2A and 6B.2B of the Iowa Code, a governmental body which proposes to acquire property under power of eminent domain for a public improvement project is required to give notice of intent to commence the project to all property owners whose properties may be acquired in whole or in part for the project; and WHEREAS, the City Council of the City of Iowa City intends to commence a project to construct the South Sycamore Sanitary Trunk Sewer Extension Project, which includes the extension of approximately 500 linear feet of sanitary sewer, which project is to be known as the South Sycamore Sanitary Trunk Sewer Extension Project; and WHEREAS, before the City of Iowa City can proceed with said project, the City Council must: a. Hold a public hearing, providing the opportunity for public input on the question of proceeding with the public improvement and on the acquisition or condemnation of property interests for the project; and b. Adopt a resolution declaring its intent to proceed with said project and authorizing the acquisition of property interests required for the project by negotiation or condemnation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. Documentation showing the proposed location of the South Sycamore Sanitary Trunk Sewer Extension Project shall be placed on file in the office of the City Clerk and made available for public viewing. 2. A public hearing on the City's intent to proceed with the South Sycamore Sanitary Trunk Sewer Extension Project and to acquire property rights therefore is to be held on the 19th day of October, 2004. at 7:00 p.m. in the Emma J. Harvat Hall, City Hall, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. 3. The Department of Public Works and City Clerk are hereby authorized and directed to cause notice of the City's intent to proceed with said project and authorize the acquisition of property for said project to be mailed and published as required by law with said Notice of Intent to be in substantially the attached form; said publication to be published in a newspaper published at least once weekly and having a general circulation in the City, not less than four (4) nor more than twenty (20) days before said hearing. Clinton Street Iowa City, IA 52240 Chapter 6B of the Iowa Code requires a governmental body which proposes to acquire property rights under power of eminent domain for a public improvement project to give notice ofthe project to all agricultural property owners whose properties may be affected and to hold a public hearing. 1. DESCRIPTION OF THE PROJECT. NOTICE IS HEREBY GIVEN to the above-identified agricultural property owners that the City Council of the City of Iowa City will consider funding of the site-specific design for the South Sycamore Sanitary Trunk Sewer Extension Project, making the final selection of the route or site location, or acquiring or condemning property rights, if necessary, required for the project. Said project includes the extension of approximately 500 linear feet of sanitary sewer. 2. PRIVATE PROPERTY RIGHTS MAY BE ACQUIRED BY NEGOTIATION OR CONDEMNATION. If the above-described project is approved by the City Council, the City may need to acquire property rights for the project improvements. Property rights may include a temporary construction easement, a pennanent easement, and/or a fee simple parcel (complete ownership). Upon review of the records of the Johnson County Auditor, it appears that properties or portions of properties owned by the above-identified persons may have to be acquired for the project by the methods described above. The City will attempt to purchase the required property by good faith negotiations. If negotiations are unsuccessful, the City will condemn those property rights which it detennines are necessary for the project. The proposed location of the above-described public improvement is shown on docrunentation which is now on file in the office of the City Clerk and available for public viewing. 3. CITY PROCESS TO DECIDE TO PROCEED WITH THE PROJECT AND TO ACQUIRE PROPERTY RIGHTS; CITY COUNCIL ACTION REQUIRED TO FUND PROJECT. The City has provided funding in its budget for this project, as well as funding to acquire any property rights that may be needed for the project. City staff has analyzed the options for how to proceed with this project and has coordinated project planning with other appropriate agencies. The planning has reached the point where preliminary designs now indicate that certain property rights may need to be acquired. Any public cornment will be considered in preparing the final designs, particularly as private property may be affected. In making the decision to fund the site-specific design for the public improvement, to make the final selection of the route or site location, or to acquire or condemn property rights, if 2 necessary, the City Council is required to hold a public hearing, giving persons interested in the proposed project the opportunity to present their views regarding the decision to fund the site-specific designs for the project, make the final selection of the route or site location, or to acquire or condemn, if necessary, property or an' interest in property for the project. The public hearing will be held on the 19th day of October, 2004 in the Emma J. Harvat Hall, City Hall, 410 East Washington Street, Iowa City, Iowa, commencing at 7:00 p.m. or, if cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk. In order to fund the site-specific design for the public improvement, to make the final selection of the route or site location, or to commence the acquisition or condemnation of property rights, if necessary, for the above-described project, City Council will be required to approve the project and authorize acquisition of private property rights for the project by Council resolution. The City Council is scheduled to consider adoption of a resolution authorizing acquisition of property rights for the above-described project following the public hearing. When an appraisal is required, if the project is approved by the City Council, an appraiser will detennine the compensation to be paid for easements and/or property acquired in fee simple. The City will offer no less than the appraised value and will attempt to purchase only the needed property by good faith negotiations. If the City is unable to acquire properties needed for the project by negotiation, the City will acquire those property rights by condemnation. 4. The City Council of the City of Iowa City, Iowa has not yet detennined to undertake the above-described project or to acquire property rights for the project. This Notice does not constitute an offer to purchase property rights. 6. STATEMENT OF RIGHTS. Just as the law grants certain entities the right to acquire private property, you as the owner of property have certain rights. You have the right to: a. Receive just compensation for the taking of property. (Iowa Const., Article I, Section 18) 3 b. An offer to purchase which may not be less than the lowest appraisal of the fair market value of the property. (Iowa Code §§ 6B.45, 6B54) c. Receive a copy of the appraisal, if an appraisal is required, upon which the acquiring agency's detennination of just compensation is based not less than lO days before being contacted by the acquiring agency's acquisition agent. ( Iowa Code §6B.45) d. When an appraisal is required, an opportunity to accompany at least one appraiser of the acquiring agency who appraises your property. (Iowa Code §6B.54) e. Participate in good faith negotiations with the acquiring agency before the acquiring agency begins condemnation proceedings. (Iowa Code §6B.3(l)) f. If you cannot agree on a purchase price with the acquiring agency, a detennination of just compensation by an impartial compensation commission and the right to appeal its award to district court. (Iowa Code §§ 6BA, 6B.7, and 6B.18) g. A review by the compensation commission of the necessity for the condemnation if your property is agricultural land being condemned for industry; (Iowa Code § 6BAA) h. Payment of the agreed upon purchase price, or if condemned, a deposit of the compensation commission award before you are required to surrender possession of the property. (Iowa Code §§ 6B.25 and 6B.54(11)) 1. Reimbursement for expenses incidental to transferring title to the acquiring agency. (Iowa Code §§ 6B.33 and 6B.54(10» J. Reimbursement of certain litigation expenses: (l) if the award of the compensation commissioners exceeds 110 percent of the acquiring agency's final offer before condemnation; and (2) if the award on appeal in court is more than the compensation commissioner's award. (Iowa Code §6B.33) k. At least 90 days written notice to vacate occupied property. (Iowa Code § 6B.54(4» 1. Since that time, the lot has been home to two primary structures and a variety of uses. Miller Bros. Monuments occupied the 2 northern building until their recent move across the street. The southern building has five distinct units, which are currently occupied by Architectural Granite & Marble, Apria Healthcare, and SE Iowa Ambulance. The applicant is now seeking to subdivide the property into two lots so that each building may be sold to separate owners. ANALYSIS: The Johnson County/Iowa City Fringe Area Agreement is intended to provide for orderly and efficient development patterns appropriate in a non-urbanized area, protect and preserve the area's natural resources, direct development to areas with physical characteristics which can accommodate development, and effectively and economically provide services for future growth and development. The Agreement grants the City the authority to require that subdivisions within the fringe area adhere to the City's subdivision standards and conditions. The Fringe Area Agreement makes it clear that commercial development in the City's growth area should in most cases be annexed into the city. In this case however, the proposed subdivision includes existing development that will not be appreciably intensified as a result of the City's approval of the subdivision. This property was developed under a previous version of the Fringe Area Agreement prior to the City having annexed the adjacent land between Naples Avenue and Highway 218. If this property was vacant land being proposed for development the Fringe Area Agreement would require annexation prior to subdivision, but given that the purpose of the subdivision is simply to allow the transfer of existing development to different ownership, annexation does not appear to be necessary. STAFF RECOMMENDATION: Staff recommends that the preliminary and final plat of SUB04-Q0022 be approved, subject to approval of legal papers prior to City Council consideration of the final plat. The proposal is to develop multi-family buildings, therefore refuse collection will be provided through a private contract. 2 BACKGROUND INFORMATION: This property was annexed into the city in 1993 and zoned RS-5. In 1995 it was rezoned to Low Density Multi-Family (RM-12) and subject to a Conditional Zoning Agreement, requiring Staff approval of a site plan that demonstrates that the development of this property conforms to the policies of the Comprehensive Plan. The applicant is seeking to subdivide the property into two lots at this time. ANALYSIS: The Northeast District Plan, adopted in 1999, included a concept plan for the Lindemann Hills neighborhood, of which this parcel is a part. While most of the neighborhood will be single-family homes, multi-family zoning is seen as appropriate for this parcel given the potential school site to the immediate west and the neighborhood commercial area immediately south. The Conditional Zoning Agree that applies to this property requires Staff approval of a site plan that makes the higher-density area an asset to the community, and fits in well with the lower-density uses in the rest of the neighborhood. The concept plan calls for small apartment buildings and townhouses on this property. The south branch of Ralston Creek runs roughly parallel to the western boundary of this property, and is partially noted on the plat. The Lindemann Hills concept plan cites the potential for a greenway and trail system that follows the creek, and any proposed development should account for that possibility. Providing open space buffers between development and creeks is one of the neighborhood planning principles that guides the Northeast District Plan and the Lindemann Hills concept plan. Staff's site design review will address most of the aspects mentioned in the District Plan. The question at hand is whether the proposed subdivision and street configuration will be adequate to incorporate the goals of the concept plan. Staff finds that the two-lot subdivision proposed mirrors the concept plan in terms of street layout. Huntington Drive will be a local street that provides adequate access to Court Street for this multi-family development and the single-family development to the north. As there is no indication when the northern lot will be developed, the Fire Department has requested an approved fire apparatus turnaround at the temporary northern terminus of Huntington Drive. This should be shown on the plat. The lots proposed are of adequate size to permit townhouses and small apartment buildings with open space, as called for in the Northeast District Plan. The proposed sanitary sewer easement along the western property border may allow for an open space and vegetated buffer between the development and the creek and potential school or lower density residential development that may occur there if a school is not built. This area may also be appropriate for a trail connecting Court Street to Lower West Branch Road. The Parks and Recreation Commission is determining if open space or fees in lieu of is desired in this location. Staff further finds that the proposed storm sewer and drainage easements on the northern boundary of the property may be an acceptable means of delineating the transition between multi-family housing and future single-family development to the north. This aspect will be revisited during Staff's consideration of the site plan for this development. Court Street currently stops 1/8 of a mile to the west of the property, at Arlington Drive. Taft Avenue is a chipseal paved road, without shoulder, curb or gutter. If development of the parcel is 3 to proceed at this time, the applicant will need to extend Court Street and related services to Taft Avenue, as the project is not in a funded year of the Capitol Improvements Program. Improvement to the intersection of Taft and Court will also be required, following the preliminary plans prepared by the City. The developer would normally be required to construct the sidewalk adjacent to Taft Avenue. Because the City will reconstruct Taft in the future, fees for the sidewalk should be paid in lieu of construction. This will need to be addressed in the legal papers at the time of Final Plat approval. There is also a water main extension fee of $395 per acre. STAFF RECOMMENDATION: Staff recommends deferral pending resolution of deficiencies and discrepancies. Upon resolution of these items staff recommends that SUB04-00024, a preliminary plat of Windsor Ridge Part Twenty One an 11.16 acre, two lot residential subdivision located at East Court Street and Taft Avenue, be approved. DEFICIENCIES AND DISCREPANCIES: 1. A temporary fire apparatus turnaround should be shown at the north end of Huntington Drive. 2. The storm sewers on Court should be shown as proposed. 3. The rezoning from OPDH-12, High Density Single-Family Residential, to OPDH, Medium Density Single-Family Residential, was recently approved by the City Council. Ten zero-lot single family homes are proposed for the property. ANALYSIS: Subdivision design: The subdivision consists of ten lots accessed from an extension of Jensen Street. Jensen Street will terminate in a cul-de-sac. The applicant will construct a trail on the east side of the property to connect the Willow Creek Trail to the north side of Willow Creek (the City is responsible for installing the pedestrian bridge over the creek). The design includes open space along the pond on the north side of the property, and also on the east side of the property concurrent with the MidAmerican pipeline easement. Conformance with Preliminary Plat: The final plat is in general conformance with the preliminary plat, and with the subdivision design standards. As part of the Planned Development Housing Plan that was approved as part of the OPDH-8 zoning, some variations to the RS-B zone were approved. These variations include smaller lot sizes and widths that would normally be permitted in the RS-8 zone. Six of the ten lots are less than the 5,000 square-foot minimum lot size, and seven of the ten lots are less than then 45- foot minimum lot width of the RS-8 zone. Because of the zero-lot house design, however, all required setbacks are met. Because of the open space designed into the subdivision, the overall density is approximately 5.5 units per acre, even without including the Jensen Street right-of-way. Open Space: Based on the City's adopted open space formula, residential development on this property is required to dedicate 3,618 square feet of open space. The applicant is proposing to dedicate a 6,507 square foot open space outlot for a trail connection and to construct the trail to the north property line. The Parks and Recreation Commission has agreed to accept this open space and maintenance of the trail. The City will install a pedestrian bridge over Willow Creek to connect this trail to the Willow Creek Trail on the north side of the creek. Re: 4th Avenue and A Street speed humps Dear Council Members: I am writing this today, Sunday September 4th, to be sure you receive it by your deadline of September 8th. I think it is very unfair and even "crooked" that you would include the responses past the deadlineof August 20t~, at 5 o'clock that day it should have been over, the late ones should have been put in the waste- basket. Once in twenty years we forgot to pay the water bill and the next day a service charge was added. What's the point in having a deadline if you don't observe it. My wife and I moved here to 413 4th Ave. 48 years ago. City High and Hoover Schools were both here, that's the reason we moved here. We have never once complained about the students. For the most part, they drive very sensibly.The students are only here 9 months of the year, they graduate and move on with their lives, but we are here 365 days of the year. Humps won't bother any of them, it will be fun for them. It is us, who pay taxes and we were also forced into paying for 60 ft. of paving some 40 years ago at a time we were young and had a child and no money. My wife got a job with Fred Fluegel at a telephone exchange nights at $1.00 an hour so we could pay for the paving, and now after all of the "ups and downs" we have been through in 48 years some of our neighbors want us to drive over humps. According to the map we received there will be a hump just south of our driveway would any of you care to listen to brakes and "thuds" all hours of the day and night? How would you CouncilMembers like it if a group of chronic complainers tried to do that to your street? AnY of you are most welcome to come and park in our driveway and see for yourself just what goes on. There has never been an accident on 4th and A, but the intersection at Court St. and 4th Ave. is an accident waiting to happen, there havebeen several fender benders there. Leave our street,~ð~ething about that bad intersection, either a 4-way stop or traffic light is desperately needed at that intersection before a bad accident happens, well that's the intersect ion we will be forced to use if humps are put in (we have always went down 4th and A to avoid that congestion) as we certainly won't abuse our car by driving over four humps every time we need to run an errand. By the way, I ret ired from the City Pol lit, ion Control after 30 years with the City. I was the one who was able to get parking on one side of the street so emergency vehicles could get through. Page two I Please don't let newcomers destroy our street, listen to someone who drove down 4th Ave. when it was gravel, helped pay for pavementjgraduated from City High as did my son and grandson. We used to have block Christmas parties, birthday parties and going away parties, it is so sad over this street "hump" thing it has brought a split in the once friendly street, some won't speak or wave now, all because of a few trouble makers who have complained about something ever since they moved here, if they think it is so bad why don't they move and let the rest of us who have always been happy here, spend the few years we have left to live here in peace. Please--please vote NO to the "humps" spend your energy deciding what can be done at Court St. and 4th Ave, our street is fine just the way it is. I see the 60% majority needed for approval has been met by a 9 to 6 vote. I applaud this vote and hope the council sees fit to move forward with this proposal. I feel speed humps will not only slow traffic and offer protection for area residents, they will also help protect the teen drivers from their worst enemy, themselves. I have witnessed some scary things on my street between 3:30 and 3:45 after City High lets out. I have seen kids drive 25 or 30 mph backwards so they can talk to friends that they passed because they were going so fast. It is common place to see them come down 4th A venue doing 40 mph or faster and squealing tires as they round the corner to A Street. Perhaps the scariest thing is to watch them play chicken with pedestrians. The driver comes flying down the street pretending like they intend to hit a student who is walking and then they swerve or hit their brakes at the last moment. How it is someone hasn't been seriously hurt or even worse, is beyond me. I honestly think you could be helping to save a life by voting yes on this proposal. WHEREAS, the City of Iowa City desires to construct the Meadow Street Bridge Replacement and Dover Street Detention Basin Improvement Project ("Project") which includes the replacement of the Meadow Street bridge spanning Ralston Creek and the replacement of storm sewer from the bridge to and within a stormwater detention basin located between Dover Street and Catskill Court on lots 20-27 in Oakes Meadow Addition; and WHEREAS, the City Council has determined that construction of the Project is a valid public purpose under State and Federal law, and has further determined that acquisition of certain property rights is necessary to construct, operate and maintain the proposed project; and WHEREAS, the City staff has determined the location of the proposed Project; and WHEREAS, City staff should be authorized to acquire necessary property rights at the best overall price to the City. In the event negotiation is successful, the Mayor and City Clerk are hereby authorized to execute and attest easement agreements and agreements in lieu of condemnation. WHEREAS, the City desires to secure the services of the Consultant to provide engineering services related to the proposed improvements of US Highway 6 from Lakeside Drive to approximately 600 feet east of 420th Avenue, and; WHEREAS, the proposed improvements to Highway 6 include grading, drainage, and paving improvements, and; NOW THEREFORE, it is agreed by and between the parties hereto that the City does now contract with the Consultant to provide services as set forth herein. I. SCOPE OF SERVICES Consultant agrees to perform the following services for the City, and to do so in a timely and satisfactory manner. Consultant shall provide the following professional services for US Highway 6 improvements as defined as Alternative B of the US Highway 6 Design Concept Report and Conceptual Drawings prepared by Shive-Hattery, Inc., dated January 12, 2004. A. Project Management: The Consultant shall provide project management for the project. A project plan shall be prepared and updated during the course of the project to manage the components of the project including scope, schedule, cost, quality, resources and stakeholders, communications, risks, procurement, and overall project integration. B. Topographic Survey: The Consultant shall provide a field survey and base map for the limits of the project corridor. C. Preliminary and Final Design: The Consultant shall provide design and plan preparation including all plan submittals necessary for the Iowa Department of Transportation critical path review process. The Guidelines and Checklists for Preliminary, Check and Final Plans shall be used to complete the submittals. D. Bidding: If the project is authorized for bidding, then the Iowa DOT shall let the project. The Consultant shall respond to inquiries from the Iowa DOT Office of Contracts and prepare addenda as requested during the bidding phase. E. Meetings: Meetings shall consist of design review workshops with the City during the design phase of the project. It is anticipated that design meetings shall be regularly scheduled every two to three weeks once the design process has initiated. The Consultant will also attend three (3) public informational I property owner meetings. F. Opinion of Probable Construction Cost: The Consultant shall prepare an opinion of probable construction cost during each submittal phase of the project. -2- Section IV G. Easements: The Consultant shall define the needs for temporary and/or permanent easements that may be required for construction of the project. H. Expenses: The Consultant shall provide reasonable reimbursable expenses as required for completion of the project. Such typical expenses include but are not limited to mileage, printing and plotting. Expenses shall be considered reimbursable and billed in addition to the lump sum fee. II. TIME OF COMPLETION The Consultant shall complete applicable phases of the Project in accordance with the schedule shown, assuming a notice to proceed is issued by the City on or before October 4, 2004. If the notice to proceed is issued at a later date, time of completion shall be extended accordingly. Unforeseen delays outside the control of the Consultant shall be justification for revising the project schedule. GENERAL TERMS A. The Consultant shall not commit any of the following employment practices and agrees to prohibit the following practices in any subcontracts. 1. To discharge or refuse to hire any individual because of their race, color, religion, sex, national origin, disability, age, marital status, gender identity, or sexual orientation. 2. To discriminate against any individual in terms, conditions, or privileges of employment because of their race, color, religion, sex, national origin, disability, age, marital status, gender identity, or sexual orientation. B. Should the City terminate this Agreement, the Consultant shall be paid for all work and services performed up to the time of termination. However, such sums shall not be greater than the "lump sum" amount listed in Section IV. The City may terminate this Agreement upon seven (7) calendar days' written notice to the Consultant. C. This Agreement shall be binding upon the successors and assigns of the parties hereto, provided that no assignment shall be without the written consent of all Parties to said Agreement. D. It is understood and agreed that the retention of the Consultant by the City for the purpose of the Project shall be as an independent contractor and shall be exclusive, but the Consultant shall have the right to employ such assistance as may be required for the performance of the Project. - 3 - . Section IV E. It is agreed by the City that all records and files pertaining to information needed by the Consultant for the project shall be available by said City upon reasonable request to the Consultant. The City agrees to furnish all reasonable assistance in the use of these records and files. F. It is further agreed that no Party to this Agreement shall perform contrary to any state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa. G. At the request of the City, the Consultant shall attend meetings of the City Council relative to the work set forth in this Agreement. Any requests made by the City shall be given with reasonable notice to the Consultant to assure attendance. H. The Consultant agrees to furnish, upon termination of this Agreement and upon demand by the City, copies of all basic notes and sketches, charts, computations, and any other data prepared or obtained by the Consultant pursuant to this Agreement without cost, and without restrictions or limitation as to the use relative to specific projects covered under this Agreement. In such event, the Consultant shall not be liable for the City's use of such documents on other projects. I. The Consultant agrees to furnish all reports, specifications, and drawings, with the seal of a professional engineer affixed thereto or such seal as required by Iowa law. J. The City agrees to tender the Consultant all fees in a timely manner, excepting, however, that failure of the Consultant to satisfactorily perform in accordance with this Agreement shall constitute grounds for the City to withhold payment of the amount sufficient to properly complete the Project in accordance with this Agreement. K. Should any section of this Agreement be found invalid, it is agreed that the remaining portion shall be deemed severable from the invalid portion and continue in full force and effect. L. Original contract drawings shall become the property of the City. The Consultant shall be allowed to keep mylar reproducible copies for the Consultant's own filing use. M. Fees paid for securing approval of authorities having jurisdiction over the Project will be paid by the City. N. Upon signing this agreement, Consultant acknowledged that Section 362.5 of the Iowa Code prohibits a City officer or employee from having an interest in a contract with the City, and certifies that no employee or officer of the City, which includes members of the City Council and City boards and commissions, has an interest, either direct or indirect, in this agreement, that does not fall within the exceptions to said statutory provision enumerated in Section 362.5. O. The Consultant agrees at all times material to this Agreement to have and maintain professional liability insurance covering the Consultant's liability for the Consultant's negligent acts, errors and omissions to the City in the sum of $1,000,000. -4- Section IV IV. COMPENSATION FOR SERVICES City shall pay Consultant for services rendered under Section I - Scope of Services the lump sum fee of $176,000.00. Consultant shall bill the City monthly for services and reimbursable expenses. Payment shall be due and payable within thirty (30) days of City's receipt of invoice. If the City fails to make monthly payments due Consultant, Consultant may, after giving seven (7) days' written notice to the City, suspend services under this Agreement until the City has paid in full all amounts due. V. ADDITIONAL SERVICES Additional Services are not included in this Agreement. If authorized under a Supplemental Agreement the Consultant shall furnish or obtain from others the following services: A. Title searches, appraisals B. Easement plats C. Right-of-way acquisition services D. Geotechnical services E. Environmental documents and permitting F. Bidding services other than those included in Section I.D. of the Scope of Services G. Construction administration H. Construction observation and materials testing I. Construction staking J. Sensitive areas ordinance VI. MISCELLANEOUS A. All provisions of the Agreement shall be reconciled in accordance with the generally accepted standards of the Engineering Profession. B. It is further agreed that there are no other considerations or monies contingent upon or resulting from the execution of this Agreement, that it is the entire Agreement, and that no other monies or considerations have been solicited.
