Washington Street, Iowa City, Iowa; at hearing the Council will consider: A resolution approving the City-initiated annexation of an approximate five-acre tract located west of Dubuque Street and south of the Iowa River. 2. An ordinance amending the Zoning Ordinance by changing the use regula- tions of an approximate five-acre tract, located west of Dubuque Street and south of the Iowa River, from County RS, Suburban Residential, to P, Public. RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF APPROXI- MATELY 7.1 2 ACRES LOCATED WEST OF DUBUQUE STREET AND SOUTH OF THE IOWA RIVER. WHEREAS, the City of Iowa City (hereinafter "City") owns an approximate 7.12 acre parcel of land located west of Dubuque Street and south of the Iowa River, and; WHEREAS, the City has initiated the annexation of the 7.12 acre tract into the City of iowa City, iowa; and WHEREAS, pursuant to Iowa Code §368.5 and 368.7 (1995), notice of the application for annexation was sent by certified mail to the Johnson County Board of Supervisors, each affected public utility, the City of Coralville, and the East Central Iowa Council of Govern- ments; and WHEREAS, none of these entities have objected to the proposed annexation. Waterplant Annexation - Former Glasgow Property Date: August 15,1996 GENERAL INFORMATION: Applicant: City of Iowa City 410 E. Washington St. Iowa City, IA 52240 Contact person: Scott Kugler Associate Planner 356-5243 Requested action: Annexation and rezoning from County RS, Suburban Residential, to P, Public Purpose: To bring the last remaining portion of the City's new water treatment plant site into the city. Location: On the west side of Dubuque Street, immediately south of the Iowa River. Size: Approximately 5 acres Existing land use and zoning: The property contains a residence and associated outbuildings; County RS Surrounding land use and zoning: North; East: South: West: Undeveloped, A-3, RS; Residential, RS; Water plant site, P; Water plant site, P. Applicable Code requirements: 4-61, Public Zone (P) File date: July 16,1996 BACKGROUND INFORMATION: This is a City initiated application to annex approximately 5 acres located at the northeast corner of the new water treatment plant site, and to fezone the property from County RS, Suburban Residential, to P, Public. Acquisition of this parcel had been challenged by the former property owner and was therefore not annexed along with the rest of the water plant site in 1995. A settlement was recently reached between the two parties and the City now clearly owns the property. As a result, the property should be annexed into the city and zoned appropriately for its intended use. ANALYSIS: It is in the City's best interest for municipal facilities to be located within the corporate limits when possible. The majority of the water treatment plant site was annexed and rezoned in 1995. The annexation and rezoning of this parcel will bring all of the land needed for the water treatment plant into the city. This site is bordered on the south and the west by property located within the corporate limits and is therefore eligible for annexation. By annexing the property the City will gain full control over zoning of the property and of what uses can or cannot occur on the property. The City's interest in obtaining full control over this property is to protect the ground water resources in the vicinity of the water treatment plant from contamination. The City has therefore purchased the property to eliminate the chances of waste from residential septic systems or other means contaminating the City's wells on the water treatment plant site. The zoning ordinance requires that all publicly owned property within the City be zoned P, Public. If this annexation is approved the property should be zoned P. This classification would be consistent with the rest of the water treatment plant site to the south and west of this parcel. STAFF RECOMMENDATION: Staff recommends that ANN96-0002/REZ96-0016, a City initiated application to annex approximately 5 acres located west of Dubuque Street, south of the Iowa River and to fezone the property from County RS, Suburban Residential, to P, Public, be approved. The City Clerk is hereby authorized and directed to certify and record a copy of this Ordinance in the Office of the County Recorder of Johnson County, Iowa, upon final approval of the annexation of the subject tract by the City Development Board and upon final passage and publication of the Ordinance as provided by law. SECTION IV. REPEALER. All ordinances and parts of ordinances in conflict with the provi- sions of this Ordinance are hereby repealed. SECTION V. SEVERABILITY. If any section, provision or par~ of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision Ordinance No. Page 3 or part thereof not adjudged invalid or unconsti- tutional. SECTION VI. EFFECTIVE DATE. This Ordi- nance shall be in effect after its final passage, approval and publication, as provided by law. Washington Street, Iowa City, Iowa, regarding the intent to convey ± 15.12 acres of land and lease :t: 7.13 acreas of land adjacent to the Elks Club southwest property line and south of Foster Road within an area commonly known as the "Peninsula" to the Elks Club with the City retaining a covenant limiting the use of chemicals and pesticides. Persons interested in expressing their views concerning this matter, either verbally or in writing, will be given the opportunity to be heard at the above-mentioned time and place. Washington Street, Iowa City, iowa, on a corrective ordinance to vacate a forty foot (40') segment of alley right-of-way abutting the east side of property located at 522 South Dubuque Street, with the City retaining a sanitary sewer and utility easement over the property.
