REVITALIZATION PLAN FOR OCTOBER 19, 2004 AND DIRECTING
THE CITY CLERK TO PUBLISH NOTICE OF SAID HEARING
Comment: In December 1994 the City Council approved Resolution
Number 94-358 creating the Near Southside Residential Urban
Revitalization Plan (the "Plan") as a tool to encourage the
redevelopment of property south of Burlington Street. Redevelopment
of this area has not been completed, as such; an amendment to the
time line is being proposed to extend the Plan, Iowa Code Chapter
404.2 requires that a public hearing be held regarding any proposed
amendments to said Plan.

PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE CAMP CARDINAL
ROAD SITE PREPARATION PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY
ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC
INSPECTION.
Comment: This project will remove the trees necessary to construct the
Camp Cardinal Road Project. The tree removal is required to occur
prior to bidding of the road construction because of the potential Indiana
Bat nesting habitat. This project will be funded by GO Bonds and Road
Use Tax.

, 04- ,,1.13 3. CONSIDER A RESOLUTION APPROVING AMENDED BYLAWS OF
THE IOWA CITY PLANNING AND ZONING COMMISSION.
Comment: At its April 15 meeting, by a vote of 6-0 (Shannon absent),
the Planning and Zoning Commission recommended approval. The
revised bylaws will allow a Commissioner with a conflict of interest to
remain in the room while an item about which they have a conflict is
discussed. However, the Commissioner will not be able to participate in
the discussion or vote on the item. The City Council Rules Committee
recommended approval at their August 30 meeting and the minutes
were on the September 14 Council agenda,
04- .J.7'~ 4. RESOLUTION AUTHORIZING THE ACQUISITION OF PERMANENT
EASEMENT FOR INSTALLATION OF A PEDESTRIAN BRIDGE
ACROSS WILLOW CREEK TO CONNECT THE WILLOW CREEK
TRAIL TO THE TRAIL BEING CONSTRUCTED ON LOT 77 OF
WALDEN WOOD PART 6, AND AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST DOCUMENTATION OF
THE SAME.
Comment: City Staff intends to install a pedestrian bridge across Willow
Creek to connect the Willow Creek Trail to the trail being constructed in
the development recently approved on Lot 77, Walden Wood Part 6.
To do so, the City will need to acquire a permanent easement from the
Aspen Lake Condominium Association. The association has indicated
they will grant the easement, without compensation. The City will
maintain the trail after it is constructed. This resolution authorizes City
staff to proceed with acquisition of the easement.

REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED
AT 435 GRANT STREET, IOWA CITY, IOWA.
Comment: The owner of the property located at 435 Grant Street
received assistance through the City of Iowa City's Housing
Rehabilitation Program in amount of $1,229.50. The loans have been
paid off; thus the liens need to be released.

Comment: The owner of the property located at 1602 North Dubuque
Street received assistance through the City of Iowa City's Housing
Rehabilitation Program in amount of $15,921.54. The loan has been
paid off; thus the lien needs to be released.

At its September 16 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of Windsor Ridge Part 20A, a 1.27 -acre,
single-lot residential subdivision located at York Place and Lower West Branch
Road subject to Staff approval of legal papers and construction drawings prior
to City Council consideration. Legal papers and construction drawings have
been approved. Staff recommended approval in a report dated September 16,
2004.

Commission recommended approval of Mackinaw Village Part One, a 6.53-
acre, 14-lot residential subdivision located north of Foster Road subject to Staff
approval of legal papers and construction drawings prior to consideration by
City Council. Legal papers and construction drawings have been approved.

MACKINAW VILLAGE PART TWO, IOWA CITY, IOWA.
At its September 16 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of Mackinaw Village Part One, a 68.71-
acre, 56-lot residential subdivision located north of Foster Road subject to
satisfactory resolution to the City Engineer regarding the description of the
western boundary (the top of the Iowa River bank) of Part Two and Staff
approval of legal papers and construction drawings prior to City Council. The
boundary description has been approved by the City Engineer. Legal papers
and construction drawings have been approved. Staff recommended approval
in a report dated September 16, 2004.

CONSIDER A MOTION ALLOWING THE MAYOR TO SIGN THE CLG NATIONAL
REGISTER REVIEW FORM RECOMMENDING THE MELROSE HISTORIC
DISTRICT FOR ELIGIBILITY FOR PLACEMENT ON THE NATIONAL REGISTER OF
HISTORIC PLACES.
After neighborhood information meeting on September 14 and public hearing on
September 23, the Historic Preservation Commission recommends that the Melrose
Historic District is eligible for placement on the National Register of Historic Places,
This motion enables the Mayor to sign the necessary forms indicating support for the
eligibility of the district. A map and the NRHP Registration Form is included in the
Council packet. Correspondence also included in Council packet.

ITEM 8. CONSIDER AN ORDINANCE AMENDING THE CITY CODE TITLE 10, "PUBLIC
04- 4\4 ~'\ WAYS", CHAPTER 3, "COMMERCIAL USE OF SIDEWALKS", SECTION 3B-1, TO
PERMIT THE UNOBSTRUCTED 8 FOOT PEDESTRIAN WAY REQUIRED FOR
SIDEWALK CAFES TO BE IN ZONE 3 OF CITY PLAZA. (PASS AND ADOPT)
Comment: The present ordinance permits sidewalk cafes located in City Plaza in
Zones 1 and 2, reserving Zone 3 as an unobstructed open area for emergency access,
which is also used daily as the primary pedestrian way in City Plaza. The present
ordinance requires an 8 foot unobstructed pedestrian way within Zones 1 and 2
wherever a sidewalk cafe is permitted. The proposed amendment would permit the use
of Zone 3 for the purpose of establishing an 8 foot unobstructed pedestrian way for
permitted sidewalk cafes.

ITEM 10. CONSIDER A RESOLUTION APPROVING JOSEPH PRESCHER AS THE ARTIST
(j""1-d-q¡ FOR THE BENTON HILL PARK ENTRY WAY AND AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY
OF IOWA CITY AND JOSEPH PRESCHER.
Comment: At your June 1, 2004 meeting, the City Council approved a Call to Artists
for the design, fabrication, and installation of an entry way to the new Benton Hill Park.
At their July 29 meeting, the Public Art Advisory Committee, in consultation with
representatives of the Miller-Orchard Neighborhood Association, selected Joseph
Prescher's design among the proposals submitted. As approved in the Call to Artists,
the cost of this project will be $30,000, with $10,000 from the previously allocated park
improvement budget and $20,000 from the annual public art capital projects allocation.
