Comment: University of Iowa Community Credit Union, Iowa City,
Iowa has requested that the City approve a Subordination
Agreement for 421 Crestview Avenue. On May 25, 1988 the
owners of the property received a $22,000 loan in the form of a
Low Interest Promissory Note and Mortgage through the City's
Housing Rehabilitation Program. University of Iowa Community
Credit Union is about to rewrite the existing Home Equity Loan with
the property owners. The property is appraised at $109,140 which
provides enough equity to cover the City's second lien position, of
which was the City's original position.

Comment: First National Bank, Iowa City, Iowa has requested that
the City approve a Subordination Agreement for 1804 Hannah Jo
Court. On August 23, 1996, Greater Iowa City Housing Fellowship
(GICHF) received a loan from the HOME Investment Partnership
Fund and a Mortgage for a total of 824,000. First National Bank is
about to finance a new mortgage to the property owner for the
amount of 873,000. The property is appraised at 8119,000 which
provides enough equity to cover the City's second lien position.

Mortgage. The terms of this lien were paid off on June 4, 1998;
thus, the lien can now be released.

(10) CONSIDER RESOLUTION AUTHORIZING APPLICATION FOR 1998
COMPREHENSIVE IMPROVEMENTS ASSISTANCE PROGRAM
(CLAP).
Comment: A Notice of Funding Availability for Fiscal Year (FY)
1998 was published in the Federal Register and the application is
due June 29, 1998. The Iowa City Housing Authority proposes to
apply for these funds for comprehensive improvements to Public
Housing properties and their management. The major issues for this
application include office renovation cost for relocation of the
Housing Authority to the Civic Center, landscaping at Shamrock
Place, and individual property upgrades including concrete repair,
storm doors at Whispering Meadows, air conditioners, floor
coverings, garage doors, and appliances. The Iowa City Housing
Authority applied for and received ClAP funds for 1997 in the
amount of 8324,000.

(1 1 ) CONSIDER A RESOLUTION NAMING DEPOSITORIES.
Comment: This resolution will increase the maximum depository
balance at four institutions. This resolution will also update the
name of Perpetual Savings Bank, FSB. We are recommending that
the investment limit at First National Bank Iowa; Magna Bank, NA;
Hawkeye State Bank; and Norwest Bank Iowa NA be increased to
$20,000,000, $35,000,000, $15,000,000, and $50,000,000,
respectively. Limits at depositories need to be raised to ensure that
we receive the best rates for investments and to cover the increase
in the volume of investments due to bond issuances. Perpetual
Savings Bank, FSB is now Commercial Federal Bank. Our depository
resolution needs to reflect this name change. Attached is Exhibit A
which shows current investment limits and balances on deposit at
the various institutions as of June 5, 1998.
Setting Public Hearings.
(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
JULY 7 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR CONSTRUCTION OF THE COLLECTOR
WELLS LOWER TERMINUS PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY
ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC
INSPECTION.
Comment: This project includes construction of the lower terminus
(below ground level) of the four horizontal collector wells (shallow
sand and gravel wells) adjacent to the Iowa River. Two wells are
located on the Lower Peninsula site and two wells are located on
the water plant site. When completed the collector wells will have a
total capacity of approximately 7.4 million gallons per day and will
be the City's primary raw water source. Public Works recommends
approval of this resolution. The estimated cost is $1,800,000 and
will be funded by Bond proceeds repair by water revenues.

amending Title 14, Chapter 6, Zoning, Article A, Zoning Title, Purpose
and Scope, Section 4, Scope, to allow more than one principal building on
a lot for religious institution uses permitted by special exception in RS

Comment: On June 4, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of a Zoning Chapter amendment to
permit more than one principal use or building on a lot through Board of
Adjustment approval of a special exception to establish or expand a
religious institution use. Staff recommended approval in a memorandum
dated May 29.
b. Consider a motion setting a public hearing for July 7 on an ordinance
amending Title 14, Chapter 6, Zoning, Article K, Environmental
Regulations, Section 1, Sensitive Areas Ordinance, to add a retention
requirement for woodlands in Factory-Built Housing Residential (RFBH)
zones,
Comment: On June 4, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of a Zoning Chapter amendment to
require a 50% woodland retention for the RFBH zone. Staff

f. Public hearing on an ordinance ~cating the northern 200 feet of the alley
between Lafayette Street and Benton Street, west of Dubuque Street,
Iowa City, Iowa. (VAC98-0002)
Comment: On May 7, 1998, by a vote of 5-0, the Planning and Zoning
Commission recommended approval of vacating the alley, subject to
Hawkeye Lumber Company entering into a lease agreement with the City
of Iowa City to lease the right-of-way, and subject to all necessary utility
easements being retained. Staff recommended approval in its May 7
staff report.

Consider an ordinance amending Title 14, Chapter 6, Zoning, Article T,
Nonconforming Uses, Structures and Land, Section 5, Regulation of
Nonconforming Lots, by changing the regulation of nonconforming lots of

Comment: At its April 2 meeting, by a vote of 5-1 with Ehrhardt voting
no, the Planning and Zoning Commission recommended approval of the
proposed amendments. Staff recommended approval in its staff
memorandum dated March 27. Council accepted correspondence on
May 26 requesting expedited consideration.

Consider an ordinance changing the zoning designation of approximately
5.4 acres from Community Commercial (CC-2, 2.4 acres) and General
Industrial (I-1, 3.0 acres) to Public (P) for property owned by Kirkwood
Community College at 1806, 1810, 1814, and 1816 Lower Muscatine

Comment: At its April 16 meeting, by a vote of 5-0, the Planning and
Zoning Commission recommended approval of the proposed rezoning.
This is a City-initiated application. Staff recommended approval in its

Comment: At its May 21 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of the preliminary and final

Comment: Phase 1 of the Downtown Streetscape project includes
improvements to the Dubuque Street pedestrian mall from the mid-mall alley
north to Washington Street and Dubuque Street from Washington Street to
Iowa Avenue. The adopted Downtown Streetscape Plan has been used to
guide the final design improvements. The total estimated construction cost
is $655,000 and will be financed with General Obligation Bonds.

CONSIDER AN ORDINANCE AMENDING THE CITY CODE TITLE 5,
CHAPTER 2, ENTITLED "VEHICLES FOR HIRE" BY DELETING THE
REQUIREMENTS FOR A DRIVING RECORD. (FIRST CONSIDERATION)
Comment: Taxicab Company owners and taxicab drivers must present an
IDOT driving record along with their application before obtaining a decal or
driving badge. Currently, the Police Chief runs an internal report with similar
information as the driving record before approving or denying the application.
This is a duplication of information and an additional cost for the applicant.
The Police Chief and City Clerk's office recommend deleting the driving
record requirement from the City Code. ~.~/~_~,.

CONSIDER A RESOLUTION APPROVING, AUTHORIZING, AND DIRECTING
THE MAYOR TO EXECUTE AND CITY CLERK TO ATTEST A DONATION
AGREEMENT WITH THE OFFICE OF THE STATE ARCHEOLOGIST TO
PROVIDE CURATION SERVICES FOR ARCHEOLOGICAL COLLECTIONS
FROM THE NAPOLEON PARK SITE.
Comment: The Archeological investigation at Napoleon Park along the route
of the South River Corridor Sewer has been completed. A report on the
investigation of the site and an artifact analysis has been prepared by Louis
Benger & Associates, the City's Archeological consultant, and has been
submitted to the Corps of Engineers and the State Historic Preservation
Office for review. The City has an obligation to preserve for future use the
artifacts collected during the archeological investigation. Donating the
artifacts to the office of the State Archeologist can best satisfy this
obligation. The Iowa City Historic Preservation Commission recommends the
artifacts be donated to the office of the State Archeologist.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST AN AGREEMENT BETWEEN SHIVE-HATTERY, INC.
OF IOWA CITY, IOWA, AND THE CITY OF IOWA CITY TO PROVIDE
CONSTRUCTION STAKING, INSPECTION AND CONSTRUCTION
MANAGEMENT SERVICES DURING CONSTRUCTION OF THE IOWA RIVER
CORRIDOR TRAIL - BURLINGTON STREET TO NAPOLEON PARK.
Comment: This agreement will provide for construction staking, inspection
and construction management services during construction of the Iowa River
Corridor Trail - Burlington Street to Napoleon Park. It is desirable to have
Shive-Hattery, Inc., the design engineer for this project, assist the City in
implementing the construction contract in those areas where outside
professional surveying engineering support is needed. The cost range of this
agreement is $121,000-$145,000 and will be funded with Local Road Use
Tax. Public Works recommends approval of this resolution.

CONSIDER A R~'OLUTION AWARDING ARCHITECTURAL CONTRACT AND
AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT
FOR COMPLETING ARCHITECTURAL SERVICES FOR THE CIVIC CENTER
THIRD FLOOR AND POLICE DEPARTMENT SECOND FLOOR EXPANSION,
Comment: The architectural firm of Rohrback-Carlson of Iowa City was
unable to continue and complete design services for the Civic Center Third
Floor and Police Second Floor Expansion Project. Engineering has since
negotiated a contract with the Iowa City architectural firm Wehner
Pattschul/Pfiffner PC to complete the project for the stipulated sum of
$94,900 for all remaining phases of services. The City retains the option of
terminating the contract at any remaining phase of design.

Comment: This resolution approves the FY99 agreement for provision of
fixed route transit service within the corporate limits of the City of University
Heights. The total cost of the FY99 contract is $27,500. This is a 2%
increase from the FY98 amount.

Comment: These three agencies are recipients of Iowa City's Aid-to-Agency
funding with the money coming from CDBG public service allocation.

CONSIDER A RESOLUTION AUTHORIZING FUNDING FOR THE AIRPORT
COMMISSION TO PROCEED WITH THE DEVELOPMENT OF PLANS,
SPECIFICATIONS, AND FORM OF CONTRACT FOR CONSTRUCTION OF A
120' X 120' AIRCRAFT HANGAR BUILDING AT THE IOWA CITY MUNICIPAL
AIRPORT.
Comment: At the June 11, 1998, Airport Commission meeting, the Airport
Commission voted to request Council financial assistance for constructing
additional hangar space at the Airport. The aircraft hangar will be
approximately 120' by 120', with a 75' door, room for two to three
corporate aircraft, and a maintenance shop. Cost of the project is estimated
to be approximately $500,000. Hangar rental would be used to repay an
internal departmental loan. Staff memorandum is included in Council packet.

CONSIDER A RESOLUTION AUTHORIZING RENEWAL OF A CHAPTER 28E
AGREEMENT FOR RADIO COMMUNICATIONS BETWEEN THE CITY OF
IOWA CITY, AND THE UNIVERSITY OF IOWA.
Comment: This resolution authorizes the renewal of a 1993 28E Agreement
with The University of Iowa for participation in the City's Trunked Radio
System. The University currently has over 100 radios on the system utilized
by Campus Security, CAMBUS, and Parking. The University pays a user fee
which generates 811,000 annually to help defer the City's system operating
costs. The cooperative agreement allows Campus Security to communicate
with Iowa City Police and Fire, and all users receive the System-Wide
notification of severe weather as issued by the City's Communications
Center.

THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST, AN
AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND THE
DUNBAR/JONES PARTNERSHIP, TO PROVIDE CONSULTANT SERVICES FOR
THE EXPANSION OF OAKLAND CEMETERY.
Comment: Conceptual design and preliminary cost estimates for the easterly
expansion of Oakland Cemetery are complete. The City Council and Parks
and Recreation Commission have agreed to proceed with Phase One of the
project which will encompass approximately 3.5 acres and provide an
additional 3,200 burial spaces. This expansion is needed due to the fact that
Oakland Cemetery will be sold out of burial spaces within the next two
years. The estimated construction cost for Phase One is 8560,000. The
negotiated fee is 855,250. Each is funded with G.O. Bonds.

CONSIDER A RESOLUTION APPROVING, AUTHORIZING, AND DIRECTING
THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST, AN
AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND PIERCE
KING ARCHITECTS, TO PROVIDE ARCHITECTURAL CONSULTANT
SERVICES FOR THE CONSTRUCTION OF THE PARK MAINTENANCE/OFFICE
BUILDING IN NAPOLEON PARK.
Comment: Preliminary design work and cost estimates have been
completed, and additional services are needed for the design, bidding, and
construction phases. The proposed building is a 75' x 150' pre-engineered
maintenance/office building which will house the Parks, Forestry, and CBD
staff and equipment. This will allow the relocation of the Forestry Operations
from the Oakland Cemetery building and the demolition of at least three old
buildings in City Park, thus improving both the appearance and efficiency.
The estimated construction cost is $680,000, and the negotiated
architectural fee is $57,000. The project is funded with G.O. Bonds.
