'rnere are ~ssues which have not been g~ven sufficient consideration m making the decision to build such an extensive and cosfly facility so hurriedly. First of all, let me say that I agree that the city needs a new water supply and treatment facility. I understand that nitrate levels have been above the Safe Drinking Waler Act (SDWA) maximum conruminant limits and that them is concern about high levois of disinfection by-products (DBPs) in the finished water. I also know that the amendments to the SDWA which would have mandated action to reduce DBPs were not enacted in Congress this year. The new members of Congress have made it quite clear that they do not support increasing ~nvironmental legislation, in particular, legislation that mandates activity by local governments which requires extensive local funding. Without knowing what legislation .will be passed you may enact new taxes and increase utility bills to meet non-existent standards. Furthermore, without knowing what legislation might be passed, you may build a plant that does not meet newly enacted standards. Of course this is always a possibility, but it is clear that changes are quite likely at the federal level during the next congressional session. The city does not need to sit still and wait to see what happens. Them are several aspects concerning water quality in Iowa City and Johnson County that need to be ~eO .ns!d.e. red; First ~e p.o. or qml!ty of treated water in Iowa City. Even if no new gts~auon ~s passea, nealm concerns need to be addressed and the city should do so. Without the pressing need of enacted legislation, it can be done with better planning. A subsurface water source would alleviate many of the current oroblems and the site for wells .should be carefully investigated. I do not wish to side with fvlr. Glasgow, but I think there ~s a case to be made about the effect of all the north county septic tanks on wells in the site now being considered. There are several other possibilities for legislative action that should affect the decision making. One is that the amendments considered last year will be passed in spite of the new congressional leadership. The city will have to act, but will have had the advantage of the extra me to make be~r plans. The second is that Congress will live up to its promise not to put the burden of financing federal mandates on local governments, and provide some funding to assist in building treatment facilities. This seems llke a long shot, considering the current fiscul situation, but it cotfid happen. Mr. Slockett proposed a mul.ti-step approa.ch in solving the wa.ter quality problems in an editorial several weeks ago. If this were done m some form, we rmght be able to take advantage of some federal assistance at a later date. F..inally, the city and county should be considerin an area :vide water and ~wa~e h-eatm n ......... g . ~ . et atstnct w~th regional facilines. The proliferauon of new housing in Johnson County ~s adding to the already considerable flueat from private septic tanks. It would be foolish to wait until we have an outbreak of water-borne g~trointestinal illness to begin planning actiota to prevent subsurface contamination. There are advantages to having several large facilities rather than many small ones, one for each town, along with a septic tank for each suburban dwelling or subdivision. The obvious is the economy of scale, but there are others. Larger facilities can be designed and run to achieve beller quality, both for drinking water purification and sewage treatment. They are subject to better regulation and monitoring so that standards will be maintained. I hope that some consideration can be given to the issues I have raised and that the eurren.t plan .fo.r a new neatmerit plant will be reconsidered. I feel that I have some experuse in this area, both because of my education (Phi) in Environmental Engineering) and my experience (teaching Environmental Health). Sincerely, Nancy K. We are requesting use of the lot on June 9, 10, 11, 16, 17 and allowing time for clean-up on Sunday, June 18. Under this schedule regular use of the lot will be able to continue from Monday, June !2 thro%~gh Thursday, June 15. We have determined this to be the best use of the space and allows for the convenience of the co~m~unity. This property is located within Fringe Area 5 on the east side of Scott Boulevard approximately one-half mile north of Highway 6. At its December 15, 1994, meeting, the Iowa City Planning & Zoning Commission recommended that the City Council forward a comment to the Johnson County Board of Supervisors recommending denial of the requested rezoning, due to the proposal's inconsistency with the mutually agreed upon Fringe Area Policy. The Commission further recommended that the Council request that the Board study the appropriateness of rezoning this and the surrounding area to industrial, consistent with the long range plan for this area. Council agrees with the recommendation from the Commission and respectfully requests that the County deny the proposed rezoning, and consider studying the appropriateness of rezoning this and the surrounding area to industrial. The Council expressed particular concern that the approval of this rezoning will impede the future industrial expansion of Iowa City. This site is located within Fringe Area 5, approximately ½ mile north of Highway 6 on the east side of Scott Boulevard. The proposed rezoning is being requested to allow two parcels to be marketed for commercial development. No specific proposed uses are identified in the application. The Fringe Area 5 policy identifies this area for the future extension of the city's existing industrial park, which is consistent with the Iowa City Comprehensive Plan. The proposed commercial zoning would be in conflict with this policy. Allowing commercial development in this location at this time may have a negative effect on the future industrial potential of this area. This is one of the few developable areas available with rail access for industrial development. Annexation should be considered for the development of urban uses in this location, and the policies of the Fringe Area Agreement should be adhered to to ensure that the full potential of this area can be realized. Aside from this site's future industrial potential, staff questions the suitability of this site for commercial development. Unless it is part of a larger district, a stand alone commercial site or small commercial district is generally located at the intersection of two major streets where it is more accessible and visible to a greater number of motorists traveling past the site. This site lies approximately ½ mile north of the nearest major intersection. Rezoning this site commercial would encourage strip commercial zoning along the east side of Scott Boulevard, which could fuRher impede industrial expansion in this area. The proliferation of driveways that would result if this and other nearby sites are rezoned individually without a more comprehensive viewpoint regarding the development of the surrounding area would not be desirable along an arterial street. Development of the proposed commercial zoning in the county would requke septic systems, which is not desirable in an area that is adjacent to the corporate limits and will likely become a part of the city in the future. Upgrades to the Heinz lift station, to serve Village Green and the industrial park, will make servicing this area possible upon annexation. However, it is not recommended that services be extended to serve small individual developments that are in conflict with the Comprehensive Plan, and without any consideration being given to the future development of the surrounding area. Therefore, it is staffs opinion that any development now within this area would be premature. Staff Recommendation: The proposed rezoning would result in premature and inappropriate commercial development in an area that has been identified for future industrial uses, and would be in conflict with the Fringe Area Agreement. Staff recommends that the City Council forward a letter to the Johnson County Board of Supervisors recommending that the proposed rezoning from RS to CH and C2 be denied. Aaachments: 1.
