Horow/ Essentially...Supervisors and city council members are the
ones...who voted against this. And in terms of presenting the
reasons why we did as well as any other issues that might help
us make this decision...I would like to have a little more
time on this.

Public hearing on an amendment of the Comprehensive Plan to
change the land use map designation of property located on the
north side of Highway 1 West from 8-16 dwellingunits per ac~e
and 16-24 dwelling units per acre to 2-8 dwelling units per
acre and general commercial.
Franklin/ The first series of hearings are on the Harlocke/Weeber
rezoning...Comp Plan Amendment which would change the
designation of that strip along Highway i from 8-16 dwelling
units per acre and 16-24 dwelling units per acre to 2-8 and
general commercial. And then we have a series of hearings on
the actual ordinance changes to rezone the property. In your
packet...concept plan .....

tract, located east of Harlocke Street from RM-44, High

Tract which is on east side of Hatlocke ..... P/Z...4-1-1
vote .... Commission recommended rezoning of this property from
RM-44 to RS-5o

by changing the use regulations of approximately two aores
located generally on the west side of Harlocke Street from RM-
44, High Density Multi-Family Residential, to RS-5, Low

Franklin/ ...Recommendation, again, 4-1-1 vote, from RM-44 to RS-5.

Franklin/ Immediately south of there...4.57 acres .... RM-44 to RS-
5. Basically that area on the west end of the large area that
we are looking at...RM-44 to RS-5.

Franklin/ Which two ..... West side of Hatlocke? In the discussions
..... the west side of Hatlocke has developed, the east side of
Hatlocke has not. The Commission decided to split out the
different sections just in case the vote went different ways
· ....rationale for downzoning has to do with traffic in the
Harlocke/Weeber neighborhood .... and the rough topography of
this area.

by conditionally changing the use regulations of an
approximate 4.09 acre tract, known as the eastern portion of
the Ruppert Tract, located generally north of Highway i West
from RM-44, High Density Multi-Family Residential, to CC-2,
Community Commercial. (~EZ93-0007)
Franklin/ Going east along Highway 1...eastern portion of the
Ruppert Tract which is that 4.09 acres on the overhead...
recom]~endation to fezone it from RM-44 to CC-2 and that is
with a condition to retain 200 feet east of the western
boundary ..... ravine...as a natural buffer .... It is not to have
anything done with it at all.
Kubby/ Is that true for the Jensen Tract as well because the ravine
goes up through the Jensen Tract on the easterly border
doesn't it?
Franklin/ There is more than one undulation in the Jensen Tract
.... The ravine does proceed to the north .... With RS-5 zoning
there was going to be a lot less dense development ......
Kubby/ Wouldn't we want the same protections for property that is
similar and adjacent to each other?
Franklin/ Possibly but I don't th~.nk that was discussed at the
Commission. The concern was that the commercial development
not sweep across that ravine along the highway.
Public hearing on an application to fezone an approximate 1.5
acre tract of land located north of Highway i West and west of
Miller Street from RS-8, Medium Density Single-Family
Residential, to CC-2, Community Commercial. (REZ94-0019)
Franklin/ 1.5 acres just to the north that is currently zoned RS-8
and the proposal is to fezone that to CC-2 and that is on a 4-
1-1 vote.
Throg/ Karin, would you elaborate on that particular parcel and why

it is being included?
Franklin/ As you know, all of this is part of some negotiations
that went on between the Ruppert Family, the Harlocke/Weeber
neighborhood and also Mace Braverman, owner of Southgate
Development.
Nov/ Who owns that 1.5 acres?
Franklib/ Ruppert Family.
Franklin/ This is the concept plan with the overlaying zones .... .
for' this all to be palpable to the Ruppert Family and the
downzoning to RS-5 and change from RM-44 to CC-2 commercial
development to the extent that is shown in this plan was
necessary for them to be agreeable to all of this.

Franklin/ (Refers to concept plan). The Ruppert Family owns from
this point...up to over in here ..... Braverman's .... brought in
a proposal to P/Z Commission for a zero lot line...rejected at
Commission level because of access on Benton Street .... They
have an interest in acquiring more property to get the access
off of Benton onto Miller. Essentially the Ruppert Family owns
the corner of Benton and Miller through this entire
'developable area down to the highway and then across.
Horow/ ...Where was the potential for open space...?
Franklin/ When you look at topography of this area .... 8 years ago
..... negotiations that went on with the Ruppert Family about
acquiring land here for open space .... this flat area in
here .... price was too high...with development of this area
(refers to overhead map) there will be an open space
requirement ...based on 3 acres per thousand ..... Busses
...have offered to the city a certain amount of land on south
end of their property... Mr. Lepic might be interested in
contributing some land .... looking at some kind of interior
open space.....May try to negotiate with commercial developer
so that we get some kind of continuity in here (refers to
overhead map)...that would be a negotiated settlement ....
Kubby/ With commercial...isn't now the time to negotiate that
because of the zoning zone?
Franklin/ It certainly could be a condition of the rezoning.

Nov/ I think it ought to be in the zoning agreement ....
Franklin/ ...At the time the discussion was the commercial going
north on this side of Miller Avenue. What this line does here
(refers to overhead map) ..... This is the commercial zoning
right here...Reason for considering this has to do with the
depth of the property given the r.o.w. of Highway i and the
ability to do anything with this because of this narrow....
Kubby/'On the concept plan...parking?
Franklin/ Yes. This concept plan is to show that there is
development potential. Larry is here and drew up the plan for
Southgate development Company .....
Horow/ Concern,..with work that has gone into getting an agreement
among the neighbors...and Ruppert .... and what does this
cpncept of open space and merging with that commercial
district means to that agreement.
Franklin/ It hasn't been discussed yet with either the Ruppert
Family or withMr. Braverman ..... I guess it depends on what it
is that you are talking about ....
Throg/ ~hat does the Neighborhood Open Space say about commercial.
Franklin/ There is not a requirement for commercial ..... it is an
amenity and feature that adds to the quality of life of
neighborhoods where people live as opposed to talking about
any kind of open space within commercial areas ..... It wasn't
the intent of the ordinance.
Kubby/
Franklin/ I am not saying that it was a thought in P/Z about
getting open space from that commercial. That is an issue that
has been raised by Mr. and Mrs. Buss who I believe will be
here tomorrow night. I don't believe it was discussed at P/Z
..... I had a conversation with Bill Buss...intentiono..in
residential area was this particular design was not going to
-work..ohad to have the open space requirement .... This doesn't
show any open space for this project and the location wo-uld be
to the west of the property...

Throg/ Given the relatively large neighborhood ..... roughly how many
acres of open space would be desirable?
Franklin/ According to the plan...7.69 or something...for the
Miller Orchard Neighborhood which is east of here ....
Kubby/ But the plan also recommends two smaller open spaces ....
Franklin/ What we would look at here would be the shape of the
piece and how accessible it was...to people to the east on
Miller and Hudson....
Kubhy/.
Franklin/ The ravine in the commercially zoned area is on the
sensitive areas map and then the...Buss ...Lepic property and
ravine .... (refers to overhead map) is on the sensitive areas
map.
Kubby/ .... new rules of the game might apply...
Franklin/ If they didn't develop it before that is adopted, yes.
Kubby/ Which could make this whole thing look different.
Franklin/ Some of the practicalities are going to make it look
different (refers to overhead map).
Kubby/ .... How much is appropriate to consider Linda's advice of if
RS-5 and RS-8 feels appropriate to us .... do we avoid
litigation°
Franklin/ You do have to have six votes out of seven on the Jensen
Tract ....

Kubby/ At .one point in the past it was stated that if you do
anything less than RS-8 there could he litigation and Linda's
advice to us was if you feel comfortable with both, think
about that. I want to hear what people are thinking.
Franklin/ As you move to RS-8 you then lose the support of the
neighborhood I believe.
Horow/ What would you he gaining...?

Pigott/ Avoid the litigation problems...
Kubby/ How strong are people feeling about the difference between
RS-5 and RS-8...? Was this coming together...? I would like
to hear other people's ....
Lehman/ A reduction from RM-44 to RS-8 certainly is a huge
.improvement.
Horow/
Lehman/ Thing that impresses me about the whole thing is this was
worked out privately...
Pigott/ .... I do like the fact that everybody has worked
together ....
Woito/ Aren't the Jensen's in agreement?
Franklin/ Bob Jansen, representing what we call the Jensen Tract,
is not in agreement with this. Their position is still for RS-
8.. Their protest of the RS-5 stands.
Woito/ Why did they get left out of the deal?
Franklin/ There was no movement ..... Wasn't anything in between to
go to.

Knabe/ Larry, it is really a matter of a traffic issue. That
is really the whole issue and has been the issue for 13 years
now. What we are concerned with is the fact we tried to
negotiate with the Jensen Tract. We even approached them about
buying the tract but they quoted us an outrageous price for
it. So we got no cooperation at all. Whereas we were able to
have some cooperation with Mace Braverman and the Ruppert
Family.

Knabe/ We had one meeting when Mr. Ruppert was first represented by
Mr. Houghton...one meeting with the lawyers...no movement at
all. ..... We felt only grounds we could stand on as a
neighborhood was to ask them to go back and reconsider ..... we
ask them is they would reconsider our proposal to use the
ravine as a natural barrier. Mr. Braverman came back with a

proposal-that you presently have before you .... everyone
seemed to be receptive to.
Baker/ Difference between RS-5 and RS-8 is a dramatic difference in
the amount of traffic?
Knabe/ Dramatic ....
Woito/ I don't understand. Your earlier concerns was from traffic
coming up through that entire area on western portion of
Ruppert Tract including what is now CC-2...RS-5. There is no
traffic there now. It will all be coming out to Highway 1.
Knabe/ That is correct only about the commercial property ....
concern was...counting on RS-8 for Jensen Property...RS-8 for
Ruppert Tract .... You are correct that the east part would come
to Highway i but that is the beauty of the negotiated
agreement.
Woito/ It also mitigates against your prior argument. The traffic
isn't there.
Knabe/ No...only way out...down Hatlocke Street. .... out of that
area ..... Only thing...if we have Jensen Tract at RS-5
...ravine does cover a fair portion of that property and then
we get the 8-10 maximum houses in terms of west side of ravine
here...
Baker/ If your choice is between RS-8 and RM-44 now, would you
prefer to be left alone.
Knabe/ ..... Our preference-we would view RS-8 as the equivalent of
an RM-44. We would not be happy with that arrangement at all
..~.We are trying to preserve this part of the neighborhood
Woito/ You have gotten a lot out of the deal the past few months.
Baker/ .... View RS-8 as a dramatic reduction on part of present
property owners .... .
Knabe/ Figure economically the price on that piece of property then
it doesn't negate the particular gain they would make as

system that we have right there...and undue burden on our
neighborhood.

piece of property ought to be RS-5 any way you look at it ....

Franklin/ Usually P/Z Commission considers rezonings at two
meetings. They decided to deal with this at just one and Sally
-was opposed.to that.

Public hearing on a resolution to annex an 80 acre tract of
land, for a project known as the Green View Manufactured
Housing Park, located southeast of Sycamore Street and east of
the Pleasant Valley Golf Course. (ANN94-0007)
Franklin/ Combine that with the item to consider a resolution and
then the p.h. on the rezoning and the first reading of the
ordinance. We sent you a number of pieces of information ....
water revenue...comparison of housing costs for stick built
and manufactured housing .... contract which is a CDBG contract
.... between the City and Bob and Erma Wolf. Highlights of that
...standard contract .... money is to go towards acquisition of
approximately 80 acres .... Wolfs will provide 20,880 months of
subsidized rent on minimum 116 pads that are to be scattered
.... priorities to households to be relocated from the flood
plain and then to low income households under 80% low median
income .... this is a draft. We will talk about procedure at
end of discussion. Next two things are A.3. and B. A.3.
speaks to rules .... lease terms that would be reviewed by the
city .... likewise for the design of the project. The design is
the responsibility of the subrecipient but it has to be
subject to thewritten concurrence of the city .... . resolution
of the council approving the design.
Kubby/ Under A.3. that is where siding, decks ....
Franklin/ Those would be enumerated in the regulations that the
Wolfs will put together ...... have a similar .set of
requlations for Green View that would indicate to the
potential tenant what the expectations are of the owners for
units as well as behavior.
Kubby/ Some of those issues can be interpreted as affordability
issues ......
Franklin/ If those are critical to your decision as opposed to

Franklin/ Offer has been made of six rental units. That is what Bob
and Erma can commit to ..... what they would be obligated to
do .... reason...they will need to purchase those units in
order for them to be rented .... investment of $200,000
potentially ..... Are the six units unacceptable?
Kubby/ I thinkwe should get back to that. There are larger issue
than ~hat.
Baker'/ Primary issue are site, cost, infrastructure .... location.
Kubby/ And housing costs.
Baker/ W"nether or not if these are affordable-
Kubby/ And who you want to serve .... ? Who is it that we want to
serve with these public moneys .... ?
Pigott/ I think you start with the proposal in front of us ..... We
have to talk about location...
Throg/ Three issues .... These three make me strongly inclined not to
support the project ..... need to listen to conversation.
Three...flood plain, efficient use.of public services, and
bang for the buck ..... flood plain-meaning the connection to
relocating people out of the flood plain at Baculus and
Thatcher Parks....2- Has to do with distance of this
development from the existing built up portion of the city and
the implications for efficient use of public services. 3- has
to do with the large subsidy in the way of Road Use Funds for
providing access .....

million..for providing access

Horow/ In terms of using that money and federal money, how does
that-
Baker/...would you be comfortable with using flood relief money for
this project.
Throg/ We can discuss that ..... flood plain...looking back at
January meetings we had in executive session...remember... us
being presented with a real good suggestion to buy out flood
plain in Baculus and Thatcher Parks .... and compel people to
relocate from there. That for me created a very strong ethical
need.to provide a relocation site...Some where a long the
line...possibility of buying out the flood plain land went
away ....
Franklin/ Goes back to...July 1993 .... first flood allocation CDBG
moneys and the council decided to allocate money for
acquisition of land for manufactured housing development
because it came apparent to us that some of the people who
were most affected by the flood were people who were living in
manufactured housing in the flood plain.
Throg/ Still that connection between buying out land in the flood
plain and development of park ....
Franklin/ That came afterwards with the second allocation which was
in July 19~4 .... talked about buying out both of those mobile
home parks that were in the flood plain but the federal money
requires that it be a voluntary buy out ..... We have one...
Thatcher ...... Throughout the discussions .... it has been my
impression and rest of staff's impression that we were'in sync
with the council in that there was a desire not only to
provide a relocation opportunity for the people who lived in
the flood plain but to take advantage of an opportunity to
pr6vide additional affordable units for some segment of the
population ..... Going to provide through this effort a housing
opportunity that was not available in Iowa City right now ....

Franklin/ When we talked initially, we had no location. We did not
have a location until last June and it was not made public
until August ..... number of places throughout the community
where we looked. And if any of you can find a better location,
please let me know.

Franklin/ ...we have never identified...that we wanted 80 acres of
manufactured housing.

Franklin/ It was available, it was for sale, it was priced okay and
that is the 80 came to...Doesn't need to be 80.
Throg/ For my own part, I was not pri%,~ to the July 1993 meeting
.... What I was aware of in January 1994 was a strong linkage
between vacating land in the flood plain and providing
opportunities for relocation of trailers or people ..... impose
very strong ethical responsibility. When that ended to
relocate people out of the flood plain went away .... in the
sense that we weren't going to be buying land and
thereby...compelling people to-
Franklin/ Is it still however a goal of the council to have
opportunities for people to move out of the flood plain
because it is not a good idea to live in the flood plain.
Throg/ I have no disagreement with that. But-
Franklin/ I am just trying to get straight with where you guys are
going to.
Throg/ ....
Franklin/ ...Until we buy it and have it in public ownership, there
are no quarantees .... If we are going to use federal money for
buy out,. it has to be voluntary. You can always make the
choice...to condemn and use local money...
Lehman/ ..... To me...larger issue...we don't have enough affordable
housing .... definite need .... a way of facilitating
construction of pads for manufactured housing that would be
more affordable.....availabillty of places to park
manufactured homes which we Just didn't have .... difference in
.cost between living in a manufactured home and the average
stick built home is like double.
Kubby/ You were looking at figures of new construction of stick
built .....

relative term .... certainly would serve a segment of the
population .....
Baker/ Helps those people who I consider working low income..~..
Throg/ Raises questions about land use for me....has to do with the
fact that Green View is an island south of the'existing built
up portion of the city which means that we would have to
extend police, fire and public transit to that area in order
to adequately serve people who live there and if we don't do
that we wouldn't be filling our responsibilities .....
Baker/ .... demand for transit will also be phased in .... It is a
long term obligation to provide transit.....

Horow/ We have the ability to change or alter those routes.
Kubby/ .... I would like to show you something. I made a map (refers
to. map) ...notice...look at area south of Highway 6 and east
of the river ..... large land marks in the coI~nunity....I have
marked where the current RFBH zones are ...... took recent
affordable housing projects and marked some of them on the
map .... Sycamore View ..... public housing new construction...
Whispering Meadows .... list of our public housing...29 out of
82...south of Highway 6 .... Greater Iowa City Housing
Fellowship who has 18 total units .... Villa Garden .... tax
abatement for Press Citizen building...majority of things that
we have termed affordable housing that have been done by
either city or by non-profit groups have been in this area
..... I want us to talk about it in terms of some of the last
five years initiative for affordable housing ..... concentrated
Baker/ ...manufactured housing, what are our options for location.
Lehman/ Staff has indicated. o.matter of land costs.... topography
is terribly important...has to be flat ....

Lehman/ I think we have made a very effort to locate affordable

date. We extend the date. The August 95 date was the
date that was the culmination of our agreement. We talked to
the people-at HUD and we extend that date. They had to
have their money out of the--~fficebya certain time. But we
could potentially get an extension.

Milkman/ It is slightly more complicated than that. We have two
sets of flood money. Part of this money is coming out of the
first set of flood money. The other part for acquisition will
be coming out of the Flood II money , we call it Flood I and
Flood II. For Flood I we can get an extension, reasonable
extension for committing the money and spending it. For Flood
II we have to have the money committed with a legal agreement
by September of '95 .... Flood II is going to be more than...We
have $820,000 in there right now for land acquisition but that
included other possibilities for buying flood plainland. Flood
I right now has $280,000 in it however rehab and excavation
costs have been much higher than anticipated and I don't think
we will have more than $100,000 left in Flood I for
acquisition.

one person is $19,000. Three people is $25,000. And so 80%- We
are n6t serving the people that are currently in mobile home
parks .... the income of the people that we are serving is
higher if' we stay at 80% ..... event to 60% median income ....

parks with older units .....
Kubby/ I look at'some of these figures...then prices of homes and
looking at...65% median income for a family of...one..... They
couldn't afford the $35,000 trailer .... they couldn't afford
the s.f. home built between 1993-94 ..... they could Just $10,
barely afford the $20,000 unit and they can't afford a three
bedroom apartment at fair market rent of $737 month. So ....
when you are looking at City S~eps .... looking at people's
incomes, they can't afford to live at Green View with looking

together the expenditures on Housing Affordability Programs

$1,266,000 for very low and low income and $104,000 for low
income. So the figures show that in fact we have spent
proportionately much more on extremely low and very low income
as was the direction of the CHAS.
