CONSIDER A RESOLUTION AMENDING THE CITY OF IOWA CITY COMMERCIAL DRIVER'S LICENSE SUBSTANCE ABUSE PREVENTION PROGRAM FOR DRUGS AND ALCOHOL Comment: Due to changes in City positions, Appendix C of the Commercial Driver's License (CDL) Program has been updated to accurately reflect the safety sensitive positions subject to the CDL Program. Appendix D has been updated to add the name of a local Substance Abuse Professional. This resolution replaces these Appendices in the CDL Program approved by Council on October 14, 2003. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING THREE MORTGAGES FOR THE PROPERTY LOCATED AT 2235 RUSSELL DRIVE, IOWA CITY, IOWA. Comment: The owners of the property located at 2235 Russell Drive received assistance through the City of Iowa City's Housing Rehabilitation Program and the Downpayment Assistance Program in the total amount of $8,218.77. The loans have been paid off; thus the liens need to be released. e. Correspondence. 1. PLANNING AND ZONING MATTERS. a) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 2 ON AN ORDINANCE CHANGING THE ZONING DESIGNATION FROM 1-1, GENERAL INDUSTRIAL, TO CC-2, COMMUNITY COMMERCIAL, FOR 0.33 ACRES OF PROPERTY LOCATED AT 611 HOLLYWOOD BOULEVARD (REZ04-00022) Comment: At its October 7 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. This rezoning will make the zoning of 611 Hollywood Boulevard consistent with the rest of the commercial properties along Highway 6 in this area. Staff recommended approval in a report dated September 15. Action: ~~/6J7Y ~aif~ b4 - 31) ~ b) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF GENERAL QUARTERS, IOWA CITY, IOWA (SUB04-00012) Comment: At its October 7 meeting, by a vote of 7-0, the Planning and Zoning Commission recommend approval, subject to approval of legal papers and construction plans prior to Council consideration. Legal papers and construction plans are approved. This will allow a 29 lot single family subdivision on the east side of Sycamore Street, south of Stanwyck Drive. Staff recommended approval in a report dated October 7. Construction plans are approved; legal papers are anticipated to be approved by October 19. This will allow a three lot residential subdivision at 211 Myrtle Avenue. DECLARING THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE SOUTH SYCAMORE SANITARY TRUNK SEWER EXTENSION PROJECT. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the South Sycamore Sanitary Sewer Extension Project. This public hearing provides interested parties the opportunity to present their views on the project and the proposed acquisition of property rights. APPROVING PLANS, SPECIFICATIONS, SPECIAL PROVISIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CAMP CARDINAL ROAD SITE PREPARATION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will remove the trees necessary to construct the Camp Cardinal Road Project. The tree removal is required to occur prior to bidding of the road construction to avoid the potential of disturbing Indiana Bat habitat during nesting season. This project is a joint project with the City of Coralville and Southgate Development. The estimated construction cost $ 195,000 of which the City will contribute $ 106,000. APPROVING THE FIRST AMENDED NEAR SOUTHSIDE RESIDENTIAL URBAN REVITALIZATION PLAN Comment: In December 1994 the City Council approved the creation of the Near Souths ide Residential Urban Revitalization Plan (the "Plan") as a tool to encourage the redevelopment of property south of Burlington Street. The original Plan had a ten-year sunset, which will cause the Plan to expire on December 13, 2004. The amendment to the Plan will extend the life of the Plan for an additional ten years to December 31, 2014. CONSIDER AN ORDINANCE AMENDING CHAPTERS 5 AND 6 OF CITY CODE TITLE 14 TO PROVIDE UPDATED REFERENCES TO SECTIONS IN THE UNIFORM CODE THAT THE CITY RECENTLY ADOPTED AS ITS BUILDING CODE. (FIRST CONSIDERATION) Comment: In Ordinance No. 04-4117, the City adopted the International Building Code (IBC), along with certain local amendments, for its Building Code. The prior code adopted by the City was the Uniform Building Code (UBC). The City Code still includes a few references to the UBC instead of the equivalent section of the IBC. This ordinance simply amends those outdated references to the UBC so that references are now to the correct section of the IBC. Action: I~/ / @ ',I) /..Yf- c:.- t/ ~ _ 7/?J ~ ~/1 / ITEM 11. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY 04 - .;Lq~ OF IOWA CITY AND THE ARTIST FOR THE NORTHSIDE NEIGHBORHOOD ART PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE SAME. Comment: The City Council of Iowa city approved the general concept of the Northside Neighborhood Art proposal at their meeting of July 6, 2004 by adopting Resolution No. 04-190. The specifics of the contract have been negotiated with the artist and City Council is requested to authorize the contract. [Correspondence included in Council packet]. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE o4-~q4 MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE OAKLAND CEMETERY SEWER SEPARATION PROJECT. Comment: Bids for this project were opened on Tuesday, October 12th and the following bids were received: Tschiggfrie Excavating Co. Dubuque, IA $ 53,988.10 Carter Kirkpatrick Services North Liberty, IA $ 56,443.00 Maxwell Construction Iowa City, IA $ 61,181.00 Bockenstedt Excavating Iowa City, IA $ 63,999.00 Engineer's Estimate $ 64,000.00 Public Works and Engineering recommend award of the contract to Tschiggfrie Excavating Company of Dubuque, Iowa. CONSIDER A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT 04 -,;(q.5 FOR LIBRARY SERVICES TO RURAL JOHNSON COUNTY. Comment: This agreement authorizes the City of Iowa City and the Iowa City Library Board of Trustees to provide library services to residents of rural Johnson County, subject to the compensation and other provisions in the agreement. The duration of the agreement is one year, with yearly options to renew. The agreement also provides that one member of the Library Board of Trustees shall be a resident of the unincorporated area of Johnson County, appointed by the Mayor of Iowa City, with the approval of the Johnson County Board of Supervisors.
