I really didn't plan a specific presentation .... answer questions...recall last year was the first time we put a three year plan together. Here is an updated three year plan ....... One significant differenoe...area of aquatics... needed to raise the swimming fees this year .... Survey was conducted...we were fairly low as far as our daily admission fee .... punch cards and passes...those are being proposed for an increase in FY96 as well ..... We have proposal...Commission adopted this .... one proposal...offer a three month pass... eliminating a su~mmer pass ..... takes a place of a summer pass ...... three month pass and 12 month are good fromthe date of purchase .... Horow/ Calls for you to have a good explanation in the brochure as to what this means, right? Trueblood/ Right. Baker/ You are not saying you are going to raise fees just because we are low compared to somebody else? Trueblood/ That is one reason .... low compared to a state wide survey ..... have self imposed goal of.~eeting 45% of our budget with non-property tax revenues... Nov/ And the water price has been going up .... Trueblood/ That does play a part in it. Kubby/ The adult annual pass is going up $31. That is a big hike Trueblood/ It is predicated on what we charge for daily admissions ...... Kubby/ Seems like a lot at once .... too much of a jump... Trueblood/ There was quite a bit of discussion at the staff level ..... Yes .... it can certainly be modified .... budget is based upon the revenues generated .... Kubby/ Trueblood/ The summer pass is higher cost than the annual pass because far more swimmers utilize the facility much more in the summer time ..... annual pass...three times a week during the summer and once a week during the remainder of the year .... base three month pass on. the summer rate ...... One Commissioner supported...summer pass lower than what it is .... decided to not lower that rate. Nov/ Three month pass is half the price of the one year pass .... Trueblood/ Passed on summer pass rates...more people utilize more pools during the summer time ..... three month rate...people will need to pay equivalent to what the current su~er rate is or would be ..... Baker/ Goal or policy of trying to achieve 45% non-property tax revenue. How long has that been policy...? Trueblood/ Policy probably for 6, 7, maybe 8 years now and we come very close every year .... get us at 44.63%. Kubby/ Question about the SPI Programs...cost of those seems to be going up much more slowly .... Why...? Trueblood/ Traditionally the $PI Programs have been lower priced .... bring in line .... quite a few of participants... are actually adults on a limited income .... When it was established .... we are slowly raising them... tradition... income... Kubby/ Statement...family breaks on prices .... swim pass .... defines family ..... I would like P/R Commission....Domestic Partnership, that you should get those same benefits ..... Throg/ Have you looked at a way...so fee increase would not be necessary..... Trueblood/ Try to do that routinely .... quite a few of costs are things we really can't control ..... material costs ..... other areas we look at...try to make our adult programs self supporting ...... target youth programs...§0% self supporting ...... direct cost to operate the program .... Also have to think in terms of the many temporary staff that we hire... wages don~t go up nearly as fast.....keep costs down.... Horow/ Okay. Trueblood/ We also do have our low income still intact. Public hearing on an amendment of the Comprehensive Plan to change the land use map designation of property located on the north side of Highway 1 West from 8-16 dwelling units per acre and 16-24 dwelling units per acre to 2-8 dwelling units per acre and general commercial. Franklin/ ...Items a. through 1 .... deal with Harlocke/Weeber area rezoning. Like to do first...Dee Vanderhoef is here, Chair of P/R Commission...also on the subcommittee that is working on the implementation of the Neighborhood Open Space Plan. They have looked at this area and have a concept to propose for open space in this area. Like to have her present that and then we can get into some ~f the grit of the zoning. Dee Vanderhoef/ Thank you .... interested in this area .... park land .... sketch of what we can vision for this area..... Vision that we put on this is no way set in stone... with a proposed downzoning that is before you now...process of going from about 6.95 acres of deficit park land in the area...down to · ..4.65 is what the zoning group re-figured for us. That changes our initial plan that was in the Neighborhood Open Space ..... down to one park...and trail...to connect... Harlocke/Weeber Neighborhood and .... Miller/Orchard Neighborhood (refers to sketch/map) ....... two property owners have indicated a possibility of donation of land .... This is where we Would like to have the flat land for a neighborhood park .... Have two neighborhoods connected .... Nov/ Vanderhoef/ That is our sketchy plan;..want land in here...want a trail in here and we ill be happy to work with all the people involved. Horow/ Thank you very much. Franklin/ .... when the residential area at corner of Miller and Benton came in for approval...an area where we would require dedication of land and we may need to purchase some additional land .... money...would come from the in lieu of fees exacted from the development on the Jensen Tract and west portion of the Ruppert Tract...depends upon how the zoning finally turns out ..... Having a lot of trouble imaging what that park might really be Franklin/ We are a little premature here in talking about how the open' space is going to be configured .... They did go to the work of thinking about that. Kubby/ (Can't hear). Franklin/ ..... Envisioning what was there .... topographic relief... becomes gentler as you proceed east .... work the gentler part of that into what the Buss's andMr. Lepic have indicated that they would contribute...look at when that property comes in for development .... conceivable to do it...deal with-these zoning issues first. HOrOW/ Franklin/ Very much generalized at this point in time. Let's go to the comp plan part of this. First step is for you all to resolve what you believe are the appropriate general land use designation is for this area ...... What is before you now is a change from 8-16 dwelling units per acre and 16-24 dwelling units per acre to 208 and commercial. It is the 16-24 .... that is going to 2-8 ...... The 8-16 is what would be changed to c0m~ercial. And that is the first Dart of this to consider ..... And the concept is basically to extend more commercial 'development on the north side of Highway i and to diminish the development potential for residential in that part that is west of the ravine and north into the Jensen Tract. That is the general concept ...... Kubby/ ...Westport Plaza..there was some concern about commercial along Highway 1 .... this would just be kind of perpetuating that ....... Horow/ It' is the general land use perspective that we are talking about.... Throg/ This side of the Ruppert Tract is best used for commercially ..... matter of access and design ....... Very comfortable with the idea of that portion being zoned commercial .... Franklin/ This is a rough map. The idea is that it is east of the ravine~ .... designated co~mmercial. The ravine...logical break point. Decisions tomorrow night are whether you are going to vote on that comp plan change or not. Three developments since the last time we talked about rezoning. We do not have a signed conditional zoning agreement for the Rupperts. There are reservations about the.content of the negotiations that were presented to you the last round ..... my understanding is an appraisal was done in which it revealed the value of the land from P44-44 to CC-2 would be diminished .... reservations about accepting the extent of the CC-2 or the residential zoning on the corner of Miller and Benton .... resolutions ...extend commercial to the west property line of the Rupperts, past the ravine; to change the RS-5 to CC-2. Kubby/ Franklin/ To upzone the corner of Benton and Miller to get additional density there to compensate them for the change from RM-44 to CC-2 ..... difference in the value is $851,000. At this point, the RS-5 here (refers to map). If the rest of it is to remain the same, the Rupperts do not find this acceptable. If the RS-5 is to remain as it is, then the suggestion is is that the zoning-at Miller/Benton corner be increased in density. Crux of that is the agreement that we thought we had before, we no longer have. You also received a letter fromMr. Jansen that indicates that he representing the Jensen Tract owners would be amenable to a conditional zoning protecting the ravine if the zoning is RS-8. The third thing that you have received is a memo from Linda Woito re: the defensibility of a downzoning to'RS-5 as distinct from RS-8. I will let Linda address that particular issue. Woito/ Not a whole lot has changed since my prior memo to you in July ...... seems to have fallen apart. Bill Meatdon called me today and he has been contacted by the Rupperts and so we have yet another lawyer involved .... concerned about is based on the hum%bets that we have extrapolated from Jim Brachtel and Jeff Davidson there is not sufficient evidence for us to say that RS-§ is safe for Hatlocke and RS-8 is dangerous. Council Work Session Page 7 Kubby/.The difference in the traffic count between RS-§ and RS-8 is 29% above the guidelines .... Woito/ Not according to Jeff Davidson...that 500 is a mid-range between I and 1,000 and it is something that we have used~.. guideline that Jeff has used .... can't say that RS-8 is dangerous and RS-§ is safe. Franklin/ ...we have in the comp plan a design capacity listed for local streets which is 0 to 100,000 average daily trips ..... 0 to 1,000 average daily trips .... What we look at in making deoisions...street design is usually an average of 500. Issue is if we were to go to court on this and anyone'of us was to take a stand and say do these counts meet our design standards and our design capacity for local streets, we would have to say tha~ existing volume as well as the projected volume are within the design capacities that we have for local streets. And that between the RS-8 zoning...and RS-5 zonings...it doesn't take you beyond those design capacities.....it is Within the realm of what has been judged .as safe for local streets and this doesn't look at the particulars o~ any situation......What has been put before you is. a zoning decision based on the amount of traffic that would come through the neighborhood and'what is being said. .... what they would be able to defend .... we could not make that big of distinction in terms of the number. of vehicles per day between RS-5 and RS-8 in relation to our design capacity. Kubby/'.... Woito~ Kubby/ .... Throg/ Moot anyhow because the Rupperts have chosen not to continue with what we understood. Horow/ Franklin/ It might be useful to move this thing along to some degree of.closure. At least the council votes on the comp plan land use designations so that we k~ow from a pol$cy perspective what you are outlining for this area as the proper zoning ..... Right now you don't have the protection of the ravines that you want. Tom is here...good to get some input from him ..... the ravine is an issue enough with the Commission that they would want to'have this back, Baker/ You are' advocating going ahead and approve the changes in the comp plan. But once we do that we have a comp plan that .says one thing and the underlying zone that contradicts. Franklin/ You have that now. Nov/ The contradiction has'been there for awhile and we are tryihg to clear it. Horow! Tom Scott/ ...Commission had serious problems with the ravine being ihcluded ih CC-2..~... At the Commission level we tried...to tighten that language..zremain in its natural state as it is today...,. If in fact the agreement is null and void because it is not signed bythe Ruppert family prior to closure of the p.h., I really think the Commission would like to revision the western tract of the Ruppert Property including the ravine ...... Jensens... open to conditional zoning agreement ... attractive to the Commission. Kubby/ Scott/ ...my only concern would be .... present proposal for the comp plan revision...if in fact that would include commercial over to the ravine and through the r~vi. ne or if in fact the zoning ..... CC-2 line would be backe'd off .... Franklin/ I don't think it matters what side of the ravine the line is on for the zoning. The important concept is the ravine is a natural demarkation for changing land use and whether the zoned boundary is on the eats of the ravine or on the west of the ravine has more to do with the preservation of it. Safe to say you are probably not going to get a signed conditional zoning agreement on-this property with anything that we have talked about so far. Kubby/_It is an opportunity ..... Horow/ At some point council has to make that decision J~st exactly what the end product is. scott/ ...on the proposed commercial, on that north tract that was part of the agreement. I think if in fact the CZA iS null a~d void, the Commission may look differently at that area a~so. Kubby/ What does that do to the comp plan vote? Franklin/ Nothing. There is already commercial extended along Highway .6 on that north side. The 1.5 acres there that is under consideration from RS-8 to CC-2 is really incons~quential in terms of the comp plan. Horow/ Move on-. Throg~ I'want to say something...I would think the owners of the land would have a strong incentive to take. the initiate to organize meetings with the other owners who'are affected by this'whole complex of'issues ...... ahd with the neighborhood in order to further their o~ interests and I would strongly encourage that. Public hearing on a resolution to annex an 80 acre tract of land, for a project known as the Green View Manufactured Housing Park, located southeast of Sycamore Street and east of the Pleasant Valley Golf Course. (ANN94-0007) Franklin/ Tom is here also .... not representing the C0~mission as the Commission in consultation with the council on either Green View or Lake Calvin. Depending upon which direction you choose to go on either of these two, you may have to have a consultation with the Commission. One way to do that .... is for you to take your initial votes ..... Green View~ you have an annexation and a rezoning..You can vote on the annexation which will only take:a'four vote majority. You can then vote on the rezoning assuming the annexation is positive. Because the rezoning requires 6, that is going to be harder to get'a positive. If that vote then is in the negative on the rezoning, I guess what I would suggest...is that at that point we will then know that the council is not in sync with the Commission. Baker/Are you saying you can annex, fezone with a majority, until you get to the third vote with a extraordinary mojority, it doesn't die the first time because (can't hear)? Franklin/ It does die. Woito/ It dies with any sufficient vote'whether it is first, second or third. Kubby/ ..... defer...so we can meet with P/Z which is our policy .... If we want to follow our process... Franklin/ You are right, it. does 'die .... We will have to defer if there is not. Let's get to the meat of the matter .... Baker/ (Can't hear). Franklin/ I am going to talk about the amended contract, the county land swap, the road costs, the land choices and then if you want to talk about the alternative uses of the flood money. T~e amended contract, in response to the council's concerns about .... the income level that was being served by this project. We gave you a revised contract which indicated that in the park there would be an obligation to provide 20 rental units over the time of build out of the park ..... Thisis an up front cost to Mr. Wolf to buy those units and then of course pads are. rented at the subsidized value. Entry income level for people who would be renting the rental units would be 50% of median or less ..... CF~NGE TAPE TO REEL 95-16 SIDE 2 ...... for the r~mainder of t~e 166 pads that are subsidized through this project. .116 minus 20. The entry income level would be 65% of median...would be able to increase their income and still have their subsidy up to 80% of median.'When any became higher than 80% of median, the rent structure on the pad would change to market rent .... Kubby/ Wolf/ (Can't hear). Kubby/ The answer is yes. Nov/ Back to the change of income ..... as soon as you get to 60%, do you have to move out? Franklin/ No. The idea was to allow people to increase t~ei~ income and not have to move .... up to 80% median. Then the rent structure ~ould change...market rate ....... Nov/ I am talking about a mobile home unit. Franklin/ There will be 20 rental units tops unless .... units have to be purchased by the Wolfs ..... Nov/ And the rent would go up on those units, however the person living there would not be forced tb move out? ' Franklin/ That is correct. Once you are not 50% of median, you' no longer qualify for Section 8. You still have the subsidized pad rent when you are above 50% median but below 80% .... have to pay the regular rent. for the unit. Lehman/ Franklin/ No, you don't have 20 unite that are below but you have got 20 rental units. At some point we would expert there would be turn over....anybody who comes in has to be at 50 or lower. And it is not like there is necessarily going to'be this swell in income that we are going to have this kind of turnover as the norm. But it is to have that opportunity....not locking them in .... to stay there in order to get the subsidy. Nov/ We'are keeping the median at whatever it is at each current year? Franklin/ Yes. Horow/ Anybody have any questions for Earin on this? Franklin/ We. investigated the land exchange with the county. I think you have the letter back from Charlie that indicates there is not support for that arrangement. So that site as an option is out. Kubby/ Can you go back ...t~'the change in the agreement .... about the city ~eviewing and getting written approval for al~ the rules, regs and requirements .... so that would include everything? Franklin/ Yes.. That would be decided at some future date but with this body~ Kubby/ If we say no to a rule. We negotiate all the rules. Franklin/ Right. We understood that that' was your desire to have that rule. Likewise the design of the. project goes to the P/Z Co~ission and city council. Okay? Page 15 Franklin/ It is not exactly plat review. It is a plan. there is not subdivision of land with this project. It will be owned by one entity...t~e layout. What this overhead is (refers to overhead projector) breakdown of-looking at concern of the investment that was being made by the city at the outset of this project. And what this is suggesting that we would build Sycamore Street Extended in phases. Phase I would come to...high point of the development (refers to-map) .... 76 contour line on the road ...... just south of the first entry road that this part of the project...northerly part Would be Phase I. This road would be built to the standard that was used (refer~ to map) .It would go into a park road for an interim period of time...only traffic that this road would serve...park road is considerably less .... $40 per linear foot .... The $317 per linear foot is a concrete road probably 31. feet of paving, curb and gutter, storm sewer, 8 foot sidewalk, standard street-collector.. Baker/ (can't.hear). Franklin/ That is from Sycamore L, yes the top, d6wn to that first entry road. Then from that high point .... south and through the park to the soccer .fields, the $40 per linear foot.is. a rural cross section...crown is up .... down to ditches on the side...drainage ditches along the side and chip seal. That road you have to completely reconstruct to then put in the concrete road, the is Phase II and Phase III. Phase I gets us about $172-units according to the design we are working with now ..... can vary...172 units is a 3-5 year build out depending upon how quickly or slowly they go .... That initial cost of $424,000 would be for approximately three years, maybe five, before we had any additional costs for roadway to allow the c6ntinuation of Green View Manufactured Housing Park. Baker/ (Can't hear). Franklin/ It would be possible but I wouldn't recommend it.
