a. Consider setting a public hearing for March 28, 1995, on an
ordinance establishing the Moffitt Cottage Historic District
for property located between Muscatins Avenue and Ralston
Creek, north of Court Street.

Throg/ Have all five property owners been contacted?
Miklo/ Yes, all property owners have been notified ....
Public hearing on an ordinance conditionally amending the use
regulations of approximately 13.09 acres located at 655 Meadow
street from RM-12, Low Density Multi-Family Residential, and
RS-5, Low Density Single-Family Residential, to RS-8, Medium
Density single-Family Residential. (REZ94-0020)
Miklo/ West of Dover Street and north of Muscatine Avenue.
Kubby/ I have a bunch of questions ....
Miklo/ Property is currently zoned RM-12 (refers to overhead)...
Proposal to fezone it to R$-8....neighbors have submitted a
successful protest petition so 6/7 council members are
necessary for this.
Throg/ Were all of those protests from property owners within 200
feet?
Miklo/ ...no...enough of them were within 200 feet .... This was
recommended for approval by the Commission...also by city
staff.
Kubby/ What would the number of lots be allowed in that current
zoning?
Miklo/ ..... the RM-12 zone which is multi family would allow 150
some .... It requires 2,725 square feet per lot area per

dwelling unit versus the 4,350 required for duplexes under the
RS-8.
Throg/ I am not entirely clear about the history of secondary
access ..... Why no secondary access was provided to that site
in earlier development decisions ....
Miklo/ There was some discussion .... Apparently ...cemetery...city
did not require it .... A certain point we would be concerned
about providing secondary access .... Under proposed rezoning
of RS-8 ..... 72 units..at our threshold of 500 vehicles trips
per day...se¢ondary access if not needed .... Al%ything above
that would require secondary access...
Kubby/Another standard that is used is number of lots ..... 29 lots
is the cut off ..... Make sure we are being consistent ....
Miklo/ First and Rochester has over 100 dwelling units on ..... one
point of access ..... under 500 vehicle trips per day policy
that is about 70 s.f. lots of 35 duplexed lots .....
Baker/
Miklo/ Could be developed at a higher density under RS-8 ....
Applicant did submit a concept plan which shows approximately
72 units ....
Baker/
Throg/ We also have a loose criteria that says we don't want more
than about 1,000 cars per day on local roads .... currently
estimated counts for Dover Street are somewhere around 700.
Miklo/ 680 approximately.
Throg/ ...say we really want to put more than 300 vehicles per day
on Dover Street given that 1,000.
Miklo/ our Traffic Engineer and also our Transportation Planner
· ..we do have a guide in comp plan that says it is desirable
to limit local streets to 1,000 trips per day. This
development would result in Dover Street exceeding that .....
Felt because there were two means of access .... national
standards call for up to 1500 vehicle trips per day...
Transportation Planner also pointed out...Dover...serves as a
collector street .... It is not ideal to have 1200 vehicles per
day on Dover Street but it is acceptable ....

Throg/ Points that Donald L. Green makes in his petition about
hazardous driving conditions .... worsened by addition of 500
Oars... I think there is some cause for concern ....
Baker/ .... Still have potential for greater traffic problem ....
Kubby/ ...maybe we can try to push that number lower .... number of
lots would be decreased ....
Nov/ 13 X 8, you got your 104 units .... under the allowable density.
Throg/
Kubby/ .... Glad we are going lower...dedication of flood plain land
~..connection between parcels...all beautiful things about the
project...concern about the street, the grade and the
windiness.
Throg/ Access.to the north is not possible. Nor to the west .... Is
there no way to provide secondary access south ....
Miklo/ It would require purchasing property from the funeral home
or purchasing an existing residences...
Throg/
Miklo/ I did ask Jim Brachtel, Traffic Engineer, about this
particular concern...curve and potential intersection .... he
said it is not idea but he was not concerned that this
development of and in itself would be unduly unsafe situation.
Pigott'/ What about .... fire vehicles .... worried about big fire
trucks trying to get around the curve .... is that a big
concern?
Miklo/ We did bring this to the attention of the Fire
Department .... they were not concerned...I could check ... I
will check. '
Throg/ Has the property owner investigated the possibility of
purchasing land near Gay's Funeral Home property to provide
secondary access to the south?
Miklo/ Not that I know of.

Kubby/ ...There is this memo from Jeff Davidson, October '92 is the
date .... looking at the secondary access policy...page 3
.... "shall be defined ..... ,, .... gray areas of going over the
threshold .... when can we go over them .....
Miklo/ We aren't going over the threshold for secondary access
..... We are exceeding our threshold for amount of traffic on
a local street.
Woito/ These policies weren't really adopted bythe council .... just
decided and there was not agreement .... a lot of controversy.
Miklo/ It was decided. I think it is in the proceeding memo that
staff could use these as guidelines...weren,t incorporated
· into the subdivision regulations.
Woito/ They weren't really adopted by the former council.
Kubby/ Do we have any guidelines about secondary access in terms of
the grade of the slope?
Woito/ I think this is the closest that you ever got to a policy.
Kubby/ So, in a letter...guideline 8%. Is that correct?
Miklo/ There is in the policies or guidelines that we are
using...when a grade exceeds 8% then we would look at a means
for a secondary access for emergency vehicles.
Kubby/ And what is the grade at Dover there...?
Miklo/ ..... 6-7%.
Kubby/ Grades confuse me ....
Miklo/ That grade would be applied to the new street and not Dover
Street.

Nov/ What is the incline percentage on Jefferson Street or market
Street .... 12-15% .... not that high...?
Kubby/ ...they didn't even meet the 3.5 to 1 .... I think ....
Baker/ The only thing that prevents this from becoming developed at
RM-12 now is lack of secondary access.

Miklo/ That is right. Someone could propose developing it at RM-12
today and at some point we would have to say that is too many
units for the amount of access.
Baker/
Kubby/ Decrease in the density of housing that would be theta ....
Throg/ Send a couple of signals...strongly favor the idea of in
fill development .... 2 .... this as a downzoning...good for
neighborhood .... matter of secondary access .... encourage
property owner to investigate that ....

Miklo/ I don't think it has been talked about ..... this meets our
currently guide..lnes...
Baker/ ...why would they want to down zone?
Nov/ If they could get secondary access, they would want to develop
it at RM-12.
Throg/ I don't have any strong opposition to RM-12.

Throg/ For me the biggest concern is traffic on that street .....

Consider a resolution approving the final plat of D&L
Subdivision,- a 6.41 acre, four lot commercial subdivision
located on the south side of Highway i West, west of Sunset
Street. ·
Miklo/ Final plat .... 6.41 aores...four lots...council approved
preliminary plat .... all conditions...have been approved. Both
staff and Commission recommend approval of this item.
Consider a resolution approving the preliminary plat of
Orchard View Estates, a 107 acre, 34 lot residential
subdivision located partially in Fringe Area 4 in Johnson
County south of Dingleberry Road NE, approximately 0.6 mile
east of its intersection with Highway 1.

Miklo/ Preliminary plat...34 lots, 107 acres. It is Fringe Area
4... staff and commission recommended approval... no
conditions recommended on this particular plat.

Consider a letter to the Johnson County Board of Supervisors
recommending approval of the rezoning of a 0.73 acre property
from A1, Rural, to RS, Suburban Residential for property
located in Fringe Area 4 near the southeast corner of Newport
Road and Prairie du Chien Road.
Miklo/ Next ~wo items are conhected...rezoning of just under an
act,...property would also be subdivided into three lots....
reconfigure the property for an additional s.f. residential
lot .... conditions were satisfied ....
Kubby/ When we get our OPDH ordinance done dealing with sensitive
areas...within one mile...versus two mile. Because it is part
of our platting process within the city and other plattiDg
issues go out one mile and that one should as well.
Miklo/ We haven't addressed that .in detail. OPDH regulations are
actually zoning regulations ..... As the ordinance is being
written...continued to be zoning regulations... to apply them
to plats in.the county we would have to negotiate that through
an amendment to the fringe area agreement.
Kubby/ I would like us to be thinking about that .... lots of
important areas within a mile of Iowa City that should be
preserved.
Throg/ Bob, do you happen to know when that next meeting of the
sensitive areas committee is?
Miklo/ I believ~ it is on March 7 ..... City Manager's Conf. Room,
12:00.

Fosse/ Take a momeDt and go over...drainage problem and. some
potential solution and seek some guidance here (refers to map
on overhead) .... years we have had problems with drainage in
this area .... chronic complaints .... water...across waterfront
Drive ..... water shed to the east of the RR tracks...broken
into two areas: 26 acreswhich drains in at this point {refers
to map)...included HyVee .... and 180 acres .... Look at HyVee
site .... look at drainage... HyVee had two choices for storm
water management... on site storage.... other choice is to
provide a 100 year conveyance out to the Iowa River ....
extension of the Iowa River .... HyVee is to pursue this
route... piggy back onto that project .... pay for the
oversizing of storm sewer .... 'remedy problems... $125,000-
140,000 ...... Other two alternatives for solving it ....
{Refers to map) ...... wate~ just sits in the area... Our other
option is when we improve this portion of Waterfront
Drive...large storm sewer...$283,O00...opportunity to piggy
back onto this project...get it done at a lower cost .....
Kubby/ Anyway of relieving problems on Gilbert Street... as well as
further east.

Kubby/ Does that decrease the number of points where storm water
enters...?
Fosse/ Yes ....
Throg/ If we do the blue line...diverting water away from the green
line ....

benefit to this property owner...HyVee .... will be able to
recoup some of those costs from that property owner ....
Throg/ Wondering if there were other property owners who would

Oakland/Grant byway of CDBG/FE~.., will freeup full cost of
that.project...extra moneys within that bond sale .... Make
sure if you are even interested in seeing this done,

Kubby/ ...... taking natural storm run off that helps feed those
wetlands .... too much ....
Fosse/ We will be diverting some of the flow for the wetland here
(refers to map).,,10-15% of the flow that goes down there ....
One other factor.,if we become a player in this,,, public
purpose .... may need to step in-and use our powers of
conde~ation ....

Karr/ This was placed on your agenda as a follow up to the
committee and also to gain some direction from council because
the last time we talked about it it was sort of a skeleton
approach so we wanted to report back before staff proceeded
with any more detail on it.
Throg/ I have one quick reaction. I would very much like to see a
map of the CB-10, 5 and 2 zones showing the areas that would
in fact be eligible for a sidewalk cafe as defined, as
constraint.
Earr/ Of all the potential zones? Sure, okay.
Throg/ .... it is very narrowly constrained ~nd maybe that is good,
maybe that is bad but I would like to see a map.
Kubby/ Other outdoor areas that serve food, like Seasoh's Best,
that is considered an outdoor service area-
Karr/ That is on private property.
Pigott/ Anything on private'property this doesn't-
Karr/ No it does not.
Kubby/ But this 'definition of that entity is an outdoor service
area or what do you call that.
Karr/ That is an outdoor service area because it is on private
property and that definition would not change. What this
proposal does is take from the section of the code dealing
with plaza cafes and the confusion of outdoor service areas
that were not on private property and put them together and
combine them into one.
Kubby/ This definition of restaurant, is it consistent with our
zoning ordinance?
Karr/ It is the definition of restaurant that we use throughout the
code. We made no change in that.
Throg/ .... Why 8 feet instead of 4 feet or some smaller-?

Karr/ 8 feet is what it is currently recommended. The committee
met, we talked about that, that was one of the areas we spent
a great deal of time on. 8 feet was strongly recommended by
the Public Works Department .... 5 feet is the ADA requirement.
We could not go below 5.
Throg/ Why did Public Works recommend 8 so strongly?
Karr/ .... Chuck felt very strongly. Rick was convinced, after
talking to Chuck, how strongly he felt a~ut it .... dealt with
the use of the pedestrian way .... going to be in a commercial
zone where you have 8 feet on either end of it .... flow of
people and the commercial nature of the areas .... 8 feet was
recommended.
Throg/
Woito/ ...When we build public sidewalks, we build them at 8 foot
widths .... that is a standard that they believe in .... maintain
for safety purposes .... free flow of people.
Throg/ The prohibition of having table and chairs in corner areas
and about having them not closer than 10 feet from an alley.
Karr/ Linda, doesn't that have to do with fire and H.I.S
emergency .equipment? A concern that it could easil~"~
extended and not affect an adjoining property-
Arkins/ Vision triangle.
Woito/ So that you would not have obstructions to people's site
from...other portions of the street.
Pigott/ Where does the number come from, 10 feet versus say 5...?
Do we have room to play?
Woito/ You have room to play in all of these numbers. They are
based in some sense on some standard .... you can't below the
5 feet in terms of ADA.
Karr/ Each one of them .... go to council... get some .sense ...go
back to committee... to take back any comments that council
had. We really wanted to get your feelings on it and then take
it back and look at site specific eases ....
Baker/ I have some specific questions .... page 2...weather
permitting. Who permits? This is a judgement of the business,

Baker/ Hours of operation, 8:00 to 9:00.
Karr/ That was arbitrary...we did talk as a com/~ittee about
establishing hours because it was a concern from our Police
Department about enforcement and safety after dark.
Throg/ There certainly should be hours...whether 10:O0 instead of
9:00.
Baker/ Or 7:00 AM-
Karr/ No, we have a little bit of concern from P/R Department for
areas in the city plaza because of maintenance. They maintain
the area...clean up between 7:00 and 8:00 .... if it was setting
up any earlier than 8:00, they thought there could be a real
problem in maintaining that area ..... especially in summer ....
Their crews start at 7:00.
Baker/ ...not that many people are going to take'advantage of this
.... 7:00 to 10:00 seems like a reasonable time...workable.
Kubby/ I like that, too.

the same thing as saying amplified sound shall not be

Karr/ That is how we have enforced it.

music is coming out of the doors.
Karr/ But it is not amplified out. It is flowing out of the doors.

Baker/ Your music is somebody else's noise .... concern about
amplified ~usic imposed on people who don't want it imposed on
them.
Karr/ We do that.on a case by case basis in the pedestrian mall now
with a sound permit.

Karr/ We don't do it in the outdoor service areas even'on private
property now. It is a prohibition there ....
Baker/ .... Concer~ed about the sound being generated somewhere else
and piped out or doors open ....
Atkins/ The timing on the amplified sound...is really very very
important .... It is during the day .... time of day is the
thing... after the business, banks, and some of the other
folks shut down .....
Baker/ ...compete sound ....

Baker/ I would like the committee to think about the time of the
regulation or prohibition.
Karr/ Larry, are you saying you wish it to be strengthened and not
just amplified equipment? But you wish to-
Baker/ If you have somebody inside playing an acoustic guitar. It
is electronic amplification that is always the problem.
Nov/ We have already said here it is not going to be allowed° Why
not just leave it that way?

and the handing or the sharing ..... But most beer gardens have
high fences...
Kubby/ The concern is still there...
Throg/ It creates an unnecessary burden for any business that wants
to do a sidewalk care ....
Nov/ It is part of the job...monitor their one service.
Throg/ A waiter is going to be there most of the time ....
Karr/ Also viewed it as an extension of a business .... you have that
responsibility .... Is there four of you that want to strike
that...?
Nov/ I think it is fine the way it is.

Kubby/ Is there another option for dealing with that concern?

Baker/ Somebody who is responsible for monitoring the area. That
doesn't mean he has to stand there all of the time.

Baker/ .... survey .... allow roll out awnings.
Karr/ I think they were talking about the awnings you see on a lot
of store fronts .... We do not allow that presently.

Throg/ W'ny we don't we ask DR to look at that and consider whether
it would be wise to amend the appropriate code?
Kubby/ Question #1 about the minimum footage. I guess what I want
to go out and do some measurements at some potential sites to
make sure if we are going to sure that 8 foot that are these
regulations functional.

Kubby/ Page 3, section #2...notifying property owners. Many of the
properties are leased to other businesses. So I would like
that notification to go not only to property owners but the
lessees.....
Nov/ It does say in #3 that it includes the ..... owner and the
renter.
Kubby/ But not for the abutting property owners .... Under #4 with
right to withdraw the license, can the council say no to
concerns of abutting property owners or lessees?
Woito/ No to the applicant on the basis of objections of the
abutting property owner?
Karr/ Yes.
Woito/ That would be all of the factors you would be looking at.

Woit0/ Withdraw is the wrong word. We need to change that.
Throg/ It seems like such a blanket exception .... real disincentive
for purchasing any hardware .... What are the kinds of
conditions under which the license might be revoked?
Karr/ Public safety ....
Throg/ What does that mean? Put some flesh on the bones.
Karr/ If they f~iled to repeatedly adhere to the hours .....
Kubby/ R. J., would it state if arrest was made in the indoor
versus outdoor section if we did this~.. having that
distinction in the future might be helpful to us .....

Winklehake/ It would be relatiqely easy to have the complaint
marked outdoor .....
Kubby/ That would be real helpful.
Karr/ Just for the record, it is one liquor license.
Throg/ Marian, if you could amend the draft ordinance to specify
the types of conditions under which a license would be likely
to be withdrawn ....
Woito/ Such as...including but not limited to.
Pigott/ Is there a fee attached to the licensing?
Woito/ Yes, you would just establish that by resolution.
Arkins/ They are using the public r.o.w. I think you should.

Nov/ Charging fees for carts on the plaza ....
Kubby/ Who will get the license? Will it come to us or
administrative?
Throg/ E.2, page 3, refers to city staff.
Woito/ It has to come to you. There are some inconsistencies in
here that we are going to iron out tomorrow.
Karr/ It is recommended because .... liquor license, we would handle
it through my office as an extension of a liquor license. We
would sign.off by all of the affected departments .... because
it is the use of public r.o.w .....

here of February 21 where Hills Bankwas going to be receiving
bids...$400,000 bid that was rejected. Is that tzlle and is
that the only bid.

Hills is taking it-over~..was a bid...how formal ..... I just
simply don't know.
