Consider setting a public hearing for April 11, 1995, on an ordinance conditionally amending the use regulations of approximately 34.21 acres located west of Taft Avenue along Court Street extended from RS-5, Low Density Single-Family Residential, to CN-1, Neighborhood Commercial (6°93 acres), RM-12, Low Density Multi-Family Residential (12 acres), and RS-8, Medium Density Single-Family Residential (8.14 and 7.14 acres). Miklo/ There are five separate parcels that would be rezoned from RS-5 to CN-1, RM-12, RS-8 .... Both staff and Commission have recom~tended approval ..... ITEM NOo 6b. Consider setting a public hearing for April 11, 1995, on an ordinance amending City Code Title 14, Chapter 5, entitled "Building and Housing," Article H, entitled "Site Plan Review," by adopting design standards for exterior stairwells and exterior corridors on multi-family residential buildings. Miklo/ ...to include design standards for exterior stairways and corridors in multi-family buildings ..... You asked us to go back and do further study .... We are proposing these guidelines .... The Building Board of Appeals recommended against adopting these guidelines .... Nov/ I noticed there is a new apartment building on Dubuque Street which is not built with exterior stairway. Kubby/ We need to keep this in our back part of our memory of where we have decreased regulations and made it so there is less concrete ..... ITF~! NOo 6d. Public hearing on an ordinance establishing the Moffitt Cottage Historic District for property located between Muscatine Avenue and Ralston Creek, north of Court Street. Miklo/ These are the five stone cottages on Muscatine Avenue. This was recommended for approval by the HP Commission, P/Z Commission and the staff. We have sent letters to all of the property owners. Four of them have indicated support. The fifth has not indicated one way or the other how they feel about it. ITEM NO. 6e. Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning,,' of the City Code by revising Article L, entitled "Provisional Uses and Special Exceptions,,, Section 1M, entitled "Neighborhood Centers," to repeal the access requirement for neighborhood centers. Miklo/ .... to repeal the requirement that neighborhood centers be on arterial or collector streets. They still would require the special exception and medium low density multi family zones. They would not require the special exception in high density multi family zones ..... Staff and the Commission both support the amendment ..... ITEM NO. 6f. Consider an ordinance amending the Conditional Zoning Agreement for 1069 Highway 1 (Westport Plaza) to allow an additional freestanding pylon sign. (REZ95-0002) (First consideration) Miklo/ ...allow the additional free standing sign for Red Lobster in Westport Plaza. Consider an ordinance conditionally amending the use regulations of approximately 13.09 acres located at 655 Meadow Street from RM-12, Low Density Multi-Family Residential, and RS-5, Low Density Single-Family Residential, to RS-8, Medium Density Single-Family Residential. (REZ94-0020) (Second consideration) Miklo/ ...East Hill Subdivision rezoning. First reading of this .... Kubby/ I had a question .... clarification .... 72 is really the number. I guess I want to know that when the plat comes back .... that staff may feel fine about 72 and P/Z negotiated 72 but if council says we want fewer, we can do that. Woito/ Yes, you can because we explicitly talked about no more than 72 ..... not all of you were comfortable with 72. Kubby/ Because we had that discussion .... we are okay on that .... good. WS032795 March 27, 1995 Council Work Session Page 4 Request-Mayor of Solon to Place Local Sales Tax on Ballot 95-42 S2 Horow/ Do have the letter from the Mayor of Solon on this... Atkins/ You saw the letter .... there are two ways that it can be on the ballot. Receipt of a petition by the County Board requesting .... 5% of the persons in the county who voted in the last preceding general election. That is one way. The second way is by motion adopted by the governing body of the city or cities or county for unincorporated areas representing at least one half of the population of the county. That is why they are asking you. So you have the authority to cause this by simply... motion. If you read it...motion adopted by the governing body of a city or cities .... or county for unincorporated areas representing at least one half of the population of the county. But the county's unincorporated areas do not represent half of the population of the county. It is or? Nov/ The county represents everybody, don't they? Atkins/ Karr/ I thought it was an "or". Atkine/ Kubby/ They have indicated they are not interested as did Coralville. Karr/ I think that is why it came to the city as a whole. Nov/ How many signatures did that require? Horow/ But the Water Forum will not be at a setting that we will be discussing this among ourselves. Kubby/ It will be one of the pieces of information talked about in terms of the financing question. Atkins/ I will do a little summary of financing and I will mention that as an option .... Nov/ Please emphasize the fact that it doesn't pay for all of the construction .... Atkins/ Solon asked a specific request to place it on the November ballot. That was their request. Horow/ At this point it is certainly premature for us to make decision either up or down because we have not discussed it. Atkins/ Kubby/ Can you let Solon know that we made this commitment to talk about it after we hear some feedback about financial options on Wednesday. Horow/ Karen, I hope it is seen within the context of the way our citizens have discussed it and that having to do with financing of the water plant. Solon can do whatever they want to. Atkins/ Would you like me to draft a letter? Lehman/ Susan, I think this is a lot bigger question that financing the water plant ..... This is something .... look at merits and facts on its own whether or not we have a new water plant or sewer plant. I hate to see us ~iscuss it in conjunction with that. Pigott/ Right .... if you did such a tax .... What would you use the revenues for and how long would you use them for that? Lots of needs out there ..... WS032795 March 27, 1995 Council Work Session Property Acquisition - Future Housinq Construction Horow/ Page 7 95-42 S2 Milkman/ I am asking you tonight for an opportunity for the city to make a purchase offer on some land that is adjacent to where the lift station... north south trunk sewer .... adjacent to Napoleon Park. I have a map (refers to map) ...... The reason it is so small, there is a house over here ..... (Refers to map) ..... Horow/ Would this be considered the same situation as First Avenue of that if people wish to purchase it later on...? Milkman/ Sure .... We have umpteen options but the time is right now. Throg/ Is there any complications with the soils of that particular ' Q site. Milkman/ (Refers to map). As I recall, there is nothing that shows up on the sensitive areas map. Woito/ We have appraisal on it that we got for the lift station. So we have the dollar/acre figure. $11,000 an acre which we think is fairly high but I couldn't talk the appraiser out of it. Nov/ And there will also be some land purchased for the lift ' 9 station. Woito/ Yes. Milkman/ We will make it as two separate proposals. Horow/ Pigott/ Milkman/ That access we are going to have to do something about anyhow...the way the road and the sewer was going to go this would have to be laid around this way. (Refers to map). Throg/ It is kind of a stretch to think of this as an in fill sight. So how do you react to that? Milkman/ What has become very clear .... we have looked for a number of other ones and they have always been so expensive .... Even now with the one on Fifth Avenue that we are doing, it is going to be close to do it. Kubby/ Milkman/ Remember this money has been revolving...money has come back ..... Kubby/ So, does the money come back in that same pot for this same purpose? Near South Side Commercial Urban Revitalization Plan requires that any new construction have its exterior design approved by the city council before a building permits issued. So that is what you have before you .... a res61ution approving the design .... The DR Committee has reviewed the project and recommends approval on the design. There is one change .... to a note that was on the plan... streetscape (refers to design plan). The note on the plans right now implies that the city will provide the streetscape which at this point in time it hasn't been decided on exactly how the streetscape will be paid for once the streetscape plan is adopted ..... Review is only in terms of the design ..... city does not know what the streetscape is going to look like .... The note has been changed to reflect that only the streetscape will comply with the design plan, the streetscape design plan for this area. Cal Lewis, the architect for the project is here to make a presentation. Horow/ We have already read the material from the DR Committee. We know that you have been through quite a lot of discussion with them and we appreciate what is reflected in the minutes. Cal Lewis/ I will go through the material here quite quickly... this is the material we presented to DR ..... photographs .... diversity of characters of structures .... mix ..... Our goal ws to try and come up .... tries to be compatible and mesh with all ..... Existing site as a couple of buildings on... (refers to design plan)...sits back 10 feet from Burlington...two story lobby ..... Also there would be an access from the alley side .... middle is a five story atrium .... parking .... curb cut .... Have out own service area access of the alley .... Walk in entrance off the alley ..... potential expansion on Phase 2 ...... (Refers to model). Kubby/ This is an important consideration for me is the alley side. It has not been decided to vacate that alley ..... Lewis/ If you are going to be doing this kind of development on this part of d.t ..... If you have what you wish, something about this size is going to be there ..... We have also tried to do somethings to make it into something .... End of our atrium coming through to that side of the building .... Throg/ What are we looking at right here? Lewis/ This is a sunscreen/canopy that takes and gives some scale from our standpoint to a two story glass lobby ..... retail establishment .... high presence and high image .... key intersection in d.t. Iowa City .... a lot of visual activity and presence and character... two story glass wall... We are trying to have it be that big... but bring some scale back down to it ..... Throg/ Small figures on the sidewalk are humans? Lewis/ Correct. Pigott/ Ground floor...glass stretches from one end to .... Lewis/ It is all window...access from the lobby... where the canopy is .... most of this facade at that lower level is Frieda's store .... show windows ..... or access points for the retail along Clinton. You can now have as much solar control as you use to have... new technology glasses .... have thermal pane windows ..... Heat gain problem was what the tinting for .... technology... to keep out the ...heat without actually having to go to the mirrored glass .... preference would be to have the clear glass .... what interactive building. Lehman/ Lewis/ Fading is still more of a problem .... Lehman/ Lot of stores that can't have fading in their windows. Lewis/ Show windows are all clear glass because you have no choice... need to show off the material. Lehman/ I have a store d.t. with tinted glass .... Lewis/ .... Any time you have direct sun rays you are going to have that problem ..... Pigott/ At least three concerns .... Why not access doors to retail .... instead of just having to go down to the end? What is the theory behind that? Lewis/ We will have that potential .... We won't have that potential on Burlington because the grade slopes by four feet .... Pigott/ .... Couldn't' there build in a stairway...? Lewis/ You start eating up retail space .... take space ..... On the Clinton Street side these will have all street front access and they will have an option of indoor into their space ..... Pigott/ Lewis/ Frieda's store is on the first floor from here to here. Pigott/ Question... what the material you will use here on the windows third and fourth floors to make it look-looks really great...? Don't know what that material is .... Lewis/ These are the materials .... Brick base have color tone to it .... Pigott/ Is there a place here in town that I can walk by and say that is what that material looks like...? Lewis/ Business building does some of this ..... They take the reflective glass .... ties glass panels together vertically .... We want it to be a little quieter than that ..... Any window reads dark ..... darker line ..... It is just a matter of light level ...... Only place that won't happen is our lobby where we got the sun literally shining in. Throg/ I am intrigued by the design... mix of the buildings on the Pentacrest, Old Capitol Mall and Jefferson Hotel .... I am curious about the brick and the stone .... where is it going to come from...? Lewis/ We have not gotten that far yet ...... Iowa limestone .... We have used that on quite a few projects in Iowa .... Like to use Iowa products. Pigott/ Signage? ..... Where do you put the signs...? Lewis/ We don't anticipate that we will have individual tenant signage on the outside of the building .... Saying ...this is Hieronymous Square .... got it shown both across the top here ..... at each entry ..... alley as well... every place there is an entry to come in ..... We will allow tenants .... sign ordinance .... You would have the tenants do their identification inside ...... They could have their sign but it would be inside their glass line and can be visible .... not be on the outside ..... There will be signs ..... Have to make an environment that is effective for the retail ..... A sign here or there is certainly preferable to an empty building ..... Nov/ What is this sunscreen? Lewis/ Basically what you are seeing on the cornice line .... got a north elevation ..... Nov/ It has pretty good supports? You are going to get snow piled on top of it. Lewis/ All of this stuff has to meet the snow load .... Horow/ Lewis/ Canopies and cornices are typical for this kind of building Kubby/ A lot of discussion ..... how prominent the entrance should be .... I want to make sure council discusses that. Horow/ I am happy the way it is .... Nov/ Lewis/ The windows at the second level .... show windows .... signage window .... inside the glass. Nov/ Usually that side of the store is a stock room .... Lewis/ ...There are other kinds of mind sets that you have to go into ..... Throg/ It really has to be open and inviting to the pedestrian ..... Lewis/ ...In an urban retail environment ..... Also it is generally a high window ..... allows them to still display internally and have a high window .... Lehman/ It would be a real shame not to have windows there .... WS032795 March 27, 1995 Council Work Session Page 16 Parkinq Meters - 500 Block Iowa Avenue 95-43 S1 Horow/ Parking meters in the 500 block of Iowa Avenue. Joe Fowler/ We brought the request for parking meters in the 500 block of Iowa Avenue because several times in the past we have had requests to put meters further out from the central business district and there has always been a reluctance by council in the past to put parking meters in front of residential areas. In this block .... there are three meters on the south side right now in front of one business and on the north side there are four meters on the side by the University of Iowa Credit Union ..... The owner of the property feels strongly that putting the meters in there will help his business ..... Horow/ Did you do any postcard surveying of this? Fowler/ No. We have monitored the meters that are there now. They are not heavily used ..... Nov/ It looked like everything was a residence except The Bookery and the Iowa Building...concerned about the residence. Do they have a place to park other than on the street...? I would feel a certain right to park. If these people have some off street parking, I have less objection to metering. Horow/ This is Mr. Michand Joe Michand/ I have The Bookery at 523 Iowa Avenue ...... The parking spaces in front of my building fill up around 7:30 in the morning and they empty around 5:00 at night ..... people who are working d.t. come in the morning and park there .... All of the non-metered parking area ..... I have a parking lot in the pack that will hold 3-4 cars but I found early on people will not use it ...... Horow/ But the houses near you do have space in the alley? Michand/ Yeah, there is some space to park behind there ..... Two houses east of me have been rental units ..... Pigott/ Michand/ What would be nice is if only I could get a couple of meters across my lot...? I also live over my business .... Horow/ We are questioning whether or not the cars that are parking there all day long are actually people who work d.t. or whether there is a combination ..... Kubby/ Because it is a public street...balancing wanting to do something to help...small business and .... Horow/ I would like to have a postcard survey .... how do folks feel on either side of you. Kubby/ Will the postcard go to the owner...or tenant? Fowler/ ...Jim does those and I believe he goes off of the utility billings. Kubby/ May or may not get the tenants .... have a little line on the postcard that says do you have adequate off street parking. Pigott/ .... Just because there is space behind the house doesn't mean the person who is a tenant .... they may have to rent it .... forced onto the street .... Horow/ But that is providing them free parking on the street. Pigott/ ...it is a balance. Kubby/ Can we make sure both owners and tenants get postcards? Atkins/ Just the 500 block? Fosse/ I will just run through the projects in the order in which they are listed. ROHRET ROAD (#25 & 26). You will be awarding contract to start construction .... over $1.4 million ..... 28E Agreement with Johnson County for maintenance of Meier Avenue during construction .... worked out some of the access issues .... compromise ..... we will grade in accesses at the end of the day ..... we did that somewhat reluctant ..... What we are going to do is we are still going to provide that alternate parking and maintain the graveled walkways .... use your discretion .... park where you can get out ..... Lehman/ Fosse/ We are going to try to cover ourselves by educating ahead of time to park elsewhere .... Lehman/ ...I am not sure it is a good idea .... creating problems. Atkins/ (Can't hear). Nov/ We are trying to say it is the risk of the property owner rather than the risk of the city. Lehman/ I am not sure that is true... if they use it and get stuck, I am not so sure we are not liable for getting them out. Atkins/ I am not so sure we could get them out ..... Horow/ We don't think there are going to be that many problems .... Kubby/ There are eight households ..... Fosse/ There will be times when the whole area is going to be messed up ..... Horow/ Rob's memo says we also hope to have a temporary street light installed in the area .... Fosse/ If he can get the utility company in there to do it, we will do it. No ..... give us a better longer lasting product .... Quick drying concrete has an extra bag of cement in every cubic yard .... stronger mix overall Horow/ City staff shirts that will be visible. What color are these going to be? Fosse/ We have not decided on that .... we have worked the logo out Horow/ We also have a letter to the DOT about the signage on Highway 1. Fosse/ Yes, let me follow up and make sure that went out. I will check on that. '.. Horow/ That was a request .... going to have increased enforcement .... Fosse/ That is something outside of our jurisdiction. Horow/ The mayor will be gently aggressive on that one... Nov/ That means a city police car cannot stop somebody on that road if they-are speeding? Kubby/ Maybe we should put that on the city county meeting? Horow/ No, it is state- Woito/ Is it outside the city limits? Horow/ Yeah. Woito/ It would have to be the county or the patrol- ABBEY LANE SANITARY TRUNK SEWER.....ne~d to get moving on. It needs to go ~hrough the future Kiwanis Park ..... number of different options ..... North is to your left .... The southwest interceptor kind of follows up the creek up this side .... need to serve that area west of the interstate... up through the park... get some input from the neighborhood ..... Fee is directly attached to acreage benefited by the drainage area and there is a finite number of the construction project which is used...very finite .... in terms of whether you could ever come up with capacity use that is estimated for the water facility, I rather doubt it and I want to confirm this in talking to Ralph Russell which I haven't done yet except through Chuck .....
