Absent: Throg. staff: Atkins, Helling, Woito, Walsh, Franklin, Klingaman, Boothroy, Schmadeke, Pelkey, Neuman, Moreno, Klinefelter, Miklo, Rocca, ¥ucuis. Tapes: 95-65, all; 95-66, all; 95-67, all. Addition to the Consent Calendar 95-65 S1 Horow/ All right and this by name change means you also have to start all over again with your licenses? Woito/ Liquor licenses. Horow/ All right. Anyone have any problems with this? Great. Pigott/ Why the change? Novick/ I don't think the name of the restaurant is changing. Horow/ Oh, just the ownership? Walsh/ Yeah. Nov/ Corporate name or corporate ownership? Walsh/ Corporate name change. Baker/ Horow/ Thank you very much and you will get all of the necessary work to the City Clerk's Office by tomorrow? Walsh/ It is already in. Horow/ Review Zoning Matters ITEM NO. 95-65 S1 5a. Public hearing on an ordinance amending City Code Title 14, Chapter 5, entitled "Building and Housing,,, Article H, entitled "Site Plan Review," by adopting design standards for exterior stairwells and exterior corridors on multi-family residential buildings. Thisrepresents only areasonably accurate transcription ofthelowa City council meeting of May 22,1995. W$052295 May 22, 1995 Council Work Session Page 2 Miklo/ First item is the continuation of the p.h. on the exterior stairwell and corridor amendments. You have before you two options. One is the ordinance that you have been considering previously. The second option would be an ordinance requiring review of the exterior stairwells but the actual design guidelines would be by resolution. If you chose the second option you could have the first reading of that ordinance and then the resolution would come later when you have the pass and adopt. Nov/ I have a couple of questions. The new system of ordinance or resolution, no one is mentioning the exterior lifts which were in the first ordinance required to be screened and roofed. Miklo/ That should be in there. Nov/ It should be in there, right, yes. Also I am not sure why we have one guideline saying you should not do this if it is facing the street and the other one says if it is facing front yard. Are. they both the same or not? Miklo/ Which guideline? Nov/ I am looking for wording. Miklo/ I think the intent was the same. Nov/ If the intent is the same then in each instance that guideline should say front yard or the guideline should say street. But not this way in one place and that way another place ....... Miklo/ I think they should say street. Franklin/ I would agree. It should say street because the term front yard is sometimes ambiguous and sometimes the side yard is the front yard and people don't know that. Nov/ What we are most concerned about is the street. Kubby/ Does anyone have a problem with the concept of making the ordinance just say you have to live by these guidelines and then having the guidelines be a separate document? Horow/ I don't think so- Kubby/ This mpresentsonlyareasonably accuratetranscription of ~elowa City council meeting of May22,1995. WS052295 May 22, 1995 Council Work Session Page 3 Baker/ Horow/ It is almost a broad brush policy ...... Kubby/ One of the things you talked about Homebuilders Association and DR, HIS, guidelines can then be changed ....... in a meeting with the Planning was that the Horow/ Okay. Any other questions? Baker/ I want a clarification... the original proposal came in just for the front side of the building, right? Miklo/ The original proposal is very similar to the guidelines in both the ordinance and the guidelines included with the resolution. There was a request by Glenn Siders to regulate only on the front. Kubby/ And we said no at the meeting. Baker/ ...So the way this is written now it would be all four sides of the building? Miklo/ Right. Baker/ Second thought .... reservations about all four sides but not strong reservations except on corner lots. Back of building is less of a concern to me than a side that is visible ..... Kubby/ A lot of apartment buildings, their main entrances are in the back ..... those alleys ..... then there is people living on the other side of the alley that are also residences that have to deal with that sight. Miklo/ One of the concerns of the two architects that was on the original committee that drafted the guidelines .... is if there is no regulation of them on the back that is almost an incentive to put them on the back and we would get more of the buildings without a front door as a result. Nov/ Also, even if they are on the back having a roof to protect them from snow and ice is still a good idea. Bob, I found the two things that seem to be in conflict ..... Guidelines, page 2, #4 says that corridors should not be on the elevation that faces the street. #5 said exterior stairwells located on the side that is facing the front yard and it would seem to me that if you said facing a street in both instances you would Thisrepresents only areasonably accurate transcription ofthelowa Citycouncil meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 4 get where you want to go. Miklo/ We will make that correction as well as add the lifts which I think was just accidently taken out. Kubby/ We clarified that at the meeting. So I am glad you caught that. Baker/ Does that mean that an alley is not a street? So- Nov/ I think it does provide less restriction if you are facing an alley or if you are facing a backyard. At least I assume that. But you are still we discourage open stairwells, period ..... Kubby/ There were some other issues that were brought up as a result of this discussion which we probably shouldn't get into now but at some point there were four things .... that we should probably talk about sometime .... They don't have anything to do specifically with exterior stairwells but were another result of that meeting. Horow/ All right .... Kubby/ So if Bob doesn't forget those and get them on paper sometime. Horow/ It doesn't have anything to do with #5a? Kubby/ No .... ITEM NO. Consideration of an ordinance amending City Code Title 14, Chapter 5, entitled "Building and Housing,', Article H, entitled "Site Plan Review," by requiring City approval of designs for exterior stairwells and exterior corridors on multi-family residential buildings. (First consideration) Horow/ Item b. is the ordinance. ITEM NO. 5c. Public hearing on an amendment to the Comprehensive Plan to adopt "IOWA CITY: BEYOND 2000 -- Iowa City's Vision for the Future." Franklin/ I am going to abbreviate my comments but this is the first time you all have seen this... highlight a couple of things. In the overall statement that begins this the issues that I think are important to point out are the ones Thisrepresents only areasonably accurate transcripfionofthelowa City council meeting of May 22,1995. WS052295 May 22, 1995 . . Council Work Session Page 5 inclusivity, accessibility and attractiveness in the community and inclusive concept of it talks about including a diverse set of people, housing, and jobs ..... that diversity and inclusiveness goes beyond just talking about people specifically. Accessibility means physical as well as financial accessibility. So that is related to the affordability issue. Attractive in the community is attractive visually but also in the sense that Iowa City is a community that people will find attractive to live in. Will find desirable to live in. I want to highlight some of the major issues ..... main ones that came up before the P/Z Commission are in the memo that I sent to you. The concept of a definite visible edge which is specifically in the land use section, that had some debate in the P/Z Commission but it was retained ...... That you know when you are entering Iowa City and when you are leaving it and how you define that edge is what we will have to get to when we talk about how we are going to implement and achieve this vision. And it can be from how you do development at that edge to acquiring land and preserving that area or somehow preserving that area as a greenbelt around the community ...... What this does as a vision statement is set that out as a goal and the debate in P/Z was about whether it was achievable or not ..... We are talking about the vision that we have for the future and achieveability is what we are going to have to work on ..... The consensus finally of the Commission was that or the majority vote of the Commission as that the definite visible edge should be retained in the mission statement. An issue of neighborhoods and this is in the Housing section as well as Land Use and Urban Pattern and I want to point it out...aoming up as we look at specific development projects. The vision statement advocates the preservation protection of the integrity of existing neighborhoods. It also talks about sense of neighborhood and neighborhoods being diverse areas that have different housing types and different people and different land uses .... a sense of neighborhood .... commercial space as well as residential uses ..... churches and schools ..... I think you are going to grapple with as you take this concept and try to make it a reality is defining what a neighborhood is. For some people a neighborhood is strictly s.f. detached housing and so to talk about the concept of neighborhood in anything that has diversity is difficult. So protecting existing neighborhoods and their integrity, creating these new neighborhoods could come out with a pattern that we have these integrated diverse neighborhoods only on the edge... out in the new areas .... What this envisions... having these diverse neighborhoods throughout the city. The This represents only a reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 6 reality of that and what we are able to achieve I am not sure ~about how we are going to get there ..... not clear as to how we are going to accomplish that ..... In the Social Services section, the P/Z Commission did make somewhat of a change .... the section was strongest in terms of the task force language about what the .... city government will do in the area of social services ..... That language was soft need to not be as definite as what the task force had put forward ...... I don't know that is an issue that you will get any input from the public about. One issue that you will get input from the public about... was the issue of inclusion. How to express inclusion and that is exactly what it is .... It is a matter of expression ..... Goals of both of these views is to include persons with disabilities in any of our considerations for the future of this city. But it is a question of how to express it and whether we and all of those who follow us will read all citizens as in fact being all citizens and not lose the emphasis that came through in many of the task force statements regarding persons with disabilities. And so I think what you are going to hear from the Johnson County Coalition for persons with disabilities is that they feel that language that says all citizens in the sections of this loses some of that focus and emphasis that they, of course, would like to have there, The Commission felt they retained the emphasis by in the overall statement at the beginning of the document defining what they meant by inclusion and in that section specifically mentioning persons with disabilities. Nov/ So they are saying we not only should mention it at the beginning, we should mention it again on each page? Franklin/ Let me refer you to an example. In P/R and Open Space. As it is now stated the second goal, "Insure the programs and facilities are accessible to all citizens." That previously said insure that programs and facilities are accessible to all citizens with special attention to the needs of those with disabilities ...... The philosophy being that if you say all citizens and George is here who is a very good spokesperson for this, that when you say all citizens, that includes everyone. And when you start to list you may exclude someone by the very fact of the listing because you don't always know every either special needs population or any kind of population descriptor ..... Nov/ Did anyone go beyond the citizen ..... foreign visitors in town ..... are we excluding those people? Would we be better off to say all persons? Thisrepresents only areasonably accur~e transcription ofthelowa Citycouncil meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 7 Franklin/ Probably. We never discussed that. Nov/ Or all residents ..... Franklin/ But then do you want to not accommodate visitors? To truly get at the whole you would say all persons ..... Nov/ Woito/ (Can't hear). Kubby/ ..... I understand not wanting to exclude anybody. I don't know if we could say for all people's including people with disabilities or on top of every page to have a short concise statement about what all citizens mean .... I think there are some very legitimate reasons why people with disabilities want to be specifically mentioned in this vision statement. Horow/ .... wondered whether or not the inclusion of their position .... on a separate page in the back would be more informative as each decade goes along... more of an educated process ..... would actually educate people .... It is a matter of repetitive education and I felt that the letter that they had, the position that they take, is one of education that truly citizens have to become more aware of ..... Educate them so that citizen means more than the abled ..... short abstract. Franklin/ One thing about a vision statement is you try to make it as brief... as possible ..... Most of all this first statement is going to be the statement that will describe out direction into the next century. Then each of the different areas .... What I am planning on doing with this is take, once you have adopted it, is putting together some kind of .... publication that we can get out that is going to be no more than a front and back of a piece of paper that hopefully has some visuals on it. That people then can take and identify with. And so what I am trying to do is get these boxed statements to crystalize your sense of these different topical areas of the direction that you want to take. Now once this is all adopted then we go to implementation and figuring out how we are going to get there and that is going to be comprehensive ..... We will do the plan that will get us to this point ..... I would prefer if you want to have the emphasis on persons with disabilities reinstated in here that you do it within the context of each of the sections rather than have a separate kind of section. I don't think a lot of people are going to read this. Thisrepresents only a reasonablyaccurate transcription ofthe Iowa City coun~l meeting of May 22, 1995. WS052295 May 22, 1995 . Council Work Session Page 8 Kubby/ The intent in most of the statements .... to emphasize people with disabilities ..... Franklin/ ~Fnat was being reacted to was the focus on persons with disabilities ....... In the beginning statement there is a very definite focus ..... Nov/ ...I read a letter from a nine year old that said please keep the playground equipment accessible for older kids, not just the preschoolers .... should put ages in that front statement also. Kubby/ We have a diverse age range of population. Horow/ ...If you start enumerating them we are inevitably going to lose...somebody ..... Kubby/ ..... Nov/ I am inclined to add ages at the list in the front .... not inclined to list on every page. Kubby/ I don't want to make a decision until I have heard the p.h. Franklin/ This is adopted by resolution and it is not on your agenda for tomorrow night. One last thing I would like to say about this is I think what this envisions is a very ambitious goal and that it is going to require the commitment of the personal energy of the people who live in Iowa City as well as a lot of public and private resources. So that is something to think about ..... ITEM NO. 5d. Consider an ordinance conditionally amending the use regulations of an approximate 1.63 acre lot located on the west side of Waterfront Drive, approximately 140 feet north of Stevens Drive from CC-2, Community Commercial, to CI-1, Intensive Commercial. (REZ95-0004) (First Consideration) Miklo/ It is first consideration .... Waterfront Drive .... ITEM NO. 5e. Consideration of an ordinance amending City Code Title 14, Chapter 6, entitled "Zoning," Article N, entitled, "Off Street Parking and Loading," to reduce the amount of required off-street parking spaces and amend the parking area design standards in the CN-1, Neighborhood Commercial zone. Consideration of an ordinance conditionally amending the use regulations of approximately 34.21 acres located west of Taft Avenue along Court Street extended from RS-5, Low Density Single- Family Residential, to CN-1, Neighborhood Co~lmercial (6.93 acres), RM-12, Low Density Multi- Family Residential (12 acres), and RS-8, Medium Density Single-Family Residential (8.14 and 7.14 acres). (REZ94-0016) (Pass and Adopt) Miklo/ Is pass and adopt for Windsor Ridge rezoning .... ITEM NO. 5g. Consider a resolution approving the preliminary plat of East Hill Subdivision, a 36-1ot, 13.11 acre residential subdivision located at 655 Meadow Street. (SUB95-0009) Miklo/ Preliminary Plat of East Hill Subdivision. This needs to be deferred to your June 6 meeting. We were anticipating the grading and erosion control plan being approved. There are some technical problems with that and it is not approved yet. Kubby/ Was there any discussion at P/Z? ..... strong minority who were saying that that up to 72 units that we may not be inclined to go up that high .... Miklo/ There were members of the public who spoke at the P/Z meeting asking for a lower density. The Commission voted unanimously that evening to go with 36 lots .... result in 72 units and I believe they based their decision on the secondary access guideline which would allow approximately 500 vehicles trips per day for 70 some units. Pigott/ It mentioned in the note that the Fire Department expressed reservations regarding secondary access .... Did we know that before? Miklo/ The Fire Marshall... has requested that there be a second way in and out ...... reiterated that concern ..... Kubby/ This represents only o reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. WS052295 May 22, 1995 council Work Session Page 10 Horow/ Okay. So that is deferred to June 6. ITEM NO. 5h. Consider a letter to the Johnson County Board of Supervisors recommending approval, with conditions, of an application submitted by Alan Weinstein for a conditional use permit to allow a home business, an art gallery, for property located in Fringe Area 5 at 3800 Owl Song Lane, S.E., immediately north of Iverness Court and east of Arlington Drive. Miklo/ A letter to the County Board of Supervisors regarding a conditional use permit. This property is surrounded by Windsor Ridge Development ..... If the city objects, it requires 4/5 votes from the County Board of Supervisors. P/Z and staff are recommending approval subject to a time limit of two years ..... requirement. Kubby/ Could you explain that 4/5? Miklo/ That is a provision in the County Zoning ordinance that says if a city which includes this conditional use property as part of its extraterritorial review objects to the issuance of that permit, then it requires 4/5 Board of Supervisors to vote approval. Kubby/ But we are saying we agreed to this. Miklo/ Subject to these conditions ..... Kubby/ Really it doesn't mean anything ..... If the county says yes to the permit without the two year condition, bow that affects going back to getting those seven lots in. How does the decision that we make here or that the county makes affects the ability to get those seven lots back into the city? .... Miklo/ I am not sure there is a connection. Kubby/ Because that land could be annexed ..... Nov/ Does anyone know whether there will be parking built? Miklo/ There will not be any parking built ..... There is an existing circular driveway that they will use ..... Kubby/ Was it this applicant's position that they didn't want those seven lots annexed? That they wanted to live in a rural area? Thisrepresents only areasonably accuratetranscrlptlon ofthelowa City council meeting of May 22,1995. W$052295 May 22, 1995 Council Work Session Page Miklo/ That may have been part of the reason .... applicant... had an understanding with Gary Watts who wanted to annex the land for the lots that they would work out some sort of real estate swap and until that occurs... he would object to further annexation. Horow/ All right. Thisrepresents only areasonably accurate transcription ofthelowa City council meeting of May 22,1995. W$052295 May 22, 1995 council Work Session Page 12 Program for Improving Neighborhoods Neighborhood Council Recommendations 95-65 S1 Klingaman/ Tomorrow evening council is going to be looking at a resolution for approving the distribution of $25,000 in funds for the use by neighborhood associations... improvement to their neighborhoods. The Neighborhood Council... named this program PIN ..... Neighborhood Council...busy... designing criteria, developing the application, and also establishing a method by means to evaluate the applications .... Run through what the applications consisted of... Northside... and Longfellow... trees in their neighborhoods .... Grant Wood Neighborhood applied for $5,000 for planting trees in Whispering Meadows Wetlands park ..... Baker/ Got any idea how many trees? Klingaman/ No. In terms of all of these applications, some you will see be more specific than others ..... Wanted them to at least work through the process ..... I know the Northside and Longfellow are expecting to get 4-5 trees planted for the $1,000 ..... Horow/ Marcia, I would like to follow up...April 12 minutes of P/R seem to raise some questions .... doing Longfellow Neighborhood Association one ..... I question .... wasn't clear to me ... Commissions whether there was a consensus from everyone... Klingaman/ The Neighborhood Council spent at least two meetings having neighborhoods present their applications .... As far as Ralston Creek is concerned there were some rough estimates done ..... Horow/ .... the timing of it. Klingaman/ That is the only application that there was a fairly substantial contingency w6rked into it ..... Kubby/ So that money is sitting there and it won't get spent until the subdivision- Klingaman/ It can't. It is private property at this point. Kubby/ It will be earmarked for that project? ...... Klingaman/ I would expect the neighborhood .... going ~.o either have to reallocate ...... I would certainly include the city council in that process. This represents only a reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 13 Pigoft/ Is there a requirement if they can't spend the money before June 1996 they have to give it back...? Klingaman/ If it is not spent by June 30, '96. It is FY96 funding so it would have to be returned at that point. I would encourage the Neighborhood Council .... that there be some discussion ...reallocate it .... Horow/ Grant Wood .... P/R minutes... that there was money remaining in the wetlands park budget... city could possibly accommodate the request for a few trees ..... This was rejected by the council? Klingaman/ Within the budget that I understand that P/R has for the wetland park, that did not include planting trees ..... Kubby/ Klingaman/ We had a full discussion of are these funds possibly going to be utilized for something that would have been ordinarily been funded next year or five years down the line .... came up time and time again ..... Neighborhood wants to see it happen before that .... Nov/ We have a Neighborhood Fund and we have a city Parkland Improvement Fund and I am a little confused about why all of this money from supposed Neighborhood Fund is being put into city wide park. Klingaman/ I think that is something we are going to see on a city wide basis .... If there are improvements in the neighborhood they tend to be in the public property .... If neighborhoods are thinking ...... of improvements... that they sit down long before .... with staff to discuss what those interests are ..... Nov/ ...seems to me if we already have city funds designated for this purpose, why are we doing fund raising? Klingaman/ Whether they are specifically designated in any of these cases, that was always the question, particularly with park development and park improvements ..... Something maybe P/R and neighborhoods need to work through. Nov/ Need a little bit more in terms of guidelines .... Kubby/ ...I think they did really well ..... Thisrepresents only areesenably accuratetranscription ofthelowa CI~ council meeting ~ May 22,1995. WS052295 May 22, 1995 Council Work Session Page 14 Klingaman/ I have to emphasize there was not a lot of time .... They had to hustle. This was the first year .... Pigott/ Homes in Longfellow neighborhoods .... how do they know they have got to do this...? Klingaman/ Horow/ I assumed it was the make up of the Longfellow Neighborhood Association .... Klingamah/ All of these neighborhoods did solicit the input of the neighborhood as a whole ...... Continue with quick review... Ralston Creek Restoration Project .... stabilizing banks... ADS site ..... lead testing of drinking water .... Toilet retrofit ...... replacing five toilets ..... Kubby/ Nice...ask for a bulk discount... Klingaman/ They are working with a neighborhood plumber and she is going to be installing the toilets...subsidy... Baker/ Guidelines on inability to pay .... standard? Who determines who gets what? Klingaman/ Wasn't specific within the application ..... HUD guidelines ..... how they end up evaluating... look at ..... Then the Scott Park Improvement Project .... One comment. It was a very good process for the Neighborhood Council... hearing each other applications... needs .... Nov/ I would like to suggest for future reference the Neighborhood Council put an upper limit on a single grant. Klingaman/ That has been considered ..... $5,000 brought up as one maximum ..... Gary and Andy are here to talk about the specifics of the ordinance. Gary had a memo in your packet that describes the process ..... Information ..... had been distributed... 50 copies... Apartment Owners Association meeting .... information has gone out .... Ordinance... is it is not controversial... has been around for quite some time .... Has been mailed out several occasions ..... There are a couple of things on the Consent Calendar that deal with Public Housing, if you have any questions about that I will be here and I can answer those questions .... Kubby/ Lehman/ One of the changes regards painting exterior surfaces and I think the guideline says shall be properly primed and painted .... What does the word properly mean? Klinefelter/ That the proper preparation is done. Lehman/ What does proper mean? Klinefelter/ According to manufacturer's instructions for the product that you use. Lehman/ Pigott/ So if it is peeling and chipping it is not properly maintained? Lehman/ One of the concerns that I have is that I think that there is a broad base for interpretation ..... intent I totally agree with. The enforcement .... not necessarily applied. Is there any was of making that any more explicit? Klinefelter/ I think even if you make it more explicit in the code you have always got variables with the individual inspectors ...... There is a lot of interpretation on that... You just go out and make the best judgement call that you can ..... Lehman/ If we could be more explicit I think it could be better Klinefelter/ I don't think that area has been much of a problem .... It is really less of an issue than it use to be .... Expectation is pretty well known ..... This represents only areasonebly accurate trens~lptlon ofthelowa City council meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 17 Pigott/ I have heard from people who say ..... first just mention it on the report .... They don't get any mention of that and then one day they get cited for not properly primed paint .... Geez... all of a sudden .... They have been hit over the head with that. I just wonder what the process is .... Klinefelter/ We have extensions. We grant extensions for things .... They propose a date of completion ..... it is usually what they ask for is 'what they get .... As you go into summer and fall and schedules get tighter and tighter, we routinely grant extensions into the next year .... That is how it is handled. Kubby/ Asked for some idea of which of these things are expensive items to change ..... So that we could balance .... have that kind of information. Klinefelter/ It is really hard to quantify some of these improvements because they vary so much. Well over 95% of the rental properties in Iowa City is in compliance with the State Fire Code ...... Very good help from the Fire Marshall .... We have been working on that for 3-4 years ..... There are still some situations out there that are in need of attention ..... Berkley Building... doesn't have a fire alarm system in it ..... $4,000-5,000 item .... Vast majority of properties are already in compliance .... Kubby/ ..... Klinefelter/ Horow/ We are essentially allowing them to be in a dangerous situation. Klinefelter/ Before that they were allowed totally ..... They are on notice that there is a problem and they have budget constraints... there is quite a process to go through .... exiting and alarm systems... are paramount .... Kubby/ Pigott/ Klinefelter/ No one likes surprises .... These amendments put it in the Housing Code .... It just clarifies basically what we have been doing. Pigott/ Thisrepresents only areasonably accurate transcription ofthelowa City council meeting of May 22,1995. Klinefelter/ The rationale is we inspect the entire... premises? Lehman/ Isn't our inspection basically for public health and safety? Lehman/ What does a fence that needs painting have to do with public health and safety? Klinefelter/ I think it is just neighborhood concerns... That is not a health issue or fire safety issue. It is a neighborhood issue ..... That was in the code before I got here .... Horow/ Boothroy/ One of the purposes of the Housing Code is to control the quality of the neighborhood .... maintain... several provisions... that requires property owners to keep their property in sanitary condition... cleaned, picked up .... To deal with neighborhood preservation .... Most of the violations that are cited are life safety issues .... But we do cite people for maintaining their fences or garages ..... Horow/ How does this tie into the Johnson County Health Department's Code enforcement in terms of public safety...? Is there any dovetail? Boothroy/ Very little ..... They basically don't get involved .... They may come out and give support .... rely on us to take enforcement action .... Horow/ Legally, this doesn't get integrated into the county's code? Boothroy/ Essentially, they leave all the residential issues up to US..... Lehman/ I think .... property owners would understand that... perception is we are strictly there for public health and safety. If we are talking about maintaining neighborhood values ... I think that would be far more palpable to a property owner ..... I don't think they understand that at all. They did consider this back in November of last year Kubby/ So there was a correlation between the study of utility usage by a participant and the fair market rent ..... Boothroy/ ...It did seem to be what they thought was fair this time. Kubby/ What will that do water and sewer? ... of pocket extra? with whatever increases we end up with Does that mean the tenants will pay out Boothroy/ That is true with the certificates ..... A lot of pressure at the Commission level not to increase the utility rates ..... We are required by HUD to at least address them .... on a regular basis .... Kubby/ On the second issue about the revised standards for voucher payments. I don't really understand this and didn't see a Housing Commission recommendation. Boothroy/ They just made a recommendation on this at their last meeting in May ..... What we did is a survey of contract rents and found that the one bedroom contract rent for the certificate program .... was $392 .... Fair market rent for a one bedroom apartment is $400 ...... The recommendation is to establish it at equal to what the contract rent is .... Kubby/ ...now it has increased because of the actual situation. Thank you. Council Work Session Page 21 Water/Wastewater Policies 95-65 S2 Arkins/ We have a presentation this evening. Chuck and Don... walk through with you ..... We have recommendations for you on how to proceed on the wastewater and water projects ...... memo... We are indicating we move ahead immediately with the wastewater project and we will show you the proposed phasing of the water project ..... what it might mean with respect to utility rates... We are getting to the point where we need to have some direction so that we can begin packaging these projects..,many other peripheral issues that I have not attended to... local policy... If I could, allow Chuck to step through the projects...wastewater and water, major elements to it. Don follow up with the financing... And then I will need some expression of interest on whether this is a satisfactory schedule and policy for you. Kubby/ .... I ~eally hope that we can go back to your policy considerations in your memo...basis for making specific decisions ..... Arkins/ Remember that there are many elements to this and that they will be coming back to you in pieces ..... Schmadeke/ I would like to start with the wastewater facility project. There is basically three objectives to this project. One is remove ammonia from wastewater effluent; to begin the phase out of the North Plant and to provide sanitary sewer service in that lower river area. The first contract is the South River Corridor Interceptor Sewer and that is shown on this drawing here (refers to map) ....... Our maximum depth on this sewer routing is through Napoleon Park ...... We will essentially wipe out those ball diamonds that are adjacent to the sewer lines ...... Part of the project will be to rebuild these ball diamonds along Napoleon Park. Horow/ Will that be in the season when they are normally used...relocating? Schmadeke/ I have been working with Terry Trueblood on it. There will probably be one season... we have a lost season. I don't think there is any doubt about that .... Arkins/ The hole is 30 feet deep and 60 feet across. This represents only a reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 22 Horow/ Is there anyway of cooperating with Coralville? Atkins/ Terry understands.. scheduling to make arrangements .... The intent is we will have a season. They may be scattered ..... Schmadeke/ In addition these ball fields drop off towards the river and I understand it is very difficult to stand in the outfield and see the batter .... we can fill that area in...have better ball fields. Atkins/ Part of the project plan is we will renovate Napoleon Park because of the dirt we will have available .... improve the drainage ..... Expect to have a better Napoleon Park ...... Baker/ Do you intend to use the revenues from the wastewater to do the park renovations? Atkins/ The hole in the ground is being caused by the sewer project... the dirt that is being moved around is being paid for by the sewer project ..... to improve the park .... Schmadeke/ It will be cheaper to use the dirt on site than to haul it away. Kubby/ Saving money to fix the park. Atkins/ Expect to get a new diamond out of it and the drainage will be improved .... Schmadeke/ Moving south then to the Napoleon Park Lift Station (refers to map). We are about 35 feet deep here at this lift station... gravity sewer on south again towards the plant site (refers to map)...eliminating existing parking lot .... (refers to map) ..... Nov/ So you are going to stay in the public r.o.w. along the street there? Schmadeke/ No, we will be on the north side of the r.o.w. here (refers to map) .... Kubby/ Will we be getting any help in paying for the re-engineering plans for that? Atkins/ There are a number of issues under negotiation. We will have a recommendation to you before too long. Thisrepresents only areesonably accuratetranscription ofthelowa City council meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 23 Woito/ I will give you a memo on it. Atkins/ We are getting a lot closer on this one. Schmadeke/ Contract #3 is tied closely to this sewer project. Southgate Avenue Paving is this section of paving right through here (refers to map)... Waterfront Drive Paving (refers to map) ...... We will be re-paving portions of Waterfront Drive as well. Kubby/ Will that be redone with the development of the new HyVee there? Schmadeke/ The part on the east side of the RR tracks will be with the HyVee project .... Then the relief sewers, Plum Street area (refers to map)...relief that surcharging condition... Sandusky area .... constructing a sewer line along Southgate Street to Keokuk (refers to map). Horow/ My question is on the Plum Street area. Are we intending to reconstruct the street? .... It is a natural flow into kind of a swail area. Schmadeke/ I believe that sewer lie is behind the curb on the south side of the street. Kubby/ Will you explain the Southgate Avenue again? I don't understand why we are re-paving that. Schmadeke/ Between Waterfront Drive and Gilbert Street. It was in the CIP, the seven year program and I think it was scheduled for FY97 which would be about the time we would be in this area. It would be a separate contract .... Kubby/ ...We are doing it now because of the timing .... This first contract, if we did decide we wanted to have a longer time frame for doing this project... what would make sense into breaking this into junks? Where would we break it up? Is it possible to break it up? Schmadeke/ You could break it up at the lift station. I don't think putting in anything north of the lift station would benefit the city .... (refers to map) ..... Atkins/ That is also making the assumption of years worth of delay and we don't have years worth of delay ..... This one was difficult to break up. This represents only a reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 24 Kubby/ ... Arkins/ You are going to see a financing option on this one ..... Horow/ If you didn't do the north part of that that would mean you would not take care of the Plum Street sewer and Pepper? Schmadeke/ That is right. Kubby/ ..... If we did break it up I would be in favor of doing the north part first. Horow/ Kubby/ It would still have to go to the North Plant .... Atkins/ But then the relief sewer wouldn't work effectively. Nov/ I see a certain a logic in connecting the two plants as a single project. Atkins/ There are two components to this, Contract 1 & 2. One is the piping and one is the actual pump station ..... We may likely get the same bidder ..... Schmadeke/ The actual pump station is in the second contract (refers to map). Nov/ Kubby/ Lehman/ Schmadeke/ Then the treatment plant work will be primarily at the south plant and that is the second contract. It would double the 6apaci~y of the South Plant ..... expand it to 10 million gallon a day with the ability to treat ammonia. Lehman/ Are we going to phase out the North Plant totally? Schmadeke/ Not in this contract. The North Plant will still function .... What happens when we have to treat ammonia the effective capacity of that North Plant is just about cut in half. So we have to transfer substantial flows to the South Plant to meet the ammonia requirement. Thisrepresents only areasonably accurate transcription ofthelowa City council meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 25 Kubby/ To completely phase out the North Plant we have to make additional improvement to the South Plant when we want to do that. Schmadeke/ That is right. We are hoping we can get through to the year 2012 ..... Baker/ When this project is completed, how much additional capacity...? Schmadeke/ About 7% ..... The reason there is 7% in there ... internal piping... in South Plant .... is all in place .... Have this 7% excess capacity. Horow/ .... by 2012 is the point we need to duplicate the South Plant footprint as it is right now. Sohmadeke/ That is right ..... Horow/ The footprint we have now is good, essentially, to 2012 at which point we really need another footprint. Schmadeke/ That is right. Problem we might face is what is going to happen to growth between now and 2012 and what is going to happen with the old portion of the North Plant ..... Kubby/ Contract #2... increase in the building size .... Schmadeke/ There is increase in the sludge de-watering facilities. It enhances out ability to digest the sludge .... Horow/ Let's get a picture of the project schedules. Arkins/ We have a separate presentation on the financing... Schedule/ Contract #1 and Contract #2 we are proposing to let in Thisrepresents only areasonably accurate transcription ~ theIowa City council meeting of May 22,1995. WS052295 May 22, 1995 council Work Session Page 26 October of this year. Contract #3 we will wait and see at what point they are constructing these facilities and we will dovetail the letting of those contracts to match this work. Nov/ ...when do you expect actual construction? Schmadeke/ Probably won't start until the first of the year. On the Water Facility we also have three objectives .... One is to find higher quality source water and we are going to be utilizing ground water to enhance well water quality. Second is to improve the quality and quantity of the treated water and to improve the pressure and water flows in our distribution system. We have the Water Facility project divided into three parts, each one taking two years to construct. The first part is 1995-1996... constructing the two silurian wells .... pump test on one closest to the river .... drill the two silurian wells on the peninsula site and the Jordan well on the treatment plant site .... raw water piping .... Initial construction of well drilling .... well water plating... install ump... electrical components ..... CHANGE TAPE TO REEL 95-66 SIDE 1 (Refers to map) ..... Improve our quality and quantity of water available at the existing site. Kubby/ Schmadeke/ Horow/ Schmadeke/ This is just the raw water piping. Once the new plant is constructed we can reverse the flow, take the water to the new plant site and then the Jordan Well at the existing plant site ..... can utilize that Jordan Well also. In addition... looking at improving the pumping capability at the existing water source tanks ..... Nov/ Schmadeke/ Internal components... Kubby/ Raw water piping, some that pipes that we are going to need... additional costs because we are thinking of phasing those in. Are those broken out in any way. Schmadeke/ The only part of this project that we may consider not doing if we were not going to phase it would be the line from Foster Road to the plant. We probably would not use that Jordan well at the plant if we weren't phasing. Kubby/ Do you know how much that pipe costs? Schmadeke/ I don't have that exact figure with me .... less than the cost ~f the Jordan Well .... useful life of Jordan well is somewhat limited .... Kubby/ Important to know .... costs to phasing it .... Schmadeke/ Also if we use this ASR that we have been talking about ...... There are some benefits of putting this pipeline in. In addition to that we are looking at preparing ourselves to begin developing the water plant site and the purchase of the Iowa River Power Dam and improvements to that structure .... Sanitary sewer extension to the site, the relocation of the Williams Brothers Pipeline and pond stabilization... at the site. Nov/ Tell me some more about the Williams Brothers Pipeline ..... Schmadeke/ What we are recommending is moving it off of our site ..... (refers to map). What we are proposing is that they relocate it to an existing easement that they now have along the south side of the interstate (refers to map). So it would be off of our site .... Couple of options... hone it out and use it for a fiber optics line ..... Work with them to negotiate some kind of lease. Pigott/ Schmadeke/ The estimate that our consultant has developed. Baker/ Pigott/ ..... How did you decide which ones go in which phase? ..... Schmadeke/ One is cost to try to equalize these parts as much as we Thisrepresents only a reasonably accurate transcription of ~elowe Citycouncil meeting of May 22,1995. Another one is the inspection work ..... double up on some of the inspection activities and they can watch two projects at one time ..... easier to supervise the work. Kubby/ ...might be some improvements that might need to be made... where are those costs? Schmadeke/ Probably be doing those improvements under any circumstance .... Kubby/ Amount of the investment in the current facility would be the same whether we phase this in or not? Schmadeke/ I think so .... Baker/ Timing of those is independent of this as well? Moreno/ That is correct. Kubby/ Do you have any idea of the costs of that is? Moreno/ Not exactly .... rebuilding filters...bringing in new coagulants... looking at $150,000 a year... depending also on how things go ..... We may have a mechanical breakdown. Schmadeke/ Total cost of this Part 1 is $5,128,000 and included in that would be the land costs. Horow/ Costs and project construction proposal that has emerged after the value analysis that was done? Schmadeke/ That is right. Atkins/ The value engineering is not finished yet. We still have another crack at that. Horow/ Schmadeke/ Their emphasis was primarily on the treatment plant costs ..... Arkins/ Please note the dates. This was 1995-96 .... Woito/ Land costs ..... Schmadeke/ They are included in this Part 1. It would be in addition to the site. Thisrepresents only a reasonably accuratetranscription ofthelowa City council meeting of May 22,1995. Schmadeke/ Part 2 is 1997-1998. In here we start making improvements we will utilize on the new site. The collector wells .... sand pit pump station .... river intake .... finished water mains .... (refers to drawing/map) ..... include access road and lagoons on the plant site. Kubby/ If we didn't extend First Avenue and the timing for extending Scott Blvd. worked with this ..... Schmadeke/ (Refers to map) ...... Pretty expensive. And this is the configuration on the lagoons that we developed (refers to map). They are about $150,000 per cell additional costs to have like a kidney shaped. The location of these lagoons it would be difficult to even see them from the roadway or from this lower level. Nov/ ...Additional lagoon, where would that be on this drawing? Schmadeke/ (Refers to map). Horow/ Schmadeke/ (Refers to map). You could probably get two more in here. That is the completion of the 1997-98 work. Total cost of that work is $9,708,000. Part 3 is treatment plant itself. That contract would be let in 1999 and when that work is completed it will be about a two year construction period. When that work is completed then the existing water treatment plant demolition and booster station on that site would be constructed. Lehman/ How much water...get from the wells we will be drilling? Schmadeke/ From the Silurian wells it is about 1 1/2 gallons a day. From the Jordan, each Jordan well will be about that same amount. Silurian wells ..... I think we would only use those for quality control .... We have these collector wells, we will get about 7 1/2 million gallons. Lehman/ 12 million gallons a day out of the wells. WS052295 May 22, 1995 Council Work Session Page 30 Schmadeke/ 3.8 we are talking about taking out of the river. Lehman/ May be periods where we will be taking almost all of our water out of the wells. Schmadeke/ That is right. Kubby/ With some of the changes... reducing drastically the percentage of the water that we will be consistently taking our of the river which means a higher quality going into the plant ..... Lehman/ .... flexibility here ..... Horow/ Don- Don Yucuis/ (Refers to Water Rate Options Charts) This is one of the options...Point out FY95 figures is what is already in place. 35% rate increase effective for bills that went out March 1. This option 1 is showing selling bonds for the entire... project. It includes one year's worth of debt service which would be a requirement when we are selling revenue bonds to have an additional one year's amount in a savings account invested .... We have a $ 2 million construction account ..... So included in this $46 1/2 million is about $4 million of a reserve. Based on selling bonds all at once, the projected rate increases aren't much different than the prior proposals that we had on the wastewater. Looking at a 40% rate increase next March and pretty much maintenance increases down the road ..... 5%, 5%, and 5% ..... another requirement that we have to look at .... within our revenue bonds and that adds to the need for rate increases down the road. Kubby/ Don't we need to start having rate increases sometime before 2012 date preparing for the next template of that wastewater treatment plant? Yucuis/ We have not factored that in. Atkins/ We proposed that once before you recall and that was rejected. Kubby/ That was a different council. Lehman/ Thisrepresents only areasonably accuratetranscription oftholowa Citycouncil meeting of May 22,1995. WS052295 May 22, 1995 · · Council Work Session Page 31 Arkins/ We can prepare that for you. Kubby/ Don't find ourselves in the same situation .... Arkins/ That can be factored in the perspective rate increase. ¥ucuis/ Also on this chart shows some of the larger users .... impact is on an average monthly bill for sewer on a large user. Baker/ ¥ucuis/ Nov/ Yucuis/ Just a little note on the differences on the interest rates. A 7% bond is $4 million and a 6.5% is about $3.8 million. It is $200,000 a year difference. So the lower the rate, the better on these. Kubby/ Atkins/ Yucuis/ Suggested option...split up the bond issue into two calendar years .... breaking it into two. What that does is deferred when we have to start paying back that... rate increase... spread out over a different time period ..... Baker/ (Can't hear). Yucuis/ The debt service on the bond service that would be sold right now would start to be paid off in FY97. The bonds that are issued in '97 would start to be paid off in '98. We need to generate cash to make those payments is why you are seeing a little bigger jump in '98 .... only have $2 million in the first year .... The next one is the water rate option... Chuck did it .... Three phases and breaking those up into three different bond issue years, '95, '97 and '99. And based on that scenario and selling bonds ...spread those rate increases out over time a little more ..... This option shows pretty much spreading it out over the 5-6 year period .... Horow/ Thisrepresents only aroasonably accurate transcription ofthelowa City council meeting of May 22, 1995. WS052295 May 22, 1995 Council Work Session Page 32 Yucuis/ In doing these rate increase what I didn't want to do is generate a lot of additional cash on hand. Maintain a sufficient cash balance but not have one that is escalating ..... On these water revenue bonds we will have these same bond restrictions and bond covenants we do on the sewer bonds ..... Set up a reserve of one years debt service and this proposal includes the one year debt service ..... Baker/ (Can't hear) ..... Atkins/ Yucuis/ You could use it to pay off part of the project. Once you issue the bonds you can't accelerate the principle payments on the bonds that are already issued ..... Baker/ Somewhere near the end you can pay off, can't you? Arkins/ There are call provisions in the bond issue but you just can't sell extra bonds and put the money in the bank ..... Baker/ ...when you get closer to the end you can pay off- Atkins/ Your debt service reserve...you can pay off your last months- Lehman/ .... What are the advantages of using GO Bonds along with these bonds...? Yucuis/ The advantage of a GO is you don't have to set up a reserve and there are two ways to repay the bond debt. One is through property taxes or two, through user fees ..... Over the years we have been selling GO debt for water and sewer projects .... The disadvantage to the users if we do a GO issue and specifically pay it with property taxes is you have a whole bunch of people who don't pay property taxes that are big ~sers .... University .... schools, ourselves, VA, Mercy .... Arkins/ We could put together a revenue GO issue and sell the GO bond...retire that debt through utility revenues ..... GO is Aaa rated ..... lower interest rate ..... Yucuis/ Atkins/ Doesn't mean we cannot blend the financing ..... GO debt is very very low. Thisrepresents only a reasonably accurate transcription oftha[ow8 City council meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 33 Nov/ We had lower interest rates the last time we had GO bonds ..... ¥ucuis/ We are looking at doubling the length of the term .... higher interest rate .... Atkins/ ...It is out intent to look at some sort of a blending ..... Yucuis/ ...yes we can blend it. The recormmendation will probably be to use user fees to repay the debt. Our bonding capacity... $65-70 million of available debt capacity that we could issue on GO. Revenue bonds is based on ability top repay the debt. Kubby/ ..... Does that affect our Aaa rating? Atkins/ The more debt you are in certainly has some affect on it ..... we pay it off so rapidly .... whole series of things. Kubby/ I would like to find out at what point do we cross a line... Atkins/ And we will do that analysis for you when the time comes. The market is going to decide it .... Kubby/ Looking at other projects that might be coming forth .... to use GO bonding .... Atkins/ We do CIP next week... you don't want to burn up all of your GO debt. You want to make sure you have some flexibility built up in there ..... Kubby/ With either of the options...phased way... are there moneys being accumulated so we don't have to borrow so much money. Yucuis/ I have not taken the rates and said okay out of this project in '98 we are going to pay $2 million in cash on hand. It can be done. Pigott/ Can we do that? Arkins/ Sure. Kubby/ Because one of the things that we talked about when we looked at the six options in the past was .... we wanted to look at bonding out 100%, accumulating 100% and something in between. And it doesn't seem like tonight those options are before us. This represents only areasonebly accuratetranscription ofthelowa City coun~l meeting of May 22,1995. WS052295 May 22, 1995 . Council Work Session Page 34 Atkins/ They are deliberately not before you. Kubby/ But that is what we wanted. Atkins/ We chose to present to you- You can have any number of options imaginable. You just tell us what you want. Tonight was intended to give you a construction schedule, getting this work under way, that is how we can finance it. If you accept the schedule, we can work with that almost any way reasonable that you want. If you want to accumulate cash, you tell us .... Kubby/ That is where the policy considerations come in because with this framework... the construction table is what is driving the decision and there may be other considerations that we want to be driving the decision. Atkins/ If you wish to accumulate cash then just add something to the rate adjustments. Pigott/ Would accumulation of cash change construction schedule...? Arkins/ The construction schedule that we believe that we have given you is the best available option given everything that we have heard today. And if you chose to amend that construction schedule obviously that affects the borrowing that occurs. Baker/ Is the construction schedule driven by the financing or by regulations? Arkins/ I believe the construction schedule for the wastewater plant is driven by regulation. The water project you have far more latitude in. That is why we gave you a six year schedule on the water plant. If you would like to make it shorter or longer we can adjust those now anyway you want. Baker/ On wastewater, it is your clear understanding that we have to do it as soon as possible. Atkins/ We have been instructed to do this project as soon as possible ..... October '95. Anything beyond that is not as soon as possible .... Kubby/ What if the question...have the City inquired with the DNR about negotiating that soon as possible? Atkins/ No, we have not. We have a plan that has been approved. And Thisrepresents only areasonably accuratetranscrlptlon ofthelowa City council meeting of May22,1995. WS052295 May 22, 1995 Council Work Session Page 35 that if you instruct me to do that I will say to them in a form of a letter that we wish to postpone that and their question to me would be why and I need an answer for that. Horow/ Council has given staff an indication .... wastewater is one that we wanted to get done. Pigoft/ That is not my understanding .... Woito/ About four years ago we did check with DNR and EPA and State Code is written such that we were suppose to be- suppose to have until year 2000 a moratorium on the ammonia. EPA came in and said sorry state, we don't like your law, we are going to overrule it ..... That is EPA position. They do not believe the DNR has that authority. In terms of supremacy law, EPA is going to win that out .... I wouldn't take that on a bet. We explored that five years ago. Atklns/ You have a choice to postpone this project if you are willing to accept the consequences. Kubby/ I don't accept that as a consequence until we check that out. Atkins/ The consequences are that if we choose to postpone we will continue to put ammonia in the river. We are already in violation. If you choose to do that that is your call. If you want me to go to the DNR and say we want to postpone this for whatever reasons we choose to do, that is fine. We could end Up with a consent decree which is what happened to us last time. Baker/ Woito/ Federal law, EPA has already come out against the DNR regulation. They don't agree with it. They are litigating it. Kubby/ Maybe what we need to do is make the request to DNR and EPA if that is council's choice .... Atkins/ You have to make a policy matter whether you are going to build it in October or some other date, pick the sate and get approval. Kubby/ Woito/ We need to know explicitly that you want to do that. Thisrepresents only areesonably eccuratetranscrlpUon ofthelowa City council meeting of May 22,1995. WS052295 May 22, 1995 Council Work Session Page 36 Atkins/ The rationale for the delay. We will have to discuss that. Pigott/ My rational would be affect the consumer in burden on the tax payer, two fold. One is ..... how does it our city and would it lighten the the fee payer, in Iowa City .... Atkins/ The framework of the project is not going to change dramatically. If you choose to buy time, that is your call as long as you understand the consequences .... The project itself can be started at a later date, that is your decision. The EPA- we have asked and they have told us no. We have an approved plan in 1995 when we submitted it and that has been approved by the DNR and they are preparing our permit now. If you wish to alter that permit, tell me, and I will go to the DNR and ask that that permit be altered. Ask. Lehman/ I think there is a larger question here than DNR .... problems because we have put things off .... If we wait two more years it is going to be that much closer to the water plant ..... We have possibilities of construction season problems ..... Our track record I don't think is real good. Pigott/ .... I think it is how do we best serve the people... without putting a huge burden on them ..... Horow/ I haven't seen that many people interested in considering other options .... Barkers have done very good work... Don't see a predominate number of people come out ..... Kubby/ Reason for phasing... is not to borrow same amount of money in different years. My interests ...is to accumulate money so you don't have those interest ~ayments .... Lehman/ .... Kubby/ Baker/ I am still trying to get clear what a good rational is for phasing the purchase of bonds .... by phasing over a longer period of time the construction requirements .... two projects, water and wastewater. Wastewater is discharged down stream outside of Iowa City. Is there a legitimate reason... to say we want to delay the construction of that plant? ..... Still going to be accumulating money in the long run to lessen the total cost of that plant. Water and wastewater is two different projects .... More concerned about the water coming into Iowa City than the wastewater discharge going out of Iowa Thisrepresents only areasonably accuretetranscrlptlon ofthelowe City council meeting of May 22,1995, WS052295 May 22, 1995 Council Work Session Page 37 City ...... That was accepted to us to wait that ten years. Baker/ ...On water ...two concern which are financial and also the fact we have a plant... that is wearing out. That has got to be replaced. The water project... is what we have got to do .... getting that project on line as soon as possible .... How do we balance that out with the cost that consumers are going to have to pay. I don't mind bashing in the water project .... Kubby/ What is the purpose of phasing it in...? Baker/ I have not problem with accumulating cash for the water plant .... We can only do that if we raise rates now .... and phase in the expenditures. Atkins/ We can give you a rate adjustment that accumulates cash for you. Baker/ Nov/ Pigott/ Construction schedule .... we would get some cleaner water in the first phase anyway so that we would get some bang for out buck .... Baker/ .... rates are going to go up regardless and they are going to go up substantially and it just depends on how much we accumulate .... Pigott/ Baker/ Horow/ Because we went through the project we saw there were a number of issues on the wastewater... three contracts .... some This represents only a reasonably accurate transcription of the Iowa City council meeting of May 22, 1995. Baker/ Horow/ I am trying to figure out just exactly what is driving this. Baker/ We need clarification on what happens if we went to the DNR ...start project in fall of 1996 ..... They are going to say yes or no .... Pigott/ Horow/ It really doesn't affect the bills. The bills have gone up .... done essentially just postponed doing the construction on something that needs to be done. Kubby/ Let's look at sample options ..... different increases .... Nov/ This plan doesn't show ebbs and flows. Kubby/ I want to accumulate cash but I don't want ebb and flow. Is there a way to not have ebb and flow? .... some percentage? ..... What are the options ...list all the possible things .... Baker/ I don't think it is that complicated. What I think this council needs to decide as soon as possible is when are we going to start these projects? Date specific ..... Financing plan based on the fact that you want to start construction as soon as possible .... or plan that says start this date and we are going to start accumulating money on this date .... We have to pick up a date .... Schmadeke/ One thing on the wastewater~ We have a 7% growth factor built into that. I don't know what we are growing at but it is something over 1% a year. If we delay that project for three years .... now less than 4% growth factor. At some point in time...say...build this wastewater facility, in a short period , we are going to have to do something because of capacity... You reach a point if you delay too long that we are going to have to redesign to get more capacity and spend more money or put a moratorium on building. Kubby/ We also need to think about accumulating cash ..... 2012 we need to double the plant .... Nov/ Some of that could be done by eliminating the zero years .... Thisrepresents only areasonebly accuratetranscription ofthelowa Citycouncll meeting of Mey 22,1995. WS052295 May 22, 1995 . . Council Work Session Page 39 Horow/ EPA does into move quickly. Nov/ May not assume they are going to answer immediately. Baker/ We know the engineering .... let's say we agree not start one of these phasing options as of fall '95. Not clear from these financing options that we re accumulating enough money in the long run for our future .... Pigott/ ...depends on what you want to do .... Baker/ Financing can be done in two ways .... we ought to be considering a different financing plan that accumulates more money up front. Atkins/ I have no trouble with that but you need to pick a date for me. When do you want to build and in your scenario, you wish to accumulate cash and you wish to reduce interest by some number. That is all fine. We have got to pick a target date to build everything off of. Baker/ Kubby/ Atkins/ Karen, the date of construction does drive it ..... You have got to decide it is time to go with the project and pick a date. Kubby/ The inflation rate is lower than the interest rate .... Atkins/ You don't know that. That is an assumption ..... Kubby/ Atkins/ We don't really know. When you bid the project we know what it is going to cost then you fix your financing permanently. Pigott/ One of the goals... reduce the amount of bonding that we do... I am interested in looking at those options and comparing them here ..... Baker/ My concern is not the date .... I think we should pick a date specific. I am not satisfied with the financing proposals that have been put forward. My long term goal is to say... these projects have to be done...pick a date .... we are going to accumulate money that is going to go back into the projects. Atkins/ Karen, we have been chasing this is issue with no target. Tonight was intended to give you a target. You now have something to shoot at .... We tried to put together options to you .... get a schedule, get them a recommendation, financing, have at it. Tell me what you want done and we will get it done. Got to have target dates to cause things to occur. Pigott/ Sounds like there is at least some agreement investigating reduce bonding and expand accumulation of cash .... Arkins/ Accumulation of cash makes a great deal of sense .... Nov/ I don't believe if we had some this three years ago we would have that much cash ...... Atkins/ I was trying to build that policy into your debate. It was rejected. Kubby/ Horow/ Can we come down to agreeing on the target date for the wastewater treatment date? ' 9 NOV/ For the construction. Horow/ Yes. It is proposed to be let in October '95. Can we at least give them a target date so they can refigure the financing based on accumulation of more cash now to save in the long run? ...... Kubby/ The sooner we start the higher the rates will have to be ..... I am interested in pushing it back a little bit from what is currently proposed .... Arkins/ It will take some pretty healthy rate increases to get some cash .... Nov/ What about Option 2- Atkins/ Kubby/ Thlsrepresents only a reasonably accurate transcription oftholowa City council meeting of May 22,1995, WS052295 May 22, 1995 Council Work Session Page 41 Baker/ Atkins/ We have call provisions in bonds but as Don pointed out, the investors that buy these bonds have fixed amounts. They invest over the long period and you can't play with that. We can go back out and refinance but you can't pay off. There is a call provision normally after so many years. Yucuis/ Pigott/ Look at less bonding and more accumulation of cash .... Pushing back schedule on wastewater making it easier for us to accumulate cash .... Kubby/ Get two options back, both of which accumulate cash .... One with a sooner time frame and one with a slightly later time frame. Atkins/ What does slightly later mean?... Kubby/ Atkins/ To accumulate cash you need years. Kubby/ Arkins/ And you would have to get the approval of the DNR ..... That we are not going to comply with the schedules that you have approved, I have to tell them that .... Kubby/ Arkins/ Kubby/ Atkins/ My experience with negotiating with them in the past has been completely contrary to that .... I would like to have 24 hours to Kubby/ That is with the assumption of accumulation of cash? Horow/ I don't agree with it but I am in the minority and I will go along with it. I just absolutely disagree with the accumulation of cash ....... Arkins/ Kubby/ Horow/ Kubby/ What I was proposing is we 'look at accumulating cash within two options. 1-With an October '95 start date for the water plant and some other later dates. See what the differences are Nov/ Just water, not wastewater? Atkins/ Wastewater is what I heard you say. Kubby/ Wastewater. Pigott/ I would be in favor of doing that by running the numbers .... Atkins/ It is not difficult to run the numbers .... Kubby/ ..... I have had people say you should accumulate cash .... What would it take to accumulate 20% of the project in cash and what would the savings be? I don't have any of that information. Atkins/ Minor delay means a year. Nov/ If we are selling bonds in 1995 and we are not doing construction until 1996 a year delay would put construction into 1997. Is this reasonable? Kubby/ ...how much money do we want to save. I would like to suggest... let some of the cost savings drive some of the decisions. What would the rates be? What would the time frame be if we accumulated 20% of the project costs. Nov/ We also need to know what the construction increased costs would be. Atkins/ Keeping in mind that you have the affects of inflation .... bond market .... changes in regulation ..... So many unknowns out there. There is a substantial risk that you are taking Baker/ Get clarification... did we all agree to start the water project this fall? Kubby/ No, the wastewater. Baker/ I said I had no problems with the water facility construction schedule as proposed ..... Atkins/ I understood that you wanted cash accumulated to water also. Pigott/ That is right. Nov/ We have discussed it back and forth, true, and I have some reservations about having told people we are collecting this 35% increase in order to do some construction and then backing off ..... Kubby/ Nov/ .... I thought it was saying that we may not need as many wells... I never heard this let's start accumulating cash and be flexible as just delaying a date. Kubby/ Delaying makes it sound like we are just postponing some decision but the affect of that is saving lots of money for people over the long haul. Lehman/ I don't think you are delaying as long as you are collecting the increased rates .... Pigott/ And you are planning for the construction and moving ahead with the project .... Nov/ ..... Kubby/ We bought land, we are testing on the wells ..... So there is movement that we can point to. Horow/ Can we get back here to some dates? You said you needed 24 hours. Was that in reference to the wastewater? All right. And Ernie, you said wastewater, October '95. Naomi, where are you? Nov/ I have no problem with October '95. Horow/ All right. So there are three of us with and you are going to let us know tomorrow? Baker/ Yeah, I want to talk to Steve and Don and Chuck ..... Horow/ The numbers that Steve and Don are going to look at then are at Karen's request in terms of beginning later and by later, what is it that we- Kubby/ I wanted to see some options- I was talking about options of saying- Arkins/ For wastewater? Kubby/ I want to look at it for both. I am proposing it for both. The other part of it was that this also also be accumulating cash even if it is the date of October '95. I want to make sure that is clarified. To look at the numbers starting october '95 with also accumulation of cash. Horow/ The increased percentage. Baker/ Wastewater timing. Horow/ We are waiting for you to tell us tomorrow and then Steve and Don are going to start generating- Baker/ Clear that we finish tonight talking about scheduling wastewater (can't hear). And I have said I have no problems with this construction thing with water as proposed tonight. Pigott/ of we My feeling, I don't want the date to determine the savings cash. We don't have to accumulate on the front end. Baker/ Water rate options, option 3 .... I hope we have accumulated substantial part of money .... Horow/ Give me a run down on starting the water project. We have already gone through- Lehman/ We need to test wells .... I think we really have to do that. Horow/ ...Chuck, when were you planning on going out for contract for bid on construction for part 1 that you gave us this evening? Schmadeke/ The Silurian wells would be this summer. The Jordan well would be this summer. The renovation of the ground water storage tanks would be this summer. And then the rest of it would be in the fall. Horow/ Okay, essentially summer and fall of '95. Larry, that is where you are? Schmadeke/ That is to tie the well water to the existing plant. The rest of the work would be in '96. Are there public safety, public health, or technical aspects that will not allow us-Are some of those so far off that we are being irresponsible in any way? ...... Atkins/ I don't believe that anything you have done is irresponsible. I do believe that some of the things you are proposing to do is risky. There is a bog difference there. It is a calculated risk and that is what we are taking. Kubby/ When we are presented with those options I would like to better understand what the risks are, financially, environmentally, public health wise and the ability of our facilities- Atkins/ You want a risk assessment. Pigott/ Kubby/ We have an amendment where we used to not allow any private wells in the city and now we are going to allow them. I don't understand... I need some explanation. Woito/ There is a gentleman that lives in a rural area just west of Walnut Ridge and he is far enough away from city water .... extraordinary circumstances. Chuck recommends approval. Lehman/ Nov/ My concerns about the wells .... how do we know that somebody did it? Woito/ They have to get a well permit from the county .... they keep on top of that stuff. Kubby/ That response of Vince Neary to Steve's response to his inquiry. The most interesting thing for me was the last sentence saying that they is a strong argument for the city hiring an environmentalist specialist looking at environmental issues .... May be.something .... may need to be a building inspector whose main area of expertise is looking at these issues .... I found that real interesting .... 6. Kubby/ I would ask that Steve in 3-60 days follow up to see that the Corp talked to the DNR about the filter stripping stuff from that one letter. Horow/ Where did this Colonel Cox come in? I thought he had left. Kubby/ No, he's the new guy. I think I want to call over. 7. Kubby/ Sensitive Areas Committee requested a change in the date from July i to September 1. I would like us to say okay. Horow/ I agree. Pigott/ They mentioned once the ordinance is completed, they plan to present it at...community groups... include community groups in the formulation of that ordinance? ..... Arkins/ Made up of a pretty broad .... lots of folks fingers in this thing .... Nov/ Changes can still be made... Kubby/ 8. Kubby/ There was a section of the Site Plan Ordinance that was removed prior to its approval but we got a copy again years ago and I guess I am interested in adding it back to the Site Plan Ordinance and it was making sure that things in the Site Plan Review Process fit into not only its self but into the surrounding neighborhoods .... design issue again .... Should be put in on the informal agenda .... Like early fall. Horow/ Great. 9. Pigott/ We got a memo about the RNC zone and wondered whether we will talk about it at some later date. That is all. Atkins/ Schedule it. Kubby/ Make sure that the memo is sent to Nancy Carlson on Jefferson Street? She is in the phone book. Atkins/ Nov/ When I included this article from the Des Moines Register I was also thinking of the RNC-12 zone. We were confronted with a situation where somebody had added onto s.f. residence, created a duplex, has a potential of 10 individuals in there and this article says ...if those ten individuals are this kind of people we can regulate it. However if it is those kind of people, we cannot and those kind of people among the list was recovering drug addicts and college students are not protecting while recovering drug addicts are in a s.f. So think about this in terms of RNC-12 zones. 10. Nov/ I have another question here about the West Side Park and the easement and the sidewalk or whatever they are calling that walkway. On most of the recent agreements for walkways we have had a 15 foot easement and eight foot walk. In this one we are having a six foot walk and I want to know why. Woito/ The walkways were already approved. This is just to remove the cloud on the title. Nov/ ...original plat...six foot' walkway was the standard .... I am saying now we are including eight foot walkways .... Can we say we will put it in that way...require it...and the property owner's fee is up to $16,000 or whatever they put in the escrow.
