Miklo/ First item is the continuation of the p.h. on the exterior
stairwell and corridor amendments. You have before you two
options. One is the ordinance that you have been considering
previously. The second option would be an ordinance requiring
review of the exterior stairwells but the actual design
guidelines would be by resolution. If you chose the second
option you could have the first reading of that ordinance and
then the resolution would come later when you have the pass
and adopt.

I have a couple of questions. The new system of ordinance or
resolution, no one is mentioning the exterior lifts which were
in the first ordinance required to be screened and roofed.
Miklo/ That should be in there.
Nov/
It should be in there, right, yes. Also I am not sure why we
have one guideline saying you should not do this if it is
facing the street and the other one says if it is facing front
yard. Are. they both the same or not?
Miklo/ Which guideline?
Nov/ I am looking for wording.
Miklo/ I think the intent was the same.

If the intent is the same then in each instance that guideline
should say front yard or the guideline should say street. But
not this way in one place and that way another place .......
Miklo/ I think they should say street.
Franklin/ I would agree. It should say street because the term
front yard is sometimes ambiguous and sometimes the side yard
is the front yard and people don't know that.
Nov/ What we are most concerned about is the street.
Kubby/ Does anyone have a problem with the concept of making the
ordinance just say you have to live by these guidelines and
then having the guidelines be a separate document?

Baker/ I want a clarification... the original proposal came in just
for the front side of the building, right?
Miklo/ The original proposal is very similar to the guidelines in
both the ordinance and the guidelines included with the
resolution. There was a request by Glenn Siders to regulate
only on the front.
Kubby/ And we said no at the meeting.
Baker/ ...So the way this is written now it would be all four sides
of the building?
Miklo/ Right.
Baker/ Second thought .... reservations about all four sides but not
strong reservations except on corner lots. Back of building is
less of a concern to me than a side that is visible .....
Kubby/ A lot of apartment buildings, their main entrances are in
the back ..... those alleys ..... then there is people living on
the other side of the alley that are also residences that have
to deal with that sight.
Miklo/ One of the concerns of the two architects that was on the
original committee that drafted the guidelines .... is if there
is no regulation of them on the back that is almost an
incentive to put them on the back and we would get more of the
buildings without a front door as a result.

Also, even if they are on the back having a roof to protect
them from snow and ice is still a good idea. Bob, I found the
two things that seem to be in conflict ..... Guidelines, page
2, #4 says that corridors should not be on the elevation that
faces the street. #5 said exterior stairwells located on the
side that is facing the front yard and it would seem to me
that if you said facing a street in both instances you would

get where you want to go.
Miklo/ We will make that correction as well as add the lifts which
I think was just accidently taken out.
Kubby/ We clarified that at the meeting. So I am glad you caught
that.
Baker/ Does that mean that an alley is not a street? So-
Nov/ I think it does provide less restriction if you are facing an
alley or if you are facing a backyard. At least I assume that.
But you are still we discourage open stairwells, period .....
Kubby/ There were some other issues that were brought up as a
result of this discussion which we probably shouldn't get into
now but at some point there were four things .... that we
should probably talk about sometime .... They don't have
anything to do specifically with exterior stairwells but were
another result of that meeting.
Horow/ All right ....
Kubby/ So if Bob doesn't forget those and get them on paper
sometime.

by requiring City approval of designs for exterior
stairwells and exterior corridors on multi-family
residential buildings. (First consideration)

Public hearing on an amendment to the Comprehensive
Plan to adopt "IOWA CITY: BEYOND 2000 -- Iowa
City's Vision for the Future."
Franklin/ I am going to abbreviate my comments but this is the
first time you all have seen this... highlight a couple of
things. In the overall statement that begins this the issues
that I think are important to point out are the ones

inclusivity, accessibility and attractiveness in the community
and inclusive concept of it talks about including a diverse
set of people, housing, and jobs ..... that diversity and
inclusiveness goes beyond just talking about people
specifically. Accessibility means physical as well as
financial accessibility. So that is related to the
affordability issue. Attractive in the community is attractive
visually but also in the sense that Iowa City is a community
that people will find attractive to live in. Will find
desirable to live in. I want to highlight some of the major
issues ..... main ones that came up before the P/Z Commission
are in the memo that I sent to you. The concept of a definite
visible edge which is specifically in the land use section,
that had some debate in the P/Z Commission but it was
retained ...... That you know when you are entering Iowa City
and when you are leaving it and how you define that edge is
what we will have to get to when we talk about how we are
going to implement and achieve this vision. And it can be from
how you do development at that edge to acquiring land and
preserving that area or somehow preserving that area as a
greenbelt around the community ...... What this does as a
vision statement is set that out as a goal and the debate in
P/Z was about whether it was achievable or not ..... We are
talking about the vision that we have for the future and
achieveability is what we are going to have to work on .....
The consensus finally of the Commission was that or the
majority vote of the Commission as that the definite visible
edge should be retained in the mission statement. An issue of
neighborhoods and this is in the Housing section as well as
Land Use and Urban Pattern and I want to point it out...aoming
up as we look at specific development projects. The vision
statement advocates the preservation protection of the
integrity of existing neighborhoods. It also talks about sense
of neighborhood and neighborhoods being diverse areas that
have different housing types and different people and
different land uses .... a sense of neighborhood .... commercial
space as well as residential uses ..... churches and schools
..... I think you are going to grapple with as you take this
concept and try to make it a reality is defining what a
neighborhood is. For some people a neighborhood is strictly
s.f. detached housing and so to talk about the concept of
neighborhood in anything that has diversity is difficult. So
protecting existing neighborhoods and their integrity,
creating these new neighborhoods could come out with a pattern
that we have these integrated diverse neighborhoods only on
the edge... out in the new areas .... What this envisions...
having these diverse neighborhoods throughout the city. The

reality of that and what we are able to achieve I am not sure
~about how we are going to get there ..... not clear as to how
we are going to accomplish that ..... In the Social Services
section, the P/Z Commission did make somewhat of a change ....
the section was strongest in terms of the task force language
about what the .... city government will do in the area of
social services ..... That language was soft need to not be as
definite as what the task force had put forward ...... I don't
know that is an issue that you will get any input from the
public about. One issue that you will get input from the
public about... was the issue of inclusion. How to express
inclusion and that is exactly what it is .... It is a matter of
expression ..... Goals of both of these views is to include
persons with disabilities in any of our considerations for the
future of this city. But it is a question of how to express it
and whether we and all of those who follow us will read all
citizens as in fact being all citizens and not lose the
emphasis that came through in many of the task force
statements regarding persons with disabilities. And so I think
what you are going to hear from the Johnson County Coalition
for persons with disabilities is that they feel that language
that says all citizens in the sections of this loses some of
that focus and emphasis that they, of course, would like to
have there, The Commission felt they retained the emphasis by
in the overall statement at the beginning of the document
defining what they meant by inclusion and in that section
specifically mentioning persons with disabilities.
Nov/ So they are saying we not only should mention it at the
beginning, we should mention it again on each page?
Franklin/ Let me refer you to an example. In P/R and Open Space. As
it is now stated the second goal, "Insure the programs and
facilities are accessible to all citizens." That previously
said insure that programs and facilities are accessible to all
citizens with special attention to the needs of those with
disabilities ...... The philosophy being that if you say all
citizens and George is here who is a very good spokesperson
for this, that when you say all citizens, that includes
everyone. And when you start to list you may exclude someone
by the very fact of the listing because you don't always know
every either special needs population or any kind of
population descriptor .....

Did anyone go beyond the citizen ..... foreign visitors in
town ..... are we excluding those people? Would we be better
off to say all persons?

Franklin/ Probably. We never discussed that.
Nov/ Or all residents .....
Franklin/ But then do you want to not accommodate visitors? To
truly get at the whole you would say all persons .....

Woito/ (Can't hear).
Kubby/ ..... I understand not wanting to exclude anybody. I don't
know if we could say for all people's including people with
disabilities or on top of every page to have a short concise
statement about what all citizens mean .... I think there are
some very legitimate reasons why people with disabilities want
to be specifically mentioned in this vision statement.
Horow/ .... wondered whether or not the inclusion of their position
.... on a separate page in the back would be more informative
as each decade goes along... more of an educated process .....
would actually educate people .... It is a matter of repetitive
education and I felt that the letter that they had, the
position that they take, is one of education that truly
citizens have to become more aware of ..... Educate them so
that citizen means more than the abled ..... short abstract.
Franklin/ One thing about a vision statement is you try to make it
as brief... as possible ..... Most of all this first statement
is going to be the statement that will describe out direction
into the next century. Then each of the different areas ....
What I am planning on doing with this is take, once you have
adopted it, is putting together some kind of .... publication
that we can get out that is going to be no more than a front
and back of a piece of paper that hopefully has some visuals
on it. That people then can take and identify with. And so
what I am trying to do is get these boxed statements to
crystalize your sense of these different topical areas of the
direction that you want to take. Now once this is all adopted
then we go to implementation and figuring out how we are going
to get there and that is going to be comprehensive ..... We
will do the plan that will get us to this point ..... I would
prefer if you want to have the emphasis on persons with
disabilities reinstated in here that you do it within the
context of each of the sections rather than have a separate
kind of section. I don't think a lot of people are going to
read this.

Kubby/ The intent in most of the statements .... to emphasize people
with disabilities .....
Franklin/ ~Fnat was being reacted to was the focus on persons with
disabilities ....... In the beginning statement there is a very
definite focus .....

...I read a letter from a nine year old that said please keep
the playground equipment accessible for older kids, not just
the preschoolers .... should put ages in that front statement
also.
Kubby/ We have a diverse age range of population.
Horow/ ...If you start enumerating them we are inevitably going to
lose...somebody .....

Nov/ I am inclined to add ages at the list in the front .... not
inclined to list on every page.
Kubby/ I don't want to make a decision until I have heard the p.h.
Franklin/ This is adopted by resolution and it is not on your
agenda for tomorrow night. One last thing I would like to say
about this is I think what this envisions is a very ambitious
goal and that it is going to require the commitment of the
personal energy of the people who live in Iowa City as well as
a lot of public and private resources. So that is something to
think about .....

use regulations of an approximate 1.63 acre lot
located on the west side of Waterfront Drive,
approximately 140 feet north of Stevens Drive from
CC-2, Community Commercial, to CI-1, Intensive

Consideration of an ordinance amending City Code
Title 14, Chapter 6, entitled "Zoning," Article N,
entitled, "Off Street Parking and Loading," to
reduce the amount of required off-street parking
spaces and amend the parking area design standards
in the CN-1, Neighborhood Commercial zone. (Pass

Consideration of an ordinance conditionally
amending the use regulations of approximately 34.21
acres located west of Taft Avenue along Court
Street extended from RS-5, Low Density Single-
Family Residential, to CN-1, Neighborhood
Co~lmercial (6.93 acres), RM-12, Low Density Multi-
Family Residential (12 acres), and RS-8, Medium
Density Single-Family Residential (8.14 and 7.14

Miklo/ Is pass and adopt for Windsor Ridge rezoning ....
ITEM NO. 5g.
Consider a resolution approving the preliminary
plat of East Hill Subdivision, a 36-1ot, 13.11 acre
residential subdivision located at 655 Meadow
Street. (SUB95-0009)
Miklo/ Preliminary Plat of East Hill Subdivision. This needs to be
deferred to your June 6 meeting. We were anticipating the
grading and erosion control plan being approved. There are
some technical problems with that and it is not approved yet.
Kubby/ Was there any discussion at P/Z? ..... strong minority who
were saying that that up to 72 units that we may not be
inclined to go up that high ....
Miklo/ There were members of the public who spoke at the P/Z
meeting asking for a lower density. The Commission voted
unanimously that evening to go with 36 lots .... result in 72
units and I believe they based their decision on the secondary
access guideline which would allow approximately 500 vehicles
trips per day for 70 some units.
Pigott/ It mentioned in the note that the Fire Department expressed
reservations regarding secondary access .... Did we know that
before?
Miklo/ The Fire Marshall... has requested that there be a second
way in and out ...... reiterated that concern .....

ITEM NO. 5h.
Consider a letter to the Johnson County Board of
Supervisors recommending approval, with conditions,
of an application submitted by Alan Weinstein for a
conditional use permit to allow a home business, an
art gallery, for property located in Fringe Area 5
at 3800 Owl Song Lane, S.E., immediately north of
Iverness Court and east of Arlington Drive.
Miklo/ A letter to the County Board of Supervisors regarding a
conditional use permit. This property is surrounded by Windsor
Ridge Development ..... If the city objects, it requires 4/5
votes from the County Board of Supervisors. P/Z and staff are
recommending approval subject to a time limit of two
years ..... requirement.
Kubby/ Could you explain that 4/5?
Miklo/ That is a provision in the County Zoning ordinance that says
if a city which includes this conditional use property as part
of its extraterritorial review objects to the issuance of that
permit, then it requires 4/5 Board of Supervisors to vote
approval.
Kubby/ But we are saying we agreed to this.
Miklo/ Subject to these conditions .....
Kubby/ Really it doesn't mean anything ..... If the county says yes
to the permit without the two year condition, bow that affects
going back to getting those seven lots in. How does the
decision that we make here or that the county makes affects
the ability to get those seven lots back into the city? ....
Miklo/ I am not sure there is a connection.
Kubby/ Because that land could be annexed .....
Nov/ Does anyone know whether there will be parking built?
Miklo/ There will not be any parking built ..... There is an
existing circular driveway that they will use .....
Kubby/ Was it this applicant's position that they didn't want those
seven lots annexed? That they wanted to live in a rural area?

Miklo/ That may have been part of the reason .... applicant... had
an understanding with Gary Watts who wanted to annex the land
for the lots that they would work out some sort of real estate
swap and until that occurs... he would object to further
annexation.

Program for Improving Neighborhoods Neighborhood Council
Recommendations 95-65 S1
Klingaman/ Tomorrow evening council is going to be looking at a
resolution for approving the distribution of $25,000 in funds
for the use by neighborhood associations... improvement to
their neighborhoods. The Neighborhood Council... named this
program PIN ..... Neighborhood Council...busy... designing
criteria, developing the application, and also establishing a
method by means to evaluate the applications .... Run through
what the applications consisted of... Northside... and
Longfellow... trees in their neighborhoods .... Grant Wood
Neighborhood applied for $5,000 for planting trees in
Whispering Meadows Wetlands park .....
Baker/ Got any idea how many trees?
Klingaman/ No. In terms of all of these applications, some you will
see be more specific than others ..... Wanted them to at least
work through the process ..... I know the Northside and
Longfellow are expecting to get 4-5 trees planted for the
$1,000 .....
Horow/ Marcia, I would like to follow up...April 12 minutes of P/R
seem to raise some questions .... doing Longfellow Neighborhood
Association one ..... I question .... wasn't clear to me ...
Commissions whether there was a consensus from everyone...
Klingaman/ The Neighborhood Council spent at least two meetings
having neighborhoods present their applications .... As far as
Ralston Creek is concerned there were some rough estimates
done .....
Horow/ .... the timing of it.
Klingaman/ That is the only application that there was a fairly
substantial contingency w6rked into it .....
Kubby/ So that money is sitting there and it won't get spent until
the subdivision-
Klingaman/ It can't. It is private property at this point.
Kubby/ It will be earmarked for that project? ......
Klingaman/ I would expect the neighborhood .... going ~.o either have
to reallocate ...... I would certainly include the city
council in that process.

Pigoft/ Is there a requirement if they can't spend the money before
June 1996 they have to give it back...?
Klingaman/ If it is not spent by June 30, '96. It is FY96 funding
so it would have to be returned at that point. I would
encourage the Neighborhood Council .... that there be some
discussion ...reallocate it ....
Horow/ Grant Wood .... P/R minutes... that there was money remaining
in the wetlands park budget... city could possibly accommodate
the request for a few trees ..... This was rejected by the
council?
Klingaman/ Within the budget that I understand that P/R has for the
wetland park, that did not include planting trees .....
Kubby/
Klingaman/ We had a full discussion of are these funds possibly
going to be utilized for something that would have been
ordinarily been funded next year or five years down the
line .... came up time and time again ..... Neighborhood wants to
see it happen before that ....

We have a Neighborhood Fund and we have a city Parkland
Improvement Fund and I am a little confused about why all of
this money from supposed Neighborhood Fund is being put into
city wide park.
Klingaman/ I think that is something we are going to see on a city
wide basis .... If there are improvements in the neighborhood
they tend to be in the public property .... If neighborhoods
are thinking ...... of improvements... that they sit down long
before .... with staff to discuss what those interests are .....
Nov/ ...seems to me if we already have city funds designated for
this purpose, why are we doing fund raising?
Klingaman/ Whether they are specifically designated in any of these
cases, that was always the question, particularly with park
development and park improvements ..... Something maybe P/R and
neighborhoods need to work through.
Nov/ Need a little bit more in terms of guidelines ....

Then the Scott Park Improvement Project .... One comment. It
was a very good process for the Neighborhood Council...

Council put an upper limit on a single grant.

here to talk about the specifics of the ordinance. Gary had a
memo in your packet that describes the process .....
Information ..... had been distributed... 50 copies...
Apartment Owners Association meeting .... information has gone
out .... Ordinance... is it is not controversial... has been
around for quite some time .... Has been mailed out several
occasions ..... There are a couple of things on the Consent
Calendar that deal with Public Housing, if you have any
questions about that I will be here and I can answer those
questions ....

Lehman/ One of the changes regards painting exterior surfaces and
I think the guideline says shall be properly primed and
painted .... What does the word properly mean?
Klinefelter/ That the proper preparation is done.
Lehman/ What does proper mean?
Klinefelter/ According to manufacturer's instructions for the
product that you use.

Pigott/ So if it is peeling and chipping it is not properly
maintained?
Lehman/ One of the concerns that I have is that I think that there
is a broad base for interpretation ..... intent I totally agree
with. The enforcement .... not necessarily applied. Is there
any was of making that any more explicit?
Klinefelter/ I think even if you make it more explicit in the code
you have always got variables with the individual inspectors
...... There is a lot of interpretation on that... You just go
out and make the best judgement call that you can .....
Lehman/ If we could be more explicit I think it could be better
Klinefelter/ I don't think that area has been much of a problem ....

then one day they get cited for not properly primed paint ....

meeting in May ..... What we did is a survey of contract rents
and found that the one bedroom contract rent for the
certificate program .... was $392 .... Fair market rent for a
one bedroom apartment is $400 ...... The recommendation is to

to proceed on the wastewater and water projects ...... memo...
We are indicating we move ahead immediately with the
wastewater project and we will show you the proposed phasing
of the water project ..... what it might mean with respect to
utility rates... We are getting to the point where we need to
have some direction so that we can begin packaging these
projects..,many other peripheral issues that I have not
attended to... local policy... If I could, allow Chuck to step
through the projects...wastewater and water, major elements to
it. Don follow up with the financing... And then I will need
some expression of interest on whether this is a satisfactory
schedule and policy for you.

Arkins/ Remember that there are many elements to this and that they

Schmadeke/ I would like to start with the wastewater facility
project. There is basically three objectives to this project.
One is remove ammonia from wastewater effluent; to begin the
phase out of the North Plant and to provide sanitary sewer
service in that lower river area.
The first contract is the South River Corridor Interceptor
Sewer and that is shown on this drawing here (refers to map)
....... Our maximum depth on this sewer routing is through
Napoleon Park ...... We will essentially wipe out those ball
diamonds that are adjacent to the sewer lines ...... Part of
the project will be to rebuild these ball diamonds along
Napoleon Park.
Horow/ Will that be in the season when they are normally
used...relocating?
Schmadeke/ I have been working with Terry Trueblood on it. There
will probably be one season... we have a lost season. I don't
think there is any doubt about that ....

the CIP, the seven year program and I think it was scheduled
for FY97 which would be about the time we would be in this

frame for doing this project... what would make sense into

have like a kidney shaped. The location of these lagoons it
would be difficult to even see them from the roadway or from

existing water treatment plant demolition and booster station
on that site would be constructed.
Lehman/ How much water...get from the wells we will be drilling?
Schmadeke/ From the Silurian wells it is about 1 1/2 gallons a day.
From the Jordan, each Jordan well will be about that same
amount. Silurian wells ..... I think we would only use those for
quality control .... We have these collector wells, we will get
about 7 1/2 million gallons.

place. 35% rate increase effective for bills that went out
March 1. This option 1 is showing selling bonds for the

revenue bonds to have an additional one year's amount in a
savings account invested .... We have a $ 2 million
construction account ..... So included in this $46 1/2 million
is about $4 million of a reserve. Based on selling bonds all
at once, the projected rate increases aren't much different
than the prior proposals that we had on the wastewater.
Looking at a 40% rate increase next March and pretty much
maintenance increases down the road ..... 5%, 5%, and 5% .....
another requirement that we have to look at .... within our
revenue bonds and that adds to the need for rate increases
down the road.
Kubby/ Don't we need to start having rate increases sometime before
2012 date preparing for the next template of that wastewater
treatment plant?
Yucuis/ We have not factored that in.

and there are two ways to repay the bond debt. One is through
property taxes or two, through user fees ..... Over the years
we have been selling GO debt for water and sewer projects ....
The disadvantage to the users if we do a GO issue and
specifically pay it with property taxes is you have a whole
bunch of people who don't pay property taxes that are big
~sers .... University .... schools, ourselves, VA, Mercy ....
Arkins/ We could put together a revenue GO issue and sell the GO
bond...retire that debt through utility revenues ..... GO is
Aaa rated ..... lower interest rate .....

Woito/ About four years ago we did check with DNR and EPA and State
Code is written such that we were suppose to be- suppose to
have until year 2000 a moratorium on the ammonia. EPA came in
and said sorry state, we don't like your law, we are going to
overrule it ..... That is EPA position. They do not believe the
DNR has that authority. In terms of supremacy law, EPA is
going to win that out .... I wouldn't take that on a bet. We
explored that five years ago.

was also thinking of the RNC-12 zone. We were confronted with
a situation where somebody had added onto s.f. residence,
created a duplex, has a potential of 10 individuals in there
and this article says ...if those ten individuals are this

of people, we cannot and those kind of people among the list
was recovering drug addicts and college students are not

10. Nov/ I have another question here about the West Side Park and
the easement and the sidewalk or whatever they are calling
that walkway. On most of the recent agreements for walkways we
have had a 15 foot easement and eight foot walk. In this one
we are having a six foot walk and I want to know why.
