NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: A public hearing on the plans, specifications, form of contract, and estimate of cost for the construction of the above-mentioned project is to be held on the 28th day of February, 1995, at 7:30 p.m. in the Council Chambers, Civic Center, Iowa City, Iowa. The City Clerk is hereby authorized and directed to publish notice of the public hearing for the above-named project in a newspaper published at least once weekly and having a general circulation in the city, not less than four (4) nor more than twenty (20) days before said hearing. IN CONSIDERATION OF THE MUTUAL PROMISES CONTAINED HEREIN THE PARTIES AGREE AS FOLLOWS: The Owner hereby grants and conveys to the City, an easement for the purposes of excavating for and the installation, replacement, maintenance and use of a separate water main and such conduits as the City shall from time to time elect for conveying water, together with all necessary appliances and fittings for use in connection with said lines, together with adequate protection thereof, and also a right-of-way ~:ith right of ingress and egress thereto, over and across the area described on the ten (10) foot water main easement, a copy of which is attached hereto and by this reference made a part hereof. The Owner further grants to the City the following rights in connection with the above: 1. The right to grade said easement area for the full width thereof, and the right to extend the cuts and fills for such grading into and on said land along and outside of said easement area, to such extent as the City may find reasonably necessary. 2. The right, from time to time, to trim, cut down and clear away all trees and brush on said easement area, and on either side of the easement area which now or hereafter in the opinion of the city may be a hazard to said easement area, or may interfere with the exercise of the City's rights hereunder in any manner. The City shall promptly backfill any trench made by it, and re- pair any damages caused by the City within the easement area. The City shall indemnify Owner against unreasonable loss or damage which may occur in the negligent exercise of the easement rights by this City. Except as expressly provided herein, the city shall have no responsibility for maintaining the easement area. The Owner reserves the right to use said easement area for pur- poses which will not interfere with the City's full enjoyment of its rights hereby granted; provided, that the Owner shall not erect or construct any building, fence or other structures; plant any trees, drill or operate any well; or construct any reservoirs or other --2" obstructions on said easement area; or diminish or substantially add to the ground cover over said easement area. Nothing in this Agreement shall be construed to impose a re- quirement on the City to install the original public improvements at issue herein. Nor shall the Owner be deemed acting as the City's agent during the original construction and installation of said improvement. The parties agree that the obligation to install the public improvement herein shall be in accordance with City specifications, and the obligation shall remain on the Owner until completion by the Owner, and until acceptance by the City, as pro- vided by law. The Owner hereby covenants with the City that it is lawfully seized and possessed of the real estate described above, and that it has good and lawful right to convey it or any part thereof. The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective parties hereto, and all covenants shall be deemed to apply to and run with the land and with the title to the land. BACKGROUND INFORMATION: The applicant, David Larsen, is proposing a four lot, commercial subdivision on the remaining 6.41 acres of the site where Menards is now located. The site was conditionally zoned C1-1 in February, 1993. The proposed subdivision will need to be reviewed for compliance with the Conditional Zoning Agreement (CZA), as well as other pertinent City Codes. ANALYSIS: Zonin~ Ordinance Compliance General: The proposed subdivision is located within a C1-1, Intensive Commercial, zone. All of the proposed lots meet the dimensional requirements specified within the Zoning Ordinance for property located in the C1-1 Zone. Conditional Zoning Agreement: Two conditions from the CZA are pertinent to the proposed subdivision, The remaining conditions are more appropriately addressed at the time of site plan approval. The first condition is that the site shall have only one vehicular access point to Highway 1. The proposed subdivision complies with this condition. The common access drive constructed with development of the Menards site serves as the sole access point for all lots within the proposed subdivision. The other pertinent condition is that the site will have an internal circulation drive which will provide access to any development within the annexed property, as well as access to property located to the north and south of the Dane tract. The proposed plat contains a 28-foot access easement which provides access to all of the proposed lots as well as to properties located both north and south of the proposed subdivision. Although the adjacent properties are currently undeveloped this condition provides for traffic circulation between the subject property and adjacent properties without having to access Highway 1 when the adjacent properties develop. Subdivision Code Compliance Storm Water Nlanagement: The applicants have submitted preliminary stormwater calculations, which are being reviewed by the Public Works Department. The area shown on the plat will accommodate the required stormwater storage for the subdivision. The applicant is pursuing expansion of the existing detention basin on the Menards property to accommo- date stormwater from the proposed subdivision. An agreement between Menards and the applicant will be required at the time of final plat approval if the Menards basin is to be expanded. 3 Grading and Erosion Control Plan: A Grading and Erosion Control Plan is required for the subdivision because it is located within a 100-year floodplain, The Plan has been submitted and is being reviewed by the Public Works Department. How much would it cost to underground the overhead electrical from College Street to Court Street? If the project is constructed in 1995, the cost would be about $528,000 and would be completed in 1996. If the project is constructed in 1996, the cost would be about $450,000. These are rough cost estimates. What is the duration of the bridge project? If traffic is maintained on Burlington Street, the project is expected to take one full construction season, April 15 to Nove~er 15. If traffic can be detoured, the project will take less time. 3. Can temporary plantings be included in the project to provide vegetation u~ntil redevelopment provides an opportunity for . permanent plantings? Sufficient space will be available (5'to 7') to plant small trees along Gilbert Street, however the trees would be much closer than the IDOT recon~ends for this type of facility. Six feet is available along the east leg of Burlington Street, but it is unlikely the IDOT would allow plantings this close to Highway 1. A minimum 10' clear zone is their standard. Other issues relevant to the scheduling of this project: 1. The IDOT advises that the bridge project may be delayed because of soils contaminated with gas and coal tar in areas that they will need to acquire for additional right-of-way to accommodate the bridge project. Because of the possible delay and the safety benefits of the intersection improvements, the IDOT recommends proceeding this summer. 2. The State contribution of $200,000 remains constant, while the ~ cost of the project increases annually because of inflation. The net effect of delay is an increase in the City's share of the project. (over) 3. Combining the bridge project with the intersection improvements would require converting the intersection plans to metric. Since the XDOT design standards for metric are different than for standard units, a simple conversion of units is not possible. Redesign to the new standard will add 30% to 40% to the design effort. Based on this information, Staff recommends proceeding with the project this sur~uer. Recently, the City of Iowa City has begun efforts to locate and utilize an increased amount of ground-water sources for its public supply. They offer several water- quality advantages over river water including: less turbidity, lower nitrate and pesticide concentrations, lower algae and other microbiological populations, and a reduced potential for contamination due to surface spills and leaks. Present plans call for determining Iowa City's water supply by combining withdrawals from both the Silurian and Jordan aquifers with water from the Iowa River and its alluvial aquifer. There are currently (1994) a variety of users utilizing the Silurian aquifer in Johnson County. These users include: the municipalities of Coralville, North Liberty, and Tiffin; the University of Iowa; a variety of rural and suburban residential communities in the vicinity of Coralville Lake; and a limited number ofself-suppfied commercial and industrial businesses. Some of the users in the immediate vicinity of the new water treatment plant and Silurian supply wells to be constructed along the east side of the Iowa River, north of Interstate 80 have expressed concern regarding the effects of future City of Iowa City withdrawals on their individual wells. There is a need to collect water-level information from the aquifers in the Iowa City/ Coralville area to determine the hydrologic conditions of the aquifer. Information on the location and amounts of other Silurian aquifer use in the area needs to be obtained to understand and evaluate fluctuations in the Silurian aquifer water levels. The collected information can be stored and made available to governmental agencies as well as the public. Public information, education, and involvement in many aspects of the new water plant, well construction efforts, and local hydrologic conditions will be key factors.in the success of these projects. This information will be useful for: (1) the evaluation and testing of new public supply wells at the proposed new water plant site by Iowa City or their agent, Howard R. Green; (2) part of an assessment of the effects of Iowa City Silurian aquifer withdrawals on nearby wells; (3) scientific, unbiased data to mitigate potential future disputes regarding the effects of Iowa City withdrawals on nearby wells; and (4) for future evaluations of the water supply potential of local aquifers. A proposal to provide assistance to the City of Iowa City to address these needs is presented. Objectives The primary objectives of the proposed assistance are: 2/15/95 I I) to collect water-level data from the Iowa City/Coralville area. The data need to be collected in a uniform, consistent, and accurate manner on a regularly scheduled basis. Appropriate quality control and quality assurance (QC/QA) procedures need to be in place to document the quality and reliability of the information. Additional information to supplement the water-level data needs to be collected that includes but is not limited to: location, depth, well construction details, and pumped rates. 2) to inventory and document the location, rate, amount, and timing of present Silurian aquifer usage in the Iowa City/Coralville area. This information is needed to understand and interpret the fluctuations in water levels of the Silurian aquifer and to be used for initial estimates of the impact of City of Iowa City withdrawals on nearby wells. 3) to compile and store the water-level and supplemental data in a long-term data base for retrieval and use by governmental agencies and public inquiries. Data needs to be stored in a tested and proven data base that supports a variety of retrieval options and users. 4) to provide hydrologic expertise in public education and outreach activities in partnership with City of Iowa City, Johnson County, and Iowa Department of Natural Resources - Geological Survey Bureau (IDNR-GSB) during the project. Work Elements Water-level Measurements Water levels are currently (1994) being collected from observation wells in the Iowa City/ Coralville area as pan of a cooperative program between the U.S. Geological Survey and IDNR-GSB (Table 1). The frequency of measurement and the spatial coverage of the well network are not sufficient to meet the needs described above. The frequency of measurement using manual, steel tape measurements in these wells can easily be increased at minimal cost. There also are several area wells that have been discontinued as part of the network that can be reactivated to provide additional spatial coverage. It may also be possible to drill or obtain permission to measure water levels in other m'ea wells. Water levels from wells that are measured can be used by Iowa City in the testing and evaluation of future public supply wells at the new water treatment plant. The installation of continuous water-level recording devices at a limited number of wells should also be considered. Continuous water-level measurements can provide information critical to understanding of aquifer response to recharge and stresses caused by pumping. Permitted users or community supply wells will be inventorled; a complete inventory of all private domestic wells in the area is beyond the scope of this effort. Attempts will be made to contact each well owner to obtain information on well construction and withdrawal. Attempts also will be made to field locate each well for exact location and suitability for use as a future observation well. Database Water-level and well-construction data will be stored in the U.S. Geological Survey's Ground Water Site Index (GWSI) database. This database has been in use by the U.S. Geological Survey and cooperating agencies for a number of years and is the current repository for historical information on wells presently and formerly in the U.S. Geological Survey's well network. An example of an input form for the GWSI database is attached to illustrate the extent of the information that can be stored and retrieved. Data that have been entered and reviewed in the database arc public record and available upon request. Computer access to the database can be provided to Iowa City. Wells in the water-level measurement network will he referenced to a common vertical datum (sea level) using a Global Positioning Survey (GPS). Project Management and Assistance Scientists and staff of the U.S. Geological Survey will be available to present or assist with presentations that include public meetings, workshops, or field tours of data-collection sites and explanations of general ground-water hydrok.gic principles and the data that are being collected. Additionally, the U.S. Geological Survey will provide periodic progress reports and consult with coopera~ors and their representatives as needed as part of the overall management of this assistance project. Activities will be coordinated with the City of Iowa City, Johnson County, and IDNR-GSB. Additional outreach efforts ranging from poster presentations and newsletters to electronic displays of information are possible but have not been costed at this time. These include providing the information to the public through Internet, computer links to public facilities such as the Iowa City public library, or other means of public access. Timeframe/Budget The duration of the assistance to be provided to Iowa City under this agreement is three years. Efforts to expand the frequency and distribution of the well network should begin as soon as possible to collect baseline information prior to withdrawals by Iowa City and to populate a database useful by Iowa City and Howard R. Green in testing public supply wells 4 at the new water treatment plant site. Measurements from the well network should be continued until them is reasonable certainty that water levels in the aquifer have reached equilibnam with the withdrawals that are being made and that the effects of the withdrawals are I:nown. The frequency of water-level measurements can be adjusted (probably to longer intervals between measurements) as information is obtained and understanding of the aquifer system becomes known. The inventory of local Silurian wells should be completed prior to analysis of new well pump tests and estimating the effects of withdrawals on ground-water levels. Data will be archived in the GWSI database and are available at any time. Extensive education/outreach activities are available during the duration of the assistance project and routine continuing outreach efforts will be available upon request. Other committee members include representatives from the DNR-Iowa Geological Bureau, Johnson County Health Dept., and Howard R. Green. The intention of our meetings has been to develop an operational plan to perform some aquifer tests on the Silurian aquifer at the site acqoircd for the new water treatment plant. In addition, we would create a structure for other orgo~aJzations and individuals to participate in the testing and to receive information on xhe results of the testing. BACKGROUND Silurian aquifer production wells are anticipated for water supply use by the City of Iowa City. The results of a Silurian aquifer pumping test program should provide the data necessary for estimating well yields and the potential for overlapping influence on existing domestic, industrial, and municipal wells in the area. The proposed location for the pumping test is in the northwest comer of the plant site. Due to seasonal fluctuations of the water level in the Silurian aquifer, two pumping tests will be conducted at the proposed testing site; one generally corresponding to the seasonal low water level (high-demand period), and one generally corresponding to the seasonal high water level (low-demand period). OBJECTIVES In addition to the creation of an operational plan that can be commuuicated to interested parties, specific objectives of the pumping testing are: Page2 2. 3. 4. Determine the hydraulic characteristics of the Silurian aquifer at the pumping test site. Evaluate the degree of hydraulic connection between the Silurian aquifer and overlying Devonian beds, alluvial material, and the Iowa River. Determine if the drawdown pattern is directionally dependent or radially symmetric. Document influences on selected existing domestic, industrial, and municipal wells located in the area; and to project the extent of pumping influence on the other proposed Silurian production wells. Determine an optimal pumping rate and schedule for the tested production well. Recommendation regarding placement of an additional well at the plant site. Recommendation on inter-well spacing for additional Silurian wells south of the plant site. ASSESSMENT OF REGIONAL PUMPING INFLUENCES A~ attempt to assess the impact of Silurian aquifer development on Silurian wells in the north corridor will be made. Specifically, the impacts of pumping the Coralville Silurian wells will be correlated, if possible, to historical drawdown values in municipal or private wells in the north corridor. This assessment will be qualitative in nature and is intended to address concerns expressed by rural residents. USGS PROPOSAL To support the pump testing project for Iowa City, the USGS has submitted a proposal to the Dept. of Public Works. The proposal includes the following: 2. 3. 4. Creation of a data base to compile and store the information collected from wells in the Iowa City/Coralville area. Provide hydrologic expertise in public education and outreach activities in partnership with the City of Iowa City, Johnson County, and the Iowa Geological Bureau during the project. A network of wells has been identified that includes public, private and industrial users. Numerous contacts have been made with residents and housing developments in the area of the plant site requesting inclusion in the pump testing procedure and offering data. Page 3 TIME FRAME/BUDGET The duration of the assistance to be provided to Iowa City is anticipated to be approximately five (3) years. The initial pump test is scheduled for late spring to early summer of 1995. Data collection and compilation would occur prior to, during, and after the pump testing project. The USGS has proposed a cost sharing structure that could split the overall cost 50/50 with the City. The yearly breakdown would be $19,115 for 1995~ $20,225 for 1996, and $21,235 for 1997. The total cost to the City is $60,575. USGS HYDROLOGIC STUDY OF SILURIAN AQUIFER FOR THE NORTH CORRIDOR, JOHNSON COUNTY The USGS has also submitted a study proposal to the Johnson County Board of Supervisors to model the Silurian aquifer in the entire Johnson County area. This study would utilize data similar to that being compiled for the Iowa City pump testing project and create a model for the Silurian aquifer for the entire Johnson County area. This model could be utilized to ascertain the qualitative and quantitative characteristics of the Silurian aquifer now and for the future. The data that would be compiled from the Iowa City proposal would overlap some of the information necessary to perform the North Corridor Study. The approximate percentage of overlap for some of the steps common to both proposals ranges up to 60%. RECOMMENDATION I believe we have created a committee that can effectively support the process that the City needs to complete in order to fulfill on our plans to draw water from the Silurian Aquifer from in and around the plant site. The project of pump testing the Silurian Aquifer will need an extensive network of wells to be monitored prior, during, and after the actual test. We have received numerous requests from residents in the North Corridor area to participate in the project by submitting location, water level and construction data from their Silurian wells. Our consultant, Howard R. Green will be performing the pump test as part of their design contract. However, the collation and maintenance of the data that needs to be collected, maintained, and distributed was not part of their scope. And it is necessary that data be collected in a method that assures quality control and quality assurance. That assurance, coupled with the third party objective nature of the USGS would benefit the information and decisions that will ueed to be made by the City and IDNR regarding use of the Silurian aquifer now and into the future. Measurements from the well network should be continued until there is reasonable certainty that water levels in the aquifer have reached equilibrium with the withdrawals that are being made and that the effects of the withdrawals are known. The frequency of water-level measurements can be adjusted (probably to longer intervals between measurements) as information is obtained and understanding of the aquifer system becomes known. The inventory of local Silurian wells should be completed prior to analysis of new well pump tests and estimating the effects of withdrawals on ground-water levels. Data will be archived in the GWSI database and are available at any ti. me. RE: South T-hangar building Listed below is a partial history of events concerning the proposed hangar building at the Airport. June, 1993 - Cost estimates, building only, $ 140,000 to $ 185,000. January 18, 1994 - City Architect cost estimates, $ 184,200 to $ 264,000, including site work. e April 19, 1994 - Commission resolution endorsing construction of additional hangar building. May 10, 1994 - Council resolution authorizing the Commission to proceed with plans and specs and to construct a hangar building. Cost estimate - approximately $ 200,000. 5. August 2, 1994 - Commission public hearing on plans and specifications. August 24, 1994 - Aeronautical study application filed with FAA. 7. September 19, 1994 - Pre-bid conference. 8. October 3, 1994 - Bid opening. One bid received. $ 447,925. 9. October 3, 1994 - Commission meeting - bid rejected. 10. October 18, 1994 - Commission meeting - vote to revise plans and specifications and rebid project. 11. october 28, 1994 - Aeronautical study determination - no obstruction. 12. December 13, 1994 - Public hearing, plans and specifications. 13. January 19, 1995 - Pre-bid conference. 14. February 3, 1995 - Bid opening. Low bid - $ 250,746. February 13, 1995 - Meet with Council to discuss bid. This building is very similar to the T-hangar built in 1976. (see chart on following page). Rent for that building was $ 93.00 per hangar per month and the Commission received 50% of the rent. Iowa City Flying Service received the other 50%. At that rate, it would have taken 15.2 years to pay the principle of $ 84,880.00. The building is listed as having a 40 year depreciation life on our fixed asset file. The proposed T-hangar would have a similar depreciation life of 40 years and would require 16.7 years to repay the principle. Because this building is not included in Iowa City Flying Service's lease, the Airport would receive 100% of the hangar rent. The hangars would rent for $ 22.00 more per month than the hangars built in 1976. Although the low bid is higher than was estimated from the numbers generated when this project started in 1993, it appears to be a good bid. 1994 was a good year for the steel building industry. In discussing this bid with the contractor, he said because of the demand for steel buildings last year, the price of steel has increased 14 % to 20 % from last year. Based on the n~mber of requests he has had for estimates, he thought 1995 would see an increase in business from 1994. He projected that to lead to another increase in building prices. I have discussed this issue with Commission members and at their Commission meeting on February 14, they will be recommending that the bid from Henningsen Construction be accepted.
