RESOLUTION TO ISSUE DANCING PERMIT
BE IT RESOLVED BY THE CiTY COUNCIL OF iOWA CITY, IOWA, that a Dancing Permit as
provided by law is hereby granted to the following named person and at the following
described locations upon his filing an application, having endorsed thereon the certificates of

A RESOLUTION SETTING A PUBLIC HEARING ON PLANS, SPECIFICATIONS,
FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION
OF THE 1 995 ASPHALT RESURFAClNG PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA,
THAT:
A public hearing on the plans, specifications, form of contract, and estimate of cost
for the construction of the above-mentioned project is to be held on the 25th day of
April, 1995, at 7:30 p.m. in the Council Chambers, Civic Center, Iowa City, Iowa.
The City Clerk is hereby authorized and directed to publish notice of the public hearing
for the above-named proposal in a newspaper published at least once weekly and
having a general circulation in the City, not less than four (4) nor more than twenty
(20) days before said hearing.
A copy of the plans, specifications, form of contract, and estimate of cost of the
construction of the above-named project is hereby ordered placed on file by the City
Engineer in the office of the City Clerk for public inspection.

at $ 55,400.00 with funding through the use of an internal loan; the Cemetery portion is $
4,475.00 with funding from the General Fund. Coralville's share is approximately $ 77,865.50.
The bulk of the project ($ 480,730.00) will be funded from Road Use Funds.

RESOLUTION NO. 95-78
RESOLUTION AUTHORIZING ABANDONED BICYCLE SALE TO BE HELD MAY 6, 1995
WHEREAS, the Police Department of the City of Iowa City, Iowa, has, during the past month,
stored a number of bicycles which have been abandoned by their owners; and
WHEREAS, the Police Department has made every effort to locate the owners of these
bicycles and has been unsuccessful in its efforts; and
WHEREAS, the number of bicycles which have accumulated have now become a storage
problem, and the same are a burden to the City of Iowa City; and
WHEREAS, it is in the public interest that said bicycles be sold at public auction to the highest
bidders,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The Police Chief is hereby authorized and directed to sell the abandoned bicycles at
public auction to the highest cash bidder therefore on May 6, 1995, 1 :OO p.m. in the
Chauncey Swan Parking Ramp, and that that notice of said sale shall be published in
the Iowa City Press-Citizen once each week for two consecutive weeks, the date of
the last publication being no more than one week prior to the day of sale.
The proceeds from the sale of these bicycles shall be paid to the public safety fund
portion of the budget of the City of Iowa City after first deducting therefrom the costs
of the sale.

RESOLUTION NO. 95-79
RESOLUTION AMENDING RESOLUTION 94-277 BY CHANGING
MEMBERSHIP REQUIREMENTS FOR THE DESIGN REVIEW COMMITTEE
FOR THE CITY OF IOWA CITY, IOWA AND APPROVING ITS BY-LAWS
WHEREAS, by Resolution No. 94-277, the City of Iowa City, Iowa, reestablished a Design
Review Committee to assist the City Council in the area of design review; and
WHEREAS, Resolution No. 94-277 permitted eligible electors of Johnson County to serve on
the Design Review Committee; and
WHEREAS, upon reviewing the membership requirements of all Iowa City Boards and
Commissions and in recognition of the impodance of consistency within all City Boards and
Commissions, the City Council Rules Committee recommended to require membership to
Boards and Commissions be limited to residents of Iowa City unless County representation
is desirable in recognition of a County budget contribution; and
WHEREAS, the City of Iowa City deems it desirable to permit only eligible electors of Iowa City
to serve on the Design Review Committee.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
Resolution No. 94-277 is hereby amended by deleting Paragraph 2a and adopting, in
lieu thereof, the following:
b. Membership. The Committee shall consist of nine (9) members. All Committee
members must be eligible electors of Iowa City. Members of the Committee
shall be appointed by the City Council with term membership to be three years,
commencing on July 1. Members may serve for more than one term. Non-
eligible electors of Iowa City serving on the Committee at the time of adoption
of this resolution may continue to serve as members of the Committee until their
terms expire.
The amended by-laws of the Iowa City Design Review Committee are hereby formally
adopted by the City Council.

IOWA CITY DESIGN REVIEW COMMITTEE
ARTICLE I.
MEETINGS
Section 1. Regular Meetinqs. Regular meetings of this Committee shall be held on the third
Monday of each month.
Section 2. Special Meetings. Special meetings of the members may be called by the Chairperson.
Upon the request of four members of the Committee, the Chairperson shall call a special meeting.
Section 3. Place of Meetings. Regular meetings shall be held in a facility accessible to people
with disabilities.
Section 4. Notice of Meetinq. Notice and agenda for all regular meetings shall be distributed to
all Committee members and the press. Notice to all members and to the media shall be at least
24 hours before a meeting is held including special meetings. All notice requirements and meet-
ings shall conform to the provisions of the State Open Meetings Law.
Section 5. Quorum. A majority of the members of the Committee shall constitute a quorum at any
meeting. A majority of votes cast at any meeting at which a quorum is present shall be decisive
of any motion or election.
Section 6. Proxies. There shall be no vote by proxy.
Section 7. Public Discussion, Time shall be made available during all regular meetings for open
public discussion.
ARTICLE II.
MEMBERSHIP
Section 1. Membership. The Design Review Committee shall consist of nine (9) members. All
Committee members must be eligible electors of Iowa City. All members of the Committee shall
serve without compensation, but shall be entitled to the necessary expenses including reasonable
travel expenses incurred in the discharge of their duties.
Section 2. Nomination. The City Council shall appoint members to the Design Review Committee
as vacancies occur.
Section 3. Terms. Terms of membership shall be three years, commencing on July 1. Members
may serve for more than one term.
Section 4. Absences. Three consecutive unexplained absences of a Committee member may
result in the Committee's recommendation to the City Council to remove the member from the
Committee, and to appoint a new member.
Section 5. Orientation for New Members. Prior to the first regular meeting following their appoint-
ment, new members shall be provided with copies of the pertinent portions of the City Code,
Design Review Committee By-Laws, and other documents useful to carrying out their duties.
Section 6. Resignations & Vacancies. If any member is no longer willing or able to serve on the
Committee, the member shall send a letter of resignation to the City Council. Vacancies occurring
in the Committee, other than by expiration of term of office, shall be filled only for the unexpired
term.
ARTICLE Ill.
OFFICERS
Section 1. Number. The officers of this Committee shall be a Chairperson and Vice-Chairperson,
and each shall be elected by members of the Committee.
Section 2. Election and Term of Office. The officers of this Committee shall be elected annually.
Section 3. Vacancies. A vacancy in either office shall be filled by a member elected for the
unexpired portion of the term.
Section 4. Chairperson. The Chairperson shall, when present, preside at all meetings of the
members, appoint committees, call special meetings and in general perform all duties of the
Chairperson, together with such other duties as may be prescribed by members from time to time.
Section 5. Vice-Chairperson. In the absence of the Chairperson, or in the event of the Chair-
person's death, inability or refusal to act, the Vice-Chairperson shall perform the duties of the
Chairperson. When so acting, the Vice-Chairperson shall have all the powers and be subject to
all the restrictions as those resting with the Chairperson.
ARTICLE iV.
CONDUCT OF COMMITTEE AFFAIRS
Section 1. Agenda. The Chairperson or a designated representative, together with appropriate
members of the City staff, shall prepare an agenda for all regular Committee meetings. Agendas
are to be sent to Committee members and the media at least three days prior to the regular
meetings.
Section 2. Secretan/. A secretary, not to be a Committee member, shall be provided by the City
for all regular and special meetings.
Section 3. Minutes. Minutes of all regular and special meetings are to be prepared and distributed
to Committee members, and approved by the Committee and sent to the City Council, in the
manner prescribed by the Council. Specific recommendations for the Council are to be set off from
the main body of the minutes and appropriately identified.
Section 4. Policies and Pro.qrams. The Committee shall periodically review the policies and
programs of the City relating to design review and make recommendations to the City Council
when appropriate.
Section 5. Referrals from Council. From time to time letters, requests for information, requests
for recommendations, and other matters are referred to the Committee by the City Council. The
Committee shall initiate the consideration of such items at the next regular meeting following
receipt of the referral, and shall notify Council of its disposition.
Section 6. Attendance at Council Meetings. The Committee Chairperson or designated represen-
tatives are to be in attendance at all City Council meetings, including informal sessions, at which
matters pertaining to the domain of the Committee's responsibilities are to be discussed or actions
taken. The Committee Chairperson is to receive Council agenda prior to each Council meeting,
and is to be otherwise notified of meetings involving Committee business.
Section 7. Annual Report. An annual report, detailing the activities of the Committee, shall be
prepared by the Chairperson, approved by the Committee, and submitted to the City Council at the
end of each fiscal year.
ARTICLE V.
AMENDMENTS
Section 1. These by-laws may be altered, amended or repealed and new by-laws adopted at any
regular meeting, or at a special meeting called for that purpose, providing a quorum is present.
Upon approval by the City Council, such by-laws shall take force and effect.

WHEREAS, the City of Iowa City desires to construct a sanitary sewer, lift station, and force
main in the Highlander area; and
WHEREAS, the City is obligated to undertake certain sanitary sewer improvements along
Highway 1, north of Interstate 80, as a condition of a CEBA grant; and
WHEREAS, the City of Iowa City desires to contract for the design of a sanitary sewer
extension, lift station, and force main; construction inspection services; project administration;
adjacent property owner liaison services; and other special services; and
WHEREAS, an Agreement for professional engineering services has been negotiated with
Shoemaker & Haaland, Professional Engineers of Coralville, Iowa; and
WHEREAS, it is in the public interest to enter into said Consultant's Agreement with
Shoemaker & Haaland, Professional Engineers.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that:
The Consultant's Agreement attached hereto is in the public interest, and is approved
as to form and content.
The Mayor and City Clerk are hereby authorized and directed to execute the attached

CONSULTANT AGREEMENT
THIS AGREEMENT, made and entered into this ltthday of April , 1995, by
and between the City of Iowa City, a municipal corporation, hereinafter referred to as
the City and Shoemaker & Haaland Professional Engineers, hereinafter referred to as the
Consultant.
Whereas the City desires to contract with the Consultant to assist with the design and
construction of improvements to the existing Highlander Lift Station and Force Main as
outlined in Alternate C of the Concept Derelopement Report prepared by the Consultant
and approved by the City and hereinafter referred to as the "Project."
NOW THEREFORE, it is agreed by and between the parties hereto that the City does
now contract with the Consultant to provide services as set forth herein.
I. SCOPE OF SERVICES
Consultant agrees to perform the following services for the City, and to do so in a
timely and satisfactory manner.
A. Design Phase
When directed to proceed by the City, the Consultant shall perform the following
services.
1. Coordination of lift station design with City Wastewater Superintendent.
Prepare the necessary applications with the Iowa Department of
Transportation to do work within the IDOT right of way.
Prepare the necessary applications with the Iowa Department of Natural
Resources and U.S. Army Corps of Engineers (if necessary) to construct
proposed wastewater systeru improvements.
4. Communicate with any affected utilities during the course of design.
Conduct periodic meetings with the City as necessary to review the status
of the Project.
Prepare final design, plans and specifications for the Project for a public
bid letting. Specifications shall incorporate the City's standard front end
documents and detailed specifications modified and supplemented as
necessary by the Consultant.
Furnish the City with two (2) copies of the Project Plans and Specifications
for final review and approval.
Upon final approval by the City of the design, plans and specifications,
prepare a final opinion of the Project's anticipated consauction cost.

Prepare and mail advance notice of project to prospective bidders at least
two weeks prior to public hearing.
Mail plans and specifications to contractors and suppliers upon their
request for said documents and payment of plan deposit.
Prepare resolutions for Council consideration of project (format provided

Bidding Phase.
Assist in tabulation and analysis of bids and furnish recommendation for

Project Administration Phase
If directed by City, the Consultant shall provide the following services:

Initiate, negotiate, review and approve all change orders required by the
construction, as prepared by the Contractor.
Coordinate, facilitate and attend bi-weekly construction meetings.
Prepare press releases, if necessary.
Initiate, review and execute monthly pay estimates prepared by the
Contractor, and submit to City Engineer with recommendation for
approval.
Upon Project completion, develop and review f'mal contract pay quantities
and Pay Estimate from as-built field measurements made by the Inspector
and Contractor, or from field and office records, and submit same to City
Engineer for approval.
Initiate, review and execute Certificates of Completion for City Council
acceptance. Draft agenda item accepting work (format to be provided by
the City).

Submit necessary documents to the IDOT stating completion of Project and
recommending acceptance upon their inspection and approval, if needed.

Have available at site, or in office, a full time representative who can
answer citizen's inquiries.

16. Obtain sales tax statement from Contractor.

C. Project Construction Inspection Phase
If directed by City, the Consultant shall provide periodic part-time on-site
inspection and documentation utilizing a technician or engineer with at least two
years experience in the inspection and construction of public improvement projects
similar to the proposed lift station and sewer system improvements.
D. Other Special Services
Provide legal research of property ownership and boundary lines and
preparation of property acquisition plats by tire or easement. Preparation
of legal descriptions and calculation of acquisition areas. Provide copies of
plats and descriptions to owner and assist legal depar'anent with
acquisitions.
Provide construction staking surveys and set construction stakes for lift
station, forze main and sanitary sewer construction and related surface
restorations.
Preparation of elementary sketches and supplementary sketches required to
resolve actual field conditions encountered.
Assist the City as expert witness in litigation arising from the development
of construction of the Project and in hearings before various approving and
regulatory agencies.
It is the understanding of the Consultant that the following work or information will be
provided by the City:
The City will provide plan drawings for the existing Lift Station and Force
Main and the City's utilities in the vicinity.
The City will provide plan drawings for the present neighboring Highway
I improvements.
The City will provide information on past lift station operating records and
pump calibration results.

The City will provide information and guidelines to be used by the
Consultant in planning for future sewage generation rates.
The City through it's Staff or other consultant shall provide topographic
contour mapping of the project, site and municipal utility information in
the vicinity of the Project.
The City will provide subsurface soil exploration for the design of the
Project as recommended by the Consultant and soils engineering
subconsultant. The Consultant will coordinate the work of the
subconsultant and the City will pay the subconsultant directly.
11. ThME OF COMPLETION
The Consultant shall complete the following phases of the Project in accordance with the
schedule shown. Time of completion may be affected by services to be provided by
others, as previously defined.
Preliminary Design Phase - 30 days after approval of the Preliminary Feasibility
Study and authorization to proceed by City.
Construction Documents Phase - 30 days after approval of the Preliminary Design
Phase and authorization to proceed by City.
HI. GENERAL TERMS
The Consultant shall not commit any of the following employment practices and
agrees to prohibit the following practices in any subcontracts.
To discharge or refuse to hire any individual because of their race, color,
religion, sex, national origin, disability, age, marital status, or sexual
orientation.
To discriminate against any individual in terms, conditions, or privileges of
employ~nent because of their race, color, religion, sex, national origin,
disability, age, marital status, or sexual orientation.
Should the City terminate this Agreement, the Consultant shall be paid for all
work and services performed up to the time of termination. However, such sums
shall not be greater than the "lump sum" amount listed in Section IV. The City
may terminate this Agreement upon seven (7) calendar days' written notice to the
Consultant.
This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be without the written consent of all
Parties to said Agreement.
It is understood and agreed that the retention of the Consultant by the City for the
purpose of the Project shall be as an independent contractor and shall be
exclusive, but the Consultant shall have the fight to employ such assistance as
may be required for the performance of the Project.

It is agreed by the City that all records and files pertaining to information needed
by the Consultant for the project shall be made available by said City upon
reasonable request from the Consultant. The City agrees to furnish all reasonable
assistance in the use of these records and fries.
It is further agreed that no Party to this Agreement shall perform contrary to any
state, federal, or local law or any of the ordinances of the City of Iowa City,
Iowa.
At the request of the City, the Consultant shall attend such meetings of the City
Council relative to the work set forth in this Agreement. Any requests made by
the City shall be given with reasonable notice to the Consultant to assure
attendance.
The Consultant agrees to furnish, upon termination of this Agreement and upon
demand by the City, copies of all basic notes and sketches, charts, computations,
and any other data prepared or obtained by the Consultant pursuant to this
Agreement without cost, and without restrictions or limitation as to the use
relative to specific projects covered under this Agreement. In such event, the
Consultant shall not be liable for the City's use of such documents on other
projects.
The Consultant agrees to furnish all reports, specifications, and drawings, with
the seal of a professional engineer affixed thereto or such seal as required by
Iowa law.
The City agrees to tender the Consultant all fees in a timely manner, except'init,
however, that failure of the Consultant to satisfactorily perform in accordance
with this Agreement shall constitute grounds for the City to withhold payment of
the amount sufficient to properly complete the Project in accordance with this
Agreement.
Should any section of this Agreement be found invalid, it is agreed that the
remaining portion shall continue in full force and effect as though severable from
the invalid portion.
Original contract drawing shall become the property of the City. The Consultant
shall be allowed to keep mylar reproducible copies for the Consultant's own filing
use.
Fees paid for securing approval of authorities having jurisdiction over Project will
be paid by the City.
COMPENSATION FOR SERVICES
Design Plan Phase - The Consultant shall be paid on a lump sum basis an amount
of $30,400.00
Project Administration Phase - The Consultant shall be paid on a lump sum basis
an amount of $4,000.00

Construction Inspection Phase - If directed to perform this phase by City, the
Consultant shall submit a detailed proposal for approval by City prior to providing
this service.

All provisions of the Agreement shall be reconciled in accordance with the
generally accepted standards of the Engineering Profession.
It is further agreed that there are no other considerations or monies contingent
upon or resulting from the execution of this Agreement, that it is the entire
Agreement, and that no other monies or considerations have been solicited.

Highlander Li~ Station Capital Project
In response to the City Council's request at your meetings of March 27 and 28,background information
is being provided on the staff's rationale for the proposed Highlander Lift station project.
In May 1993, the City Council undedook a capital projects priority setting process. The Highlander
Lift Station capacity expansion was rated as the second highest priority wastewater project. The West
Side trunk was the first priority and this project has been completed. The Highlander project received
a high priority from the Council based on an apparent desire to enable development in the
NCS/Northgate Corporate Park area and the nodh slope of the area south ot 1-80, all within the
corporate limits. Shodly after the priority setting, the City Council approved application for a CEBA
for NCS that included the expansion of the Highlander Lift Station as part of our local match.
As pad of tho capital project priority setting, the Council also gave a high priority to the extension of
Scott Boulevard from Rochester Avenue to Highway 1. The reasons for this priority appeared to be
two-fold: 1) the pemeption that the extension of Scolt Boulevard would dived a significant amount of
traffic from Nodh Dodge Street, and 2) interest in development of the Nodbeast Area of Iowa City
(south of 1-80) by the private sector and support from the Council for development in this area.
It is within the context of these decisions that the slaff has proceeded with the Highlander project. The
original project called for a capacity expansion in the lift station and extension of a trunk line under
Highway 1 and 1-80 1o the northern pad of the Krall farm in the Nodheast Area. The flint step in
carrying out a capital improvement project is to evaluate the project in the context of City plans and
policies and Council decisions that are pertinent to the project at the time the project is being built.
Planning and Public Works evaluated the Highlander project in the context of the service area for the
lift station, the City's growth policy, anticipated land uses, estimated timing of development from both
a public and private pempective, and the costs of the project-in the long-run and in the short-run.
Service area and growth policies: The ultimate service area for the lift station is based on topography
and anticipated development. The topography sets the physical limitations of the service area;
anticipated development is governed by policies and decisions of the Council. Combined, these
factors determine the ultimate service area. The service area presented to the Council at your last
set of meetings was a physical service area which can be modified by your and future Councils'
decisions. The service area the staff worked with in making our recommendation to you included the
topographic service area within the corporate limits and a relatively small area north of the corporate
limits where we anticipate development pressures if Scott Boulevard is extended. Moving the lift
station north along Highway 1 allows us to serve lhis area and prepares for the eventual extension of
the system to serve the area west of NCS that is in the corporate limits. Service to the area west of
NCS from the current location of the lift station is impeded by the NCS development. Otherwise the
service areas of the two lift station locations, current and proposed, can be the same with proper depth
at the southerly location (rebuilding the existing li~t station).

The adopted Comprehensive Plan anticipates development north of 1-80 within the corporate limits.
This development is not included in the phasing sequence since the projected land use is for Office
Research Development Centers. The growth policy did not anticipate annexation nodh of the existing
corporate limits in this location, however the decision to extend Scott Boulevard to Highway 1 will likely
precipitate some development pressures along the arterial street and we can expect in the long-run
annexation of 60-80 acres for urban development along Scott Boulevard. This possibility was taken
into account when evaluating the lift station.
Anticipated land uses and timinq: The size of the lift station is dependent upon the types of usem and
when it is likely the uses will be in place. The projected uses for most of the planned service area of
this litt station are office research development centers. We did anticipate also the possibility of some
residential development, padicularly in transitional areas and as a complement to well-planned office
research park developments. Because much of this development is not expected in the shod-run, the
lift station will be sized to handle expected short-run flows and will be constructed to allow for
upgrades. Any trunk lines will be sized for ultimate flows since it is not efficient to build in a need to
replace lines.
Costs: Although it may appear prudent in the short-run to build a smaller or more constrained facility,
if the long-term plans for an area dictate the need for a larger facility or a relocated facility, it is often
less expensive and wiser to install a facility which will serve the long-term needs of an area. We have
attempted to recommend such a facility in this case. We have also tried to minimize any "throw-
aways", that is, elements which may serve today's needs but will need to be redone or abandoned in
the future for an alternative facility. The original project, upon more detailed evaluation, would not
allow us to serve the entire planned service area and elements of that project would need to be
replaced, abandoned or reconstructed in the future.
Based on all of the above, we recommended to you Option C as presented at your last meeting (see
Option B & C attached). There are, however, essentially three options for the Council to consider that
we believe are viable:
.Option A Do nothing. Delay the capacity expansion of the Highlander Lift Station. NCS can function
with the current system, however further development in this area including Northgate Corporate Park
will be conslrained. We also will not have met our local match obligation for the CEBA; we are unsure
of the ramifications of this choice.
Option B Eliminate the existing lift station, construct the trunk sewer and lift station as shown in
Option B but do not extend the line east along the drainageway. This will allow some further
development south of the drainage swale east of Highway 1 but will require additional infrastructure
for full development within the corporate limits.
Option C Construct an additional lift station at the northerly site and extend a trunk line along the
drainage swale east of Highway 1. This will allow more extensive development in this area and will
set up the possibility of serving the area south of 1-80 (the Kmll farm). Development beyond the
corporate limits will be governed by the Council's decisions regarding the timing of construction of
Scott Boulevard and annexation.
Another option available to the City is to combine Options B and C which would consist of constructing
the lift station as shown in Option B and extending the trunk line as shown in Option C. The total
project cost would be $506,250, exceeding the $435,000 budget.
Staff will be available at your Monday and Tuesday night meetings if you wish to discuss this item.
