CONSIDER A MOTION SETTING A PUBLIC HEARING FOR DECEMBER 7, 2004 REGARDING IOWA CITY'S PROPOSED 2006-2010 CONSOLIDATED PLAN (a.k.a. CITY STEPS). Comment: As required by the U.S. Department of Housing and Community Development, a public hearing is being scheduled to solicit citizen input prior to the adoption of Iowa City's 2006-2010 Consolidated Plan (CITY STEPS). This public hearing is being set for December 7, 2004. A 30-day public comment period on the proposed CITY STEPS plan started on October 15, 2004. in addition to this public hearing, three public input meetings and two consultation meetings were held to gather citizen input. Also, the Housing and Community Development Commission (HCDC) held a public hearing on September 30, 2004 and at their November 18, 2004 meeting, HCDC is scheduled to make a recommendation to the Council concerning the adoption of the proposed CITY STEPS plan. 04- - :3oQ' 2. CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME LOCATED AT 718 HIGHLAND AVENUE TO A PUBLIC HOUSING PROGRAM TENANT AND SETTING A PUBLIC HEARING FOR DECEMBER 7, 2004. Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program, proposes to sell 718 Highland Avenue to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $123,000. The family has participated in the public housing program for twelve years. The applicant has been employed with the Iowa City Community School District for four and one-half years. The family has received a written commitment for a mortgage from a local bank in the amount of $92,250. The City will provide a second mortgage for the remaining $30,750. Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program, proposes to sell 1508 Dover Street to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $132,000. The family has participated in the public housing program for more than five years. The husband has been employed with the Iowa State Department of Corrections for six years and the wife has been self-employed for four and one-half years. The family has received a written commitment for a mortgage from a local bank in the amount of $99,000. The City will provide a second mortgage for the remaining $33,000. This sale will provide the opportunity for a low-income family to obtain ownership of their own home. 04- ~II 4. CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME LOCATED AT 2614 INDIGO COURT TO A PUBLIC HOUSING PROGRAM TENANT AND SETTING A PUBLIC HEARING FOR DECEMBER 7, 2004. Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program, proposes to sell 2614 Indigo Court to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $105,000. The family has participated in the public housing program for two years. The husband is employed at the University of Iowa and has his own lawn care business. The wife was previously employed at the University of Iowa, but is currently disabled. The family received a written commitment for a mortgage from a local bank in the amount of $84,000. The City will provide a second mortgage for the remaining $21,000. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST DOCUMENTATION FOR THE PARTIAL RELEASE OF A STORM WATER DETENTION BASIN EASEMENT AGREEMENT LOCATED ON LOT 22, APPLE RIDGE SUBDIVISION TO IOWA CITY, IOWA. Comment: As shown and granted in the final plat of Apple Ridge Subdivision, the City has a 0.5 acre storm water detention basin easement agreement on the above-referenced lot located within the Apple Ridge Subdivision at the northeast corner of Weeber Street and Edingale Drive. The owner of the subject property, KD3 Construction LLC, wishes to build on a portion of the easement area. The owner has requested that the City release a portion of the easement consisting of approximately 0.15 acres. The City Public Works Department has reviewed and considered the request, and recommends that the release of the existing easement be issued in exchange for a replacement storm water detention basin easement as well as a sanitary sewer easement. This resolution authorizes execution of the releases and agreements necessary to accomplish this. 04- 3f4 3. CONSIDER A RESOLUTION AMENDING THE CITY OF IOWA CITY COMMERCIAL DRIVER'S LICENSE SUBSTANCE ABUSE PREVENTION PROGRAM FOR DRUGS AND ALCOHOL BY AMENDING APPENDIX C AND AUTHORIZING THE CITY MANAGER TO MAKE NON-SUBSTANTIVE CHANGES IN THE FUTURE. Comment: This resolution amends Appendix C of the Commercial Driver's License Program to reflect a change in the list of Safety Sensitive positions. Changes to this appendix are necessitated by changes in job duties, as well as changes in job titles or the creation of new positions. The second part of this resolution authorizes the City Manager or designee to update the Program as required by changes in the federal law or other non-substantive changes such as this without requiring council action. Any major changes to the Program would continue to be presented to Council in the form of a resolution for action by Council. c<'+-- 31S 4. (SUB04-00030) Comment: At its October 21 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval subject to wetlands verification before City Council consideration. Staff recommended approval in a report dated October 21 subject to wetlands verification. A wetlands report has been received verifying that there are no wetlands present. This is an 8.95-acre, 47-lot residential subdivision located south of Whispering Meadows Drive and west of Pinto Lane. (Staff report included in Council packet). CONSIDER A RESOLUTION SETTING DATES OF A CONSULTATION AND 04- 3!7 PUBLIC HEARING ON PROPOSED AMENDMENT NO. 1 TO THE NORTHGATE CORPORATE PARK URBAN RENEWAL PLAN FOR THE CITY OF IOWA CITY. Comment: The City of Iowa City received a request by Southgate Development Company to expand the existing Northgate Corporate Park Urban Renewal Area. On October 12, 2004 the Council Economic Development Committee voted unanimously to recommend approval of the expansion of the Northgate Corporate Park Urban Renewal Area. By approving this agenda item the Council is setting the date for the required consultation meeting with other taxing jurisdictions as December 8, 2004 and setting a public hearing date for January 4, 2005. CONSIDER AN ORDINANCE AMENDING TITLE 5, "BUSINESS AND LICENSE ._g~- 4-14S REGULATIONS," CHAPTER 2, "VEHICLES FOR HIRE," SECTION 5-2-8 "VEHICLE FOR HIRE REQUIREMENTS," OF THE CITY CODE BY DELETING (B) . - "DISTINCTIVE COLOR SCHEME REQUIRED" AND REPLACING IT WITH A NEW (B) "DISTINCTIVE COLOR SCHEME REQUIRED" TO CLARIFY LANGUAGE. (SECOND CONSIDERATION) Comment: The current City Code does not state that each owner or operating company have one distinctive color scheme. CONSIDER AN ORDINANCE AMENDING CHAPTERS 5 AND 6 OF CITY CODE 04 - 1-1 46 TITLE 14 TO PROVIDE UPDATED REFERENCES TO SECTIONS IN THE UNIFORM - CODE THAT THE CITY RECENTLY ADOPTED AS ITS BUILDING CODE. (PASS AND ADOPT) Comment: In Ordinance No. 04-4117, the City adopted the International Building Code (IBC), along with certain local amendments, for its Building Code. The prior code adopted by the City was the Uniform Building Code (UBC). The City Code still includes a few references to the UBC instead of the equivalent section of the IBC. This ordinance simply amends those outdated references to the UBC so that references are now to the correct section of the IBC. Action: e9A~ /fC?~ I ( ~~7 7/0 . / ITEM 10. CONSIDER A RESOLUTION APPROVING THE 2004-2005 DEER MANAGEMENT PLAN FOR IOWA CITY. Comment: Each year, the City Council will consider a deer management plan based on the Long-Term Plan approved by the Council in March of 1998. The Resolution includes a recommendation for sharpshooting, as regulated by the DNR, within the corporate limits of Iowa City during the Winter of 2004-2005. Action: tJJo/f'.e0~ c4w ~ ~'r.J ITEM 11. CONSIDER A RESOLUTION SUPPORTING THE DEVELOPMENT OF AFFORDABLE HOUSING IN IOWA CITY BY WHISPERING GARDEN IHA LIMITED PARTNERSHIP. Comment: Whispering Garden IHA Limited Partnership is applying to the Iowa Finance Authority for financial assistance in the form of Low-Income Housing Tax Credits for the construction of 12 affordable housing units for families and persons with special needs. The project will leverage the Low-Income Housing Tax Credits with FY04 City HOME funds (Agreement signed on March 11, 2004) and private funds. Whispering Garden IHA Limited Partnership has asked the City Council for a resolution of support to assist them in meeting the scoring criteria for the Low-Income Housing Tax Credit program. CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE CITY _04" ~,~ MANAGER TO EXECUTE AND FILE AN APPLICATION WITH THE UNITED STATES DEPARTMENT OF TRANSPORTATION FOR A GRANT UNDER 49 U.S.C. 5307 AND/OR 5309, TO BE USED FOR FY05 TRANSIT OPERATING AND/OR CAPITAL ASSISTANCE FUNDING. Comment: JCCOG will be preparing the annual Federal Transit Administration [FTA] Section 5307 application on behalf of Iowa City Transit. Funding in the amount of $444,955 is being requested for FY05 transit operations. This is an increase of 1.3% from the FY04 operating apportionment. Action: tJi4lM1~~~ f)P;~ V"t7 I ITEM 13. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A DEDICATION OF SCHOOL SITE AND COST SHARING AGREEMENT BETWEEN CLEAR CREEK, LLC; SOUTHGATE DEVELOPMENT COMPANY, INC.; THE CITY OF IOWA CITY; AND THE CITY OF CORALVILLE Comment: In accordance with the parties' Memorandum of Understanding dated December 21, 2001 regarding the Clear Creek Master Plan and Camp Cardinal Road, this agreement provides for the conveyance to the Iowa City Community School District of a school site of 13 acres more or less within the area included within the Master Plan, and provides for cost sharing for the infrastructure necessary for the school site. Iowa City's obligation is to pay 1/6th of the cost of the portion of Kennedy Parkway that abuts the school site.
