Kubby/ The theme of the celebration this year is partners at work
which I think really epitomizes what CDBG is about because you
are putting together local lenders, local small contractors,
lower income households, service providers and everybody
coming together and I think that the CDBG moneys that come
into our community leverage $3.00, a 3:1 ration. So, it is a
really great thing and a neat thing to celebrate.

CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR
JULY 18, 1995, ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE IOWA CITY
SENIOR CENTER MASONRY RESTORATION PROJECT.
Comment: This exterior repair project of the Senior Center is
the second and final phase of a water proofing project to
eliminate water penetration at various points inside the
building. The project includes complete sealant and tuck
pointing of all stone and masonry of the exterior walls and
exterior stairs. The work should be completed in November
1995. The Engineer's estimate is 997,469 with funding
provided from an internal loan.

CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR
JULY 11, 1995, ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE CON-
STRUCTION OF THE LONGFELLOW AREA STORM AND
SANITARY SEWER PROJECT.
Comment: This project consists of the reconstruction of
approximately 1,400 linear feet of sanitary sewer and
construction of 2,150 linear feet of storm sewer. The project
also involves miscellaneous repairs to the sanitary sewer
system. Total estimated cost of this project is t~496,117.00.
Funding will be provided by General Obligation Bonds.

CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR
JULY 11, 1995 ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE CON-
STRUCTION OF THE LONGFELLOW AREA SANITARY SEWER
REHABILITATION PROJECT.
Comment: This project consists of root grinding and pressure
grouting of 1,332 joints on 8" vitrified clay sewer pipe. Total
estimated cost of this project is $39,815.44. Funding will be
provided by General Obligation Bonds.

CONSIDER A RESOLUTION SETTING PUBLIC HEARING FOR
JULY 11, 1995 ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE CON-
STRUCTION OF THE FAIRVIEW AVENUE/HIGH STREET
STORM SEWER PROJECT.
Comment: This project involves construction of storm sewer
improveme. nts in the area between High Street and Fairview
Avenue. The improvements are designed to reduce storm
water flooding and associated property damage. The estimat-
ed cost of construction is $285,000. Funding for this project
is from General Obligation Bonds.
CONSIDER A RESOLUTION OF INTENT 'TO CONVEY
CITY-OWNED PROPERTY AT 1109 5TH AVENUE AND
SETTING A PUBLIC HEARING FOR JULY 18, 1995.
Comment: Staff is in the process of selecting an eligible low
to moderate income buyer for the home. A resale agreement
will ensure that this home will remain affordable to a low to
moderate income household for fifteen years.

CONSIDER A RESOLUTION OF INTENT TO CONVEY
CITY-OWNED PROPERTY AT 451 RUNDELL STREET AND
SETTING A PUBLIC HEARING FOR JULY 18, 1995.
Comment: This is the home that the City moved from Bowery
Street in 1992 and then selected a buyer, these original
owners recently moved. Staff is in the process of selecting
another eligible low to moderate income buyer for the home.
A resale agreement will ensure that this home will remain
affordable to a low to moderate income household for at least
twelve years.

Consider a motion to approve disbursements in the amount of
~6,778,625.51 for the period of May 1 through May 31,
1995, as recommended by the Finance Director subject to
audit. Disbursements are published and permanently retained
in the City Clerk's office in accordance with State Code.

CONSIDER A RESOLUTION APPROVING AN AGREEMENT
9ETWEEN THE CITY OF IOWA CITY AND THE IOWA STATE
DEPARTMENT OF ECONOMIC DEVELOPMENT FOR IOWA
EMERGENCY SHELTER GRANTS pROGRAM FUNDING, AND
AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY
CLERK TO ATTEST THE SAME.
Comment: The Iowa Department of Economic Development
has agreed to provide to the City of Iowa City a maximum of
~69,600.00 in U.S. Department of Housing and Urban
Development funding for the aupport of shelter services at the
Domestic Violence Intervention Program ($25,500), Emergen-
cy Housing Project (~ 10,000), the Greater Iowa City Housing
Fellowship ($4,000), and Youth Homes, Inc. ($27,600). The
award also includes 82,500 to reimburse the City for its
expenses in administering this grant. This is a 23% increase
from the FY95 allocation due to a larger congressional
appropriation.

Comment: Amendment//14 is the Total Development Cost
in the amount of $1,261,811 for the Public Housing project
IA05P022009 construction of 13 detached conventional
units, which represents an increase of 983,261.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST A SUBORDINATION
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND
PERPETUAL SAVINGS BANK, FSB FOR PROPERTY LOCATED
AT 1807 G STREET, IOWA CITY, IOWA.
Comment: The City's Housing Rehabilitation Office was
contacted by Perpetual Savings Bank, FSB requesting the City
to approve a subordination agreement for the owner of the
property located at 1807 G Street. In July of 1990 the
owner of the property received rehabilitation assistance
through the Housing Rehabilitation Program in the form of a
life lien for an original amount of $6,525 of which the
property owner used only 95,966.52. Perpetual Savings
Bank, FSB is about to increase the first mortgage to 957,540.
The appraised value is 970,O70, which provides enough
equity to cover the City's second lien position, which was the
City's original position.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF
A LIEN REGARDING A PROMISSORY NOTE FOR PROPERTY
LOCATED AT 1025 EAST BLOOMINGTON STREET, IOWA
CITY, IOWA.
Comment: The owner of the property located at 1025 East
Bloomington Street received rehabilitation assistance through
the Housing Rehabilitation Program on August 15, 1990. The
financing was in the form of a five-year no-interest loan for
t~ 1,335. The loan was paid off on May 11, 1995, thus the
lien can now be released.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST A ~ELEASE CON-
CERNING THE SUBDIVIDER'S OBLIGATIONS UNDER THE
CONDITIONAL ZONING AGREEMENT AFFECTING WILD
PRAIRIE ESTATES, PARTS I & I1, IOWA CITY, IOWA.
Comment: The Conditional Zoning Agreement for the
conditional rezoning 71.05 acres of land north of Rohret
Road, as originally passed and subsequently amended,
obligates the developer of Wild Prairie Estates, Parts I & II, to
pay all costs associated with the subdivision development, to
pay a pro rata share of the Westside Trunk Sewer upgrade, to
await building permits until the upgrade is complete, and to
limit the number of building permits to 52 until December 31,
1995 or the completion of the Rohret Road upgrade. This
obligation constitutes a lien and a cloud on the title to the lots
in the Subdivisions. The Public Works/Engineering Depart-
ment has certified that all applicable conditions for this
subdivision have been satisfied by the Developer, and a
release of those obligations created by the CZA is appropri-
ate. This release removes the cloud on the title to the lots in
Wild Prairie Estates Parts I & II, as created by the Conditional
Zoning Agreement.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST A PARTIAL RE-
LEASE AGREEMENT CONCERNING THE STORMWATER
MANAGEMENT EASEMENT AGREEMENT FOR WILD PRAIRIE
ESTATES, PARTS I & II, IOWA CITY, IOWA
Comment: The Subdivideds Agreement and Stormwater
Management Easement Agreement for Wild Prairie Estates,
Parts I & II, obligate the Developer to construct a stormwater
management fa. cility. This obligation constitutes a lien and a
cloud on the title to the lots in the Subdivision. The Develop-
er has substantially completed the stormwater facility but a
general release of the facilities is not yet appropriate. This
Partial Release Agreement removes the cloud on the title to
the lots in the subdivision while protecting the City's interests
by establishing an escrow fund which will be retained until
the facility and further develophnent which may impact the
_/~ same ,.are completed.

Comment: Roger and Nadia Ellerhoff applied for permission to plant vege-
tation on the Public Parkway behind 1233 Duck Creck Drive. City staff
inspected the area and recommend approval of such licnese subject to the
conditions set out in the agreement.
Mayor's Youth Employment Board - One vacancy for a three-year term beginning

to address council on an item not on the agenda. I would ask
you to please step forward, sign in, state your name, and keep
your comments to no more that five minutes. These are for
items not on the agenda.
Karr/ Madam Mayor, I don't believe we had a roll call on the
Consent Calendar.
Horow/ Hold up on Item #4. We will go back and ask for a roll call

Back to Public Discussion. Is there anyone who wishes to
address council on an item that is not on the agenda?
cindy Burke/ I have come tonight to ask you to please consider
amending Iowa City's ordinance pertaining to Human Rights
because I believe there are a few loop holes to make it
possible to be discriminated against. I believe that this goes
against the wishes of you the authors of the current
ordinance.
Nov/ Excuse me, would you lift the microphone a little bit closer
to your face so we can hear better.
Burke/ I believe this goes against the wishes of you, the author of
the current ordinance. I also believe that discrimination
regardless of the form it takes is wrong. Iowa City is my home
and I am very proud and honored to live here because this is
a truly special city. Therefore I was disturbed to discover
that someone could willfully if someone ignorantly
discriminated against me without there being any legal
recourse available. I am currently under the guidance of two
doctors undergoing hormone replacement therapy to facilitate
gender transformation on April 21 of this year an employee of
a local business refused to do business with me due to the
hormones I take, estrogen and progesterone and that this meant
that I was a high risk for HIV. This was based on the
assumption that transgendered individuals are active
homosexuals and as such are high risk for HIV. I tried to
explain that this person's perceptions were in error but I
didn't get anywhere. Not getting anywhere and all the while
feeling a deep hurt unlike anything I have ever felt and
informed this person that in my opinion I was being
discriminated against illegally. I contacted Heather Shank,

our Human Rights Coordinator, and filed a complaint. On June
5 Heather informed me that currently transgendered individuals
are not covered by any federal, state or local discrimination
laws. She then suggested that I appear before you to address
this discrepancy. If transsexuals aren't included and perhaps

truly don't think that you, my fellow citizens, would condone
anyone suffering what I have endured. I have recovered from
the hurt that I felt as a result of that person's words and
actions. The experience has actually made me a stronger
person. However it is my finest wish that no other person will
ever experience the anguish that I suffered as a result of
someone else's ignorance. Extending you my deepest gratitude

Consideration of a resolution to adopt "IOWA CITY: BEYOND 2000
-- Iowa City's Vision for the Future" as an amendment to the Iowa
City Comprehensive Plan.
Comment: At its meeting of April 20, 1995, the Planning and
Zoning Commission recommended, by a vote of 5-0, adoption of
"IOWA CITY: BEYOND 2000" as an amendment to the Iowa City
Comprehensive Plan. "IOWA CITY: BEYOND 2000" is a statement
reflecting the vision 80 Iowa Citians hold for our City in the next
century. This statement was reviewed by seven of Iowa City's
citizen boards and commissions prior to the final recommendation by
the Planning and Zoning Commission. Public comments were
received atthe May 23 public hearing on this item. Consideration of
the resolution was deferred by Council at its June 6, 1995 meeting
to June 27, 1995.

Consideration of an ordinance amending City Code Title 14, Chapter
5, entitled "Building and Housing," Article H, entitled "Site Plan
Review,*' by adopting design standards for exterior stairwells and
exterior corridors on multi-family residential buildings. (Pass and

Comment: At its March 2, 1995, meeting, the Planning and Zoning
Commission, by a vote of 4ol with Jakobsen voting no, recommend-
ed approval of an ordinance requiring City approval of designs for
exterior stairways and corridors on multi-family buildings and
adopting design guidelines for their location and appearance. The
Commission's recommendation is consistent with the staff recom-
mendation contained in the staff report dated January 13, 1995.
Comments were received atthe April 11 and April 25 public hearings
on this item. A committee with representatives of the Design
Review Committee, Board of Appeals, Home Builders Association
and City Council has proposed that the guidelines portion of the
ordinance be adopted by resolution. Accordingly, staff has drafted
an alternative ordinance and resolution for the Council's consider-
ation. No public comments were received on the alternative
ordinance at the May 23 pdblic hearing.

Throg/ You know I have read this, the letter from Johnson County
Coalition for Persons With Disabilities and I find it to be
quite an eloquent letter and before I read it I was inclined
to support the negotiated provision that we came up with last
three weeks ago. I now find myself persuaded that we should do
what they suggest and if I could take the liberty there of-
There are a couple of three sentences there in the letter that
I would like to read whether we decide to make the changes
there or not. They are pretty eloquent. They write that the
historic exclusion of persons with disabilities from
mainstream public policy is well documented. For person's with
disabilities have been denied access to mainstream society
through overt discrimination, ignorance, silence and well
intentioned acts. Disability based anti-discrimination laws
are in their embryonic stages, enforced sporadically and
subject to review and appeal. Consequently the rights and
needs of persons with disabilities are not foremost in the
public mind,not are they immediately intuitive. Without
explicit use of the phrase persons with disabilities, future
decision makers and others not privy to the current council
deliberation and committee proceedings may not understand that
the term all citizens is meant to include and embrace us. And
they go on to elaborate and I think they are right. So what I
would like to do, what I would like to move I suppose is that
we amend the page 2, the Preamble to the Visions Statement to
delete the last sentence and this is going to get a little
complicated and then replace that last sentence with the full
sentence recommended by the Coalition.
Nov/ Which is basically reverting to the original Preamble.
Throg/ With a modification and that is between the word lifestyles,
and I would insert the word ages because we wanted to include
that in our revision. All right. And then they recommend one,
two, three, four, five-five other specific changes right here
in the document and I think we should make those changes so my
motion would include those changes with two modifications and
they are necessary.

want to change that to read programs and services will be
offered that meet the needs of all citizens, including persons
with disabilities. And then on page 3, under transportation,
where they recommend changing the language to a transportation
system which enhances the quality of life for persons with
disabilities. I would think we would want to insert words for
all citizens, including persons with disabilities. End of
motion.

words, markings which are sensitive to the needs and abilities
of all users and I don't know if we used your language that we

No, that wouldn't be quite the same and actually that is to me
a preferable way to word these things. For example, under the
Arts, Culture and Human Development we can easily say programs
and services will be offered that meet the needs and abilities
of all citizens without putting the disabilities in such
marked light. It is as if we may exclude people without
disabilities if we put too much emphasis on this.
Kubby/ I don't think so. I believe what we are doing by making
these language changes is we are going back to what the task
forces, through a process of consensus building. That the
intent was that we want to have services that are accessible
by all with special focus in the next 20 years on making sure
our community is accessible to people with disabilities. That
does not exclude. Most of the times when things are done to
make things accessible to people with varying disabilities it
makes that program or that physical thing accessible to even
more people, not just people with specific disabilities. And
so it is not exclusionary.

though our intents are all in the right-Everyone's intent is
in the right place but it is something I have grappled with
all day and I don't know what the answer is and in the end of
the day when we vote on this I am sure it will be a vote that
~,e all can be happy with. But the struggle I have is that, you
know, I recognize that there are these efforts for equal
rights for people with disabilities and that effort is
constant, it is frustrating and often times it is unrealized
and that whenever person's with disabilities see their rights
being curtailed, whether they are being abridged or attempting
to be eliminated, they must fight on every front to maintain
that. However, sometimes I think we fall into a familiar and
unnecessary deadlock in the use of language and not to say
that language is unimportant. It is terribly important. It is
terribly important in this document. And I think we all
understand that that they have significance. That in a Visions

Statement we want those words to ring out and have meaning.
And the argument here before us or the discussion is not about
which words we use but how often we use them. I just want to
point that out. How often do we use them in the document. Is
it important the number of times we mention that or is it not.
And my frustration is that at the end of the day, you know,
when we pass this document, we are still not going to have
Iowa Avenue increase that extra six inches or whatever. We are
still not going to have those businesses with that extra
accessibility. It is important to concentrate on this issue.
Boy, it is frustrating when we are delaying with this in this
level to me and I don't know where I come out in the end.
Sometimes I swing and I know, geez, you're right, we should
mention it in every one of them, especially when I see
affordable housing here. I think, yeah, that is an area where
people with disabilities have often found themselves concerned
in this community. So, you know, I can see in specific areas
where I can say yeah, that is a really good point. On the
other hand, you know, we shouldn't measure the success of
failure of this document based on the number of times this is
mentioned in the document and I just wanted to say that
because that is so frustrating.

That is an interesting comment because the Preamble was
written after each of these task forces had met and had
written their individual pages and I am not sure that each
individual page would have had this emphasis if they had had
the Preamble with them when they were writing it. It's a
difficult decision. There is no question.
Throg/ Well, I guess where come down with this is that I think
Bruno's point and Naomi's point about the number of times we
refer to people with disabilities in the Vision Statement is
correct. But that means that it is not going to harm, in a
sense, harm the Vision Statement if we in fact refer to
persons with disabilities at four or five specific points
later in the document. But what it does do, referring in the
way suggested by the Coalition, what it does do is respond to
the Coalition and respond to their expressed desire, their
expressed concern, their needs, their wishes that we, as the
decision making body for the city, acknowledge that there is
something unique about having disabilities and that we intend
to respond to those needs. Now how we actually respond is
complicated, takes money, all that kind of stufz. But it is
the way of us overtly responding and I think that is
important.

Pigott/ And I think it is important to respond to the desires and
wishes of all citizens including persons with disabilities as
we have said as the proposed changes indicate in the document.
In the same time I think it is important to respond to those
concerns. I do understand also the concern that there are wide
variety of people who have been and are using a controversial
word but oppressed by our government, our federal government
in the past. African Americans, women, etc. and I struggle
with how to mention those groups all in this document in a way
that recognizes the struggle that all of these groups are
continuing to face on a daily basis in a variety of ways in
our community and I don't mean to throw wet cloth over- I
really want us to think about that and recognize that
sometimes that semantics and they are important, it is not
semantics, but it indicates our commitment to a group- to
quality. But that in this case we are not necessarily reducing
our commitment to a set of values because we mention it in a
Preamble but not in the other. Even if we do it does
demonstrate that. I strongly feel that we don't demonstrate a
lack of commitment if we don't do it in each of those areas.
Anyway-
Baker/ First a clarification about what the original resolution
was. It was to adopt a statement with just this language in
the Preamble and to leave the other particular sections saying
all citizens.
Horow/ Right.
Baker/ So we have revised the Preamble-
Horow/ The motion is on the floor to amend the original proposal.
Baker/ I just want to make sure the public understands the
difference between what we are talking about here is that as
originally proposed before Jim's amendments, the last line of
the Preamble would say this, Iowa City will be an inclusive,
accessible and safe community to all its citizens-all races,
cultures, lifestyles, ages and socio-economic groups while
giving particular attention to persons with disabilities. That
is the Preamble which sets up the goals for the whole
statement and in a sense, it defines what the statement means
by citizens. Now, that is the original proposal at least as
presented tonight and I am comfortable with that. What I am
afraid of and fear is probably too strong of a word since we
are all talking about language here. But I do not want
misinterpretation to occur because we disagree about language

There is no difference in our commitment to on this issue and
to make these things happen for this group, particularly
tonight, but all of these groups. Now the question is one, do
we need to single out a group in each one of the categories
for special attention to, Karen, I will use your phrase, to
live out our goals-live out the goal of. I would think that
not putting it in each part of the document does not negate
our li¥ing out those goals. It is a question not only of the
number of ~imes but the placement in the document and I, for
example, might disagree with Jim's statement that it does no
har~ to put it in each one. That I think there is a difference
in separating a particular group, highlighting them
individually in each one of those things. That one doesn't
guarantee them anything more than what we guarantee in the
Preamble and indeed and I am sensitive to language on all of
these issues, my campaign for everything. That indeed, it
might indeed, be-

Baker/ I am running for language czar. There is the potential that
this would be a disservice to this group by this highlighting
and I will only pass along what was passed along to me by a
person who wished to remain anonymous. That indeed and they
fit into this group. That it is as if we are being pulled out
and put into the corner of the room and highlighted. This
person did not like that. This persons would not say in public
but I told him I would pass it along. I don't think that this
decision tonight dilutes, the lack of putting it in in each
particular section, dilutes our commitment. Do not
misunderstand that. Do not come up and say well, I would feel
better if I think you are more sincere if you do it this way.
We are not. There is not a question of sincerity. It is a
question of inclusion for everybody, defining all citizens and
as a logical extension if the language is important for each
particular section I would suggest that instead of just
highlighting persons with disabilities to each one of these
sections, if you want to do it, go back and repeat everyone of
these groups.

response to the Coalition and to people with disabilities. If

will feel comfortable either way in terms of the substance of
the vision statement with regard to people with disabilities.

version last week. Those words, it seems that is exactly what
we are doing when we add persons with disabilities in each of
the other categories. In other words we are doing, we are
cutting it out but we are- I don't see a difference if there
is an objection to placing the persons with disabilities in a
special separate category in the Preamble, why is there no
objection to that in each of the specific areas? Why is there
instead a desire to do that in each of the areas and if that
is not the case, why is that not so. I just don't understand
that.
Carter/ I don't know if I can explain it either. But the Task Force
came up on a consensus building forum with these and when you
took out the word persons with disabilities it changed the
meaning. There are only five places where we want it put back
in. We don't want it in every task force. We don't want it all
citizens including persons with disabilities. I feel the
Coalition does not want that. We went through and explained
how it changed the meaning of the goal or the maintaining or
whatever heading it was under. It changed the meaning of those

and this was like what Karen had said. Out of 80 people we
decided that seven people with disabilities on these task
force. This was a cross section of the con, unity. This is
their consensus building. This was their ideas, their goals,
their maintenance, their improvements. This is what each group
decided upon. And all we are asking is that we put back in
where we were taken out and we don't want to be specialized.
We just want to be part of the mainstream like when Jim read
the sentences he read. Which I am glad you read those. Thank
you. I don't know that that explains anything. I don't-like I
said to Karen coming in here. Like Kevin Burk says to often,
if we have s~ch special needs and we are such a special
population then why doesn't the rest of the world want or need
or want to be where we are at if they are so special and when
you make that phrase while paying particular attention to, you
know, that puts us in a special category. Now, as far as the
rest of the task force statements went, you know, like I say
again, they were consensus building. This is what we voted on.
This is just part of the meaning of whatever particular
statement we voted on. I feel it just fits right in with
everything else. It is not calling particular attention.

these other areas in arts and housing and parking and open
space, etc. that you are making persons with disabilities in
a special separate category. It is just putting back what you

statements for that area and by making sure that we are

Coalition statement not because they are not going to look at

amendment because we are trying to be very careful on how we

potentially work against the very thing that they were
proposing to accomplish. I think when we define citizens in
such a way and it is very clear from the entire statement is
applicable to every category and with all due respect to the
Coalition, I think these language changes are symbolism and

difference. Symbols are important. The substance of how we act

Kubby/ I want to express my support for this document. It is a
really beautiful thing and it was very inclusive and we have
worked very hard, council did, to have a great diversity of
people on each of these nine task forces in terms of
perspective, gender, socio-economic status, making sure there
were people with disabilities and it was wonderful to see how
a real grass roots process came and people with such different
perspectives came up with a vision statement that everyone in
that group felt comfortable with and so a lot of communities
don't go through this kind of a process. It is more of a top
down process instead of a bottom up process and I think this
really helps guide us, the city council, when we make policy.
So the next step-this is our visions, the next step is to then
look at our Comprehensive Plan that then will implement these
vision statements and that is where we are going to continue
to need people watching what we are doing and getting involved
in that implementation. So I am very happy to support this.

Throg/ I would like to strongly support the idea of sending this
letter mainly because the proposed rezoning could establish a
precedent on Highway 1 that in affect would lead to strip
development over time and that is such a nice corridor leading
into Iowa City. It would be sad to see it become strip
development.
Kubby/ In our mutually agreed upon or we think mutually agreed upon
Fringe Area Agreement states that that area should remain
agricultural.

Kubby/ I think for me the most important thing is that council in
the past five years, actually seven years, have made decisions
that have boxed in the airport and it has limited our choices
and configuration when we look at options for the airport to
make sure we have proper clear zone. If we would not send this
letter we would be sending another letter saying that it is
okay to put in a mobile home park with 500 housing units and
it would again block us in another whole section and if the
Master Plan for the airport says that we need to change or
shift where the runways are, we might have to relocate people
which we have just gotten done doing and it is not an easy
task, no matter what the income of people are or the condition
of the mobile homes are. And so for me that is one of the most
important reasons to send this letter and we did ask last
night that Mayor Horowitz present our case in person to the
Board of Supervisors and she agreed to do that.
Horow/ Yes, I really did. I find it very difficult to say that it
is inappropriate and to wait until the Master Plan is done
because I feel like the need for the housing out there is very
very real and I commend the developer for proposing this. But
I do feel that unfortunately the advisability of the Airport
Master Plan being completed-that needs to take place before
this rezoning takes place.
Kubby/ I don't really know what the time frame is. It may be that
this can be proposed again if the supervisors deny it after
the Master Plan has been finalized. Not implemented but the
plan finalized.
Baker/ I, you know, I apologize to the rest of you last night
because I basically sort of sleep through this issue when it
got to the discussion part at the meeting last night. But I
have really ambivalent feelings about this particular issue
because we have conflicting goals here. Even though this would
technically be in the county it is adjacent to the city. It
is-does qualify as affordable housing. There are a lot of
problems with the location but I have been thinking whether or

not an adamant denial or perhaps we could suggest that the
county defer this until the Master Plan is completed without
saying no-
Horow/ That was what was suggested last night. I feel very strongly
about that. I think that certainly is my-
Baker/ There may be.some way that the project like this could occur
at that location. A lot of factors have to be taken into
account. The Fringe Area Agreement is one of those things that
we try to be consistent over and over again and we get
ignored. And here is a case where perhaps the Fringe Area
Agreement works against a goal that we might want to achieve
and it is very hard to find a location for development of t~is
size and that is why I have ambivalent feelings. I recognize
all of the problems here and I don't know what Bob Wolf's time
table is and what his ultimate layout is going to be and I
don't think the county itself has conditional zoning. But they
have creative zoning sometimes and perhaps things could be
worked out. I am ambivalent about a strong denial here and-
Kubby/ I have no problem not having a strong denial and maybe even
changing the letter to have the letter focus on we would like
you to defer this until we have the Master Plan figured out or
even the outline of it.
Baker/ I don't know how that deferral or delay would affect ].and
purchase and construction. But indeed it doesn't make sense
to-we might not have control over it anyway. But to have
something there that eventually is qoing to put us in anot~e~
legal bind. But if the developer can-anticipate that potential
and work that into a rezoning or develop a plan. I just don't
know enough specifics about the proposal and all of these
other things.
Kubby/ The reality is because of the Fringe Area we really have
little to say about zoning and that this development can
happen without a plat. So really it is in the county's
ballpark.
Baker/ That is why instead of flat out saying no, say we would like
you to defer and let us talk some more about it.
Nov/ Well, I am not sure that under ideal circumstances we should
ever recommend residential adjacent to an airport and I don't
know how the Airport Master Plan is going to work out and how
the FAA is going to feel about this because they do change.

Now this year they may it is okay. They have it here and next
year they say it is okay to have it there. It happened to us
before.
Horow/ All right. I would remind council members that letter
addresses the fact that we are agreeing with the
recommendation of P/Z Commission which says no-denial and if
you, it is your intent to change this letter in the
intenseness of the denial-
Burnside/ Madam Mayor, could I just point out one thing that I
don't want to get lost in this discussion. I am pretty certain
that the discussion before P/Z that ended up with these four
recommendations was sent to you with those four items scaled.
That there was thought, consideration and logic behind their
listing these four in the order in which they appear and that
not to necessarily disagree with the comments here. But I
would point out here to you that the waiting for the Master
Plan is point #4 on their list of four and P/Z, I think, did
not-while they attached weight to that, they did not consider
that to be the single most consideration.
Baker/ And there is another consideration that is not listed here
that P/Z did talk about which was-One of their concerns was
this kind of build up of development being outside of city
control. Outside of water and sewer systems and the city not
having review over the platting process and that was a concern
as well.
Kubby/ I typically have that concern but Bob Wolf facilities out at
Modern Manor work well.
Baker/ That wasn't intended as a reflection on Bob Wolf-
Kubby/ So the motion is for the letter as written tonight.
Throg/ I would like to make another point. I think if we might note
perhaps for the benefit of the Board of Supervisors. If we
might note the intense process that we recently went through
searching for a new airport and that we concluded from that
that it was unwise to build a new airport and would like to
also note that improving rezoning for this particular project
would make it more likely that the airport would have to be
relocated at some point in time in the future and if that is
the case it would be relocated somewhere in the county.

relocating county residents.
Throg/ And it would be pretty controversial in the county.
Baker/ Jim, I don't necessarily follow that this would make it more
likely that the airport would have to move. I don't see that
as a given but I understand-
Throg/ I do not mean to say that by itself this proposal would
force us to relocate the airport. I don't mean that at all. I
do mean that if this is approved and a couple of other
projects are approved end up surrounding the airport with
development. That will greatly increase the pressure to
relocate.
Baker/ Has an effort been made to buy this land ourselves?
Kubby/ Not to this point. One of the options, I think it was Option
3 of the Airport Feasibility Study was saying that one of the
ways we can stay in our current location was to extend that
runway that actually goes through the pond which sounds really
wild. That that is part of this development. So that
automatically X's out one option in the Master Plan which was
one view for staying in the current location now. We had
different consultants working on how to reconfigure things but
it does limit us.
Baker/ Yeah. The idea of filling that pond is a separate issue that
is a real-

Horow/ city Council Information.
Kubby/ I wanted to request that our Legal staff give us another
update on the Cliff Apartments and the erosion control
problems that at our next meeting. When I go by-I know there
has been some movement. When I go by, it just doesn't seem
like any work is being done and the hill is continuing to
slough and when we have really hard rains like we had this
week, I get real scared about the continuing slough off that
hill. I am getting a little frustrated about how fair we are
being. I feel like we are bending over backwards to be fair in
our process and I am at the point that at the next meeting
that if the report is not favorable I am going to ask for four
votes that we ask the DNR to declare this an environmental
infraction with $1,000 day fine.
Baker/ Let's do that tonight.
Kubby/ I don't know that Anne can give a report. I didn't want to
make her go back through the files because Linda has been
really working on this. I don't know if you can give us an
update on.
Burnside/ I, tonight, I cannot. I have not reviewed this for a very
long time.
Kubby/ She has been doing double duty since Linda has been gone and
I decided it wouldn't be fair.
Burnside/ I would have looked it up for you if I had realized you
wanted it and I-

town, there are lots of fun things to do in town. The Jazz
Fest is happening on the night of the 3rd. You can go d.t, the
streets will be closed. We can dance in the streets which I
think is a really important community building activity. And
people should come out for it all day on 4th of July. There is

going to be music starting in the morning all the way through

Kubby/ On the 4th of July, Bruno and Sue and Naomi and I are going
to be participating in the 4th of July Parade in Coralville.
It starts at 10AM, line the streets of Coralville and be nice
to us.
Nov/ This is just one more effort in regional cooperation.
Horow/ It is a fun event. I thoroughly enjoy it. The last time we
had the parade it seemed to me that there was a rainy day and
the car broke down half way, so I took out my umbrella and
finished walking like Mary Poppins. Iowa City was there doing
its thing.
Nov/
I was going to say something else. That is why I told Karen to
talk about the parade. I was going to talk about all the
things I have been doing since the last council meeting and it
has been one of these sometimes and I think this is a good
reflection on what goes on in Iowa City other than the council
meeting. We have a new Safety Village at Grant Wood School. It
is a wonderful little thing. Cute little buildings and
streets, stop signs and RR Crossings, and little push pedal
cars that children in Kindergarten to learn safety. There is
a house that teaches kids what to do when a fire happens to
come. They teach them how to dial 911. They have an imitation
smoke alarm. They teach them how to escape from the house and
the kids love it. So if anybody is in the Grant Wood
Neighborhood, you can have a look at it and admire all of the
volunteer labor and funding that went to build this because
there wasn't anything involved. Just a terrific group of
citizens. I also went to welcome a reunion of WWII Veterans of
the U.S Navy which met here in Iowa City and I went to a
meeting of the Emergency Management people from all over Iowa
and nearby states and they met in Iowa City. There was a
meeting in Cedar Rapids of the Iowa Commission on the status
of African Americans, a statewide meeting. They came to Cedar

Rapids, they served breakfast and they wanted to hear from
both Linn County and Johnson County about what African
Americans have to say about their communities. Good or bad,
they wanted to hear about it and if there are African
Americans listening who have not been able to attend the
meeting, call me and I can give you the names of local contact
person. There is a local citizen who is on the Governor's
Commission and they would really like to hear from people and
I made a contact there with somebody who was talking with
great concern about what happened to Cedar Rapids-what could
happen to Cedar Rapids if they went into a charter system of
government and I said Uhat it is not bad at all. We've had it
for 20 years and I sent them a copy of the Iowa City Charter.
That was a fun meeting. And then both Larry and I met with a
Japanese professor who teaches American Studies in Japan and
she was a delightful person. We discovered all three of us had
been at the University of North Carolina in Chapel Hill. Just
one more fun time. Steve was there also. We have had lots of
interesting events going on.
Throg/ Did you dance?
Nov/ We did not.
Horow/ There is life other than dancing. I appreciate that very
much.
Throg/ I have a couple of things that I would like to mention. Last
Monday night and Tuesday night I had the great pleasure of
meeting with a group of three Japanese women who are visiting
here as a part of a return visit that many Japanese women were
making. They were returning a visit that many American women
had made to Japan in November. It is part of a program
sponsored by I think the group International Cultural Exchange
headquartered in New York City. And what a fantastic time it
was. It was just great fun. We had a potluck dinner at Roberta
Till-Retz's house and Jay Retz's house and the dinner with
several other folks, including Karen, at Aoise restaurant on
Tuesday night. We had a fantastic time. So I would like to
praise both of those-the three women from Japan and Roberta
Till-Retz and Ellen Dorsey for a fantastic job in organizing
that trip. It was terrific. The other thing I would like to
say is that I intend not to run for re-election and I wanted
to say that and let the people out here know what that is all
about. As many of you know I have had to be in Louisville,
Kentucky for three weeks out of the past six in order to help
my father move to a convalescent care center and I am going to

need to go back there again on Thursday. I will be down there
for another. I expect to be down there for probably at least
two more weeks over the next two months or so. I think my
father's condition and many other factors have led me to
conclude that I shouldn't seek re-election at this time. I
want to elaborate briefly on that decision. Meaning no
disrespect to other folks, my friends on the council here, my
sense is that Bruno Pigott, Karen Kubby and I have brought a
new and healthy spirit of oneness, creativity and
thoughtfulness to this council. Collectively I think we have
succeeded in shifting council priorities and initiating
several new projects that will be very good for this city. I
feel very good about the job that I have done and I would
really like to talk about the issues that defend my record, to
confront the objections and let the voters decide whether they
support the vision of building a more affordable and
sustainable future for this city. Once more I would really
love to be part of a new majority that would help realize that
vision. However, I have also learned that it is extremely
difficult, both emotionally and physically to be a good parent
to my two teenage sons, to be a good son to my aged father, to
fill other personal and financial obligations and perform well
as a scholar and teacher at the University while also giving
council issues the careful attention they deserve. So, let me
be clear on this point because I know I have talked with many
people about this over the last few weeks. I want to make sure
that other potential candidates for council don't
misunderstand me. Balancing work at the University and being
on the city council is not the problem. That is not the
problem. That is easy. What is difficult is balancing work and
council stuff while also sustaining the personal relationships
that are important to me at this particular moment in my life
because I my age, the fact that I have little kids, I have an
older father and so on. So, anyhow that is the story. Thanks.
Kubby/ You know, you haven't been on council very long and a lot of
times it takes a lot of years to see changes that happen. But
I feel that you have been a really great leader on a lot of
these issues, especially bringing up issues around development
and neighborhood cohesiveness and environmental protection and
affordability in terms of water and sewer issues. All of those
I think are just tremendous contributions that you have made
in a very short period of time and I really appreciate your
leadership. You have been a good role model for me and I you
are just a beautiful person. Thanks.

enjoyable it has been to work with Jim on council and I am

continue and I hope that activity in city affairs will
continue in other interesting ways. So, I look forward to
Jim's continued role in our city's development, not the end of
it in new capacities whenever. But I appreciate having the
opportunity to work with him. It has been a great learning

Horow/ I had the honor over the past couple of weeks of
representing Iowa City in East Berlin and parts of Poland. I
took the occasion of personal trip with my husband to go to
the water purification and wastewater treatment plant of the
City of Berlin which now includes both West Berlin and East
Berlin as well as-It is like a bus man's holiday. As well as
looking at the infrastructure at Krackow, Poland and I would
be willing to talk about this with anyone. But I do think that
Iowa City has a lot to-I was very proud of the engineers that
we have and our Department of Public Works. I was proud of the
way our city functions and I let everybody know it. I think we
had some very healthy exchanges. But we really have a lot to
give to other communities in our experiences and I appreciated
having the honor of representing all of you. That is it.

Comment: Due to the ongoing paratransit negotiation between the City of
Coralville, the City of Iowa City, and Johnson County, Johnson County
has agreed to extend the FY95 paratransit service agreement one month
until July 31, 1995. A clause in the FY95 agreement permits such an
extension.

Comment: When the City sold the Old Public Library and adjacent parking
lot, the sale obligated the buyer of the parking lot to submit building
designs for Council approval for any development of the parking lot. The
owner has revised the design of the proposed building for the site, thus
requiring Council approval of the revised design. At its meeting of June
12, 1 995, the Design Review Committee reviewed the preliminary plans
for the project and forwarded comments to the Council regarding the
project in the form of a memo included in the Council packet.

By a ~ ote of 7-0, the Committee recommends approval of the
following bylaw amendments:
ARTICLE 1, MEETINGS
Section 1, Regular Meetinqs, Regular meetings of this
committee shall be held on the first and third Monday of each
month.

By a vote of 6-1 (Quigley voting no), the Committee recom-
mends Council approval of the following bylaw amendment:
ARTICLE II, MEMBERSHIP
Section 1. Membership. The Desigr~ Review Committee shall
consist of seven (7) members, of which two (2) shall be
licensed architects; three (3) shall be either design profession-
als and/or involved in the building trades; and two (2) shall be
at large members of the community, All members must be
eligible electors of Iowa City. All members of the Committee
shall serve without compensation, but shall be entitled to the
necessary expenses including reasonable travel expenses
incurred in the discharge of their duties, By a vote of 6-0-1
(Quigley abstaining), the Committee further recommends to
the City Council that when the membership bylaw amend-
ment is adopted, that terms of the existing members would
end and that the City Council make appointments for
seven positions, In addition, the Committee encourages the
Council to reappoint existing members to the Committee for
the sake of continuity.
Comment: The proposed bylaws will be submitted to the City
Council for referral to the Rules Committee in the near future.

Baker/ I just noticed this. I thought this was a stealth campaign
for the local Democrats or something. That is all.

Nov/ The local Spanish American Democrats. Before we get into this
we need to do somehow some amendment to our regulations on
Sidewalk Cafes so that we can accommodate people who cannot
see.
Pigott/ Do we need to amend the ordinance to do that or can we do
it in the design review process of these cafes?
Kubby/ I have a suggestion. I would suggest that we contact the
Council on Disability Rights and Education and the Johnson
County Coalition for Persons With Disabilities and ask them
for some suggestions about a variety of issues that may come
up for people with disabilities using the sidewalk cafe. On
the DR Committee one of the comments was that pedestal tables
are harder for people using wheelchairs to get into for eating
and I don't know what other kinds of issues. Before we start
asking people to think about these issues I guess I would like
to know what the breath of them are and the best group of
people to ask are people who are advocates for and who are
people with disabilities.
Horow/ I read that and I understand the dilemma but having partaken
at a beck of a lot of sidewalk cafes in Germany and Poland
and being in the presence of people with disabilities, I
somehow wish there were a way we could have a little bit more
information from other cities or other locations of sidewalk
cafes. This thing can't be that difficult. I mean people do
get around them and I would hate to think that we are making
a mountain out of a mole hill.
Kubby/ That is why we should ask the people who are- What do they

need to not have physical conflicts with the actual care?
Baker/ I think, Sue, this is a paraphrase or not. Surely this is
not a problem unique to Iowa City that has been anticipated
and worked on somewhere. We ought to find out who it is.
Horow/ There is a motion on the floor. Do you wish to defer this?
Do you wish to amend this or what?
Pigott/ Let's do it but with the understanding that in general
terms we would like to have the Council on Disabilities and
Awareness look at these issues and then once we find out what
they think they hear the issues and concerns that they have
are, find out from other cities how they have overcome some of
those concerns.
Horowitz/ I would like to ask our City Clerk her comments on what
we are about to do.
Karr/ What you are about to do?
Horow/ If we approve this motion-
Karr/ We have a signed agreement.
Horow/ Is we approve the resolution with the caveat that we
essentially ask the Council on Disabilities and the Coalition
to get back to us, does that present you with a problem?
Karr/ We have two other sidewalk cafes and I think the question
becomes grandfather in, voluntary compliance. I believe they
are all going to be as cooperative as they can and it is going
to be very difficult for them to respond to something without
it existing. I think what we need to do is find out that
information and see what options we have and then get back.
Kubby/ And in our request for information from the Council and from
the Coalition to ask them to look at what other cities do-
Karr/ It is important to note thatwhen we did do the ordinance, it
is interesting that this didn't come up in an across the
country sampling of any of the other ordinances. It did not.
That doesn't mean they didn't take care of it in another
method, i.e. the design review method or building code or
something of that nature. But I think we should go back and
take a look at how we patterned our-what we patterned our
ordinance after and whether those cities are doing in addition

to going back to the groups affected and coming back with a
recommendation. I think you will get compliance and
cooperation from those that are participating.
And I am not insisting that the amendments be in the

ask for their cooperation with whatever we come up with.

Since I have had some experience with this. I have been on the
DR Committee. We were never presented with the request to
approve something such as last night because we were told
maybe this window is going to be here or maybe this window is
going to be there and maybe there is going to be three
windows. I am not quite sure and this is not what I call a
finished design. We should have a sketch that says this is it
and we should see the building materials before we say this
building we will be ready to approve. So therefore, I would
like to defer it. The people who are building this did change
the parking and they had the parking changes approved by the
Board of Adjustment and therefore we are not going to change
their parking. We are Just going to be sure they have a
finished design for their building.
Kubby/ The building we looked at was quite beautiful and everybody
liked all of it. We just need to a finalized version of what
the side going on Gilbert Street would look like and we need
to vote on something that is more concrete than what we looked
at last night. But, in the paper, in the Press Citizen they
used the word disdained. That we had disdain for part of the
design and I really took offense to that word because we
really thought it was a beautiful design and we just needed
clarification and a more solid idea of what we were voting on
because the reason it is going through DR is that the council
said when we sell this land to you we want to make sure that
what you present to us is what is built/ So that is what we
want to follow through on.

Horow/ I would like to add to Naomi's question and that is do we
have the ability to have pedestrian flow around so that they
can use this side of the street?
Fosse/ The current configuration does not allow for that. That
would send pedestrian traffic out into the travel portion of
College Street and that is a very good question that you have
Naomi. I would have to work on the scheduling and the staging
of it so that we don't completely close that corridor down to
pedestrians.

Now, that was my concern. If we are closing the side where the
church is, people can still walk along the Carnegie Plaza
side. But if they start construction and we close both
sidewalks, then I don't know what we are going to do.
Kubby/ They have to come to us for an agreement to use the public
r.o.w. for staging. Correct?
Fosse/ That is correct.
Kubby/ so we would have some control over that timing? What is the
time frame of the church project?
Fosse/ Their agreement will expire March 30, 1996. They hope to be
done prior to that but we give them plenty of time in case
there is some problem with the construction.
Horow/ I don't understand how other cities can have covered over
even pedestrian walkways around construction that is going on,
major construction. And we've never had even pedestrian block
all. So they walk in the streets. They walk in a protected
part of the street. Why aren't we able to do that?

Fosse/ We could require that if you wanted it. It is a matter of
cost and-
Horow/ Anticipating both sides of College Street being under
construction, I think this is something that should be
anticipated.
Kubby/ Maybe when the next one comes we can do that.
Horow/ Who pays for this?
Fosse/ The contractor pays for it. It is included in the bid for
the renovation. Ideally the property owner should have made
this request prior to the bid. Now we are dealing with the
contractor after the bid. Carnegie Plaza, we should work with
them upfront and make sure the property owners-
Horow/ I don't think it is fair to throw it all on Carnegie Plaza.
Kubby/ It was nice when First National Bank had their protected
covered thing, there were children and young adults involved
in doing murals there, too. So it wasn't just this brown
wooden thing. It was a rain forest after they were done. There
may be another opportunity there especially since it might be
there for a period of time.
Horow/ When you work with them to see how we can get pedestrians
safely through there- That is a heavily traveled corridor.
Fosse/ The difficult thing, especially that the church is facing is
getting materials on and off the site and they either need to
bring those materials on from Gilbert Street or off of College
Street. Carnegie Plaza may have some more options that just
College Street.
Nov/ They have an alley, though, for both the church and Carnegie
Plaza.
Fosse/ The Church has the Masonic Temple between and that. There is
an alley all the way behind but the renovation is pretty much
occurring in front of the church. I see where you are talking
about.

College Street and those two parking avenues, sections of the

Comment: This agreement is the result of binding arbitration and provides
for a 3.25% across-the-board wage increase effective July 1, 1995. It
further provides for a 2.8 percent wage increase awarded by the arbitrator
in consideration for the revised work schedule implemented as of April 8,
1995. The agreement also includes several language modifications and a
925 per year increase (from $250.to 9275) for all personnel certified as

Kubby/ Yeah, I have a few items in here and one of them in the
agreement is on page 7 and it is a word that is bothering me
and this word does have a substantive result and I am not
interested in trying to change the word because I know we went
through a very long process to get this agreement and I am not
interested in changing the word. It is on page 7 and it has to
do with funeral leave and it says there will be no loss of
compensation to attend a funeral of his or her spouse,
children, mother, father, step parent, sister, brother or
grandparent. I would like us to direct our personnel office to
enforce this as partner, not spouse because spouse is a legal
term and some people have relationships that are not legalbut
they should be able to go to their partner's-
Throg/ It is consistent with the policy we adopted earlier.
Kubby/ Is there any problem with that. And maybe how we behave and
I guess I would like you to put it in your file for the next
time we go into negotiation to negotiate.
Helling/ It is an interpretation. Frankly I am not aware of any
situations in the bargaining unit where it would apply at this
point in time. We will back in negotiation in a couple of
months and we could-

Nov/ I have heard the word spousal equivalent on documents similar
to this. I am not exactly delighted with the word but if that
is what people want, this is okay.
Kubby/ Partner flows better than souse-
Helling/ There is probably some language in other contracts that we
could borrow on that confines it to the issue we are talking
about while not allowing people to take advantage of it.
Kubby/ The other issue I have in there is page 5 and it is about
administrative duty that is also called light duty and my

question is in what document are the rules for who gets light
duty?
Helling/ There isn't a document like that. It is at the Chief's
discretion.
Kubby/ Okay. Because one of the issues is we're interested in
recruiting non-traditional people in some of these professions
with the city and one of those groups is women. I would like
to make sure that light duty is available for female
firefighters who may choose to become pregnant, so they can
still have a profession as firefighter and not have to take
off all of their personal leave and sick leave as well as
pregnancy leave while they're still able to perform but not
in the full capacity of a firefighter.
Horow/ I guess my question to you in all sincerity is, wouldn't
that be prejudiced against males who can't choose to be
pregnant?
Kubby/ It is a way to make sure there is equal access to
professions for all women.
Horow/ Right but the light duty is rotated throughout both genders.
Kubby/ Well I don't know if it's in this case but in some cases,
pregnancy is termed a disability.
Horow/ That's a really weird statement. It's treated as any other
temporary disability.
Kubby/ And any firefighter who has like a temporary disability for
a back problem, it's light duty.
Helling/ No. No duty is guaranteed by the contract. The governing
factor in the chief's decision is primarily is is there light
duty available, number one. And then number two, budget,
because if you assign somebody to light duty, it may impact
on their sick leave for the future whatever so you wind up
paying more rather than somebody would work longer before they
would go on a leave without pay, which means in some cases
maybe not in fire cases but in some cases you hire substitute
people for them. And then to complicate things further, it
makes a difference whether it's duty related or not for Police
and Fire because of Chapter 411 of the Code which says if it's
duty related they're paid out of the general fund in which
case we would bring them in because we're paying them any way.

So there's a variety of factors that come into play. We have
always in our negotiations reserved that for the discretion of
the department, whether or not light duty is available and
whether or not it can be something productive.
Kubby/ So maybe I misspoke. I know there have been some people with
back p~oblems who have been given light duty. It doesn't mean
that they are guaranteed that.
Helling/ Right.
Kubby/ So, I don't expect any resolution tonight. But I wanted to
bring the issue up that if we really want gender equity in
these professions, Police and Fire in particular, that we have
to look at some of these issues and that because men can't get
pregnant so far it may be seen as discriminatory but that is
the reality of our genetics. So if we want to encourage the
expansion of women in these professions there are some
accommodations that need to be made.
Horow/ Okay. Interesting discussion. Any further discussion?
Kubby/ I don't know-I want this not to just die. I don't want to
just say this.
Helling/ Can I make a suggestion because generally what we do is we
discuss these things as part of our strategies when we go into
bargaining in a closed session. And I would suggest that these
kind of issues that we do that.

Comment: This amendment revises the residential curbside recycling
program to include increasing the frequency to weekly collection, providing
a curbside recycling container, and beginning to collect cardboard. The
emended ordinance also revises the residential refuse collection program
to include the placement of a separate charge on bulky residential wastes,
adds clean untreated wood waste to brush and tree limb collection, and
places a unit based pricing system on residential refuse.

Comment: The proposed amendments to the Housing Code were initiated
by the Housing Inspection staff and the Fire Marshal. They have been
unanimously recommended by the Housing Commission. The amend-
ments are intended to enhance the life safety provisions of the Iowa City
Housing Code.

· 'J ENTITLED "TELEPHONE FRANCHISE", TO ADOPT STANDARDS FOR
ENTERING FRANCHISE AGREEMENTS TO PROVIDE ELECTRONIC
COMMUNICATIONS SERVICES. (PASS AND ADOPT)
Comment: The proposed amendment repeals an antiquated code provision
regarding the use of public ways by AT&T, and adopts in its place
language modified from Chapter 364, Code of Iowa, which states the
City's authority to grant franchises for entities occupying the public right-
of-way to provide electronic communication services. This ordinance
would act as companion legislation to the City's cable television franchise
ordinance,

Kubby/ I know that you all probably talked about this last time but
I wasn't here. I think I have three things-four things I want
to say. First is hallelujah. Well, I feel like it is something
I have been talking about

Kubby/ Each household get one bag. The anecdotal information from
our Solid Waste crews are that most households have one or two
bags. So this program, I believe really won't be motivating
for the majority to recycle more and put less garbage into a
sack that goes to the landfill. But what we decided to do is
we requested staff to monitor the collection to see if that
anecdotal information is true and as we get closer to the year
2000 needing to reduce our waste that goes to the landfill by
50% we may move in another direction with this to create even
more incentive for people to recycle. Let's see. I wanted to
remind people to they can still use their recycling container
that they purchased and or decorated already. You will still
get charged for the other container and if you need a second
one you will get that. If you already have one and you want
one from the city you can still get one but you can still use
your own container. And lastly, I wish that we had a more
flushed out educational program presented to us and I know
there will be one but I wished we had more detail about that
because I think it is really important that we make these kind
of major changes. That we have a comprehensive consistent and
frequent promotion out there of the beauty of this. This is
not a hassle. This is a beautiful thing and people-I know a
lot of people are very happy about this and I am very happy
that we are doing it.

Nov/ Yes. I have seen ads for Coralville collecting all numbers of
plastics because they have a market for them now. Have we
heard anything more about that.

Atkins/ Floyd mentioned to me in passing the other day and I really
don't know any more than that. He told me about expanding the
plastics collection at the time when we start some of these
others. I will do my best to find out.
Nov/ I would like to find out more about that and I have talked to
people who say that they are more likely to put their
recyclables at curbside when we include cardboard. We get
people saying well, I am going to take the cardboard over the
Benton Street anyway. I might as well take the other things.

C. ENTITLED "POTABLE WATER USE AND SERVICE" TO PROVIDE FOR
THE USE OR ABANDONMENT OF PRIVATE WELLS UNDER EXTRAORDI-
NARY CIRCUMSTANCES WITHIN THE IOWA CITY CITY LIMITS. (PASS
AND ADOPT)
Comment: The existing City Code does not permit private well construc-
tion within the City limits. This ordinance amendment permits private well
installation if the point of use is greater than 300 feet from an accessible
distributisn water main, if the private well is located outside the influence
of an existing or proposed City owned well and the Public Works director
approves the well due to extraordinary circumstances, The amendment
also permits the City to require connection to the City Water Facility when
the above conditions are not satisfied. Public Works recommends adoption
of this ordinance.
