Miklo/ Your first item is setting a p.h. on the annexation of 250
acres located north of 1-80 and west of North Dubuque Street.
This is the water plant site.
Lehman/ Why don't we just call it the water plant site?

Consider setting a public hearing on an ordinance
amending the Zoning Ordinance by amending the use
regulations of an approximately 250 acre property
located north of 1-80 and west of N. Dubuque Street
from County A1, Rural; RS, Suburban; and R3A,
Suburban Residential; to P, Public. (REZ94-0018)
Miklo/ Setting a p.h. on the rezoning of the property from a series
of county zoning designations to P within the city. The agenda
should have said setting that p.h. for August 1.
Throg/ Would activities like the Science Center fit under P?
Miklo/ If it is associated with a government entity it would .... If
the city grants approval of it. The P designation is for
anything that a government entity owns and it is exempt
basically from zoning so almost anything goes.
Horow/ If we own the property and it was a private concern on the
public property, would it still be considered a public
property?
Miklo/ As long we owned it it would be permitted.
Lehman/
Miklo/ ...anything is permitted in the P zone.

Development Housing Overlay, and RS-8, Medium

Miklo/ Setting a p.h. for rezoning approximately 7.8 acres adjacent
to Old Dubuque Road and North Dodge Street from RS-5 to OPDH.
This is the project that Bob Burns and Greater Iowa City
Housing Fellowship have proposed. You have been hearing a lot
about this ..... We do have copies of the staff report and
corresponding material to give you some background.
Horow/ It will be almost impossible to get P/Z Conunission and
council together by August 1 unless you all have some idea of
a calendar that Marian and I don't have. Do you-Was there a
reason why you put this for August 1 in terms of expediency on
their part?
Miklo/ That is a normal course of a rezoning in this situation.
Typically if P/Z Commission recommends to deny, it is not
placed on your agenda unless the applicant requests so. In
this case they have requested so .....
Horow/ In other words we still have time after August 1 to have
time?
Miklo/ Right.
Lehman/ I would rather have a meeting with the Co~ission after the
p.h.
Horow/ All right.
Kubby/ I want to review the process with OPDH ...... another process
is what the exact OPDH would entail.
Miklo/ With the OPDH rezoning there is a development plan that
specifies the placement of the buildings, type of buildings,
parking, design, etc. The provision allows waivers of some of

timing of August meetings .....
Franklin/ Your consultation with P/Z occurs if it appears that the
council is going to against the P/Z's recommendation and we
don't know any of that yet. So we will have the hearing on
August 1 .... you'll want to continue the p.h. At that point if
you give some indication what your sentiments are .....
schedule it ..... Some time between the 1st and 15th .... That
commission's schedule follows the same as yours in August .....

Nov/ It is not impossible that we come before their session on the
loth?
Kubby/ I want more time than 24 hours between where we are voting
on the decision ..... and when we talk with P/Z .....
Horow/ .... Where does this stand in terms of protest?
Miklo/ At this point I don't believe we have received any official
protest. The protest can be submitted up to the close of the
p.h.

Kubby/ I am assuming the P/Z's recommendation was that if it would
pass that there be a tree protection plan and that it adhere
to elements in the Sensitive Areas Ordinance.
Horow/
Lehman/ I think that is significant.

218/Highway 1 interchange and property located in

Miklo/ The p.h. on annexation of the Winebrenner Ford site. This
annexation also includes the interchange and portion of the
Hwy 218/Mighway 1 r.o.w. Both P/ Z Commission and staff
recommended approval of this item.

approximate 103.86 acres, which includes the

Miklo/ Rezoning the property from the county designation to CI-

Kirkwood.
Nov/ Are they paying any property tax on that?
Miklo/ Kirkwood is exempt but Winebrenner Ford would...pay property

campus at this location.
Horow/ Do they have land anywhere else that we know of?
Miklo/ I am not aware of where they might have other land.

Miklo/ The Comp Plan indicates this area is appropriate for
industrial or commercial development .....
Kubby/ Seems like there are some big issues here for me. 1-
.... getting FAA okay about height and .... lighting ..... How
do you get that much lighting that doesn't interfere with
airport operations?
Miklo/ There are other dealerships in the area that received FAA
approval .....
Kubby/ Other thing I am concerned about is sewage treatment and
water supply ..... language in here is pretty vague ..... Cars
are greasy and oily, even new cars at some point .... How do
you prevent that contamination of the septic system?
Miklo/ The County Health Department will have to approval the
wastewater treatment for this particular property.
Kubby/ So will there be something on the permit that stipulates
that it has to have some kind of a system that either traps
this oil and grease or whatever? ...... We don't do septic
tanks ..... We don't approve or disapprove them specifically.
Miklo/ I can check with the Heath Department ......
Kubby/ ...... some discussion at P/Z level about limiting what was
able to go through the septic systems ......
Nov/ In the letter from Winebrenner that they are looking at the
possibility of using a community mound system ........
Kubby/ .....
Miklo/ Initially they applied to the county for a rezoning and that
letter references that initial application.
Kubby/ ...... annexed but limited by how fast you can develop ....
Miklo/ Public Works Department has been following this ..... we
won't be able to sewer this for quite some time .... City
Engineers Office has not raised those sorts of concerns.
Kubby/ What is the time frame for sewer and water out in that area?
Miklo/ Water we can provide to them upon annexation. Sewer is
sometime in the distance .... ten years to twenty years.

Throg/ Can you help me understand the water part of it? ....
Miklo/ The sewage system will require a major trunk line...
water line is available .... (refers to map).
Throg/ Who will pay for the extension of the water line?
Miklo/ That will be a tap on fee. Not necessarily a tap on fee but
there is a water main extension fee that is charged for all
developments, $354 an acre ......
Nov/ So it is 39 acres times $354?
Miklo/ Right.
Kubby/ Is that the full cost of putting in a line or is there some
sharing?
Miklo/ I believe that that formula takes into account extension of
the line for development such as this.
Kubby/ What about Naples Avenue? ...
Miklo/ For previous development in the county there was a
requirement that Naples Avenue be improved and that has been
delayed for a number of reasons .... We understand from the
county that that should be done this summer .... The street is
actually an easement ..... We are working with the County
Engineer on a maintenance agreement that would specify our
responsibility to maintain the street ....
Throg/ At some point .... I need to say... I don't share the vision
associated with this particular development ...... I will, at
some point in this process, have to elaborate on that.
Miklo/ One of the staff's recommendation... this probably would
have happened in the county even if we would have objected to
the zoning .... this way it will have city services and also
generate tax revenue.
Throg/ ... the Comp Plan has shortcomings in my judgement because
it is based primarily on two dimensional land use ...... I
think we need to refine our Comp Plan for developing parts of
the city ......

approximate 0.82 acre tract of land, the north
portion of Lot 4, Highlander First Addition, which
is located on Northgate Drive from RDP, Research
Development Park, to CO-i, Commercial Office.

Public hearing on an ordinance amending the condi-
tional zoning agreement for Lots 4-17, Highlander
First Addition, revising the development standard
pertaining to rooflines and parapet walls. (REZ95-
0008)
Miklo/ Rezoning of a portion of Lot 4 of Northgate Corporate Park
from RDP to CO-1. The next item is associated with that in
that it would amend the development standards or requirements
for Northgate Corporate Park to replace requirement that
buildings have flat roofs with a requirement that the
architecture throughout the area be consistent. This was
brought about in there was a proposal to build on a portion of
this lot ..... we agreed with the applicant that there should
be more flexibility in the guidelines that are the standards
for the park. The remainder of the tract .... more appropriate
for CI-1 which is the adjacent zone to the west.
Pigott/
Mik10/ Original application was to fezone the entire tract to CO-1.
Kubby/ And now it is just the northerly portion.
Pigott/ I thought before the southerly portion was incorporated
...... What you are saying now is that it is not
inappropriate some places ....
Miklo/ There is a topographic change which makes it more
appropriate for CO-1.
Horow/
Miklo/ This is the lot immediately adjacent the existing CO-1. The
topography breaks there .... We would anticipate the rest of
the ORP staying as it is.

Horow/ ... the oovenant was really carefully forged out ..... I am
questioning because the rest of the ORP is not moving are we
in danger of seeing more erosion of this?
Miklo/ I don't believe rezoning is likely but amendments to the
development standards are something that we have
discussed ..... may be more room for flexibility ......
Horow/ Is it possible to look at it within the
entire package of ORP area in the city? .....

Kubby/ I have a couple of questions... Have there been people who
have looked at this for research development? But because of
the covenants they have said it is too restrictive .... Or is
it people are not that interested in that zoning in our
community?
Harry Wolf/ We have a specific proposal from a specific user who
has designs on this line .... There is a natural terrain break
in that lot ....
Kubby/ I was thinking more of the remaining lots... have there been
over the past five years interest in those lots?
Wolf/ We have had varied interests .... at this point we have this
proposal ..... and they have a concern about the
restrictiveness of the roof line ..... Let us to consider
maybe taking a more comprehensive look at a later date at the
entire park. Our intent is not to change the use.
Horow/ Is this use compatible with research development?
Wolf/ Yes ..... The need to go CO-1...issue of topography and also
restriction that no lot can be less that one acre in the RDP
zone ...... We have specific user we believe appropriate for
the zone. The one issue right now is the roof line.
Nov/ What was the reason for not putting the C0-1 on a different
lot?
Wolf/ The scale of this project and this particular user wants to

be on Lot 4 ...... This is really where they want to be ....
Throg/ I don't see any reason not to support the proposed change in
the zoning. But in the long run building single purpose
commercial zones is probably a mistake ..... There is only one
way to get there .... by auto .... There are other images of how
to develop communities .... We really need to start to take
them very seriously .....
Horow/ If I recall... the whole Northgate Research Park concept was
that the bus would be available... get public transportation
out there ..... we do have an established area .... I share
your concern on this.
Miklo/ We do have a request to expedite consideration of this .....
At the time you had the second reading on you would also pass
and adopt.

to an existing house... recommended approval subject to any

subdivision in the county of our extraterritorial area off of
Herbert Hoover Highway .... recommended approval of this
vacation request .....

Public hearing on an ordinance amending City Code
Title 14, Chapter 6, entitled "Zoning," Article S,
entitled "Performance Standards," Sections 10B and
10C, concerning the location of underground storage
tanks.
Miklo/ P.h. on amendment of the performance standards regarding the
location of underground storage tanks. Currently there are
performance standards in the zoning ordinance. This amendment
would refer to the UFC for the regulation for those storage
tanks...exception... underground storage tanks adjacent to the
residential area would have to be ten feet from a property
line.
Nov/ I would like to know why there is no distance requirement on
small above ground tanks ....
Miklo/ I will have to check with the Building Department and Fire
Department.
Nov/ And I would like to know what types of liquids are to be in
those tanks that are stored at zero distance.
Horow/
Nov/ It just says zero. It doesn't say commercial or residential
.... I am talking about the above ground .... It doesn't make
sense and I would like to know why it is written that way.
Miklo/ One of the items... for Commission pending list is a
revisiting all of the performance standards in the industrial
zone. That is an issue that we could tackle at that time. I
will try to find out the answers to your questions°

p.h. on the vacation of the resolution there was a question on
how these two plat designs interrelated to the ravine in the
area. (Refers to plat) .....
Nov/ So there is more room between the street and ravine on the
second plat ....
Kubby/ How many lots in the old plat were getting into the ravine
and how many in the new plant?
Miklo/ (Refers to plat) Most of the lots on the north side were
adjacent to the ravine of had part of the ravine .... (refers
to plat) ..... There are four lots in this vicinity that have
ravine .......
Kubby/...there are more lots and the lots are more buildable.

plat of Walden Wood, Part 8, a 12 lot, 4.3 acre
subdivision located west of Mormon Trek Boulevard,

Miklo/ Resolution on the preliminary plat of Walden Wood, Part 8.
We are asking that this be deferred indefinitely. There is a
need to acquire an easement across an existing pipeline
easement in the area for drainage .....
Horow/ Does this have anything to do with the proposed trail system
that would be along that same pipeline area?
Miklo/ There was a request from the neighborhood that the city
consider accepting the pipeline easement for a trail system.
P/R Commission look at that and chose to accept it. (Refers to

Consider a resolution approving the final plat of
Galway Hills Subdivision, Part Two, a 14.71 acre,
24-1ot residential subdivision located in the

Miklo/ Final plat of Galway Hills, Part 2, 24 lots. This was
approved by the P/Z Conmission subject to the City Forester
approving the Tree Protection Plan for lots 43 and 44 and that
has been approved... Also it was subject to legal papers ....
those both have been approved... plat is in order for
approval .....

requested and those changes have been made.

produced? Can you give me an estimate?
Schnittjer/ I don't recall .... put in close to four days work
assembling the information ....
Horow/ Point out how much the forester ...... This is not an easy
thing to undertake.

I am interested in giving direction to our inspectors about
how important this is to everybody. That they make sure that
this is done properly.
Horow/ This sort of process would get to Doug's, right?. Who would
oversee construction of this?

Miklo/ The Tree Protection Plan has two phases. 1-When the streets
and sewer and water lines are put in. Public Works would
oversee that. 2-Applies to the construction of the two houses
on the lots and HIS would oversee that.
Kubby/ I would like that both departments get the message then...

Calendar which is setting a p.h. on the Curb Ramp Project.
That will come back to you. It is not ready at this time. So

Karr/ I don't know. I was informed by Engineering. It is just not
ready yet.

F.I.R.S.T. Presentation - Intercity Bikeway 95-85 S2
Horow/ Mr. Cook has given us a fantastic stand up map of Iowa City
Trails.
Casey Cook/ I understand I have a half hour on the agenda ..... Make
some introductory comments of this thing for about ten minutes
and then field questions ..... There are four things that I
want to talk about: 1-~at we are trying to do here; 2-Steps
we have taken to date; 3- The next steps that we would like to
take and 4- What requests we have of council ..... There are
three aspects: 1- transportation aspect and one of the key
transportation aspects is this remote lot of the University.
We are trying to connect this remote lot and the family
housing into the Iowa River Trail here. 2- Provide a safe
corridor .... (refers to map) ..... The point of this link is to
provide an access for kids to get over to West High School ....
We are trying to take a little bit of traffic off of
Melrose .... Second thing we are looking at is a link from Camp
Cardinal over here (refers to map) ...... Those are the main
things. This evolved from the Neighborhood Open Space Plan and
our discussions there ..... wanted to get it in the pipeline.
This is a third priority behind the Iowa River Trail and
behind the Willow Creek Trail (refers to map) .... takes so
much lead time .... Don't know how long ISTEA funds are going
to last and we want to have plans in place so we can compete
effectively for those plans ..... We have been going to various
commissions and affected parties .... need to do more
discussion with the Coralville folks .... They are to the point
that they want to look at some engineered plans (refers to
map) ....

Cook/ ...try to get a better hand on what their concerns are. I
sent a letter to Charlie Denney and Dick summarizing our
conversation .... We have also talked to the P/R Commission...
preliminary support from them .... Come back with a more

questions. So those are the steps we have taken. The future
steps that we are looking at .... anticipate that 1-we are
going to need some staff time to negotiate with the RR about
RRr.o.w.

Coralville ..... price involved ..... 2- To put it in the
budget to do some engineering on this trail so we can get some
clear cost estimates on what it is going to cost. 3- Staff
time to incorporate cost and engineering drawing into a grant
so they can apply for ICTEA moneys .... Is it not true that the
Transportation Funding .... ICTEA funds come up with 80% local
match .....
Kubby/ Part of this is in newer... challenging for us to get
transportation corridors in already developed areas in town.
Where is that in FIRST visions of this whole system of trails?
Cook/ Could you start out with an easier question, please? My point
of view, I think we need to be very opportunistic about
trails. In this case...two land owners... they are interested
in making some arrangement so we can utilize the land ....
after consensus is built then you are in a position to go to
land owners and say we have got a trial here... it could go
through your backyard .... I don't think right now that is
feasible ..... some future point it may happen .... Until you
build that consensus...take advantage of the opportunities
that you have ....
Kubby/ It is quite of frustrating .... higher density of housing
.... hardest place to get people to use their bicycles as
transportation tools for most of the year ..... get them out
into the outer lying trails ..... Somehow it seems
backwards .... I want to do it all.

Boothroy/ I really appreciate the opportunity to go early ..... We
have talked about this before ..... Briefly run through it a
little bit for you. We have 18 units down on Broadway Street,
1926 and 1946 Broadway .... ten unit building...will be
completed in terms of its rehab. The eight unit is occupied.
We started talking about the sale of this apartment complex to
HACCAP back in January and they did apply for Block Grant
funds... to establish transitional housing in the 18 units ....
You have two resolutions. They are... the same. The deposition
plan for this project is the acquisition of 18 replacement
units which is what you are going to have the p.h. on July
27th ..... That is the plan: acquisition of 18 existing s.f.
structures and the other part is the application for
permission to proceed with the disposition of Broadway. What
HUD will do, the disposition plan, they will approve it and as
it is presently together...go forward if in fact... we get the
funding for the 18 replacement units ..... The opportunities
are very narrow for that ..... only funds that are going to be
there are for replacement units ..... questionable at this
point whether we will get the 18 replacement units ...... At
this point in time the window of opportunity for that is to
try to get that application into HUD by the end of this month.
To try to get this application for the disposition plan into
HUD by Thursday, the 20th.
Kubby/ Do we have to be specific on our application about the new
18 units that they be existing units versus new?
Boothroy/ Absolutely .... The application is very specific. It says
acquisition of existing units. You are not allowed to mix and
match .... got to do one or the other .... replacement units
have the highest priority ..... In talking to HUD officials in
Des Moines and Kansas City where they reviewed us, it is

There are no relocation issues involved here and of course

stores. The reason we wanted these here... we do want... to
catch people's attention ..... But PJ who is a store
designer .... who does coop and natural food store design is on
