Council. We are looking forward to having a nice little
celebration d.t. in co~unemoration of signing and passage and
effective dates of the ADA. We would just like to extend an
invitation to all of you to come down and hang out with us.
There will be music and poetry reading and just some
presentations by some of the folks in the community and some
folks from outside of the community coming from outside of the
community coming into town just to speak and choose some good
words.

contracts to Iowa City's sidewalk system into
compliance Americans with Disabilities Act.

Ramp ect is approximately 9100,000. This
will be funded by road use taxes & bond
ds.

LANDFILL LEACHATE LIFT STATION CONSTRUCTION
PROJECT.
Comment: This project will provide a new lift station
with improved capacity to pump leachate from the
landfill to the wastewater treatment plant to meet all
state and .federal regulations. The Engineer's con-
struction cost estimate is $545,600. Funding for this
project will be provided by landfill revenues.

Comment: The owner of the property located at 431

declining balance loan for $8,.500. The balance of the
loan was paid off on July 7, 1995, thus the lien can
now be released.

PLANNING AND ZONING MATTERS.
Consider setting a public hearing for Augus~ 1, 1995 on a
resolution to annex an approximately 2.~O acre property
located north of 1-80 and west of N. Dubuque Street.
Comment: At its July 6, 1995 meeting, by a vote of 6-0, the
Planning and Zoning Commission recommended approval of
the annexation of this property, which is the site of the
proposed water treatment plant. The Commission's recom-
mendation is consistent with the staff report.

Horow/ Public discussion. This is the place on the agenda for items
not on the agenda. Anyone in the public who wishes to address
council may sign in, state your name, keep your comments to
five minutes.
Robert Kemp/ Estron Street in Iowa City. Staff and council, Mayor
Horow you have decided to go ahead with the council census of
Iowa City to find out the number of people who are living in
Iowa City and those people who might be leaving Iowa City. I
want to address briefly the question, maybe, trying to find
out why people do decide to leave Iowa City or stay in Iowa
City including college students. We know why they come. Some
stay, some leave. High school students, some come and some
stay. I wonder why. I am going to focus just this 30 seconds
on older Americans, we they are important, simply because they
do have, as far as Iowa City is concerned, a fair amount of
disposable income. They present fairly few demands on our
school system and probably us older guys don't ravage and
pillage much anymore and that is probably a good thing for
crime. So, it does reduce the crime in Iowa City or
possibilities. The only gangs we are in are maybe bridge clubs
or bird watching or something like that and that is probably
that doesn't require too many police and about the only
hunting with assault weapons would be-I don't think we would
do any pheasant hunting with assault weapons but I suppose it
might help. I would like to say, though, I would like to go on
but I am not going to. I would like to show you a presentation
made by KCRG in Iowa City, Gerald Tresnick who looked at Iowa
City as a place to live and why people do come here and I can
indulge the city council for just a few minutes. I think it is
worth maybe some thoughts about why people come to Iowa City.
Not just the number. Why they come or why they leave.

Kubby/ It is nice to have another form of communication at city
council meetings. I know in the past there had been some
rejection of the council of presenting information to us via
this media and this probably is a precedence and I am really

Horow/ When P/Z Commission denied the request from the developer,
the developer always has the ability to come to council and
ask councils to set a p.h. for this and this is what we are

people to get to and understand both of the sides of issues on
this and come to us by August. Do you wish to add anything?

Consider setting a public hearing for August 1, 1995 on an
Ordinance amending Title 14, Chapter 4, "Land Control and
Development," Article C, "Historic Preservation Regulations,"
and Chapter 6, "Zoning," Article J, "Overlay Zones" to allow
the City to designate historic landmarks and conservation
districts.
Comment: At its July 6, 1995, meeting, by a vote of 4-2,
with Jakobsen and Starr voting no, the Planning and Zoning
Commission recommended approval of the amendment to
allow the designation of conservation districts and, by a vote
of 6-0, recommended approval of the amendment to allow the
designation of historic landmarks. The Historic Preservation
Commission, by a vote of 5-0, also recommended approval of
the amendments at its May 9, 1995 meeting.

Horow/ Declare the p.h. open. I would ask you to sign in, state
your name and keep your comments to no more than five minutes.
Last evening council considered this and council member Kubby
asked about the issue of lighting and FAAapproval. Do we have
any more information on this?
Miklo/ The applicants will be required to receive an FAA clearance
for the proposal. There are similar businesses in the area
that have received permits for lighting.
Kubby/ Will the permit be section by section as this property is
developed or will the FAA be looking at the whole thing?
Miklo/ It is based on the building permit that they are applying
for at the time. So if they submit a plan for the entire site
yet they will consider that. If they choose to do it in
portions they could do it in that manner.
Kubby/ So if they do it in portions, by the time the third auto
use/sales use which usually has a lot of light, will the FAA
know that there are two other auto sales lots right adjacent
so it is an accumulative affect?
Miklo/ I would imagine they keep records of pervious approvals.
Horow/ It occurs to me that this would be a useful recommendation
with the airport update. I see your point that there be an
accumulative consideration. Either the FAA gives approval for
the whole acreage or if they do it piece meal. We will be
dealing with that this fall. Does anyone else have any issue
that they wish to bring to council?
Baker/ Sue, could I.just ask for clarification because I was just
not here at the meeting last night. I am looking at two staff
reports and I hope they are all relevant to this particular
item. This item says 103 acres and the two staff reports talk
about 39 acres. What was the difference there?
Miklo/ The first or the actual property, private property, is 39
and some acres. The annexation also includes the r.o.w. of
Highway 1 and 218. There are some discrepancies in some of the

earlier reports because those were based on estimates. We have
actually had the properties surveyed and the 103 acres is a
correct acreage.
Baker/ Then the staff report also says Winebrenner Ford on behalf
of Kirkwood Community College. What does that mean?
Miklo/ Winebrenner Ford is in the process of purchasing the
property from Kirkwood Community College.
Baker/ Thank you.
Horow/The resolution spells that out, Larry, that the interchange
consists of 64.56 acres. Private property is 39.
Baker/ Thank you.
Throg/ Sue, I am just kind of imagining that there are people out
in the audience that are watching the discussion and don't
really understand what is being annexed and why and what the
consequences are. So, I wonder if we could ask Bob to briefly
describe this proposed annexation in a little bit more detail
so anybody who is watching will have a better sense of what is
happening.
Miklo/ The property is at the southwest corner of Highway 1 and 218
interchange. The area currently contains Miller Monuments.
There is also a implement dealership there just to the west
which is in the county. Winebrenner Ford originally approached
the county about rezoning property and having it developed in
the county. As a matter of the Fringe Area Agreement we
reviewed that proposal for a county rezoning and recommended
that it actually be annexed into the city so that we could
provide city services, water, police, fire protection. Also it
is our Fringe Area Policy that more urban type of this should
occur in the city. At that point Winebrenner Ford submitted an
annexation request to us and a rezoning request. If the
annexation is approved and the zoning is approved, Winebrenner
Ford plans to move into this site and there is a possibility
of one or more additional car dealerships on the same
property.
Throg/ And what does the Comp Plan say about this particular area?
Miklo/ The Comp Plan designates this interchange for industrial or
commercial development. The plan goes on to say that those
types of uses should occur at this interchange rather than

other interchange on the west side. For example, the Melrose
Avenue interchange encourages residential in that area and
suggests that commercial be concentrated in this one area
rather than spread out along the highway.
Throg/ So it is likely that we would expect to see kind of a
cluster of commercial development on all four sides of that
intersection of Highway 1 and Highway 218 over time and this
would be part of that process.
Horow/ Having watched the commercial development from Carousel
Motors to the west, both on the south side and the north. When
I was on the P/Z Commission I know the amount of detail that
when into considering development specifically because it is
an entrance into the city. So, on my part, it seems to me that
by annexing it helps us control (can't hear). However this is
a p.h. and I apologize for giving my opinion but I wanted to
help you in terms of the (can't hear). Is there anything-
anyone else from the public? Declare the p.h. closed.

0.82 acre tract of land, the north portion of Lot 4, Highlander
First Addition, which is located on Northgate Drive from RDP,

zoning agreement for Lots 4-17, Highlander First Addition,
revising the development standard pertaining to rooflines and
parapet walls, (REZ95-0008)
Comment: At its June 15, 199§ meeting, by a vote of 6-0,
the Planning and Zoning Commission recommended approval
of revising the development standards for Northgate Corporate
Park'by repealing Section 10.30.3 which required flat rooflines
and replacing it with language that supports consistency, but
does not specify a required)design for rooflines and parapet
walls throughout the corporate park, This recommendation is
consistent with the staff recommendation contained in the
staff memorandu~ dat~d~, 1995,
Public hearing on an ordinance vacating a 20-foot wide alley
located east of Gilbert Court and immediately north of Lot 4
of Block 3, Lyon's Addition. (VAC95-0002) ~/~/.~.~_~..~/~
Comment: At its June 15, 1995 meeting, by a vote of 5-0,
the Planning and Zoning Commission recommended approval
of the requested alley vacation, subject to the retention of a
five-foot easement along the noah edge of the subject alley
for storm sewer and ditch maintenance, and subject to the
retention of easements for any utility that may exist within
this right-of-way, This recommendation is consistent with the
staff recommendation set fo~h in the June 15, 1995 staff
repo., No utilities exist within the right-of-way, so no
easements are needed.

Public hearing on an resolution vacating Fox Hollow Subdivi-
sion, a 31-lot, 52.21 acre subdivision located north of Herbert
Hoover Highway and west of Taft Avenue. (VAC95-0003)
Comment: At its June 15, 1995 meeting, by a vote of 5-0,
the Planning and Zoning Commission recommended approval
of vacating the Fox Hollow Subdivision. This recommendation
is consistent with the staff recommendation contained in the
staff report dated June 15, 1995.
Action:
Public hearing on an ordinance amending City Code Title 14,
Chapter 6, entitled "Zoning," Article S, entitled "Performance
Standards," Sections 10B and 10C, concerning the location of
underground storage tanks.
Comment: At its June 15, 1995 meeting, by a vote of 5-0,
the Planning and Zoning Commission recommended approval
of amending Section 14-6S-10B by repealing all references to
underground storage tanks, and amending Section 14-6S-10C
by including all undergr. ound flammable and combustible liquid
storage tanks, not just those associated with filling stations
under-the governance of the Iowa City Uniform Fire Code,
except the minimum distance between underground bulk
storage tanks and any residential zone boundary shall be at
least ten feet. This recommendation is consistent with the
staff recommendation contained in the staff memorandum
dated June 15, 1995.

Public hearing on an ordinance amending City Code
Title 14, Chapter 6, entitled "Zoning," Article S,
entitled "Performance Standards," Sections 10B and
10C, concerning the location of underground storage
tanks.
Horow/ Declare the p.h. open.
Nov/ Before you close the p.h., Bob, did you find out anymore about
what kinds of things would be stored in an above ground tank?
Miklo/ There could be flammable liquids stored in above ground
tanks. In addition to the Zoning Ordinance which regulates
above ground tanks, the Fire Code also regulates them and they
actually, in some circumstance, require a greater setback than
the Zoning Ordinance requires and those set backs are
determined based on the size of the tank and the type of
liquid. So there is quite a variation. We will be reviewing
all of the performance standards for the industrial zone. So
we will look at the setbacks for the above ground storage
tanks at that time.
Nov/ Can we make our requirement in the Zoning Code agree with the
Fire Code?
Miklo/ They could. The difficulty is the Fire Code is quite
complex. It may take several pages. If we leave it as is, the
Fire Code supersedes setback. If it is necessary, it is a
great setback.
Kubby/ Can we just reference the Fire Code in our Zoning Code?
Miklo/ We could do that.
Nov/ At least reference it. Do we need to continue the p.h. if we
are going to make that change in the code?
Kubby/ Is that substantial?

Kubby/ I am very glad that we are doing this. The thing that we did
just before this was saying that the old plans for this
development are no longer in effect and we are putting in a
new plan for development and I had with the original
development voted against it because four of the lots were
going to be very much in a very steep ravine. Even some of the
buildable portions of the lot although not all of it. This new
plat still has four lots that go into the ravine but the lots
have been reconfigured so that there are larger lots and there
are lots of buildable portion that is in a more level area. So
it will be a lot better for saving the ravine and keeping that
intact which helps the whole neighborhood in terms of
drainage. So it is not just that I value ravines for some
esoteric reason. There is good purposes for the whole
neighborhood to save those ravines as well as wildlife issues
and just saving wood areas and species that grow there. I am
very glad this change is happening.

Kubby/ I have a few comments about this. This has been a long time
in coming and I am really glad we are finally doing this.
There are three things that I think were really important to
me. That any contract we do for paratransit that they would
have certain characteristics. First and foremost that the
services don't decline. That we have the same high level of
service for people needing paratransit. That is in this
contract. That are our breadth of service in terms of where
people can get rides to does not change. You can get a ride
within the county and actually sometimes a SEATS goes to Cedar
Rapids for shopping trips and other things on a coordinated
basis. That is in here. That we have one system for the whole
county so that things were simplified, that we didn't
duplicate services, that we were working together. We
accomplished that. And that we had one dispatching operation.
We figured out how to do that. So I am real happy about this.
I question-I don't question. I wish this were a multi-year
contract. I understand the reasons for us not doing that so we
can see how this one works and there is an option to renew for
a year. I dislike the thought of us every two years having to
go through this process with the RFP. Not so much as a
competitive exercise to make sure we are getting the best bang
for our buck and in terms of the emotional impact it has on
the community. Their independence is dependent on this
service. So I wish that stuff were different but that is kind
of out of our control. The feds have said every two years you
need to do this. I support this contract with those
hesitations.
Horow/ Anyone else have comments?
Lehman/ Sue, you and I were on the committee that first met last
October and I think it is important to recognize that there
really was a commitment on the part of the city and I think on
the Board of Supervisors to come to some agreement that we
could continue the service as we have always know it. I think
our new agreement has a couple of provisions in it that are
going to make next years's agreement and subsequent agreements
even easier. So, I, too, am very pleased with it.

Baker/ I just had a quick question for Steve. A confirmation of
something he said earlier. In the final result of this
process, the RFP process, negotiations, we have ended up
saving the city-providing the same service and saving the city
a substantial amount of money.

$40,000.

Pigott/ There was concern and conversations that I have had with
residence in the city about some of the great lengths to which
SEATS employees go to helping their consumers to the door with

Kubby/ The other thing is that at one point the Board of
Supervisors had chosen not to respond to our RFP. I am really
glad they were listening to the consumers of SEATS saying we
want you to put a proposal in and I am glad. Sometimes it is
hard in government to change your mind and say well, that
first decision wasn't the best one. And so I am grateful that
they were open to doing it.

Kubby/ Ric Graf had actually resigned his term on the HR Co~nission
and he did that for health reasons while he was dying from
complications of AIDS and he did pass away last week. I guess
I want to acknowledge that because of what an asset he was to
this community. He was never scared to say what he thought
about things no matter how big the barriers were and he was
just a very vocal civil rights activist and I think it is
appropriate to honor him in some way. There is a public
memorial for him on Sunday, July 23, in upper Hickory Hill
Park and that people are invited to. Space is available at
5:30, ceremony at 7:00 and community potluck afterwards. So,
come and honor him.
Horow/ I appreciated Ric's input in Healthy People 2000. He was
involved in more than just those issues that people think are
controversial. He was involved in ordinary health care.
Kubby/ Even small things. His garden and winning a community
appreciation award. The personal things that end up giving
this community a flavor happen because of people like Ric
Graf.

Kubby/ I have one item tonight. Many of us got calls about a
possible exotic animal ordinance and I told Lisa Goodman, our
Animal Control Officer, that I would talk a little bit about
what is happening in her office and her department. TheAnimal
Control Advisory Committee which is an appointed committee
that is made up of Coralville and Iowa City people and I think
Johnson County folks, too. But they have asked out Animal
Control Officer to put together an exotic animal control
ordinance that would not ban the possession or sale of exotic
animals but would control it in a way and when I say exotic
animals Lisa said she was talking about things like lions and
tigers and bears. Not about parrots or ferrets or things of
that nature. Lions and tigers and bears, oh my. That is what
she said. But not tropical fish. There was that rumor about
tropical fish going on. It is not true. This ordinance would
not control tropical fish but what it would do is permit
exotic animals to make sure there was proper enclosures,
space, heating, health care for any animal. It would also
permit kennels and if circuses or petting zoos came to town
they would have to get a permit to check all of those things
for the health and safety of the community as well as the
animals. I suggested to Lisa that there be some kind of public
process in writing the ordinance because there is a lot of
fear when you start banning certain kinds of animals or even
controlling who can have what in what environment. So if
people are interested in this issue, whether you are coming at
it from a viewpoint of a animal rights activist or whether you
are coming at it from the viewpoint if you are someone who
buys and sells exotics to get a hold of Lisa Goodman at the
Animal Control Office to say that you would like to be on
reviewing and getting input about the ordinance before it
comes to the point of- There is the exotic issue.

Association Amnesty International and the Center for
International and Comparative Studies are all getting together
to host a forum to discuss the importance of the convention to

nation. Sort of in context for preparation for the Fourth
World Conference for Women which is taking place, I think, in
Beijing this fall. I say I think because there is plenty of
controversy regarding human rights record in Beijing. In any
case, in preparation for all of this conference there is a
campaign to educate and discuss about women's issues and the
international laws which seek to protect women's rights and
encourage us, us being the United States government, to ratify
the convention to eliminate all forms of discrimination
against women. So tonight, right now in fact, at the public
library this is being conducted and anyone who is watching
this is interested in talking about this should rush on down
to the public library for that discussion and it should be
worthwhile. It is all a great part of an effort to bring
international issues down to a local level and bring local
input up to the international level. So, I applaud those
people who are involve with this.
Kubby/ Bruno, is that a document that can be ratified by a local
government?
Pigott/ It is and I think these organizations would like to bring
it perhaps to us for an endorsement/resolution stating our
policy to encourage the government to ratify it. So maybe we

Baker/ One item, Madam Mayor, and with some indulgence I need to
take a couple of minutes on this one. As we all know serving
on the council is a public figure you sometimes are the
subject of discussion by other people and the public and you
learn to very often just let people have their say. I would
like to take a couple of minutes to clarify what I think are
some possible misperceptions based upon a recent publication

in a local newspaper. This has to do with the city's record in
providing or working towards eliminating barriers for persons
with disabilities. This recent letter to the editor in which
and I understand the limitations of the letters to the
editors. They are 250 words and you put in a lot of
information and you have a lot of energy and commotion and you
want to present as much of your case as possible and sometimes
inadvertently and unintentionally perhaps some misperceptions
are created. And I would like to take a couple of minutes to
talk about that because I think that people of Iowa City need
to understand a little bit more about the record of how the
city, not just this council, but the city in the past has been
working towards eliminating those sorts of barriers. I asked
Dale to do some research about two specific things in this
particular letter. One was about the history of our transit
service and how we are coming into compliance or the speed in
which we are coming into compliance with various federal
regulations and also to talk very briefly about what the city
has been doing financially in the last few years and what we
are doing on a regular basis to help bring the city into
compliance and eliminate a lot of those barriers. I also ask
Dale to contact this particular letter writer because there
were specific problems and I just needed to find out if he
made contact and if there's something the city can do to solve
those particular problems and then I've got one brief comment
about another portion of that particular letter. So Dale,
could you bring us up to date?
Helling/ History-wise, as far as the compliance with the transit
system and the operation I think you're specifically talking
about, the mandate to lift equip coaches, that was mandated by
the federal government in 1973, and there was a lot of outcry
at that time and after that, I don't know the exact time but
sometime later on in the '70's, before that could be totally
enforced, the federal government rescinded that and gave
cities and transit operators, whoever they might be, cities,
counties, whatever, transit authorities, the alternative to
either provide lift equipped coaches, or to provide
paratransit services. At that time, the vast, vast majority of
transit operators around the country opted for the
paratransit alternative as did Iowa City, and operated a
paratransit system thereby being in compliance up until 1990
when the Americans with Disabilities Act was passed. The ADA
then was a new mandate for lift equipped coaches as well as
paratransit service and that was not an immediate requirement
but required that new coached as they were purchased would be
equipped with lift equipped facilities. Since that time we

have purchased five coaches in Iowa City and they have all
been equipped with lift devices. We will be replacing
probably, hopefully anyway, if the federal money is there, ten
more coaches in the next two years. They will be lift
equipped. That will leave six to be replaced and those six
were purchased four or five years ago. They'll be replaced in
approximately in 2002 or 2003. When we replace those, then we
will have a full fleet. Any additions that might happen as far
as additional coaches or whatever, would be purchased. They
would have lift equipped as well.
Baker/ What's the problem with just taking the current buses and
making them accessible?
Helling/ Well, that can be done. Number one, that was part of the
problem back in the 70's. There was a lot of retrofit that was
being done or being tried at that time and there were a lot of
problems. This is heavy equipment and it's kind of a complex
operation if it's built into the coach it functions much
better. If it isn't, not only will the equipment not function
correctly because the transit coach isn't designed to
accommodate it, but it will cause a lot of excessive wear on
certain components of the bus because they are very heavy in
and the suspensions and so forth aren't designed specifically
to have that so retrofit just hasn't worked very well.
Kubby/ If I understand CAMBUS has done (can't hear).
Helling/ I understand they have done some fairly recently. I don't
know the results of that, and at least what we know about
anyway is these kind of problems develop over time. I think
retro-fitting now is much better than it was ten or fifteen
years ago. I remember reading something about Los Angeles's
running about 80-90% down time on their wheel chair lifts on
their buses at one point that were retrofit. But certainly
that's, we have- that's an option that I think you could
address if you wish. I don't have the cost or anything at this
point.
Kubby/ (Can't hear) technology because it's always changing and
that when it is appropriate and cost effective (can't hear)
makes all our lives accessible.
Baker/ The point I was trying to make was that we are working
certainly as this and many other areas probably not as quickly
as is satisfactory for the people directly affected, but we
are making progress, substantial progress I think. I didn't

want the public to think that this was simply being ignored
again.
Helling/ Our current paratransit plan that involves what I've
explained to you is in compliance. That we're not out of
compliance at this point as long as we continue to put lift
equipment on our new buses.
Throg/ I just want to follow up. You're point's correct and I want
to share it. But you also alluded to something else that
probably deserves a little bit of discussion and that is you
were suggesting that it may well be possible that Congress
will reduce the amount of funding available for new transit
capital expenditures, new buses. Not to mention the fact that
they are very likely to cut operating funds for transit. Not
to mention the fact that they are very likely to cut in the
development block grant by about 30% and they're going to cut
HOME fund- what's HOME stand for? I can't remember what the
acronym stands for, but they're going to cut that
substantially. And all of this has already been agreed upon by
a joint resolution of both the House and Senate. So what we're
looking forward to in the near term future like within the
next five years is substantial cuts in very major components
of our local funding package. Substantial cuts in federal
funding, and they're going to have significant effect on the
services that this city council and city government is going
to be able to deliver unless some other sources of funding are
foun~. So we're facing I think-
Kubby/ A challenging time.
Throg/ A challenging and not particularly happy future over the
next five years.
Nov/ And you haven't any really good ideas about where those
sources may be.
Pigott/ That's right.
Throg/ Well we can dream up some possibilities like say a sales
tax. There are ways to generate funds. Then the question
becomes, well it's right here. Who's going to pay for new
buses and accommodate people with disabilities.
Baker/ Dale, you were going to talk a little bit about other
financial commitments the city's making towards this.

Helling/ For a number of years quite a number of years in the past,
the city had allocated I think it was $25,000 a year to do
curb ramps in addition to all our projects where we're
reconstructing curbs or streets. In those cases we had ramped
those as a matter of course and then in addition set aside
money with the advent again of the ADA I think you increased
that four fold and now you allocate $100,000 a year.
Baker/ Which we did tonight.
Helling/ In addition which you set a p.h. on your consent calendar
for August First for this year's projects.
Karr/ We deleted that.
Baker/ Is it ready to go in?
Karr/ We deleted it.
Helling/ Okay. And that's on an annual basis. The staff regularly
takes input and keeps track of complaints or input we get
about where the barriers are and every year we attempt to then
to prioritize those kind of situations and so when we develop
the project for that year, we can hit the highest priorities.
We encourage people who use certain routes in the city who use
wheelchairs and go in certain ways, to let us know if there
are specific barriers there and we can kind of adjust our
priorities that way. That's what we intend to continue to do
so eventually we'll have all the corners ramped.
Baker/ It's just a process that is slow but it does involve a
lot of citizen input and the locations are affected by
input which you did from people.
Helling/ It's much easier to do it, to design our projects each
year if we have that input then trying to figure it out
ourselves.
Horow/ Well, the other thing that occurred to me, when we built the
houses along First Avenue, weren't they built to be accessible
or at least one.
Nov/ Convertible I think.
Horow/ Convertible.
Atkins/ Now remember we dealt with that issue Susan because it

arose during the design and I honestly don't recollect what we
did.
Kubby/ But there's some block grant money. It's very simple. For
the Press-Citizen project. If all those units will be either
built accessible at the beginning or adaptable for individual

unfortunately an issue that cannot be solved quickly and it is
a long term process and that's why i bring it up tonight
because I didn't want the great majority of people to
misunderstand people's frustration and I think that's what I
wanted to address. Were you able to contact this person and I
don't want to know particular things but you're going to try
and address those particular concerns.
Helling/ Right. I did talk to her and she gave me some specific
information and I'll get back with the proper departments and
we'll do that. Sure.
Nov/ Larry, I'd like to add one more thing that we have done with
government funds. We have converted homes for people who
needed it. If they needed grants or wider doors or something
like that because they became disabled or they developed a
need for a wheel chair, we have done that kind of thing.
Baker/ One last point I'd like to make and I don't want to spend a
lot of time with it. There was a reference to this discussion
about the visions statement and the disagreement about the
wording about the vision statement. We talked at length about
this at the last meeting and those of you who watched it
certainly can remember that and transcripts are available for
our complete discussion. We have, you know, a word for word
transcript that's available. For those people who might not
have kept up with that particular issue, I'm going to do like
a 60 second summary. We went through a long process of various
committees dealing with certain aspects of life in Iowa City
to put together what the citizens of Iowa City see as a
vision. A lot of those areas were economic development, arts
and entertainment, environment, housing, and from those
individual statements, they were sent all to the P/Z
Commission to be compiled and sent to us. A few of those
individual statements for particular areas made specific
reference to people with disabilities. Once it got to the P/Z
level, the suggestion was made that we incorporate all groups
into one preamble defining citizens specifically in the
preamble and using the phrase all citizens in the rest of the

document. There was disagreement about whether to include
specifically people with disabilities in various specific
sections and there was a lengthy discussion of that. But I
think that one of the things that was clear in that discussion
was that the council was unanimous in commitment to working on
this problem. And I don't think there's any individual council
member- I don't think any individual council member would say
that they have a higher commitment or more sincere commitment
than any other council member. We disagreed about that
particular part of the vision statement. And I didn't want the
public to be mislead, possibly mislead, unintentionally
mislead about the commitment of everybody on this council and
I'm not going to speak for the council but I think it's safe
to say that all of us see each other and city staff committed
to this together to resolve and solve these problems and once
we get past a discussion of particular wording, we will work
together on this.
Kubby/ I think that's really true. The only think I'd disagree with
or add to that is we may have different ways of going about
doing it as individual council members and that when a group
of people organizes themselves and says this is the way we
want to be presented and some of the comments at the last
meeting were things like this will really hurt you in the end,
and it's better to be in the preamble than to be in these
specific places and there could be some downside. I guess I
just trust the group that's organizing around this issue to
represent themselves and I felt like some of that conversation
was a little bit patronizing, and that's just my view of it.
You may disagree with that and I don't think that was your
intent at all but I think that was how I think it got
interpreted by some of the people.
Baker/ I would certainly disagree with that.
Kubby/ Because I talked with them and so we may have different ways
of expressing how we want to do it but I do agree totally with
your statement. I mean you do speak for me when you say that
you believe that no one has a higher commitment than any one
else on this issue.
Baker/ And I think we all have make a distinction here and the
public has to understand this tkzt very often disagreeing with
you does not mean we're nut listening to you. It just simply
means we disagree about that particular aspect.

Throg/ I have been looking over the duties that are specified in
the proposed by-laws and it says, among other things, that the
proposed commission would review and make recommendations to
the city council regarding the use of public funds to meet the
needs of low and moderate income residents. Well, I totally
support the proposed duty but I am just wondering if the rest
of you would agree that that would exclude reviewing the CIP.
Horow/ So far it includes the Aid to Agencies. Marianne-
Throg/ Just so I can be clear about that. It seems to me that the
CIP is a very important component of development of the city
as a whole and the development of the city as a whole has a
vital influence on the provision of housing, jobs and
services. Services grow and moderate income residents.
Kubby/ So why would you object to them reviewing CIP?
Throg/ I am sorry, I am not objecting to it. It is my understanding
that they would have the authority to review the CIP.
Horow/ To make recommendations.
Throg/ To review and make recommendations and I just want to be
clear that that is part of the understanding.
Horow/ And we have the right to accept.

from their experience with various agencies.
Throg/ I guess I have a related question. Maybe Marianne can answer
it. We will soon be in the process of revising the Comp Plan
as a follow on to the Visioning thing or process. So I guess
I am wondering whether it is understood that the new Housing
and Community Development Commission will review and comment
on any draft Comp Plan that comes out of that process?
Milkman/ I think they will review and comment on appropriate
sections of it.
Kubby/ Isn't there a caveat in there that says any issue that
affects low to moderate income residents, that they may make
recommendations through that statement in the by-laws?
Milkman/ One of our concerns, frankly, in writing these duties and
limiting them somewhat is when you look at community
development it is everything and we didn't want to give the
new commission such an overwhelming set of charges that they
would just really have a very hard time with it. So that is
why they were some what restricted. Certainly they can and
probably should review things affecting low and moderate
income.
Kubby/ Sue and I, I don't know when we are going to be meeting but
if people have additional comments about the by-laws or if
anybody out there reads them and has a comment, get a hold of
Sue or I before our Rules Committee meeting which most likely
will be before one of our informal or formal meetings.
Baker/ Sue, can I go back and get some clarification on an issue
that Jim just raised because I just got in on the tail end of
it about the review of the CIP budget by this Commission and
everyone is shaking their heads yes, that is what it means?
Does that mean literally a formal staff presentation because
I assume that every board and commission has sort of
prerogative to review anything and make recommendations or
comments on the CIP budget but the assumption that it is a
formal presentation? Is it too presumptuous to start talking
about this now but what that means?
Atkins/ I am not so sure you want to talk about that right now,
Larry, but personally if that is what the council is
comfortable with, we have no trouble making a presentation to
Boards and Commission and in fact, if you recall, the last go
around, you sent the P/R Commission lists to them and ask them

to set their particular priority. It is not out of the
question. In fact other communities I served the P/Z
Commission was the primary agency in the CIP.
Baker/ When you mentioned this commission I kept thinking of the
Planning Commission, what their review process was.
Nov/ In terms of what part of it. Certainly this commission isn't
going to be terribly interested in the bridges CIP.
Throg/ Actually you are getting to the point I was trying to bring
up. The CIP involves setting priorities about how to spend a
bundle of money over the next seven years. So then the
question becomes-I wish I can't remember the exact language
here. The questions becomes how will that expenditure of a
bundle of funds over seven years affect housing, jobs and
services to low and moderate income residents. That is the
fundamental question. I think it would be very important for
the council to ask and expect the new commission to review the
CIP from that perspective.
Horow/ I think that would probably dovetail with the City Steps.

Kubby/ I was talking to some people last night and they made a very
interesting suggestion and that is when we contract out for
design work to some how build in an incentive into our
contract that if this cell is cheaper than the last one, you
get some percentage of the savings or some kind of incentive
to design things in a way that does what we need it to do but
get creative to do it in cheaper way or less expensive way.
Lehman/ More efficient.
Fosse/ In this case I think we are going to see an increase in the
price because the current cell that we are just finishing up
now has a four foot thick clay liner in it and the EPA is
pressuring Iowa to change the regulations to a two foot thick
clay liner with a synthetic liner superimposed beneath that
which is kind of pushing the cost up on it and-
Kubby/ But we could jiggle things for that to accommodate those
things that are out of the designers control. It is just an
idea. I don't know how it would work but it would be
interesting for us to think about that for a future design
contract. To brainstorm how to create those incentives for
anything.
Throg/ So as a policy question you are basically asking the council
to direct staff to devise some kind of procedure for building
incentives into contracts for cost savings.
Kubby/ Yeah.
Throg/ I think it is a great idea.
Horow/ Look at Purchasing Department to look at something or not
only just Engineering but anything.
Fosse/ In a sense that is built into our process in that for
engineering services our decisions are based on qualifications
with the thought being the best qualified people have the best

ideas and they create the best design at the least cost. But
we have not going beyond that and provided financial
incentives. That is something we can look at.
Kubby/ If it could save us more than the incentive would cost us it

Kubby/ The other question I had about the cover for the old
landfill that we are filling up and I know that we have done
some experimentation with poplar trees and that there has been
some studies in different parts of the country. Is Iowa not
allowing that as a cover or part of the covering system for
old landfills?
Fosse/ I don't know the answer to that. We have got some poplar
experiments going on out at our landfill and whether they will
allow us to incorporate that into this part of the cap, I
don't know and I don't know the results and successes in
reducing leachate.
Kubby/ I would like us to ask Howard R. Green when they are
designing this to look into that question. If it is working
well and can be approved by DNR, how to make that happen. A
lot of ifs.

Throg/ I want to ask a difficult question only because I have heard
this question asked of me and therefore I need to ask it. Why
is it better for Howard H. Green to do the follow up work
rather than some other consultant firm? Said differently,
Howard R. Green had the initial contract back in 1991 or there
abouts and then is currently doing the work for us with regard
to the site development and now will be have this new contract
for follow up work. So, I know that some people look upon that
with great disfavor. So, Steve, I wonder if you could-
Atkins/ I want Chuck to come to the microphone. Also, Jim, while I
am answering you and your question is well taken. We have had
a number of projects. In fact our wastewater improvements that
we did in 1980's we hired a separate firm to oversee the
construction, management, and in affect, our eyes and ears on
the project site. There is another thought process that says
that the design engineer, particularly one that has already
gone through the process of value engineering where there has
been some sorting by an independent firm to begin with, is
better equipped and probably a little less expensive because
it is not as necessary of them to get up to speed on certain
issues with respect to overseeing the construction activity.
The design and the construction are different enough that I
think you can use the same firm. I very much agree with you
and understand your point and kind of consternation that it
does cause. A little bit like the fox guarding the hen house.
Excuse me for being trite but they have designed it and
therefore they can stay on top of it. I don't think there is
a right answer because I have seen it done both ways.
Pigott/ Do we do a competitive process on this?
Schmadeke/ Not for engineering services, we don't. We just
negotiate.
Throg/ Why don't we do competitive bid?
Schmadeke/ It is difficult for this type of work because we don't
specify every detail of the responsibility. We would have to

know where things are suppose to be, how deep they are suppose
to be, what codes are suppose to be followed. We know how

it could be put out for competitive bid.
Schmadeke/ But we don't tell the consultant what- Like two people
out on the job site for specific types of work. We leave that
up to them. If we go out for competitive bids they will use
the minimum amount that they feel is necessary. We may not get
the quality of work that we want because of that competitive
bid and yet it can be difficult for us to go out and say you
don't have enough people on site. We are going to require you
to put more. They haven't built that into their bid.
Kubby/ It is competitive in terms of you know who is out there to
do this kind of work or people contact you to do this kind of
work and that we look at qualifications and past experience on
the kinds of jobs that we need some consulting on and so in

that sense it is competitive but not on the money.
Horow/ I guess the thing that I keep mentioning is the actual
construction is competitive.
Woito/ It has to be by law, yeah.
Horow/ So the management, it seems to me, has to be someone who has
worked in it because they are working with a company that has
not it. I understand the question that comes to you but I
would suggest (can't hear). This is a major company that
(can't hear) bids for much (can't hear). These people have to
ride herd over the ones who are coming into this blind, doing
the work as designed.
Kubby/ We look at the people who have offered to do this for us and
we have interviewed a couple. Do we- say someone does a new
water plant in another area of the state where certain
consultant companies have worked. Do we- Like happened three
years ago that they were on the job doing the same kind of
work. Do we call them and say in the aftermath were things
really okay now that the plant is up and running or were there
some problems. Do we do any kind of reference checks basically
about this specific kinds of projects.
Schmadeke/ We do at the time of interviewing but we don't follow up
after we are done on specific jobs that they indicate that
they are involved in.
Kubby/ So it is kind of general reference, not specific reference.
Is that something we could do if we wanted to?
Schmadeke/ We could, yes.
Horow/ We did with the airport (can't hear).
Kubby/ I think it is not a bad idea.
Woito/ We did with the codifiers. We called like 50 references.

management job like this just because you don't know exactly

built into the cost of the water plant. So this is not
something that is on top of it or a condition to it. And I
guess, Chuck, if you folks are comfortable with these folks,
obviously you feel very confident they are going to do a good
job. It is probably worth something just to deal with folks
you are familiar with.
Kubby/ It is amazing they want to do it actually when they know the
level of scrutiny that this project will have.

unique. We are trying to put a New Pioneer in the downtown
area. It is already in the d.t. area and the unique part about
this particular project is that it is not only serving the
d.to and the pedestrian traffic but it also serving the whole
community it requires parking to do that for this particular
project. What I have here is the perspective of the project
and I would like to run through some of the things that we
felt were important. First of all this is Gilbert Street
running here and College Street running this direction.
Pigott/ And the Rec Center is right across-
Pattschull/ Is right across here and the church is sitting on this
corner. The thing about this street is Gilbert Street really
is an automotive heavy traffic street. All your automotive
traffic is moving this way and College Street on the other
hand in more of a pedestrian operation. Everything runs from
the town out to this (can't hear). So our intent was trying to
market the New Pioneer so that-

Pattschull/ Our intent was to try and get New Pioneer in front of
the community so that it will be a success and for it to read
as a food store and still to have a gigantic parking space
that is projected out in front. So what we have is actually
put the parking under the building and you enter, if you were
coming onto Gilbert Street, you would enter on College and
pass the front and this becomes a front entrance. What we are
trying to do with the building is actually put the entry back
in here so it sort of defines the center of the block. So the
building on this side, this mass becomes sort of the dividing
line and catches the pedestrian traffic that comes through and
focuses everything in this particular location which is the

entry to the building. If you are coming by car, you can come
in and enter through a parking level that runs along this
total side of the building, comes out of the back into the
alley and then comes back under the building. You can circle
through that parking area and then you can either exit back
out onto Gilbert Street in back of the building or come back
out on College Street to go either direction. I can show you
some of the floor plans but I would like to walk through some
of this a little farther first. Pedestrian traffic then comes
down College and actually focuses into this area and comes
into the front of the building and it is actually opening in
under this area and there is an elevator that lets you get
down to the lower level as well as the stairway. We are
planning to keep open and lighted on the lower level. So the
retail store actually occupies the first floor. There is a
mezzanine level up above that extends out as a deck area over
the front entry way that becomes the focal point of the
building. The mezzanine goes back in to this section and then
there is about a third of the floor area that is on the
mezzanine level of the building. The building itself-Then on
top of that we have the apartment complex that occupies the L
shaped section of the building. It has a separate entrance
that is located also off of College Street. The building does
have a large mass and one of the things that we tried to do is
break that mass up and the way we did it was to utilize brick
construction on the lower level which is basically a two story
level and then we are using a stucco construction or finish on
the upper level and we are trying to create interest in the
building in developing a curved roof to give it some color and
some form in the building that would create interest and call
your attention to. We have also developed some of our trees.
We do have some window area along here that lets you see in
the building as well as provide an opportunity to provide
banners and create a lot of interest on this street for the
automotive traffic that comes through that space. I think I
would like to quickly run through the floor plans. I am not
sure if they are going to show up as well on camera or not.
But the parking that runs along side of the building comes
this way, turns into the alley and exits on Gilbert Street. It
also turns in at this location right here and comes in under
the building. So that if you were coming to the building, as
I indicated before, you would be coming up College and you
could pass through here and if you could find a spot here you
could take it or you could pass on around and go under the
building, go to the parking level below and actually come back
out again or go around if you wanted to or come out at this
location right here. Part of the problem is getting the

vehicular traffic away from the corner so there is space to
operate.
Horow/ I think that is fine. Thank you very much. We appreciate

Kubby/ There were three things I was most concerned about. One is
making sure that there was some design in the building that
facilitated pedestrian access and I think this building does
that. Two of the things are trying to decrease the visual mass
of the building and making sure that the side on Gilbert
Street was not one big wall and I think this design
accomplishes those three major goals and I think seeing it in
color helped flush out the three dimensional aspects of the
building and helped me visualize it more. So thank you for
taking the time to do that today and I will be happy to
approve this resolution.
Pigott/ I have two comments as well. One was it was great to be
able to have some of the potential materials last night to be
able to see what we are working with. I really appreciate
that. And the second thing, just a comment on past editorial
that stuck with me about this issue about approving windows
and so fourth and so on. You know, I think it is within
council's purview to look at these things, to consider them
despite what the editorial said about taking time to do that
because, you know, while they may consider us taking too much
time on this issue they certainly wouldn't want us to approve
a building that looked like the ATT or Bell Building d.t. So
I think it was certainly within our rights to do that
especially since it was stipulated that we were to do so.

that changes in color and materials do require new approval.
So please don't, on a whim, say well we are going to put the
stucco underneath and the brick on top or any other such color
changes without coming back and asking for approval because I
know this has happened in the past. And I think the idea of
having a grocery store d.t. and the idea of having New Pioneer
be that grocery store is excellent. I think they deserve the
right to expand and improve and I wholeheartedly endorse that.
I also think the building is not a bad design. I think it is
a well designed building but it is a building that has not
considered its neighbors in its design and I feel that was the
original intention and the design approval was written into
the contract and I am going to vote no.
Throg/ I was going to say pretty much what Bruno said. However,
since he already made his statement, I am not going to repeat
it. I want to disagree with something you said. You will, of
course, continue to vote no I suppose. It would be very
difficult for this particular building to really respond
effectively to all of the buildings around it. Let me explain
why. There is a Masonic Lodge across the street. There is the
1890's or 1900's classical style old library building to the
west. There is the Happy Joes thing just to the south. Across
the street is the modernist Robert E. Lee Recreation Center
and then catty corner across the street is the Grey Hound Bus
Station. So you have this real mix of diverse styles. You
can't respond to all of them directly.

I am less than specific. It was meant to respond to the
library and the church and the kinds of things that face it
very much closer than the Rec Center or the other stuff. There
is also going to be a potential traffic congestion here and
you know, all these kinds of things will be considered. The
original plan was not to have parking there and they were
given approval for parking and I am not arguing against that.
But I am saying that it was not part of the original plan.
Horow/ I, too, have to applaud New Pioneer for coming into the d.t.
area. With our projected development, encouragement of
development south of Burlington, this will certainly assist.
I have never understood why we don't have a grocery store d.t.
to service all the people who live in that area and so I am
really pleased that they have chosen to remain here. They have
gone the extra mile in going through the design for this and

Lehman/ My understanding is this is going to be-the replacement
will be buying existing housing units that are located in the
city now. Although I applaud the program I really cannot
support taking 18 units of what would be considered, I think,
low to moderate cost housing, out of the inventory that we
have which is already very very low. We are talking about
denying 18 young families or whatever the opportunity of
buying a home that they can afford in order that we can put
someone in with assistance. I applaud that but I don't think
it is right. I would much rather see us, if we want 18
additional units, to build 18 additional units rather than
deplete an inventory that is already very very low.
Pigott/ I support the sentiment you have. At the same time I
realize that past efforts to build affordable units resulted
in somewhat more concentrated affordable housing. One of the
goals that we have is to disperse our affordable housing over
a wide area. I think this will help achieve that goal which at
the same time I think you are right, Ernie, we need to
concentrate on increasing the stock of affordable housing, not
just maintaining it at its current levels.

I have to say something like that also because I was listed as
not supporting the census and all of my questions were should
we or should we not do a census but I have concerned about the
way we are required to do it. There will be no mail forms on
this. Nothing goes through the post office. Everything must be
knocking on the door, it must be done from 6:00 to 8:00 or on
weekends and I am just not as happy as I might be with the
style we are required to use.
Pigott/ One of the things gained from the census is money and when
Jim referred earlier tonight about the crisis that cities will
face funding given how the House and Senate agreements
recently. I think this will help address that and I am
supporting that.
Kubby/ Can we talk specifically about those amounts? I mean we are
projecting a cost of $200,000 and a possible or likely income
over three years of $600,000.
Atkins/ That is correct.
Kubby/ That is a net of $400,000.
Atkins/ If the numbers of close to our estimates you will have
recovered the cost of the census within the first year easily
and making the assumption that the numbers are good for at
least several more years thereafter and our funding continues
at the level it has been, you are correct. $400,000 to
$600,000 is a very comfortable number with respect to new
revenues.

Atkins/ Primarily it is road use tax and then the municipal aid
formula which is figured into our General Fund and a number of
minor accounts where the population is used as one of the

Kubby/ Which includes Transit Funding and other things through
JCCOG.
Atkins/ Yes.
Arkins/ I know in saying yes to this that we are putting a burden
on our City Clerk's Office so I guess want to make sure that
that is acknowledged. That there is a tradeoff for the greater
community so Marian is going to have to deal with a lot of
stuff. It is a positive trade off but she is going to have to
feel the brunt of it.
Karr/ I thought you were going to give me a chunk of the change.
Throg/ You will be included in the census.
Horow/ I would like to ask the City Clerk and City Attorney the
comment at this point is not true-adjusting for the decrease
in the University of Iowa student population. That is now
projected to be increased. Does this make any difference in

AND A COMMERCIAL DRIVER'S LICENSE SUBSTANCE ABUSE
PREVENTION PROGRAM FOR DRUGS AND ALCOHOL.
Comment: Federal regulations require that the City of Iowa City develop
a testing program for certain employees, The program developed
mirrors the federal regulations and will apply immediately to employees
holding Commercial Driver's licenses in all divisions except Transit,
Federal regulations mandate that Transit employees will be subject to
the program effective January 1, 1996, The Substance Abuse Policy
is required to be included as a part of th~ testing program, The
Substance Abuse Policy also includes the requirements of the Drug Free
Workplace Act of 1988,
RESOLUTION AUTHORIZING EXECUTION OF CONTRACT FOR SALE OF
REAL ESTATE BETWEEN OWNERS OF PROPERTY KNOWN AS "THE
PENINSULA PROPERTY" AND THE CITY OF IOWA CITY IN CONNEC-
TION WITH THE IOWA CITY WATER SUPPLY AND TREATMENT
FACILITIES PROJECT.
Comment: The "Peninsula property," which is.approximately 208 acres,
has been the subject of negotiation between City staff and the owners
for several months - as part of the Iowa City water supply and
treatment facilities project. The area contains high grade sand and a
substantial amount of high quality water, for use in the new Water
supply and treatment facility. The contract for sale of real estate
provides that the City will purchase the Peninsula property, but reserve
the approximately ten acres for owners.

to give us a brief summary on the whole aspect of the
peninsula.
Atkins/ Hopefully, this is on camera now as I reflect on the
language you just read on the item in the agenda, this
proposed purchase is I think for more consequential than just
the potential for a water source. I'd like to comment on that
also during this brief presentation. I think we have kind of
a unique opportunity for the purchase of a unique piece of
property and the resolution tonight will, if approved, will do
just that. This property involves in the dark lines, is
bordered by the Iowa River and magically, that is why they
call it a peninsula, and the Elks golf course. For the
property is south and west of the Elks Golf Course. The
property has been appraised at $2,100,000. We have a contract
proposal tonight for you for the purchase of all of this land
for $2,000,000. And the financing is primarily made up of two
sources. One, Federal Community Development Mitigation monies,
and secondly, the city's general revenues. 110 acres of this
site is considered in the flood plain and or transition zone
that is substantially affected in value and development
potential because of the flood plain. The federal government
allows us as a city to utilize their funds for the purchase of
flood plain areas, that is removing it from the potential for
private development and placing it in public hands and by
requirement of federal law, the land is intended to be open
space and available for public enjoyment and not for any
future development. The purchase of this site I think has a
number of advantages. The first of which is the fulfillment of
the federal obligation and that being the flood mitigation.
But their and I think just as important to us peripheral
issues. The second is, we gain a substantial tract of land
through the use of federal monies that can be used for open
space. Thirdly, the fact is that we can use federal monies for
the purchase of this land and not local resources. And lastly,
and important to us is the fact that this site to be
purchased, the flood plain area, has an available water
resource that we can choose at some time in the future to tap
into to supplement our water treatment, distribution, and new
source projects that are under way. Now a question may arise

as to that the purchase involves the whole site. Well, the
whole site is being purchased for really rather simple
reasons, is that the property owner wishes to sell all of the
land at one time. This upper portion has development potential
and is approximately ninety acres. You cannot, according to
federal law, condemn this land. That if we are going to
utilize the moneys for flood mitigation, we must purchase it
in total. The bottom line is that for approximately $2,700,000
plus or minus, will be for the purchase of the flood plain
area. $1.3 for the developable area. We have secured a rather
unique piece of property, used federal moneys to do so, have
a potential water resource available to us, have additional
open space and public access made available. The Iowa River
Power Dam is also accessed. At some time in the future, I am
assuming the council will direct us to put together some sort
of development proposal concerning the upper 90 acres. We
happen to believe that the investment of the general revenues
in the purchase of this upper property is an investment and
that is should significantly increase in value based upon the
policies that you develop at some time in the future. Any
questions for me.
Kubby/ Just to be clear. Even though we are going to use this land
for water resources, the purchase of the land, there will be
no water rates used to pay for the land. Only for any
development of wells, alluvial wells to gain access to the
resource underneath the soil.
Atkins/ Yes, Karen, that is correct. This has sand and gravel
formations. Gives potential for us for an additional water
resource. However we are buying the land with federal moneys.
That if we would choose to invest in a water resource, I am
assuming you would react the use of water revenues. But for
the time being, remember, your primary purpose in purchasing
is flood mitigation and that all the other peripheral benefits
accrue to us by the purchase of this property.
Nov/ And this was under water in 1993.
Atkins/ It was wet in '93.
Lehman/ Steve, this has been a part of the plan for the water plant
for a year?
Atkins/ We had considered this lower site as a potential for a
water resource at least a year ago. We are able to fashion
this financial package, fulfill a number of land use as well

Comment: This amendment revises the residential curbside recycling
program to include increasing the frequency to weekly collection,
providing a curbside recycling container, and beginning to collect
cardboard. The amended ordinance also revises the residential refuse
collection program to include the placement of a separate charge on
bulky residential wastes, adds clean untreated wood waste to brush and
tree limb collection, and places a unit-based pricing system on residential
refuse.

that certain things are happening. So in July of this year we
are going to start doing cardboard?
Atkins/ We hope to, yes.

Kubby/ In July or August of this year we will add cardboard to our
curbside.
Atkins/ We hope to add cardboard this summer. We have to get the
contracts together.

Atkins/ That is the plan.
Kubby/ What I am interested i~ doing is because this is a change of
how you approach solid waste, how we as a city do and how you
deal with it in your home and this incentive of unit base
pricing, I am interested in us-I know that we are going to do
an educational program but I guess I want it to get more
solidified in that we have like a three month, I don't know
about the time frame. I am just suggesting something like a
three month campaign of information before that date. Which
would mean that we need to see something and talk about
something a couple of months before that so it could get
developed and be implemented.
Horow/ Karen, Floyd Pelkey is really already jumped the gun on
this. He not only, as we all know, has started Trash Talk, but

he is also going to do some on Cable. He intends to have the
Trash Talk on Cable and have people come and talk about,
either council members of experts in the field. I think-
Kubby/ I think experts in the home would be the best.
Horow/ As the primary care giver I would totally agree on that. I
think Floyd has picked u the ball and run with it.
Kubby/ I guess I would like to see a plan that it is multi-media,
that it is pervasive, that maybe we do something in
conjunction with Coralville when there are things that are
oommon, etc.
Horow/ I think they are already working with that. We do have a
Solid Waste Technical Advisory Committee that has been sort of
dormant for a while. But the tenant/landlord pilot program is
still going. They are getting a lot of input from them. I
think that what we haven't seen, what the problem is r~ght
now, I think it is already ongoing.
Pigott/ It may be true, all that may be happening. But I firmly
believe that the people are not aware of what and Floyd may be
doing Trash Talks and so forth and so on but I am afraid that
we are going to wake up one day with this new system and
people are going to be going oh yeah, I slightly remember that
in the back of my head but- So I would like us to do something
really substantial and maybe a three month campaign that is
multi-media or whatever in addition to what Floyd is already
doing I think is really important because I still believe
regardless of what is happening right now that I don't hear
people talking about this and this is big enough so people, I
would expect, out there would be saying hey Bruno, I didn't
know or I did know that this is happening and what is this
going to mean.

campaign three to four weeks ahead of time because whatever
people have heard in January they will not remember in March.
Kubby/ I am not saying that the be any lag time in between when we
adopt out informational stuff and when we begin the program.
And several informational things that we are doing needs to be
continuous because we have a new influx of people all of the
time. So this needs to be an ongoing thing. But we need to
promote it, get people excited about it. This is not drudgery.
