HomeMy WebLinkAbout1995-07-18 OrdinanceORDINANCE NO, 95-3684 AN ORDINANCE AMENDING TITLE 14, CHAP- TER 3 ENTITLED "CITY UTILITIES," ARTICLE H ENTITLED "SOLID WASTE" OF THE CITY CODE BY REVISING RESIDENTIAL SOLID WASTE COLLECTION PROGRAMS INCLUDING CURSSIDE RECYCLING, BULKY WASTE, YARD WASTE AND INSTITUTING A UNIT-BASED FEE SYSTEM FOR REFUSE, AND ALSO AMENDING TITLE 3, CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES," BY REVISING FEES FOR COLLECTION OF RESIDENTIAL REFUSE, BULKY WASTE, WHITE GOODS, UNTREATED LUMBER, AND ALSO FOR LANDFILL USE FEES. WHEREAS, the City desires to encourage more participation in the City's curbside recy- cling program by increasing the frequency of collection and by including the collection of cardboard and untreated lumber; and WHEREAS, the City desires to encourage the community as a whole to use sound environ- mental solid waste management practices by implementing a unit-based refuse fee and also by placing a fee on all bulky items as a reason- able means to achieve this goal; and WHEREAS, it is in the public interest to update the existing fee schedule concerning residential refuse, bulky waste, anti-litter, untreated lumber, landfill, and white goods. NOW, THEREFORE, BE IT OBDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, THAT: SECTION 1. AMENDMENTS. 1. Title 14, Chapter 3, entitled "CiW Utili- ties," Article H, entitled "Solid Waste," Section 14-3H-2, entitled "DEFINITIONS," is hereby amended by: a. Repealing the definition of "Building Demolition Materials" and adding a new definition to read as follows; BUILDING DEMOLITION MATERI- ALS: Waste material from the con- struction, destruction or demolition of residential, commercial, or industrial buildings, except brick, foundation materials and untreated wood waste. b. Repealing the definition of "Bulky Rubbish" and adding a new definition to read as follows: Ordinance No. 95-3684 Page 2 BULKY RUBBISH: Nonputrescible refuse consisting of combustible and/or noncombustible waste materi- als which are either too large or too heavy to be placed in a thirty-five (35) gallon container and/or safely and conveniently loaded into solid waste transportation vehicles by solid waste collectors. c. Add three new definitions to read as follows'. RESIDENTIAL REFUSE: Refuse ex- cluding appliances, bulky rubbish, and construction demolition wastes. UNCLASSIFIED WASTE: Includes any material disposed of at the landfill which is not defined as solid waste. UNTREATED WOOD WASTE: In- cludes tree limbs, brush, Christmas trees, and untreated lumber. Title 14, Chapter 3, entitled "City Utili- ties," Article H, entitled "Solid Waste," Section 14-3H-8, entitled "Storage of Solid Waste," is hereby amended by: a. Repealing the second unmarked para- graph, Subsection C1 entitled "Con- tainer Specifications: Residential Refuse" and adding a new unmarked paragraph to read as follows: The weight of any individual con- tainer, including contents, shall not exceed fifty (50) pounds. Galvanized metal containers or rubber, fiberglass or plastic containers which do not become brittle in cold weather are deemed appropriate. Disposable solid waste containers, as approved by the Director, may also be used for storage of residential solid waste. b. Repealing Subsection C3 entitled "Container Specifications: Recycling Waste," and adding a new paragraph to read as follows: Residential solid waste designated by the City for recycling shall be stored in either a City-supplied recy- cling container or an approved con- tainer, of not more than thirty-five {35) gallons in capacity, nor less than five (5) gallons in capacity. Contain- ers shall be leakproof, waterproof and fitted with a tight lid and shall be properly covered at all times, except Ordinance No. 95-3684 Page 3 when depositing waste therein or removing the contents thereof. The containers shall be of light weight, sturdy construction. The weight of any individual container, including contents, shall not exceed fifty (50) pounds. Galvanized metal containers or rubber, fiberglass or plastic con- tainers which do not become brittle in cold weather are deemed appropriate. Disposable solid waste containers shall not be used for storage of recy- cling waste. Each item designated by the CiW for recycling shall be stored in a separate or approved compart- mentalized container except for card- board. c. Repealing Subsection D, entitled "Storage of Limbs and Brush," and adding a new Subsection D to read as fallows: UNTREATED WOOD WASTE: Tree limbs, brush and untreated lumber measuring less than four inches (4") in diameter, together with brush being stored for pick-up, shall be securely tied in bundles not larger than forW- eight inches (48") long and eighteen inches (18") in diameter when being stored for pickup other than in stor- age containers. The weight of any individual bundle shall not exceed fifty (50) pounds. Title 14, Chapter 3, entitled "City Utili- ties," Article H, entitled "Solid Waste," Section 14-3H-9, entitled "Collection and Disposal of Solid Waste," Subsection A "Collection from Residential Dwellings," is hereby amended as follows: a. Subsection Ale, entitled "Collection of Refuse," is hereby amended by adding a sentence to the end of Sub- section Ale, to read as follows: The owner, responsible party, occu- pant or operator of such premises will be billed for collection and disposal in the amount provided in the schedule of fees, Title 3, Chapter 4 of the City Code. b. Repealing subsection A3, entitled "Recycling Waste," to read as fol- lows: Ordinance No. 95-3684 Page 4 Residential recycling waste may be collected separately from other solid waste in the same manner as residen- tial refuse and in accordance with the provisions of subsection A1 above. Residential recycling waste collected separately shall include newsprint, clear glass containers, metal cans, plastic containers (//1 and //2) and cardboard (corrugated and chipboard). Clear glass containers, metal cans and plastic containers must be thoroughly rinsed prior to disposal. The residen- tial recycling of waste itemized in this subsection A3 is not mandatory. Only properly stored recycling waste shall be collected. c. Repealing Subsection A4a, entitled "Certain Wastes Not Subject to Col- lection," to read as follows: The City will not collect any of the following solid waste materials from any dwelling, residence or residential premises served by City solid waste collection services: lead acid batter- ies, waste oil, construction/demolition materials (except ontreated wood waste} or any substance or material determined by the Director to be hazardous or unacceptable for collec- tion. The Director may adopt and enforce regulations, based on health and safety concerns, specifying addi- tional substances and materials not subject to collection, as provided under Section 14~3H-5 of this Article. d. Repealing Subsection A4b and amending a new Subsection A4b, to read as follows: Waste oil may be disposed of at the City solid waste disposal facilities as provided in Section 14-3H-10 of this Article. 4. Title 14, Chapter 3 entitled "CiW Utilities," Article H entitled "Solid Waste," Section 14-3H-9, Subsection B, entitled "Collec- tion of Tires, Appliance and Bulky Rub- bish," is hereby amended as follows: a. By adding a new sentence to the end of Subsection B2 to read as follows: The owner, responsible party, occu- pant or operator of such premises will be billed on a per collection and per Ordinance No. 95-3684 ~i Page 5 '"' item basis in the amount provided in the schedule of fees, Title 3, Chapter 4 of the City Code, b. Subsection C, entitled "Collection of Tree and Brush Limbs," is hereby amended by repealing said catchline and subsection and amending same to read as follows: Collection of Untreated Wood Waste: Tree, brush limbs and un- treated wood waste shall be collected for no fee. Tree and brush limbs cre- ated by commercial tree service oper- ations or by the clearing of land for construction will not be collected by the City, c. Subsection D, entitled "Times and Location of Collection Containers," is hereby repealed and amended to read as follows: Refuse containers, recycling con- tainers, and untreated wood waste bundles, and yard waste containers, as described in subsection 14-3H-8C and D, respectively, of this Article, together with other solid waste per- reitted to be placed at the curb, shall be placed for collection at the curb of the street upon which the residence, dwelling or premises fronts. Each type of waste listed herein must be physically separated in order to enable the solid waste collector to easily identify differing contents as well as differing containers. Yard waste containers and recycling waste con- tainers must be clearly marked as such. Placement of solid waste at the curb for collection shall occur prior to seven o'clock (7:00) A,M. on the regularly scheduled collection day but shall not occur before three o'clock (3:00) P.M, on the day before the regularly scheduled collection day, Containers shall be removed from the curb on the same day collection is made and returned to a location rea- sonably near the side or back of any permanent building on the premises. Title 14, Chapter 3, entitled "City Utili- ties," Article H, entitled "Solid Waste," Section 14-3H-10, entitled "Solid Waste Disposal Requirements," Subsection C is Ordinance No. 95-3684 Page 6 hereby emended by repealing Subsection C, including the catchline, and adding a new subsection and catchline to read as follows: C. Disposal of Weste Oil: Persons or operators residing, Ioceted or operat- ing within the landfill service area may dispose of waste oil from their private vehicles by delivering same to locations approved by the Director, provided such wastes were generated by ectivities or operations located and operating, in whole or in part, within the lendfill service aree. 6. Title 14, Chapter 3, entitled "City Utili- ties," Article H, entitled "Solid Waste," Section 14-3H-11, entitled "Littering," Subsection F3 entitled "Clearing by City of Vacant Private Property Abetement Costs" is hereby amended by repealing the first sentence and adding a new sentence to read as follows: After the City has effected the removal of such offending litter or has paid for its removal, a 9100 minimum charge or the actual cost thereof, plus accrued interest at the maximum rate designated by law per annum from the date of completion of the work, shall remain an obligation of the offending owner, person, party, occupant, operator or property. SECTION 2. AMENDMENTS. 1. Title 3, Chapter 4, entitled "Schedule of Fees, Rates, Charges, Bonds, Fines end Penalties," of the City Code is hereby amended by repealing fees listed herein and substituting in lieu thereof the follow- ing: Yard Waste Collection Fees Untreated wood waste 90 Collection of Large Item Fees Bulky rubbish 91 O/stop and one item. 95/additional items. REPEALER. All ordinances and parts of ordinances in conflict with the provi- sions of this Ordinance are hereby repealed. SECTION IV. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudicatien shall not affect the validity of the Ordinance as a whole or any section, provision Ordinance No. 95-3684 Page 8 or part thereof not adjudged invalid or unconsti- tutional. SECTION V. EFFECTIVE DATE. The implemen- tation of cardboard and untreated wood waste collection programs, the bulky waste program and the $100 cleanup fee program will begin July 31, 1995. The weekly collection of recyclables will begin March 4, 1996. The billing and fees provisions herein shall be in effect only after their final passage, approval and publication, as provided by law to be collected as set forth in §14-3A-4, City Code.
