Washington St., Iowa City, IA 52240; 319-356-5140 RESOLUTION NO. 98-232 RESOLUTION APPROVING THE PRELIMINARY PLAT OF GREEN MOUNTAIN MEADOW, IOWA CITY, IOWA. ', WHEREAS, the owner, HBH Development, flied with the City Clerk of Iowa City, Iowa, an application for approval of the preliminary plat of Green Mountain Meadow; and WHEREAS, the Department of Planning and Community Development and the Public Works Department examined the preliminary plat and recommended approval; and WHEREAS, the Planning and Zoning Commission examined the preliminary plat and, after due deliberation, recommended acceptance and approval of the plat; and WHEREAS, the preliminary plat conforms with all of the requirements of the City Ordinances of the City of Iowa City, Iowa. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA THAT: 1. The preliminary plat of Green Mountain Meadow, Iowa City, Iowa, is hereby approved. 2. The Mayor and City Clerk of the City of Iowa City, Iowa are hereby authorized and directed to certify this resolution, which shall be affixed to the plat after passage and approval by law. CORP., LODGE NO.590 FOR USE AS A GOLF DRIVING RANGE, AND SETTING A PUBLIC HEARING FOR JULY 28, 1998. Comment: As part of earlier negotiations with the Elks, the City granted the Elks a permanent easement to establish two golf holes on land known as the lower peninsula. The Elks have requested that the City lease them an addi- tional approximately 5 acres of land next to the two golf holes to use as a driving range. City staff has not yet received the EIk's final proposal which will be necessary to proceed with this item. Resolution No. 98-233 For Your Pecords RESOLUTION PROVIDING FOR THE REDEMPTION OF PRIOR BONDS AND THE EXECUTION OF DOCUMENTS RELATING THERETO WHEREAS, the City of Iowa City, Iowa (the "Issuer"), pursuant to the provisions of Chapter 4 19 of the Code of Iowa (the "Act") has previously issued its Hospital Facility Refunding Revenue Bonds, Series 1986 (Mercy Hospital, Iowa City, Iowa) (the "Prior Bonds") pursuant to tSae provisions of a Bond Trust Indenture dated as of November 1, 1986 (the "Bond Indenture") and loaned the proceeds thereof to Mercy Hospital, Iowa City, Iowa (the "Borrower") pursuant to a Loan Agreement dated as of November 1, 1986 (the "Loan Agreement") for the purpose of refunding another issue of the Issuer's bonds issued pursuant to the Act; and WHEREAS, the Borrower has determined to provide for the payment and redemption of the Prior Bonds pursuant to the prepayment provisions of the Loan Agreement and has requested the Issuer to take such action as is required of the Issuer by the Loan Agreement and Bond Indenture to provide for prepayment and redemption of the Prior Bonds; and WHEREAS, the Borrower has presented for consideration by the City Council a form of escrow agreement (the "Escrow Agreement") among the Issuer, the Borrower and Norwest Bank Iowa, National Association (current Trustee under the Bond Indenture) (the "Bond Trustee") to accomplish the prepayment and redemption of the Prior Bonds; and NOW THEREFORE BE 1T RESOLVED, by the City Council of the City of Iowa City, Iowa, as follows: Section 1. That the prepayment and redemption of the Prior Bonds as contemplated by the Escrow Agreement is approved. Section 2. That the Escrow Agreement in substantially the form presented to and considered by the Council and containing substantially the terms and provisions set forth therein is hereby authorized and approved and the Mayor is hereby authorized and directed to execute and deliver the Escrow Agreement on behalf of the Issuer with such changes thereto as the Issuer's counsel or bond counsel may deem appropriate, such execution to be conclusive evidence of approval of such document in accordance with the terms hereof. Section 3. ?hm the Mayor and City Clerk are hereby authorized and directed to execute, attest, seal and deliver any and all documents and do any and all things deemed necessary to affect the prepayment and redemption of the Prior Bonds and the execution and delivery of the Escrow Agreement and to carry out the intent and purposes of this Resolution. Section 4. That the provisions of this Resolution are hereby declared to be separable and if any section, phrase or provision shall for any reason be declared to be invalid, such declaration shall not affect the validity of the remainder of the sections, phrases and provisions.
