Washington Street, Iowa City, IA 52240; 319-356-5243 (REZ04-00026) AN ORDINANCE CHANGING THE ZONING DESIGNATION FROM MEDIUM DENSITY SINGLE FAMILY RESIDENTIAL (RS-8) AND NEIGHBORHOOD CONSERVATION RESIDENTIAL (RNC-12), TO MEDIUM DENSITY SINGLE FAMILY RESIDENTIAL/HISTORIC PRESERVATION OVERLAY (RS-8/OHP) AND NEIGHBORHOOD CONSERVATION RESIDENTIAL/HISTORIC PRESERVATION OVERLAY (RNC-121OHP) TO DESIGNATE THE GILBERT-LINN STREET HISTORIC DISTRICT. WHEREAS, the historic resources of the Northside Neighborhood have been surveyed and evaluated, and the proposed Gilbert-Linn Street Historic District has been deemed eligible for the National Register of Historic Places and for local historic district designation; and WHEREAS, the Iowa City Historic Preservation Plan, contained in the Iowa City Comprehensive Plan, recommends consideration of the designation of conservation and historic districts within the Northside Neighborhood; and WHEREAS, the Iowa City Comprehensive Plan recommends preservation of the integrity of historic neighborhoods, the stabilization of neighborhoods, and supports efforts of the Historic Preservation Commission; and WHEREAS, the Iowa City Municipal Code authorizes the Historic Preservation Commission to recommend and the City Council to designate historic districts, where deemed appropriate, as a means of preserving the neighborhood character of traditional Iowa City neighborhoods, or for preserving areas that exemplify unique or distinctive development patterns; and WHEREAS, the Historic Preservation Commission feels that the Gilbert-Linn Street Historic District will help stabilize the neighborhood by providing for design review of alterations and additions to, and demolition of existing buildings, and the construction of new building, which will assure compatibility with the existing character of the district, and will encourage the retention of existing contributing structures within the Northside Neighborhood; and WHEREAS, at its September 23, 2004 public hearing, the Historic Preservation Commission recommended said properties for rezoning to designate the Gilbert -Linn Street Historic District; and WHEREAS, at its October XX, 2004 meeting, the Planning and Zoning Commission recommended approval of said rezoning to designate the Gilbert-Linn Street Historic District; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: SECTION I. APPROVAL. The Gilbert-Linn Street Historic District, legally described below and illustrated on Exhibit A attached hereto and incorporated herein by this reference, is hereby designated as a Historic Preservation Overlay (OPH) Zone and subject to the guidelines of the Iowa City Historic Preservation Handbook including Section 8.4, Northside Neighborhood District Guidelines hereto attached, incorporated herein by this reference: An area containing all of Blocks 55 and 56, the north half of Block 57, and lots I and 8 of Block 72, Original Town, Iowa City, Iowa. Also including, in said Original Town: The west 30' of lot 3, and all of lots 4,5,6 and 7, Block 54; All of lots 4 and 5, plus the west 20' of lot 6, Block 50; All of lots 4 and 5, plus the west 20' of lot 3, Block 49; All of lot 4, plus the west 15' of the south 40' of lot 3, Block 48; All of lots 1,2, and 8, plus the east half of lot 3, Block 69; All of lots 1,7, and 8, plus the east half of lot 6, and the east 50' of lot 2, Block 70; The east 60' of the south 75' of lot 8, and the north 75' of lots 7 and 8, Block 71; In Block 71, all of lot 1, plus the east 17.25' of the north 81' of lot 2, and a portion of lot 2, described as follows: Beginning at the southwest corner of lot 1, thence north 69', west 17.25', north 6', west 22', south 75', east 40' to the beginning. SECTION II. ZONING MAP. The Building Inspector is hereby authorized and directed to change the zoning map of the City of Iowa City, Iowa, to conform to this amendment upon the final passage, approval and publication of this ordinance as provided by law. SECTION III. CERTIFICATION AND RECORDING. Upon passage and approval of the Ordinance, the City Clerk is hereby authorized and directed to certify a copy of this ordinance and to record the same at the office of the County Recorder of Johnson County, Iowa, all as provided by law. SECTION IV. REPEALER. All ordinances and parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. SECTION V. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION VI. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and publication, as provided by law. Passed and approved this day of ,2004. City of Iowa City M MORANDUM Date: December 22, 2004 To: City Council From: Don Anciaux, Chair, Planning and Zoning Commisson Re: Gilbert/Linn Street Historic District At our November 4th meeting the Planning and Zoning Commission recommended by a vote of 7-0 that the Gilbert/Linn Street Historic District be approved. This unanimous vote came after three public meetings held over a four week period during which the Commission received lengthy testimony from a variety of citizens who spoke both for and against the establishment of the Historic District. The Commission's recommendation is based on the proposed district clearly meeting the goals and strategies of the Comprehensive Plan. The Comprehensive Plan stresses the policy of preserving and improving our core neighborhoods and the variety of housing that they provide. The establishment of a Historic Districts is one of the City's most cost effective means of stabilizing and rejuvenating older neighborhoods. Past experience demonstrates that historic district designation leads to considerable private investment and neighborhood improvement. Property owners who are assured that quality standards are set for development in their area are more likely to make investment decisions based on the long term rather than choosing the quick fix. Although individual property owners in an area may oppose the establishment of a historic district, the Comprehensive Plan and the benefits that the city has received from other historic districts, indicates that the Gilbert/Linn Street Historic District is in the best interest of our community. The Council has asked if the Planning and Zoning Commission would like to meet with the Council to discuss your upcoming vote and decision regarding the fate of the district. We respectfully suggest that the Council meet with the Historic Preservation Commission rather than the Planning and Zoning Commission. As noted we found that the proposed district clearly is supported by our community's Comprehensive Plan and would be a continuation of our past efforts to stabilize and improve our core neighborhoods. As of today's date I personally know of three homes in the North Gilbert/Lima district that have vinyl siding jobs in process. We are the proud owners of two of the homes: 225 Church and 402 East Davenport. The other is located at the Southeast comer of Linn and Davenport, We feel that it would be very unfair if the proposed historic district would pass and sl.m!!ar siding projects would be strictly prohibited. We purcha.qed the home at 402 East Davenport on November i, 2004, after it had been sitting vacant and neglected for the better part of 10 years, It was a complete eyesore, There even was a junk ear sitting in the driveway for I0 year~. Our list of repairs and improvements is extensive, and it includes vinyl siding installation, window replacement, new roof, new furnace, new electrical service, new kitchen, new bathroom, and new plumbing. The interior will be completely repainted, plaster repaired, fireplace reactivated, and hardwood floors all refinished. When complete it will once again be a beautiful home! The exterior items would be prohibited under the proposed ordinance, in our case the vinyl siding and the replacement windows, This is way too much of an infringement on the rights of the ownerS. It puts the City in the position of setting the standards for what is "appropriate." The properties were all purchased by the owners before this ordinance, and to impose thi.q whole new set of rules and regulations on owners after the fact is not right. Property owners like vinyl siding because it has much more pei-nhanence than painted siding. A home with new vinyl .qding will retain its "new siding" look many years after the painted siding needs repaiming. Please stop and take a look at the 402 East Davenport home ff you would like to see what old painted siding looks like. It is just a few short blocks from the Civic Center. ff you are interested I can show you another home that hag been sided using exactly the sm siding and colors being used at the East Davenport home, It turned out very nice and many people have gone out of their way to compliment the owners, Please review the enclosed list of restrictions und, c4 the historic district and let me know if you IMPORTANT INFORMATION FOR ALL PROPERTY OWNERS IN THE HISTORIC DISTRICT, IN IOWA CITY, IOWA. CANNOT use unpainted treated wood for elements that would have been painted in the historic application. CANNOT use wrought iron elements unless they were part of the historic design. (12) SITE AND LANDSCAPING - CANNOT provide parking spaoos between the primary stmcUn~ and the street. CANNOT add curb cuts and driveways from the street when access is available from the alley. CANNOT remove historic metal fences. CANNOT replace historic brick paving with concrete. CANNOT remove mature trees, unless tree is causing damage to the building, is diseased, or is structurally un~ound, as determined by a professional arborist. CANNOT install chain link, wire mesh or rail fences in locations highlY visible from the street. (13) DECKS AND RAMPS - CANNOT construct a deck between the street and the street-facing facade if it detracts from the neighborhood or is not compatible with the architectural style of the existing building. CANNOT construct a ramp that extends more than 8 feet in front of the primary, street-facing fagade. (14) GARAGES - NOT RECOMMENDED to construct a garage that attaches to the primary building. (15) DEMOLITAION - CANNOT demolish any primary building on a contributing property within a conservation or historic district or any Iowa City Historic Lalldmark. CANNOT remove any historic architectural feature, such as a porch, chimney, bay window, drainer, brackets or decorative trim, that is si~tmificant to the architectural character and style of the building. To those councilors who expressed their support for historic preservation, yet indicated intent to vote in opposition to the Gilbert-Linn District and the City's Comprehensive Plan - we wonder, since you are not voting to support historic preservation, what you are doing to support preservation of the neighborhoods adjoining downtown Iowa City? Some of you indicated you could not support the Gilbert-Linn District in light of opposition by owners of 52% of properties. What is the percentage that would change your vote? Would your vote change if only 49% of property owners were opposed? If not 49%, is the magic number 35%? 22%? Have you considered the possibility that if one or two individual landlords owned enough property, they could effectively control any decision regarding historic preservation? Is that your intent? Some Councilors encouraged supporters of the District to continue their efforts to educate property owners who are opposed to the designation. Does the City have a responsibility for educating citizens, including landlords, about the benefits of historic designation and the principles of the comprehensive plan? While the Commission did vote 7 - 0 approving the ordinance establishing the historic district, it did so with what I considered much reservation and frustration. Our only authority was to determine whether the district was in compliance with the Comprehensive Plan. The vote reflects that very limited purview and nothing more. For the letter to imply that our vote indicated support for the district concept or the benefits of a historic district designation is misleading. As I recall, most of our discussions centered on whether we had any authority to look at anything other than the proposed district and its relationship to long range planning and/or zoning issues as expressed in the Comprehensive Plan. In general, I think we found that the plan supported the continuation of the existing zoning and therefore the Historic District overlay did not contradict the zoning and/or uses indicated for this neighborhood in the Comprehensive Plan. I think if you read minutes from those meetings you will see a level of frustration from various Commissioners about not only the process we are required to be part of, but also the divisive nature this proposal had on property owners within this neighborhood. Almost all public presentations at our meetings related to issues we, as a P & Z Commission, had no authority to address. Our responsibility in this matter was extremely restricted and did not appear to allow us to deal with the process used in proposing the district, the impact of the district on the property owners or the appropriateness of the historic designation. The second paragraph of the letter, obviously written by staff, does not completely reflect my views and I think the views of some other P & Z Commission members. The theory put forth in this paragraph concerning the benefits of "considerable private investment and neighborhood improvements" as a result of histoi-ic district designation was not discussed during our meetings. There may have been a fleeting reference to such in staff presentations, but no statistical data to substantiate such a theory was presented. The paragraph also speaks about the benefits of certain "quality standards" as an influencing factor in property owner's decisions to improve their property. Again, I do not recall any statistical information being presented that compared historic restoration efforts in designated districts versus other areas of the community. As the letter indicates we heard a great deal of input from citizens at 3 separate public hearings on the proposal. The presentations from citizens focused on issues outside the Planning & Zoning Commission oversight responsibility. Those speaking in favor of the district focused on the need to preserve the character of their neighborhood. Based on their comments I understood the character of the neighborhood they wished to preserve as that of a quiet pristine owner-occupied-home neighborhood, close to campus and downtown. Those speaking in opposition of the district expressed concerns about the costs and additional governmental red tape associated with making improvements and modifications to their property under a historic district designation. While I strongly support the preservation of historical assets in our community, I am skeptical of the way historic designations are being used. I think what this issue brings to the forefront is the broader question about the future of this specific neighborhood in light of its current composition and in light of the evolutionary growth of our community. Is this a neighborhood that should be a transition zone between the downtown 1/4/2005 Page 2 of 2 commercial area and the highly motivated historically enthusiastic north side? Is this a neighborhood where a new paradigm could be developed that would represent all property owners and the broader interests of the community as a whole? Are there other ways to achieve an improved neighborhood that retains certain necessary historical aspects without imposing such stringent requirements on all properties? In other words is there a "happy medium" that might be appropriate for this neighborhood that is slightly different that what we have used in the past for historic district designations. Is there something that everyone can buy into? One of my major difficulties with historic district designation is that restrictions and requirements of that designation come with no direct incentives. We impose certain restrictions without giving a direct incentive to property owners. If we feel strongly about the overall benefits historic district designations bring to our community we should be willing to put some incentives behind the designation. These incentives could encourage all property owners to make improvements to their property in a historically appropriate manner through grants, tax incentives or Iow interest loans that would mitigate any differences between normal improvement costs and those costs necessary to comply with historic district standards. This would apply to all property owners in a district, owner occupied and tenant occupied. With such a high percentage of property owners not supporting this proposed district I think it is incumbent upon the Historic Preservation Commission, City Staff and the City Council to look for viable options and compromises that will enhance the future of this neighborhood and benefit all property owners. It is time to think out of the box and look for new ideas and concepts that can be supported by a broader property owner base. Your decision to postpone action on this request is justified and warranted pending further work by staff and the Historic Preservation Commission to bringing the neighborhood property owners to some consensus. AN ORDINANCE EXCLUDING AIRPORT SHUTTLES FROM THE COLOR SCHEME REQUIREMENTS OF VEHICLES FOR HIRE AND CLARIFYING THE DEFINITION OF VEHICLE FOR HIRE, WHEREAS, the reasons for requiring that taxicabs have a distinct color scheme are not applicable to the shuttle services that provide transportation only to and from the Eastern Iowa Airport; , WHEREAS, the exclusion of charter transportation services from vehicle for hire regulations should be limited to vehicles carrying passengers for hire either on a fixed route or pursuant to a contract with advance reservations; and WHEREAS, it is in the public interest to adopt these amendments. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CITY, IOWA: SECTION I. AMENDMENTS. 1. Title 5, entitled "Business and License Regulation," Chapter 2, entitled "Vehicles for Hire, Section 1 entitled "Definitions," is amended by adding the following new definition: Airport Shuttle: A vehicle furnished with a driver that carries passengers for hire exclusively on a route that either starts at or ends at the Eastern Iowa Airport. 2. Title 5, entitled "Business and License Regulation," Chapter 2, entitled "Vehicles for Hire, Section 1 entitled "Definitions," is amended by adding the following new definition: Charter Transportation: A vehicle furnished with a driver that carries passengers for hire either on a fixed route in the city or pursuant to a written contract with reservations at least twenty-four (24) hours in advance of the service. 3. Title 5, entitled "Business and License Regulation," Chapter 2, entitled "Vehicles for Hire, Section 1 entitled "Definitions," is amended by deleting the definition of "vehicle for hire" and substituting the ifollowing new definition: Vehicle for Hire: All vehicles furnished with a driver that carry passengers for hire withini the city, including but not limited to taxicabs, pedicabs, horse drawn vehicles, and airport shuttles.: Charter transportation as defined in this section and a vehicle owned or operated by any governmental entity that provides public transportation are not a vehicle for hire. 4. Title 5, entitled "Business and License Regulation," Chapter 2, entitled "Vehicles for Hire, Section 8 entitled '¥ehicle for Hire Requirements," Paragraph B, entitled "Distinctive Color Scheme Required," is amended by deleting Paragraph B in its entirety and substituting the following new Paragraph B: Each vehicle for hire, except for airport shuttles, shall be furnished in a distinctive color so that it may be readily and easily distinguished as a vehicle for hire which color scheme shall and must at all times meet with the approval and requirements of the City Clerk. SECTION II. REPEALER. All ordinances and parts of ordinances in conflict with the provision of this Ordinance are hereby repealed. SECTION III. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whq)le or any section, provision or part thereof not adjudged invalid or unconstitutional.
