Consider setting a public hearing for August 29, 1995 on an ordinance amending the Zoning Chapter by changing the use regulations of an approximate 29 acre tract of land located west of Mormon Trek Boulevard and south of Rohret Road from RS-5, Low Density Single-Family Residential, to OPDH-8, Planned Development Housing Overlay. (REZ95-0009) Miklo/ Setting a p.h. for August 29 ..... This rezoning .... to 0PDH- 8 ..... The OPDH Plan for this area will allow 232 dwelling units. Horow/ I have a question... can this OPDH-8 also mean RS-10 density. Miklo/ No. This particular plan is coming in at 8 dwelling units per acre. Horow/ Throg/ I have a request. In the material... there are references to affordability ..... I would like to see some information about the types of units that are involved, what the rental ranges are, what the price ranges are. Some information that helps us understand the extent to which this particular development might deal with affordable housing issues. Kubby/ It is fine to know that ..... how is that enforced ..... enforcement tool ..... Gary had said .... units... open to Section 8. Love to have that as part of the conditional zoning... offered... Miklo/ It would be difficult for us to provide you with specifics on the cost of the housing ..... In terms of the P/Z Commission discussion .... based on fact...town houses and multi-family... would be more affordable than s.f .... Horow/ If there is anything you can get by August 29th. As a preventive measure, why not build it into the conditional zoning that they must provide the money for the infrastructure for the lights to coincide with the development .... Miklo/ ...City is planning to put a light in .... Horow/ Do you have a date...sequence of when this is going to happen? Miklo/ I believe it is scheduled to happen this fall. Horow/ Davidson/ .... This is an intersection that council could override that .... Our intention has been that with this development .... planning in the CIP process of bringing it to you within the five years .... Horow/ I thought this was going to happen before five years. Council/ (All talking). Davidson/ Horow/ We need some verification on this .... that is a corner that needs traffic control before rather than later. Kubby/ I would ask that... developer pay for the light .... that this be part of the condition that money be for the light .... Horow/ ..... Can we legally have that developer be responsible for that light? ...... the warrant is based on more than just that development .... Woito/ In the CZA, they agree to it .... Kubby/ Ask us to inquire to the developer to see if they would add that as a condition. Lehman/ I have no problem in asking them ..... Kubby/ They will create more traffic... Consider setting a public hearing for August 29, 1995 on an amendment to City Code Title 14, Chapter 6, Article V, "Minor Modification Procedures," to allow parking for persons with disabilities in the front yard of a co~nercial zone even when located adjacent to a residential zone. Miklo/ Setting p.h. on August 29 .... The proposed amendment would allow parking for persons with disabilities in the front yard of the commercial zone ..... generally when a commercial zone is within 50 feet of a residential zone there is no parking allowed in the front yard. This would provide for a possible exception to that. P/Z Commission voted in favor of this. Jacobson and Scott voted against it. Horow/ What were their reasons? Miklo/ Scott expressed concern about encroachment of commercial use near a residential zone. Jacobson didn't state a reason. The proposed annexation of a portion of Windsor Ridge .... (Presents plat). Kubby/ I have a legal question. Does having a 200 foot versus a 50 or 80 foot flagpole give the Weinstein's any more or less protection against involuntary annexation? Woito/ I don't see it makes any difference. Horow/ If the annexation goes through and they have a 50 foot smaller amount of land. At the point the property south of American Legion Road asks to be annexed... creating an island and the state law would force the city to annex .... It would be an involuntary annex? Woito/ It would be an involuntary annex? Kubby/ Would that case be the same if the area in question would not be annexed? Woito/ I don't think it is going to be any different. It is going to be either way. Horow/ Woito/ I did ask Bob to check on who owns that property to the south in terms of what kind of development potential there is. Miklo/ (Refers to map) E. L. If you chose to annex the area to the south of American Legion Road .... Horow/ ...we can't promise a future council would not annex... Arkins/ The city cannot be forced to annex a piece of property. We can pursue an involuntary annexation ...... Kubby/ If we said yes to annexing south of American Legion, we would have to annex Weinstein's because it would be creating an island. Arkins/ Woito/ Your first decision would force you to involuntarily annex Weinstein's, yes. But you wouldn't be forced in the first instance to annex the property south of there. Nov/ It would happen only if we annexed all the area below that flagpole .... There are two property owners ...... Atkins/ If O'Harra or Prybil chooses to pursue annexation then Weinstein's would have to be annexed because we would be creating the island ..... Woito/ ...I am sure you people talked about this before... You can pass a resolution of your intent not to annex the lower portion and thereby protect the Weinstein's but the council after you can change their minds. Throg/ .... Woito/ I think the discussion is a red herring. Throg/ We are talking 200 feet versus 80 feet. Woito/ Now that the law has changed the Iowa Development Board says it is a distinction without a difference now. Kubby/ Miklo/ To the west of the proposed annexation is city land. Throg/ ...question as to whether there is any difference substantively between the 200 and 80 feet. Woito/ I think the people who are most eager to propose that are not in the country. Horow/ I received a phone call from him today and his concern is that he would prefer that is gets- Throg/ When is he coming back .... matter of due process and giving a person an opportunity to speak. Horow/ He would like to defer this force Iowa City to annex involuntary annexation .... until the state says we won't Weinstein's because of this Atkins/ The state cannot force us to annex .... What he would like is an expression that you will not annex and thereby create an island and thereby force him to come in. But...other property owners have a bearing upon .... Kubby/ I don't mind continuing the p.h. and having the vote on the next agenda so he can choose to oome back in the next two weeks ..... Horow/ Let's consider that. ITEMNO. 5g. consider an ordinance amending Title 14, Chapter 4, "Land Control and Development," Article C, "Historic Preservation Regulations," and Chapter 6, "Zoning," Article J, "Overlay Zones" to allow the city to designate historic landmarks and conservation districts. (First consideration) Miklo/ Includes amendments to Historic Preservation regulations and Zoning Ordinance regarding landmark designations and conservation districts. Kubby/ I wasn't clear about why the two no votes .... Horow/ Jaoobson...she just had problems with the whole concept of conservation districts .... intrusion into a neighborhood .... Kubby/ Yesterday...coming into town .... a couple of towns that I had been in...stream of auto places .... all in one place .... just coming into that side of town...auto uses...Walmart of Mennards... I am not sure .... it is just a concern I have about that entrance way into Iowa City from the south... not that welcoming. Pigott/ I think it is putting it mildly and I agree. Horow/ There have been people on P/Z .... they have called the city... do have citizens who recognize... companies have to adhere to the concept of an entrance way into the city .... Kubby/ ...esthetics of that particular use ..... It is an intense use that helps create a flavor when you drive in from the south ..... I have concerns about the particular use ..... Horow/ People come in from the south to purchase the automobile .... Nov/ Always two sides to these kinds of things ..... Pigott/ I hear .... sense of I don't like the spread of that look .... If we wanted car dealerships, isn't that the place... This sort of thing is not look that I like to vote for ..... I am against something I will probably vote for. Consider an ordinance amending City Code Title 14, Chapter 6, entitled "Zoning," Article S, entitled "Performance Standards," Sections 10B and 10c, con- cerning the location of underground storage tanks. (Second consideration) Miklo/ Second consideration... Nov/ Bob, I had a question about that .... Miklo/ You had some concerns about above ground storage tanks and what can be stored in them and how far they had to be from the property line. That varies depending on size of the tank and type of liquid that is stored. We are working with the Fire Marshall to amend the code regarding above ground tanks to make those in compliance with the fire code as well. That is an ordinance that should be coming back to you soon. ITEM NO. 5m. Greenleaf/ There are numerous clouds on the title but those will be cleared at the time of closing. Woito/ Thank you. Horow/ Some of the issues that we dealt with last time, Bob, in terms of the signage was for the open space. Has that been resolved? Pigott/ Whether there would be a sign indicating open space... Miklo/ I wasn't aware that that was a question. I will research that. Horow/ I think the answer we got was there would be a sign there. The question was what does this really need? Is this really going to be considered open space? Will the public feel welcomed? The other question that was raised ..... whole issue of flood moneys not being used for purchase .... open space .... or flood moneys not being used for sewer repair in the area. Steve, would you be able to clear my mind on this?... Atkins/ My recollections was we chose not to do it on that parcel just simply because of all the legal complications and timing that was involved in it. The other was the sewer project in the Longfellow area was financed by local generated moneys because of the speed in which we wanted to move on the thing. Horow/ We wouldn't have been able to be speedy with the use of flood moneys? Just simply didn't think they could have the project put together in time of the federal restrictions. Davis Bacon would have been required, a number of other issues ..... Thought we wanted this project completed this year. Kubby/ The David Bacon issue was we did things... we didn't think the moneys could be encumbered by August 15, 1995. So we didn't use flood moneys ..... competitive bidding process. Atkins/ What is the sign issue on the- Is that something we can accommodate as a city? Council/ (All talking). Atkins/ We can build a sign very easily that would encourage folks to use it. We have people to do that. Kubby/ I think there is two issues with the sign. One is making sure that people are very clear... is usable. Other one is to let people know that there is public space that they can get to it from Sheridan. Atkins/ That doesn't need to tie you up ..... we can certainly accommodate that for you .... Horow/ Atkins/ That should be a minor issue... I am sure we can accommodate that. Kubby/ Letter to each of us...city buying a couple of the lots on Sheridan Avenue side, lots 19 & 20, to increase the entrance way from the street to the public space ..... may have been some other things. I will bring it tomorrow. Throg/ What is not clear to me is the cost .... I have no idea what the cost would be. Worth looking into .... acquisition for parkland .... P/R Commission would have to be involved. Kubby/ .... if we are interested...we should send that message. Pigott/ It would be worth investigating .... Throg/ Depend on the owner. Kubby/ We are talking about exploring whether we would want to ask P/R to explore what it would take to buy lots 19 & 20 to have a bigger entrance way off of Sheridan .... to open space. Throg/ We could refer that to the P/R Commission and ask them to explore the possibility of purchasing those two lots .... Lehman/ Just see what they think of it. Nov/ They can certainly offer us a recommendation, pro or con. Kubby/ I will look at that letter again .... obligation to make sure .... to the specific requests .... I got it at home... I will bring it. ITEM NO. $n. Consider a resolution approving a preliminary plat of Saddlebrook, a 223 acre, 10-lot residential subdivision located south of Highway 6 and Heinz Road. (SUB95-0012) Throg/ What is the name of this particular development? Miklo/ Saddlebrook ..... formerly Lake Calvin Estates, formerly Sycamore Farms. Nov/ The plat on this is entirely illegible. Kubby/ Can we get a big one up here? Miklo/ ...I could bring one tomorrow night. Nov/ I would like to see something legible ....... Kubby/ Steve (Bright), do either of you happen to have the plat that we could unfold to look at... it would be helpful for me .... Ralph Stoffer/ (Refers to plat). Council Work Session page 13 Kubby/ ...The parkway is not an arterial? ..... It is now a collector? Miklo/ It will function as a collector .... go beyond this neighborhood .... limited access. Kubby/ Technically it is a collector that functions as an arterial .... Miklo/ The design standard is somewhere in between a collector and an arterial. Kubby/ Who is paying for it? Davidson/ The functional classification it will be an arterial (can't hear). Kubby/ In the staff report I saw two different statements about who was paying for it. Miklo/ The CZA obligates the applicant to pay for all oversized costs which would be the difference between a local street and a collector or an arterial .... exception for the parkway .... It provides the city may negotiate with the applicant on the timing. If the applicant needs the road earlier than the city feels it is needed for that area they would have to pay .... Kubby/ So what is the situation. Will that parkway be built before eee,ee Miklo/ No, the parkway will not be built in the initial phase of the development. Horow/ When is that anticipated? Nov/ (Refers to plat). Miklo/ Depends on the rate of development in that area. Nov/ There was some discussion... about when to finish the storm water basin.
