General discussion 95-105 S2 Nov/ If anyone has any parliamentary questions, she will take them now. Then we will go to P/Z- Kubby/ Do you mean just in general? On page 462 of Roberts Rules- Throg/ I should tell you I did ask Anna question this afternoon having to do with the CityVote-with a potential motion to reconsider CityVote and in the memo that Anne gave us it was unclear to me whether tomorrow's meeting would in fact be the next regular meeting of the city council after the one at which we adopted the resolution because we have held two meetings in between. So I needed to ask her that question .... conclusion... tomorrow is in fact the next regular meeting .... Nov/ Any other questions for tomorrow night? Thank you, Anne. Review Zoning Matters 95-105 S2 ITEM NO. 4a. Public hearing on an ordinance amending the Zoning Chapter by changing the use regulations on an approximate 2.02 acre tract of land located east of Lakeside Drive and south of Highway 6 from ID-RS, Interim Development Single-Family Residential, to RM-12, Low Density, Multi-Family Residential. (REZ95-0012) Miklo/ Proposal to rezone 2.2 acres .... ID-RS to RM-12 .... The P/Z commission recommended against this rezoning on August 3. They reconsidered...September 7 meeting and again voted against recommending approval of the rezoning. Staff has recommended approval of the rezoning subject to a CZA ..... provide some sort of landscape buffer between the proposed residential area and that industrial development. There are also concerns regarding the intersection of Lakeside Drive and Highway 6 and the neighborhood has expressed concerns about cuing in that area .... So we drafted a CZA... The applicant .... Kubby/ What are his particular objections? We attempted to sit down and see if we could work out a concept plan for the site or a more specific agreement and weren't able to .... Without a CZA we would not recommend approval of the RM-12 zoning .... Baker/ Language .... Miklo/ Yes, it is similar to other language. From their point of view- We have used this successfully in other- Kubby/ Is it possible to defer the zoning to give the developer and staff time .... to get at least a little further along in this process? ..... Miklo/ If the applicant was willing to defer we certainly try .... Kubby/ Miklo/ The proposal would be for a straight RM-12 zone and our recommendation would be against approving a straight RM-12. Woito/ But you wouldn't have an ordinance in front of you to vote on ..... You could amend the CZA requirement. Throg/ .... I understood you said that the P/Z Commission voted denial ....the second time. I didn't hear you say what the vote was. Miklo/ The second time it was a vote of 4-2... voted against the recommendation. Throg/ I was a little bit unclear about your discussion of the CZA then after. When you were talking about the CZA, were you referring to conditions that were discussed after the P/Z's vote to deny the second time? Miklo/ These conditions were drawn up before the P/Z Commission- They were aware of those and basically supported-The one condition... P/Z wanted... that P/Z would see the site plan after the zoning. Typically site plans are approved administratively unless they are appealed to the P/Z Commission. They wanted this to come before them regardless. Kubby/ What was the next vote? .... Miklo/ Their concern was that the uniqueness of the site, the odd shape, the large portion that is covered by an easement, its location of this intersection, that that hadn't been addressed to their satisfaction ..... Baker / Miklo/ Kubby/ What is it that they want different? Miklo/ I think they would like to see a concept plan before voting on it to show that the 30 some units that are allowed under RM-12 could actually fit onto the site ...... They are ooncerned that the density allowed under RM-12 may be too high. Staff doesn't believe that .... Throg/ I would very much like to hear what the Commission says about this .... Woito/ Kubby/ We haven't seen the minutes yet to that meeting. Throg/ Nov/ Would staff Miklo/ That is a Plan. Staff or Commission consider OPDH-12 on this? possibility. That would require a specific OPDH is comfortable with approving this with a less stringent requirement for a site plan as long as conditions were placed on it ..... Woito/ Wouldn't an OPDH get the same density? Miklo/ Yes it could. Kubby/ What about instead of having staff approve the site plan, we approve of the site plan? .... Had that been discussed at all? The first staff report indicates that the RM-12 is consistent with the Comp Plan ...... Throg/ .... Mullen/ I am counsel for CB Development, the owner of the property. The initial staff recommendation notes that they have a little problem with the concept plan .... these are issues more appropriately addressed during the site plan review process ..... This is suppose to be a land use question ...... Our objection to the proposed CZA is that it is totally arbitrary. It has no objective guidelines whatsoever ..... We don't believe that is right .... legal .... my folks are prepared to find out whether that is legal ..... site review plan process to deal with exactly these questions. There are some things in the CZA that we wouldn't object to ..... Woito/ Is there some reason you didn't pursue the OPDH, Larry? Mullen/ I got into the process late .... You have a process to deal with it. Kubby/ I think that is not the whole picture .... There are certain things... That is why we have a CZA ..... Mullen/ Larry Schnittjer/ In regard to your question about OPDH, you have to have a base zone .... Woito/ Oh and you don't have one. Schnittjer/ (Can't hear). Mullen/ We feel the question is a zoning question. I believe the Commission is totally out of control here ..... Throg/ I think...it is correct to say if you do not agree to the CZA .... then there is no agreement .... Kubby/ Are we under any obligation to change the ID-RS zone? This ID-RS was created when the larger ID-RS to the south was rezoned for the Whispering Meadows development ..... I would agree that this is probably not appropriate for ID-RS as a zoning. But something bet!~een an RM-12 and ID-RS might be considered. RS-8 might be a little low but RS-12 might be a possibility ..... In terms of the concept plan, one of the reasons we feel that these issues need to be addressed in the CZA .... because of discussions with P/Z... hadn't had success in negotiating with the applicant ..... Throg/ I feel a bit confused by what is really at stake .... We haven't seen the minutes of the last P/Z meeting. There are some other documents we haven't seen. I do not feel like I have adequate information upon which to make any kind of decision tonight .... I would prefer .... not to act on this. Nov/ It is just a p.h ..... Throg/ I need greater clarity. I drove around the neighborhood .... see during peak times what it was like .... I didn't see the traffic problems that the neighbors had talked about .... Throg/ What is the count of vehicles per day right now on Mormon Trek? Miklo/...approximately 15,000 vehicles per day. Nov/ ...I seem to remember 8,000 and potential for 15,000 .... Miklo/ I have the numbers before the new counts were released .... South of Benton Street/Mormon Trek has... 10,000 vehicles per day ...... Something over 10,000 .... Street is designed for 20,000 ..... Because there are very few driveways and curb cuts where the street is narrower it can handle more traffic .... Kubby/ ..... Is it wide enough to stripe it as a four lane? Miklo/ I don't know if it is... designed as two lane. We could ask Public Works and see. Kubby/ T encourage somebody else to go .... Nov/ It doesn't look terrible but I wasn't there during peak traffic... Pigott/ I was there yesterday at 4:O0 .... Miklo/ Jeff Davidson .... said this is one of the best functioning arterials .... Nov/ In this rezoning, do we have the authority to ask for trees and landscape plans? Miklo/ Yes .... it does comply with our standards... Nov/ We have some very serious concerns about the sidewalk next to the street .... Are we going to have some big trees on the other side of the sidewalk .... We won't have any trees in the r.o.w ..... Miklo/ (Refers to plat). Nov/ Some of those look like bigger trees are at the back...rather than along the sidewalk .... Miklo/ .... have the applicant address that. ought to do something about landscape planting Nov/ .... maybe we and shading. Throg/ I would be inclined to agree with Naomi on that .... Not clear to me, reading that, whether there would be any vegetation .... would be appropriate to have that kind of vegetation along those streets ..... Baker/ (Can't hear). Miklo/ During the course of the discussion there were several versions of the OPDH plan and landscaping was not one that they discussed extensively ..... was some concern .... on Mormon Trek Blvd... row of white pines... buffer .... I agree with you .... Kubby/ Process .... how do we vote on something .... in terms of recourse if trees aren't there .... Watts/ I will have something to you by tomorrow night. Pigott/ Some of the neighbors pointed out .... explanation of pricing of the houses .... explain discrepancy between the two numbers. Watts/ The 12-plex .... we are going to try to have condos inside the 12-plex $65,000-75,000 ..... the 18-plexes...pricing $85,000-90,000 up to $100,000. The four plexes ...$105,000 range. Duplexes up to around $120,000. So the most affordable would be in the 12-plexes ..... different in price range .... Pigott/ Watts/ The association fees are separate .... in marketing of homes .... Throg/ What is the likely monthly or annual fee be? Watts/ Rough guess...$50-55 a month .... insurance .... Kubby/ ..... If that is one of the reasons is we are voting of this... why wouldn't we want to somehow put that as part of our parameters? Throg/ Kubby/ ..... Throg/ Linda, what flexibility do we have with regard to trying to stipulate some price ranges as part of the rezoning? Could that be a conditional rezoning? You can always ask .... Kubb¥/ That is just what I am asking. Baker/ I don't see it as a factor in my decision .... The affordability is an attractive feature but it is not ..... Kubby/ I think the other issue I would really like to sse people talk about tonight ..... is we agree with the concept of mixed styles of housing .... How do you justify doing another one here? .... want to hear what people are thinking about that particular point ..... Nov/ I did think about that ..... numbers a bit skewed .... zero-lot line... 13% s.f. and when I put in my calculations... zero lot line as s.f. kind of housing .... I also felt that included Pheasant Ridge within the neighborhood was a little lengthy, too far extended .... would have defined it further south .... Baker/ Also an underlying philosophical question which is what is our role in determining how specific...kind of housing gets built ..... Throg/ But we are influencing that judgement by our willingness or unwillingness to fezone. Kubby/ Baker/ I am not sure the city is doing more subsidized housing in that area ..... Kubby/ ...balancing out the different kinds of housing in different parts of town .... Baker/ At this point in our discussion to different type of housing after inappropriate. start negotiating for a this process seems Kubby/ I am not asking for that .... What compensates for that point in your mind... want to hear what people are thinking .... Pigott/ .... why not have it here... also building a higher density on the east side of town at Windsor Ridge ..... You tell me where it is that we shouldn't build .... Woito/ No. Throg/ So that is where I stand .... That is why I am interested in doing ..... Kubby/ ...How do you ensure that unless it is part of the parameters? .... Throg/ On one hand ..... ask staff to work with the developer to come up with a conditional statement that he could live with ...... It was real clear the worry seems to stem from that particular development ..... ITEM NO. 4g. Consider an ordinance amending Title 14, Chapter 4, "Land Control and Development," Article C, "Historic Preservation Regulations," and Chapter 6, "Zoning," Article J, "Overlay Zones" to allow the City to designate historic landmarks and conservation districts. WS091195 September 11, 1995 Council Work Session Page 15 Metering of Loadinq Zones in CBD 95-107 Sl Joe Fowler/ On the parking meters on the loading zones. When the idea was first presented ...easy... Since that time I have been approached by several people that had other concerns .... Research as to how we got where we are today. I attached some past history, the 1972 resolution which set the tone for current parking configuration... memo by Neil Berlin... listed some pros and cons for you as far as putting the meters in... easier to understand... easier to enforce... cons... public might feel we are taking away what they perceive to be free spaces... commercial vehicles would be forced into the traveled lanes more than they are now... congestion... visual congestion.. reduced access for emergency vehicles. Baker/ Fowler/ If the loading zones aren't there...trucks parked in the street... row of trucks down the street. Lehman/ Joe, when is the last time you say a commercial vehicle in a commercial loading zone? Fowler/ Probably depend on which loading zone ..... Lehman/ This is where this came from... tons of people getting $5.00 tickets .... just be a meter .... Kubby/ Short term meter .... Lehman/ Fowler/ If the loading zone is empty a commercial vehicle can go ahead and sue it without paying a meter... Kubby/ Is it possible to have signage that gives a better indication? .... Jim Brachtel/ Part of what is on there now is the time limit and we were instructed that it is required under our ticket system... That is why some of that verbiage is on there .... Kubby/ Brachtel/ In all instances we try for economy in words because it is more readily read. I am like everybody else .... $5.00 bet .... Lehman/ ...maybe just a sign that says commercial only. People don't read that... Nov/ Just put on extra money on the meter...disincentive to park there ..... let's make it a dollar. Baker/ Lehman/ Nightmare to enforce it the way you have got it ..... Fowler/ Right now it is a problem with enforcement .... limited only to $5.00 ..... Don't think there is any real disincentive to the cost of parking. Kubby/ .... I don't want commercial vehicles parking in the middle of the street ..... Lehman/ You can't get in there .... commercial vehicles have to park in the street .... Kubby/ ...few people who are in that category that are legitimate to park there ..... Nov/ But they do have signs. Lehman/ I think I hear you saying you don't think this is a particularly good idea. Fowler/ When you first mentioned it I said sounds good. people talked to me...wanted to make sure I everybody ' s viewpoint. Then other presented Lehman/ Fowler/ Our bottom line if you would like to try this we think Clinton Street, 100 & 200 block, would be a good trial place to see if it would work .... between Washington and Burlington because there is not a lot of store front loading done in that area ..... short term parking...street is wide enough... Lehman/ Other thing...have to meter the regular loading zones. Fowler/ Right... do both sides...all loading zones... Reason we didn't recommend the other block to the north was that some of the businesses there have large vehicles that take a long time to deliver .... too congested .... Kubby/ I don't have a problem with experimenting .... Lehman/ Joe, did DTA-they have no objection to the proposal? Does this mean that we give this a test and try it? Fowler/ I have gotten mixed reviews... majority...would be beneficial to have more parking... Dale has talked to them or sent a letter .... Kubby/ Baker/ Spaces are filled up .... Fowler/ This would take places reserved for commercial vehicles that are being used by the general public and make it a legal parking place, very short term. Lehman/ Simple for the meter maids... Throg/ A lot of people have complained to me...this is not one of them... not persuaded that we need to do anything differently... Not support the idea. Intrigued by resolution 72-132, parking policies... would be appropriate to instruct staff to reconsider and update those parking policies to take into account what we know about use of the ramps, use of on- street parking ..... parking incentives for carpool users... reconsidering parking policies for d.t. area. Can we explain why broken meters- Fowler/ If a person comes along and they can see something obviously wrong with the meter they don't give a ticket. If they can't see something wrong they go ahead and give the ticket, they write the meter number down and they come back to the shop and they write it on the list... Back of ticket there is a phone number for you to call. You call into the shop .... they go out and check the meter...ticket is dismissed .... You don't have to pay the ticket ....
