that are begin requested ....... What we are asking to do is
change the statute so we could have four at-large members and
then one member per district ..... increase the at-large

Baker/ You don't anticipate any problem with the even numbers?
Russell Tie vote... is possible. We seldom have close votes. I

ITEM NOo 5a. Public hearing on an ordinance amending the Zoning
Chapter by changing the use regulations on an
approximate 2.02 acre tract of land located east of
Lakeside Drive and south of Highway 6 from ID-RS,
Interim Development Single-Family Residential, to
RM-12, Low Density, Multi-Family Residential.

Franklin/ The first item which is the p.h ..... rezoning of two
acres ... We are working with the developer on this ..... be
able to come to some resolution on a site plan so that
everybody is moderately happy. The P/Z .... voted to
reconsider this on October 5 and we would request that you
continue the p.h. to October 10th and defer first
consideration to October 10.

Consider an ordinance amending the Zoning Chapter
by changing the use regulations of an approximate
29 acre tract of land located west of Mormon Trek

Franklin/ Second consideration on parking for persons with
disabilities in the front yard. #b was the first
consideration- I am sorry, forget that. We didn't have first
consideration of item a. on, I thought we did.
Woito/ So you are going to continue the p.h. on item a.?
Franklin/ Yes. How could I forget item b. Second consideration of
Mormon Trek Village ..... that is a repeat.
ITEM NOo 5c.
Consider an amendment to City Code Title 14,
Chapter 6, Article V, "Minor Modification
Procedures," to allow parking for persons with
disabilities in the front yard of a commercial zone
even when located adjacent to a residential zone.
(Second consideration)
Franklin/ Is the second consideration on parking for persons with
disabilities. The staff would request expedited consideration
of this. Doug Boothroy now is working with a property owner

that if this were to be adopted sooner it would just work out
in terms of the timing for the building permit.

Consider a resolution for preliminary and final
plat approval of Donohoe Fourth Subdivision, an
11.35 acre, two-lot commercial subdivision located
in Fringe Area 1 on the south side of Highway 1 at
its intersection with Landon Road. (SUB95-0019)
Franklin/ Consider a resolution .... Donohoe Fourth Subdivision. This
is an ll acre two lot commercial subdivision in the county in
Fringe Area 1. We all did recommend this not be rezoned.
However it was rezoned to commercial. This is the plat ....
issue.. has to do with the access to Highway 1. This plat does
show restricted access to Highway 1. So we recommend approval
and the Commission recommended that ....
Kubby/ This brings up the whole frustration about the Fringe Area
Agreement and our different interpretation. What is the time
frame that we are working on now?
Franklin/ The Fringe Agreement?
Kubby/ We had also written a letter saying we want to hear back
from you by a certain date .....
Horow/ They are in the process of getting the letter composed ....
The object is to get back to us .... Then we will discuss what
we are going to come back .....
Throg/ We still don't know what our negotiating posture is. We
haven't talked about it.
Horow/ We had to get the letter back first.
Throg/ .... We need to meet by ourselves before we meet with the
Board to be clear about what our position is.
Franklin/ The Board is having a conversation about this again at
their October 3rd meeting. I would expect some correspondence
back after that. Maybe we can schedule it for October 9th for
the council to talk about it .....

Franklin/ Consider a resolution for a final plat for Kennedy's
waterfront Addition. The legal papers on this are not
completed and so we ask you to defer this to October 10th ....
Did you have a question on anything?
Kubby/ I do and it is about the P/Z-staff work plan and I didn't
really get a chance to compare the old one .... just pending
stuff, right? It says pending list on it.
Franklin/ The pending list is their work program. That does not
include a current applications .... it doesn't include anything
for HP or Riverfront and Natural Areas. Just for P/Z items but
it is studies as well as ordinance amendments. So it is
anything other than applications essentially.
Kubby/ Depending on what happens with the Sensitive Areas
Ordinance, it seems like we are going to need to develop some
further educational materials .... for people who live in areas
..... So that people uDderstand ....
Franklin/ So interject that as a work item somewhere.
Kubby/ I guess maybe wait until it passes .....
Franklin/ We know that the educational component of this ordinance
is going to be a big part of it with developers as well as
with the general public and we expect that as each of us on
the staff has exposure to people who are getting involved with
the ordinance .....
Kubby/ The brochures have gotten rave reviews so far.

Near Southside Planning Update 95-112 Sl
Franklin/ The consultants from Gould Evans are here, Dave Knopick
and Brian Hamilton. We have just gone through a meeting with
the Advisory Committee and I think learned some interesting
things today that have some impact on the preferred
alternative. Just as a recap-recall that we are doing this as
a consequence of the work that you all did on the Near South
Side and the agreement that we needed to look at the design
component for the Near Southside. What is included in this
plan addresses largely public development, that is within the
streetscape, identifying focal points, gathering area,
parkland, some parking components are included in it .... Also
acts as a framework for private development in this area .....
plays out over a number of years .... beyond all of us ..... It
is a concept for the area... vision... idea. This is an update
for you. You don't need to make any decisions tonight. Some
more work will be done on it... Schedule is to have it back to
you for approval in November or December. But before the end
of this calendar year for sure. Glen will give a short
presentation about the contract .... any input from you... if
there are any major things that you see at this point in time
that are issues for you.

gave earlier today at the Advisory Committee... proposal that
we are talking about. Calling it the near South Side Design
Framework ..... talked about concept of the Near South
Side...d.t. extension .... recognize some distinct enclaves
within the Near Southside ..... needs to be understood in some
component parts (presents drawing) ..... Concepts: 1-unified
streetscape, 2-parking, 3- green links concept .... streetscape
elements are... in the public r.o.w. that can serve to unify
a project area ..... We have a number of recommendations for
lighting fixtures... banners .... We have a number of
suggestions for parking ..... We would like to consider...
still working with parallel parking... bring out an ...
elephant ear ..... area of green that comes out and narrows the
street .... defines the street from the parking... third
concept is the green links concept... important to understand
..... provides a backbone or structure... northern part of
green links is Burlington .... north-south is Clinton ....
Understand ...... subdistricts... enclaves ..... Talk about the
concept of d.t. extension .... says that in the one block
between Burlington... and Court.. wanting to extend the
essence of what d.t. is into that block .... knit together a
division that exists .... concept of links.. Here is

Burlington today (refers to drawing) ..... defines edge of d.t.
Proposing... create a seam that begins to bind it up...
negotiate with DOT... creation of a median in the middle of
Burlington.. change the character of Burlington .....
streetscape treatment... blvd. character ..... enhanced
pedestrian lighting, banners... call attention to the improved
nature of Burlington. There is a picture of Burlington with
the median... enhanced lighting fixturest.. proposed
Hieronymous Square Development... dramatically change the
character of Burlington ..... If we are talking about d.t.
extension ..... d.t. streetscape .... pedestrian mall ....
interesting paving pattern... plantings... awnings... We think
Clinton Street... as you develop south along Clinton that you
pull a similar character d.t .... you are using similar kind of
paving treatment... planting beds... awnings... unify this
area of Clinton... governmental center .... Advisory Committee
did not agree with one of the concepts today .... In the
governmental center... County Court House, jail, Federal
Building .... this is that area...Bounded by Court, Harrison
crosses it in the middle .... What is proposed here is really
a definition of an enclave, governmental enclave. An area that
gives a much needed focal point in the center of the Near
South Side. We feel that this is a key cornerstone of the
concept because you have a number of governmental entities
that have their own buildings... an alliance needs to be
forged within these entities to create a governmental
complex .... Let's create an enclave that hangs together and
has unity... enhanced crossing points for pedestrians at the
corners .... Clinton .... proposed a governmental mall... actual
closure of Clinton for one block .... Harrison and Clinton...
we would propose to extend the brick paving to Clinton ....
enhance this kind of very rich texture... define this as kind
of a single unit .... If we keep Clinton open that kind of
Brick paving will probably go to the north again... still go
to the drawing board on that one as well.

LeRoy/ They didn't like the street closed ..... We thought we had
worked out the parking for the Post Office and they felt that
it was not adequate ..... The concept is kind of a super block
Court House Square and around this Court House Square there is
diagonal all the way around it. They felt that was not
adequate to meet that parking demand.

LeRoy/ Proximity. And we talked with them and indeed with city
staff... provide cluster parking and that people turn into
pedestrians... obviously they have not yet bought into that
concept as a concept that would govern this particular
government district. And we met with probably unanimous
resistance. to the closing of Clinton ..... not the
modification of Clinton, not the enhancement of Clinton, not
the greenspace ..... but the fact that all traffic would be
taken off of that one block did meet with significant
resistance. In this area you see the governmental center is at
the criss crossing action of the southern spine with the east
west spine with the north south spine...occurs within the
governmental center .... almost in dead center of Near South
Side... kind of perfect central focal point .... We were
proposing diagonal parking which is consistent with this kind
of Court House Square image .... this area is going to have to
be re-worked .... (refers to drawing) .... location for
potential parking ramp .... great promise for the creation of
a proposed civic park. One of your charges to us was to look
for opportunities for green space in the Near South Side ....
W~at you see is the parking deck in the back and the creation
of an area that in the summer you could use for some very
formal kind of activities .... in winter you could use for ice
skating... adequate parking .... The next area is the Ralston
Creek Mix use District .... great opportunity... unenvisioned
.... opportunity ...proposing Ralston Creek be enhanced ....
kind of introduction point... enhanced by proposed park...
gateway to this east west green links concept... crosses along
Harrison through Harrison Hill Park and into the governmental
center .... into the University of Iowa area .... Lighting
fixtures be same as d.t. fixtures... very simple kind of
paving... creek is the amenity... bring pathway through
Harrison Hill Park... ultimately into the University of Iowa
campus on that side and into a potential open space. We think
that the Near Southside deserves access... to the river .....
That really completes that green links concept from water on
one side to water on the other side and the governmental
center i the middle and it seems to really work as an open
space concept. In area to the south.. Rock Island Square...
Rock Island terminal (refers to drawing). Then there is a
commercial cluster to the right hand side...surrounding by
additional higher density housing ..... The Rock Island
terminal currently being re-used as office space ..... brick
buildings... opportunity for enrichment of that environment.
The buildings .... opportunities... looks more like this...
creating a clustered commercial area .... represents a
destination from outside the Near Southside. Again, in this

particular area we are talking about enhanced streetscape ....
intimate pedestrian environment .... colorful awnings... richer
paving pattern .... historic light fixtures .... Get the sense
of a different kind of place that now exists... enhancing
that. In terms of housing... propose a different way of
looking at housing gin the future in the Near Southside. Three
generations of housing... 1- you can see the kind of four
story with parking underneath... without a lot of paying
attention to the pedestrian... 2-it has a richer texture...
take a look at how it hits the ground... 3- look at the
breaking down of the massiveness of those buildings... step
back.. creation of a front area... courtyards... Breaking down
of the massiveness and a more pedestrian friendly environment.
Finally the University of Iowa district .... power plants, bus
terminals, and motor pools... They indicated a willingness and
a desire to want to be part of the Near Southside... They want
to be good neighbors... encourage them... to explore that
green linkage .... somehow you want to get it to the river...
connect through that green linkage concept .... utilitarian ....
not to be tied into a specific lighting fixture. Over all..
the participants... bought into the overall framework of this
concept .... the only objection of serious nature was for the
closing of that one block of Clinton.. a lot of discussion
about details... beyond the scope.. We think, in summary, that
this represents a forward looking and realistic view .... An
enhancement of what already exists in the Near South Side...
fairly conservative kind of proposal... implementation would
be incremental .... project by project... building by
building ......
Horow/ Does anyone have any questions?
Baker/ I certainly understand the concern about closing Clinton
Street. But in your study .... discussion .... was there some
consideration given to narrowing the street?
LeRoy/ Yeah .... If you do these sort of elephant ear concepts .....
the street is going to appear narrower ....
Baker/
LeRoy/ (Refers to drawing) .... Because of the diagonal parking,
Clinton becomes one lane of moving traffic and then the
diagonal parking that plays off of it ..... d.t. Lawrence,
Kansas .... diagonal parking along the store fronts .... still
allow that through traffic but it would generally slow down
traffic in the governmental center.

Baker/ Seems like an extremely wide street ....

LeRoy/ Whenever you go from parallel parking to diagonal parking
you are taking more space out of the street and so the street
is actually narrower .... one lane each way ....
Baker/ Not just narrowing the traffic lane but increasing the space
in front of the buildings ....
LeRoy/ We will take another look at that, too...
Baker/ Question about the third type of housing that you are trying
to visualize .... present zoning restrictions .... look at the
density of housing.
LeRoy/ It would be our hope...encourage higher density housing in
the Near Southside .... We would hopefully create this so that
you could keep this same density of housing... scale break
down of those buildings... Goal is to keep the same density
but encourage a breakdown of massiveness of scale ....
particularly for pedestrians ....
Kubby/ Doesn't our zoning down there give density bonuses ....
Franklin/ The zoning that is there now would allow this type of
development to occur. It is a matter of developers wanting to
do it that way... feeling that the market would support it ....
Dave Knopick/ The other option, too, would be a design review
process.
LeRoy/ ...zoning overlay...
Baker/ ...University would like to have river access. Have you
talked to them?
LeRoy/ They would like to accommodate river access for the Near
Southside. Now how they do that .... we don't know the exact
configuration... don't know exactly what they are...

LeRoy/ What we are looking for is a visual corridor to the river.

We are not looking for people to cross the RR tracks
necessarily .... That the river is visually present for people
in the Near Southside ....
Lehman/ How practical are the islands on Burlington Street? ....
LeRoy/ Brian has developed...Jeff has taken and talked to the state
DOT about this... We feel that you can still make significant
enough improvement in the area .... From the feedback that we
have gotten... they haven't said no... Jeff suggested an extra
50 feet be given over to it... negotiating posture .... still
have enough semblance of a median to make a difference ....
Nov/ .... On the commercial area on Dubuque Street .... added peak
roofs .... is this a possibility? ...
Brian Hamilton/ I drew this from an aerial overlay. If peak roofs
are shown it is my mistake ....
LeRoy/ When you have some of the facades like that that you can do
things .... give it that enhancement in appearance...
Nov/ I would like to see structurally possible roof lines ....
Knopick/ There are some houses that are currently businesses on
that commercial strip there .....
Throg/ I attended the Advisory Committee meeting this afternoon...
terrific job... like components of the concept .... There are
lots of little details.
Pigott/ I like it as well... even like the idea of the government
mall .... worth exploring .....
LeRoy/ Again. let us talk about the adoption process and the
relationship between the Advisory Board and the governing
body ..... ultimately you are going to adopt a concept.
Throg/ Surely the Advisory Committee said don't close that block of
Clinton Street .... It is possible ....
LeRoy/ Wondering of getting the way of both worlds ....

pedestrian...very strong .... even though vehicles are driving
up and down... the priority is given to the pedestrian.
Kubby/ ...lighting... I like the looks of the historic lights but
they really send light up .... still rather inefficient ....
lighting the sky instead of lighting down .....
Brian Hamilton/ There is a multitude of fixtures .... not been our
charge to identify or outline... There are ways to do that...
next step... What you saw up here is conceptual ....
different... more historic or rich or traditional.

Howard Horan/ Chairman of the Airport Commission ..... Jerry
Searls .... I think he has made it all very very clear .....
Just to review real quickly, his approach was that there is no
way to design an effective Master Plan for the Airport without
designing or coming up with a concept for all the space around
it ...... So he has-he just started on a blank piece of
paper... first of all he has moved the main road (refers to
drawing)... research development park... s.f. housing down in
this area ....... maintained the city park as a nature
preservation area... 4-H Fairgrounds virtually untouched ....
access... several .... lots industrial...commercial...
manufactured housing .... I-4 zoning ..... This runway 1735 ....
is most likely the first to deteriorate... let that degrade...
fail... 5-7-10 years... logical thing to do... (refers to
map)... let that runway deteriorate... and finally close
it ..... We would extend 624 about 1200 feet and using a system
called declared distances and end up with a runway..200 feet
shorter than it is now ....
Baker/ Extended it but it will be shorter?
Horan/ FAA .... if they say that is how we do safety, then that is
how we do safety ..... (refers to map) ....... several other
industrial lots to be developed up here (refers to map).
Baker/ Extend it and it will be shorter .... 250 feet shorter than

Horan/ Trying to maintain a basic level of general aviation service
that to date we have had ....

Kubby/ The physical space would be there but the threshold would
have to be backed up ....
Baker/ Is there a figure that makes displacement unnecessary? ....
Is there an extension that you can put down that wouldn't be
1200 feet...

people?
Horan/ No .... use system of displaced threshold and declare a
distance. Without that the runway gets shorter and shorter and
shorter.
Kubby/ .... talked about the mobile home park.
Horan/ I think the Airline has to go .....

Horan/ Most of the landowners have been contacted .... most of their
questions addressed... In concept the landowners have
supported this.
Horow/ What is the potential of using federal funds in term of
displacing or help in relocating?
Horan/ That is fundable at 90% federal funds from the FAA ..... 10%
local funds.

Horan/ ...... logical place to relocate.

Horan/ ...relocating the motel... might be possible to relocate on
airport property that has not been zoned for commercial.
Horan/ I don't see why not.
Kubby/ .... type of housing units much different .... too simple to
say they can move into Bob Wolf's ....
Horow/ ...I don't think it is impossible .....
Baker/ You are assuming that federal government will pay for
relocation ..... part of relocating costs is upgrading
housing...
Horan/ I would think... we would need you to be satisfied.

understand what all the implications of such a decision

overall land use in that area .... pertains.. land around the
airport ..... That we deliberately look at the impact on the
land around it .....

it is in the runway protection zone.
Lehman/ It would seem to me..revenue from sale of industrial
parkland would go a long ways in paying for our share ....

Horan/ Marty Kelley has talked with us .... seems to make sense...
Throg/ I see three main elements to this concept plan. 1- keep the
airport there... meet FAA standards .... 2-Getting rid of
..1735 runway .... 95% coverage .... It is possible to close
that runway .... sounds to me like a good thing to do... 3-
Notion of having commercial and industrial development around
the periphery of the airport .... That strikes me as very
wise .... protects the airport from any further encroachments
in the future ..... not open to residential development ....
Horan/ That is in the county .... presented it to the Board of
Supervisors... great plan .... If Karin has concerns about too
many roads on too many ridge tops .... As long as we approach
it with a plan...
Nov/ We are not going to decide where those roads are .....
industrial ...there has to be a sewer line .... This is going
to be a while .... long term plan...
Horan/ ...30 year look... What we had hoped is a joint meeting with
the city council and Johnson County Board of Supervisors to
come up with some specific agreements, 28E agreements, that
have to do with zoning and development around the airport .....
Establish that and get the ball rolling.
Horow/ I have talked with Charlie Duffy with that idea .....
Supervisors would be available before our meeting on the 23rd,
Monday ....

Davidson/ Just a very brief review of how we got to where we
are right now. The first ..... page .... memo from Rick to Steve
in July 1991 saying they have taken a look at Melrose Avenue
Bridge... time to look at a new structure. Council then
directed Rick... to begin designing a four-lane bridge .... 75-
80% design... IDOT granted what was called a categorical
exclusion which is a basically an exclusion to doing any kind
of detailed environmental review .... There then began a ...
discussion ..... we were directed to conduct an environmental
assessment of the project. Council decided... not comfortable
with making a decision on what the design of the bridge should
be... The EA also became an alternative analysis...7
alternatives... consultant was then hired .... to investigate
the 7 alternatives .... That process has been completed... we
have...fulfilled all requirements of DOT, all requirements of
federal Highway Administration and we are under the impression
that we have also given you all the information that at this
point you require .... You received this document a couple of
weeks ago... remains to be done is for you to select a
recommended alternative that will then be placed into this
report and it will be sent to the Federal Highway
Administration for concurrence and at that point the funds for
both the street reconstruction and bridge reconstruction is
about $1.2 million all together would be released. The Federal
Highway Commission is one member of the nine member focus
group that council established .... Four members of the focus
group in the audience tonight ..... I believe this is
significant .... that we have come down to a recommendation
from the consultant that staff has concurred that we are
comfortable with. It is to what we started this with... it is
different .... a better design .... a three lane design which
also includes seven foot shoulders on either side for transit
vehicles and bicyclists. You are aware... has been some
controversy... same width as a four lane design .... It is a
better design than the four lane design... safer...more
functional .... predicated on... take the natural environment
into consideration, take the built environmental into
consideration..oability of the street to carry traffic and the
ability of the street to accommodate all the modes of
transportation that exists in that area .... You have all of
the alternatives that were looked at. We are assuming council
is not interested in do nothing alternative... Alternative to
construct a new street through University property ...also has

Does our staff agree with that assessment?
Atkins/ Right now I am not sure... we have done everything legally
we were suppose to do and I have asked staff to make a couple
of other phone calls to see if it is required. Secondly, if
this individual wants to be part of our bidder list... he
needs to send us a credential statement ..... We will check it
out. To the best of my knowledge we have done everything we
were suppose to do.
Woito/ And it may be a little premature. When we finally get down
to the design stage we will be able to send something off to
the State Archeologist and say we think there is something
here but we are not at the final design stage.

was at $.35 for specific reason... they would do some of the

office .... Chamber Office then bills each and every merchant,
collects the money.
