Review Zoning Matters 95- 142 S2
ITEM NOo 6a. Consider setting a public hearing for January 16,
1996, on an ordinance amending the Zoning Chapter
by changing the use regulations for a .5 acre
property located at 840 Cross Park Avenue from CO-
1, Commercial Office, to CC-2, Community
Commercial.
Miklo/ Setting a p.h. for January 16 on a rezoning0.. Cross Park
Avenue from Commercial office to Community Commercial. This
was recommended against by both staff and P/Z Commission.
Horow/ Is this because of the presence of Econofoods and the fact
that there is another kids new store right adjacent to it in
CC-2. What was the reason?
Miklo/ Rationale for P/Z Commission and staff was that the
apartment south of Econofoods ..... there was an unfortunate
zoning situation there ..... On this area the apartments are
now on the south side of this street and there is Commercial
Office across the street ..... buffer between Commercial office
and Retail Commercial. P/Z Commission felt that extending the
Community Commercial farther to the west would exasperate a
bad situation ..... They viewed the Econofood situation as not
being ideal and they didn't want to make it any worse.
ITEM NO, 6b.
Consider setting a public hearing for January 16,
1996, on an ordinance amending the Zoning Chapter
by changing the use regulations of an approximate
.3 acre property located at 1500 Sycamore Street
from RS-5, Low Density Single-Family Residential,
to CO-i, Office Commercial.
Miklo/ Proposal to rezone... 1/3 of an acre at 1500 Sycamore
Street... to Co-1 .... P/Z Commission also recommended denial
of this. Staff had recommended approval with some conditions.
It was our feeling... can be used as a buffer or transition

between residential and commercial.
Horow/ This was taken under advisement by P/Z about ten years ago
.... At that time the neighbors protested strongly .... Does
staff have any information about any other requests to use
this property?
Miklo/ Apparently... property is grandfathered in for religious
institution. The offices for Lutheran Social Services were
allowed in this residential zone as a religious institution
back in 1967 ...... A religious institution would require a
special exception but the office is grandfathered in .... Can
be used as a church.
Nov/ Doesn't that create more traffic than the proposed use?
Miklo/ Potentially.
Kubby/ Discussion... restrictions on the sale of that property in
the future. Have you heard anything about that?
Miklo/ I haven't .....

Consider setting a public hearing for January 16,
1996, on an ordinance amending Title 14, Chapter 6,
entitled "Zoning," Article D, entitled "Residential
Zones," Section 5, entitled "Neighborhood
Conservation Residential Zone (RNC-12)," to clarify
the number of roomers permitted in duplex units in
the RNC-12 zone.
Miklo/ Setting p.h. on January 16 on an amendment to the RNC-12 ...
to change the number of roomers that are allowed in duplexes.
Currently the zone only allows one roomer per duplex. The
proposal would make it two per duplex similar to the RM-12
zone. This was recommended against by the P/Z Commission.
Staff had recommended approval. This came to the staff's
attention .... Davenport and Fairchild Street were being
rezoned ..... Council had instructed us to look at it and see
if we could make it consistent.
Kubby/ So being consistent would be going up to two?

Miklo/ It had been P~-12 previously ..... Any existing duplex in the
RNC-12 zone can have two roomers. Any new duplex established
after the December of last year... could only have one duplex.

Public hearing on an ordinance amending Title 14,
Chapter 6, entitled "Zoning," to allow recycling
processing facilities in the I-l, General
Industrial, zone and related amendments.
Miklo/ A p.h. on an amendment... to allow recycling facilities in
the I-1 ..... It would also allow outdoor storage of materials
such as tires and appliances by special exception in that
zone. Both P/Z Commission and staff recommend approval of this
amendment. There is also a letter... from a gentleman who
would like us to consider allowing of materials that include
hazardous materials under this provision. In our drafting of
the ordinance we excluded hazardous materials ...... we would
suggest that be a special exception. If you wanted to make
that change now we could send this back to P/Z ....
Nov/ What about the I-2 zone?
Nov/ That would allow it as a salvage yard.
Nov/ In the new proposal with hazardous materials, is that allowed
in the I-2 zone?
Miklo/ The I-2 zone would allow hazardous materials as a salvage
yard. Recycling centers are limited to the I-1 zone.
Kubby/
Miklo/ As the ordinance is drafted .... we can't consider hazardous
materials except in the I-2 zone.
Throg/ Strikes me as unwise to do this on the spur of the
moment .... Instruct one of our commissions or staff to
investigate more thoroughly ..... too many questions here ....

... I was surprised to hear that it was not even a special
exception in the I-2 zone ..... I have another question on the
I-1 zone .... concerned about the idea of storing tires .... Are
we going to require a site plan review for this kind of
development?
Miklo/ There would be an opportunity for that at the Board of
Adjustment .....

Hor0w/ What do we mean by mosquito abatement?
Miklo/ Concern was .... tires stored outdoors, they collect rain...
possibility for mosquitos. P/Z thought there might be methods

Nov/ I figured out the amount of storage and I am very concerned
about it.
Kubby/ Do you think it is too much?
Nov/ Yes .... 1500 square feet .... 12,000 cubic feet of tire storage.
That is too much .....
Miklo/ We based the 1500 square feet on our facility at the
landfill and this is about half that size.
Nov/
Miklo/ It would be reviewed by the Board of Adjustment .....
Nov/ If we have an ordinance that says up to 1500 square feet, they
have very little jurisdiction .... has to be smaller ....
Miklo/ If it is a special exception the board could say 500 square
feet.

Kubby/ It is outdoor storage. If they have any kind of outdoor
storage, they have to go through the Board of Adjustment.
Nov/ I am concerned about the amount of space ..... Difficult for
the Board of Adjustment to say we want a smaller space.

Horow/ .... The ordinance seems to address the screening for
aesthetic reasons. I did not see there was screening for
leachate ........ problems we had down by the bus barn .... I
don't see the containment factor here being addressed ..... The

question of leachate in terms of materials ......
Miklo/ In terms of materials that will be recycled, the
ordinance... requires... says other approved materials. Those
would be reviewed on a case by case basis by the Board of
Adjustment ......
Horow/ So there was no discussion in terms of having curbs? ....
Miklo/ No ..... I do want to clarify something. In terms of
hazardous materials in the I-2 zone, it would require a
special exception. All junks yards or salvage yards require
special exception.
Throg/ .... Strikes me that this proposed amendment would be quite
consistent with our economic development policy .... more
likely that recycling would be accomplished ..... Strikes me as
a pretty wise amendment.
Horow/ As long as all of the specifications are really adhered
to .... I am assuming the Board of Adjustment reads the minutes
of council when we discuss things like this .....
Miklo/ With each case staff will bring that material to them ....
They would be charged with determining how to safely handle
these materials.
Kubby/ Can we find out-It sounds like this new company kind of has
a place in mind... find out where they are looking at?
Miklo/ Look at this independently.
Arkins/ (Can't hear).
Horow/ Bob, do we know...this letter we just received, has a site
specific.
Miklo/ I don't know that. We will investigate that and find out for
you.

I don't think this is at all controversial. It just clarifies
what the original ordinance meant. It was worded vaguely, it
was interpreted vaguely. This way it will be interpreted
specifically.

advantage of .....
Pigott/ ..... I don't necessarily like the kind of time and
temperature sort of specifics that we are granting .... Might
be other ways people want to do that.

Pigott/ When we consider the change in the sign ordinance we can
look at others way to-
Kubby/ That is a different section of the ordinance ......
Nov/ This ordinance is just projecting signs .....
Miklo/ In terms of the projecting signs .... look at... to allow
clocks to be put on those. On fascia signs you can put a clock
on now as long as it is perpendicular to the building.
Kubby/ If someone wanted to put a projecting sign that had a clock
that was non-digital, you couldn't do it with this amendment?
Will that issue be talked about when we revamp the ordinance?
Miklo/ We will look at that.
Pigott/ .... We have expressed interest that we would look at
projecting signs all together.
Nov/ That is another issue. This clarifies the intent of the
original ordinance.
Throg/ Two weeks ago .... design was much more important .... I don't
feel strongly about it.

Miklo/ We require bicycle parking for all uses in the CB-5 zone ....
The intent was more that being a d.t. area it is easier for
the city to provide the bicycle parking .....
Kubby/ It will help to have a more consistent streetscape too... we
will provide consistent design of racks as well .....

expansion to the Iowa City growth boundaries. I thought our
growth boundaries .... were based on water shed boundaries ....
Are we suggesting that the water shed boundaries may have
shifted because of the '93 floods?
Miklo/ No... the growth boundaries are based on water shed and we
do not have complete information on some of those water sheds.
This would be updating to include all of the streams and
rivers in those water sheds.
Kubby/ The only reason we would change out growth boundaries is
because the water shed boundaries had shifted?
Miklo/ This wouldn't change the growth boundaries. It would be
covering the flood plains-

approving the design plan for Talbots at Old Capital Mall.
Bill Holland is here from Talbots .... go over their plans for
this store. The DR Com~mtttee did meet this evening and
recommended approval with a couple of conditions ..... They
were minor .....
Horow/ Welcome to Iowa City .....
Bill Holland/ (Presents design plans). This is one corner of the
Old Capitol Mall... presently occupied by Gifted... 4,000
square feet ....
Horow/ Dee Norton, do you want to come up and take a look at this.
Holland/ Proposing... have some signage on the exterior of the
mall, awnings... new display window on the Clinton Street side
..... exterior entrance ..... good exposure to bring some new
customers into the mall .... make a more active streetscape and
more attractive building.

Schoon/ Two conditions: 1-Fascia signs be a little smaller .....
Part of that condition was also to lower the Talbots sign to
make it more apart of the store. The condition the sign be no
higher than the actual height of the sign.
Holland/ (Refers to design plan).
Schoon/ The idea was to make it more a part of the store and not
compete so much with the 01d Capital Mall sign. The other
condition was there be future approval of the Osco sign and
theater sign location. Mall is going to look at some other
possible locations ..... They are recommending future approval
of the location of those signs.
Kubby/ Does Osco or the theaters get to have any say...?
Schoon/ That is something... the Mall is working on.

sign is coming down.

Schoon/ I think the perspective is if Oscos does not agree, Talbots
will be back with a revised design plan .... That is something
the Mall is going to have to work out with one of their
tenants .....

they said they will need to work out those arrangements with
those tenants.

Pigott/ I am curious about the location of the door .... Why is it
right next to the main entrance? ...... It looks great ....

fairly substantial grade change ...... Just a slope ..... Seems
to be an easy, reasonable unobtrusive way of getting
handicapped access into the store .....

store and remove the need to have the stairs which will

Atkins/ We really didn't staff this issue. We passed the
correspondence along... It appeared to be something that I
thought was of some consequences .....
Kubby/ Partnership wants to buy some condominiums that are going to
be built soon in another area and that they want to still use
the federal moneys that were slated for the Saratoga Springs
project for this project.
Horow/ Mr. Burns .... have you heard back from the Iowa Finance
Authority?
Bob Burns/ Yes ..... We have asked for your approval to use CDBG and
HOME funds for acquisition of existing or new construction
condominiums. We are combining those funds with equity capital
that we will raise through the low income housing tax credit.
We applied to the Iowa Finance Authority for the low income
housing tax credits .... when rezoning was denied... wrote a
letter to the Finance Authority and asked them if we could
change sites and preserve our application. They said that
would be our right if we did that ..... bring in the private
market .... try to find a site that either had existing condos
or proposed new condos for sale.
Horow/ Did you have to give the Iowa Finance Authority a location?
Burns/ No, not yet .... We wanted to make you aware of the concept
first so that you knew what we were doing ..... may have to act
quickly. You may want to approve...
Pigott/ Use some of the funds for Working Singles Program .....
Milkman/ No... different funds ..... two sets of funds. $300,000 in
FY95 funds; $200,000 in FY96 funds. the $300,000 in FY95
funds, CDBG and HOME, we said had to be committed by November
1 and if not we were going to have to move ahead with other
projects which we are doing. Are also $200,000 of F¥96 funds,
HOME and CDBG that are available.
Kubby/ Bob... $500,000 or $200,000?
Burns/ $200,000 .... that is the scenario we are working with. We
think we can combine the $200,000 in city allocated federal
funds with about $360,000 in state allocated

Burns/ The price of the units that .... at this point .... $60,000 -
$100,000 per unit and we think that we hope to be somewhere in
between there and be able to acquire at least 12 units.
Kubby/ Do you have a location in mind?
Burns/ Iowa city.
Nov/ Potential for scattered site ....
Kubby/ I have a hard time just saying yes without a location .....
I suppose we could say if they are scattered site, the
southeast side is a possibility and if it is all in one
neighborhood it cannot be in the southeast side ..... value of
not concentrating on the southeast side.
Throg/ Seems to me it would be inappropriate of us to say yes
tonight ..... without knowing more ..... Maybe what you are
looking for is some general indication... sense that this idea
might be acceptable depending on the details.
Kubby/ This should go back to HCDC.

Throg/ I am wondering if Marianne or any of the other staff members
have any firm opinions based on what they know up to now ....
Milkman/ One of the guidelines that they would like right now is a
price range which you will find acceptable, a per unit cost.
But aside from that the issue of location ...... the question
of financing of them and of the total subsidy. We don't have
any or there are no guidelines as such as what is an
acceptable subsidy per unit.
Throg/ What cost of house is affordable to a family at 90% median
family income?
Milkman/ They can afford, from our experience, afford approximately
$65,000 mortgage .....
Nov/ That does not tell us whether they are going to buy these
units and resell them or if they are going to buy them and

rent them. Are they going to be rented?
Burns/ We would lease to eligible occupants. So it would be a
minimum of 20 years and there is a condition that would allow
us to go to 30 years .....
Nov/ ...It is the rent that is relevant.
Kubby/ ...chart of what cost per unit was .... don't want to much
above what is the private market. Why should we pay more? ....
I would like to hear what that number is.
Milkman/ ...average sale price of s.f. units which I think was
$108,000 ..... Also looking at rental units, what condos were
selling for... range from $58,000 through $80,000
approximately.
Kubby/ I don't want to say a number tonight. To ask the commission

report directly to Rick and Chuck. They would hire... survey
work... We normally would go out for proposal on this and we
did ..... Chuck said maybe now is the time for us to try this

the racquetball courts, it would receive no usage. It is low
usage right now. The University has very much nicer
racquetball facilities that are open the public .....
