Staff: Atkins, Helling, Woito, Karr, Franklin, Miklo, Schoon, Trueblood, Milkman. Council Elect: Norton, Thornberry. Tapes: 95-142, Side 2; 95-145, Side 1. Review Zoning Matters 95- 142 S2 ITEM NOo 6a. Consider setting a public hearing for January 16, 1996, on an ordinance amending the Zoning Chapter by changing the use regulations for a .5 acre property located at 840 Cross Park Avenue from CO- 1, Commercial Office, to CC-2, Community Commercial. Miklo/ Setting a p.h. for January 16 on a rezoning0.. Cross Park Avenue from Commercial office to Community Commercial. This was recommended against by both staff and P/Z Commission. Horow/ Is this because of the presence of Econofoods and the fact that there is another kids new store right adjacent to it in CC-2. What was the reason? Miklo/ Rationale for P/Z Commission and staff was that the apartment south of Econofoods ..... there was an unfortunate zoning situation there ..... On this area the apartments are now on the south side of this street and there is Commercial Office across the street ..... buffer between Commercial office and Retail Commercial. P/Z Commission felt that extending the Community Commercial farther to the west would exasperate a bad situation ..... They viewed the Econofood situation as not being ideal and they didn't want to make it any worse. ITEM NO, 6b. Consider setting a public hearing for January 16, 1996, on an ordinance amending the Zoning Chapter by changing the use regulations of an approximate .3 acre property located at 1500 Sycamore Street from RS-5, Low Density Single-Family Residential, to CO-i, Office Commercial. Miklo/ Proposal to rezone... 1/3 of an acre at 1500 Sycamore Street... to Co-1 .... P/Z Commission also recommended denial of this. Staff had recommended approval with some conditions. It was our feeling... can be used as a buffer or transition Thisrepresents only areasonebly accuratetranscription ofthelowa Citycouncil meetlngofDecember18,1995, WS121895 December 18, 1995 Council Work Session Page 2 between residential and commercial. Horow/ This was taken under advisement by P/Z about ten years ago .... At that time the neighbors protested strongly .... Does staff have any information about any other requests to use this property? Miklo/ Apparently... property is grandfathered in for religious institution. The offices for Lutheran Social Services were allowed in this residential zone as a religious institution back in 1967 ...... A religious institution would require a special exception but the office is grandfathered in .... Can be used as a church. Nov/ Doesn't that create more traffic than the proposed use? Miklo/ Potentially. Kubby/ Discussion... restrictions on the sale of that property in the future. Have you heard anything about that? Miklo/ I haven't ..... ITF2~ NO. 6c. Consider setting a public hearing for January 16, 1996, on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article D, entitled "Residential Zones," Section 5, entitled "Neighborhood Conservation Residential Zone (RNC-12)," to clarify the number of roomers permitted in duplex units in the RNC-12 zone. Miklo/ Setting p.h. on January 16 on an amendment to the RNC-12 ... to change the number of roomers that are allowed in duplexes. Currently the zone only allows one roomer per duplex. The proposal would make it two per duplex similar to the RM-12 zone. This was recommended against by the P/Z Commission. Staff had recommended approval. This came to the staff's attention .... Davenport and Fairchild Street were being rezoned ..... Council had instructed us to look at it and see if we could make it consistent. Kubby/ So being consistent would be going up to two? Miklo Right. Nov/ Thlsrepresentsonlyareasonablyaccuratetranscrtption ofthelowaCItycouncll meeting of December18,1995, WS121895 December 18, 1995 Council Work Session Page 3 Miklo/ It had been P~-12 previously ..... Any existing duplex in the RNC-12 zone can have two roomers. Any new duplex established after the December of last year... could only have one duplex. ITF24 NO. 6d. Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," to allow recycling processing facilities in the I-l, General Industrial, zone and related amendments. Miklo/ A p.h. on an amendment... to allow recycling facilities in the I-1 ..... It would also allow outdoor storage of materials such as tires and appliances by special exception in that zone. Both P/Z Commission and staff recommend approval of this amendment. There is also a letter... from a gentleman who would like us to consider allowing of materials that include hazardous materials under this provision. In our drafting of the ordinance we excluded hazardous materials ...... we would suggest that be a special exception. If you wanted to make that change now we could send this back to P/Z .... Nov/ What about the I-2 zone? Nov/ That would allow it as a salvage yard. Nov/ In the new proposal with hazardous materials, is that allowed in the I-2 zone? Miklo/ The I-2 zone would allow hazardous materials as a salvage yard. Recycling centers are limited to the I-1 zone. Kubby/ Miklo/ As the ordinance is drafted .... we can't consider hazardous materials except in the I-2 zone. Throg/ Strikes me as unwise to do this on the spur of the moment .... Instruct one of our commissions or staff to investigate more thoroughly ..... too many questions here .... Nov/ ... I was surprised to hear that it was not even a special exception in the I-2 zone ..... I have another question on the I-1 zone .... concerned about the idea of storing tires .... Are we going to require a site plan review for this kind of development? Miklo/ There would be an opportunity for that at the Board of Adjustment ..... This represents only a reasonably accurate transcription of the Iowa City council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 4 Hor0w/ What do we mean by mosquito abatement? Miklo/ Concern was .... tires stored outdoors, they collect rain... possibility for mosquitos. P/Z thought there might be methods Kubb¥/ Nov/ I figured out the amount of storage and I am very concerned about it. Kubby/ Do you think it is too much? Nov/ Yes .... 1500 square feet .... 12,000 cubic feet of tire storage. That is too much ..... Miklo/ We based the 1500 square feet on our facility at the landfill and this is about half that size. Nov/ Miklo/ It would be reviewed by the Board of Adjustment ..... Nov/ If we have an ordinance that says up to 1500 square feet, they have very little jurisdiction .... has to be smaller .... Miklo/ If it is a special exception the board could say 500 square feet. Nov/ Kubby/ It is outdoor storage. If they have any kind of outdoor storage, they have to go through the Board of Adjustment. Nov/ I am concerned about the amount of space ..... Difficult for the Board of Adjustment to say we want a smaller space. Kubby/ Pigott/ I agree with your concern, Naomi. Kubb¥/ Horow/ .... The ordinance seems to address the screening for aesthetic reasons. I did not see there was screening for leachate ........ problems we had down by the bus barn .... I don't see the containment factor here being addressed ..... The This represents only a reasonably accurate transcription of the Iowa City council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 5 question of leachate in terms of materials ...... Miklo/ In terms of materials that will be recycled, the ordinance... requires... says other approved materials. Those would be reviewed on a case by case basis by the Board of Adjustment ...... Horow/ So there was no discussion in terms of having curbs? .... Miklo/ No ..... I do want to clarify something. In terms of hazardous materials in the I-2 zone, it would require a special exception. All junks yards or salvage yards require special exception. Throg/ .... Strikes me that this proposed amendment would be quite consistent with our economic development policy .... more likely that recycling would be accomplished ..... Strikes me as a pretty wise amendment. Horow/ As long as all of the specifications are really adhered to .... I am assuming the Board of Adjustment reads the minutes of council when we discuss things like this ..... Miklo/ With each case staff will bring that material to them .... They would be charged with determining how to safely handle these materials. Kubby/ Can we find out-It sounds like this new company kind of has a place in mind... find out where they are looking at? Miklo/ Look at this independently. Arkins/ (Can't hear). Horow/ Bob, do we know...this letter we just received, has a site specific. Miklo/ I don't know that. We will investigate that and find out for you. Horow/ Kubby/ It would be good to contact them to I-To find out if they have a specific site in mind and 2~...deal with this as a separate issue ..... They understand what the situation is. ITEM NOo 6e. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article 5, entitled "Performance Standards," Section IOB, concerning the location of aboveground storage tanks. (First consideration) Miklo/ First consideration of the ordinance regarding above ground storage tanks. ITEM NOo 6g. consider an ordinance amending the Zoning Chapter to clarify the definition of time/temperature signs. (First consideration) Miklo/ First consideration of the time and temperature sign amendments. Kubby/ Will everyone be here tomorrow night, Sue? Horow/ Yes. Kubby/ There was some concern about this ..... Nov/ I don't think this is at all controversial. It just clarifies what the original ordinance meant. It was worded vaguely, it was interpreted vaguely. This way it will be interpreted specifically. Kubby/ Horow/ ...felt the ordinance as it has been written was taken advantage of ..... Pigott/ ..... I don't necessarily like the kind of time and temperature sort of specifics that we are granting .... Might be other ways people want to do that. Kubby/ And still provide the time and temperature for the public. Pigott/ I mentioned another city that used a clock .... instead of Thisrepresents only ereasonably accuratetranscription ofthelowa Citycouncil meeting ofDecember18,1995. WS121895 December 18, 1995 Council Work Session Page 7 the digital readout ..... Nov/ .... This just clarifies the current ordinance .... Pigott/ When we consider the change in the sign ordinance we can look at others way to- Kubby/ That is a different section of the ordinance ...... Nov/ This ordinance is just projecting signs ..... Miklo/ In terms of the projecting signs .... look at... to allow clocks to be put on those. On fascia signs you can put a clock on now as long as it is perpendicular to the building. Kubby/ If someone wanted to put a projecting sign that had a clock that was non-digital, you couldn't do it with this amendment? Will that issue be talked about when we revamp the ordinance? Miklo/ We will look at that. Pigott/ .... We have expressed interest that we would look at projecting signs all together. Nov/ That is another issue. This clarifies the intent of the original ordinance. Throg/ Two weeks ago .... design was much more important .... I don't feel strongly about it. ITEM NO o 6h. Consider an ordinance amending the Zoning Chapter by repealing Title 14, Chapter 6, Article J, Section 1, River Corridor Overlay Zone. (Second consideration) Miklo/ Second consideration of an ordinance repealing river corridor overlay zone. Nov/ Does anyone have any interest in collapsing some of these? Horow/ Fine with me. Nov/ Very simple clarification amendments...shorten the agenda. Pigott/ I agree .... Horow/ I will work that out with the City Clerk ..... Horow/ Marian, let's work on H. through K. Great. ITEM NO. 6i. Consider an ordinance amending Title 14, Chapter 5, Building and Housing, Article H, Site Plan Review, to include a reference to the Sensitive Areas Site Plan. (Second consideration) ITEM NO. 6j. (Second consideration) ITEM NO. 61. Consider an ordinance amending the Zoning Chapter to allow adult day care, elder family homes, and elder group homes under certain conditions in Iowa City, and to change the definition of elderly. (Second consideration) Miklo/ Second consideration of amendments dealing with adult day care, elderly family homes, elder public group homes and definition of elderly. ITEM NOo 6m. Consider an ordinance amending the Zoning Chapter to require bicycle parking for commercial and multi-family residential developments. (Second consideration) Miklo/ Second consideration of the amendments regarding bicycle parking. Nov/ .... The description of bicycle parking in front of banks in CB-5 zone, we have zero bicycle parking requirements ..... Miklo/ We attempted city's policy public basis. to be consistent in CB-5 and CB-10 with the of providing bicycle parking facilities on Nov/ Assume public r.o.w. will have bicycle parking. Miklo/ Right. Thlsrepresents only oreasonebly accuratetranscrlptlon of thelowa CltycouncllmaettngofDocember18o1995. WS121895 December 18, 1995 Council Work Session Page 9 Nov/ o.oIf a bank is required to provide some parking in the CB-5 zone, I was wondering why we don't require some bicycle parking as well ...... Throg/ Matter of consistency .... Miklo/ We require bicycle parking for all uses in the CB-5 zone .... The intent was more that being a d.t. area it is easier for the city to provide the bicycle parking ..... Kubby/ It will help to have a more consistent streetscape too... we will provide consistent design of racks as well ..... Nov/ Banks and grocery stores... people would go with a bicycle and would want to park closer ...... It says that expansion to the Iowa City growth boundaries. I thought our growth boundaries .... were based on water shed boundaries .... Are we suggesting that the water shed boundaries may have shifted because of the '93 floods? Miklo/ No... the growth boundaries are based on water shed and we do not have complete information on some of those water sheds. This would be updating to include all of the streams and rivers in those water sheds. Kubby/ The only reason we would change out growth boundaries is because the water shed boundaries had shifted? Miklo/ This wouldn't change the growth boundaries. It would be covering the flood plains- Kubby/ ..°?hat we would look at our flooding within... to the boundary of .... Thank you. WS121895 December 18, 1995 Council Work Session Page 11 Old CaDital Mall Redesign - Talbots Pro4ect Horow/ David- 95-142 S2 Schoon/ On your agenda tomorrow night you will have a resolution approving the design plan for Talbots at Old Capital Mall. Bill Holland is here from Talbots .... go over their plans for this store. The DR Com~mtttee did meet this evening and recommended approval with a couple of conditions ..... They were minor ..... Horow/ Welcome to Iowa City ..... Bill Holland/ (Presents design plans). This is one corner of the Old Capitol Mall... presently occupied by Gifted... 4,000 square feet .... Horow/ Dee Norton, do you want to come up and take a look at this. Holland/ Proposing... have some signage on the exterior of the mall, awnings... new display window on the Clinton Street side ..... exterior entrance ..... good exposure to bring some new customers into the mall .... make a more active streetscape and more attractive building. Throg/ Schoon/ Two conditions: 1-Fascia signs be a little smaller ..... Part of that condition was also to lower the Talbots sign to make it more apart of the store. The condition the sign be no higher than the actual height of the sign. Holland/ (Refers to design plan). Schoon/ The idea was to make it more a part of the store and not compete so much with the 01d Capital Mall sign. The other condition was there be future approval of the Osco sign and theater sign location. Mall is going to look at some other possible locations ..... They are recommending future approval of the location of those signs. Kubby/ Does Osco or the theaters get to have any say...? Schoon/ That is something... the Mall is working on. Kubby/ I would like to hear some feedback from them since their sign is coming down. Thlsrepresentsonlyareasonablyaccuretetranscrlptlonofthelowa CitycouncilmeetingofOecember18,1995. WS121895 December 18, 1995 Council Work Session Page 12 Nov/ Kubb¥/ Horow/ We are dealing with this tomorrow. Schoon/ I think the perspective is if Oscos does not agree, Talbots will be back with a revised design plan .... That is something the Mall is going to have to work out with one of their tenants ..... Kubby/ Schoon/ I will double check that for you. Speaking with the Mall they said they will need to work out those arrangements with those tenants. Kubby/ Pigott/ I am curious about the location of the door .... Why is it right next to the main entrance? ...... It looks great .... Kubby/ ..... why not have a ramp go into the store? ..... Pigott/ Holland/ ...we wanted to have an exterior entrance. There is a fairly substantial grade change ...... Just a slope ..... Seems to be an easy, reasonable unobtrusive way of getting handicapped access into the store ..... Nov/ Kubb¥/ Why not have the ramped sloped area be on the inside of the store and remove the need to have the stairs which will maintain the bus waiting area...? (refers to design plans) Council/ (All talking). Hol land/ Horow/ What you are saying is it is impossible to put a slope on the outside area that wouldn't be difficult for people to get up? You've got to have stairs one way or another? Holland/ Coming straight up from the sidewalk to our entrance there This represents only a reasonably accurate transcription of the Iowa City council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session is not enough space to slope up. Nov/ (Refers to design plan). Holland/ The entrance to the Mall is still floor. It continues to slope up .... Page 13 five inches below the Kubby/ It is possible to have that slope be on the inside... of the store to remove the necessity of stairs on the outside of the store? Holland/ ...no. The existing condition represented by the Mall doesn't really comply with the accessibility guidelines ..... Kubby/ Five inches difference (refers to design plan). Holland/ At the level where the Mall doors are it is five inches below the floor. Kubby/ Holland/ Throg/ I don't see any difficulty of this at all ..... People will continue to be able to stand outside ..... Kubby/ ...potential conflict in the future ..... Throg/ Kubby/ Horow/ There is also a door from the Mall .... I don't see the big deal. Council/ (All talking). Kubby/ So are the majority of people okay with the door and the step? Council/ (Yes). Kubby/ (Refers to design plan). Seems like that corner... newspaper vending machines... Whatever we can do to soften and help make it a more human ..... Laura .... Why the DR Committee felt okay about giving up that planting bed ...... Laura Hawks/ They are expanding the window there .... already is an existing planter .... pin oakes... Will be quite a bit of nice interaction... pedestrian .... awnings .... display. Kubby/ Council/ Hawks/ There are beautiful mature plants... they will stay. Horow/ Any other questions for Laura? Norton/ The outside door, that would allow for that store to be open for different hours... do you anticipate the same hours as the rest of the mall? Holland/ I believe it will be open the same hours .... Nov/ It is a general rule... follow their hours .... Horow/ In Bettendorf .... their after Christmas sale starts at 8:00 Schoon/ The Talbots sign will have a red T and white letters instead of a red T and black letters. Nov/ Normal awnings, right? WS121895 December 18, 1995 Council Work Session Page 15 Letter of December 11 from B. Burns and C. Eastham Horow/ Which staff person? 95-142 S2 Atkins/ We really didn't staff this issue. We passed the correspondence along... It appeared to be something that I thought was of some consequences ..... Kubby/ Partnership wants to buy some condominiums that are going to be built soon in another area and that they want to still use the federal moneys that were slated for the Saratoga Springs project for this project. Horow/ Mr. Burns .... have you heard back from the Iowa Finance Authority? Bob Burns/ Yes ..... We have asked for your approval to use CDBG and HOME funds for acquisition of existing or new construction condominiums. We are combining those funds with equity capital that we will raise through the low income housing tax credit. We applied to the Iowa Finance Authority for the low income housing tax credits .... when rezoning was denied... wrote a letter to the Finance Authority and asked them if we could change sites and preserve our application. They said that would be our right if we did that ..... bring in the private market .... try to find a site that either had existing condos or proposed new condos for sale. Horow/ Did you have to give the Iowa Finance Authority a location? Burns/ No, not yet .... We wanted to make you aware of the concept first so that you knew what we were doing ..... may have to act quickly. You may want to approve... Pigott/ Use some of the funds for Working Singles Program ..... Milkman/ No... different funds ..... two sets of funds. $300,000 in FY95 funds; $200,000 in FY96 funds. the $300,000 in FY95 funds, CDBG and HOME, we said had to be committed by November 1 and if not we were going to have to move ahead with other projects which we are doing. Are also $200,000 of F¥96 funds, HOME and CDBG that are available. Kubby/ Bob... $500,000 or $200,000? Burns/ $200,000 .... that is the scenario we are working with. We think we can combine the $200,000 in city allocated federal funds with about $360,000 in state allocated Thlsrepresentsonlyareasonablyaccuratetranscrlpfionofthelowa Cltycouncilrr~eetingofDecember18,1995. Kubby/ Do you have a location in mind? Burns/ Iowa city. Nov/ Potential for scattered site .... Kubby/ I have a hard time just saying yes without a location ..... I suppose we could say if they are scattered site, the southeast side is a possibility and if it is all in one neighborhood it cannot be in the southeast side ..... value of not concentrating on the southeast side. Throg/ Seems to me it would be inappropriate of us to say yes tonight ..... without knowing more ..... Maybe what you are looking for is some general indication... sense that this idea might be acceptable depending on the details. Kubby/ This should go back to HCDC. Norton/ Horow/ Throg/ I am wondering if Marianne or any of the other staff members have any firm opinions based on what they know up to now .... Milkman/ One of the guidelines that they would like right now is a price range which you will find acceptable, a per unit cost. But aside from that the issue of location ...... the question of financing of them and of the total subsidy. We don't have any or there are no guidelines as such as what is an acceptable subsidy per unit. Throg/ What cost of house is affordable to a family at 90% median family income? Milkman/ They can afford, from our experience, afford approximately $65,000 mortgage ..... Milkman/ ...average sale price of s.f. units which I think was $108,000 ..... Also looking at rental units, what condos were selling for... range from $58,000 through $80,000 approximately. Kubby/ I don't want to say a number tonight. To ask the commission to also look at that issue when they are making a decision. Horow/ I think this is something the commission must look at .... You haven't gotten some of the elements that we would be interested in. Kubby/ I think the idea would be great. Throg/ ..... implication would be scattered site housing would be much more appealing to this council .... reasonable approach. Kubby/ .... Talked about a sidewalk trail ..... Mormon Trek from Highway 6 to Melrose ..... Council/ Kubby/ Longfellow neighborhood .... Nov/ ...We said once the machinery is here we ought to look at other areas where we want to go through the embankment. Please find out if Mormon Trek or Longfellow Neighborhood can use that equipment at the same time. 5. Nov/ Can you explain the memo on construction supervision. Atkins/ Simplest terms is... we as a city staff would take over the construction management. We do that routinely now for small projects ..... example out on Rohret Road. What we would intend to do is take one of our inspectors, promote them... special project inspector. Even hire two additional inspectors ..... report directly to Rick and Chuck. They would hire... survey work... We normally would go out for proposal on this and we did ..... Chuck said maybe now is the time for us to try this ...I think we can do it .... Council/ Atkins/ Total we estimated was about $800,000 for the 30 months. Stanley's estimate was $2.1 million ..... This represents only a reasonably accurate transcription of the Iowa City council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 24 Pigott/ What are we not doing? Atkins/ We will do our best to continue the current capital projects ...... informed they would have 30 month employment .... They would have the opportunity to return to their old position. Woito/ Stanley would be doing... the land survey stuff. We don't have a certified land surveyor on our staff. Nov/ Arkins/ Concrete will be manufactured in Davenport. It is shipped over here by truck. They do spot inspections ..... Kubby/ Horow/ Existing staff person would be the inspector coordinator would have two temporary employees? Atkins/ He would have two additional field inspectors that we would hire ..... You have a fixed compliment of employees right now. We will staff up during this .... return... Nov/ Pigott/ What about training these new employees who would be here temporat i ly? Atkins/ Not that difficult .... securing them is not the easiest in the world .... Be able to find folks to do this .... We will save a lot of money. Norton/ .... only be one position in the city staff that would be temporarily filled? Atkins/ Randali's position would be vacated and we would fill that and he would hire whatever he needs in the field ..... Norton/ Basically one replacement .... Seems like such a huge project. Arkins/ ...it is primarily excavation work ..... we also want to bid a pump station .... May think about taking that one on also. This is a good one for us to start. Horow/ What happens to the employees we were thinking of in terms This represents only a reasonably accurate transcription of the Iowa City cnuncil meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 25 of enforcing the Sensitive Areas Ordinance? Atkins/ Separate .... budget time. Kubby/ Any ethical concerns about us watching ourselves? Atkins/ We are not watching ourselves .... We want what we pay for .... We want to be in the filed to make sure we get what we pay for. Horow/ The staff employee would get a higher salary .... Atkins/ Rick Fosse ..... supervise project for about a year and a half .... promoted to city engineer. Kubby/ 6. Throg/ I had a question about Weeber/Harlocke. There is a letter or memo that says the asking price is too high .... people in the neighborhood were willing to contribute some funds to buy land for parks. I am just wondering whether it is worth having exploratory conversation with those folks. council/ (All talking). Atkins/ Would you like me to talk to (can't hear). I will do it. Kubby/ .... Buss property... donation. Horow/ Throg/ 7. Throg/ I have a letter here for each of you. Marian, for the two missing council members, should I give you their two copies? I also have a letter for you Steve...you and the staff. You might want to get that back to Lorraine. 8. Pigott/ (Agenda #19-THE FIRST AVENUE IMPROVEMENTS PROJECT, MUSCATINE AVENUE TO D STREET and #4g.(3) Letter from Bob Smith regarding the First Avenue Project). Bob Smith wrote us a letter regarding First Avenue. Is that something we can respond to Bob? Arkins/ Kubby/ I know that Dee Vanderhoef... wants to re-look at that. I am Thlsrepresentsonlyareasonably accuratetranscriptionofthelowa CIW council meetingof December IB, 1995. WS121895 December 18, 1995 Council Work Session Page 26 wondering... how much does this resolution lock things in? Atkins/ Whenever you pass a resolution we take it pretty seriously. Kubby/ Arkins/ Kubby/ I just know that Dee had said she wants to have the new council discuss this again ..... Atkins/ Kubby/ If there are four people who want to reopen the Atkins/ Kubby/ The seven of us were very unanimous .... Nov/ Only one dissenting voice... Dee Vanderhoef ..... Norton/ I still think it may take some more thought .... Atkins/ If you choose to vote on it tomorrow night, you will vote on it and I will (can't hear). 9. Pigott/ (Agenda #4g(2) Letter from Mark Ginsberg requesting funding for the Iowa City Jazz Festival) .... made a request. Atkins/ I have $5,000 in the budget for them ..... Pigott/ May be an issue better taken up by the new- Nov/ discussion It is budgeted this year and I would like us to remember that when we have allocated $5,000 or any other number to a human services agency we have seen an absolutely complete detailed budget ........... Kubby/ ...we haven't discussed it so we are kind of in the same place as last year .... Nov/ The next council may or may not choose to allocate this money. Pigott/ For clarification sake ...... it would be a budget for the whole festival or how this $5,000 would be spent. This represents only a reasonably accurate transcription of the Iowa City council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 27 Nov/ Who is contributing what? Who is getting paid for what? The whole thing ...... Pigott/ Kubby/ Jazz Fest... other requests .... Atkins/ Some of the things in there involve some changes in policy .... Kubby/ Atkins/ I think we are going back into the serving of liquor on the outside ..... I think that is where Mark is going with that ..... Karr/ 10. Kubby/ (Agenda #4g(5) Letter from Ed Barker regarding water and wastewater rates). I guess I want to talk about Ed Barker's letter to us and that it seems that this council made a very specific two part policy decision. That we wanted to have a certain amount of moneys for down payment and a certain time frame and the only we can meet those two things... is with the proposed rate increase schedule as presented to us. Is that correct? Atkins/ Yes. Kubby/ If people wanted to change that we would have to change either ..... Atkins/ Yes .... Horow/ Is there someone who wishes to change the timing or the down payment amount? Kubby/ Horow/ We have given instructions to the staff .... Atkins/ Please keep in mind, the rates will only be as high as they have to be ..... Any cost savings will simply be reflected in the rates ..... Horow/ ..... rate reduction .... We want to make a better ~aClllty and we want to charge what it costs .... Other thing is the fiber optics... There were two new things in there for you. Woito/ The DNR has also demanded the honey wagon treatment .... Horow/ We haven't talked about reducing the rate ..... Kubby/ At each time we talk about rates we should talk about the decreasing costs ...plus providing for whatever the next step is ..... I would like to do... write Ed a letter to talk about that balance .... articulate that to Ed again. Horow/ Sure can ..... new ideas... I am getting the feedback.. just move, get going .... They want council to move on the issue and not continue to regurgitate it. Nov/ Rates reflect all of our operating cost increases... rates are not just construction. 11. Kubby/ (Agenda #17 REVISED SCHEDULE OF FEES AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS). I wanted to let people know that I want to separate out in the fee structure ... the pottery and users fee. I will abstain from that section so I want to delete that ..... Horow/ That is just that one line potters studio, card and clay. Two fees. Kubby/ 12. Nov/ (Agenda #17 REVISED SCHEDULE OF FEES AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS). There are two instances where the fees have not increased for many years. The racquetball court rental and the monthly locker rent ..... Why don't we up it ..... Trueblood/ The racquetball (can't hear) projected for F¥98 ..... Nov/ I think it should have been happening all along the way ..... I am asking why has this one stayed the same? This represents only e reasonably accurate transcription of the Iowa City council meeting of December 18. 1995. WS121895 December 18, 1995 Council Work Session Page 29 Trueblood/ It was our feeling that if the fees were increased on the racquetball courts, it would receive no usage. It is low usage right now. The University has very much nicer racquetball facilities that are open the public ..... Nov/ Same true of the monthly locker fees? Trueblood/ Monthly locker fees, I question them myself .... we may even be considering eliminating monthly locker fees because of the low number of users for that ..... You may see them eliminated. Nov/ ...six months makes sense .... Trueblood/ .... most of those are the six month rates .... Nov/ I am assuming your pool fees are going to start in June...? Trueblood/ There is no projected increase in the actual admission fees, just on the lessons ..... Nov/ Swim club fees doubled .... Trueblood/ ...only for when they have exclusive use of the entire pool ..... just in swim meets. Kubby/ .... last year ...fairly close .... I guess I want to prevent any kind of trend... Why isn't it at 45% .... Trueblood/ .... establish the goal of 40% next year and we have exceeded it. Kubby/ Trend is dipping below for a couple of years .... Atkins/ .... Terry's instruction clearly are 45% .... such a broad number of items .... Trueblood/ Two examples... the increases for swim lessons .... FY96 will exceed that .... based on a requested budget ..... We do it every year. Kubby/ Nov/ Ought to look at the end of FY96... expenses. Trueblood/ Each year... revenues have come in exceeding estimates .... Thisrepresents only areasonably accuratetranscription oftholowa Citycouncil meeting of DecemboriS, 1995. WS121895 December 18, 1995 Council Work Session Page 30 13. Kubby/ We got a memo from Karin Franklin about the Neuzil Tract. I just wanted ..... I want to go for it. Need to check in with the University Heights .... appraisal is fair. 14. Kubby/ Memo from Linda about the contested case with the DNR about the mercury in the waste water stream ..... University... Woito/ They have done them .... It is not going to basically change the levels in the waste water stream that we are adding to the river because of the impossible levels that the DNR has established. Atkins/ We are not sure that we can comply. That is the problem. Woito/ It is a technological problem ..... Atkins/ .°after all the work that we have gone through. Kubby/ ... we should see out levels drop .... Woito/ The testing and the samples...are in consistent. The protocol that the feds have established is at a much higher level than the state has established. It is just a .... nightmare. We have a hearing scheduled February 23 ..... Kubby/ What is it more in our power to do to reduce the amount of mercury that we are releasing into the environment .... Atkins/ Woito/ We would have to spend thousands of dollars to do the research to arrive at the right technology and sampling protocol to do it. Kubby/ Do we disagree with the feds or state levels? Woito/ Yes. Atkins/ Yes...we Just simply disagree with them. Kubby/ Do we meet federal levels? Woito/ Yes, you do. Kubby/ Other communities, do they meet state stringent levels? Woito/ I don't know. This represents only a reasonably accurate transcription of the Iowa C~ty council meeting of December 18, 1995. WS121895 December 18, 1995 Council Work Session Page 31 Kubby/ I guess I would want to know that. If they can do it, why can't we do it ..... Who else is putting mercury into our system? Horow/ This is an issue that could come up to LEGURC at the next meeting. Atkins/ Let me find out about other towns ...... 15. Horow/ (Agenda #4f.(6) SHARED ACCESS EASEMENT AGREEMENT AND A PERPETUAL PARKING EASEMENT AGREEMENT FOR 820 AND 824 E. BURLINGTON STREET). Linda .... has to do with the Hanson property... the two parcels. These two paragraphs sounded inconsistent. On the one hand we talk about the installation of a driveway common access ...... obligations for repairs .... etc .... Woito/ I agree that is inconsistent and I need to double check with Sara as to why that is in there. I have the same question. 16. Horow/ (Agenda #4f(4) Letter from Becky Feuerbacher of Coralville regarding a skateboarding facility). I had to agree with the reasoning of having skateboards as a sport and she would like a response to my letter ..... It has been suggested that she suggest to the Coralville city council that they come up with a facility for skateboarding. Kubby/ Work with the Iowa City Rec Commission .... Horow/ .... I appreciate the letter .... Nov/ We have heard this many times .... Kubby/ We have looked at it .... need some concrete .... Council/ (All talking). Horow/ Concern...P/R minutes...
