RESOLUTION NO. 05-41
RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME
LOCATED AT 2311 NEVADA AVENUE TO A PUBLIC HOUSING PROGRAM
TENANT AND SETTING A PUBLIC HEARING FOR FEBRUARY 15, 2005.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing
Authority; and
WHEREAS, on September 14, 1993, the City Council considered and passed Resolution No.
93-255 approving the Section 5(h) implementing agreement for the conversion of public
housing to private ownership, also known as the Tenant-to-Ownership Program; and
WHEREAS, the Iowa City Housing Authority owns a single family home located at 2311 Nevada
Avenue, Iowa City; and
WHEREAS, a public housing program tenant has offered to purchase the home at 2311
Nevada Avenue for the principal sum of $117,000, which is the appraised value of the property;
and
WHEREAS, this sale would provide the opportunity for a Iow-income family to obtain ownership
of their own home; and
WHEREAS, this sale is conditioned on the family securing adequate financing for the purchase
of the home.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, that:
1. The City Council does hereby declare its intent to convey a single family home located at
2311 Nevada Avenue, Iowa City, Iowa, also known as Lot Forty-four (44), Block Sixteen
(16), Fair Meadows Addition Fourth Unit, to a public housing program tenant for the sum
of $117,000.
2. A public hearing on said proposal should be and is hereby set for February 15, 2005, at
7:00 p.m. in Emma J. Harvat Hall of the Iowa City City Hall, 410 East Washington Street,
Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council
thereafter as posted by the City Clerk, and that the City Clerk be and is hereby directed to
cause notice of said public hearing to be published as provided by law.

DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND

GENERAL OBLIGATION BONDS (FOR AN ESSENTIAL
CORPORATE PURPOSE) OF IOWA CITY, IOWA, AND
PROVIDING FOR PUBLICATION OF NOTICE THEREOF
WHEREAS, it is deemed necessary and advisable that the City of Iowa City, Iowa,
should issue General Obligation Bonds to the amount of $5,335,000, as authorized by
Section 384.25, of the City Code of Iowa, for the purpose of providing funds to pay costs
of carrying out an essential corporate purpose project as hereinafter described; and
WHEREAS, before said bonds may be issued, it is necessary to comply with the
provisions of said Code, and to publish a notice of the proposal to issue such bonds and of
the time and place of the meeting at which the Council proposes to take action for the
issuance of the bonds and to receive oral and/or written objections from any resident or
property owner of said City to such action;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE

bonds will be used to provide funds to pay costs of the construction, reconstruction, and
repairing of improvements to public ways and streets; the construction, improvement, and
repair of bridges; the reconstruction, extension and improvement of the existing
Municipal Airport; the rehabilitation, improvement and equipping of existing city parks;
and equipping of the fire and police departments.
Section 2. That the Clerk is hereby directed to cause at least one publication to be
made of a notice of said meeting, in a legal newspaper, printed wholly in the English
language, published at least once weekly, and having general circulation in said City, said
publication to be not less than four clear days nor more than twenty days before the date
of said public meeting on the issuance of said bonds.
Section 3. The notice of the proposed action to issue said bonds shall be in

$700,000 OF GENERAL OBLIGATION BONDS (FOR A
GENERAL CORPORATE PURPOSE) AND PROVIDING
FOR PUBLICATION OF NOTICE THEREOF
WHEREAS, the City of Iowa City, Iowa, is in need of funds to carry out a general
corporate purpose project as hereinafter described; and, it is deemed necessary that it
should issue general obligation bonds to the amount of not to exceed $700,000 as
authorized by Section 384.26 of the City Code of Iowa, for the purpose of providing
funds to pay costs thereof; and
WHEREAS, said City has a population of more than 5,000, but not more than
75,000, and the amount of said proposed bond issue is not more than $700,000.00; and
WHEREAS, before said bonds may be issued, it is necessary to comply with the
provisions of Chapter 384 of the City Code of Iowa, and to publish a notice of the
proposal to issue such bonds and the right to petition for an election;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY

It is with pleasure that I present for your acceptance the Iowa City Municipal Airport Strategic
Plan for fiscal years 2006-2010. We have been working on this strategic plan since August
2004, and adopted it at our meeting on January 13, 2005. The City Attorney has indicated it is
not appropriate for the City Council to formally adopt the Airport Strategic Plan because the
Airport is under the Commission's jurisdiction. However, we feel it is important to present it to
you for your acceptance in our interest in having a closer working relationship with the City
Manager and City Council.
I would like to take a few minutes at your January 31 work session to receive any comments or
answer any questions regarding the strategic plan. It will be on your February 1 formal meeting
agenda for acceptance. It is our intention once the management structure of the airport is
worked out to have the airport manager use this document in the management of the airport for
the five-year period FY06-10.

Executive Summary
The Iowa City Municipal Airport exists to serve the general aviation needs of the greater Iowa City
community. This strategic plan is to guide the direction of the Iowa City Municipal Airport for the period
fiscal years 2006-2010. Through implementation of the 1996 Iowa City Municipal Airport Master Plan
and FAA Airport Layout Plan, facilities will be maintained and upgraded to comply with the latest safety
features and Federal Aviation Administration regulations.
To answer the question "What do we want the Iowa City Municipal ^irport to be in 20107", the Airport
Commission adopted the following Vision Statement:
Vision Statement
The Iowa City Municipal Airport, through the direction of the Airport Commission,
will provide a safe, cost-effective general aviation airport that creates and
enriches economic, educational, health care, cultural, and recreational
opportunities for the greater Iowa City area.
To answer the question of what needs to be done to reach the vision for 2010, the following Mission
Statement was adopted:

the City of Iowa City and meet the needs of stakeholders.
The Iowa City Municipal Airport Commission has developed six strategic planning goals to be
accomplished in the FY2006-2010 period.
Strategic Planning Goals
· Establish an effective management structure and improve communication with the
City Council and City Administration.
Develop and maintain adequate funding mechanisms for airport operations and
improvements; increase revenue generated by airport operations, sell property to
repay debt for infrastructure development of Aviation Commerce Park.
· Increase use of the airport for aviation and other community uses.
· Increase the usefulness of the airport for economic development.
· Upgrade taxiways and runways and other airport infrastructure.
Enhance appearance and "curb appeal" of the airport; develop a public viewing area
on the airport grounds.
In preparing this strategic plan, the Iowa City Municipal Airport reviewed the strategic plans of similar-
sized communities. The 1996 Iowa City Municipal Airport Master Plan, the FAA Airport Layout Plan, the
2003 Iowa City Municipal Airport Business Plan, and the adopted Comprehensive Plan for the City of
Iowa City were also used as resource documents. Implementation of this strategic plan for the Iowa
City Municipal Airport will establish a solid foundation for the delivery of general aviation services to the
community for the five-year strategic planning period and beyond.

Introduction
In 2004 the Iowa City Municipal Airport Commission determined that a
strategic plan was needed to guide the direction of the Iowa City
Municipal Airport for the period FY2006 through 2010. The basic
question to be answered by the strategic plan is: Where are we now
and where do we want to be in five years? The City of Iowa City's
Assistant Director of Planning and Community Development was
brought on board to facilitate the process of developing a five-year
strategic plan. At the initial planning session it was agreed by the
Commission that the following elements would be accepted as
"givens" and not open to scrutiny in the strategic planning process:
Givens
1. That Iowa City will have a general aviation airport.
2. That it will be at the existing location of the Iowa City Municipal Airport.
3. That it will be approximately the size of the existing site.
4. That the City will proceed with closing of the north-south runway and implementation of other
1996 Iowa City Municipal Airport Master Plan and FAA approved Airport Layout Plan elements.
Summary of Process
The Commission began with stakeholder input sessions involving representatives from key community
organizations and other special interest groups. These interest groups included City and County
government; the Chamber of Commerce and other business associations; pilots and hangar tenants;
businesses in the area; real estate developers and brokers; the Iowa City Area Development Group;
citizen groups; and the airport Fixed Base Operator. The results of the stakeholder input sessions are
summarized in an appendix to the strategic plan.
At an initial strategic planning session the City's Assistant Director of Planning and Community
Development reviewed the South Central District Plan of the Iowa City Comprehensive Plan. This
district plan shows the Iowa City Municipal Airport as a principle land use in the South Central Planning
District. The South Central District Plan shows property redevelopment adjacent to the airport which is
consistent with the 1996 Iowa City Municipal Airport Master Plan, particularly to the south of the airport
along the alignment of Mormon Trek Boulevard Extended.
The next step in the strategic planning process was to develop the Vision Statement and Mission
Statement for the Iowa City Municipal Airport. The vision statement addresses the question, "What do
we want the airport to be in 20107" The mission statement addresses the question, "What do we need
to reach the vision for 20107" Once the vision statement and mission statement were agreed upon, the
commission addressed the strengths and weaknesses to achieving the vision.
A five-year plan was developed consisting of goals for achieving the
vision for the Iowa City Municipal Airport as well as specific strategies
for accomplishing the goals. It is expected that the Airport Manager will
develop a work plan for meeting the goals of the Iowa City Municipal
Airport Strategic Plan during the five-year planning period. The airport
manager's work performance will be evaluated by the commission
based on accomplishing the goals of the strategic plan.

The Commission's goal was to develop a five-year strategic plan that is understandable to the public
and contains measurable strategies for achieving the goals of the plan. The Iowa City Municipal Airport
Strategic Plan will be re-evaluated at various points during the five-year planning period.
The Iowa City Community
The Iowa City Municipal Airport is located two miles southwest of
downtown Iowa City in Johnson County. Iowa City is the home of the
University of Iowa, with a student body of approximately 29,000. The Iowa
City-Cedar Rapids corridor is one of two principal economic growth areas ;.~..
within the state of Iowa. The Iowa City Municipal Airport is integrated into
the activities of the University of Iowa, including the University of Iowa
Hospitals and Clinics, the medical college, the other academic colleges,
and the athletics department. The Iowa City Municipal Airport is
strategically located in close proximity to Interstates 80 and 380, as well as
U.S. Highways 6 and 218, and Iowa Highway 1.
Operations and Facilities
The Iowa City Municipal Airport is one of the most active general aviation airports in Iowa. Seventy-four
aircraft are based at the Iowa City Municipal Airport. The Iowa City Municipal Airport conducts
approximately 18,900 flight operations annually. These operations generate outside dollars into the
local economy.
Existing Iowa City Municipal Airport facilities include three
runways, the terminal building, a maintenance facility, hangars,
and fueling facilities. The three runways are each 150 feet wide
and therefore able to accommodate larger aircraft than many
other general aviation airports. The existing runway lengths are
2,553 feet, 3,900 feet, and 4,355 feet. The airport terminal
includes a pilot's lounge, a weather briefing room, a lobby, a
classroom, and administrative office facilities. Fueling facilities
are provided for the Fixed Base Operator. The Fixed Base
~ Operator offers fuel sales, charter service, maintenance, flight
lessons, and other airport support services.
History
The Iowa City Municipal Airport had its first recorded flights in 1918. In 1920 the U.S. Postal Service
chose the site as a fuel stop between Chicago and Omaha.
Public ownership of the Iowa City Municipal Airport was
established in 1929, and 1937 saw the first asphalt-surfaced
runway. In 1940 Runway 12-30 was extended in an effort to
provide a base of defense for the Rock Island Arsenal. 1941
saw the first concrete paving of an Iowa City Municipal Airport
runway. In 1944 the Iowa City Airport Commission was formed.
Between 1930 and 1972 commercial passenger flights were
available at the Iowa City Municipal Airport.

1992 Airport Relocation Study
In 1992 a consultant was hired to consider the possible relocation of the Iowa City Municipal Airport.
Several alternative sites for the proposed relocation were evaluated along with the existing site. After
much deliberation it was determined by the Iowa City City Council that the Iowa City Municipal Airport
would remain at the existing site. The City Council directed that a master plan be completed to ensure
safe aviation operations into the future that are consistent with the requirements of the Federal Aviation
Administration.
1996 Master Plan
In 1996 an Iowa City Municipal Airport Master Plan was
completed. The master plan evaluated several alternatives
involving extending runways and/or constructing new runways
with different configurations. The most significant elements of
the approved master plan were to extend Runway 7-25 by 800
feet, realign Dane Road, close and demolish a portion of
Runway 18-36 to allow the extension of Mormon Trek
Boulevard between Iowa Highway 1 and Riverside Drive, and
remove the old United Airlines hangar. A program is in place
for completing the elements of the 1996 master plan as federal
funds become available. Ongoing work includes the extension
of Runway 7-25.

opportunities for the greater Iowa City area.
Mission Statement: Why does the Iowa City Municipal Airport exist?
The mission of the Iowa City Municipal Airport is to support the strategic goals of
the City of Iowa City and meet the needs of stakeholders.
Goals & Strategies
1. Establish effective management structure and improve communication with the City
Council and City administration.
Strategies:
· Airport Commission and City Council adopt the strategic plan.
· Determine preferred management arrangement and hire Airport Manager.
· Airport Commission member or Airport Manager will attend City Council meetings monthly to
give an update on Airport activities.
· The Airport Manager will meet periodically with the City Manager to discuss Airport issues.
· Provide an annual report to the City Council
The management of the Iowa City Municipal Airport and the day-to-day airport administrative functions
have been identified as needing improvement. This includes record keeping, communications,
documentation, financial control, and marketing. There is a need for a formal policy on lease rates and
charges, formalized airport rules and regulations, and a marketing plan. Communication between the
Airport Manager and the City Manager should be consistent and at a level that assures the City
Manager is well informed on issues and activities.
The Airport Commission has reporting responsibility to the City Council relative to the financial and
operational viability of the airport; the City Manager is not directly involved. This has made it difficult for
the City Manager in that he must answer to the City Council when there are issues at the airport, but he
has little authority to seek change. This lack of communication between the Airport Manager/Airport
Commission and City Manager/City Council has also impacted how the media deals with airport issues.
A more positive team approach is needed between the Airport Commission, which sets policy for the
Iowa City Municipal Airport, the Airport Manager, who conducts the daily decision making, and the City
Manager/City Council, who have ultimate financial control over the airport. Better communication is
needed so that the airport is integrated into other aspects of the City of Iowa City organization.
2. Develop and maintain adequate funding mechanisms for airport operations and
improvements: increase revenue generated by airport operations; sell property to
repay debt for infrastructure development of Aviation Commerce Park
Strategies:
· Identify funding sources and apply for federal, state, and pdvate funding each year.
· Annually evaluate and revise as needed sources of revenue such as fuel sales, hangar leases,
and airport fees.
· Sell or lease Aviation Commerce Park properties to generate income.
Historically, the City of Iowa City has used General Funds to make up the deficit between revenues and
expenses for operation of the Iowa City Municipal Airport. The airport must develop strategies for
moving closer to self-sufficiency. This will include strategies involving the fixed-base operator, fuel
sales, and hangar revenues. Non-aviation revenue sources should also be investigated. The airport
may never be totally financially self-sufficient, but there is potential for moving closer to self-sufficiency.

The Aviation Commerce Park is a 17-1ot commercial subdivision platted on the north end of the airport
property. Roadway, water, and sanitary sewer infrastructure was extended to this area by the City of
Iowa City. The arrangement between the City and the Airport Commission involves funds spent for the
extension of infrastructure to be repaid from the sale of the lots in Aviation Commerce Park. Once this
infrastructure debt is repaid, the subsequent sale of lots will accrue funds for the capital and operating
expenses of the Iowa City Municipal Airport.
3. Increase use of the airport for aviation and other community uses
Strategies:
· Develop and implement an airport marketing plan with measurable objectives.
· Include in the annual report a summary of airport use.
· Develop a plan for acquiring a precision instrument approach and implement if feasible.
Use of the Iowa City Municipal Airport has been relatively flat for the past several years. Forecasts
based on current management operations are for continued but slow growth in the next five years.
Proiections are based on trends pertaining to fuel usage, hangar rents, and increased aircraft traffic. If a
more aggressive marketing and management plan is put into place, use of the airport could increase
more significantly.
A significant restriction is the lack of a precision instrument landing system approach. A lack of a
precision approach limits the attractiveness of the airport for turbine and jet aimraft operators because
of the possibility of not being able to get in or out of the airport on a timely basis. It is projected that the
Iowa City Municipal Airport will be successful in achieving a precision instrument landing system
approach with the help of the FAA. This will significantly increase aircraft activity in Iowa City.
It is desirable to integrate the airport more into the non-aviation community. The location of the Iowa
City Municipal Airport is a beautiful setting for non-aviation functions such as car shows, flea markets,
and recreation. There is significant potential to increase the use of airport for non-aviation functions.
4. Increase the usefulness of the airport for economic development
Strategies:
· Complete runway extension to open the airport to larger corporate aircraft.
· Allow for privately funded hangar construction.
· Have the Airport Manager meet at least quarterly with Director of Iowa City Area Development
group and Executive Director of the Chamber of Commerce.
· Have the Airport Manager meet with at least two community business leaders monthly to
discuss the potential for the airport to benefit economic development.
· On an annual basis track number of flight types such as business flights, visitor flights, and
medical flights.
· Host events designed to draw attention to the airport as it relates to Iowa City area businesses.
Based on discussions with local community leaders, businesses, and the aviation community, the Iowa
City Municipal Airport is an important asset to the area. In 1994, the Iowa City Department of Planning
and Community Development conservatively placed the economic impact of the Iowa City Municipal
Airport at $1.7 million annually. Today this number likely exceeds $2.5 million annually. A 2000 Iowa
State University study stated that the total economic effect of the air transportation industry in Johnson
County was nearly $18 million annually. Industry studies have clearly shown the economic benefit to
the community of having a close-in regional airport.

Benefits include employment (wages and salaries), lodging, food, entertainment, and other support
services. Indirectly, the community benefits from access to aircraft charter, air ambulance services,
organ donor flights, flight instruction, small package freight, and general aviation support to the
University and private business.
5. Upgrade taxiways and runways and other airport infrastructure
Strategies:
· Have the Airport Manager provide an annual runway, taxiways and ramp condition report.
· Have the Airport Manager provide an annual airport infrastructure condition report.
· Acquire funding for annual improvements to ensure that all surface areas are in safe and
functional condition.
Iowa City Municipal Airport Master Plan and Airport Layout Plan improvements to taxiways and
runways will be conducted over the next several years. This will result in a transformation from a
three-runway airport to a two-runway airport. The length of the principal runway will be extended
from 4,355 feet to 5,155 feet. An ongoing program of maintenance and capital improvements
consistent with the Airport Master Plan must be budgeted for and conducted to ensure the
continued good condition of airport infrastructure.
6. Enhance appearance and "curb appeal" of the airport; develop a public viewing area
on the airport grounds
Strategies:
· Obtain FAA approval and implement viewing area and children's play area,
· Identify and apply for grants for use on buildings and facilities needing work.
· Increase landscaping in and around the terminal building and entry drive.
· Increase use of airport terminal meeting room by outside groups in accordance with established
policy.
The Iowa City Municipal Airport terminal building has been recently refurbished and is considered an
attractive, historically significant asset to a general aviation airport such as the Iowa City Municipal
Airport. It is desirable to maintain the adjacent buildings and grounds in similar condition. An open
space area with public access should be created to generate interest by the general public in the Iowa
City Municipal Airport. Such space should be developed consistent with FAA regulations. Enhanced
appearance of the Iowa City Municipal Airport will generate interest in use of the airport property for
non-aviation functions as well as aviation functions.

Conclusion
The Iowa City Municipal Airport Strategic Plan has presented the vision for the Iowa City Municipal
Airport and identified six goals to be accomplished over the next five years. The strategic plan will allow
the City of Iowa City to anticipate and respond to changes that will impact the delivery of general
aviation services to the Iowa City community. The strategic plan will be reviewed annually by the Iowa
City Municipal Airport Commission and the Airport Manager. The elements of the Iowa City Municipal
Airport Strategic Plan are a sound investment in the future for the citizens of Iowa City.
The Iowa City Municipal ,Airport Commission welcomes comments on this plan and its implementation.

RESOLUTION AMENDING THE COMPREHENSIVE PLAN TO REVISE THE
LAND USE MAP FOR THE SOUTHWEST DISTRICT PLAN
WHEREAS, in conjunction with a rezoning and annexation application for undeveloped property
north of Highway 1, west of Highway 218, and east of Kitty Lee Road, James Davis has requested
an amendment to the Comprehensive Plan, specifically, the Southwest District Land Use Plan;
and
WHEREAS, the proposed amendment would change the Southwest District Plan land use map to
show the undeveloped property north of Highway 1, west of Highway 218, and east of Kitty Lee
Road as Office and General Commercial, instead of Rural Residential; and
WHEREAS, the Rural Residential designation was predicated on municipal sanitary sewer service
not extending to this property; and
WHEREAS, the applicant has proposed a sewer lift station to allow for municipal sanitary sewer
service to be extended to the property; and
WHEREAS, the Highway 1/Highway 218 interchange area has been identified in the 1997
Comprehensive Plan as appropriate for commercial development in Iowa City; and
WHEREAS, given that a plan to bring municipal sanitary sewer service to the undeveloped
property west of Highway 218, north of Highway 1, and east of Kitty Lee Road has been
developed and the land around the Highway 1/Highway 218 interchange has been identified as
appropriate for commercial development, it is logical to amend the Southwest District Land Use
Plan to reflect Office and General Commercial on the subject property; and
WHEREAS, at their January 6 meeting, by a vote of 6-0, the Planning and Zoning Commission
recommended amending the Southwest District Land Use Plan to reflect Office Commercial
development adjacent to existing residential development, and General Commercial development
on the remainder of undeveloped property north of Highway 1, west of Highway 218, and east of
Kitty Lee Road.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The Southwest District Land Use Map is hereby amended to reflect Office Commercial

SPECIAL INFORMATION:

BACKGROUND INFORMATION:
The Saddlebrook development was annexed into the City in 1994. The annexation and zoning of
this property was subject to a Conditional Zoning Agreement (CZA). The major conditions of the
CZA specified that the applicant would provide for wetland protection and mitigation; construction
of a trail network; dedication or payment of fees for neighborhood open space and dedication of a
school site. The subject area was zoned RS-8, Medium Density Single-Family at that time. In 2004
a Preliminary Plat and a Planned Development Housing Overlay (OPDH) over the existing RS-8
zoning was approved to allow the development of single-family homes, duplexes and townhouses.
ANALYSIS:
The final plat complies with the approved OPDH plan and preliminary plat. As provided for in
the OPDH plan many of the lots are narrower and smaller in lot area than normally required by
the underlying RS-8 zoning. Lots 28-32 are for town house units. Lots 33-37, 39-43, 45-47, 22-
27 are for single-family homes. Lots 38, 44 and 21 are for duplexes. Lots 1-20 are for attached
zero lot line dwellings. A common private open space is located near the center of the
subdivision.
The Neighborhood Open Space Ordinance requires the dedication of 16,500 square feet of
public open space or payment of fees in lieu of open space for a development of this size. The
Parks and Recreation Commission has indicated that open space dedication for the
Saddlebrook development should occur in the far western portion of the RS-8 zone where it can
be added to the Sycamore Greenway. The legal papers should indicate that the open space
obligation for this subdivision is being transferred to the adjacent undeveloped property. The
legal papers should also provide for off-site easements for the 15' water main easement and 15'
storm sewer and drainage easement. Plats and legal descriptions will also need to be included
with the legal papers. The construction Drawings and legal papers should provide for the
installation Pinto Lane to the intersection with Paddock Circle.
STAFF RECOMMENDATION:
Provided that the deficiencies and discrepancies are resolved, staff recommends that the final plat
of Saddlebrook Meadows Part 1, an 8.95-acre 47-1ot residential subdivision located south of
Whispering Meadows Ddve, be approved subject to legal papers and construction drawings being
approved by staff prior to City Council consideration.
DEFICIENCIES AND DISCREPANCIES
1. The 15' utility easement along Pinto Lane needs to be labeled.
2. Outllot A should be labeled as Private Open Space.
3. The applicant should verify that the 90° angle ROW lines at both intersections of the alley and
Blazing Star intersection allow enough room for the curb returns. They may need to be
modified with curves in order for the return to fit within the ROW.

RESOLUTION NO. 05-66
RESOLUTION APPROVING AN AMENDMENT TO A PURCHASE AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND UNITED ACTION FOR YOUTH FOR
CONDOMINIUM UNIT 1-C IN TOWER PLACE AND PARKING, AND THE
DISPOSITION OF SAID PROPERTY IN ACCORDANCE THEREWITH.
WHEREAS, Tower Place and Parking includes commercial space which has been marketed for
sale to the general public; and
WHEREAS, in June of 2002, the City Council approved a purchase agreement pursuant to
which the City is selling Unit 1-C of the Tower Place & Parking condominium regime to United
Action for Youth (UAY) for a total price of $500,000; and
WHEREAS, pursuant to the purchase agreement, UAY paid $225,000 of the purchase price in
August of 2002 when they received a CDBG award in that amount. As amended in July, 2004,
said purchase agreement calls for UAY to pay the balance of the purchase price in installments
of $100,000 on or before December 1, 2004, and $175,000 on or before December 1, 2005;
and
WHEREAS, UAY has requested that the purchase agreement be amended to allow them to
pay the balance of the purchase price in installments of $25,000 by March 1, 2005; $125,000 at
the end of 2005, and; $125,000 at the end 2006 as set forth in the amendment attached hereto;
and
WHEREAS, following public hearing on the City Council's intent to approve the amendment to
said purchase agreement and to dispose of the property in accordance therewith, City Council
finds that the amendment to the purchase agreement should be approved and that said
property should be conveyed in accordance with said amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The City Council hereby approves in form and substance the attached Third Amendment
to the purchase agreement between the City of Iowa City and United Action for Youth for
Unit 1-C in Tower Place and Parking and the disposition of said property in accordance
with the purchase agreement as amended.
2. Upon direction of the City Attorney, the Mayor and the City Clerk are hereby authorized to
execute the attached amendment to the purchase agreement and take any further action
necessary to dispose of said property in accordance with said amendment.
3. The City Clerk is hereby authorized and directed to certify the necessary copies approving
said amendment of the purchase agreement and record said certified copies with the
Johnson County Recorder at UAY's expense.

RESOLUTION DELEGATING RESPONSIBILITY TO PARTICULAR PERSONS
HOLDING SPECIFIED POSITIONS TO IMPLEMENT THE REQUIREMENTS OF
CHAPTER 22, IOWA'S PUBLIC RECORDS STATUTE, AND RESCINDING
RESOLUTION NO. 04-160.
WHEREAS, Iowa Code § 22.1(2) provides that each governmental body shall delegate to
particular officials and employees the responsibility for implementing the requirements of
Chapter 22 and that the governmental body shall publicly announce the particular officials or
employees to whom responsibility to implement the requirements of Chapter 22 has been
delegated;
WHEREAS, Iowa Code § 22.1(2) defines public records" as "all records, documents, tape, or
other information stored or preserved in any medium, or belonging" to the City of Iowa City;
WHEREAS, Iowa Code § 22.3 allows the lawful custodian of the records to adopt and enforce
reasonable rules regarding the work and the protections of the records against damage or
disorganization;
WHEREAS, Iowa Code § 22.3 provides that all expenses shall be paid by the person desiring to
copy or examine the records, that the City may charge a reasonable fee for supervising the
examination of the records and the cost of the photocopying;
WHEREAS, Iowa Code § 22.3A allows the public certain access to data stored electronically;
WHEREAS, Resolution No. 04-160 establishes fees and policies for copying and examining
public records in the City Clerk's office;
WHEREAS, it is in the best interest of the public and City staff to have a single, uniform policy
applicable to all City offices and departments; and
WHEREAS, the City Council finds that the Public Records Policy of the City of Iowa City, which
is attached Exhibit 1, and incorporated herein, is reasonable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
Exhibit 1 is adopted as the policy of the City of Iowa City for the examination and copying of public
records.

PUBLIC RECORDS POLICY OF THE CITY OF IOWA CITY
1. Statement of Policy. The purpose of this policy is to facilitate broad access to public
records. The City is committed to the policies set forth in Iowa Code Chapter 22 (2003),
as amended. City staff shall cooperate with members of the public in implementing the
provisions of that chapter.
2. Custodian. For purposes of this policy, "Custodian" means the person lawfully
delegated by the City to act for the City in implementing Iowa Code Chapter 22. As
designated in Resolution No. 0.5-(07, the Custodians are:

3. Location of Record. A request for access to a record should be directed to the
Department Head, Director, or Coordinator of the particular City office where the record
is kept. Records of a City board or commission are maintained in the office of the
Department that staffs the board or commission and the person designated in paragraph
2 as the Custodian of the Records of that Department shall be the Custodian of the
board or commission's records. If the location of the record is not known by the
requestor, the request shall be directed to the City Clerk.
4. Office Hours. Requests for access to public records may be made in writing, in person,
by e-mail, by fax, or by telephone. The request should identify the particular records by
name or description to facilitate the location of the record. To facilitate a reply, mail or
telephone requests should include the name, address, and telephone number of the
person requesting the information. A person shall not be required to explain why the
record is being requested.
5. Response. Access to a public record shall be provided promptly upon request unless
the size or nature of the request makes prompt access infeasible. Absent unusual
circumstances, access shall be provided within five (5) working days from the date the
request is received by the Custodian. If the size or nature of the request for access to a
record requires time for compliance, the Custodian shall comply with the request as
soon as feasible. Access to a record may be delayed for one of the purposes authorized
by Iowa Code section 22.8(4) or 22.10(4) (2003), as amended. The Custodian shall
promptly give notice to the requestor of the reason for any delay in access to a public
record and an estimate of the length of that delay and, upon request, shall promptly
provide that notice to the requestor in writing.
6. Denial. The Custodian may deny access to the record only on the grounds that such a
denial is warranted under by Iowa Code section 22.8(4) or 22.10(4) (2003), as amended,
or that it is a confidential record, or that its disclosure is prohibited by a court order, or
other applicable law.
7. Security of record. No person may, without permission from the Custodian, search or
remove any record from the City's files. Examination of City records shall be supervised
by the Custodian or a designee of the Custodian. Copying of City records shall be done
by the Custodian or designee. Records shall be protected from damage and
disorganization.
8. Fees.
Reproduction
The charge for copies of records and documents shall be as follows:
a. Photocopy $ .15 per page
b. Microfilm copy $ .50 per page
c. Large Document copy (e.g. plat) $1.50 per page
d. Audio tape/diskette/CD of meeting $3.50 per each

When the mailing of copies is requested, the actual cost of such mailing may be charged
to the requestor.
Fax
When facsimile transmission is requested, the charge shall be $2.50 per page.
Search and Retrieval.
No charge will be made for the first fifteen (15) minutes for the services of staff in
research and retrieval of records. Retrievals of more than fifteen (15) minutes will be
assessed in quarter-hour intervals at the rate of $5.00 per quarter hour.
Supervisory Fee. An hourly fee will be charged for actual City expenses in supervising
the examination and copying of requested records when the supervision time required is
in excess of fifteen (15) minutes. Supervision of more than fifteen (15) minutes will be
assessed in quarter-hour intervals at the rate of $5.00 per quarter-hour.
Advance Deposits. When the estimated total fee chargeable under this policy exceeds
$25, the Custodian may require the requestor to make an advance payment to cover all
or a part of the estimated fee. When a requestor has previously failed to pay a fee
chargeable under this policy, the Custodian may require advance payment of the full
amount of any estimated fee before the Custodian processes a new request from that
requestor. Each department is responsible for collecting any applicable fee and
providing an appropriate receipt.
Overtime. If the services requested cannot be completed during regular office hours,
a person may request that work be completed after hours. The charge will be the actual
overtime paid to the person providing the assistance. The decision to authorize overtime
shall be made by the Department Director or Supervisor, and there is no guarantee that
the records will be provided in the time requested.
Certified Copies. Certified copies of public documents in the City Clerk's office may be
made only at the time the photocopy is made by the City Clerk.
Electronic Data. The City is not required under Chapter 22 to provide the public with
access to City software, but must allow access to records that are combined with its data
processing software. If it is necessary to separate the record from the software to
provide access, the City shall bear the cost of the separation. After the record has been
separated, any additional fees (e.g., photocopying) shall be as provided in Paragraph 7
below. If the person requests that the record be specially processed, the fee for doing
so shall be assessed in quarter-hour intervals at the rate of $11.00 per quarter-hour.
9. Confidential Records.
a. Basis. The Custodian may treat a record as a confidential record and withhold it
from examination only to the extent that the Custodian is authorized by Iowa
Code section 22.7 (2003), as amended, another applicable provision of law, or
court order to refuse to disclose that record to members of the public.
b. Access to Confidential Records. Under Iowa Code section 22.7 (2003), as
amended, or other applicable provision of law, the Custodian may disclose
certain confidential records to one or more members of the public. In requesting
the Custodian to permit the examination and copying of such a confidential
record, the following procedures apply and are in addition to those specified for
request for access to records provided above.
(1) Proof of identity. The Custodian may require the person requesting the
confidential record to provide proof of identity or authority to secure
access to the record.
(2) Requests. The Custodian may require a request to examine and copy a
confidential record to be in writing. A person requesting access to such a
record may be required to sign a certified statement or affidavit
enumerating the specific reasons justifying access to the confidential
record and to provide any proof deemed necessary by the Custodian to
establish relevant facts.
c. Request denied. When the Custodian denies a request for access to a
confidential record, the Custodian shall promptly notify the requestor. If the
requestor indicates to the Custodian that a written notification of the denial is
desired, the Custodian shall promptly provide such a notification that is signed by
the Custodian and that includes:
(1) The name and title or position of the Custodian responsible for the denial;
and
(2) A citation to the provision of the law vesting authority in the Custodian to
deny disclosure of the record and a brief statement of the reason for the
denial to the requestor.
d. Request granted. When the Custodian grants a request for access to a
confidential record to a particular person, the Custodian shall state any lawful
restrictions imposed by the Custodian on that person's examination and copying
of the record.
e. Request that record be treated as confidential record. A request that a record be
treated as a confidential record and withheld from public inspection shall be in
writing if the Custodian so requests. The request shall set forth the legal and
factual basis justifying the request and the name, address, and telephone
number of a person authorized to respond to any inquiry or action of the
Custodian concerning the request. Failure to make such a request does not
preclude the Custodian from treating it as a confidential record. If the request is
denied, the Custodian shall notify the requestor of the determination and the
reasons therefore. On application by the requestor, the Custodian may engage
in a good faith, reasonable delay in allowing examination of the record so that the
requestor may seek injunctive relief under Iowa Code section 22.8 (2003), as
amended, or other applicable law. The Custodian shall notify requestor in writing
of the time period allowed to seek injunctive relief.
f. Third Party. A person who is the subject of a confidential record may request
that the record be disclosed to a third party. Said request must be in writing and
must identity the particular record or records that may be disclosed, and the
particular person or class of persons to whom the record may be disclosed.
Such request does not require the disclosure of the record by the Custodian.
Appearance of counsel on behalf of a person who is the subject of a confidential
record is deemed to constitute consent for the City to disclose records about that
person to the person's attorney.
10. Redaction of a Record. The Custodian may redact from a record any information that is
confidential under state or federal law, such as a Social Security Number.
11. Creation of a Record. If the Custodian determines that it may be more feasible,
economical, or otherwise reasonable that a response to a request may be better met by
the creation of a record, such as a report or a document that does not presently exist,
and that would be produced as a result of research or analysis, the Custodian may, but
will not be required, to notify the requestor of that determination. The Custodian may
advise the requestor of the actual cost of creating and providing such document that
does not currently exist. The Custodian and the requester may in such instance, but will
not be required to, agree to approve such document in exchange for the actual cost in
lieu of providing access to the records originally requested. In absence of such
agreement, records will be made available as provided in this policy.

Authority signed by the bidder or the bidder's authorized agent. A properly completed Contractor's Bid
Bond (Form No. 650001), or a properly completed Contractor's Annual Bid Bond (Form No. 650043),
both available from the Iowa Department of Transportation, Office of Contracts, may be used in lieu of
that specified above.
The contracting authority will issue an exemption certificate for the purchase or use of building
materials, supplies, and equipment that will be used in the performance of the construction contract, as
provided by Iowa Code Sections 422.42(16), 422.42(17) and 422.47(5).
Failure to execute a contract and file an acceptable Performance Bond and Certificate of Insurance
within 30 days of the date of the approval for awarding the contract, as herein provided, will be just and
sufficient cause for the denial of the award and the forfeiture of the proposal guarantee.
The Iowa Department of Transportation (or other approved contracting authority) hereby notifies all
bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement,

RESOLUTION AUTHORIZING EXECUTION OF A CHAPTER 28E AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY, IOWA
REGARDING CERTAIN ROAD MAINTENANCE PURPOSES.
WHEREAS, both the City of Iowa City ("the City") and Johnson County ("the County") are public
agencies as defined by Section 28E.2 of the Code of Iowa (2003); and
WHEREAS, portions of several roads adjacent to or near the corporate limits of the City need
continuous maintenance and repair; and
WHEREAS, the City has annexed certain territory and in the future likely will annex additional
territory which will access onto these roads; and
WHEREAS, the County and the City agree that maintenance of the above-mentioned roads is
beneficial and necessary to the public's use thereof as well as to the enjoyment of the abutting
property owners; and
WHEREAS, the County and the City desire to set forth their respective duties and costs
associated with maintenance of said roads in an efficient and equitable manner, as specifically
contemplated in Chapter 28E of the Code of Iowa (2003).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The Mayor and City Clerk are hereby authorized to execute the Chapter 28E agreement
with Johnson County, attached hereto and incorporated by reference herein, and said
agreement is hereby approved as to form and content, and is found to be in the best
interests of the citizens of Iowa City, Iowa.
2. The City Clerk is hereby authorized to forward the executed Resolution and Agreement to
the Johnson County Board of Supervisors for execution and recording in the Offices of the
Johnson County Recorder and for filing with the Iowa Secretary of State, with recording
and filing costs to be shared by both parties.

IT IS NOW AGREED that the City and the County enter into an agreement pursuant to
Chapter 28E of the Code of Iowa (2003) providing for cooperative action for the maintenance
and repair of the aforementioned roads and to that end, specifically the City and the County agree
as follows:
1. PURPOSE AND SCOPE: The purpose of this Agreement is to define and assign specific
responsibilities and outline reimbursable costs for maintenance and repair of certain roads as
specified herein as is beneficial and necessary to the public's use thereof and for the enjoyment of
the abutting property owners.
2. CONSIDERATION: The mutual consideration herein is undertaking the maintenance
and repair of the subject roads. No separate legal entity is created by this Agreement. The
Johnson County Board of Supervisors shall administer the County's duties and responsibilities
herein and the City Council of Iowa City shall administer the City's duties and responsibilities
herein.
3. AFFECTED ROADS AND DIVISION OF MAINTENANCE RESPONSIBILITY: The
road segments that are subject to this Agreement are listed on Exhibit A, attached hereto and
incorporated herein by this reference. The City's and/or the County's specific maintenance
and/or repair responsibilities for each of these road segments is as set out on Exhibit A.
4. CHANGES TO ROADS AFFECTED OR MAINTENANCE RESPONSIBILITY: The
parties acknowledge that they may from time to time desire to add roads to or remove roads from
this Agreement or they may wish to change maintenance and/or repair responsibilities, both
without the necessity of adopting a new agreement. Accordingly, the roads affected or the
parties' maintenance and/or repair responsibilities may be altered by mutual agreement of the
parties upon their both passing a Resolution adopting a new, identical Exhibit A. Said Resolution
should specifically reference the Exhibit A to this Agreement, and the book and page number of
the Agreement as recorded in the records of the Johnson County Recorder.
5. NORMAL MAINTENANCE: For those road segments for which the City or the County
are respectively responsible under Exhibit A, the County and the City agree to perform all normal
maintenance reasonably necessary for the safe use and enjoyment of said roads. '~blormal
maintenance" includes, but is not limited to, where appropriate, gravel surfacing, oil/chip seal
surfacing, blading, snow removal, brush and weed control, traffic control signage and pavement
marking (which must be done according to the Manual on Uniform Traffic Control Devices),
ditch cleaning pothole patching, and shoulder maintenance.
6. REIMBURSABLE COSTS OF NORMAL MAINTENANCE: The City and the County
agree that all such normal maintenance or major maintenance activities for said roads shall be
deemed "reimbursable claims" if the costs thereof exceed $7,000.00 per mile and/or $2,000.00
per bridge crossing or culvert crossing. Said reimbursable claims shall be treated as follows:
a) Prior to undertaking the work, the party responsible for the work as outlined in Exhibit
A shall first seek and obtain approval from the other party. The City and the County
specifically agree that such approval shall not be unreasonably withheld. In the event of
an emergency, pre-approval shall not be required prior to performing the work.
b) Upon obtaining approval and upon completion of the work, the responsible entity, as
set out in Exhibit A shall submit a written claim to the other party, requesting
reimbursement for 50% of those amounts exceeding $7,000.00 per mile and/or $2,000.00
per bridge crossing or culvert crossing, itemizing the work performed and date
completed.
c) The party receiving the claim shall pay or dispute said claim in a timely manner.
d) This agreement neither pertains to nor governs new construction work..
7. LIABILITY AND THIRD-PARTY RIGHTS: Nothing herein is intended to alter the
City's and/or the County's ultimate responsibility for their own right-of-way, including liability
for or immunity from third party claims. Nor is this 28E Agreement intended to create any third-
party benefits. Rather, this Agreement is intended as an efficient way to maintain the quality of
life for both rural and urban living, and thereby protect the public interest during transition from
rural to urban development as land is annexed into the City.
8. PERMITS: The political subdivision within which the road right-of-way is located shall
be responsible for issuing drive and utility permits. Both entities acknowledge that jurisdiction of
the road right-of-way may be divided at its centerline, with each entity responsible for drive and
utility permits on one side of the road right-of-way.
9. SPEED LIMITS: Speed limits shall be established by mutual agreement between the
City and the County and adopted jointly by ordinance or resolution. In the absence of such
ordinance or resolution, the speed restrictions of Iowa Code §321.285, as amended, shall apply.
10. MUNICIPAL UTILITIES: On the road segments listed on Exhibit A, upon review and
approval of the County Engineer, the County hereby grants to the City the use of County right-of-
way for the installation and maintenance of City-owned utilities, which approval shall not be
unreasonably withheld. The County is neither responsible nor liable for the installation or
maintenance of City-owned utilities located within the County rights-of-way.
11. NOTICES: Any notice by County to City is effective by ordinary mail addressed to:

12. EFFECTIVE DATE: This Agreement shall be effective when approved and signed by
both the Johnson County Board of Supervisors and the City Council of Iowa City, and filed with
the Iowa Secretary of State and the Johnson County Recorder as provided in Section 28E.8 of the
Code of Iowa (2003).
13. DURATION AND TERMINATION: Once effective, this Agreement shall be in effect
for five (5) years after the date it is executed. At the end of the five (5) year effective period, the
Agreement shall be automatically renewed for an additional five (5) year period unless the
County or the City objects in writing to such renewal prior to the renewal date. Either party may
terminate this agreement upon thirty (30) calendar days written notice of termination to the other
party at the address listed in paragraph 11 above.
14. REVIEW OF THE AGREEMENT: At any time during the term of the Agreement either
the County or the City may initiate review of this Agreement by contacting the other party, at
which time both parties shall consider modifications of the Agreement, as appropriate.
Annexation or de-annexation of land by the City, which includes any portion of the roads listed
herein, shall require either renegotiation of this Agreement or alteration of Exhibit A as provided
for above.
15. INTERPRETATION AND ENFORCEMENT: Interpretation and enforcement of the
Agreement shall be in accordance with Chapter 28E of the Code of Iowa (2003) and statutes
respecting the rights and responsibilities of the political subdivisions.
16. DISPUTE RESOLUTION: Matters in dispute or subject to interpretation shall be first
submitted to the parties for resolution prior to either party pursuing administrative or judicial
remedies. In the event such matters must be submitted to the parties, they shall be submitted
specifically to Public Works Director of the City of Iowa City, as representative for the City, and
to the Johnson County Engineer, as representative for the County, who will both make a good
faith effort to resolve the dispute.
17. SUPERSEDING EFFECT: This agreement replaces and supersedes any existing 28E
agreements between the City of Iowa City and Johnson County relating to road maintenance
responsibilities for those road right-of-ways listed on Exhibit A.

RESOLUTION NO.
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST A LISTING AGREEMENT WITH HARRY R.
WOLF OF NAI IOWA REALTY COMMERCIAL TO LIST FOR
LEASING PURPOSES COMMERCIAL SPACE WITHIN THE COURT
STREET TRANSPORTATION CENTER
WHEREAS, the Court Street Transportation Center will have two units of commercial
space available with the facility upon completion of the project; and
WHEREAS, such commercial space will be made available for commercial leasing; and
WHEREAS, City staff, following interviews with real estate brokers, recommends Harry
R. Wolf of NAI Iowa Realty Commercial be selected to assist the City of Iowa City in the
leasing of said commercial space; and
WHEREAS, the parties have negotiated a listing agreement setting out the terms and
conditions of the listing agreement; and
WHEREAS, it would be in the public interest of the City of Iowa City to enter into said
listing agreement to assist in the leasing of such commercial space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF IOWA CITY, IOWA THAT:
1. The listing agreement by and between the City of Iowa City, Iowa and Harry R.
Wolf of NAI Iowa Realty Commercial, copy of which is on file with the City
Clerk, is in the public interest, and is hereby approved as to form and content; and
2. The Mayor and City Clerk are hereby authorized and directed to respectively sign
and attest said listing agreement in duplicate for and on behalf of the City of Iowa
City.
