a. Consider a motion setting a public hearing for September 9 on an ordinance
changing the zoning designation of an approximate 4,000 square foot property
located at 114 Wright Street from Community Commercial (CC-2) to Planned High
Density Multiple-Family Residential (PRM).
b. Public hearing on an ordinance changing the zoning designation of approximately
9.27 acres from Low Density Single-Family Residential (RS-5) to Sensitive Areas
Overlay/Medium Density Residential (OSA-8) to allow a 72-unit residential
development on property located on the south side of Taft Speedway west of
Dubuque Street. (REZ98-0009)
c. Consider an ordinance amending City Code Title 14, Chapter 6, entitled
"Zoning," Article V, entitled "Minor Modification Procedures," to allow the height
of free-standing signs to be increased under certain circumstances. (Second
consideration)
d. Consider an ordinance amending Title 14, Chapter 6, Zoning, Article K,
Environmental Regulations, Section 1, Sensitive Areas Ordinance, to add a
retention requirement for woodlands in Factory-Built Housing Residential (RFBH)

e. Consider an ordinance changing the zoning designation of approximately 22.20
acres from Public (P) to Public/Intensive Commercial (P/CI-1) for property located

Kubby/Statement... acknowledging grant... housing rehabilitation.
2. Kubby/(Agenda Item #24- In response to Kubby, City Attorney Dilkes and City
Clerk Karr clarified outdoor service areas, sidewalk cafes and ped mall vendors.
3. Norton/(Agenda Item #20- ... the grant for relocating the CRANDIC-Iowa Interstate
Railroad interchange?
Davidson/... there were not funds for improving arterial street railroad crossings.
The benefit of the project was in decreasing traffic congestion on arterial
streets...many people in the community wanted this project.
4. Norton/...project to replace the railroad crossing of Highway 6.
Davidson/...my understanding that the state grant required the closing of the highway
for a week in both directions...

Winklehake/Building searches...for locating lost or missing people. And also...
narcotics dog .... Types of activities that dogs can be trained for .... patrol and
narcotics .... Searches as well as finding lost people .... Animal... make sure that it
stays on a lease.
As far as the training, there are several different locations all across the United
States .... Recommended... cost .... Housing and food for the trainer... Five week
bonding period with the handler and the dog and these are costs that we got...
suppliers and people that have worked closely with Cedar Rapids Police
Department and Marion Police Department as far as outfitting a squad car ....
Taking one that we have in the fleet .... Kennel... drop window... cannel built at
the handlers location... use the animal... take a look at the number of alarms that
we have... best estimate that I can give you.
Vanderhoef/R. J., approximately how much do we pay when we call for a handler and a
dog to come in for a situation for us?
Winklehake/It depends on where we get them from. We have 28E agreements with
Johnson County...Marion...Linn County .... Most of the law enforcement
agencies will supply us with an animal ....
Vanderhoef/So in our 28E agreement, what do we give them for this service?
Winklehake/We sign a 28E agreement and say if you need us sometime, we will come
and help you.
Vanderhoef/So it is a reciprocal service agreement with no dollars.
Norton/But you pay overtime?
Winklehake/ .... The people we send, we will pay our overtime...
Vanderhoef/Do you envision us doing that same thing if we get a dog?
Winklehake/As a general policy, law enforcement agencies in this particular area, if they
are asked for their assistance, they will provide it for the other agency.

Champion/Having your own dog, you would use it more frequently .... I think it is a
tremendous asset ....
Thornberry/ .... on a search, this dog would be on a lease. If they did a building search,
would that also be true?
Winklehake/... it would not be... We are researching a lot of general orders that have to
do with dogs in building searches. The recommended way would be to announce
at three times over a five minute period before you ever released that animal.
O'Donnell/How many people are we going to have... to handle the dog?
Winklehake/You train one dog with one handler ..... end up with vacation... when that
dog is not going to be available to you.
Vanderhoef/Your choice would be to have a dog that is dual trained, both for narcotics
and for search?
Winklehake/For patrol... including apprehension ....
Lehman/Patrol... asset of a dog could be the presence of that animal walking around
downtown... Could that be a PR tool for the Police Department?
Winklehake/Of course it would be.
Lehman/I would hope that it would be... a visible sort of thing ....
Winklehake/Past experience that I had .... Public Safety Day .... Always the biggest
request was for the canine ....Kids see the dog ....People are very interested in
seeing that animal.
Norton/The dog stays at the officers house?
Winklehake/Generally yes .... You will have an agreement with the handler... work 7-7
½ hour day .... Give you X amount of overtime in the course of a month...
training... At this point we have not identified a handler ....Once we do that, then
we would discuss that with them... reasonable solution .... Fits into our labor
contract.
Norton/ .... The implication that dog can be used... tricky... I would be interested in what
the history of litigation in units that are using dog .... Limit the number of search
situations in which the dog could be used ....Oakdale... When the dog is on a
chase, you have got to be able to stop it ....

Thornberry/...in his memo he said it would be on a lease... if they are outside ....If they
are outside, they would be on a lease.
Winklehake/You would have to have them on a lease.
Norton/...my point is that there are a lot of complications... Have you visited a training
center to see how this works? ....
Winklehake/I saw the training center in Chicago.
Kubby/For me .... hesitation .... specific idea .... Because of a specific incident .... As we
approach and finish the accreditation process .... Providing better police
service .... List out all of those concerns .... A canine unit might be one of those
many things. I guess I don't want to leap on the canine issue until I kind of see
what are all of the needs of the police department .... Prevention of crime in our
community .... More receptive to the canine unit... after reading the
information... I want to wait until the accreditation process is a little further
along .... Prioritize .... I would like to approach it in that way .....
Winklehake/The accreditation process will not identify whether or not you should have a
canine ..... It will say if you do, then here is the criteria you have to follow.
Kubby/Accreditation process ..... take care of the concems that we have ..... I feel like we
are just grabbing onto this one issue .....Prioritizing ....And building them into
the budget.
Vanderhoef/...I had the same hesitation .... I have moved along in this process .... Talked
to a few people that have had some experience with them .... I am convinced at
this point that this is a positive thing for our police department.
Kubby/That may be... But until I see what the list of possibilities are, I don't know ....
Thornberry/I think we should start along this process as soon as possible ..... There have
been many times when there have been building searches that this could have
been utilized.
Norton/How many times have you sought help from another agency and not have been
able to get it? ..... I want to know what the litigation history is .... Heavy duty use
of force .... It is a difficult thing... highly trained .... I am looking at waiting to see
what our budget looks like... I would like to have some testimony from people
who have been using them ....

Norton/I have made a few phone calls ....
O'Donnell/I talked to the highway patrol and they are convinced .... This is an extension
for the police force ....
Norton/It is a dog and a hammer ....

Lehman/I have personally felt... I think this is something we should have done a long
long time ago ..... Is... cooperation with Coralville?
Winklehake/I spoke with Chief Bedford in Coralville a couple of times... In the past...
number of issues ..... Community event ...... Most of the time you are not going to
find two communities sharing the resource such as this simply because one
community is going to be responsible for the care and the feeding and the
grooming of that animal.
Lehman/Do you envision Coralville being willing to participate?
Winklehake/We already have a 28E agreement .....
Kubby/...North Liberty does not have a police department... They use the sheriffs
department ....
Lehman/How long would it take if we decided to move forward with this? ....
Winklehake/It would take us- We need to put out a notification to find out who would be
interested in being a handler .... Process of going through our intemal interviews
and then we would want to visit the location... and make sure they understand
what kind of animal we want .... One that will be trained to be able to be recalled
and try to get as much as a guarantee was you can in that kind of situation .... The
whole thing .... Eight weeks.
Kubby/I would even suggest that we put this in as part of the budget.
Winklehake/...the training is a good five weeks .... Depends... animal that has the kind
of temperament .... It is a possible that it could be a while ....
Lehman/... Could we... expect to have an animal by the first of the year? ....

Winklehake/Providing we can get an animal and training scheduled for that ....
Kubby/I prefer to wait until next FY and have it as part of the budget.
Norton/I would, too.
O'Donnell/I would rather move on it.
Kubby/I didn't get to finish my sentence.
O'Donnell/Let us see if they aren't four people interested.
Lehman/Well, finish your sentence.
Kubby/I did get to finish it before.
Lehman/How many people would like to proceed? There is a majority who would like to
proceed .... I have had conversations with three different groups within the
community who are very interested in this. I would like permission from council
to solicit funds from the public to fund the dog ..... community support .... I know
there is some support out there .... write notes to service clubs and some
organizations, soliciting their support for this project.
Norton/There are so many things we could have asked for support .... Last year ....
Lehman/...I have been approached by some folks.
Thomberry/I don't see the harm.
O'Donnell/I think it is a good idea.

Transit Route Study 98-94 S1
Fowler/...basic questions we felt we needed answered before we could go ahead and
finish up with the route study. You received some requests for transit service to
West High... Two options for transit service to the community and the first option
would be a blanket service .... Give transit service to the largest segment of the
community possible and it is not really based on fidership demands ..... based on
offering the opportunity to everybody in the community ..... to have transit
service. Another option .... Demand driven .... Concentrate it in areas that have
high density dwellings and large destination points. And to move to a service like
that, you would begin pulling transit service out of residential communities... and
concentrating it on high density areas .... Drawbacks to go to that type of the
system... a segment of the community that no longer had accessible
transportation. It is possible to develop a hybrid... and concentrate your resources
in a high density area .... Increase operating budget... or start cutting back the
service in the residential areas .... We do this in a couple of neighborhoods
now... not good service to the residents when you start doing that ....
A year ago we had a committee of transit management and transit drivers...
looking at streamlining the transit system and trying to serve the larger
segment .... Whatever we would proposed would end up back on your table... We
thought... come talk to you before we do it and see what form of transportation
you would like the community to have and then we will build the system around
it. We do have to change. The routes have to be changed .... New requirements ....
We know that .... Would you like us to continue with the blanket coverage and
offer the service to the largest segment, the largest geographic area of the
community or do you want to start concentrating on high density areas and drop
service in some of the other areas ....Potential is there for increase in ridership in
high demand area.
Vanderhoef/How long has it been since we expanded outward to our outer boundaries?
Kubby/We added Plaenview.
Fowler/Plaenview was added .... '91.
Vanderhoef/...so we have a lot of expanded areas that are not receiving any service fight
now. Other question... Do you have any information on the new federal dollars
available for transit for welfare to work? ....
Fowler/No.
Vanderhoef/I understand there are some ....

Norton/The last time we discussed this... council... interested in both the blanket
coverage... not equally thick in all regions ....Maybe even more hybrid .... But
thinning it to match our resources ....Think the frequency a little bit ....Outlying
areas... Thin the blanket or not equally thick blanket ....
Fowler/...We are going to end up in a situation like we have on 7th Ave ....
Compromised position where we run 7th Ave. during peak but not during off-
hours .... We dropped a lot of mid-day riders... ended up riding para-transit ....
Norton/
Fowler/Many people moved into the community knowing that they moved into areas that
currently didn't have service .... I guess we would like your okay in advance that
what we bring back is going to fit what you want.
Champion/How do we know that until we see it?
Norton/
Fowler/...What we will have to do... a lot of neighborhoods .... May not end up with
service .... Or people that have twice an hour service in the morning may get once
an hour service.
Thornberry/I do get concems from people... see the buses running with nobody on
them ....
Norton/Inevitable... part of spreading the blanket.
Champion/You got to put sidewalks where people walk and put buses where people ride
them .... I think West High, not having a bus go out there, I think that is terrible ....
A long walk from anywhere.
Vanderhoef/Large businesses that have a lot of workers and potential riders .... Equally a
problem .... More interested in looking a bit more towards where the riders area
and where the need is being shown rather than going with the super blanket that
we had had in the past.
Kubby/For me... minimum, thing... blanket service at peak time .... On Court Hill
route... it is used extensively at peak time ....
Norton/I can buy that, blanket coverage at peak times..

Lehman/How can we be everywhere at peak times?
Kubby/
Lehman/If we had them all there during peak times, aren't they still all there during the
slack time?
Kubby/ ....use the bus more if it was every half hour.
Vanderhoef/I would look at new innovative kinds of things... smaller buses or quick
shorter routes .... That could be used at peak times ....
Norton/Isn't it largely personnel?

Fowler/We have a lot of drivers who do work a split shift .....
Vanderhoef/I would also like to talk with the school district and see what they could
come up to assist us with these loop routes for the schools.
Fowler/West High. There are currently two busses that go through the west side of town
that go by West High .... Backside ....
O'Donnell/
Fowler/The area that is not served for West High right now would be the Hunters Run,
Southwest Estates, Walnut Ridge, Galway Hills .... They don't have a bus .... Our
problem is we no longer have a bus that goes in front of West High .... Trail that is
in will be a very long, undesirable walk in the winter.
O'Donnell/Why don't we have a bus going to the front of West High?
Fowler/All of our routes end at Westside Drive.
O'Donnell/We think we have an obligation to get kids to high school.
Lehman/School system ....
Champion/I think the state law-

Champion/I don't think they are going to use education dollars to do that.
Lehman/If we were to use the blanket policy that Mr. Norton... Could we have a policy
that provides a thick blanket during peak times and a thinner blanket during non-
peak times without increasing our total budget?
Kubby/A thick blanket during peak times and a varied blanket during the day.
Lehman/So we could maximize the number of riders during peak hours .... while not
cutting off service totally to areas that we presently serve.
Fowler/We could combine some routes midday .... People would have a further walk
from where the bus would be ....
Kubby/A lot of the drivers really know their routes well... project what the paratransit
increase would be .....
Norton/... sales tax consideration... this is one of the clear needs... with our resources
are restrained ....
Kubby/I don't think we can give them direction based on thinking the sales tax is going
to pass.
Norton/That is one of the issues .... Accommodate out community properly... with
resources that are sharply limited .....
Vanderhoef/I would like to put on the agenda for the joint meeting because I would like
to also see what that Westside loop could look like if we were doing something in
conjunction with Coralville .....
Norton/We have street layouts that do not permit a loop .... Some places where our
streets are incompatible with the transit system.
Vanderhoef/
Lehman/Joe, have we given you any indication of where we think we would like to be?
Fowler/I think you have... a very good indication. What I think you have told us is that
you would like to see the city continue to have blanket coverage during both
morning and afternoon peak and then in areas where there is potential high

demand for increased ridership, to divert some of our resources to those areas so
that we increase service in some areas but we maintain service throughout the
entire city, maybe not at the current level that it is today.
Lehman/That is exactly- You got it word for word.
Kubby/And that we talk to Coralville about working on the Westside loop with us and
then some of Dee's ideas about using paratransit vehicles maybe at night to do
some on demand service for certain routes.
Fowler/That has been part of the delay in the route study .... Some of those resources be
diverted to daytime.

Landfill Issues 98-94 S1
Atkins/Landfill issues. I want to give you sort of a quick briefing on a number of issues.
The council had asked that we bring back to you the issue of the height of the
landfill, that 870 and 810 .... We have on your agenda for tomorrow evening a
Landfill Policy statement... You have a land purchase .... I also prepared a memo
to you an land fill rates .... We feel comfortable with those numbers. It is a two
year commitment ..... I would like your impressions... upcoming budget... around
these rates... residential rates are also going to go down. The timing of the
thing... We arbitrarily picked January 1... Enjoy the ability that we have to
reduce those rates.
One final item.. recommending to you in upcoming CIP. We had originally
planned to have the Household Hazardous waste considered for the new Public
Works site south go the Airport. We are going to change that recommendation
and have it at the landfill .... That our current staff can then run the thing .... 57
hours a week... provide a very good service.
Lehman/...you have come up with a reduced rate... I believe that if we offer a reduced
rates to haulers, it is not unreasonable for us to ask haulers to contract with us...
two year deal... To get that rate, we should require haulers agree to haul all of
their refuse to our landfill. And if they don't, they do not get the lower rate ....
Norton/Can we do that?
Lehman/You can check with Eleanor ....
Atkins/I think we can contract with them... We have charged variable rates before ....
Dilkes/What did you say?
Lehman/Could we contract with our haulers, offering them a reduced rate if they agree to
haul all of their refuse from Johnson County locations... haul it all to our land fill,
we will give them the lower rate. If they don't agree to do that they then pay the
higher rate. Two year period of time.
Dilkes/It raises some issues for me. I think we have to take a look at it.
Kubby/...contract with municipalities... that we know we can do.
Atkins/We can do that.

Neumann/In a contract with a community, it would only be for what they control and
that is residential.
Lehman/They can require their haulers to come to our landfill.
Neumann/If they take over collection. They would have to take it over city wide and
contract that out .... Take over the business waste stream.
Atkins/Ernie, I hear you saying that you want us to do what we can to direct these
haulers in some form of a commitment. We will have to research the thing.
Norton/Any leverage on private commercial establishment ....
Atkins/A municipality can provide refuge collection services without having them do it
with their own employees ..... They control it through contracts ....
Lehman/Let's look into it, that is all.
Thornberry/What is the reasoning behind lowering the rates?
Atkins/Several reasons... we now have an accurate project over the life of the landfill ....
Accumulating cash... short term .... Anticipating... We were creating cash more
rapidly than we needed it. Now that we have the Master Plan .... 33 life... We
know what the capital projects are going to be... good estimates on the
tonnage .... Factor all of those things together... We can take some of these costs
and spread them over a much longer period of time .... Our projections.. We
should be in the position by year 2010 to have our full commitment for closure,
post-closure cash in the bank ..... Which means... take those costs and spread
them over a longer period of time, you don't have to charge on this end ....
Lehman/That is based on the life of the landfill as projected.
Atkins/We project the life of the landfill to be 33 years .... Height issue .... 45 years ....
Now we know, the thing is going to last a much longer period of time than we
anticipated.

Atkins/It will fill up ....Economic decisions ....Accumulate cash ....

Thornberry/I spent two hours this afternoon at Nick Yutzy's house. He has concerns ....
The city is lowering their rates just after he has made the investment that we know
about of taking the garbage out of state.
Atkins/First of all, I don't know what kind of investment he has made. He didn't share
that with us .... I do not know if he put one nickel into the thing ....

Thornberry/ .... we know that there is garbage leaving town... We know the reason that it
is leaving town is because they are dumping for a lower rate.
Atkins/That is one of the reasons.
Thornberry/So we are now lowering ours-
Atkins/We are lowering ours because you put a Master Plan in place that allows us to
make far better long term management decisions and the Illinois land fill guy may
be only $20 a ton but he is also not providing any of the services that we provide.
We have a whole array of services that we provide out of those landfill fees. It is
more than just a economic decision ....
Thornberry/But listen to me and try to understand, Steve .... It looks like we are trying to
be competitive with the private sector and can do things to affect the private
sector in a negative way by adjusting our prices .... To get a long term contract ....
I believe .... Something like $40,000 that he dumped in the Iowa City Land fill ....
Atkins/We provide a service, they don't ....
Thornberry/They can take anything but nuclear waste to Illinois ....
Norton/Seemed to me we were looking at those rates .... He says that we do have some
additional services .... We were asking him to look for some way to come down to
a little bit closer to where the market is ....
Thornberry/... I would like them to either come down a lot more .... Or leave them the
way they are .... We can bring them down lower.
Kubby/How can we bring them down lower? .... Formula .... Operation, maintenance...
service .... policies...

Atkins/This is the level of risk I believe you should take ....I could squeeze a little
more... I would recommend against it...
Champion/...I feel strongly that we run a very clean landfill... services ....
Norton/What is the virtue, Dean, of staying where we were? .... That is not competitive
at all.
Kubby/
Thornberry/I am saying one of the other .... Current rate ....
Norton/It would fill up slower.
Thornberry/We could go for volume... and really getting all of the volume ....
Lehman/
Thomberry/I don't think we should penalize them just because they take some of it and
not all of it .... If we kept the rates the same, we could lower the rates-
Norton/This is kind of a nice number ....
Lehman/...I don't have a problem... we have accumulated cash... We now can project
33 years ....A period certain ....We know how much we can put into that
landfill ....Certain things that are known... A master plan ....This is the rate that
will take care of it... Two year rate .... Talking about a 33 year landfill based on
today' s collection rate .... That landfill may last 100 years .... May be 80 .... If we
just get the cardboard out of the waste stream...
Thornberry/We also are going to have an increase in population.

Norton/ ....we could lower those rates further ....

Thornberry/You want a contract with the private haulers... pay a premium ....
Lehman/ .... We will provide you this land fill... advantageous price ....

Thornberry/I think we should have a one rate thing and I don't think it is fair .... Pay the
higher rate. I just think it ought to be a one rate structure.
Norton/...paragraph 11, need to demonstrate a commitment. I don't know what that
meant.
Atkins/...I think you need to get to each of those communities in some fashion. They
need to demonstrate... they are committed to the use of the Iowa City Landfill ....
If we are going to continue to provide this service, we have to do this in an
efficient manner .... Some reasonable waste stream... certain agreements .... I
don't know what the form of that commitment is ....
Thornberry/Do these figures and that length of time reflect the 870 feet?
Atkins/We will discuss that in a moment.

Atkins/There could be a dramatic change in state or federal regulations .... 2-We use
reasonable inflation terms .... Cost of labor... leachate monitoring system...

Atkins/We have two more issues this evening, one is the sales tax and then the update on
the library project. It would seem to me that a discussion of the ballot proposition
and policy statement appear to be the most important issues... Made
assumption... meeting on the 16th with Coralville and Johnson County. It might
be an opportunity to at least give them a clue what your plans are. What I have prepared
for you is what I thought was the last position statement on the part of the council
with respect to the ballot proposition, keeping in mind the ballot proposition is
much more succinct. I have prepared a policy statement which is an elaboration of
that for you to use ....
Norton/Certainly some discussion at the end... about whether 5K is enough in that last
category .... Some consensus that that might be 10.

Airport/South Central Area Projects 98-95 S1

Atkins/I have prepared for you a little summary memo. When we were discussing among
ourselves the airport projects... the South Central District has been deferred by
P/Z at least temporarily for some other things they want to get done... Clearly this
plan and the implications of the airport and surrounding development, we're
going to spend a lot of money in this area... make sure we're all on board on
that... make sure we have general agreement on where we're going on these.
One is the South Central District Plan is a land use plan for the area in and around
the airport. Lots of public facilities, lots of development issues, opportunities,
those things are all pending. You have to wait for P/Z. The Airport Master Plan...
has received your support, support of the Airport Commission. We will begin
taking that plan... and its elements and incorporate them into the upcoming
Capital Improvement Plan .... Eleanor's planning an update on land acquisition
and a couple of other things...
The North Airport Commercial Development. That' s the official name we hung
on that area up to the northern part of the runway. We have a contract pending for
you tomorrow night... first step in initiating the development process. The
contract will provide for streets, utilities, engineering, design... Karin .... has
spoken with school officials about the road location. The north route is preferred.
There is a southerly route. We believe... incorporated into the contract, they will
give us both options .... We are awaiting the Iowa Jet Service decision... We
believe we have sufficient guidelines from that committee with respect to the need
to develop an agreement on this parcel of ground between the City Council and
the Airport Commission. Unless we hear otherwise from you, the task for Ron
and I and the other staff members to... prepare a draft agreement so that those
parties understand the commitments you're going to have on that Noah
Commercial area...

location of that road? That's in the contract isn't it?

intent for us to proceed and make that Airport Terminal Renovation Project and
upcoming CIP.

to the Airport, all be items that down the road the city may expect to be paid for.

pick the building pad, the site that you want to see developed- Village Inn... that
site was burned... allowed for the compaction. There is a process ....
Literally...compacts the stuff, then you fill back in and you can create a
reasonably sound, buildable surface. We would like to pursue that concept ..... It
is about $2 million to prepare the site .... If we can show you a $2 million
investment .... Evidently this is so unstable that we would have to do something
and this concept of smashing it ..... Most of us were chuckling .... The depth of
this stuff is anywhere from 9 - 22 feet of garbage ....

week or so ago .... Where somebody already had one deposit and was going to be
asked to make a second deposit before the first deposit even came back. I think
Don is addressing that.
Kubby/I had nine calls about that issue...lower income people .... Some people did not
have a good record of paying bills, some people did.
