2005, ON THE CITY OF IOWA CITY FY06 IOWA DEPARTMENT OF
TRANSPORTATION CONSOLIDATED TRANSIT FUNDING
APPLICATION AND AUTHORIZING THE PUBLICATION OF A NOTICE
OF SAID HEARING.
Comment: JCCOG will be completing Iowa City Transit's FY06 Iowa
Department of Transportation Consolidated Transit Funding Application.
This application will contain FY06 State Transit Assistance formula
operating funds and a listing of projects programmed for Federal Transit
Administration Section 5307 and/or 5309 operating and capital projects. A
public hearing on the application is required by law, with a notice of the
hearing published in advance. The grant application will be available for
public review prior to the public hearing.
2) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR APRIL 5 ON
AN APPEAL TO THE CITY COUNCIL OF THE DECISION OF THE
HISTORIC PRESERVATION COMMISSION TO DENY A CERTIFICATE
OF APPROPRIATENESS FOR THE INSTALLATION OF AN AUTOMATIC
TELLER MACHINE IN THE FACADE OF 13 S. LINN STREET.
Comment: Scott K~'ing has appealed the decision of the Historic
Preservation Commission to deny a Certificate of Appropriateness for the
installation of an ATM in the facade of 13 S. Linn Street. Prior to the April 5
public hearing, Staff will provide Council with information regarding the
application for a certificate and the appeal process.

PERMANENT SANITARY SEWER EASEMENT FROM JOHNSON
COUNTY, ON PROPERTY LOCATED SOUTH AND EAST OF THE
COUNTY HOME SOUTH OF MELROSE AVENUE.
Comment: Municipal sanitary sewer has been constructed across property
owned by Johnson County, south and east of the County Home and
Melrose Avenue, to extend service to the future National Guard building.
Johnson County has executed and delivered the necessary permanent
sanitary sewer easement agreement, a copy of which is attached and has
been approved by the Public Works Department. This resolution authorizes
execution of said permanent easement agreement by the Mayor and City
Clerk.

3) CONSIDER A RESOLUTION NAMING DEPOSITORIES.
Comment: This resolution includes name and address changes for various
banks. It increases the depository limits at West Bancorporation, Inc. and U
of I Credit Union from $30 to $35 million and from $25 to $30 million
respectively. We are also recommending that First American Bank be
added to the list of depositories with a depository limit of $10 million.
Investments at this institution would be collateralized by the state sinking
fund.

Comment: At their February 17 meeting, by a vote of 6-0 (Shannon absent), the
Planning and Zoning Commission recommended approval. Staff recommended
approval in a report dated December 16, 2004, and in subsequent memoranda
dated February 11 and February 17. The territory proposed for annexation is
undeveloped, vacant property proposed for commercial development. The
applicant has requested a deferral of this item to the April 5 City Council

related to infrastructure improvements, funding, landscaping, fencing and
sanitary sewer provision. Staff recommended approval in a report dated
December 16, 2004, and in subsequent memoranda dated February 11 and
February 17. The rezoning will allow for development of MWD Davis Addition, a
commercial development proposed for this property. The applicant requested
that the Planning and Zoning Commission reconsider the recommended
conditions for the rezoning. This will take place at the Commission's March 17
meeting. Staff recommends this item be deferred until the Council votes on the

approval in a report dated February 17. The pavement in this segment of Dane
Road was removed as part of the Mormon Trek Boulevard project. Applicant
has requested expedited consideration.

Comment: At its February 3rd meeting by a vote of 7-0, the Planning and
Zoning Commission recommended approval of amendments to the sign
regulations to allow electronic changeable copy signs. Staff recommended
approval in a memorandum dated January 27.

OF COST FOR CONSTRUCTION OF THE 2005 ASPHALT RESURFACING
PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH
BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND
FIXING TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: This biennial project involves the asphalt resurfacing and chip sealing of
various streets throughout Iowa City and various City Park's parking lots. The
estimated construction cost is $557,000 and will be funded with Road Use tax
proceeds. Staff memo included in Council packet.

EXTENSION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO
ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH
ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF
BIDS.
Comment: This project includes paving of Camp Cardinal Road from Melrose Avenue
to Highway 6 in Coralville. It also includes grading work and the installation of
sidewalks, storm sewer, sanitary sewer and water main. This is a joint project with the
City of Coralville, and Southgate Development. The estimated construction cost is
$6,463,000 and the City's share of approximately $2,406,000 will be funded with Road
Use tax proceeds, Water revenues and General Obligation bond proceeds.

ITEM 8. AMENDING TITLE 3, ENTITLED "CITY FINANCES, TAXATION & FEES," CHAPTER
4, ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND
PENALTIES," SECTION 3-4-5, ENTITLED "SOLID WASTE DISPOSAL," OF THE
CITY CODE TO INCREASE OR CHANGE CERTAIN SOLID WASTE CHARGES.
Comment: This proposed ordinance would increase residential solid waste collection
fees by approximately three percent (3%). Currently the fee is $12.10 per month; the
increase will change the fee to $12.50. This action is necessary due to annual
increases in operational costs. The last fee increase was in May of 2002.

"STORMWATER COLLECTION, DISCHARGE AND RUNOFF," TO CREATE AN
ILLICIT DISCHARGE AND CONNECTION STORMWATER ORDINANCE. (SECOND
CONSIDERATION)
Comment: This ordinance establishes methods for controlling the introduction of
pollutants into the City's stormwater drainage system and is required by Federal law
and the City's NPDES permit. Staff recommends expedited consideration.
ITEM 10. CONSIDER A MOTION APPROVING TAX EXEMPTION CERTIFICATE
Comment: This certificate is executed and delivered in connection with the issuance
by the City of $7,020,000 General Obligation Bonds. This certificate sets out in detail a
number of facts, promises and obligations which must be met and agreed to by the City
in order to maintain these Bonds as tax exempt.
ITEM 11. CONSIDER A MOTION APPROVING CONTINUING DISCLOSURE CERTIFICATE
Comment: This certificate is executed and delivered in connection with the issuance
by the City of $7,020,000 General Obligation Bonds. The disclosure certificate is being
executed and delivered for the benefit of the holders and beneficial owners of the
bonds and in order to assist the participating underwriters in complying with the
Securities Exchange Commission (SEC) rule 15c2-12(b)(5).

ITEM 13. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST AN AMENDMENT TO THE AGREEMENT TO PURCHASE AN
O5'/"~l APARTMENT BUILDING FROM GREATER IOWA CITY HOUSING FELLOWSHIP
(GICHF) AND TO ASSIST GICHF IN THE FINANCING OF AFFORDABLE HOUSING
IN THE PENINSULA.
Comment: The Peninsula Development Agreement calls for construction of affordable
housing in the Peninsula Neighborhood. The Iowa City Housing Authority (ICHA) and
Greater Iowa City Housing Fellowship (GICHF) have been working closely to develop
affordable housing units in the Peninsula, including an apartment building. On
September 23, 2003, the City and GICHF entered into an agreement in which the City
(ICHA) agreed to purchase the apartment building from GICHF upon its completion.
The proposed amendment covers the construction costs for an additional apartment
(i.e., 9 units to 10 units) and other additional costs associated with the completion of
the project. The ICHA should take possession of the apartment building early April
2005.
ITEM 14. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF
UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK
REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO
CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR
COLLECTION IN THE SAME MANNER AS PROPERTY TAXES.
Comment: The City has the authority under Iowa Code §364.13B to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to
be assessed against the property. This assessment is being pursued only after the City
took many steps to resolve the matter. The City notified the homeowners to abate the
nuisance (for example, to remove snow from the sidewalk) and after the homeowner
did not take action to abate the nuisance, the City abated the nuisance and billed the
owner. After being billed at least twice, these owners still have not paid the abatement
costs. The City has sent a letter to the homeowner giving them notice that this
resolution would be on the agenda, a copy of which is attached to the resolution. No
interest will be charged if the owner pays within 30 days of passage of the resolution.
Attached as an exhibit to the resolution is a list of the properties that will be assessed
and the amount that will be assessed.
