amend the PCRB By-Laws, Article V, Section 3, to read "Place of
Meetings. All meetings shall be held at a place reasonably accessible to
the public;" [this item should be referred to the Rules Committee as
soon as possible to allow finalization of a location for a Community
Forum on October 22] and (3) grant an extension to the PCRB of 45
days to file their public report on Complaints #98-11, #98-14 and #98-
16 because the Board is awaiting additional information requested from

CONSIDER A MOTION SETTING A PUBLIC HEARING FOR SEPTEMBER
22 ON THE APPEAL TO CITY COUNCIL OF THE DECISION OF THE
HISTORIC PRESERVATION COMMISSION REGARDING THE
CERTIFICATE OF APPROPRIATENESS FOR CONSTRUCTION OF A NEW
PRIMARY BUILDING ON LOTS I & 2, M&W ADDITION {803 S.
SUMMIT STREET), WHICH APPEAL WAS FILED WITH THE CITY CLERK
ON AUGUST 20, 1998 BY APPLICANT BRADFORD J. HOUSER.
Comment: On August 20, 1998, by letter directed to and filed with the
City Clerk, Bradford J. Houser, the applicant for a Certificate of
Appropriateness for new construction at 803 S. Summit Street, filed an
appeal to the City Council of the decision of the Historic Preservation
Commission regarding the Certificate, specifically the decision of the
Commission concerning the type of siding allowed on the structure.

(2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING
FOR SEPTEMBER 22 ON AN ORDINANCE AMENDING TITLE 3
ENTITLED 'CITY FINANCES, TAXATION & FEES,' CHAPTER 4
ENTITLED 'SCHEDULE OF FEES, RATES, CHARGES, BONDS,
FINES, AND PENALTIES' OF THE CITY CODE TO
DECREASE THE RATES FOR LANDFILL USE FEES.
Comment: This resolution sets a public hearing to allow for public input
regarding the proposed decrease in landfill use fees. The new rates are
scheduled to go into effect on January 1, 1999.

( 1 ) CONSIDER A RESOLUTION APPROVING THE BY-LAWS OF
THE IOWA CITY HUMAN RIGHTS COMMISSION.
Comment: This resolution adds the Administrative Closure Provision of
the Human Rights Ordinance to the Complaint Process Provision of the
by-laws. The revisions also include the correction of a scrivener's error
in a prior draft. Decisions of the three-member Commission teams are
to be made by majority, but this change was inadvertently omitted in
the last revision and the term consensus remained.
(2) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR
THE IOWA CITY CIVIC CENTER FRONT ENTRANCE.
Comment: See Engineer's Report.
(3) CONSIDER A RESOLUTION ACCEPTING THE WORK
FOR THE REMOVAL--~ AND REPLACEMENT OF THE
ROOF AND INSULATION ON THE CIVIC CENTER.
Through change orders, the contract amount was reduced from
~62,399 to ~59,~5. All work covered by the contract has ~en
completed, and all invoices have been paid other than a 5% retmnage
(Deferred from July 7, July 28, and August 25.)

CONSIDER A RESOLUTION APPROVING THE PUBLIC HOUSING
MANAGEMENT ASSESSMENT PROGRAM |PHMAP) CERTIFICATION
OF THE IOWA CITY HOUSING AUTHORITY FOR FY98.
Comment: The Department of Housing and Urban Development (HUD)
requires housing authorities to certify fiscal year performance data as a
means of monitoring local activity. HUD will score the Iowa City
Housing Authority (ICHA) based on indicators and will identify areas of
concern or performance based on these indicators. The Public Housing
Management Assessment Program (pHMAP) certification, HUD-50072,
is the only performance report required for FY98.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN
REGARDING MORTGAGE FOR THE PROPERTY LOCATED AT
221 SOUTH SEVENTH AVENUE, IOWA CITY, IOWA.
ITEM NO. 4.
Comment: The owner of the property located at 221 South Seventh
Avenue received assistance through the City's Housing Rehabilitation
Program for a total of $3,011 on April 15, 1996. The financing was a
Mortgage in the form of a low-interest loan. The loan was paid off on
September 1, 1998; thus the lien can now be released.

Consider a motion setting a public hearing for September 22 on an ordinance
changing the zoning designation of approximately 22 acres from Medium
Density Single-Family Residential (RS-8) to Low Density Single-Family
Residential (RS-5) for property located in the Summit Street Historic District.
(REZ98-0010).
Comment: At its August 20 meeting., by the vote of 6-0, the Planning and
Zoning Commission recommended approval of the proposed rezoning. Staff
recommended approval in a report dated August 6~_~_~ ~

Comment: At its July 2 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning. Staff
recommended approval in its June 18 report.

Consider an ordinance changing the zoning designation of approximately
9.27 acres from Low Density Single-Family Residential (RS-5) to Sensitive
Areas Overlay/Medium Density Residential (OSA-8) to allow a 72-unit
residential development on property located on the south side of Taft
Comment: At its July 16 meeting, by a vote of 1-4 on an affirmative motion
with Shannon voting yes, the Planning and Zoning Commission
recommended denial of the proposed rezoning, consistent with the
recommendation contained in the July 2 staff repo~. In a letter dated
July 15, 1998, the applicant requested that this application be forwarded for
consideration by the City Council regardless of the recommendation from the
Commission.

Consider a resolution approving a prelim!nary plat of Prairie Meadow Part 2, a
16 acre, 7-lot residential subdivision located at 2140 Prairie Du Chien Road in
Johnson County. (SUB98-0018)

Comment: At its August 20 meeting, by a vote of 6-0, the Planning and
Zoning Commission recommended that the preliminary plat of Prairie Meadow
Part 2 be approved, subject to the right-of-way for Syril Street being
extended from the east property line of Lot 7, to the new alignment of Prairie
Du Chien Road, at the time Lot 7 is resubdivided or developed, or at the
completion of the realignment of Prairie Du Chien Road. Staff recommended
approval in a report dated August 6.

Consider a resolution approving a preliminaW plat of CountW Club Estates
First Addition, a 10.82 acre 21-lot residemial subdivision located at the west
terminus of Phoenix Drive. (SUB98-0011)
Comment: At its August 20 meeting, the Planning and Zoning Commission,
by a vote of 6-0, recommended that the preliminary plat of Country Club
Estates First Addition, be approved. Staff recommended approval in a report
dated August 20.
Consider a resolution approving a preliminary and final plat of a Resubdivision
of Lot 53 of Walden Hills, an 8.33 acre, 4-lot residential subdivision located
at the northwest corner of Rohret Road and Shannon Drive. (SUB98-0019)
Comment: At its August 20 meeting, the Planning and Zoning Commission,
by a vote of 6-0, recommended that the preliminary and final plat of a
Resubdivision of Lot 53 of Walden Hills, be approved, subject to the approval
of legal papers and construction drawings prior to City Council approval.
Staff recommended approval in a report dated August 20.

Consider a motion to forward a letter to the Johnson County Board of
Supervisors recommending that a request to rezone 15.0 acres of property
from Rural (A1) to Planned Commercial (CP-2), for property located along the
south side of Interstate-80, west of its interchange with Herbert Hoover
Highway, be denied. (CZ9836)
Comment: At its August 20 meeting, by a vote of 5-0, with Supple
abstaining due to the appearance of a conflict of interest, the Planning and
Zoning Commission recommended denial of the proposed rezoning. Staff
recommended denial in a memorandum dat~ed August 14, 1998.
h. Consider a resolution adopting a schedule of fees for Planning & Zoning and
Board of Adjustment applications.
ITEM NO. 6.
Comment: In July, Council directed staff to implement a revised property
owner notification process for Planning & Zoning and Board of Adjustment
applications. To cover the costs of increased mailings and new signs,
Council instructed staff to raise application fees by $25 per item and to
adjust the fees annually for inflation. The new fees will take affect
January 1. Application fees were last increased in 1990.

PUBLIC H~RING ON A RESOLUTION APPROVING P~ATIONS,
FORM .OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF
THE PARK MAINTENANCE BUILDING IN NAPOLEON PARK.
Comment: Due to last minute complications, staff recommends that the public
hearing be ceased and the bidding process delayed until this_.winter. The bid
may be awarded for spring construction.

ITEM NO. 7.
CONSIDER AN ORDINANCE AMENDING TITLE 9 OF THE CITY CODE OF IOWA
CITY ENTITLED "MOTOR VEHICLES AND TRAFFIC," BY AMENDING
CHAPTER 4, ADDING SECTION 1C THEREIN TO PROVIDE FOR ADDITIONAL
ENFORCEMENT ABILITIES FOR PARKING VIOLATIONS. (SECOND
CONSIDERATION)
ITEM NO. 8.
Comment: City parking enforcement personnel have identified a problem
enforcing parking after an initial violation is cited. In high parking demand areas,
it is more convenient to be issued a $5 violation than to find alternative parking.
A motorist can park illegally all day forthe price of a $5 violation. This action
ESTABLISHING THE DESIGN REVIEW COMMITTEE AS A STAFF COMMITTEE.
ITEM NO. 9.
Comment: This resolution is to provide for the transition of design review
responsibilities from an appointed citizens group to qualified members of the City
staff.

COMPUTER SYSTEMS FOR THE PURPOSE OF RECEIVING BENEFITS UNDER
CHAPTER 15, PART 13, ENTITLED 'NEW JOBS AND INCOME ACT," OF THE
CODE OF IOWA, FOR IMPROVEMENTS IN THE CITY IOWA CITY, JOHNSON
COUNTY, IOWA
OF NATIONAL
Comment: National Computer Systems (NCS) is requesting approval to receive
benefits under the State of Iowa New Jobs and Income Program (NJIP). Similar
to the Community Economic Betterment Account Program, the community in
which the project is located must approve the submittal of an application. Under
NJIP, the local community's contribution to the project is in the form of property
tax exemption. NCS would receive a declining percentage property tax
exemption for a period of 10 years.

CONSIDER A RESOLUTION AUTHORIZING ARCHITECTURAL CONTRACT AND
AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT
FOR ARCHITECTURAL SERVICES FOR THE IOWA CITY LANDFILL SCALE
HOUSE AND RECYCLE CENTER.
ITEM NO. 11.
Comment: This contract is for design of a replacement for the Landfill
scalehouse that was destroyed in the June 29 windstorm. Integrated into this
new building will be the Household Hazardous Waste Facility. This contract is
with Wehner Pattschull & Pfiffner, PC of Iowa City and will be funded by Landfill
fees and FEMA.
CONSIDER A RESOLUTION AMENDING THE BUDG~ED ~SITIONS IN THE
WAST~ATER TR~TMENT DIVISION OF THE PUBLIC WORKS DEPARTMENT
AND THE AFSCME PAY P~N.
Comment: The Classification Committee has reviewed the position of Senior
Treatment Plant Operator - Wastewater, as provided by the AFSCME Collective
Bargaining Agreement, and has determined that the duties performed by this
position are equivalent to those of positions in Grade 14 of the Pay Plan.
Therefore, it is recommended the full-time position of Senior Treatment Plant
Operator - Wastewater be reclassified from AFSCME Grade 12 to AFSCME
Grade 14. Annual cost is approximately $1,300.
ITEM NO. 12.
CONSIDER MOTION GRANTING A 45 DAY EXTENSION TO THE POLICE
CITIZENS REVIEW BOARD FOR THE FILING OF REPORTS WITH THE CITY
COUNCIL ON COMPLAINTS #98-11, #98-14, AND #98-16.
Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and
sets forth reporting mechanisms for complaints. The Ordinance also provides for
the City Council to grant extensions of the 30-day reporting requirement for
good cause. At their meeting of September 1, 1998, the Board unanimously
requested a 45-day extension for the reason stated in the letter included in
Council packet.

an unexpired term ending September 1, 2000. (Sandy Kuhlmann
resigned.) (2 males and 4 females currently serve on this Commission.)

Housing end Community Development Commission: Consider two
appointments to fill three-year terms expiring September 1, 2001. (Daniel
Cilek resigned; term expired for Daniel Coleman.) (2 males and 4 females
