Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:00 p.m. on the 9th day of
September, 1998, in the Civic Center Council
Chambers, 410 E. Washington Street, Iowa
City, Iowa; at which hearing the Council will
consider:
1. An . ordinance changing the zoning
designation of an approximate 4,000 square
foot property located at 114 Wright Street
from Community Commercial (CC-2) to Planned
High Density Multiple-Family Residential (PRM).
Copies of the proposed ordinance are on file
for public examination in the office of the City
Clerk, Civic Center, Iowa City, Iowa. Persons
wishing to make their views known for Council
consideration are encouraged to appear at the
above-mentioned time and place.

ORDINANCE NO.
AN ORDINANCE AMENDING THE ZONING
CHAPTER BY CHANGING THE ZONING
DESIGNATION FROM CC-2, COMMUNITY
COMMERCIAL TO PRM, PLANNED HIGH
DENSITY RESIDENTIAL MULTI-FAMILY
FOR 4,000 SQUARE FEET LOCATED AT
114 WRIGHT STREET.
WHEREAS, the property owner, Dennis
Langenberg, has requested a zone change
from CC-2 to PRM for property located at
114 Wdght Street; and
WHEREAS, the Comprehensive Plan
designates this property and the surrounding
area for mixed use residential and
commercial uses; and
WHEREAS, the proposed PRM zone is
in compliance with the land use designation
of the Comprehensive Plan for this area;
WHEREAS, the Planning and Zoning
Commission has reviewed this proposed
zone change and has recommended
approval;
WHEREAS, the adjacent properties
within this block are zoned PRM.
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA:
SECTION I. ZONING AMENDMENT.
Property described below is hereby
reclassified from its present classification of
CC-2 to PRM.
The east 50 feet of Lot 6 in Block 11, in
that part of Iowa City, Iowa, laid off and
platted as the County Seat of Johnson
County, Iowa, according to the recorded plat
thereof.
SECTION II. ZONING MAP. The Building
Official is hereby authorized and directed to
change the zoning map of the City of Iowa
City, Iowa to conform to this amendment
upon final passage, approval, and publication
of this ordinance as provided by law.

SECTION III. REPEALER. All
ordinances and parts of ordinances in conflict
with the provisions of this Ordinance am
hereby repealed.
SECTION IV. SEVERABILITY. If any
section, provision or part of the Ordinance
shall be adjudged to be invalid or
unconstitutional, such adjudication shall not
affect the validity of the Ordinance as a
whole or any section, provision or part
thereof not adjudged invalid or unconsti-
tutional.
SECTION V. EFFECTIVE DATE. This
Ordinance shall be in effect after its final
passage, approval and publication, as
provided by law.

The subject property contains a building that apparently was originally built as a single-
residence. At some point in time it was converted to a mixed-use building with bar on the
first floor and an apartment on the second floor. The property owner recently converted the
first floor to residential uses. The existing Community Commercial (CC-2) zone does not allow
residential uses on the first floor of a building. The applicant, Dennis Langenberg, has
requested that the property be rezoned from CC-2 to Planned High Density Residential
Multi-Family (PRM) to allow the first floor of this building to continue to be used for
residential purposes.

ANALYSIS:
This property is within the area covered by the Near Southside Neighborhood Redevelopment
Plan which was adopted by the City in 1992. The plan encourages the area south of
Burlington Street and generally west of Gilbert Street to develop for high intensity, mixed-use
residential and commercial uses. The subject property apparently was zoned CC-2 along with
other properties in the vicinity in recognition of the existing land uses in the area. The other
properties within the northwest portion of this block are currently zoned PRM and developed
with residential uses. Many of the properties have buildings which were originally built as
single-family houses that have been converted to higher density residential uses. The property
immediately to the west contains an older, multi-family building. The properties to the east
and south contain commercial buildings including office and restaurant/bar uses.
The Community Commercial Zone (CC-2) is intended to provide for major business districts to
serve a significant segment of the total community population. In addition to a variety of
retail goods and services, these centers may typically feature a number of large traffic
generators requiring access from major thoroughfares. The Planned High Density Multi-Family
Residential Zone (PRM) is intended to provide for development of high density multi-family
dwellings in centrally located areas which are in close proximity to public transportation and
employment and commercial centers. To provide to a variety of housing and building types,
this Zone allows both low-rise and mid-rise buildings. Because of the high density of
development anticipated in this Zone, special consideration of building and site design is
required.
Given its location in an area of transition from commercial to residential uses, and the Near
Southside Plan' s encouragement of high intensity mixed uses in this area, the proposed PRM
zoning would appear to be compatible with the existing and proposed land uses and zoning
for this portion of the city. Rezoning of the property will probably not result in any immediate
redevelopment of the property. In the long term it may be possible that this property, along
with adjacent properties, would be redeveloped for higher density residential uses.
Because of the small size of this property and its location in an area with low visibility from
major streets, the rezoning of the property from CC-2 to PRM would not have a great affect
on the city' s overall inventory of CC-2 zoning. Traffic generation from this property should
not vary significantly whether it is zoned CC-2 or PRM.
STAFF RECOMMENDATION: Staff recommends that the request to rezone 4,000 square
feet located at 114 Wright Street from CC-2, Community Commercial, to PRM, Planned High-
Density Residential Multi-Family, be approved.

Dear Mr. Miklo:
I am seeking to have my property -- as cited above-- rezoned for the following reasons:
I believe that by rezoning Lot 008 for the purpose of renting, it will be compatible with the west half of
the block on Clinton Street. The majority of the block consists of rental properties. The lot itself is not conducive to CC2 zoning because of limited parking.
Furthermore, the building on Lot 008 was originally a house and best suits the neighborhood in that ca-
pacity.

the construction of the Park Maintenance
Building in Napoleon Park in said City at
7:00 p.m. on the 9th day of Septamber, 1998,
said meeting to be held in the Council Cham-
bers in the Civic Cantor in said City.

and estimated cost are now on file in the
office Of the City Clerk in the Civic Canter in
Iowa City, Iowa, and may be inspected by any
persons interested.
Any persons interested may appear at said
meeting of the City Council for the purpose of

ment.
