Public hearing on an ordinance changing the zoning designation of approximately 22 acres from Medium Density Single-Family Residential (RS-8) to Low Density Single-Family Residential (RS-5) for property located in the Summit Street Historic District. (REZ98-0010). Franklin/P. h. on rezoning... Summit Street from RS-8 to RS-5 .... Shown on the overhead. This is recommended for rezoning by the P/Z Commission on a vote of 6-0 .... Also recommended by the staff that this be rezoned .... You have quite a bit of material in your packet. There has been a protest but not enough to warrant an extraordinary majority vote. Kubby/There is a suggestion from John Shaw to look at allowing certain kinds of additions being put on non-conforming uses and the legal suggestion was that we really need to take a measured look at that whole issue. Is that something that is going to be looked at? Franklin/If you direct us to. Kubby/...hard for me... I don't really understand what the ramifications are .... I would like a short informal discussion about it to know whether we want you to spend time doing that or not. Franklin/Okay. Thornberry/...if a property were to be caught on fire... bums 100% .... If it was a duplex they couldn't rebuild, is that correct? Kubby/They could rebuild to single family. Franklin/That is right .... Issue is 100% of assessed value .... Very few times in which the destruction is going to be that complete... usually... value left in the property .... Is there value? .... Kubby/If there is 1% value- Franklin/As the ordinance is written now it is 100% of assessed value has to be gone .... Mean that the foundation would have to totally deteriorate to the point that you couldn't use any of it...very hard to get to that point .... Really put less of a burden on non-conforming properties and it is a philosophical issue... Thinking at that time was don't make it so hard for them to rebuild. Lehman/Essentially this does not eliminate any non-conforming building .... It basically protects the non-conforming building .... Norton/In perpetuity. Franklin/ Norton/What was the objection to leaving out the south end of Summit Street? .... Franklin/I don't believe there was a lot of discussion of leaving out the south end at the P/Z Commission .... Kubby/But the zoning is different on the very north end of the properties... distinction between the noah end and the south end .... Franklin/It was all the RS-8 .... Thornberry/It does not go south to the tracks? Franklin/No. Norton/That RS-8 will come back in on the RS-5 .... Franklin/I think one of the other thoughts in terms of the property south of Sheridan .... Houser... has to do with the fact that there are a number of properties south of Sheridan that if you did some kind of renovation on them... those properties would become contributing parts of the Historic District .... Norton/ Lehman/I really think this sort of discussion is better held at the p.h .... Thornberry/I still have a question. Lehman/Are they questions the public should hear answers to as well as the council? Thornberry/I would like to know if these lots are too small ....Are there restrictions in building on some of those? Franklin/There are some restrictions... A s.f. house, if it is on a non-conforming lot ....A s.f. house on a non-conforming lot can be built... You can build a s.f. house .... There are many exceptions in the Zoning Ordinance made for s.f. .... That you can have a s.f. structure even if it is a non-conforming lot .... In the ordinance, it specifically allows to have a s.f. structure on a non-conforming lot. Lehman/That is another question we should have at the p.h. so the public can hear those answers... Kubby/I want to make sure that there are a majority of people who are even interested in discussing that issue .... Norton/... John was suggesting... Kubby/Can non-conforming buildings increase their habitable space and what affect will it have across the city? .... Norton/I do ..... Franklin/If that is a change that you want to make, that is a significant change. Lehman/...We want to know the ramifications. Franklin/To consider that, it is significant .... When you talk about increasing the amount of habitable space, then that becomes significant. Kubby/I need to know the superficial pros and cons .... Seems like there is interest here. Thornberry/Does habitable include a porch or a screened in porch? Franklin/Potentially ....Let' s schedule a general discussion of the principles of it .... Franklin/ Kubby/Maybe some of the questions we talked about tonight, you could reiterate the answers tomorrow .... Everyone who asked a question, ask it again tomorrow night .... Those points are really important. Thornberry/I will be bringing up another one about the lots that are there now, can they be built on satisfactorily .... Lehman/ b. Consider an ordinance changing the zoning designation of an approximate 4,000 square foot property located at 114 Wright Street from Community Commercial (CC-2) to Planned High Density Multiple-Family Residential (PRM). (First consideration) Franklin/First consideration on the rezoning of 114 Wright Street from CC-2 to PRM. We had the p.h. on this already .... Dee... This was a change that was made from a bar .... To a residential unit without a building permit... The owner believed that because he was going to live in the unit, he didn't need to get a building permit... now wants to get it zoned. Norton/ ....always a curiosity how these things happen. c. Consider an ordinance changing the zoning designation of approximately 9.27 acres from Low Density Single-Family Residential (RS-5) to Sensitive Areas Overlay/Medium Density Residential (OSA-8) to allow a 72-unit residential development on property located on the south side of Taft Speedway west of Dubuque Street. I had a letter... requesting that this be deferred for another two weeks ....I think we should go for maybe two more weeks .... Lehman/Okay. Karr/ Franklin/I have a letter to me .... d. Consider a resolution approving a preliminary plat of Country Club Estates First Addition, a 10.82 acre 21-lot residential subdivision located at the west terminus of Phoenix Drive. (SUB98-0011) Franklin/Consider a resolution approving the preliminary plat of Country Club Estates. Please defer for two weeks. They are trying to work an easement into the subdivision. If we don't have something by tomorrow, that is a revised plat, then we want to defer it indefinitely .... Lehman/ Franklin/ Kubby/We got... correspondence... worried that there is going to be two much traffic .... When would they need secondary access? .... Franklin/There is very little they can do before they would need secondary access ..... Kubby/ Norton/Have we done anything .... Problem... large areas... then developed in pieces .... You can't take the broad look at stormwater and streets that you would like to. Franklin/We do try to get the developers to bring in all that they own when they do a plat .... Get them to give us a concept plan for the future .... We are doing much more of that... anticipating a slightly higher density ....In terms of them developing it in phases, that is almost a fact of life ....You can only do certain parts at a time economically. Norton/The concept plan has no teeth to it. Franklin/Not unless it is part of a conditional zoning ....Windsor Ridge... did a large plan for that area .... Consider a resolution approving an amendment to the 28E agreement between the City of Coralville and the City of Iowa City regarding future annexations and extraterritorial review of subdivision plats. Franklin/Next is the 28E agreement for Coralville. Jeff.... Davidson/ .... principle issue seems to be .... Is that Area A .... colored areas... where neither Coralville or Iowa City has made a commitment with respect to extending municipal services .... Within that two mile area of review... Area A .... (refers to overhead projection map) .... On that ridge... Coralville... updated their community plan last year .... Expanded their growth area over to Dubuque Street .... Iowa River .... That is intended to be an area where neither city has made a commitment for the next 25 years for annexation and extension of municipal services .... Coralville would have purview to review subdivisions out in the county .... Coralville could eventually annex clear over into the blue area (refers to overhead projection map). Kubby/Karin, in terms of environmental factors, whose subdivision regulations are more stringent, Iowa City or Coralville? Franklin/Iowa City' s are in terms of zoning .... Sensitive Area Ordinance is a zoning base .... That is not something that we apply in the county... Lehman/So we both would be applying similar standards? Kubby/ Franklin/We have agreed upon standards with the county as to what we are going to look at and what we will impose in certain areas in our Fringe Agreement. We don't have a similar agreement with Coralville .... So I can't really say exactly what Coralville's standards would be for the subdivisions there. Norton/Given this location .... Crucial for us to keep that... Kubby/ ....can't impose other restrictions .... Is there significant difference in the overview? Davidson/ .... Coralville... they do differ in some areas .... Street standards and setbacks .... Franklin/I am not aware of a difference but I don't know how Coralville reviews subdivision in the county ..... Davidson/Iowa City is not going to know unless you tune into the meeting .... Thomberry/ Norton/ Thornberry/Jim did not know... asked Kelley at the meeting. Would we have to put in a pump station to get over that ridge and he said yes, we would .... Davidson/Even the existing dovetail area requires a lift station for Coralville to serve that with their municipal service. Norton/ Lehman/ Franklin/Could we not, in this agreement with Coralville, rather than having joint review ....Have an agreement with Coralville about the standards that would be imposed? Lehman/Could we ask them to apply our standards? Franklin/Potentially. Thomberry/ Lehman/...as long as we protect ourselves .... Davidson/Within that two mile area, for a subdivision you do have the fight to approve or disapprove it. Resolving, you advise .... Lehman/Do I hear most folks seem to think we would like to retain the review in this area. I see one, two, three, four, five... If at the meeting tomorrow night when you vote it down to indicate perhaps what the group would approve, whether it is joint review, whether it is Iowa City retaining review in the entire area and then I will simply go back to Coralville with that. Lehman/If I understand this... my sense of why we probably want to retain review in this area is to protect our interests in the future whether it be... other design standards... protecting our water supply .... A higher priotity than annexation .... Our primary concern is protecting future interests of Iowa City by requiting standards that would be compatible with what we have within the city .... Joint review or do it ourselves. Davidson/What I hear you say, Ernie, is that you would just assume retain review? Lehman/I think that is what I hear people say. (All talking). Kubby/Then there is that one little section that says something that we need to redo this anyway .... That every time something is annexed we have to renegotiate the agreement about where the review lines are. Davidson/I will try to find out from Coralville about whether they will accept a new agreement with the provision that Iowa City retains review of this whole area .... Kubby/Can't we still make that one change to the agreement? .... Davidson/I will present that to them. Kubby/One of the proclamations, the Motor-Ioway .... To commemorate the role of the motor vehicle in our history ..... If we could change that word to recognize... Lehman/Does anyone else feel the same way about that? We are going to recognize and commemorate then. Karr/You are going to redo it in both? Lehman/...I think we will leave it the way it is. I don't hear anybody else. 2. Kubby/(ITEM #15- RULES OF ORDER FOR THE CONDUCT OF FORMAL COUNCIL MEETINGS .) In our minutes of September 19... public discussion change, it says council agreed to discuss the matter further but we have an item on our agenda to do it although we don't have any resolution that outlines how these changes will be made. So I am not sure how we can vote on it .... We haven't had out further discussion as agreed to at our last meeting .... Karr/There should be a resolution in there .... Kubby/Where is it? Karr/At the end of the agenda. Kubby/Okay, I will have to look. My point still stands in that the minutes states we agreed to discuss the matter further .... We should have discussion about it .... I don't like that we agreed to discuss it and then it is on the agenda. Norton/ Kubby/I think we should defer this to have further discussion .... Lehman/I have no problem discussing it... deferring it for another meeting .... Norton/I read it there was a majority to do it ....I can't think of an option to deal with it .... Kubby/Our minutes said we would discuss it further ..... Lehman/I think it is still pending ....Depends on what we decide tomorrow night. 3. Kubby/(ITEM #12- CONSIDER A RESOLUTION APPROVING THE COLOR OF EXTERIOR AWNING AT 115 E. COLLEGE STREET.) We didn't have any drawing or didn't really say what colors they were going to be. Karr/I have a picture... and I have the fabric. Kubby/Can you pass that around tonight so we know what we are voting for? 4. Norton/(ITEM #7- 803 S. SUMMIT STREET APPEAL CERTIFICATE OF APPROPRIATENESS.) I want to be sure we are all straight on .... Fine print from the City Attorney which specifies.. decision based just on the process, not the substance of the matter. Lehman/...comments and discussions relative to the merits of the various sitings are going to be inappropriate comments. We have to talk about the process it went through and whether or not we find that they did or did not act arbitrarily or capriciously and if we do find that they were not arbitrary or capricious, we accept their findings, period ..... Thomberry/What is the process or proof that they acted in a capricious manner? Lehman/That is the whole point. We have the minutes .... We have all the information... Our job at this point is to determine whether or not that process was arbitrary or capricious. Kubby/ Thomberry/ Lehman/ Kubby/Are there some standards to use for arbitrary and capricious? Dilkes/The basic standard was put in the memo that I sent you. The Iowa Supreme Court has defined it as not grounded in law or facts .... Case law... administrative agencies at the State level .... There should be deference to the expertise of the Commission .... Arbitrary and capricious... couple of examples... For instance... Keep in mind... reasonable minds can differ... not a arbitrary decision. Example of an arbitrary decision would be if the Commission relied on factors that it was not suppose to consider, for instance .... If it entirely ignored an important aspect of the consideration .... If it offered an explanation for its decision that ran counter to the evidence before it .... Evidence was not in front of it .... It would not be arbitrary of it was based on the facts in front of the Commission .... Norton/The fact that it was based on their judgement was not arbitrary? Lehman/That is right ..... Thornberry/They still made a decision without being experts in the field .... Lehman/Based on the information that they have available to them, was their decision arbitrary or capricious? .... Kubby/That conversation is not what we are to do .... Norton/Had they sought appropriate advice? .... Thornberry/I just think that this is one reason why when you take a complete district... and make it under the Historical Society's purview, it is not up to individual houses to opt out .... That is the fallacy that I see of doing it district wide .... Kubby/But that is not how the state law does it. Thornberry/You don't have the option of opting out of that designation. Norton/You don't have the option of opting out of rezoning either .... Thornberry/ Lehman/ Dilkes/...unusual position for you to be in .... One of the things about the position you are in tomorrow is that you listen to- You read everything you were given, you listen to everything that is presented to you tomorrow night and then you have your deliberation about that. If you can, in a very systematic way: 1 .What were the rules they followed? Were those the rules they were suppose to follow? 2. What were the facts they relied on? Were those facts in the records7 What is the decision they made? Was it based on the law and based on that fact? You need to do that in a fairly systematic way and I think that will help keep you on track. Lehman/Okay. Kubby/Thank you .... Norton/ Lehman/Other agenda items? Kubby/I just had another quick question about the Gringos thing.'? Are they going to repair their sign to go with the awning? .... Karr/I can check for tomorrow. Kubby/The sign will not match .... Lehman/ Kubby/The awning, if it is green with the black stripes, will not match the orange, yellow and red. Can we find that out by tomorrow? Karr/Yes, I will check for tomorrow. O'Donnell/ Lehman/All right. Steve, I have one comment... I see we are again looking at the land fill proposal for recycling building out there. Kubby/That is on the agenda. Norton/That is on for tonight. Arkins/ Lehman/Okay, we will get to that later. Anything else on the agenda? This represents only a reasonably accurate transcription of the Iowa City council meeting of September 21, 1998 WS092198 September 21, 1998 Council Work Session Page 13 Iowa Avenue Parking Garage Financing Update 98-101 S2 Atkins/This will take but a few minutes, I want to bring you up to speed where we are... Circus and Rodeo Permit Regulations, draw a line through that. Your packet of information did not include the regulations... We will pull that and put in on the next meeting. We have tried to put together a financing package for the Iowa Avenue Garage and commercial space .... Difficult .... Total project cost is still estimated about $12 million .... Asked... consider that electric overhead thing... in the alley, get rid of that, take it out.. dress up that alley... transformer... And that the alley be reconstructed also .... Dressed up .... There are two major elements to this project. $8.5 million we estimate for the parking garage, $3.5 million for the commercial. I want to deal with the commercial first ....$3.5 million will build approximately 37,000 square feet of commercial space ....Eventually become subject to private activity regulations under IRS code... financing has to be dealt with separately .... Additionally we have planned that some of that 37,000 square feet be used as compensation for the property owners .... Remainder of that square footage would be on the open market. We are suggesting... we would not do permanent financing for the commercial component... short term borrowing and that 37,000 square feet would be used as the compensation instrument... subject to the open market... we would sell it. In order to accomplish it we would like to have some acknowledgement from you... try to put together some sort of public private partnership. That is trying to secure the private capital early in the game... condominium... like to avoid the city being a commercial landlord .... Propose that we do it by way of condominium. Norton/How much of that 37,000 would be retained to deal with people who are involved already? Atkins/Subject to negotiation. We estimate... 16,000 to 18,000 square feet would likely be committed for purposes of compensation. Please do not hold me to that. Eleanor is directing those negotiations .... Thomberry/ Atkins/Total square footage, two levels. Lehman/What is the square footage that would be used for the parking offices? Atkins/About 22,000 square feet and that can be financed by parking revenue bonds .... Are there people we could approach to buy the property... support mechanism for minority and women owned business or new ideas. Atkins/If we choose to own it... caution you... incubator concept in retail, that is something a little unusual .... Normally if you make an investment in incubator space, you try to create a lot of jobs .... Our intent fight now is condominium .... Norton/...keep the city from becoming a landlord. Atkins/It doesn't mean we can't do it .... Kubby/ Atkins/ ....short term... get it built... maybe have it pre-sold... I would like your permission to explore that concept .... More difficult one is the financing of the parking garage component. We estimate that the... $8.5 million plus .... Of that, $3.5 million we will be taking pieces of it out... financed by parking revenue .... We can then legitimately finance any portion of that $8.5 million by a parking revenue bond. There are other elements to this project... financed by other means... Add alley... financed by road use tax, GO debt... cash from the parking fund .... CHANGE TAPE TO REEL 98-103 SIDE 1 Atkins/Now our projections indicate level of the $8.5- plus, including the demolition of Eastlawn, alley and some electrical .... Rate increase... year 05 .... We also we believe we can avoid using the fine revenue from the General Fund... We need to bring the negotiations on the property closer to conclusion .... There are some things I would like you to think about. That next council meeting I would like to place the formal contract to design this project on your agenda for your approval .... Move negotiations along... In the design we have approximately 3400 square feet of second floor... interest in assigning that to the Senior Center .... plus walkway is about $.5 million ..... would be GO debt .... County officials... didn't think the 3400 square feet was enough for what their interest were .... Linda... programming purposes... making sure it is filled up .... We do have an obligation to get back to the county .... County folks are very concerned about the meals program. It is simply out of space, they have got no storage .... It is really not good at all .... 8,000 square feet .... It is approaching big bucks .... It will be on your agenda for the next meeting .... We are still refining this thing. Kubby/There is going to be a huge roof on the thing, right? .... really tall... prudent to think about collecting some solar power .... Eliminating some utility bills ....If there is a way to incorporate- Atkins/I will ask that question for you. Norton/ Atkins/Solar power. Norton/Steve, fight about .... Parking ramps... Atkins/We have done our analysis of the other parking ramps .... Joe has spent the most time calculating an income to this project... done the analysis .... We feel it is going to be extensively used .... It appears...w e can afford to do this project .... Lehman/Before we have Steve proceed, if we have any strong reservations about this, now is the time to say so because at the next meeting we are going to be asked to approve the design of a building .... Substantial amount of money .... We all know the concept .... Know the numbers. I guess it is a matter of are we willing to move forward with this? .... Atkins/ Thornberry/My only concern is if we don't do this, there is not a prayer that we can do anything on Iowa Avenue .... Lehman/Exactly fight .... Thornberry/...sort of a blend... If you want to do Iowa Avenue, you got to have some place to put those cars. Kubby/I would disagree with that. I think we could do Iowa Avenue and do some other things ....Free shuttle ....Possibilities ....Diagonal parking .... Norton/There has been talk about remote lots. Champion/ Thornberry/ This represents only a reasonably accurate transcription of the Iowa City council meeting of September 21, 1998 WS092198 September 21, 1998 Council Work Session Page 16 Vanderhoef/What I need to ask is what is the commitment of the council and to what extent they are willing to remove and how much parking... off of Iowa Avenue? .... economic impact .... Down in that area .... Kubby/ Norton/Ramp is now considerably larger than before .... I haven't played out those numbers .... Vanderhoef/Originally numbers... 350 ...now up in the 600 range. Would it be more prudent to downsize the size of this ramp and the cost so we can have some on- street revenue? .... It goes away if there is no parking to fine from. Atkins/The parking meter revenue on Iowa Avenue is approximately $200,000. The fine revenue is approximately $60,000. We normally place in the General Fund $460,000 from our parking fund. What we will estimate in the future with all of Iowa Avenue gone, it will be $400,000. (All talking). Norton/How far down Iowa Avenue do you plan to take parking off?. Atkins/I would have to get the drawings out .... Gilbert Street to Clinton .... Norton/ Atkins/We made the assumption that it is all gone... in the middle of Iowa Avenue... all the way down to Gilbert .... Financial outcome is a loss of revenue .... The parking garage becomes something else. Vanderhoef/ Thornberry/...it is not zero parking? O'Donnell/How many spots are we talking about removing7 Lehman/I think we said some time ago that Iowa Avenue would not be done without a ramp .... Economies of scale... Norton/I would just like to see those numbers .... About Iowa Avenue. Phase I, Block 100, 192 spaces would be left, they would lose 69. Phase II, 119 spaces left, you lose 73. When we are all done, there is a loss of 142 spaces, subtract that from the size of the ramp which is 580 .... New spaces... very rough numbers. Champion/When this parking ramp is built .... Students... very convenient for them... free up available parking spaces .... Lehman/Do we tell Steve to move forward? Council/(Yes). Lehman/Then I have a question... folks... Harmon Building... Cottage .... Waiting... timeframe .... We need some answers for these folks... some indication .... When would demolition start? .... Atkins/First thing you have to have is a commitment to the project .... Eleanor needs the flexibility to be able to negotiate that and she also needs to understand the commitment that this is a go project .... Kubby/We did get... e-mail... think about semester break... make sure our timing would give the landlord the cue and ability .... Norton/I want to make sure the Senior Center .... Atkins/If you decide to take that space and tum it over to the Senior Center... approximately $.5 million investment .... GO debt ....Also limits the square footage that you would condominimize .... Norton/ Atkins/Eleanor still needs the ability .... Property owners will seek financial considerations better than the value that we are dealing .....with and we have not settled that. We typically don't make recommendations on design review matters, we facilitate it... We received $120,000 from Federal Home Loan Bank to expand our existing rehab program. We have closed on our first Federal Home Bank rehab loan this week. Certificates of deposit to help subsidize the construction financing for builders ....interested in producing affordable housing... University students.. determine viability of it... two major finding... low interest construction finance was not an obstacle for developers at this point .... Second finding was that major employers don't find certificates of deposits to be an attractive investment option for them ....
