RESOLUTION TO ISSUE DANCING PERMIT
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that a Dancing Permit as
provided by law is hereby granted to the following named person and at the following

RESOLUTION NO. 98-298
RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AND FILE AN APPLICATION WITH THE UNITED STATES DEPART-
MENT OF TRANSPORTATION FOR A GRANT UNDER 49 U.S.C. 5307, TO BE
USED FOR TRANSIT OPERATING AND CAPITAL ASSISTANCE FUNDING.
WHEREAS, the City of Iowa City operates a municipal transit system; and
WHEREAS, Section 5307 of Title 49 of the United States Code (U.S.C.) authorizes the Secretary
of Transportation to provide grants for mass transportation projects; and
WHEREAS, if the City receives a grant from the U.S. Department of Transportation, the contract
for financial assistance will impose certain obligations upon the City, including the obligation to
provide the local share of projects costs; and
WHEREAS, pursuant to the provisions of Title VI of the Civil Rights Act of 1964, the Department
of Transportation, in conjunction with the filing of applications for assistance under Title 53 U.S.C.
requires an applicant to provide assurances that it will comply with Title VI of the Civil Rights Act of
1964 and the Department of Transportation's requirements under Title 53 U.S.C.; and
WHEREAS, it is the City's goal to utilize disadvantaged business enterprise to the fullest extent
possible in conjunction with this project, and to establish and administer definitive procedures to
ensure that disadvantaged businesses shall have the maximum feasible opportunity to compete
for contracts when the City procures construction contracts, supplies, equipment contracts,
consultants or other services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The City Manager is authorized to execute and file an application with the U.S.
Department of Transportation, on behalf of the City of Iowa City, to aid in financing the
City's transit operations pursuant to 49 U.S.C. §5307.
The City Manager is authorized to execute and file with said application the required
assurances and any other documents required by the U.S. Department of Transportation
to satisfy the requirements of Title VI of the Civil Rights Act of 1964.
The City Manager, or the Johnson County Council of Governments (JCCOG) -
Transportation Planning Division (Transportation Planner or Assistant Transportation
Planner) acting as the City Manager's representative, are authorized to furnish such
additional information required by the Department of Transportation in connection with
said application·

The City Manager is authorized to develop and execute affirmative disadvantaged
business policies with respect to the project and the project's procurement needs.
The City Manager is authorized to execute grant agreements with the U.S. Department of
Transportation, on behalf of the City of Iowa City, for aid in financing transit operations and
capital improvements.
The Johnson County Council of Governments - Transportation Planning Division -
Assistant Transportation Planner [Kevin L. Doyle] is authorized to submit and review
Federal Transit Administration grant applications, quarterly reports, and any other required
information electronically on behalf of the City of Iowa City and Iowa City Transit with the
Federal Transit Administration.
7. Upon approval of the grant application, the grant agreement may be sent directly to
JCCOG from the Federal Transit Administration for local execution.

RESOLUTION APPROVING COMPREHENSIVE IMPROVEMENTS ASSISTANCE
PROGRAM (CLAP) BUDGET AND DESIGNATION OF MAGGIE GROSVERNOR
AS THE PROJECT OFFICER
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing
Authority and the Department of Housing and Urban Development has authorized funding for
1998 Comprehensive Improvements Assistance Program (CLAP) funds; and
WHEREAS, the City of Iowa City presently has an Annual Contributions Contract with the
Department of Housing and Urban Development to administer a Certificate, Voucher and
Public Housing Programs; and
WHEREAS, the participants of the housing assistance programs and the Citizens of Iowa City
would benefit from the Comprehensive Improvements Assistance Program funds; AND
WHEREAS, Maggie Grosvenor is the Housing Administrator of the Iowa City Housing
Authority and is the direct supervisor of the operations of the Iowa City Housing Authority.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, THAT:
The Mayor and City Clerk are hereby authorized and directed to respectively sign and
attest said certifications and agreements, and Budget to the Department of Housing
and Urban Development for ClAP funds.
The Mayor and City Clerk are hereby authorized and directed to respectively sign and
attest to the appointment of Maggie Grosvenor as the project officer.
The City Clerk is hereby authorized and directed to certify appropriate copies of this
resolution together with any necessary certifications as may be required by the
Department of Housing and Urban Development.

TO ATTEST THE RELEASE OF A LIEN REGARDING A MORTGAGE FOR THE
PROPERTY LOCATED AT 841 7th AVENUE, IOWA CITY, IOWA
WHEREAS, on June 17, 1998, the property owners of 841 7th Avenue, executed a
Mortgage through the City's Housing Rehabilitation Program; and
WHEREAS, this document created a lien against the property; and
WHEREAS, the loan was paid off on September 16, 1998; and
WHEREAS, the lien needs to be released.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT:
The Mayor is authorized to sign and the City Clerk to attest the attached Release of
Lien for recordation, whereby the City does release the property located at 841 7th
Avenue, Iowa City, Iowa from the Mortgage recorded June 18, 1998 in Book 2513,

from an obligation of the property owners, Randall J and Marti Vermace, to the City of
Iowa City in the total amount of 89,643 represented by a Mortgage recorded bn June 18,

Office.
These obligations have been satisfied and the property is hereby released from any liens or

AGREEMENT, A PROMISSORY NOTE AND A MORTGAGE FOR THE

WHEREAS, on May 16, 1991, the property owner of 15 North Lucas Street executed a
Rehabilitation Agreement, a Promissory Note and a Mortgage in the form of a t~ree-year no
interest loan for the amount of ~1,860.00 through the City's Housing Rehabilitation
Program, and
WHEREAS, these documents created a lien against the property; and
WHEREAS, the owner paid off the loan on August 31, 1998; and
WHEREAS, the lien needs to be released.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached

RESOLUTION AMENDING THE BY-LAWS OF THE POLICE CITIZENS REVIEW
BOARD TO ALLOW COMMUNITY FORUMS TO BE HELD IN NON-CITY,FACILITIES
IN IOWA CITY.
WHEREAS, the Police Citizens Review Board desires to amend its by-laws to allow community
forums to be held in non-City facilities in Iowa City; and
WHEREAS, the Police Citizens Review Board recommended approval of said amendments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:

RESOLUTION APPROVING THE PRELIMINARY PLAT OF COUNTRY CLUB

WHEREAS, the owner, S & J Development, filed with the City Clerk of Iowa City, Iowa, an
application for approval of the preliminary plat of Country Club Estates First Addition; and
WHEREAS, the Department of Planning and Community Development and the Public Works
Department examined the preliminary plat and recommended approval; and

28E Agreement regarding annexation and extraterritorial review of subdivisions between
Iowa City and Coralville
At your July 28, 1998 City Council meeting, you deferred action on the proposed amendment to
the 28E Agreement between Iowa City and Coralville regarding annexation and extraterritorial
review of subdivision plats. Your deferral was over concerns about the proposed split of
extraterritorial subdivision review authority in the area north of Iowa City which is not part of
either Iowa City or Coralville's long range growth areas. In the current agreement this review
dividing line runs along a ridge west of County Road W-66 (Dubuque Street extended). Since
Coralville's long range growth boundary has now been extended to Dubuque Street, the
subdivision review line is proposed to be the Iowa River.
This matter was discussed at the September 16, 1998 meeting between the City Councils of
Coralville and Iowa City, the Iowa City School Board, and the Johnson County Board of
Supervisors. There was discussion of modifying the area between Dubuque Street and the river
to be under Iowa City review authority or joint review authority, but this matter was left
unresolved. The proposed amendment to the agreement for consideration at your September
22 meeting continues to reflect extraterritorial subdivision review authority being divided
between Iowa City and Coralville along the Iowa River.
The City of Coralville has already approved the amended agreement. They have also annexed
the Barrington Heights area which was formerly part of the Iowa City extraterritorial review area.
The existing agreement states that if either City annexes .property in the extraterritorial review
area, the agreement is invalidated and should be renegotiated.

RESOLUTION REPEALING RESOLUTION NO. 96-264 AND ESTABLISHING
THE DESIGN REVIEW COMMITTEE AS A STAFF COMMITTEE.
WHEREAS, the Design Review Committee was established in 1974 to assist the City Council in
the review of design elements in urban renewal projects; and
WHEREAS, urban renewal is nearly complete with the exception of one project; and
WHEREAS, the responsibilities and authority of the Design Review Committee have been
somewhat limited in recent years; and
WHEREAS, the City Council wishes to continue to review the design of buildings and projects as .
outlined in the pertinent sections of the Iowa City Code; and
WHEREAS, recruitment of members to the Design Review Committee has been difficult and
attaining a quorum at meetings has been problematic.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The Design Review Committee, as an appointed citizen committee, is hereby dissolved and
City Council Resolution No. 96-264, which established said citizen committee, is hereby
repealed.
The City Manager is directed to appoint a staff committee to serve the functions of the Design
Review Committee outlined in the Iowa City Code and City Council Resolution No. 97-303
approving Design Review Committee Procedures and Guidelines for Projecting Signs. This
committee will include the City Architect, at least two members of the Department of Planning
and Community Development, one member of the Department of Housing and Inspection
Services, and one other person.

Re: Need for Design Review Committee
I would like to respond to the Council's consideration of changing or eliminating the Design
Review Committee (DRC). Currently, citizen members of the committee volunteer their expertise
and time in hopes of making Iowa City a better place. The DRC has served the Council, property
owners, and the community very well. This is an excellent arrangement! With support from the
City Council, the DRC can be an enthusiastic, valuable asset not only to the Council, but to the
people of Iowa City as well. However, there is a need for some evaluation of this committee.
In Karin Franklin's letter to the Council regarding Design Review (dated August 24, 1998), she
identifies the problems this citizen committee has faced. "Over the last few years .... the DRC
has had limited ability to influence design. Some members have become discouraged by the lack
of support by the City Council for more extensive design review authority for the Committee;
attendance has been poor and vacancies on the Committee hard to fill." Karin offers three
options the Council might pursue to change design review:
If the Council feels there is no need for design review at all, eliminate
the committee and amend the Code. The Council will lose all ability
to influence design.
Design review could be administrated through city permits. This
would require revision of codes and interpretation of these criteria
will be problematic.
Appoint a staff committee. This, too, will require substantial effort
by the city, and it will be difficult to substitute the expertise that has
served on the citizen committee. The DRC has had three licensed,
practicing architects, landscape architects, and design professionals
serving the City Council.
If these are the options, the best solution is to utilize the citizen committee.
The need for design review, especially in the downtown area, is greater than ever· It did not end
with the inventory of urban renewal parcels. After all, remodeling, renovation and renewal will be
on-going. The face of downtown is in transition. Existing businesses and new business
development are acutely aware of this environment. I believe downtown property owners will be
more amiable to seek design advice from a citizen design review committee than from a city staff
committee.
The DRC is very aware that some changes need to be made. It has been in the process of self-
evaluation; evaluating the duties prescribed to it, and the services it could be providing. Should
the Council encourage this committee, I believe the enthusiasm, attendance, and participation of
members will be dramatically improved. Please consider utilizing the DRC for the benefit of the
Iowa City community.

Plaza planting beds and that no other temporary fencing measure be taken while the City waits

be incorporated into a comprehensive streetscape plan.

for New or Refurbished Streetscapes or Exterior Spaces was awarded to the First National Bank.

WHEREAS, the City of Iowa City seeks to have a new landfill scale house and computerized scale
system operational by June 29, 1999, to expand the landfill site to include a recycling center and
household hazardous waste drop site, and to integrate all work with H.R. Green study and master
plan for future expansion; and
WHEREAS, these facilities shall improve and expand upon solid waste collection, separation,
recycling, and landfilling functions already existing; and
WHEREAS, the City wishes to proceed with architectural services with the architectural firm of
Wehner Pattschull and Pfiffner, PC of Iowa City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,

CONSULTANT AGREEMENT
for the
Iowa City Landfill and Recycle Center Project
THIS AGREEMENT, made and entered into this 22 day of September, 1998, by and between the
CITY of Iowa City, a municipal corporation, hereinafter referred to as the CITY and Wehner,
Pattschull and Pfiffner, PC of Iowa City, Iowa, hereinafter referred to as the CONSULTANT.
WHEREAS, and CITY of Iowa City seeks to have a new Landfill scale house and computerized
scale system operational by June 29, 1999; to expand the Landfill site to include a recycling
center and household hazardous waste drop site; and to integrate all work with the H.R. Green
study and master plan for future expansion, hereinafter referred to as the PROJECT and
WHEREAS, these facilities shall be designed for ease of maintenance and long term use and
WHEREAS, these facilities shall improve and expand upon solid waste collection, separation,
recycling and landfilling functions already existing.
NOW, THEREFORE, it is agreed by and between the parties hereto that the CITY does now
contract with the CONSULTANT to provide ssrvices for the PROJECT as set fodh herein.
The work to be performed by the CONSULTANT under the Scope of Services shall encompass
and include all detail work, services, materials, equipment and supplies necessary !o prepare
and deliver preliminary plans, final plans and contract documents for the PROJECT.
1. SCOPE OF SERVICES
The Consultant Agrees to Perform the Following:
1.1 Schematic Desiqn Phase
1.1.1

The CONSULTANT shall review and provide a preliminary evaluation of the
PROJECT program, schedule, and budget.
The CONSULTANT shall prepare drawings and other documents integrating
masterplan and building design which depict several alternative concepts which
satisfy program, schedule and budget requirements and make a
recommendation to the CITY as to the most appropriate and/or ranking of the
alternatives. CONSULTANT shall rigid mount one set of drawings for public
presentation.
1.1.3
The CONSULTANT shall prepare a preliminary estimate of construction cost in
sufficient detail to Identify PROJECT phasing requirements, contingencies,
design costs through construction administration, depadmental subdivisions, and
any add or deduct alternates recommended.
1.1.4 The CONSULTANT shall obtain CITY approval prior to proceeding to the next
phase of design.

1.2.1
The CONSULTANT shall prepare drawings and other documents which describe
the PROJECT'S size, structural system, exterior appearance, colors, and
materials, mechanical and electrical systems, floor to floor relationships, site
relationships, and other appmpdate elements.
1.2.2 CONSULTANT shall rigid mount one set of drawings for public presentation.
1.2.3 CONSULTANT shall update the schematic design preliminary construction cost
estimate.
1.2.4 The CONSULTANT shall obtain CITY approval pdor to proceeding to the next
phase of design.

Construction Document Phase
1.3.1
Based on the Design Development documents prepared by the CONSULTANT
approved by the CITY, the CONSULTANT shall prepare for approval by the
CITY, Construction Documents consisting of drawings and specifications setting
fodh in complete detail the requirements for the construction of the PROJECT.
1.3.2
Drawings shall be completed in electronic format AutoCAD 14 or compatible
program approved by the CITY. All electronic data shall be transferred to the
CITY on disks. In addition plots of all drawings shall be given to the CITY.
1.3.3 A hard copy master set of specifications shall be given to the CITY.
1.3.4 The CONSULTANT shall prepare a final construction cost estimate.
1.3.5 The CONSULTANT shall assist the CITY in preparing and filing of approval
documents required of government agencies with authority over the PROJECT.
1.3.6 CONSULTANT shall provide one dgid mounted set (24" x 36") of colored, with
shades and shadows, building elevations for presentation to the CITY Council.

1.4.1 The CONSULTANT shall assist the CITY in obtaining bids for the PROJECT
which includes but is not limited to holding a prebid conference, preparation and
distribution of addenda, responding to contractor inquiries, documentation of plan
holders, distribution of plan sets, approval of substitutions, assistance with bid opening,
providing bid analysis, and providing a recommendation of contract award.

The CONSULTANT shall assist the CITY in preparing and awarding the
contracts for construction.

Construction Contract Administration Phase
1.5.1
The CONSULTANTS construction review and inspection responsibilities begin
with the City Council award of contract and ends with the final payment 30 days
after formal City Council acceptance of work.
1.5.2
The CONSULTANT shall visit the site at intervals necessary to become familiar
with the progress and quality of work and to determine in general it the work is
being performed in a manner indicating that work, when complete, will be in
accordance with the contract documents, From the beginning of footing and
foundation construction through the "Certificate of Substantial Completion: site
visits shall be at intervals appropriate to the stage of construction, and in
addition, upon reasonable request of the CITY.
1.5.3 The CONSULTANT shall not be required to be continuously on site.
1.5.4
The CONSULTANT shall as necessary but no less than monthly keep the CITY
informed on the progress and quality of work and endeavor to guard the CITY
against defects and deficiencies in the work.
1.5.5 The CONSULTANT shall at all times have access to the work in progress,
unless specifically denied in writing by the CITY.
1.5.6 The CONSULTANT shall review the Contractor's "Application for Payments" and
make recommendations on the amount to be paid.
1.5.7
The CONSULTANT shall have authority to reject work that does not conform to
the contract documents and with mutual consent of the CITY may require
additional tests and inspections be conducted to Insure contract document
compliance of questionable components.
1.5.8
The CONSULTANT shall prepare and process all required "Field Instructions"
and "Change Orders" and review and approve or take other appropriate action
on Contractor submittals in a timely manner (ten (10) working days or less) so as
not to delay construction, but such review and approval shall be for the limited
purpose of checking for conformance with the information provided and the
design concept expressed in the signed documents.
1.5.9
The CONSULTANT shall prepare electronic media "record set" at the completion
of construction and deliver disks tot he CITY at the time of final construction
payment,

1.6.1 Incorporate in scope of services, design parameters for energy, conservation,
recycle and reuse.

1.6.2 Research availability of energy conservation and recycling related grants on both state
and national levels. Assist in preparation of grant applications.

1.7 Services or Expenses Which Shall Be Provided by the CITY
1.7.1
The CITY shall provide information regarding special equipment and system
requirements for the PROJECT.
1.7.2 The CITY shall provide an updated budget including construction cost, CITY
costs, and contingencies.
1.7.3
The city shell designate a staff representative as the primary contact for the
CONSULTANT to coordinate any CITY response required of inquiries by the
CONSULTANT. CITY decisions and responses will be rendered in a timely
manner.
1.7.4 The CITY shall furnish all test, inspections, and repods required by law or the
contract documents.
1.7.5
The CITY shall respond in writing if information, surveys, and reports given to
the CONSULTANT have questionable reliability, beyond those disclaimers given
in such information, surveys, and repods.
1.7.6
The CITY shall promptly in writing inform the CONSULTANT of any PROJECT
deficiencies discovered by the CITY dudrig its normal review of the progress of
work.
1.7.7
If the CITY requires cedi~cation of any podion of the PROJECT work by the
CONSULTANT, the language of such cedification shall be submitted to the
CONSULTANT for the review an mutual approval at least 14 days prior to
execution.
2. GENERALTERMS
2.1
The CONSULTANT shall not commit any of the following employment practices and
agrees to prohibit the following practices in any subcontracts.
2.1.1
To discharge or refuse to hire any individual because of their race, color,
religion, sex, national odgin, or disability, age, marital status, sexual orientation
or gender identity.
2.1.2
To discriminate against any individual in terms, conditions, or privileges or
employment because of their race, color, religion, sex, national origin, disability,
age, madtal status, sexual orientation or gender identity.
2.2
Should the CITY terminate this Agreement, the CONSULTANT shall be paid for all work
and services performed up to the time of termination. However, such sums shall not be
greater than the "lump sum" amounts listed in Section 4. The CITY may terminate this
Agreement upon seven (7) calendar days' written notice to the CONSULTANT.

This Agreement shall be binding upon the successors and assigns of the padies hereto,
provided that no assignment shall be without the wdtten consent of all Padies to said
Agreement.
It is understood and agreed that the retention of the CONSULTANT by the CITY for the
purpose of the PROJECT shall be as an independent contractor and shall be exclusive,
but the CONSULTANT shall have the dght to employ such assistance as may be
required for the performance of the PROJECT.
It is agreed by the CITY that all records and files pedaining to information needed by the
CONSULTANT for the PROJECT shall be available by said CITY upon reasonable
request to the CONSULTANT. The CITY agrees to furnish all reasonable assistance in
the use of these records and files.
It is furlher agreed that no Pady to this Agreement shall perform contrary to any state,
federal, or local law or any of the ordinances of the CITY of Iowa CITY, Iowa.
At the request of the CITY, the CONSULTANT shall attend such meetings of the CITY
Council relative to the work set fodh in this Agreement. Any requests made by the CITY
shall be given with reasonable notice to the CONSULTANT to assure attendance.
The CONSULTANT agrees to furnish, upon termination of this Agreement and upon
demand by the CITY, copies of all basic notes and sketches, chads, computations, and
other data prepared or obtained by the CONSULTANT pursuant to this Agreement
without cost, and without restrictions or limitation as to the use relative to specific
PROJECTs covered under this Agreement. In such event, the CONSULTANT shall not
be liable for the CITY'S use of such documents on other PROJECTs.
The CONSULTANT agrees to furnish all completed repods, specifications, and
drawings, with the seal of a professional engineer affixed thereto or such seal as
required by Iowa law.
The CITY agrees to tender the CONSULTANT all fees in a timely manner, excepting,
however, that failure of the CONSULTANT to satisfactorily perform in accordance with
this Agreement shall constitute grounds for the CITY to withhold payment of the amount
sufficient to propedy complete the PROJECT in accordance with this Agreement.
Should any section of this Agreement be found invalid, it is agreed that the remaining
podion shall be deemed severable from the invalid podion and continue in full force and
effect.
Original contract drawings shall become the properly of the CITY. The CONSULTANT
shall be allowed to keep mylar reproducible copies and/or computer disk for the
CONSULTANT's own use.
Fees paid for securing approval of authorities having jurisdiction over the PROJECT will
be paid by the CITY.
Upon signing this agreement, CONSULTANT acknowledged that Section 362.5 of the
Iowa Code prohibits a CITY officer or employee from having an interest in a contract
with the CITY, and certifies that no employee or officer of the CITY, which includes
members of the CiTY Council and CITY boards and commissions, has an interest, either

direct or indirect, in this agreement, that does not fall within the exceptions to said
statutory prohibition enumerated in Section 362.5.
3. SCHEDULE
3.1 Time of Coml~letion
The CONSULTANT shall complete the following phases of the PROJECT in accordance with the
schedule shown. The work will commence within one week of receipt of wdtten notice to
proceed.
Schematic design complete - October 5, 1998
Design development complete - November 5, 1998
Construction documents complete - December 22, 1998
Bidding and negotiations - January 25, 1999
4. COMPENSATION FOR SERVICES
4.'1 Method of Payment
CITY shall pay CONSULTANT for services rendered under Section I - Scope of Services the
Lump Sum of $122,420.00. This is based on the preliminary PROJECT construction budget
estimate of six hundred thousand twenty dollars ($620,000). Should the CITY agree in writing to
substantially increase or decrease the budget for the project (by 15%), this lump sum fee may be
renegotiated.
4.2 Payment Schedule

Stipulated sum. The stipulated sum shall be paid in padial amounts equal to
the percentage of progress of work dudng each design phase. Payments will be
made no more than once monthly according to the CITY's schedule of check
release and papenNork deadline, dates, allowing time for CITY staff review of
payment applications.
If the CITY fails to make monthly payments due CONSULTANT, CONSULTANT
may, after giving seven (7) days written notice to CITY, suspend services under
the Agreement until CITY has paid in full all amounts due.
CONSULTANT shall provide working drawings and other documentation
deemed necessary to the CITY at meetings held periodically during the design
phase and reach mutual agreement that work has been performed in accordance
with the attached schedule.
4.3 Reimbursables
The following shall be considered the only reimbursable expenses allowed when directly incurred
for work on this PROJECT (payments shall be made on scheduled check release dates as per
above as sums accumulate):

4.3.1 Reproductions of drawings and specifications provided during the bidding
process. The number and cost of Bid Documents shall be agreed to in writing.
4.3.2 Postage and handling of documents dudng the bidding process.
Additional Services
Additional services are those CONSULTANT services beyond those described tn the
scope of services and agreed to in writing by both padies. Payments for additional
services, if any, shall be made as h~cu.rred and as per CITY's scheduled check release
dates as noted above. Computation of additional CONSULTANT services shall be
calculated as follows:
Principal's time at $70.00 per hour.
Employees' time per the schedule of hourly rates provided for the personnel
involved, as provided in Attachment A.
SUBCONSULTANTS at 1.1 times amounts billed the CONSULTANT.
4.4.1
The CONSULTANTS's records for the preparation of fees pedaining to the
PROJECT shall be available to the CITY or CITY's authorized representative at
mutually convenient times.
MISCELLANEOUS
Insurance Requirements
Cedificate of Insurance, Cancellation or Modification
Before commencing work, the CONSULTANT shall submit to the CITY, for approval, a
Cedificate of Insurance meeting the requirements specified herein, to be In effect for the
full contract period.
The CONSULTANT shall notify the CITY in writing at least thidy (30) calendar days prior
to any change or cancellation of said policy of policies.
Cancellation or modification of said policy or policies shall be considered just cause for
the CITY to immediately cancel the Agreement and/or halt work on the PROJECT, and
to withhold payment for any work performed on the contract.
Minimum Coverage
Any policies of insurance purchased by the CONSULTANT to satisfy its responsibilities
under this Agreement shall include contractual liability coverage, and shall be in the
following type and minimum amounts:

1.10.7 If the CITY requires certification of any portion of the PROJECT work by
the CONSULTANT, the language of such certification shall be submitted
to the CONSULTANT for review and mutual approval at least 14 days
prior to execution.
GENERAL TERMS
The CONSULTANT shall not commit any of the following employment practices
and agrees to prohibit the following practices in any subcontracts.

To discharge or refuse to hire any individual because of their race, color,
religion, sex, national origin, disability, age, marital status, sexual
orientation or gender identity.

To discriminate against any individual in terms, conditions, or privileges
of employment because of their race, color, religion, sex, national origin,
disability, age, marital status, sexual orientation or gender identity.
Should the CITY terminate this Agreement, the CONSULTANT shall be paid for
all work and services performed up to the time of termination. However, such
sums shall not be greater than the "lump sum" mounts listed in Section 4. The
CITY may terminate this Agreement upon seven (7) calendar days' written notice
to the CONSULTANT.
This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be without the written consent of all
Parties to said Agreement.
It is understood and agreed that the retention of the CONSULTANT by the CITY
for the purpose of the PROJECT shall be as an independent contractor and shall
be exclusive, but the CONSULTANT shall have the right to employ such
assistance as may be required for the performance of the PROJECT.
It is agreed by the CITY that all records and files pertaining to information needed
by the CONSULTANT for the PROJECT shall be available by said CITY upon
reasonable request to the CONSULTANT. The CITY agrees to furnish all
reasonable assistance in the use of these records and files.
It is further agreed that no Party to this Agreement shall perform contrary to any
state, federal, or local law or any of the ordinances of the CITY of Iowa CITY,
Iowa.
At the request of the CITY, the CONSULTANT shall attend iuch meetings of the
CITY Council relative to the work set forth in this Agreement. Any requests

made by the CITY shall be given with reasonable notice to the CONSULTANT to
assure attendance.
-.'[,he CONSULTANT agrees to furnish, upon termination of this Agreement and
u~ demand by the CITY, copi6s of all basic notes and sketches, charts,
comp'b'mations, and any other data prepared or obtained by the CONSULTANT
pursuant to this Agreement without cost, and without restrictions or limitation as
to the use relative to specific PROJECTs covered under this Agreement. In such
event, the CONSULTANT shall not be liable for the CITY'S use of such
documents on other PROJECTs.
The CONSULTANT agrees to furnish all completed reports, specifications, and
drawings, with the seal of a professional engineer affixed thereto or such seal as
required by Iowa law.
The CITY agrees to tender the CONSULTANT all fees in a timely manner,
excepting, however, that failure of the CONSULTANT to satisfactorily perform
in accordance with this Agreement shall constitute grounds for the CITY to
withhold payment of the amount sufficient to properly complete the PROJECT in
accordance with this Agreement.
Should any section of this Agreement be found invalid, it is agreed that the
remaining portion shall be deemed severable from the invalid portion and
continue in full force and effect.
Original contract drawings shall become the property of the CITY. The
CONSULTANT shall be allowed to keep mylar reproducible copies and/or
computer disk for the CONSULTANTs own use.
Fees paid for securing approval of authorities having jurisdiction over the
PROJECT will be paid by the CITY.
Upon signing this agreement, CONSULTANT acknowledged that Section 362.5 of
the Iowa Code prohibits a CITY officer or employee from having an interest in a
contract with the CITY, and certifies that no employee or officer of the CITY,
which includes members of the CITY Council and CITY boards and commissions,
'has an interest, either direct or indirect, in this agreement, that does not fall within
the exceptions to said statutory prohibition enumerated in Section 362.5.

COMPENSATION FOR SERVICES
4ol Method of Payment
CITY shall pay CONSULTANT for services rendered under Section I - Scope of Services the
Lump Sum of $174,200.00. Based on the preliminary PROJECT construction budget estimate of
nine hundred thousand dollars ($900,000). Should the CITY agree in writing to substantially
increase or decrease the budget for the project (by 15%), this lump sum fee may be
renegotiated.
4.2 Payment Schedule
4.2.1
Stipulated sum. The stipulated sum shall be paid in padial amounts equal to
the percentage of progress of work dudng each design phase. Payments will be
made no more than once monthly according to the CITY's schedule of check
release and paperwork deadline, dates, allowing time for CITY staff review of
payment applications.
4.2.2

If the CITY fails to make monthly payments due CONSULTANT, CONSULTANT
may, after giving seven (7) days wdtten notice to CITY, suspend services under
the Agreement until CITY has paid in full all amounts due.
CONSULTANT shall provide working drawings and other documentation
deemed necessary to the CITY at meetings held periodically dudng the design
phase and reach mutual agreement that work has been performed in accordance
with the attached schedule.

4.3 Reimbursables
The following shall be considered the only reimbursable expenses allowed when directly
incurred for work on this PROJECT (payments shall be made on scheduled check release
dates as per above as sums accumulate):

Reproductions of drawings and specifications provided during the bidding
process. The number and cost of Bid Documents shall be agreed to in
writing.
4.3.2 Postage and handling of documents during the bidding process.
4.4 Additional Services
Additional services are those CONSULTANT services beyond those described in
the scope of services and agreed to in writing by both parties. Payments for
additional services, if any, shall be made as incurred and as per CITY's scheduled
check release dates as noted above. Computation of additional CONSULTANT
services shall be calculated as follows:

4.4.1

PROJECT shall be available to the CITY or CITY's authorized
representative at mt~tually convenient times.
5. MISCELLANEOUS'
5.1 Insurance ReqUii'ements
5.1.1 Certificate of Insurance, Cancellation or Modification
Before commencing work, the CONSULTANT shall submit to the CITY, for
approval, a Certificate of Insurance meeting the requirements specified herein, to
be in effect for the full contract period.
The CONSULTANT shall notify the CITY in writing at~ least thirty (30) calendar
days prior to any change or cancellation of said policy o~policies.

Cancellation or modification of said policy or policies shall be considered just
cause for the CITY to immediately cancel the Agreement and/or halt work on the
PROJECT, and to withhold payment for any work performed on the contract.
5.1.2 Minimum Coverage
Any policies of insurance purchased by the CONSULTANT to satisfy its
responsibilities under this Agreement shall include contractual liability coverage,

We have selected a consultant to design a permanent replacement building for the landfill scale house,
after the windstorm demolished the trailer on June 29. We have also just completed a study ofthe long
term technical and financial operation of the landfill. It seems clear the City's intention is to continue to
provide solid waste disposal services into the foreseeable, for the community.
Considering the changing nature of solid waste disposal regulation, legislation, and even the public's
expectation, it seems it would be an appropriate time to consider a significant addition to routine solid
waste disposal services offered by the City oflowa City. We feel we should incorporate a "Household
tl. Tnrdous Waste" (HHW) collection and exchange Facility into the plans currently being developed for
the landfill site.
The public demand for the collection of HHW has been growing. This is evident by the great
participation in our annual HHW Clean Up dayS, in the mount of this matedal being deposited at the "de
facto" HHW/waste oil drop off site, and in the number of phone requests for assistance in disposing of
obviously toxic materials from the public. Since June, we have already had calls From households
holding such things as elemental mercury, lead arse~ate, banned weed killer, and fluoreseent bulbs
(conLain mercury). The community is highly educated and motivated to recycle and safely dispose of
hazardous materials. Many express disappointment in not having an effective disposal option when their
need arises, and often express a willingness t~ pay "reasonable" fees for such a service.
The community would benefit by establi~ing an HHW center in a couple ways. First, homes would
contain fewer toxic/health hazaMs by the regular removal or unusable or unwanted products. Secondly,
the landfill area it self would have le{;s of these materials actually being "buried", reducing the potential
impact on groundwater and on the ;:vastewater treatment plant, where leachate is treated.
We have envisioned attaching an |HtW center to the scale house operation, in order to utilize present staff
in monitoring and instructing the public in HHW procedures. The project would also re-organize the site
layout and access roads to more efficiently accept the various "salvage" and recycle materials presently
handled on site. We would like to see the entire facility developed in ways that would highlight recycled,
renewable resource pi:oducts, and energy conservation products, in order to Further educate the public on
solid waste problems.
In order to proceed with the permanent scale house and these other concepts, we would like to give the
architectural and engineering designers a scope for their work, as soon as possible. Please let me know if
you are in agreement with this approach.

hazardous wastes. We tell them to wait for our "once per year" collection day, or describe
appropriate actions they could take. Many people try to comply but many are also frustrated.

The LandFall Division is anxtous to get an effective program starled to coiled household hazardous waste (IIHW)
materials. Such a program should evenlually reduce contaminants in leachate, lowering the risk for gmundwaler
problems, and also reduc'tng the load of conlaminants at the wastewater treatment plant.
We feel the landflU site would be the preferred location for an HItW facility. The rollowing points outline the

at such a facility.
3. The landf'dl is staffed 57 hours per week (9. 5 hrs, 6 days) including Saturday.

These employees have been dealing with the public and their various, unusual waste products for
some time.
5. Two derks (scaleh~jnse operators) are available for accepting appointments, answering telephone
questions, and monitoring public access to the facility. These clerks presently answer public questions
regarding other !andrdl acOvttles. Cash business is already conducted at the site, and could include
charges for new services.
6. The landfill is el!trendy handling other "recycling" 8cOvtlJes oll site, such as yard waste~ tires, scrap
metal, waste o~ and appltnnces. Landfill personnel handle the bulk recycling bins, as well Including
newsprint, pbi~e, glass, and cans. (cardbond collection sites will be added in the spring)
Unknown materials are chopped off frequently at the ,mmauned oH drop site In town. The sinIT
effectively dealt with gasoline, antifreeze, car ballertes, Sharps, and household waste products.
The layout of the a possible |HtW collection cenler has been sketched out by Dan Scott, and is presen~y being
reviewed by !andfill staff and the solid waste planner. It is felt the facility could be built as economically at the
landfill as anywhere sInce land and staff are available. The facility at the landfall would complement other programs

DNR. grant funds of up to $100,000 may be available for a "county wide" ItHW center. ff authorization to proceed

RESOLUTION APPROVING THE COLOR OF EXTERIOR AWNING AT, 115 E.
COLLEGE STREET.
WHEREAS, the applicant, Gringo's of Iowa City, Inc. has filed an application for design review
approval of the exterior awning at 115 E. College Street, Iowa City, Iowa, hereinafter "Project"; and
WHEREAS, given that the project consists of exterior awning color alterations occurring on a
projecting structure that was part of a project governed by Title 14, Chapter 4, Article E, entitled
"Design Review," of City Code requires the Design Review Committee to review and make a
recommendation to the City Council regarding the design of the project; and
WHEREAS, the design review application for the project, a copy of which is on file in the Department
of Public Works, has been forwarded to the Design Review Committee, and by default the
Committee has recommended the design of the project be accepted and approved; and
WHEREAS, the design of the project is found by default to conform with all of the applicable
requirements of the Design Review Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The color of the exterior awning at 115 E. College Street, Iowa City, Iowa, be approved.
2. The Mayor and City Clerk of the City of Iowa City, Iowa are hereby authorized and directed to

Re: Awning at 115 E. College St. (Gringo's of Iowa City, Inc.)
Gringo's of Iowa City, Inc. at 115 E. College Street has made application for a
new sign & new color for an existing awning. As required by the Design Review
Ordinance only the awning which projects more that a foot into the plaza is
subject to the Design Review Ordinance. As required by ordinance the
application must be reviewed by the Design Review Committee and sent to
Council within thirty (30) days of application submission, since there are currently
only three members of a seven-member committee no quorum is possible for a
meeting, consequently, this application is automatically forwarded to Council and
shall be deemed as receiving a recommendation of approval from the Design
Review Committee.
As staff assistant to the Design Review Committee, I routinely deal with these
issues and find the Gringo's application consistent with the color aesthetics of
the Downtown Plaza. I would, as concerned staff, recommend approval of this
application.

UNIVERSITY OF IOWA.
WHEREAS, the City of Iowa City, Iowa pursuant to State law, is responsible for the care,
supervision and control of streets, sidewalks, alleys and other public grounds; and
WHEREAS, the University of Iowa has been authorized by Resolution No. 76-464 to install and
maintain informational guide signs at specific sites within the public right-of-way; and
WHEREAS, the University of Iowa desires to place additional informational guide signs; and
WHEREAS, the City Council has been advised and does believe it is in the City's interest to
authorize the Director of Public Works to approve or deny and execute applications on the City's
behalf for the placement of informational guide signs by the University of Iowa in public right-of-
way, now and in the future, without City Council review and authorization.

RESOLUTION ESTABLISHING FEES OR ASSESSING COSTS FOR
CERTAIN SERVICES PERFORMED BY THE FIRE DEPARTMENT
WHEREAS, the City of Iowa City Fire Department provides certain services other than those
duties required by State and municipal law; and
WHEREAS, Occupational Safety & Health Administration regulations require employers in
general industry and governmental units to develop procedures to utilize in-house or outside
rescue services for permit-required confined space response; and
WHEREAS, the City Council of Iowa City has enacted Ordinance No. 98-3845 to provide for the
establishment of fees or assessing costs when utilizing the Fire Department's Confined Space
Rescue Team for permit-required confined space response rescue or recovery operations, and
WHEREAS, the Fire Chief has recommended the establishment of a fee or assessing costs for'
those affected commercial and industrial users within the corporate limits of the City of Iowa City
which choose to utilize the specialized services of the Fire Department's Confined Space
Rescue Team for permit-required confined space response activities as detailed herein:
A yearly fee of $300 for those affected businesses which notify the Iowa City Fire
Department that they intend to utilize the Iowa City Fire Department as their outside rescue
services provider for permit-required confined space response activities.
If the Fire Department responds to a permit-required confined space rescue service request
and the affected business has not previously notified the Fire Department that it has been
designated as the outside confined space rescue service provider and has not paid the
yearly fee of $300, such affected business shall be billed and shall pay the full cost of such
confined space rescue response costs incurred by the Fire Department.
WHEREAS, the City Council of Iowa City is desirous of charging a fee or assessing costs for
such service to offset the cost of such service;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, that the above-said schedule of fees or assessed costs for services be adopted
and effective October ]. ,1998.
