Comment: The owners of the property located at 1932 Hafor Drive received assistance through the City's Housing Rehabilitation Program for a total of 92,828 on April 11, 1995. The financing was in the form of a Rehabilitation Agreement, a Promissory Note and a Mortgage. The loan was paid off on October 1, 1998; thus, the lien can now be released. q~5- Jz~ (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A PROMISSORY NOTE IN THE FORM OF A TEN YEAR DEPRECIATION LIEN FOR THE PROPERTY LOCATED AT 724 RONALDS STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 724 Ronalds Street received assistance through the City's Housing Rehabilitation Program for a total of 911,000 on November 1, 1988. The financing was a Promissory Note in the form of Ten-Year Depreciation Lien. The terms of the lien were satisfied on October 7, 1998; thus, the lien can now be released. ~ 5- ~,~ (5) CONSIDER A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FUNDING FROM THE FEDERAL RECREATIONAL TRAILS PROGRAM. Comment: Staff is applying for a grant through the Iowa Department of Transportation from the Federal Recreational Trails Program to help fund a segment of the Willow Creek Trail from Mormon Trek Boulevard to Willow Creek Drive. The project will include widening sidewalks along Mormon Trek Boulevard and Benton Street and constructing a 1 O-foot wide asphalt trail in Willow Creek Park and Kiwanis Park. The preliminary cost estimate for this proje~,~clu ing design, construction, and administration, is 930'1,001.50. ~ ¢'le~eral Recreational Trails Program finds are available for up to 80% of the project cost, or a~c~43,745. (VAC98-0005) Comment: At its September 17 meeting, by a vote of 5-1, the Planning and Zoning Commission recommended approval of the proposed vacation, subject to utility easements and an emergency vehicle access easement being retained and subject to The University of Iowa submitting proof of ownership of all adjacent properties. Staff recommended approval in a report dated September 17. ge Consider an ordinance changing the zoning designation of approximately 9.27 acres from Low Density Single-Family Residential (RS-5) to Sensitive Areas Overlay/Medium Density Residential (OSA-8) to allow a 72-unit residential development on property located on the south side of Taft Comment: Correspondence from applicant included in Council packet requesting item be withdrawn. Action: Consider an ordinance changing the zoning designation of approximately 22 acres from Medium Density Single-Family Residential (RS-8) to Low Density Single-Family Residential (RS-5) for property located in the Summit Street Historic District. (REZ98-0010). (Second consideration) Comment: At its August 20 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. Staff recommended approval in a report dated August 6. Consider an ordinance changing the zoning designation of an approximate 4,000 square foot property located at 114 Wright Street from Community Commercial (CC-2) to Planned High Density Multiple-Family Residential (PRM). (Pass and adopt) Commission recommended approval of the recommended approval in its June 18 report. Staff October 20, 1998 City of Iowa City Page 7 Consider a motion to forward a letter to the Johnson County Board of Supervisors recommending that a request submitted by Gerald Milder to rezone 20.4 acres of land from Rural (A1)to Suburban Residential (RS-10) for property located at 4820 American Legion Road be denied. (CZ9831) Comment: At its July 16 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended that the Council forward a letter recommending that the RS-10 zoning be denied. On July 28, the City Council approved a motion to forward a letter to the Johnson County Board of Supervisors recommending denial. At the request of the applicant, the Planning and Zoning Commission reconsidered the Milder rezoning request on September 17, and recommended by a vote of 4-2 that the Council forward a letter to the Board of Supervisors recommending denial. This is consistent with the August 27 staff memorandum. The Commission suggested that City and County staff investigate whether there is some way to resolve cases such as this without running counter to the intent of the Fringe Area Agreement. Staff has incorporated a paragraph containing the Commission's suggestion into the letter that is to be forwarded to the Board of Supervisors. Consideration was deferred on October 6. ~ ~ ITEM NO. 7. PUBLIC HEARING ON AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA CITY, IOWA, BY AMENDING SECTION 8-5-5, ENTITLED "KEEPING DISORDERLY HOUSE," TO PROVIDE FOR POLICE INITIATED COMPLAINTS AND TO PROVIDE FOR POLICE AUTHORITY TO RESTORE ORDER AND DISPERSE PERSONS FROM VIOLATING PREMISES. Comment: The Iowa City Police Department and the City Attorney's Office have recommended enactment of amendments to the Disorderly House Ordinance, as they meet the goals of explicitly authorizing police involvement before the disturbance is out of control, as well as explicitly granting authority to restore order and disperse persons after a citation has been issued and to provide for penalties for violation of s.~~u '~Correspondence included in Council packet. Action: ee October 20, 1998 City of Iowa City Page 8 ITEM NO. 8. CONSIDER AN ORDINANCE AMENDING TITLE 8, CHAPTER 6, SECTION 1 ENTITLED "SALE OF CIGARETTES TO PERSONS UNDER EIGHTEEN YEARS OF AGE" OF THE CITY CODE TO PROHIBIT THE USE OR POSSESSION OF TOBACCO PRODUCTS OR CIGARETTES BY PERSONS UNDER EIGHTEEN YEARS OF AGE. (FIRST CONSIDERATION) Comment: State law currently prohibits the use or possession of tobacco products or cigarettes by persons under eighteen years of age. The City currently has no such similar ordinance in effect; although, the City has incorporated the State Code provisions pertaining to the sale and possession of tobacco products and cigarettes as part of Section 8-6-1A of the City Code as it relates to cigarette sales to persons under eighteen years of age. This amendment would amend the title to Section 8-6-1 of the City Code to reflect that Section 8-6-1A prohibits the sale of tobacco products and cigarettes to persons under eighteen years of age and prohibits the possession of tobacco products and cigarettes by persons under eighteen years of age. Under the City and State Code provisions, fines incurred and paid would be remitted to the City. ITEM NO. 9. CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE E ENTITLED "WASTEWATER TREATMENT WORKS INDIRECT DISCHARGE," Comment: This ordinance will raise the infiuent limits for zinc at the North and South Wastewater Treatment Plants. This change reflects the ability of the two plants to remove zinc from the wastewater stream. The removed zinc will become a component of the final sludge product. The zinc component of the sludge will comply with EPA and IDNR requirements for land application of wastewater sludges. October 20, 1998 City of Iowa City Page 9 ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING TITLE 3 ENTITLED "CITY FINANCES, TAXATION & FEES," CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES, AND PENALTIES" OF THE CITY CODE TO DECREASE THE RATES FOR LANDFILL USE FEES. (SECOND CONSIDERATION) Comment: Based on the recently completed Landfill Master Plan, landfill fees are proposed to be decreased by 910 per ton from 948.50 to 938.50 (Iowa City premises, subject to property tax and City-owned property) and 953.50 to 943.50 (all other), untreated wood and yard waste from 930/ton to 924/ton, minimum fee from 94.00 to 93.00 (Iowa City premises, subject to property tax and City-owned property) and 94.25 to 93.25 (all other), and adding a new fee for Asbestos Containing Material, 91 O0 and 9105/ton. ITEM NO. 11. CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE H ENTITLED "SOLID WASTE," SUBSECTION 2, ENTITLED "DEFINITIONS" OF THE CITY CODE TO AMEND SEVERAL DEFINITIONS. (SECOND CONSIDERATION) Comment: The ordinance amends several definitions within Section H, Solid Waste. A new definition is added for asbestos-containing material, friable, and nonfriable contaminated soil. Action: ITEM NO. 12. 5%53 CONSIDER AN ORDINANCE AMENDING TITLE 12, CHAPTER 4 OF THE CITY CODE, BY CHANGING THE NAME OF THE "BROADBAND TELECOMMUNICATIONS COMMISSION" TO "TELECOMMUNICATIONS COMMISSION." (PASS AND ADOPT) Comment: As a result of the merger of the various media, current and future issues addressed by the Broadband Telecommunications Commission will continue to involve a wide range of telecommunications beyond the original concept of cable TV services and delivery. The Commission felt that its name should more accurately reflect its actual responsibilities and functions and has recommended to the City Council that the name of Broadband Telecommunications Commission be changed to the Telecommunications Commission. Action: :2~/,,'~~ October 20, 1998 City of Iowa City Page 10 ITEM NO. 13. cf~5- 3~,t CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A MEMORANDUM OF AGREEMENT SUBMITTED TO THE ADVISORY COUNCIL ON HISTORIC PRESERVATION REGARDING THE IOWA INTERSTATE RAILROAD- CRANDIC RAILROAD INTERCHANGE RELOCATION PROJECT. Comment: The City of Iowa City has entered into an agreement with the Iowa Department of Transportation for a 91 .065 million grant through the Iowa Clean Air Attainment Program, to relocate the interchange between the Iowa Interstate Railroad and the CRANDIC Railroad from south Iowa City to the Amana Colonies. The City has also entered into a side agreement with the railroads for them to provide the local match for the project, construct the project, and retain ownership of the project upon completion. Federal Highway Administration under Section 106 of the National Historic Preservation Act has required investigation of a reinforced concrete slab bridge which will be removed in conjunction with construction of the new interchange, and an investigation on the impact of the project on the Iowa Amana Villages, which is a district listed on the National Register of Historic Places and a National Historic Landmark. The investigations have been completed at the expense of the railroads and findings of no adverse effect upon historic property determined in each case. This memorandum of understanding stipulates the action which has been carried out to document the impact on historic property, and requires the City of Iowa City to place the completed documentation at the State Historical Society, the Johnson County Historical Society, the Amana Colonies Land Use District, the Amana Historical Society, and the Iowa Department of Transportation. ITEM NO. 14. CONSIDER A RESOLUTION ACCEPTING THE WATER FEATURE CONCEPT CALLED "WEATHERDANCE" FOR THE NEW DOWNTOWN WATER FEATURE AND AUTHORIZING NEGOTIATION OF A CONTRACT WITH THE ARTISTS ANDREA MYKLEBUST AND STANTON SEARS. Comment: At their meeting of October 14, 1998, the Public Art Advisory Committee recommended by a vote of 6-0 that the water feature concept by Myklebust/Sears called "Weatherdance" be accepted by the City Council and that a contract with the artists be pursued. . CONSIDER A RESOLUTION TEMPORARILY CLOSING A PORTION OF JEFFERSON STREET RIGHT-OF-WAY AND AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY AND THE UNIVERSITY OF IOWA. Comment: The University of Iowa desires to construct the Spence Laboratories Chilled Water Connection Project located on the south side of Jefferson Street between Dubuque Street and Gilbert Street. The temporary use and closure of City right-of-way along Jefferson Street is necessary during construction to secure the construction site against pedestrian and vehicular traffic, and provide adequate space for construction. Closure includes the removal of on-street parking and the south traffic lane between Dubuque Street and Gilbert Street on Jefferson Street. The anticipated starting date for this project is November 1, 1998, and is expected to be finished no later than Jonuary 31, 1999. Action: CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN AGREEMENT WITH JAMES AND LORETTA CLARK, FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY FOR A PORTION OF MARKET STREET IN IOWA CITY, IOWA. Comment: This temporary agreement is to allow James and Loretta Clark to temporarily close City sidewalk adjacent to their property addressed as 414 E Market Street along the north edge of Market Street between Gilbert and Van Buren Streets. This agreement is requested in order to facilitate the safe construction of a house addition and to secure the construction site from pedestrian traffic. The City Forester has been consulted regarding protection of the right-of-way trees during construction. Action: October 20, 1998 City of Iowa City Page 12 ITEM NO. 17. ITEM NO. 18. CONSIDER A RESOLUTION AUTHORIZING FUNDING FOR THE AIRPORT COMMISSION TO PROCEED WITH CONSTRUTION OF A 120' BY 140' AIRCRAFT HANGAR BUILDING, INCLUDING 20' BY 60' OFFICE AREA, AT THE IOWA CITY MUNICIPAL AIRPORT. Comment: At the September 16, 1998, Airport Commission meeting, the Airport Commission received bids to construct a new FBO hangar. The building will replace the shop maintenance building and the United hangar. The following bids were received: Unzeitig Construction Abild Construction Knutson-MidAmerica McComas-Lacina Construction Wendler Engineering and Construction $850,400 $742,000 $734,614 $684,596 $681,000 The Commission recommends the bid from Wendler Engineering and Construction for $681,000. The Airport Commission has a lease with Iowa City Flying Service that will pay back the loan for the building, including interest. This lease is separate from the fixed base operator (FBO) lease. CONSIDER A RESOLUTION OF INTENT TO LEASE APPROXIMATELY 3.7 ACRES OF CITY-OWNED LAND ON THE LOWER PENINSULA TO THE BENEVOLENT AND PROTECTIVE ORDER OF ELKS OF THE U.S.A. CORP., LODGE NO. 590 FOR USE AS A GOLF DRIVING RANGE, AND SETTING A PUBLIC HEARING FOR NOVEMBER 3, 1998. Comment: As part of earlier negotiations with the Elks, the City granted the Elks a permanent easement to establish two golf holes on land known as the lower peninsula. The Elks have requested that the City lease them an additional approximately 3.7 acres of land next to the two golf holes to use as a driving range. CONSIDER A City of Iowa City Page 13 O~/~4J ,29 MOTION SETTING PUBLIC DISCUSSION FOR/NOVEMBER 3, 1998, REQUESTING PUBLIC INPUT ON THE PROPOSED BALLOT LANGUAGE AND POLICY STATEMENT REGARDING THE IMPOSITION OF A LOCAL SALES TAX. Comment: Iowa City Council has discussed imposing a local sales tax of one cent. After a number of meetings, the proposed language was developed. The purpose of the public discussion is to hear citizen input on the language and policy statement. Plans call for Council to act on the calling of a special election at their regular meeting on November 17. City of Iowa City MEMORANDUM Date: October 19, 1998 To: Mayor and City Council From: City Clerk Re: Addition to the October 20, 1998 Agenda **ITEM NO. 20 CONSIDER A RESOLUTION TO ADOPT THE IOWA CITY POLICE CITIZENS REVIEW BOARD STANDARD OPERATING PROCEDURES AND GUIDE- LINES. Comment: Section 8-8-7(4) of the City Code establishes the Police Citizens Review Board (PCRB) and requires that procedural rules be approved by the City Council. Af- ter months of review the PCRB adopted standard operating procedures and guidelines at their September 15 meeting, and recommended approval by the City Council at their October 6 meeting. Staff recommends deferral of the resolution until November 17 to allow time for review. * *Renumber the rest of the agenda beginning with Announcement of Vacancies as ITEM NO. 21. October 20, 1998 City of Iowa City Page 14 ITEM NO~. (8) Senior Center Commission: Two vacancies to fill three-year terms ending December 31, 2001. (Terms expire for Philip Zell and Kenneth Mobily.)
