Washington www.icgov.org ITEM NO. 1 CALL TO ORDER Roll Call ITEM NO. 2 CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY," __O5_~ ~! -~'~. CHAPTER 3, ENTITLED "COMMERCIAL USE OF SIDEWALKS," SECTION 4, ENTITLED "TEMPORARY USE OF SIDEWALK PERMITS" TO ALLOW FOR THE COMMERCIAL USE OF SIDEWALKS DURING THE HOURS OF THE FRIDAY NIGHT CONCERT SERIES. (Second Consideration) Comment: This will allow businesses to place items for sale on the sidewalk areas downtown during the summer, primarily in association with the Friday Night Concert Series. The permitting process will be the same as applies to other sidewalk sales events. Staff has recommended expedited consideration. Action: . Special Agenda May 6, 2005 Page 2 ITEM NO. 3 ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 3, ENTITLED "CITY UTILTIES," ARTICLE H, ENTITLED "SOLID WASTE," SECTION 8, ENTITLED "STORAGE OF SOLID WASTE" BY AMENDING SUBSECTION E, ENTITLED "LOCATION OF SOLID WASTE CONTAINER," AND BY ADDING A NEW SUBSECTION F, ENTITLED "DOWNTOWN SOLID WASTE CONTAINER CODE" TO ESTABLISH A PERMIT SYSTEM FOR STORAGE OF SOLID WASTE CONTAINERS IN THE DOWNTOWN PUBLIC RIGHTS-OF-WAY. (First Consideration) Comment: There are nearly 100 solid waste containers (dumpsters) in the alleys in the downtown, many of which are overflowing and unsanitary. Although City Code section 14-3H-SE presently requires a written agreement among the City Council, the hauler, and the property owner to have a container in the right-of-way, that generally has not been enforced. This ordinance creates a permit process for the containers in the downtown alleys, which will not require Council action on every container and which will be easier for the City to enforce. The specific requirements of the permitting system will be established by resolution. Any container without a permit sixty (60) days after the effective date of this ordinance must be removed. Action: ~-~'~.,,~.~ ITEM NO. 4 CONSIDER A MOTION TO ADJOURN TO EXECUTIVE SESSION TO DISCUSS STRATEGY WITH COUNSEL IN MATTERS THAT ARE PRESENTLY IN LITIGATION OR WHERE LITIGATION IS IMMINENT WHERE ITS DISCLOSURE WOULD BE LIKELY TO PREJUDICE OR DISADVANTAGE THE POSITION OF THE GOVERNMENTAL BODY IN THAT LITIGATION. Action: ITEM NO. 5 CONSIDER A RESOLUTION RATIFYING SETTLEMENT OF PENDING LITIGATION. Comment: Depending on discussion during executive session scheduled for the Special Council Meeting of May 6, 2005, the City Council may pass a Resolution Authorizing Settlement in Pending Litigation. Special Agenda May 6, 2005 Page 3 ITEM NO. 6 CONSIDER A MOTION TO ADJOURN TO EXECUTIVE SESSION TO EVALUATE THE PROFESSIONAL COMPETENCY OF INDIVIDUALS WHOSE APPOINTMENT, HIRING, PERFORMANCE OR DISCHARGE IS BEING CONSIDERED WHEN NECESSARY TO PREVENT NEEDLESS AND IRREPARABLE INJURY TO THOSE INDIVIDUALS' REPUTATIONS AND THOSE INDIVIDUALS REQUESTED A CLOSED SESSION.
