Resolutions.
1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST AN AMENDMENT TO LICENSE
AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY
BETWEEN THE CITY OF IOWA CITY, LANDOWNER, AND TENANT
SYLVIA VENUTO d/b/a VENUTO'S WORLD BISTRO, FOR A
SIDEWALK CAFg: AT 115 E. COLLEGE STREET.
Comment: On April 19, 2005, Council passed Resolution No. 05-162
approving a sidewalk caf6 agreement for Venuto's World Bistro. The
agreement allowed the business to have temporary and removable
fencing. Shortly thereafter, the business applied to have anchored
fencing, which staff has approved. This amendment to the initial
agreement allows the business to construct anchored fencing; there are
no other changes.
2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN
REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT
145 SOUTH WESTMINSTER STREET, IOWA CITY, IOWA.
Comment: On January 23, 2003, the owner of 145 South Westminster
Street executed a Second Mortgage in the amount of $22,000 to secure a
loan from the City for said amount as part of the Tenant to Ownership
Program. The owner of 145 South Westminster Street also executed a
Resale Agreement with the City on January 23, 2003, for the property at
145 South Westminster Street. The owner sold the home to another
income-eligible buyer. The loan was fully paid on May 5, 2005, and the
owner has met all the obligations contained in the Resale Agreement. It is
now the City's responsibility to release this lien.

SIGNAGE FOR "DICK BLICK ART MATERIALS" ON OLD CAPITOL
TOWN CENTER AT ~ 201 S. CLINTON STREET.
Comment: Sign Productions has applied for a permit to install a sign for
Dick Blick Art Materials at Old Capitol Town Center, 201 S. Clinton
Street. Since this is an Urban Renewal parcel, approval by the Design
Review Committee and City Council is required.

Comment: This resolution adopts the job descriptions for the City
Manager, City Attorney and City Clerk.

BETWEEN THE CITY OF IOWA CITY AND ASCAP (AMERICAN
SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS) AND
THE CITY OF IOWA CITY AND BMI (BROADCAST MUSIC, INC.)
Comment: The City uses music in a variety of public settings. ASCAP
and BMI license nearly 98% of all music commercially available in the
United States. The proposed license agreements were negotiated by
IMLA (International Municipal Lawyers Association) on behalf of its
members, and provide coverage for almost all non-dramatic
performances of music presented on both City property and at functions
and events hosted by the City on City property at an annual rate based
on population. The fee for Iowa City is $537.00 per year for the ASCAP
license and $537.00 per year for the BMI license. Staff memorandum
included in Council packet.

' AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH
RIVERSIDE THEATRE THAT ALLOWS THE SALE OF WINE AND
BEER UNDER LIMITED CIRCUMSTANCES IN CITY PARK FROM
JUNE 13, 2005 THROUGH SEPTEMBER 24, 2005.
Comment: On April 20, 2004, Council passed Ordinance No. 04-4123
that allows for the sale and consumption of alcohol in a city park, on a
right-of-way, or other public ground, excluding public buildings, pursuant
to written agreement. Staff has approved the agreement, which is
attached to the resolution, that allows Riverside Theatre to sell beer and
wine and for attendees to consume beer and wine from June 13 through
September 24, 2005 in a specified area in and around Riverside Festival
Stage in City Park. The period extends beyond the summer
Shakespeare festival that ends on July 17 because Riverside Theatre
will be having a production from September 16 through September 24 in
conjunction with its twenty-five year anniversary celebration. The terms
in the agreement are the same as last year with the exception of the
dates.

Comment: At its May 5 meeting, by a ote of 6-0 (Shannon absent), the
Planning and Zoning Commission recommended approval of a Sensitive Areas
Overlay Zone and Sensitive Areas Development Plan for MWD Davis Addition,
a 50.04 acre commercial subdivision located north of Highway 1, west of
Highway 218 and east of Kitty Lee Road. The Commission recommended
approval subject to the wetland planting area being amended to include the
proposed wetland buffer, prior to City Council consideration. Staff
recommended approval in a report dated April 21, and in a subsequent
memorandum dated April 29.

single-family lots and 38 attached zero-lot line lots) on 25.67 acres of property
located on Wintergreen Drive. Staff recommended approval in a memorandum
dated March 31, 2005.

Comment: At its April 21 meeting, by a vote of 5-0, the Planning and Zoning
Commission recommended approval of annexing this territory. The City has
received voluntary annexation requests from the two property owners included in
the annexation, Beverly Horton and Clear Creek LLC. The owner of the
residence in the annexation territory, Beverly Horton, has requested the
scheduled transition of property taxes as allowed by State Code. Staff
recommended approval in a report dated April 21.

facilities, 3) an easement for a sanita~ sewer line and 4) a landscaping plan and
fencing specifications for a buffer adjacent to Sycamore Street. Staff
recommended approval in a repo~ dated April 7. Approval of this rezoning will
permit development of Brookwood Pointe, a 29.2 acre, 106-1ot residential
subdivision.

Comment: A public hearing is required under Iowa Code section 324.2(4)(a) when a
municipality is considering whether to extend a franchise. Staff and the Iowa City
Telecommunications Commission both are recommending an extension of the cable

Comment: This project will replace the streets and sidewalks removed in
conjunction with the water main replacements on Deforest Street between Franklin

and Pearl Street. The estimated construction cost is $100,000 and will be funded with
Water revenues.

ITEM 8. ASSESSING A $300.00 CIVIL PENALTY AGAINST ONE-EYED JAKES, PURSUANT
TO IOWA CODE SECTION 453A.22(2) (2005)
Comment: This hearing is the time designated for the Council to consider whether to
adopt a Resolution assessing the $300.00 civil penalty authorized by Iowa Code
section 453A.22(2) against One-Eyed Jakes, 18-20 South Clinton St., Iowa City.
Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be
assessed to a retail cigarette permit holder when and if that permit holder's employee
violates Iowa Code section 453A.2(1) by selling or providing tobacco to a minor. As a
part of the hearing, the Council will be provided with information establishing an
employee of permit holder One-Eyed Jakes violated Iowa Code section 453A.2(1). The
permit holder's representative will then have the opportunity to provide the Council with
information s/he deems appropriate. The Council will then decide whether to assess
the requested civil penalty and, if it decides to do so, will adopt an appropriate
Resolution. The hearing will not provide the opportunity for public comment.

ENTITLED "SOLID WASTE," SECTION 8, ENTITLED "STORAGE OF SOLID
WASTE" BY AMENDING SUBSECTION E, ENTITLED "LOCATION OF SOLID
WASTE CONTAINER," AND BY ADDING A NEW SUBSECTION F, ENTITLED
"DOWNTOWN SOLID WASTE CONTAINER CODE" TO ESTABLISH A PERMIT
SYSTEM FOR STORAGE OF SOLID WASTE CONTAINERS IN THE DOWNTOWN
PUBLIC RIGHTS-OF-WAY. (SECOND CONSIDERATION)
Comment: There are nearly 100 solid waste containers (dumpsters) in the alleys in the
downtown, many of which are overflowing and unsanitary. Although City Code section
14-3H-SE presently requires a written agreement among the City Council, the hauler,
and the property owner to have a container in the right-of-way, that generally has not
been enforced. This ordinance creates a permit process for the containers in the
downtown alleys, which will not require Council action on every container and which
will be easier for the City to enforce. The specific requirements of the permitting system
will be established by resolution. Any container without a permit sixty (60) days after
the effective date of this ordinance must be removed.

ITEM 10. CONSIDER A RESOLUTION ADOPTING PERMIT SYSTEM FOR SOLID WASTE
D~ [~<~ CONTAINERS IN THE DOWNTOWN ALLEYS INCLUDING PROVISIONS FOR
' ' APPLICATION, ISSUANCE, DURATION, INSPECTION, SUSPENSION,
REVOCATION, REMOVAL, FEES, AND INSURANCE.
Comment: On May 6, 2005, Council approved first consideration of an ordinance
creating a permit process for the solid waste containers (dumpsters) in the downtown
alleys. Said ordinance provides that the specific requirements of the permitting system
will be established by resolution. This resolution approves a permitting system, a
copy of which is attached to the resolution, that sets forth those details, including: a)
how one applies for a permit; b) when a permit is to be issued; c) no permit fees for at
least the first year; d) the insurance requirements; e) the process by which permits may
be suspended and revoked; f) when a container may be removed from an alley; and g)
sanitation requirements, such as cleaning and locking.

Comment: Council held Executive Session on May 6, 2005, to evaluate the City
Manager, City Attorney, and City Clerk. As a result of that session adjustments were
made in compensation for those three employees as outlined in the resolution.

Comment: Bids for this project were opened on Tuesday, May 17th and the
following bids were received:
Lynch's Excavating West Branch, Iowa $146,945.00
Carter-Kirkpatrick Services North Liberty, Iowa $153,725.00
Engineer's Estimate $127,000.00
Public Works and Engineering recommend award of the contract to Lynch's
Excavating of West Branch, Iowa. This project will be funded with Water
