HomeMy WebLinkAbout2005-05-17 Appointment NOTICE THE CITY COUNCIL OF IOWA CITY IS CONSIDERING APPOINTMENT TO THE FOLLOWING COMMISSION: AIRPORT COMMISSION One Vacancy - Unexpired Term Ending March 1,2008 Duties: To exercise all the powers granted to cities and towns under Chapter 330 of the Code of Iowa, except the power to sell said airport. To annually certify the amount of taxes within the limitations of the Statutes of the State of Iowa to be levied for Airport purposes. All funds derived from taxation or otherwise for airport purposes shall be under the full and absolute control of the Airport Commission, deposited with the City Treasurer, and disbursed only on the written warrants or order of the Airport Commission. Iowa City-appointed members of boards and commissions must be eligible electors of the City of Iowa City. The Airport Commission meets the second Thursday of each month at 5:45 p.m. Applications must be received by 5:00 p.m., Wednesday, May 11, 2005. To hear and decide appeals where it is alleged there is an error in any order, requirement, decision, or determination made by an administrative official in the enforcement of the Airport Zoning Chapter. 2. To hear and decide special exceptions to the terms of the Airport Zoning Chapter upon which such board is required to pass under the Airport Zoning Chapter. 3. To authorize upon appeal in specific cases such variance from the terms of the Airport Zoning Chapter as will not be contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the Airport Zoning Chapter will result in unnecessary hardship, and so that the spirit of the Airport Zoning Chapter shall be observed and substantial justice done. This includes determining long-range goals of Library service, adopting written policies to govern operation of the Library, and employing a competent staff to help plan and implement the Board's service goals. 'hrough my previous committee work I feel I can work well with a team of others. I am a detailed oriented person and have good organizational skills. I am applying for this position as I feel the public library is one of the most wonderful assets of the City of Iowa City. The service is truly remarkable and the cost to use the library is free! Dilkes, City Attorney ~ Re: Resignation of Michael Maharry I have been asked for a legal opinion regarding Michael Maharry's status on the commission in light of the events at your April 28, 2005 meeting. It is my understanding Mr. Maharry recused himself from the commission at that meeting due to a conflict of interest, but remained at the meeting as a member of the public. During the course of the meeting, based on what appears to be a misunderstanding on the part of Mr. Maharry that he needed to resign from the commission in order to speak as a member of the public, Mr. Maharry stated for the record that he was resigning from the commission. I have listened to the tape of the relevant portion of the meeting in which Mr. Maharry spoke as a member of the public and stated his resignation from the commission. Mr. Maharry's oral resignation was clear and unequivicol. That being the case, and in the absence of any rules requiring that resignation from the commission be made in writing or accepted by the City Council, or any rule allowing for the withdrawal of a resignation, it is our determination that Mr. Maharry's resignation was effective immediately and he is no longer a member of the Historic Preservation Commission. Mr. Maharry could of course re-apply for appointment to the commission. I would like to clarify an issue related to Mr. Maharry's resignation. Mr. Maharry's belief that he needed to resign from the commission in order to speak as a member of the public after having recused himself was incorrect. In the absence of a bylaw or formally adopted rule providing otherwise, a member of a board or commission who has properly recused himself or herself based on a conflict of interest is free to remain at the meeting and speak as a member of the public. That is currently the case with the City Council. The Planning & Zoning Commission, on the other hand, has adopted a bylaw providing that the commission member may remain at the meeting but may not speak as a member of the pubic.
