(1) CONSIDER A RESOLUTION ADOPTING THE AMENDED FY99 ANNUAL ACTION PLAN BUDGET WHICH IS A PART OF THE CONSOLIDATED PLAN AS MANDATED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. (2) Comment: Changes to the FY99 Annual Action Plan budget included additional allocations of funds to the Crisis Center ($25,000) and to the Salvation Army (98,550). It also included a return of 967,000 in FY98 CDBG funds by Heartland Candleworks. At its October 15 meeting, the Housing and Community Development Commission recommended the approval of the FY99 Annual Action Plan budget, as amended. CONSIDER A RESOLUTION ACCEPTING WORK FOR THE REMOVAL AND REPLACEMENT OF THE ROOF AND INSULATION ON THE CIVIC CENTER. Comment: In September of 1997, a contract was entered into with Maintenance Associates of Marion, Iowa to remove and replace two sections of the Civic Center roof and insulation, one section being above the Fire Station and the other above the Council Chambers. Through change orders, the contract amount was reduced from 962,399 to 959,445. All work covered by the contract has been completed, all required paperwork has been submitted, and all invoices have been paid other than a 5% retainage. Consider a motion setting a public hearing for December 1 on an ordinance to vacate street right-of-way located east of North Market Square Park, and south of Horace-Mann School. (VAC98-0006) Comment: At its November 5 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of this vacation, subject to the Old Johnson Street right-of-way remaining open to public recreational use and not being fenced off or otherwise separated from Market Square Park, the alley right-of-way remaining open to fire and emergency vehicle access, and subject to the retention of all necessary utility easements. Staff recommended approval in its November 5 staff report. (ANN98-0002)~ Comment: At its October I meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed annexation. (REZ98-O004) ~ Comment: At its October 1 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning, subject to agreements and easements for the provision of sanitary sewer service, and the final building elevation designs to be approved by the Department of Planning and Community Development. Consider an ordinance changing the zoning designation of a 4.45 acre tract from Suburban Residential (County RS), to Low Density Single-Family Residential (RS-5) and Public (P) for property located at the east terminus of Court Street. (REZ98-O015). (First consideration) Comment: At its October 1 meeting, the Planning and Zoning Commission, by a vote of 6-0, recommended approval of the proposed rezoning. Staff recommended approval in a report dated September 17. Consider an ordinance vacating the Madison Street right-of-way south of Prentiss Street, the Des Moines Street right-of-way west of Capitol Street and the 20-foot wide alley south of Prentiss Street and west of Capitol Street. (VAC98-0005) (Second consideration) Comment: At its September 17 meeting, by a vote of 5-1, the Planning and Zoning Commission recommended approval of the proposed vacation, subject to utility easements and an emergency vehicle access easement being retained and subject to The University of Iowa submitting proof of ownership of all adjacent properties. Staff recommended approval in a report dated September 17. (SUB98-0026) Comment: At its November 5 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the final plat subject to the approval of legal papers and construction drawings prior to Council consideration. ITEM NO. 8. Comment: The attached Winter 1998/99 Deer Management Plan has received the unanimous recommendation of the Iowa City/Coralville Deer Management Committee and is in harmony with the long-term deer management plan previously approved by the City Council. This plan will begin the process of providing needed relief and protection for the environment, property owners, and motorists in Iowa City. PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF $8,400,000 GENERAL OBLIGATION BONDS. Comment: This public hearing is being held to receive public comment regarding the issuance of up to ~8,400,000 of General Obligation bonds. Proceeds from the bonds will pay the cost of the construction, reconstruction, and repairing of sidewalks and street improvements; the acquisition, installation, and repair of street lighting fixtures; the construction, reconstruction, enlargement, improvement, and repair of bridges; the construction, reconstruction, extension, improvement and equipping of works and facilities useful for the collection and disposal of surface waters and streams; the rehabilitation and improvement of existing City parks; and the reconstruction, extension and improvement of the Municipal Airport, including acquisition of land. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. Comment: This public hearing is being held to receive public comment regarding the issuance of up to $700,000 of General Obligation Bonds. Proceeds from the bonds will pay the costs of the reconstruction, improvement and equipping of the Civic Center - Third Floor. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. Comment: This public hearing is being held to receive public comment regarding the issuance of up to 8470,000 of General Obligation Bonds. Proceeds from the bonds will pay the costs of the improvement and equipping of the Public Library, including computer replacement and ICN Room. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. Comment: This public hearing is being held to receive public comment regarding the issuance of up to $700,000 of General Obligation Bonds. Proceeds from the bonds will pay costs of the acquisition and equipping of a recreation building - ScanIon Gymnasium. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. The sale date will be scheduled in March of 1999. PUBLIC HEARING Action: CONSIDER A RESOLUTION INSTITUTING November 17, 1998 City of Iowa City Page 12 ITEM NO. 20. PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE AUTHORIZATION AND ISSUANCE OF NOT TO EXCEED $330,000 GENERAL OBLIGATION BONDS. Comment: This public hearing is being held to receive public comment regarding the issuance of up to ~330,000 of General Obligation Bonds. Proceeds from the bonds will pay costs of the improvement and equipping of recreation grounds, including the South Site Soccer Fields. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. The sale date will be scheduled in March of 1999. PUBLIC HEARING Action: ITEM NO. 21. CONSIDER A RESOLUTION INSTITUTING Action: PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED 98,000,000 SEWER REVENUE BONDS. Comment: This public hearing is being held to receive public comment regarding the issuance of up to ~8,000,000 of Sewer Revenue Bonds. Proceeds from the bonds will pay costs of extending, improving and equipping the sanitary sewer utility of the City. Projects included are the Willow Creek, River Street, and Westminster Sanitary Sewers and South Plant expansion costs. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. The sale date will be scheduled in December of 1998 or January of 1999. PUBLIC HEARING Action: CONSIDER A RESOLUTION INSTITUTING Action: November 17, 1998 City of Iowa City Page 13 ITEM NO. 22. PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $9,200,000 WATER REVENUE BONDS. Comment: This public hearing is being held to receive public comment regarding the issuance of up to 99,200,000 of Water Revenue Bonds. Proceeds from the bonds will pay costs of extending, improving and equipping the water utility of the City. Projects included are the Iowa River Dam, site development and water mains. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. Proceeds from the bonds will pay costs of constructing a multi-level parking facility at or near the south side of Iowa Avenue between Linn Street and Gilbert Street. The resolution authorizes staff to proceed on behalf of the City with the sale of the bonds, to select a date for the sale thereof, and to take all action necessary to permit the sale of said bonds on a basis favorable to the City and acceptable to the City Council. CONSIDER AN ORDINANCE AMENDING TITLE 9 OF THE CITY CODE OF IOWA CITY ENTITLED "MOTOR VEHICLES AND TRAFFIC," BY AMENDING CHAPTER 3, SECTION 6B HEREIN TO CHANGE THE SPEED LIMIT ON US HIGHWAY 6 FROM THE EAST CITY LIMIT TO A POINT 500 FEET WEST OF HEINZ ROAD. (FIRST CONSIDERATION) Comment: The speed limit on the portion of US Highway 6 is currently 55 mph. Staff recommends reducing the speed limit to 45 mph in this area, This is consistent with the speed limit guidance in the City Code and is consistent with a speed study that was performed in this area by Iowa Department of Transportation. Because US Highway 6 is under the joint jurisdiction of Iowa City and the Iowa DOT, the speed limit must be adopted jointly by the City of Iowa City and the Iowa Transportation Commission. ITEM NO. 25. CONSIDER AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA CITY, IOWA, BY AMENDING SECTION 8-5-5, ENTITLED "KEEPING DISORDERLY HOUSE," TO PROVIDE FOR POLICE INITIATED COMPLAINTS AND TO PROVIDE FOR POLICE AUTHORITY TO RESTORE ORDER AND DISPERSE PERSONS FROM VIOLATING PREMISES. (SECOND CONSIDERATION) Comment: The Iowa City Police Department and the City Attorney's Office have recommended enactment of amendments to the Disorderly House Ordinance, as they meet the goals of explicitly authorizing police involvement before the disturbance is out of control, as well as explicitly granting authority to restore order and disperse persons after a citation has been issued and to provide for '/ November 17, 1998 City of Iowa City Page t 5 ITEM NO. 26. CONSIDER AN ORDINANCE AMENDING TITLE 8, CHAPTER 6, SECTION 1 ENTITLED "SALE OF CIGARETTES TO PERSONS UNDER EIGHTEEN YEARS OF AGE" OF THE CITY CODE TO PROHIBIT THE USE OR POSSESSION OF TOBACCO PRODUCTS OR CIGARETTES BY PERSONS UNDER EIGHTEEN YEARS OF AGE. (PASS AND ADOPT) Comment: State law currently prohibits the use or possession of tobacco products or cigarettes by persons under eighteen years of age. The City currently has no such similar ordinance in effect; although, the City has incorporated the State Code provisions pertaining to the sale and possession of tobacco products and cigarettes as part of Section 8-6-1A of the City Code as it relates to cigarette sales to persons under eighteen years of age. This amendment would amend the title to Section 8-6-1 of the City Code to reflect that Section 8-6-1A prohibits the sale of tobacco products and cigarettes to persons under eighteen years of age and prohibits the possession of tobacco products and cigarettes by persons under eighteen years of age. Under the City and State Code provisions, fines incurred and paid would be remitted to the City. Action: 7Jl, t/,4C/,~,~//~J~ CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED "UNIFIED DEVELOPMENT CODE," CHAPTER 3, ENTITLED "CITY UTILITIES," ARTICLE E ENTITLED "WASTEWATER TREATMENT WORKS INDIRECT DISCHARGE," SECTION 4, ENTITLED "PRETREATMENT STANDARDS," OF THE CITY CODE TO AMEND PLANT INFLUENT ZINC STANDARDS. (PASS AND ADOPT) Comment: This ordinance will raise the influent limits for zinc at the North and South Wastewater Treatment Plants. This change reflects the ability of the two plants to remove zinc from the wastewater stream. The removed zinc will become a component of the final sludge product. The zinc component of the sludge will comply with EPA and IDNR requirements for land application of wastewater sludges. CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE UNIVERSITY OF IOWA, FOR TEMPORARY USE OF PUBLIC RIGHTS-OF-WAY FOR PORTIONS OF PRENTISS, MADISON AND CAPITOL STREETS IN IOWA CITY, IOWA. ITEM NO. 29. Comment: This agreement is to allow The University of Iowa to temporarily close public sidewalk adjacent to Prentiss, Capitol, and Madison Streets. This agreement is requested in order to facilitate the safe construction of the University Services Building and to secure the site from pedestrian traffic. The effective date of the agreement is November 18, 1998, and shall end upon substantial completion of the construction, but no later than January 1, 2000. CONSIDER A RESOLUTION OF INTENT TO CONVEY VACATED PORTIONS OF THE DES MOINES STREET RIGHT-OF-WAY LOCATED WEST OF CAPITOL STREET AND EAST OF THE IOWA RIVER, THE MADISON STREET RIGHT-OF- WAY SOUTH OF PRENTISS STREET AND NORTH OF THE IOWA INTERSTATE RAILROAD TRACKS, AND THE 20 FOOT WIDE ALLEY BETWEEN PRENTISS STREET AND THE DES MOINES STREET RIGHT-OF-WAY WEST OF CAPITOL STREET TO THE UNIVERSITY OF IOWA/IOWA STATE BOARD OF REGENTS, THE REDEVELOPER OF THE SUBJECT PROPERTY AND OWNER OF ALL ABUTTING PROPERTIES, AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR DECEMBER 1, 1998. Comment: On October 20, 1998, the City Council held a public hearing on an ordinance vacating portions of the Des Moines Street right-of-way located west of Capitol Street and east of the Iowa River, the Madison Street right-of-way south of Prentiss Street and north of the Iowa Interstate Railroad tracks, and the 20 foot wide alley between Prentiss Street and the Des Moines Street right-of- way west of Capitol Street for the purpose of facilitating redevelopment of the adjacent and subject properties by The University of Iowa for a new administration building. Said adjacent properties are currently being acquired by The University of Iowa/Iowa State Board of Regents for said redevelopment, and as such redevelopment is by a governmental body for a public purpose, it is proposed that said property transfer be made without compensation pursuant to Iowa Code §364.7(3) (1997). This Resolution declares the City Council's intent to convey the above property to The University of Iowa/Iowa State Board of Regents, and sets a public hearing on the proposed conveyance for December 1, 1998. CONSIDER A RESOLUTION REQUESTING SUBMISSION OF THE IMPOSITION OF A LOCAL SALES AND SERVICES TAX TO THE QUALIFIED ELECTORS OF THE INCORPORATED AND UNINCORPORATED AREAS OF JOHNSON COUNTY. ITEM NO. 31. Comment: This resolution requests the Johnson County Commissioner of Elections to submit to the voters the question of imposition of a 1% local sales and services tax at a special election to be held on March 30, 1999. The resolution also sets forth the ballot proposition that states who the proceeds of the tax would be applied and used. If the ballot proposition were to pass, the resolution sets an effective date of July 1, 1999, for the 1% tax. o CONSIDER A RESOLUTION TO ADOPT THE IOWA CITY POLICE CITIZENS REVIEW BOARD STANDARD OPERATING PROCEDURES AND GUIDELINES. Comment: Section 8-8-7(4) of the City Code establishes the Police Citizens Review Board (PCRB) and requires that procedural rules be approved by the City Council. After months of review, the PCRB adopted standard operating procedures and guidelines at their September 15 meeting and recommended approval by the City Council at their October 6 meeting. item was deferred on October 20. CONSIDER A MOTION GRANTING AN EXTENSION TO DECEMBER 18, 1998, TO THE POLICE CITIZENS REVIEW BOARD FOR THE FILING OF A REPORT WITH THE CITY COUNCIL ON COMPLAINT #98-17. Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides for the City Council to grant extensions of the 30-day reporting requirement for good cause.
