CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR JANUARY 12
ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF
COST FOR THE CONSTRUCTION OF THE PARK MAINTENANCE BUILDING IN
NAPOLEON PARK, DIRECTING CITY CLERK TO PUBLIC NOTICE OF SAID
HEARING, AND DIRECTING THE PARKS AND RECREATION DIRECTOR TO
PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project includes the construction of a pre-engineered building
in the north end of Napoleon Park. It will house the maintenance and
management operations of the Parks, Forestry, and CBD Divisions, allowing
for the relocation of all Forestry equipment and personnel from Oakland
Cemetery. The building is 11,250 square feet in size, and the estimated
construction cost is $786,000.

ESTIMATE OF COST FOR THE CONSTRUCTION OF THE SUMMIT
STREET BRIDGE RECONSTRUCTION PROJECT [PROJECT NO. BRM-
3715(13)--8N-52], DIRECTING CITY CLERK TO PUBLISH NOTICE OF
SAID HEARING, AND DIRECTING THE CITY ENGINEER TO
PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project involves the complete removal and replacement of
the Summit Street Bridge spanning the Iowa Interstate Railroad and the
reconstruction of the Summit Street pavement between Kirkwood Avenue
and Sheridan Avenue along with the installation of water main and storm
sewer facilities. The total estimated construction cost is $1,246,000. This
project will be funded with approximately $729,000 of Federal Aid Highway
Bridge Replacement and Rehabilitation Program monies and about $517,000
of Road Use Tax revenue and General Obligation bonds. This project is
projected to be let by the Iowa Department of Transportation on February 16,
1999.

STATION - LOWER TERMINUS PROJECT, DIRECTING CITY CLERK TO

TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project includes construction of the Lower Terminus (below
ground level) of the sand pit pump station. This pump station will pump raw
water from both the Iowa River intake structure and the 18 acre sand pit to
the water treatment plant. A maximum of 3.8 million gallons per day (mgd)
of river water and 1.2 mgd of sand pit water will be available for treatment.
The estimated cost is $590,000 and will be funded water revenue bonds.

REIMBURSE THE CITY FOR CERTAIN ORIGINAL EXPENDITURES
PAID IN CONNECTION WITH SPECIFIED PROJECTS.

Comment: This resolution declares official intent under Treasury Regulation
1.150-2 that the City of Iowa City will issue debt to reimburse itself for
expenditures paid out for: Library Computer Replacement ICN Room,
$470,000; ScanIon Gymnasium, $700,000; Willow Creek Sanitary Sewer,
$5,608,670; and Expansion of South Treatment Plant, $600,000. Project
costs will be paid out of Landfill Reserve and Sewer Operations Funds until
bonds are sold.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST THE RELEASE OF THREE
ACCESS, UTILITY AND SANITARY SEWER EASEMENTS LOCATED ON
LOT 51, WALDEN HILLS SUBDIVISION, IOWA CITY, IOWA.
Comment: The City currently possesses three 36' access, utility and sanitary
sewer easements across Lot 51, Walden Hills Subdivision, Iowa City, Iowa.
These easements were granted with the original platting of Walden Hills ~n
anticipation of a particular development design for the parcel. However, a
resubdivision of Lot 51 has been approved along with an alternative
development design, which design requires the release of the above
referenced easements to clear title to certain lots within the resubdtws~on
Public Works has recommended releasing the existing easements an
anticipated by the approved plan. This Resolution authorizes the execution of
a release of the three 36' access, utility and sanitary sewer easements as
stated above.

ITEM NO. 5. PLANNING AND ZONING MATTERS.
Consider a motion setting a public hearing for January 12 on an ordinance
designation 2 South Linn Street as an Iowa City Historic Landmark.
Comment: At its November 12 meeting by a vote of 8-0 the Historic Preservation
Commission recommend approval of the proposed Landmark designation. It is
anticipated that the Planning and Zoning Commission will vote on this item at their
December 17 meeting.

Consider a motion setting a public hearing for January 12 on an ordinance
changing the zoning designation of approximately 0.2 acres located at 703 Benton
Court from Medium Density Single-Family Residential (RS-8) to High Density Multi-
Family Residential (RM-44). (REZ98-O015)
Comment: At its November 19 meeting, by a vote of 3-3, Ehrhardt, Gibson and
Shannon voting no and Schintler abstaining, the Planning and Zoning Commission
recommended denial of the proposed rezoning. Staff recommended approval in its
October 15 report. In a letter dated November 23, the applicant asked that the
Council consider this rezoning request.

Consider a motion setting a public hearing for January 12 on an ordinance
changing the zoning designation of 21.26 acres located on the east side of Naples
Avenue form Intensive Commercial (C1-1) to Sensitive Areas Overlay Zone-
Intensive Commercial (OSA-CI-1).
Comment: At Its November 19 meeting, by a vote of 6-1, Ehrhardt voting no, the
Planning and Zoning Commission recommended approval of the rezoning and
associated Sensitive Areas Development Plan, to permit grading in Areas A and B
of the rezoning exhibit, subject to the establishment of native plant species on the
altered slopes, and removal of area C form the plan. In its October 15 report, staff
recommends approval subject to the conditions included by the Commission.

Consider an ordinance to vacate street right-of-way located east of North Market
Square Park, and south of Horace-Mann School. (VAC98~0006) (First

Comment: At its November 5 meeting, by a vote of 5-0, the Planning and Zoning
Commission recommended approval of this vacation, subject to the Old Johnson
Street right-of-way remaining open to public recreational use and not being fenced
off or otherwise separated from Market Square Park, the alley right-of-way
remaining open to fire and emergency vehicle access, and subject to the retention
of all necessary utility easements. Staff recommended approval in its November 5
staff report.

CONSIDER AN ORDINANCE AMENDING SECTION 8-7-1, CITY CODE, TO ALLOW
THE DISCHARGE OF FIREARMS FOR DEER MANAGEMENT PURPOSES. (SECOND
CONSIDERATION)

Comment: The City intends to contract with the United States Department of
Agriculture ("USDA") for sharpshooting of deer this winter as part of the City's deer
management plan. This ordinance amendment will allow employees of the USDA to
discharge firearms within the City pursuant to this contract and the City's deer
management plan. Staff recommends expedited consideration of this item to allow
sharpshooting to begin in early January.

STATES DEPARTMENT OF AGRICULTURE ("USDA") FOR THE SHARPSHOOTING OF
DEER PURSUANT TO THE WINTER 1998/99 DEER MANAGEMENT PLAN.

Comment: The attached Cooperative Services Agreement sets forth the terms under
which the USDA will sharpshoot deer for the City of Iowa City.

CONSIDER AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF IOWA
CITY, IOWA, BY AMENDING CHAPTER 8, ENTITLED "POLICE CITIZENS REVIEW
BOARD," SPECIFICALLY, SECTIONS 8-8-2 AND B-8-7, TO ELIMINATE
COMPLAINANT PARTICIPATION IN DUE PROCESS NAME-CLEARING HEARINGS.
(SECOND CONSIDERATION)
Comment: After review of the proposed PCRB standard operating procedures, the
City Attorney's Office has recommended a revision to the ordinance establishing the
Police Citizen's Review Board. The recommended amendment eliminates the
complainant as a participant in the name-clearing hearing required to be afforded by
constitutional due process when a proposed Board report is critical of the officer's
conduct. Staff recommends expedited consideration.

RESOLUTION DIRECTING THAT PUBLIC PROPERTY WITHIN THE AREA
COMMONLY KNOWN AS THE PENINSULA BE CLOSED TO THE PUBLIC
WHILE DEER SHARPSHOOTING ACTIVITIES ARE BEING CONDUCTED
PURSUANT TO THE CITY'S DEER MANAGEMENT PLAN.
Comment: For safety reasons, staff recommends that public property within the
area commonly known as the "peninsula" be closed while deer sharpshooting
activities are being conducted.

CONSIDER A RESOLUTION TO ADOPT THE IOWA CITY POLICE CITIZENS REVIEW
BOARD STANDARD OPERATING PROCEDURES AND GUIDELINES.
Comment: Section 8-8-7(4) of the City Code establishes the Police Citizens Review
Board (PCRB) and requires that procedural rules be approved by the City Council.
After months of review, the PCRB adopted standard operating procedures and
guidelines at their September 15 meeting and recommended approval by the City
Council at their October 6 meeting. Consideration of this item was deferred on
October 20 and November 17.

ITEM NO. 10. CONSIDER AN ORDINANCE AMENDING TITLE 9 OF THE CITY CODE OF IOWA CITY

6B HEREIN TO CHANGE THE SPEED LIMIT ON US HIGHWAY 6 FROM THE EAST
CITY LIMIT TO A POINT 500 FEET WEST OF HEINZ ROAD. (PASS AND ADOPT)
Comment: The speed limit on the portion of US Highway 6 is currently 55 mph. Staff
recommends reducing the speed limit to 45 mph in this area. This is consistent with
the speed limit guidance in the City Code and is consistent with a speed study that
was performed in this area by Iowa Department of Transportation. Because US
Highway 6 is under the joint jurisdiction of Iowa City and the Iowa DOT, the speed
limit must be adopted jointly by the City of Iowa City and the Iowa Transportation
commission.

CONSIDER A RESOLUTION AUTHORIZING THE HISTORIC PRESERVATION
COMMISSION TO APPLY FOR A CERTIFIED LOCAL GOVERNMENT GRANT FOR THE
SURVEY AND EVALUATION OF THE EARLY NEIGHBORHOOD NORTHEAST OF THE
ORIGINAL TOWN PLAT, PHASE III. (NORTHSIDE/GOOSETOWN)
Comment: This project would complete a three-phase survey of the Northside and
Goosetown neighborhoods. The Commission anticipates requesting a grant of
approximately $10,000 which would require a local match of approximately $6,000 to
be provided through funds allocated within the Urban Planning Division's budget for
this purpose, volunteer and City staff time, and other in-kind services and supplies.

CONSIDER A RESOLUTION AUTHORIZING THE ADOPTION OF THE REVISED
VOUCHER PAYMENT STANDARDS FOR THE IOWA CITY HOUSING AUTHORITY
VOUCHER PROGRAM.
Comment: The Iowa City Housing Authority is required to revise the Voucher
Payment Standards in compliance with HUD regulations for use in it's Voucher
program. The Voucher Payment Standards for each size of dwelling unit must not
exceed 110% of the current Fair Market Rent (FMR) or be less than 90% of the FMR.
The Iowa City Housing Authority proposes to set the Voucher Payment Standards to
be the same as the FMR's (100%). Voucher Payment Standards are used in the
calculation for the amount of Housing Assistance Payment (HAP) paid to landlords on
behalf of the tenant (subsidy equals payment standard minus 30% of tenant's
adjusted monthly income). HUD, through the Annual Contributions Contract (ACC),
will pay the increase in the Voucher Payment Standard. The revised Voucher Payment
Standards will assist the tenant by lowering their portion of the rent. When the FMR's
are published by HUD annually, the Voucher Payment Standards will be automatically
adjusted. Revised Voucher Payment Standards will be effective immediately.

ITEM NO. 13. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
Q~ ~t~ ASSISTED HOUSING DIVISION OF THE HOUSING AND INSPECTION SERVICES
DEPARTMENT BY ADDING A POSITION OF HOUSING PROGRAM ASSISTANT.
Comment: The Iowa City Housing Authority has received notice from the Department
of Housing and Urban Development of Section 8 Funding for 1 O0 additional vouchers
in the amount of $399,252 annually. The Assisted Housing Division of the
Department of Housing and Inspection services is adding a Housing Program Assistant
to assist in the implementation of these vouchers. The cost of the position will be
covered by the increase in Administrative Fee earned in the utilization of the additional
1 O0 vouchers.

CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
ASSISTED HOUSING DIVISION OF THE HOUSING AND INSPECTION SERVICES
DEPARTMENT BY ADDING A POSITION OF FSS PROGRAM COORDINATOR AND
AMENDING THE AFSCME PAY PLAN.
Comment: HUD has made funds available to fully fund (salary and benefits) a Section
8 Family Self-Sufficiency (FSS) Program Coordinator. The Section FSS program
promotes the development of local strategies to coordinate the use of assistance
under the Section 8 rental program with public and private resources to enable
participating families to achieve economic independence and self-sufficiency. An FSS
Program Coordinator assures that program participants are linked to the supportive
services they need to achieve self-sufficiency.

CONSIDER A RESOLUTION OF INTENT TO CONVEY VACATED PORTIONS OF
STREET RIGHT-OF-WAY LOCATED EAST OF NORTH MARKET SQUARE PARK, AND
SOUTH OF HORACE MANN SCHOOL, TO THE IOWA CITY SCHOOL DISTRICT, AND
SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR JANUARY 12, 1999.
Comment: The City Council has held a public hearing on an ordinance vacating
portions of street right-of-way located east of North Market Square Park and south of
Horace Mann School for the purpose of transferring ownership of said right-of-way to
the Iowa City School District for a park and subject to certain provisions for continued
use of the properties by the public. As this transfer of ownership is to a governmental
body for the public purpose of a park, it is proposed that said property transfer be
made without compensation pursuant to Iowa Code §364.7(3) (1997). This
Resolution declares the City Council's intent to convey the above vacated properties

ITEM NO. 17.
Comment: HLM Design of NorthAmerica, Inc. previously prepared schematic design
documents for renovation of the Airport Terminal Building. HLM has agreed to prepare
design development documents, construction documents, assist the Airport with
bidding, and perform administration of the construction contract. This resolution would
authorize an interdepartmental loan to the Airport Commission to pay for these
consultant services.
