ORDINANCE NO.
ORDINANCE AMENDING TITLE '14, ENTITLED "UNIFIED DEVELOPMENT CODI=," CHAPTER 3,
ENTITLED "CITY UTILTIES," ARTICLE H, ENTITLED "SOLID WASTE," SECTION 2, ENTITLED
"DEFINITIONS" BY AMENDING THE DEFINITION OF "DOWNTOWN" TO DELETE THE CB5 ZONE
FROM THE PERMIT REQUIREMENTS OF SOLID WASTE CONTAINERS IN THE DOWNTOWN
PUBLIC RIGHTS-OF-WAY,
WHEREAS, Ordinance No. 05-4160 created a permitting requirement for solid waste containers in
"downtown" public rights-of-way;
WHEREAS, Ordinance No. 05-4160 defines "downtown" as the "CB10 and CB5 zones as defined in
the City's zoning code";
WHEREAS, it is not necessary to include the rights-of-way in the CB5 zone in the permitting process
to achieve the purposes of Ordinance No. 05-4160; and
WHEREAS, it is in the best interest of the City to delete the CB5 zone from the definition of
"downtown."
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. AMENDMENTS.
1. Title 14, entitled "Unified Development Code," Chapter 3, entitled "City Utilities," Ar[icle H, entitled
"Solid Waste," Section 2, entitled "Definitions" is hereby amended by deleting the definition of "downtown"
and substituting the following new definition:
Downtown: The CB10 zone as defined in the City's zoning code.
SECTION II. REPEALER. All ordinances and pads of ordinances in conflict with the provision of this
Ordinance are hereby repealed.
SECTION Ill. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be
invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any
section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and
publication, as provided by law.
