Comment: This resolution sets a public hearing for 7:00 p.m. on January 26, 1999, to receive public comment regarding the issuance of up to $4,700,000 of General Obligation bonds to allow the City to refund the Series 1990, 1991 and 1992 General Obligation Bonds and Series 1992 Capital Loan notes if there are sufficient savings to do so. The resolution also authorizes the City Clerk to publish the Notice of Hearing. Comment: Th' nstruction of Foster Road from the Idyllwild C erty, a bike trail from Foster Road t ater mains, and Water Fac' ' The estimated (3) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR JANUARY 26 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE COLLEGE STREET PEDESTRIAN MALL WATER MAIN REPLACEMENT PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. This project replaces old water main in the College Street Pedestrian Mall between Clinton Street and the Library. The old water main has been a constant source of water main breaks and maintenance problems. New water main will be installed prior to the Phase II Downtown Streetscape Improvements. ( 1 ) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE CONSTRUCTION OF THE 1998 PAVEMENT MARKING PROJECT. Comment: See Engineer's Report. (2) CONSIDER A RESOLUTION ACCEPTING THE WORK SENIOR CENTER '97-'98 HVAC RENOVATION FOR THE PROJECT. Comment: See Engineer's Report. (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A RENTAL REHABILITATION LOAN FOR THE PROPERTY LOCATED AT 212~ SOUTH CLINTON STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 21 2~ South Clinton Street received ~70,000 assistance through the City's Rental Rehabilitation Program on March 24, 1988. The financing was in the form of a 1 O-year, no-interest declining balance loan. The terms of this lien were satisfied on December 24, 1998; thus the lien can now be released. Correspondence. PUBLIC DISCUSSION (ITEMS NOT ON THE AGENDA) [UNTIL 8:00 P.M.]. Public Discussion will be continued, if necessary, prior to "City Council Information" item. ITEM NO. 6. PLANNING AND ZONING MATTERS. Consider a motion setting a public hearing for January 26 on an ordinance conditionally changing the zoning designation of approximately 61.8 acres located south of Whispering Meadows Drive from Medium Density Single-Family Residential (RS-8) to Factory Built Housing Residential (RFBH - 59.25 acres) and Low Density Multi-Family Residential (RM-12 - 2.55 acres). (REZ98-0011 ) Comment: At its October 1 meeting, by a vote of 4-2 with Chait and Shannon voting no, the Planning and Zoning Commission recommended denial of the proposed rezoning. Staff recommended denial in a memorandum dated September 25. The applicant has subsequently agreed to a conditional zoning agreement which addresses the concerns raised by staff. Action: Public hearing on an ordinance designating 2 South Linn Street as an Iowa City Comment: At its November 12 meeting by a vote of 8-0, the Historic Preservation Commission recommended approval of the proposed landmark desgination. At its December 17 meeting, by a vote of 1 to 5 on a motion to approve, with Bovbjerg, Chait, Schintler, Shannon, and Supple voting no, the Planning and Zoning Commission recommended denial of the proposed designation. In a letter dated December 1, 1998, the State Historical Society of Iowa concurred with the assessment of the Historic Preservation Commission that the subject property meets the local and state requirements for designation as an Iowa City Historic Landmark. ~ ~ January 12, 1999 City of Iowa City Page 6 C= de Public hearing on an ordinance changing the zoning designation of approximately 0.2 acres located at 703 Benton Court from Medium Density Single-Family Residential (RS-8) to High Density Multi-Family Residential (RM-44). (REZ98-0016) Comment: At its November 19 meeting, by a vote of 3-3-1, Ehrhardt, Gibson and Shannon voting no and Schintler abstaining, the Planning and Zoning Commission recommended denial of the proposed rezoning. Staff recommended approval in its October 15 report. In a letter dated November 23, the applicant asked that the Public hearing on an ordinance changing the zoning designation of 21.26 acres located on the east side of Naples Avenue form Intensive Commercial (C1-1) to Sensitive Areas Overlay Zone-Intensive Commercial (OSA-CI-1). Comment: At Its November 19 meeting, by a vote of 6-1, Ehrhardt voting no, the Planning and Zoning Commission recommended approval of the rezoning and associated Sensitive Areas Development Plan, to permit grading in Areas A and B of the rezoning exhibit, Subject to the establishment of native plant species on the altered slopes, and removal of area C form the plan. In its October 15 report, staff recommends approval subject to the conditions included by the Commission. (VAC98-0006) (Second consideration) Comment: At its November 5 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of this vacation, subject to the Old Johnson Street right-of-way remaining open to public recreational use and not being fenced off or otherwise separated from Market Square Park, the alley right-of-way remaining open to fire and emergency vehicle access, and subject to the retention of all necessary utility easements. Consider a resolution approving a final plat of Village Green Part ~a 30.85 acre, 2-lot residential subdivision with two outlots located on Wellington Drive. (SUB98-0029) ITEM NO. 7. Comment: At its November 19 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this final plat subject to staff approval of legal papers and construction drawings. The legal papers and construction drawings are under review. Staff recommended approval in its November 19 report. Action: ~L~/1~z¢/----~- /, '/" ~ PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE PARK MAINTENANCE BUILDING IN NAPOLEON PARK. Comment: This project includes the construction of a pre-engineered building in the north end of Napoleon Park. It will house the maintenance and management operations of the Parks, Forestry, and CBD Divisions, allowing for the relocation of all Forestry equipment and personnel from Oakland Cemetery. The building is 11,250 square feet in size, and the estimated construction cost is ~786,000. Staff requests the public hearing be continued and the resolution deferred to January 26 to correct discrepancies in plans and specifications be PUBLIC HEARING Action: ~ CONSIDER A RESOLUTION APPROVING Action: ~/~ January 12, 1999 City of Iowa City Page 8 ITEM NO. 8. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE SUMMIT STREET BRIDGE RECONSTRUCTION PROJECT [PROJECT NO. BRM-3715(13)--8N-52], ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves the complete removal and replacement of the Summit Street Bridge spanning the Iowa Interstate Railroad and the reconstruction of the Summit Street pavement between Kirkwood Avenue and Sheridan Avenue along with installation of water main, storm sewer facilities, and sidewalk. The estimated construction cost is $1,246,000. This project will be funded with approximately ~729,000 of Federal Aid Highway Bridge Replacement and Rehabilitation Program monies and about 951 7,000 of Road Use Tax revenue and General Obligation bonds. This project will be let by the Iowa Department of Transportation on February 16, 1999. a. PUBLIC HEARING Action: ITEM NO. 9. b. CONSIDER A RESOLUTION APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE SAND PIT PUMP STATION - LOWER TERMINUS PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project includes construction of the Lower Terminus (below ground level) of the sand pit pump station. This pump station will pump raw water from both the Iowa River intake structure and the 18 acre sand pit to the water treatment plant. A maximum of 3.8 million gallons per day (mgd) of river water and 1.2 mgd of sand pit water will be available for treatment. The estimated cost is $590,000 and will be funded with Water Revenue bonds. PUBLIC HEARING Action: ~._~ CONSIDER A RESOLUTION APPROVING Action: January 12, 1999 City of Iowa City Page 9 ITEM NO. 10. CONDITIONAL CONVEYANCE OF VACATED PORTIONS OF THE OLD JOHNSON STREET RIGHT-OF-WAY AND ADJOINING ALLEY LOCATED EAST OF NORTH MARKET SQUARE PARK, AND SOUTH OF HORACE MANN SCHOOL, TO THE IOWA CITY SCHOOL DISTRICT FOR THE PURPOSES OF PROVIDING A NEARBY PUBLIC PARK TO THE STUDENTS OF HORACE MANN SCHOO~.,/FOR A PUBLIC PURPOSE AND WITHOUT COMPENSATION. Comment: The City Council has held a public hearing on an ordinance vacating portions of street right-of-way located east of North Market Square Park and south of Horace Mann School for the purpose of transferring ownership of said right-of-way to the Iowa City School District for a park and subject to certain provisions for continued use of the properties by the public. As this transfer of ownership is to a governmental body for the public purpose of a park, it is proposed that said property transfer be made without compensation pursuant to Iowa Code §364.7(3) (1997). a. PUBLIC HEARING Action: ITEM NO. 11. b. CONSIDER A RESOLUTION AUTHORIZING SECTION 14, CHAPTER 5, ARTICLE A, BUILDING CODE, BY ADOPTING VOLUMES 1, 2, AND 3 OF THE 1997 EDITION OF THE UNIFORM BUILDING CODE PUBLISHED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, AND PROVIDING FOR CERTAIN AMENDMENTS THEREOF; TO PROVIDE FOR THE PROTECTION OF THE HEALTH, WELFARE, AND SAFETY OF THE CITIZENS OF IOWA CITY, IOWA Comment: Pursuant to Council request, the amendment of the 1997 Uniform Building Code regarding the fee for building permits has been revised such that fees will not increase due to amended language in the code. Also, the Historic Preservation Commission has reviewed the amendments and does recommend adoption. Furthermore, the foundation wall reinforcement issue has been revisited, and a provision has been included for alternate reinforcing layout which was proposed by the Home Builders Association of Iowa City. Staff recommends Council give this item first consideration so that it can be adopted and implemented by March 1, 1999. a. PUBLIC DISCUSSION Action: b. CONSIDER AN ORDINANCE AMENDING TITLE 7, CHAPTER 1, FIRE PREVENTION AND PROTECTION, BY ADOPTING THE 1997 EDITION OF THE UNIFORM FIRE CODE AND PROVIDING FOR CERTAIN AMENDMENTS THEREOF; TO PROVIDE FOR THE PROTECTION OF THE HEALTH, WELFARE AND SAFETY OF THE CITIZENS OF IOWA CITY, IOWA. (FIRST CONSIDERATION) Comment: Council held a public discussion of this item on November 17. Members of the Homebuilders Association have been kept informed of all items discussed by the Board of Appeals during development of the local amendments. Representatives of the Homebuilders Association were present at several Board meetings and provided valuable input into the ordinance. Staff recommends Council give first consideration of this item. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 5, ARTICLE B, OF THE CITY CODE, BY ADOPTING THE 1997 EDITION OF THE UNIFORM PLUMBING CODE, WITH CERTAIN AMENDMENTS, TO REGULATE THE PRACTICE, MATERIALS AND FIXTURES USED IN THE INSTALLATION, MAINTENANCE, EXTENSION, AND ALTERATION OF ALL PIPING, FIXTURES, APPLIANCES AND APPURTENANCES IN CONNECTION WITH VARIOUS PLUMBING SYSTEMS, TO PROVIDE FOR THE ISSUANCE OF PERMITS AND INSPECTION OF PLUMBING INSTALLATIONS AND THE COLLECTION OF FEES, AND TO PROVIDE PENALTIES FOR VIOLATIONS. (FIRST CONSIDERATION) ITEM NO. 16. Comment: See Item No. 12 for comment. ~TA~~HORIZING CONSIDER A RESOLUTION TH THE ACQUISITION OF PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE FOSTER ROAD Comment: The City of Iowa City must acquire rig p sements, and temporary construction easements to construct the Foster Road Improvements Project. This resolution authorizes City staff to negotiate and the Mayor to sign these documents, including authorization of condemnation if necessary. Every effort will be made to negotiate acceptable agreements without resorting to condemnation. Prior to proceeding with condemnation, staff will notify Council. CONSIDER A RESOLUTION ESTABLISHING A REVISED SCHEDULE OF FEES AND CHARGES FOR PARKS AND RECREATION SERVICES AND PROGRAMS, EXCLUDING THE POTTER'S STUDIO. Comment: The Parks and Recreation Commission and staff review fees and charges annually, and increases are considered in order to help support the Recreation Division's budget. A three-year plan has been established, with FYO0 fee increases being recommended for adoption at this time, and FY01 and FY02 fee increases tentatively identified, Some of the FYO0 increases will actually be implemented in FY99 because the summer season begins in FY99 but continues into FYO0. The Parks and Recreation Commission reviewed and adopted the proposed increases at their meeting of December 9, 1998. CONSIDER STUDIO IN Comment: A RESOLUTION ESTABLISHING FEES AND CHARGES FOR THE POTTER'S THE ROBERT A. LEE COMMUNITY RECREATION CENTER. See above. //"'~ K"~'x4 CONSIDER A RESOLUTION/~~XECUTION OF A REVISED CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE CITY OF CORALVILLE REGARDING CERTAIN OBLIGATIONS INVOLVING THE IOWA RIVER POWER DAM RENOVATION PROJECT. Comment: In Spring of 1997 Iowa City and Coralville executed a 28E Agreement regarding the cities' respective obligations in connection with the Iowa River Power Dam Renovation Project. Since the execution of the original agreement changes have been made to the design of the project which affect the relative obligations of the cities and require the execution of a revised 28E Agreement. Changes include a final agreement on design, additional expense to Coralville for design changes to the westerly approach walk, clarification that Iowa City is responsible for property acquisition and acknowledgement by both parties that Iowa City will use 5th Street Place to gain access to the dam for maintenance. IN CONNECTION WITH THE AIRPORT MASTER PLAN PROJECT. ITEM NO. 22. ITEM NO. 23. Comment: ACSG, Inc. has requested an increase in funding of $285,000 based on the costs ACSG has and will incur performing property acquisition services in connection with the Airport Master Plan Project. Ninety percent (90%) of this additional funding is eligible for reimbursement from the Federal Aviation Administration (FAA). The Iowa City Airport Commission has approved ACSG's request subject to approval of the FAA and the City Council authorizing said additional funding. Action: CONSIDER A RESOLUTION TO ADOPT THE IOWA CITY POLICE CITIZENS REVIEW BOARD STANDARD OPERATING PROCEDURES AND GUIDELINES. Comment: Section 8-8-7(4) of the City Code establishes the Police Citizens Review Board (PCRB) and requires that procedural rules be approved by the City Council. After months of review, the PCRB adopted standard operating procedures and guidelines at their September 15 meeting and recommended approval by the 'City Council at their October 6 meeting. Consideration of this item was deferred on October 20, November 17, and December 15. Correspondence and staff memorandum included in Council packet. CONSIDER A RESOLUTION ADOPTING THE SALES TAX POLICY. Comment: On November 17, 1998, the City Council of Iowa City adopted Resolution 98-372 requesting a special election on March 30, 1999, on the imposition of a local sales tax and services tax. (1) Historic Preservation Commission - Four vacancies (including one Brown Street District and one Moffitt Cottage District representative) to fill three- year terms ending March 29, 2002. (Terms expire for Betty Kelly, Lars Anderson, Marc Mills, and Doris Malkmus.) (4 females and 2 males currently serve on this Commission.) (2) Telecommunications Commission - Two vacancies to fill three-year terms ending March 13, 2002. (Terms expire for Jim Pusack and Cordell Jeppsen.)
