CONSIDER A RESOLUTION DETERMINING THE NECESSITY AND
SETTING DATES OF A CONSULTATION (FEBRUARY 22) AND A
PUBLIC HEARING (MARCH 23) ON A PROPOSED NORTHGATE
CORPORATE PARK URBAN RENEWAL PLAN FOR A PROPOSED
URBAN RENEWAL AREA IN THE CITY OF IOWA CITY, IOWA.
Comment: The proposed resolution states that the Council has reasonable
cause to believe that the proposed urban renewal area satisfies the eligibility
criteria for designation as an urban renewal area under Iowa law. The
resolution sets the date for the public hearing on the proposed plan for March
23, 1999.

CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
FEBRUARY 23 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE RIVER STREET /
WOOLF AVENUE RECONSTRUCTION PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project involves the reconstruction of the River Street
pavement between N. Riverside Drive and WooIf Avenue, the reconstruction
of the WooIf Avenue pavement from Rider Street to approximately 300' north
of River Street, and the installation of water main, sanitary sewer and Phase
II of the Riverside/Arts Campus storm sewer improvements. The estimated
construction cost is ~2,193,000 of which approximately ~550,000 will be
funded by The University of Iowa. Iowa City's share of the cost will be
funded with Road Use Tax revenue and General Obligation bonds.

CONSIDER A MOTION SETTING A PUBLIC HEARING FOR FEBRUARY 23
REGARDING A BUDGET AMENDMENT TO THE FY99 ANNUAL ACTION
PLAN.
Comment: At their January 21 meeting, the Housing and Community
Development Commission voted to approve an additional allocation of
$60,000 in FY99 HOME funds to Riverview Place Apartments LP. These
funds were needed to leverage State HOME funds that had been committed
to the project. A public hearing is being held to comply with the Citizen
Participation Plan requirements outlined in CITY STEPS.

CONSIDER A MOTION SETTING A PUBLIC HEARING FOR MARCH 2
ON THE CITY OF IOWA CITY FY2000 IOWA DEPARTMENT OF
TRANSPORTATION CONSOLIDATED TRANSIT FUNDING APPLICATION AND
AUTHORIZING THE PUBLICATION OF A NOTICE OF SAID HEARING.
Comment: In March, JCCOG will be completing Iowa City Transit's FY2000
Iowa Department of Transportation Consolidated Transit Funding Application.
This application will contain FY2000 State Transit Assistance formula
operating funds and Federal Transit Administration Section 5307 and/or 5309
operating and capital projects. A public hearing on the application is required
by law with a notice of the hearing published in advance. The grant
application will be available for public review prior to the public hearing.

FEBRUARY 23 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE

Comment: This resolution sets a public hearing on the FY2000 Proposed
Operating Budget, the three-year Financial Plan and multi-year Capital
Improvements Program (CIP) through Fiscal Year 2003 on February 23,
1999. Detailed information on the budget will be available for public
inspection on February 12, 1999.

LOCATED AT 1212 HIGHLAND AVENUE, IOWA CITY, IOWA.
Comment: The owner of the property located at 1212 Highland Avenue
received $4,200 assistance through the City's Housing Rehabilitation
Program on October 2, 1990. The financing was in the form of a 5-year,
low-interest loan. The loan has been paid in full; thus the lien can now be
released.

CONSIDER A RESOLUTION NAMING DEPOSITORIES.
Comment: This resolution will change the names of two depositories and the
home office location for these two depositories. This resolution will also
increase the maximum depository balance at three institutions. On November
16, 1998, First National Bank Iowa became Mercantile Bank Midwest. The
home office location for Mercantile Bank Midwest is West Des Moines, Iowa.
We are recommending that the investment limit at Mercantile Bank Midwest
be increased to $25,000,000. On December 4, 1998, Magna Bank, N.A.
became Union Planters Bank, N.A. The home office location for Union
Planters Bank, N.A. is Cordova, Tennessee. We are recommending that the
investment limit at Hawkeye State Bank be increased to $20,000,000. We
are recommending that the investment limit at Brenton Bank be increased to
$6,000,000.

Consider an ordinance changing the zoning designation of 21.26 acres located on
the east side of Naples Avenue form Intensive Commercial (C1-1) to Sensitive
Areas Overlay Zone-Intensive Commercial (OSA-CI-1). (Second consideration)
Comment: At its November 19 meeting, by a vote of 6-1, Ehrhardt voting no, the
Planning and Zoning Commission recommended approval of the rezoning and
associated Sensitive Areas Development Plan, to permit grading in Areas A and B
of the rezoning exhibit, subject to the establishment of native plant species on the
altered slopes, and removal of area C form the plan. In its October 15 report, staff
recommends approval subject to the conditions included by the Commission.
Action:
Consider a resolution approving a final plat of Boyd's Fashionable Acres, an 11.51
acre, 16-Lot residential subdivision located on the south side of Rochester Avenue,
east of Post road, and west of Mt. Vernon Road. (SUB98-0030)
Comment: At its December 17 meeting, by a vote of 5-2, with Ehrhardt and
Supple voting no, the Planning and Zoning Commission recommended approval of
the final plat subject to staff approval of legal papers and construction drawings
prior to City Council consideration. The legal papers are under review.
Construction drawings have been approved. Staff recommended approval in its
December 17 staff report. Deferred on January 26.
Consider a response to the Johnson County Board of Supervisors regarding a
request by the Board to resolve a rezoning issue in Area B of the Johnson
County/Iowa City Fringe Area Agreement.
Comment: After consultation with representatives of the Board of Supervisors,
the City Council representatives recommend a letter be sent to the Board
supporting the Board's proposed resolution of the Milder rezoning case and
advocating reservation of the 18.4 acre outlot as a parcel on which no further

PLACE FOR RECEIPT OF BIDS.
Comment: This project consists of construction and reconstruction of sidewalk curb
ramps to A.D.A. standards along routes prioritized by JCCOG and special interest
groups and a new sidewalk along the south side of Highway 6 from Heinz Road to the
bus stop at Bon Aire. The estimated construction cost is approximately $270,000.
Road Use taxes, bond proceeds, and the IDOT will fund this project.

COST FOR THE CONSTRUCTION OF THE IOWA CITY DOWNTOWN
STREETSCAPE, PHASE II IMRPOVEMENTS, ESTABLISHING AMOUNT OF
BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO
PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR
RECEIPT OF BIDS.
COMMENT: Phase II of the Downtown Streetscape project includes
improvements to College Street and Washington Street between Clinton Street
and Gilbert Street; Clinton Street and Linn Street between Iowa Avenue and
Burlington Street; and Dubuque Street between the Phase I improvements and
Burlington Street. Due to budgetary considerations, the bidding documents shall
be amended to allow the City of Iowa City the option of removing from this
project the streetscape improvements associated with Clinton Street and/or Linn
Street. The adopted Downtown Streetscape Plan has been used to guide the
final design improvements. The total estimated construction cost for all work is
$2,200,000 and will be financed with General Obligation bonds.

CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 9, CHAPTER 4, ENTITLED
"PARKING REGULATIONS," ARTICLE 4, ENTITLED "GENERAL PARKING
RESTRICTIONS," SECTION H, ENTITLED "IN EXCESS OF FORTY-EIGHT HOURS"
REGARDING THE STORAGE OF VEHICLES ON STREETS, ALLEYS AND PUBLIC
PROPERTY. (SECOND CONSIDERATION)
Comment: Section 9-4-4H currently prohibits any vehicle from being parked or
remaining "at the same location upon any street, alley or public ground at any time for
a period longer than forty eight (48) hours." The issue has arisen as to what
constitutes "the same location." This amendment specifies that a vehicle must be
moved at least twenty feet (20') in order to comply with the ordinance. Requiring a
vehicle to be moved at least twenty feet (20') is consistent with one of the purposes
of the ordinance, which is to allow for general street cleaning and snow removal.

ENTITLED "MOTOR VEHICLES AND TRAFFIC," BY AMENDING CHAPTER 3, SECTION
6B THEREIN TO REDUCE THE SPEED LIMIT ON NAPLES AVENUE FROM THE CITY
LIMIT TO THE INTERSECTION WITH IOWA HIGHWAY 1. (SECOND CONSIDERATION)
Comment: Currently this portion of roadway does not have a posted speed limit,
which defaults to 55 mph during daylight hours and 50 mph during non-daylight
hours. As the adjacent property continues to develop and conflict points and
driveways are introduced, the existing speed limit is inappropriate. Because of sight
distance limitation, staff's recommendation is to reduce the speed limit to 35 mph.
Because Naples Avenue from the corporate limits to the intersection with Iowa
Highway 1 is under the joint jurisdiction of Iowa City and Johnson County, the speed
limit must be adopted jointly by the Iowa City City Council and the Johnson County
Board of Supervisors. The Johnson County Board of Supervisors considered this
matter at their February 2, 1999, work session.

BUILDING CODE, BY ADOPTING VOLUMES 1, 2, AND 3 OF THE 1997 EDITION OF
THE UNIFORM BUILDING CODE PUBLISHED BY THE INTERNATIONAL CONFERENCE
OF BUILDING OFFICIALS, AND PROVIDING FOR CERTAIN AMENDMENTS THEREOF;
TO PROVIDE FOR THE PROTECTION OF THE HEALTH, WELFARE, AND SAFETY OF
THE CITIZENS OF IOWA CITY, IOWA. (PASS AND ADOPT)
Comment: Pursuant to Council request, the amendment of the 1997 Uniform Building
Code regarding the fee for building permits has been revised such that fees will not
increase due to amended language in the code. Also, the Historic Preservation
Commission has reviewed the amendments and does recommend adoption.
Furthermore, the foundation wall reinforcement issue has been revisited, and a
provision has been included for alternate reinforcing layout which was proposed by the
Home Builders Association of Iowa City.

PREVENTION
Comment: Council held a public discussion of this item on November 17. Members
of the Homebuilders Association have been kept informed of all items discussed by
the Board of Appeals during development of the local amendments. Representatives
of the Homebuilders Association were present at several Board meetings and provided
valuable input into the ordinance.

CONSIDER A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS
FOR THE CONSTRUCTION OF THE RIVER STREET / WOOLF AVENUE
RECONSTRUCTION PROJECT.
Comment: The City of Iowa City must acquire right-of-way and temporary
construction easements to facilitate the construction of the River Street / WooIf
Avenue Reconstruction Project. This resolution authorizes City staff to negotiate and
the Mayor to sign these documents, including authorization of condemnation if
necessary. Every effort will be made to negotiate acceptable agreements without
resorting to condemnation. Prior to proceeding with condemnation, staff will notify
Council.
CONSIDER A MOTION TO ACCEPT THE FORM OF TAX EXEMPTION CERTIFICATE
PERTAINING TO THE $7,000,000 SEWER REVENUE BONDS.
Comment: This certificate is executed and delivered in connection with the issuance
by the City of $7,000,000 Sewer Revenue Bonds. This certificate sets out in detail a
number of facts, promises, and obligations which must be met and agreed to by the
City in order to maintain these Bonds as tax exempt.
CONSIDER A MOTION TO ACCEPT THE FORM OF CONTINUING DISCLOSURE
CERTIFICATE PERTAINING TO THE $7,000,000 SEWER REVENUE BONDS.
Comment: This certificate is executed and delivered in connection with the issuance
by the City of Iowa City of ~7,000,000 Sewer Revenue Bonds. The disclosure
certificate is being executed and delivered for the benefit of the holders and beneficial
owners of the bonds and in order to assist the participating underwriters in complying
with the Securities Exchange Commission (SEC) Rule 15c-12(b)(5).

AND SECURING THE PAYMENT OF $7,000,000 SEWER REVENUE BONDS OF THE
CITY OF IOWA CITY, IOWA, UNDER THE PROVISIONS OF THE CITY CODE OF IOWA,
AND PROVIDING FOR A METHOD OF PAYMENT OF SAID BONDS.

CONSIDER MOTION GRANTING A 30 DAY EXTENSION TO THE POLICE CITIZENS'
REVIEW BOARD FOR THE FILING OF A REPORT WITH THE CITY COUNCIL ON
COMPLAINT #98-19.
Comment: Ordinance 97-3792 establishes the Police Citizens' Review Board and sets
forth reporting mechanisms for complaints. The Ordinance also provides for the City
Council to grant extensions of the 30-day reporting requirement for good cause. At
their meeting of January 26, 1999, the Board unanimously requested a 30-day
extension for the reasons stated in the letter included in Council packet. If the
extension is granted, the Board intends to have a report filed with the City Council no
later than March 14, 1999.

CONSIDER A RESOLUTION REGARDING THE STATUS OF THE CITY OF TIFFIN AS A
"NON-CONTIGUOUS" CITY ON NOVEMBER 17, 1998, THE DATE OF THE IOWA CITY
CITY COUNCIL'S RESOLUTION REQUESTING SUBMISSION OF THE QUESTION OF
THE IMPOSITION OF THE LOCAL SALES AND SERVICES TAX TO THE QUALIFIED
ELECTORS OF THE INCORPORATED AND UNINCORPORATED AREAS OF JOHNSON
COUNTY.
Comment: Comment: By Resolution No. 98-372 the City Council requested
submission of the question of the imposition of a local sales and services tax to the
qualified electors of the incorporated and unincorporated areas of Johnson County.
One of the "Whereas" (non-binding) clauses of the resolution incorrectly identified
Tiffin as contiguous city. This corrective resolution identifies the error, and states that
the identification of contiguous cities in the earlier resolution was unnecessary and
immaterial to the calling of the election.
