Comment: This bi-annual project involves the asphalt resurfacing and the chip sealing of various streets throughout Iowa City. February 23, 1999 City of Iowa City Page 3 q~- CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 2 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY TRANSIT FACILITY METHANE ABATEMENT PROJECT, PHASE I, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves drilling three horizontal collector runs under the transit facility to extract the methane from under the building footprint. f. Resolutions. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA STATE BANK AND TRUST COMPANY, IOWA CITY, 10WA FOR PROPERTY LOCATED AT 435 - 437 SOUTH SUMMIT STREET, IOWA CITY, IOWA. Comment: Iowa State Bank and Trust Company has requested that the City approve a Subordination Agreement for 435 - 437 South Summit Street. On October 30, 1990, the owners of the property received a $17,000 ten-year declining balance loan. Iowa State Bank and Trust Company has refinanced the first mortgage with the property owners. The property is appraised at $185,000 which provides enough equity to cover the City's second lien position, of which was the City's original position. (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 2014 HANNAH JO COURT, IOWA CITY, IOWA. Comment: The owners of the property located at 2014 Hannah Jo Court received assistance through the City's Downpayment Assistance Program for the amount of 93,000 on October 31, 1996. The financing was in the form of a Mortgage. The loan was paid off on February 12, 1999; thus the lien can now be released. (3) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE SANITARY SEWER AND WATER MAIN PUBLIC IMPROVEMENTS FOR AUDITOR'S PARCEL 98068. Comment: See Engineer's Report. (4) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE WATER MAIN PUBLIC IMPROVEMENTS FOR IDYLLWILD CONDOMINIUMS (BUILDINGS 15- 18). Comment: See Engineer's Report. Consider a motion setting a public hearing for March 23 on an ordinance changing the zoning designation of approximately 8.08 acres located at the west termini of Langenberg Avenue and Hemingway Lane from Medium Density Single-Family Residential (RS-8) to Planned Development Housing Overlay/Medium Density Single- Family Residential (PDH-8). (REZ98-0018) Comment: At its February 4 meeting, by a vote of 4-2 with Bovbjerg and Ehrhardt voting no, the Planning and Zoning Commission recommended approval of the proposed rezoning subject to conditions, as recommended by staff. The staff recommendation is contained in its report dated January 21. Action: February 23, 1999 City of Iowa City Page 5 ITEM NO. 8. Conditionally changing the zoning designation of approximately 61.8 acres located south of Whispering Meadows Drive from Medium Density Single-Family Residential (RS-8) to Factory Built Housing Residential (RFBH - 59.25 acres) and Low Density Multi-Family Residential (RM-12 - 2.55 acres). (REZ98-0011 ) Comment: At its October 1 meeting, by a vote of 4-2 with Chait and Shannon voting no, the Planning and Zoning Commission recommended denial of the proposed rezoning. Staff recommended denial in a memorandum dated September 25. The applicant has subsequently agreed to a conditional zoning agreement which addresses the concerns raised by staff. (1) Public Hearing (continued from January 26) (2) Consider an Ordinance (First consideration) Consider an ordinance changing the zoning designation of 21.26 acres located on the east side of Naples Avenue from Intensive Commercial (C1-1) to Sensitive Areas Overlay Zone-Intensive Commercial (OSA-CI-1). (Pass and adopt) Comment: At its November 19 meeting, by a vote of 6-1, Ehrhardt voting no, the Planning and Zoning C'ommission recommended approval of the rezoning and associated Sensitive Areas Development Plan, to permit grading in Areas A and B of the rezoning exhibit, subject to the establishment of native plant species on the altered slopes, and removal of area C form the plan. In its October 15 report, staff recommends approval subject to the conditions included by the Commission. Staff has received a plan that conforms with the Planning and Zoning Commission's recommendation. PUBLIC HEARING TO DISCUSS THE PROPOSED OPERA~/~R THE FISCAL YEAR JULY 1, 1999, THROUGH JUNE 30, 2000, THE PROPOSED THREE- YEAR FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2003. Comment: This public hearing is to allow public comment on the FY2000 Proposed Operating Budget, the three-year Financial Plan and multi-year Capital Improvements Program (CIP) through Fiscal Year 2003. Detailed information on the budget will be available for public inspection on February 12, 1999. Revisions made during the budget process were outlined in a staff memorandum dated February 12, 1999. AMENDMENT TO THE FY99 ANNUAL ACTION PLAN BUDGET WHICH IS A PART OF THE CONSOLIDATED PLAN AS MANDATED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: At their January 21 meeting, the Housing and Community Development Commission voted to approve an additional allocation of 960,000 in FY99 HOME funds to Riverview Place Apartments LP. These funds were needed to leverage State HOME funds that had been committed to the project. A public hearing is being held to comply with the Citizen Participation Plan requirements outlined in CITY STEPS. Staff memorandum included in Council packet. PUBLIC HEARING Action: ITEM NO. 10. CONSIDER A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE RIVER STREET / WOOLF AVENUE RECONSTRUCTION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves the reconstruction of the River Street pavement between N. Riversidle Drive and WooIf Avenue, the reconstruction of the WooIf Avenue pavement from Rider Street to approximately 300' north of River Street, and the installation of water main, sanitary sewer, storm sewer and Phase II of the Riverside/Arts Campus storm sewer improvements. The estimated construction cost is 92,193,000 of which approximately 9600,000 will be funded by The University of Iowa. Iowa City's share of the cost will be funded with Road Use Tax revenue and General Obligation bonds. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 9, CHAPTER 4, ENTITLED ."PARKING REGULATIONS," ARTICLE 4, ENTITLED "GENERAL PARKING RESTRICTIONS," SECTION H, ENTITLED "IN EXCESS OF FORTY-EIGHT HOURS" REGARDING THE STORAGE OF VEHICLES ON STREETS, ALLEYS AND PUBLIC PROPERTY. (PASS AND ADOPT) Comment: Section 9-4-4H currently prohibits any vehicle from being parked or remaining "at the same location upon any street, alley or public ground at any time for a period longer than forty eight (48) hours." The issue has arisen as to what constitutes "the same location." This amendment specifies that a vehicle must be moved at least twenty feet (20') in order to comply with the ordinance. Requiring a vehicle to be moved at least twenty feet (20') is consistent with one of the purposes of the ordinance, which is to allow for general street cleaning and snow removal. CONSIDER AN ORDINANCE AMENDING TITLE ENTITLED "MOTOR VEHICLES AND TRAFFIC," BY AMENDING CHAPTER 3, SECTION 6B THEREIN TO REDUCE THE SPEED LIMIT ON NAPLES AVENUE FROM THE CITY LIMIT TO THE INTERSECTION WITH IOWA HIGHWAY 1. (PASS AND ADOPT) Comment: Currently this portion of roadway does not have a posted speed limit, which defaults to 55 mph during daylight hours and 50 mph during non-daylight hours. As the adjacent property continues to develop and conflict points and driveways are introduced, the existing speed limit is inappropriate. Because of sight distance limitation, staff's recommendation is to reduce the speed limit to 35 mph. Because Naples Avenue from the corporate limits to the intersection with Iowa Highway 1 is under the joint jurisdiction of Iowa City and Johnson County, the speed limit must be adopted jointly by the Iowa City City Council and the Johnson County Board of Supervisors. The Johnson County Board of Supervisors considered this matter at their February 2, 1999, work session. CONSIDER A RESOLUTION TO ADOPT AMENDED BY-LAWS FOR THE PUBLIC ART ADVISORY COMMITTEE. Comment: By a vote of 6-0, the Public Art Advisory Committee recommended approval of amended by-laws at their December 3, 1998, meeting. The Rules Committee reviewed the proposed amendments and referred the by-laws back to the Public Art Advisory Committee. The Public Art Advisory Committee recommended approval by a vote of 6-0 at their February 11, 1999, meeting of the by-laws as revised by the Rules Committee. Consideration deferred on February 9. Action: February 23, 1999 City of Iowa City Page 8 ITEM NO. 14. ITEM NO. 15. ITEM NO. 16. CONSIDER A RESOLUTION APPROVING THE CALLS TO ARTISTS FOR TWO SCULPTURES IN THE DOWNTOWN PEDESTRIAN MALL. Comment: The Public Art Advisory Committee has chosen the placement of two permanent sculptures on the sculpture pads in the Downtown Pedestrian Mall as the remaining public art project for FY99. There are two Calls to Artists - one targeting Iowa artists and one to be advertised nationally. Both Calls and the budgets included therein are recommended by the Committee for approval, after a public discussion held February 4, 1999. Action: CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR CONSTRUCTION OF SAND PIT PUMP STATION - LOWER TERMINUS PROJECT. Comment: The bid opening for this project was on February 16, 1999, at 10:30 a.m. and the following bid was received: Reynolds, Inc., Orleans, IN Engineer's Estimate 799,325 9590,000 Public Works and Engineering recommend award of the project to Reynolds, Inc. of Orleans, IN. Funding will be from water revenue bonds. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHOR~ TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR CONSTRUCTION OF THE COLLEGE STREET PEDESTRIAN MALL WATER MAIN REPLACEMENT PROJECT. Comment: The bid opening for this project was on February 16, 1999, at 10:30 a.m. and the following bid was received: Project with Bore & Jack Installation Project with Directional Drilling Installation Maxwell Const, Inc., Iowa City, IA Engineer's Estimate 9254,345 9249,775 9203,650 Public Works and Engineering recommend deferring award of the project to the March 2, 1999, Council meeting at which time bids for the Phase II Downtown Streetscape will have been received. Comment: The bid opening for this project was on February 17, 1999, at 2:00 p.m. and the following bids, including four alternates, were received: McCommas-Lacina Construction, Iowa City, IA Clinton Engineering Co., Clinton, IA Selzer-Werderitsch Construction, Iowa City, IA Frye Builders & Associates, Muscatine, IA Henningsen Construction, Atlantic, IA Abild Construction, Cedar Rapids, IA H. It is recommended that the contract be awarded to McComas-Lacina Construction for the low total bid of $871,105 (including four alternates). This project will be funded by General Obligation Bonds, Road Use Taxes, and the General Fund. Action: PUBLIC DISCUSSION [IF NECESSARY] (ITEMS NOT ON THE AGENDA). ITEM NO. 19.
