CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME LOCATED AT 2537 WHISPERING PRAIRIE AVENUE TO A PUBLIC HOUSING PROGRAM TENANT AND SETTING A PUBLIC HEARING FOR AUGUST 2, 2005. Comment: The Iowa City Housing Authority, under its Tenant-to- Ownership Program, proposes to sell 2537 Whispering Prairie Avenue to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $110,000. The family has participated in the public housing program for eight years. The family has received a written commitment for a mortgage from a local bank in the amount of $82,500. The City will provide a second mortgage for the remaining $27,500. This sale will provide the opportunity for a Iow-income family to obtain ownership of their own home. July 19, 2005 City of Iowa City Page 3 e) ResOlutions. o~-- g..~l 1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 2409 ASTER AVENUE, IOWA CITY, IOWA. Comment: On September 16, 2002, the owner of 2409 Aster Avenue executed a Second Mortgage in the amount of $8,100 to secure a loan from the City for said amount as part of the Tenant to Ownership Program. The owner of 2409 Aster Avenue also executed a Resale Agreement with the City on September 16, 2002, for the property at 2409 Aster Avenue. The owner sold the home to another income-eligible buyer. The loan was fully paid on July 8, 2005, and the owner has met all the obligations contained in the Resale Agreement. It is now the City's responsibility to release these liens. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RESALE AND OCCUPANCY AGREEMENT REGARDING THE PROPERTY LOCATED AT 2409 ASTER AVENUE, IOWA CITY, IOWA. Comment: On July 8, 2005, the Iowa City Housing Authority, through its Affordable Dream Home Program, provided a income-eligible family a $20,500 loan, which is secured by a second mortgage, to assist them in the purchase of the single-family home located at 2409 Aster Avenue. In the event that the family sells the home within fifteen years, the Resale and Occupancy Agreement requires that the owners sell the property to an income-eligible family and that the City receive a percentage of the appreciated value of the property. © c~ _ <p .~ 3. CONSIDER AMENDING RESOLUTION 03-229 APPROVING A FINAL PLAT OF HIGHLAND WOODS, A 6.92 ACRE 10-LOT RESIDENTIAL SUBDIVISION LOCATED WEST OF CUMBERLAND LANE BY AMENDING THE NAME OF THE PROPERTY OWNER AND THE LEGAL DESCRIPTION OF THE PROPERTY. Comment: The final plat for the Highland Woods subdivision was approved by Resolution No. 03-229 on July 15, 2003. A title objection has been raised regarding typographical errors contained in the resolution. The property owner was incorrectly named and the legal description contained a discrepancy. CONSIDER A RESOLUTION ESTABLISHING THE NAME OF THE LOCAL STREET LOCATED BETWEEN MORMON TREK BOULEVARD AND DANE ROAD ADJACENT TO J JR DAVIS ADDITION PART 2, IOWA CITY, IOWA, AND J JR DAVIS ADDITION PART 3, IOWA CITY, IOWA Comment: On April 25, 2005, the City Council via Resolution Nos. 05-149 and 05-150 approved the final plats of J JR Davis Second Addition and J JR Davis Third Addition. Said final plats lie adjacent to both sides of an east-west City local street connecting Mormon Trek Boulevard and Dane Road, which street has been designated as "Eagle View Drive" on each plat. Because said local street lies adjacent to these plats, but is not contained within either one, the City should formally establish its name by resolution. This resolution establishes "Eagle View Drive" as the name of the street. ©~-~ 5. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE 2004 SANITARY SEWER REPAIR PROJECT. Comment: This project has been completed in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. This project repaired the sanitary and storm sewer system at a variety of sites located throughout Iowa City. o~ .~ ~'~,~) 6. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 838 RUNDELL STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 838 Rundell Street received assistance through the City of Iowa City's Housing Rehabilitation Program. Action: e) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR AUGUST 2 ON A RESOLUTION VACATING ALLEY RIGHT-OF-WAY IN PENINSULA NEIGHBORHOOD FIRST ADDITION (VAC05-00005) Comment: It is anticipated the Planning and Zoning Commission will act on this vacation at it's July 21 meeting. Action: f) VACATING AND AUTHORIZING CONVEYANCE OF THE PUBLIC ALLEYS WITHIN THE PENINSULA NEIGHBORHOOD SECOND ADDITION IOWA CITY, IOWA. (VAC05-00004) Comment: At its June 16 meeting, by a vote of 6-0 (Brooks absent), the Planning and Zoning Commission recommended approval of vacating the alleys in Peninsula Neighborhood Second Addition. Staff recommended approval in a report dated June 16. Staff recommends conveyance of the alleys to Peninsula Development L.L.C., which previously paid for them pursuant to its development agreement with the City. 1. The territory is part of the Clear Creek Master Plan, endorsed by the City in April, 2002. Staff recommended approval in a report dated April 21. h) CONSIDER A RESOLUTION APPROVING THE PRELIMINARY PLAT OF ok - ~ © MWD DAVIS ADDITION, IOWA CITY, IOWA (SUB05-00003) Comment: At it's May 5 meeting, by a vote of 6-0 (Shannon absent), the Planning and Zoning Commission recommended approval of the preliminary plat of MWD Davis Addition, a 14-1ot commercial subdivision located north of Highway 1 and west of Highway 218. The Sensitive Areas Overlay Development Plan was approved by Council on July 5. Staff recommended approval in a report dated April 21 and in a subsequent memorandum dated April 29. i) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF MWD DAVIS ADDITION, A PORTION OF WHICH INCLUDES A RESUBDIVlSION OF LOTS 13-17 OF RH DAVIS SUBDIVISION, AND A PORTION OF OLDE OAK LANE IN RH DAVIS SUBDIVISION, IOWA CITY, IOWA (SUB05-00009) Comment: At it's July 6 meeting, by a vote of 6-0 (Brooks absent), the Planning and Zoning Commission recommended approval of the final plat of MWD Davis Addition, subject to approval of legal papers and construction plans prior to Council consideration. Legal papers have been approved. Construction plans have not been approved. Staff recommended approval in a report dated July 6, 2005. Staff recommends deferral due to delay of construction plans. CONSIDER A RESOLUTION Act,on: k) CONSIDER A RESOLUTION APPROVING THE PRELIMINARY PLAT OF ~ ~,~ VILLAGE GREEN, PARTS ~111 AND ~lV, IOWA Cl~, IOWA (SUB04- 00017) Comment: At it's May 5 meeting, by a vote of 6-0 (Shannon absent), the Planning and Zoning Commission recommended approval of the pmlimina~ plat of Village Green, Pads XXIII and ~IV, a 76-1ot, 25.67-acre, residential subdivision located on Wintergreen Drive. Approval will allow the development of 38 single-family lots and 38 attached zero-lot line lots. Staff recommended approval in a memorandum dated March 31, 2005. The rezoning for this subdivision was approved at the July 5, 2005 City Council meeting. Action: July 19, 2005 City of Iowa City Page 10 ITEM 5. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY LANDFILL FY06 CELL CONSTRUCTION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include constructing an additional cell on the west half of the landfill. This new cell will be constructed in accordance with all federal and state regulations. The estimated construction is $2,000,000 and will be funded with Landfill revenues. a) PUBLIC HEARING Action: 5 - ~z~'_'~ b) CONSIDER A RESOLUTION Action: .. ? ITEM 6. DECLARING THE CI~'S INTENT TO PROCEED WITH AND AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE HIGHWAY 6 IMPROVEMENT PROJECT. Comment: The City of Iowa City must acquire permanent easements and temporaw construction easements to construct the Highway 6 Improvement Project. This public hearing provides interested padies the oppodunity to present their views on the project and the proposed acquisition of prope~y rights. This project includes widening Highway 6 from Lakeside Drive to just beyond 420th Street. a) PUBLIC HEARING Action: ~ ~ b) CONSIDER A RESOLUTION July 19, 2005 City of Iowa City Page 11 ITEM 7. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE TRANSPORTATION PLANNING DIVISION OF THE PLANNING AND COMMUNITY ~' --~4,,~ .. DEVELOPMENT DEPARTMENT BY THE ADDITION OF ONE HALF-TIME ASSOCIATE PLANNER POSITION. Comment: The JCCOG Urbanized Area Policy Board, at its meeting of July 6, 2005, approved the addition of one half-time (.5) Associate Planner position for the JCCOG Transportation Planning Division which will, in effect, increase' the half-time FTE to a full time position. This will allow an Associate Planner to perform duties related to traffic engineering issues, land used planning and transportation planning while allowing the JCCOG Executive Director more time to concentrate on administrative and management tasks that cannot be addressed adequately when the Executive Director is providing backup for the previously mentioned tasks. ITEM 8. CONSIDER A RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED ~ HUMPS ON THE 300 BLOCK OF FOURTH AVENUE. Comment: The residents of the 300 block of Fourth Avenue have successfully completed the City of Iowa City Traffic Calming Program. This resulted in a survey of the neighborhood yielding a 80% majority in favor of speed humps. . ~ ITEM 9. CONSIDER A RESOLUTION AWARDING THE VEHICLE TOWING AND .~ z~cr~ STORAGE SERVICES CONTRACT TO BIG 10 UNIVERSITY TOWING, INC. Comment: The Request for Proposal document was posted to the City of Iowa City's web site on May 18, 2005. The City received one proposal for this contract on June 21, 2005. The City is recommending Big 10 University Towing, Inc. for the three-year contract. Big 10 University Towing, Inc. will provide towing and storage services for vehicles impounded due to traffic violations, abandonment, and police investigation. July 19, 2005 City of Iowa City Page 12 ITEM 10. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN EXTENSION OF THE AGREEMENT WITH IOWA REALTY -~z~c~ COMMERCIAL TO SELL AND LEASE PROPERTY IN THE AVIATION COMMERCE PARK. Comment: The listing agreement to sell and lease the property known as the Aviation Commerce Park subdivision executed by the Airport Commission, the City Council, and Iowa Realty Commercial will expire on July 22, 2005. The parties amended the listing agreement in June 2004 and again in January 2005 by extending it for six months each time. This would extend the listing agreement for another six months. The Iowa City Airport Commission will consider this extension at its meeting on July 14. The extension only modifies the term of the agreement; no other changes to the listing agreement are made. The Council will be informed of the Commission's discussion/action.--, ITEM 11. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE IOWA DEPARTMENT OF TRANSPORTATION FUNDING ,_?,z~c) .... AGREEMENT FOR THE INTERSECTION IMPROVEMENTS OF HIGHWAY 1 WITH KITTY LEE ROAD AND THE U.S. 218 EXIT RAMP, UST-001-5(82)--4A-52 AND UST- 001-5(83)--4A-52. Comment: The agreements are for Iowa Department of Transportation Urban-State Traffic Engineering Program (U-STEP) funds. The agreements require a 45% City and 55% State split of the construction costs of the improvements at the intersection of Highway 1 with Kitty Lee Road and the U.S. 218 southbound exit ramp onto Highway 1. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR '~ O~ ~L~ CONSTRUCTION OF THE MISSING LINK TRAIL PROJECT. Comment: Bids for this project were opened on Tuesday, July 12th and the following bid was received: Peterson Contractors, Inc. Reinbeck, IA $111,807.83 Streb Construction Co., Inc. Iowa City, IA $113,869.45 J & L Construction Washington, IA $117,620.95 Bockenstedt Excavating Iowa City, IA $122,174.00 All American Concrete West Liberty, IA $134,401.00 Engineer's Estimate $111,000.00 Public Works and Engineering recommend award of the contract to Peterson Contractors of Reinbeck, Iowa. The project will be funded by General Obligation bond proceeds. Action: ITEM 13.
