Consider a motion setting a public hearing for March 30 on a resolution adopting and incorporating the Northeast District Plan into the Iowa City Comprehensive Plan. Franklin/Set p.h. for March 30 on a resolution adopting and incorporating the Northeast District Plan into the Iowa City Comprehensive Plan. You will be sent copies of this document probably next week .... Look at it, study it ....presentations on the 29th' Kubby/I am kind of concerned about the date because it is the sales tax vote .... City wide thing .... Franklin/I think you would want to continue it anyway for something as big as this. Do you want to set it for a different date? Kubby/ Karr/You have meetings March 30 and then you have got it April 6 .... Kubby/Big community issues .... (All talking). Lehman/If we have it on the 30th, we are probably going to continue it anyway .... Noaheast Plan. Franklin/Karen, you are suggesting setting it for April 67 Kubby/That would be my personal preference. Franklin/We haven't sent notices yet? .... Is that a 4 and 20 rule? Franklin/Would you like to set if for the 6th rather than the 30th? Lehman/Does the council wish to do that? Council/(Yes). Franklind Okay. We will probably do some of the staff presentation on the 29th at the work session anyway .... Norton/I don't understand why you don't have the p.h. twice. Lehman/We will continue the heating one way or the other .... It will be more than just one night .... Vanderhoef/We can set it tomorrow night, okay. [See discussion at end of item e.] b. Consider a motion setting a public hearing for March 30 on an ordinance amending City Code subsection 14-4B pertaining to change Board of Adjustment notice requirements and incorporate Board powers and procedures into the Zoning Chapter. Franklind Setting p.h. for March 30 on an ordinance amending a section of the Code. Basically this is some housekeeping things on putting Board of Adjustment notice requirements and so forth into the Zoning Chapter. Kubby/Why was not in the recodi~cation? Franklin/I can't answer that. Karr/It was in the recodi~cation but in a separate chapter. It was in there but not in a logical place that one would find it .... Norton/I was confused about this issue of staff recommendation. Franklind That is not something that you are going to act on. That is something that the Board and the Board staff looked at after having attended a conference in which there was some advice for the staff not to give recommendations. Consider a motion setting a public hearing for March 30 on an ordinance changing the zoning designation of 2.78 acres located at the northeast corner of Duck Creek Brive and Rohret Road from Low Density Single-Famfiy Residential (RS-5) to Sensitive Areas Overlay/Low Density Residential (OSA-5) to permit a 14- unit residential development. (1~Z98-0019) Franklin/Set a p.h. for March 30 on an ordinance changing the zoning designation of 2.78 acres. This is for Greater Iowa City Housing Fellowship... Rohret Road and Duck Creek Drive. You have a letter in your packet... asking that this be acted on by the city council since it was denied at the P/Z Commission .... They would like to go forward with it. Norton/When will we get out material on it? Franklin/The 29th. Do you want it sooner? Norton/I will come and get some .... One of those I need early... consideration... Norton/Could be in the packet (can't hear). Franklin/Sure we can. We have it all right now .... Kubby/Might be neighbors... suggest that we move this to April 6... because neighbors might want to come in... Norton/The neighbors are certainly going to want to come .... Lehman/That is an hour before the polls close. O'Donnell/They can come. Thornberry/They are not going to wait until the last minute to come .... All done by the last hour anyway. Kubby/Local elections are won and lost in that last hour. Norton/...might go twice anyway. Franklin Okay, I will send you the material early on this to everybody. d. Consider a resolution approving a preliminary plat of Country Club Estates First Addition, a 10.4-acre 20-lot residential subdivision located at the west terminus of Phoenix Drive. (SUB98-0011) Franklin/To consider a resolution on the preliminary plat of Country Club Estates First Addition. We have seen this a number of times before and you should have received a hard copy of a plat that was suppose to be in your packet. Norton/This is a revised plat? Franklin/I have it here. (Refers to overhead). The point that was holding this thing up... done back in August .... Was a conflict over access to some property outside of the subdivision that had been promised earlier by the previous owner of this property. This piece right here between Lots 16 and 17 has become an outlot which can fulfill the access requirement and the obligation to the property owner just to the southeast of the subdivision. It is already to go at this point. Kubby/...concern about traffic on Phoenix Drive with more development and not having a second way out. In August ... saying we wouldn't want another part of this development to happen until we had a concept plan. Franklin/Beyond this, yes. Kubby/ Franklin/...The developer is well aware of that. We stated it in two staff reports... Question is we want to have development start now from Rohret Road and go north along Lakeshore Drive (refers to overhead) .... Norton/What about going north? .... Franklin/(Refers to overhead). You got the county property right here and this is where Lakeshore would come up, intersect with Phoenix. We may stub it out at this point in anticipation of the county property developing at some point in time .... Phoenix will indirectly go to Slothhower and up. Lakeside will be a north-south here .... Duck Creek... could go on up... And therefore... offofRohret... Going to have... front end... arterial... latter end comes... How we can avoid that. Franklin/As this progresses, I think we need to look at Slothhower as a capital project... right now it is not on our list at all .... This has been very erratic... I don't know if we have to anticipate it right now. If this goes... successful... We want them to bring in a concept plan for the whole area .... What is going to be the timing on getting over the Slothhower? Will we start this paving and then have Phoenix come in and Lakeshore come it .... Norton/ Vanderhoef/Is Slothhower on the Regional Transportation Plan as an arterial? Davidson/No. Franklin/No, 965 is .... Slothhower will be between Melrose and Rohret at some point .... It will not be the arterial that 965 will be .... It is a connector. Vanderhoef/ Franklin/We use to have primary and secondary arterials .... Davidson/I wanted to add .... Conversations we have had with Mike Spear who is the developer of this. He has discussed Slothhower Road... see it now more as a collector, he has expressed some interest in possibly relocating this part of it ....in this area... That is fine with us (refers to overhead) .... We have indicated that based on his discussions with this property owner over here that that is something that we wouldn't have a problem with if he decided to plat it that way. Norton/...What is going to happen is if Slothhowerjogs anywhere but east, you are going to have people on Phoenix and cut over to it... Davidson/...need to have an overall concept plan to look at it. Norton/ Davidson/The more Teg Drives and First Avenues we have, we get very sensitive about those things .... Like to have larger development plans to evaluate. Thornberry/Do you see either Phoenix or Lakeshore going all the way to Melrose? Norton/Not necessarily but going all the way at least to Slothhower. Would either of those need to go to Melrose if Slothhower were improved? Norton/I wouldn't think so .... In order to use Slothhower they are not going to want to make that funny angle down there .... Bend offof Phoenix and cut fight up through there .... Vanderhoef/People will use this as an artefial... Franklin/I don't have an overhead of the concept that Mike Speer has been working with but- Vanderhoef/(Refers to overhead) .... access to? ....How big an area is that and what would it develop out as? .... Franklin/It is zoned RR-1 which is one acre lot, residential .... Vanderhoef/...traffic that we are putting down on Country Club Drive into that area .... What about this developer if he chose to go in there fight now, how big a deal might that be? Franklin/I am kind of guessing at this fight now. These lots in here (refers to overhead)... probably one acre lots and then they get bigger. I would say it is about an acre .... which means you would get... maybe three houses .... Vanderhoef/That is not overloading the street .... Franklin/On the larger concept plan .... Not being adopted at this point... As Phoenix goes out, it intersects with another street on the concept so that you have to turn twice before you get to Slothhower .... To make it not as direct to Slothhower .... Kubby/Does this developer own any land that is not in this plat this is currently zoned RS-5? .... Franklin/(Can't hear). Kubby/And what legal means do we have to tell him he can't develop that without a concept plan for the whole area? Franklin/For one thing there is not sewer capacity for it at this point. Kubby/Thank you .... There is also some sewer constraints for this part in here ....Chuck, is it the line... that goes out to the County Home? .... Schmadeke/(Can't hear0. Kubby/If they want to pay for all of the infrastructure, could they do that and then get capacity by paying for the lines themselves? .... Franklin/Potentially but we are still going to have to approve that plat... We have told him we want a concept plan for the whole are before we go any further with this. He has been very cooperative .... In terms of legally what we could require? Kubby/In the past... may be a cooperative spirit now... legal question... If he came in with wanting to plat some of that already zoned RS-5 and everything was legal and he was willing to pay for the sewer, how could we say no? Franklin/There is a provision in the Code about aliquot parts .... It is something that Sarah would have to explain to you .... But it what she has used in our staff meetings as an argument of how we can require that full piece of property that is owned by a person can be pulled into a concept plan before we are compelled to approve a plat... Something in the state code .... Kubby/We do that all over town... Franklin/We have a concept plan for Village Green for the whole thing. Norton/We need leverage on that .... Kubby/That is what I am asking. What is the leverage to make happen what we say we want?... Dilkes/I will talk to Sarah about it. Franklin/Maybe she can write something up .... Consider a resolution approving a final plat of Hollywood Manor, Part 6, an 8'32- acre, 24-1ot residential subdivision located on the west side of Sycamore Street south of Burns Avenue. (SUB98-0028) Franklin/Consider a resolution approving a final plat of Hollywood Manor, Part 6 .... West side of Sycamore. Kubby/We have a letter in our pile, too. Franklin/You have a letter from Phil Leff.... What Phil is asking .... Letter dated March 1. It was hand delivered. Kubby/...they need to get an out-of-state signature to get it back. Franklin/Bill Frantz is in Florida right now ....He won't be back until April but they would like to go forward with this plat. Kubby/ Franklin/You can do it subject to the legal papers being signed .... No issues. Dilkes/There are no issues .... We have done that before .... In a case like this where we know that everything has been approved .... I don't have any problem with it. O'DonnelY I also want to bring up there was a suggestion to name this Wetherby Drive and I would like to see this happen .... I feel this is a way to emphasize the park .... Kubby/Straight across .... Thornberry/Bill Frantz requested it with me also and I told him I would support the name change. Norton/...We need to find some kind of a reasonable principle .... Captain Irish .... I am kind of leaning toward a constant name for that .... Lakeside... I don't want to invite them to think it is a through street .....You need aliquot again... What is going to happen to the west there? (All talking). Kubby/For me it is not relevant if it stops or goes all the way through. To have a street .... That is only that long that is an inconsistent name with the street .... Intersection that is at all right angles... creates confusion... O'Donnell/Drive across Burlington to Grand... Thornberry/You are against it, you are for it .... Vanderhoef/I am against changing it because of the ease of traveling around within the city. I like the name Wetherby ....It will be appropriate ....to have a Weatherby Street that leads into the park .... (All talking). Thornberry/...I don't want an address on it- These are new houses .... These are stick built nice houses and he would like the name changed to Wetherby indicating park as opposed to low income housing development. Kubby/ ....Show that Lakeside Drive has diversity in housing along .... Champion/Change the name of Lakeside to Wetherby. Lehman/I have visited with staff .... Police Dept. and Fire Dept. have... no concern one way or the other .... My concem... difficulty from law enforcement or from the Fire Dept. and there is no difficulty ....Staff has no problem with this one way or the other either. Franklin/When we looked at it... it is not a big deal and since he wanted it Wetherby and it was... future access for the park, we went with it. Norton/ Lehman/We will decide that tomorrow night. I think Wetherby is a great name and it goes right into the park... kind of cool. We vote tomorrow night .... (All talking). Kubby/ Thornberry/ Lehman/ O'Donnell/I think we have an opportunity to emphasize the park .... Wetherby... great name for a street .... Kubby/Our commission did suggest that we have it be Lakeside .... Karr/Ernie, Can I go back one step. The first item that you had indicated support to change the p.h .... to April 6, the Northeast District Plan .... Bob Miklo and staff was working with a lot of neighborhoods on this and there was a lot of advance publicity go out regarding March 23. It changed to March 30. Now it would change a third time to April 6 .... It would be a third change. Lehman/We could leave it there and continue it twice .... Carry it on to three meetings .... We will leave it on March 30, continue it to the 6th and very possibility again. Karr/I think it would be less cumbersome for some neighborhoods that are planning on it. Vanderhoef/Karin, tell me what we have to do tomorrow night. Which way is it in the plan on the name of Wetherby? Franklin/The plat shows Wetherby. P/Z's recommendation is subject to the name being changed to Lakeside. So- Vanderhoef/When this comes before us tomorrow night, we have to- Franklin/Plat says Wetherby. P/Z Commission recommendation was for approval subject to the name being changed to Lakeside. Norton/ Vanderhoef/ O'Donnell/We don't want to change it. (All talking). Lehman/Thank you, Karin. (Agenda #8- THE FILING OF THE CONSOLIDATED TRANSIT FUNDING APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FY2000 IOWA DOT STATE TRANSIT ASSISTANCE AND FEDERAL TRANSIT ADMINISTRATION FUNDING.) Kubby/I have one item... Transit...big one .... Why are we in any position to act on this if we know that in the next five to ten years ....we probably wouldn't be able to do something besides the Iowa Avenue. Davidson/We are under the impression that within the next five years with this funding we could do something. Without this funding we can't do something. Kubby/So this isn't just- Okay, so it would be through 2002. That is on the shy side of five years... Davidson/Once we received the funding, we then have four years to use it .... trying to position ourselves such that if the federal government decides they are interested in discretionary projects of this nature, we are in line and that is basically what we are doing. There has been some discussion of this at the state level in our discussion of transit funding .....some likelihood it may be available ....In line at some point in the future. Kubby/Four years after receiving the grant money .... Davidson/This comes fi-om ISTEA and is subject to our usual rules... four year term of limitations on the funds. Norton/After all, we have made some movement down there. Davidson/We have the parking impact fee funds and .... Able to get 80% of the money .... Enable council to reconsider the project and possibly moving it out. 2. Vanderhoef/On ISTEA funds, did I read it fight that we could possibly get funding for things like visitor centers and so forth? Davidson/It is possible, yes. Vanderhoef/Okay, thank you. Davidson/Any other questions? .... Lehman/Other agenda items? Norton/How are we going to present the project list there in connection with the bonding, #107 ..... I was just asking for general opinion. Seems to me it would be nice to show what it is going for .... Atkins/Do whatever you would like .... Kubby/I think we should tell people. Atkins/If you would like, we will have something prepared. Norton/To run down the items. Kubby/Sure, I think that is a real good idea. Atkins/Okay, I will take care of that. Norton/...I think it is nice for people to know what we are doing. 4. (Agenda #3c(4)- CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR MARCH 30 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE FOSTER ROAD PAVING AND WATER FACILITY SITE DEVELOPMENT - PHASE II IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.) Atkins/I want to just give you a heads up on is under the Consent Calendar .... Foster Road Paving, Water Facilities, Site Development... This is one of those projects that incorporates several components of the Capital Plan into one project .... I am going to write a memo to you. Foster Road is in there, part of the Peninsula .... bidding as one job. Lehman/ 5. Norton/I have one more. It is about Summit Street. Here we have only one bid. This is the same person that bid the Woolf Avenue Bridge .... How many bids did we have on Wolf Avenue? Atkins/We had a couple of bids .... This project... IDOT bids these on our behalf.... They are funding the 800,000 of this thing. Norton/That is the tail wagging the dog. Atkins/It is their money ....I think we had at least three bids on Woolf Avenue. Atkins/We still have some retainage. We could come pretty close to the thing .... Kubby/To know the difference between the bid and the final .... How close we were on that one. (Agenda #8 - THE FILING OF THE CONSOLIDATED TRANSIT FUNDING APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FY2000 IOWA DOT STATE TRANSIT ASSISTANCE AND FEDERAL TRANSIT ADMINISTRATION FUNDING.) VanderhoefJ I have a question... It has to do with a resolution in the packet and the description we have on the agenda. And the difference is this $323,000 for the operation of it but our Transit Plan here it is listed here only at $9.8 million .... Davidson/This is for capital projects only. There are operating funds including in the resolution as well. Vanderhoef/Okay, we don't have to vote on the operations? Davidson/You are authorizing a resolution for both the operating funds and the capital funds. Kevin's memo only included the capital funds because those are the ones that we thought you might have questions about .... Vanderhoef/I am looking at the resolution that excludes the operating funds. Davidson/I will double check that before tomorrow. Vanderhoef/It says $9,850,000 and when he totals it up here, then he has got $10 million. We are not on this- Davidson/We will double check that and make sure we have the fight number in there before tomorrow. Vanderhoef/Thank you. (Agenda #18 - CONSIDER A MOTION TO APPROVE A TENTATIVE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA CITY LIBRARY BOARD OF TRUSTEES AND THE AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, LOCAL #183, AFL-CIO, FOR A COLLECTIVE BARGAINING AGREEMENT TO BE EFFECTIVE JULY 1, 1999, THROUGH JUNE 30, 2001). Norton/Dale, on the union agreement. With respect to the .... Third item on there about time off for work related matters. It is perfectly clear what work related litigation is? Helling/It is similar to what we have in the other contracts .... It has to be something related to work .... Court .... City car .... Norton/What if they are in a city car and were speeding or in an accident and had to make a court appearance ..... ? Helling/There is a .... general exception that we have applied... If they are a party to the action, it is a private matter ....Same would hold true if they are a defendant ..... Other ways to deal with that ....Could be subject to disciplinary action or whatever .... Norton/What about time off for voting? What is they live in Hills or somewhere? Helling/There are so many other opportunities now to vote absentee... Very few instances where that is going to occur anyway .... Practice... This just kind of firms up in the language what the practice has been .... Norton/Are you required to give time off for voting? Helling/I believe under state law there is a requirement .....not carte blanche. There has to be a reason why it is needed ..... Davidson/It has been resolved about Item #8. I think .... Iowa City Transit is one of 37 transit systems in the state and the operating assistance, the assistance to operate transit systems, we will be receiving a percentage, the 3.18447. That is Iowa City's percentage of a number which will be determined in the future. Kevin has estimated that for you in the comment .... Approximately $296,000 .... The resolution refers to the percentage plus the capital funds ..... Vanderhoef/ Davidson/You are voting on $9 million plus a percentage of the future operating funds. Champion/I just want to ask something about the Airport .... Redesign of that terminal. Will that be approved by the Historic Preservation Commission. Atkins/I spoke with Ron today... My question to Ron was will the building architecturally be substantially the same? And his answer .... They intended to make the building architecturally satisfying to Historic Preservation. There are a couple of what-ifs going on .... That item should be on your meeting of the 29th work session .... There is some difference of opinion ....Community room on the second floor ....Requirement for the elevator... Historic Preservation folks don't like the idea of an elevator ....Those are issues that have yet to be resolved. Heads up .... Kubby/Suggestions from them... Atkins/ Norton/Impressive .... (All talking). Norton/It is a significant building. We ought to do everything we can to try to make it reflect that historic. Thomberry/Two things... It is not 50 years old and it does not fall under the Historic Preservation .... I did not think the Historic Preservation Society had the authority to dictate what it looked like inside ..... I don't think they have got any authority to say what you can and cannot do on the inside .... I don't care if it is on the historic register. Kubby/We have got them as a resource .... Thomberry/...To keep it super historical ....You couldn't have elevators... The laws have changed. Champion/ .... Elevator... affects the outside of the building .... Atkins/I do not know... Champion/If the elevator can be put somewhere else. Atkins/If they can maintain the glass block .... Thornberry/You can't see through the glass block now. Atkins/Downtown Streetscape will be presented by Rob Winstead .... Winstead/Did everyone get a copy of the results, okay? We opened bids this afternoon, got two bids, one if from All American Concrete .... Also one from Iowa Bridge and Culvert.
