O_~-~ ~--A..%..:~ 1. CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE FAMILY HOME LOCATED AT 2434 ASTER AVENUE TO A PUBLIC HOUSING PROGRAM TENANT AND SETTING A PUBLIC HEARING FOR AUGUST 16, 2005. Comment: The Iowa City Housing Authority, under its Tenant-to- Ownership Program, proposes to sell 2434 Aster Avenue to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $110,000. The family has participated in the public housing program for almost eight years and has successfully completed the Family Self-Sufficiency Program. The family has received a written commitment for a mortgage from a local bank in the amount of $82,500. The City will provide a second mortgage for the remaining $27,500. This sale will provide the opportunity for a Iow-income family to obtain ownership of their own home. ©% -~SA 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING ON AUGUST 16, 2005 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE JC DogPAC DOG PARK PROJECT. DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. CONSIDER A RESOLUTION RENEWING THE LISTING AGREEMENT FOR COMMERCIAL SPACE AT THE COURT STREET TRANSPORTATION CENTER WITH NAI IOWA REALTY COMMERCIAL. Comment: After considering competitive proposals, the City awarded the listing agreement for two commercial spaces in the Court Street Transportation Center to NAI Iowa Realty Commercial. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING THREE MORTGAGES FOR THE PROPERTY LOCATED AT 1007 EAST BLOOMINGTON STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 1007 East Bloomington Street received assistance through the City of Iowa City's Housing Rehabilitation Program. Comment: The owner of the property located at 507 East College Street received assistance through the City of Iowa City's Community Development Block Grant (CDBG) Funds. ANNES DRIVE, IOWA CITY, IOWA. Comment: Iowa State Bank and Trust Co., has requested that the City approve a Subordination Agreement for 834 St. Annes Drive. On December 4, 2002, the owner of the property received a loan from the City of Iowa City's Downpayment Assistance Program and on September 8, 2004, the owner received additional assistance from the City of Iowa City's Housing Rehab Program. Comment: Council is considering passage and adoption of resolution vacating the alley right-of-way in the Peninsula Neighborhood First Addition. To facilitate installation of private utilities in private easements rather than public right-of-way, and subject to public utility and access easements and a maintenance agreement, Staff recommends conveyance of the alleys to Peninsula Development L~L~C~, which previously paid for them pursuant to its development agreement with the City. This Resolution declares the City Council's intent to convey the above property to Peninsula Development LLC, and sets a public hearing on the proposed conveyance for August 16, 2005. Legal papers have been approved. Construction plans have not been approved. Staff recommended approval in a report dated July 6, 2005. (SUB05-00011) Comment: At its July 21 meeting by a vote of 6-0 (Plahutnik absent) the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated July 21. The Resubdivision of North Airport Development, is a 40.79-acre, 11-lot, commercial subdivision located north of the Iowa City Airport between Riverside Drive and Ruppert Road. Staff recommended approval in a report dated May 20, 2004. Legal papers and construction plans have been approved. Country Club Estates, Part 2, is a 43- lot 16.65-acre, residential subdivision located north of Lake Shore Drive and west of Flagstaff Drive. August 2, 2005 City of Iowa City Page 10 ITEM 6. ASSESSING A CIVIL PENALTY OF EITHER $1500.00 OR A THIRTY (30) DAY RETAIL CIGARETTE PERMIT SUSPENSION AGAINST T & M MINI MART, PURSUANT TO IOWA CODE SECTION 453A.22(2) Comment: This hearing is the time designated for the Council to consider whether a Resolution should be adopted assessing the civil penalty authorized by Iowa Code section 453A.22(2) against T & M Mini Mart, 2601 Highway 6 E. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2 by selling or providing tobacco to a minor. The civil penalty for the second time the permit holder's employee violates section 453A.2 is either $1500.00 or a thirty (30) day suspension of the retail cigarette permit, at the option of the permittee. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder T & M Mini Mart violated section 453A.2 by selling or providing tobacco to a minor and that this is the second such violation by an employee of this permit holder within a two-year period. The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," BY AMENDING SECTION 12 THEREIN TO MODIFY LANE USE CONTROL AND PAVEMENT MARKINGS ON MELROSE AVENUE, FROM UNIVERSITY HEIGHTS TO BYINGTON ROAD. (FIRST CONSIDERATION) Comment: In connection with the Grand Avenue Improvement Project Melrose Avenue is being reconstructed and widened between Melrose Court and South Grand Avenue to provide for dedicated left-turn lanes for eastbound traffic turning north onto South Grand Avenue and westbound traffic turning south onto Melrose Court, and in connection therewith Melrose Avenue is to be designated a one-way street from South Grand Avenue to Byington Road. Lane designations and appropriate pavement markings at this location are incorporated into City Ordinance. This ordinance amends the City Code to reflect the changes made in connection with the Grand Avenue Improvement Project. Staff has requested expedited action on this ordinance. CONSIDER AN ORDINANCE AMENDING TITLE 3 ENTITLED "CITY FINANCES, TAXATION & FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES, AND PENALTIES" SECTION 7, "PUBLIC TRANSPORTATION" TO INCLUDE SPECIAL FARES, SPECIAL PASSES AND CHARGES FOR BICYCLE LOCKERS. (FIRST CONSIDERATION) Comment: This Ordinance is an updated listing of all Iowa City Transit fares, passes, special fares, and new charge for the bike lockers in the Court Street Transportation Center. There have been various passes and fares instituted on trial basis that are now permanent. This Ordinance will do this for the fares as listed in the City Code. Staff memorandum included in Council packet. ITEM 10. CONSIDER AN ORDINANCE AMENDING TITLE 9 ENTITLED "MOTOR VEHICLES AND TRAFFIC", CHAPTER 7 ENTITLED "VEHICLE SIZE, WEIGHT AND LOAD", TO RESTRICT LARGE TRUCK TRAFFIC ON COURT STREET FROM THE INTERSECTION OF SUMMIT STREET TO THE INTERSECTION OF MUSCATINE AVENUE. (FIRST CONSIDERATION) Comment: This Ordinance will amend the City Code to add Court Street between Summit Street and Muscatine Avenue to the list of streets where vehicles larger than 16 ton gvw are prohibited. The existing streets where large trucks are embargoed include Kirkwood Avenue and Lower Muscatine road, and First Avenue. This action has been requested by residents of Court Street between Summit Street and Muscatine Avenue. ITEM 11. CONSIDER A RESOLUTION NAMING A NEW NEIGHBORHOOD PARK "HARLOCKE HILL PARK" Comment: This 0.91 acre mini-park was obtained through the Neighborhood Open Space process when the Weeber's Third Addition development was completed; it is located adjacent to Harlocke Street. A meeting was held with the neighborhood association to gain ideas for development and naming of the park. The Harlocke Hill suggestion was the result of a neighborhood survey, and was subsequently endorsed by the Parks and Recreation Commission at their meeting of July 13, 2005. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR TEMPORARY USE OF PUBLIC bG - -~ RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, LANDOWNERS, LAURENCE SHORT, ELIZABETH HULLETE BELLE & BELLE FAMILY TRUST, AND TENANT TROPICAL CHILL, INC. d/b/a BALDY'S WRAPS, FOR A SIDEWALK CAFI~ AT 18 S. CLINTON STREET. Comment: Tropical Chill, Inc., d/b/a as Baldy's Wraps, seek a license agreement for temporary use of public right-of-way at 18 S. Clinton Street, Iowa City, iowa for a sidewalk caf6. City Staff has reviewed the plans and specifications and required submittals and recommends approval of said agreement. ITEM 13. CONSIDER A RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY ~-.-.~b7 AND BETWEEN THE CiTY OF IOWA CITY AND ANDERSON-BOGERT ENGINEERS AND SURVEYORS, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE GILBERT/PRENTISS/BOWERY INTERSECTION IMPROVEMENT PROJECT. Comment: This contract will provide for the conceptual design, preliminary design, and final design of the Gilbert/Prentiss/Bowery Intersection Improvement Project. The cost of the services is not to exceed the $60,000 and will be funded with Road Use Tax. Action: ITEM 14. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR ~-~- ~ CONSTRUCTION OF THE HOLLYWOOD BOULEVARD SEWER REPAIR PROJECT. Comment: Bids for this project were opened on Tuesday, July 26t' and the following bid was received: Tschiggfrie Excavating Dubuque, IA $188,136.00 Dave Schmitt Construction Cedar Rapids, IA $193,464.50 Carter Kirkpatrick Services North Liberty, IA $220,040.00 Engineer's Estimate $229,975.00 Public Works and Engineering recommend award of the contract to Tschiggfrie Excavating. Section 4.04(A)(3) of the Iowa City Home Rule Charter states that the City Manager shall appoint the Police Chief with the approval of the City Council. The City Manager has appointed Samuel E.
