CONSIDER A RESOLUTION OF INTENT TO CONVEY A 5,941 SQUARE FOOT PARCEL OF PROPERTY TO ADJACENT PROPERTY OWNERS JOHN H. ROFFMAN AND JOELLEN S. ROFFMAN AND SETTING A PUBLIC HEARING ON SAID CONVEYANCE FOR SEPTEMBER 6, 2005. Comment: The City needs to acquire 119 square feet of permanent easement and 613 square feet of temporary easement from John H. Roffman and Joellen S. Roffman for the Mormon Trek Boulevard Extension - Box Culverts Project. The Roffmans have accepted the City's offer to purchase said property interests at the appraised price of $3.00 per square foot, on the condition that the City sell them a 5,941 square foot piece of adjacent City-owned property, at the price of $3.00 per square foot, for a total of $17,823.00. A map depicting the location of the parcels to be acquired by the City and the Roffmans is in your Council packet. Comment: The City of Iowa City, through the Iowa City Housing Authority (ICHA), has created the Affordable Dream Home Opportunities Program (ADHOP) using funds received from the sale of public housing units. Under an agreement with HUD, the ICHA Es required to reinvest the proceeds to expand affordable housing opportunities in Iowa City. Since 1998, 44 home ownership opportunities have been created by the ICHA. The ICHA intends to build in Longfellow Manor Subdivision one universal designed two-family dwelling for sale to families who earn up to 80% of the median income. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Approval will allow the development of a 49-1ot, 33.3-acre subdivision with 10 commercial lots and 39 residential lots located south of Rochester Avenue, east of Scott Boulevard, and north of Lower West Branch Road. o ~ -~/f~ h) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF BROOKWOOD POINTE FIRST ADDITION, IOWA CITY, IOWA (SUB05-00017) Comment: At its August 4 meeting by a vote of 5-0 (Anciaux and Plahutnik absent), the Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings prior to Council consideration of the final plat. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Approval will allow development of a 23-1ot, 29.26-acre residential subdivision located on South Sycamore Street between Hollywood Manor and South Pointe subdivisions. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 2434 ASTER AVENUE TO A PUBLIC HOUSING PROGRAM TENANT. Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program, proposes to sell 2434 Aster Avenue to a public housing program tenant. The amount of the sale will be the appraised value of the home, which is $110,000. The family has participated in the public housing program for almost eight years and has successfully completed the Family Self-Sufficiency Program. The family has received a written commitment for a mortgage from a local bank in the amount of $82,500. The City will provide a second mortgage for the remaining $27,500. This sale will provide the opportunity for a Iow-income family to obtain ownership of their own home. a) PUBLIC HEARING Action: '~40 ~:--~:~-' ZS~./~L,:'*~ O .~ J~q r~ b) CONSIDER A RESOLUTION ITEM 6. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE JC DogPAC DOG PARK PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project consists of installing fence, waste tank, and concrete paving as necessary for the off-leash dog park. The estimated base bid construction cost is $76,000.00. An add alternate to this project has been included to construct a pond. The total estimated cost including the alternate is $140,000.00. This project will be funded with Landfill reserves that will be reimbursed by DogPAC. a) PUBLIC HEARING Action: /160 ¢~"~"--'~ ~'~c~ ~~-~- c~ ~ ~- ~"1 ~ b) CONSIDER A RESOLUTION Action: August 16, 2005 City of Iowa City Page 10 ITEM 7. CONSIDER AN ORDINANCE AMENDING SECTION 1-9-3B OF THE CODE OF ORDINANCES OF IOWA CITY, AND AMENDING THE BOUNDARIES OF CERTAIN VOTING PRECINCTS IN IOWA CITY TO REFLECT VARIOUS BOUNDARY CHANGES TO THE CORPORATE LIMITS OF IOWA CITY. (FIRST CONSIDERATION) Comment: With the recent severance and annexation of various properties, changes are necessary to the precinct boundaries of Precincts 8, 9, and 13. Although there is an addition to Precinct 7 also, no language change is necessary since the new property will be incorporated in the existing description which refers to the City's corporate boundary. Since most of the land is undeveloped or has only commercial uses, residents will be unaffected by this change, with the exception of one household in Precinct 7. ^ct,on: ITEM 8. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, ENTITLED SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS" TO ESTABLISH THE SPEED LIMIT ON COURT STREET EAST OF ITS INTERSECTION WITH LINDEMANN DRIVE. (FIRST CONSIDERATION) Comment: The current speed limit on Court Street from its intersection with Lindemann Drive east to the City limits is 25 miles per hour. City Staff has conducted an engineering and traffic investigation and recommends that 35 miles per hour is a more reasonable, appropriate and safe speed limit for said portion of Court Street. A memorandum from Staff is in your packet. This ordinance amends the speed limit in each speed limit accordingly. Staff requests expedited consideration of this ordinance. CONSIDER AN ORDINANCE AMENDING TITLE 3, ENTITLED "CITY FINANCES, TAXATION AND FEES" CHAPTER 4, ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINE AND PENALTIES," SECTION 8, ENTITLED "PARKING VIOLATIONS," TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 4, ENTITLED "PARKING REGULATIONS," SECTION 10, ENTITLED "PARKING FOR LOADING AND UNDLOADING" AND SECTION 14, ENTITLED "ENFORCEMENT," AND ADDING NEW SECTION 15 ENTITLED "LIBRARY PARKING" TO INCREASE AVAILABILTY OF PARKING FOR LIBRARY PATRONS, TO ESTABLISH FINES FOR LIBRARY PARKING VIOLATIONS, AND TO PROVIDE FOR INCREASED ENFORCEMENT OF LOADING ZONE VIOLATIONS. Comment: This ordinance increases the regulations on loading zone parking and establishes regulations for library parking. Under the current ordinance, a vehicle parked in violation of a loading zone sign cannot be ticketed a second time until two hours have gone by. Staff observes frequent violation of loading zone signs. The proposed amendment will allow a second ticket thirty (30) minutes after the first loading zone violation ticket. The ordinance also designates six of the seven parking spaces (not the handicap space) on Linn Street in front the library as "library parking" to increase the availability of parking for library patrons. The 5-minute space for book drop off will be enforced at all hours, but the other five spots will be limited to library use just during library hours. A vehicle parked in violation of the "library parking" provisions can receive a ticket ten (10) minutes after the first violation. The ordinance further provides that each space have a sign containing certain information that will notify the public of the library parking requirements and that vehicles parked illegally in the book drop off space can be towed. CONSIDER AN ORDINANCE AMENDING TITLE 3 ENTITLED "CITY FINANCES, TAXATION & FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, ~I'?Z BONDS, FINES, AND PENALTIES" SECTION 7, "PUBLIC TRANSPORTATION" TO INCLUDE SPECIAL FARES, SPECIAL PASSES AND CHARGES FOR BICYCLE LOCKERS. (SECOND CONSIDERATION) Comment: This Ordinance is an updated listing of ail Iowa City Transit fares, passes, special fares, and new charge for the bike lockers in the Court Street Transportation Center. There have been various passes and fares instituted on trial basis that are now permanent. This Ordinance will do this for the fares as listed in the City Code. CONSIDER AN ORDINANCE AMENDING TITLE 9 ENTITLED "MOTOR VEHICLES AND TRAFFIC", CHAPTER 7 ENTITLED "VEHICLE SIZE, WEIGHT AND LOAD", TO (}'~-~l'~~ .RESTRICT LARGE TRUCK TRAFFIC ON COURT STREET FROM THE INTERSECTION OF SUMMIT STREET TO THE INTERSECTION OF MUSCATINE AVENUE. (SECOND CONSIDERATION) Comment: This Ordinance will amend the City Code to add Court Street between Summit Street and Muscatine Avenue to the list of streets where vehicles larger than 16 ton gvw are prohibited. The existing streets where large trucks are embargoed include Kirkwood Avenue and Lower Muscatine Road, and First Avenue. This action has been requested by residents of Court Street between Summit Street and Muscatine Avenue. Correspondence included in Council packet. ITEM 12. CONSIDER AN ORDIN~ANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," BY AMENDING --z~l ,~z~ SECTION 12 THEREIN TO MODIFY LANE USE CONTROL AND PAVEMENT MARKINGS ON MELROSE AVENUE, FROM UNIVERSITY HEIGHTS TO BYINGTON ROAD. (PASS AND ADOPT) Comment: In connection with the Grand Avenue Improvement Project Melrose Avenue is being reconstructed and widened between Melrose Court and South Grand Avenue to provide for dedicated left-turn lanes for eastbound traffic turning north onto South Grand Avenue and westbound traffic turning south onto Melrose Court, and in connection therewith Melrose Avenue is to be designated a one-way street from South Grand Avenue to Byington Road. Lane designations and appropriate pavement markings at this location are incorporated into City Ordinance. This ordinance amends the City Code to reflect the changes made in connection with the Grand Avenue Improvement Project. Comment: The Department of Housing and Urban Development (HUD) requires Housing Authorities to certify fiscal year performance data as a means of monitoring local activity. HUD will score the Iowa City Housing Authority (ICHA) based on indicators and will identify areas of concern or performance based on these indicators. August 16, 2005 City of Iowa City Page 13 ITEM 14. CONSIDER A RESOLUTION ESTABLISHING FEES FOR SERVICES AND ACTIVITIES OF THE IOWA CITY HOUSING AND INSPECTION SERVICES ~-~ ~2 DEPARTMENT. Comment: The FY 2006 budget approved by City Council included an additional full- time position for the rental housing division. City Council has directed rental housing to fund 100% of its budget through permit fees. Accordingly, housing inspection proposes to increase rental permit fees. The proposed fees would be $120 per structure, $16 per unit and $6 per bedroom. Presently the fees are $110 per structure, $15 per unit and $5 per bedroom, which for a twelve apartment, 24-bedroom building equals $205.00 per year, or $1.42 a month per apartment. Under the proposed fee structure, this building's rental permit fees would increase to $228.00 per year, or $1.58 a month per apartment, a $.16 cent increase. The fee increase would become effective on January 1, 2006. The full-time position will increase the amount of units inspected annually, allow currently unlicensed single family rentals to be added to the roles - thereby increasing revenue - and enable the department to better respond to the Neighborhood Housing Relations Task Force's initiatives. Enclosed in Council packet you will find documents detailing the rental division's present status and its response to the Greater Iowa City Apartment Association's February 15, 2005 letter to City Council. CONSIDER A RESOLUTION ESTABLISHING THE NAME OF TVVO LOCAL STREETS; ONE LOCATED BETWEEN SYCAMORE STREET AND KOUNTRY r,,~,~_~c~l LANE AND THE OTHER LOCATED BETWEEN THE AFOREMENTIONED UNNAMED STREET AND THE ENTRANCE TO THE IOWA CITY KICKERS SOCCER PARK. Comment: Two local streets in the southeast portion of Iowa City have not been officially named. One street has unofficially been signed Soccer Park Road, and the east-west roadway connecting Sycamore Street with Soccer Park Road is not signed. There are no addresses assigned to these streets. It is desired to establish the speed limit on these roads. In order to assign a posted limit, these roads must be officially named. It is possible that when the adjacent property is platted these names will be changed through the platting process. The two street names for consideration are Soccer Park Road and Lehman Avenue. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, ENTITLED SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS" TO ESTABLISH THE SPEED LIMIT ON SOCCER PARK ROAD FROM ITS INTERSECTION WITH LEHMAN AVENUE TO THE ENTRANCE OF THE SOCCER PARK. (FIRST CONSIDERATION) Comment: The current speed limit on Soccer Park Road is from its intersection with Lehman Avenue to the entrance of the soccer park is 45 miles per hour. City Staff has conducted an engineering and traffic investigation and recommends that 30 miles per hour is a more reasonable, appropriate and safe speed limit for said portion of Soccer Park Road· This ordinance amends the speed limit in each speed limit accordingly. CONSIDER A RESOLUTION CONCERNING MEDIACOM COMMUNICATIONS CORPORATION'S 2005 UPDATING OF RATES FOR BASIC CABLE SERVICES. Comment: The City annually reviews basic cable rate information filed with the Federal Communications Commission (FCC) by Mediacom as pad of our limited rate regulation authority. We then either approve or challenge the maximum permitted rate calculated by Mediacom. In the most recent filings for the year beginning August 1, 2005, the proposed basic se~ice rate and the maximum permitted rate have been found to be compliant with FCC formulas and with prior agreements be~een Mediacom and the City. It is recommended that this resolution be adopted.
