HACAP does not disagree with the policy of returning money to the housing funding stream for redistribution as long as the policies are equally enforced on all participants. I am sure that every non profit can bring a forceful and a lucid argument that could be as convincing as the next non profit. It would be much more coherent to have the waiver requests be part of the application process. Then the HCDC could properly assess the merits of the projects. It seems rather absurd that you go through the grant process and then after the money is allocated you come forward and say you cannot do the project within the scope of the grant you submitted without further assistance. I would like to see the proposal tabled and have the Council Committee solicit some public input before the next Council meeting. Your property at 88 Heron Circle is a double frontage lot, as are many at the end of a cul-de-sac that back up to another street. Most corner lots are double frontage lots also (front and side) and in some cases triple frontage (front, side and back). In 88 Heron Circles case, it is the front on Heron Circle and the back on Scott Blvd.. The following is from City of Iowa City ordinance Chapter 1, Article A, Section 14-1A-6: "The abutting property owner shall maintain all public right of way located between the edge of the street or curb line and the property line, and shall keep such area in a safe condition free from defects, debris, nuisances, obstructions or any other hazard. The abutting property owner may be liable for damages caused by failure 'to maintain the public right of way located between the edge of the street or curb line and the property line. The abutting property owner shall maintain the sidewalk in a safe condition, in a state of good repair, and free from defects. The abutting property owner may be liable for damages caused by failure to maintain the sidewalk. However, the property owner shall in no event remove diseased trees or dead wood or plant, trim, remove or treat any tree or plant material on public right of way without first obtaining a permit from the City Forester." Therefore the maintenance of sidewalks abutting the front and back of 88 Heron Circle is the responsibility of the property owner. I live at 88 Heron Circle, Iowa City, 52245 on the east side of town and I am responsible for sidewalk maintenance in the front of our home on Heron Circle. In addition, our property borders Scott Btvd in the back. The sidewalk there is actually more a bike/running trail that is 8 feet wide. I was concerned that I am somehow responsible for this second walking/biking trail in addition to the sidewalk in front of my house. In posing this question to Ms. Champion she left a phone message that I was not responsible for this trail. I am checking to make sure that that is correct. CSpan2, which broadcast the proceedings of the US Senate, was deleted and a channel out ef Dubuque, which broadcast the Christian Broadcasting Network, was added in its place. I see ne problem with CBN being a part of basic service if there is a demonstrable local demand for it. However at a time when the Senate will soon begin hearings ena new Supreme Court Justice it seems obvious that Mediacem has a responsibility to the council and the citizens as the sole local cable provider to cover the actions ef our elected representatives at all levels. I have called Hediacem customer service (800-332-0245 then 0) about this issue twice. The first representative said the basic lineup was determined by customer demand. The second representative said he did not know how the lineup was determined. As you have recently signed a 13-year contract with Hediacom could you please provide the public with the basic elements of the provider's responsibilities. How is the basic lineup determined? Does the customer have input and if it does how does the individual make it known? Does the council have input in the basic lineup? How does the council hold Hediacom accountable for changes that de not serve the public interest? Local radio and TV stations are owned and programmed by large corporations. A national chain owns the local newspaper and the editors are chosen from within the corporation and none ef them are from this town. This is an educated town that, as you well knew, is ready, willing and able te manage its own entry into the Information Age. When the public goes to the polls this November they should know that they are net just voting about the option for a Public Power Utility, that option with emerging technologies implies the potential for a Public Information Utility as well. The City cannot require Mediacom to carry any particular channel or network on any tier of service. Federal law dictates this matter. Federal law does require Mediacom to carry all local broadcast stations, IPTV and local access channels on the basic tier. Beyond these requirements, Mediacom is able to choose whether and where any particular programming is placed. By local broadcast stations ! include Iow power broadcast stations. Tn the Cedar Rapids area two such Iow power stations have been started in the last year. According to Federal law, Mediacom has to carry these stations on the basic tier if they have a Grade B contour signal entering Johnson County. According to Mediacom these are "must- carry" stations. It is Mediacom that then decides which channels would be eliminated or moved to a different tier as a result of the addition of these, or any other channels. Technically the basic tier of the local cable system is only capable of carrying 21 channels. To increase this capacity the cable system would require massive changes requiring a technical overhaul of the system. The City cannot require such an overhaul. The City has two opportunities for input regarding programming, beyond requiring local access channels. During the refranchising or extension process the City may require certain broad categories of programming - such as news programming, children's programming, history programming and so forth. The City did include such categories of programming in the new franchise agreement. However, the City cannot require a particular channel nor that any such programming or channel be placed on a particular tier of service. This again is due to Federal law. 8/15/2005 TO: Mr. Latta The City may also require that Mediacom conduct a survey of the community to determine their programming interests prior to a system upgrade or rebuild. To the best of my knowledge Mediacom plans no such upgrade or rebuild in the near future. Tf you have an interest in CSPANTT being carried on the basic tier, T would suggest you write a letter directly to Mediacom. Tt may also be useful to cc any such letter to your Congressional representatives, as it is Federal law that dictates these matters. I would appreciate a copy of any such letter as well. This email is abeut Hediacom, Iewa City's cable provider. Yesterday (duly 27, 2005), mediacom cancelled C-SPAN2 frem their basic cable service without notice. I rely on C- SPAN2 to keep myself informed ef what is happening in the Senate and by extensien this ceuntry. I censider C-SPAN2 te be a necessity to perferm my duties as a citizen of beth this country and this state. Besides the impertant judge confirmatien/filibuster press conferences and debates, I saw some ef the John Bolton hearings, some of the debates on the bill te repeal the estate tax, and perhaps most impertantly, I saw our ewn Senater Charles Grassly chair hearings en secial security reform. I was struck by Sen. Grassly's emotional speech en the need to make secial security viable, so that it will still be there for his grand-daughter, net just "Grandpa Grassly." My vote the next time Sen. Grassly's seat is up will be mere informed because of the availability ef C-SPAN2. Hy votes te make my epinion heard on the issues I have beceme more informed about watching C-SPAN2 will be better exercised. I de net want te miss the Senate Judiciary Committee's hearings on John Roberts, or any other impertant business the Senate will be doing in the future. Although I have subscribed to different mediacom cable packages over the last six years, I chose to stay with basic cable this time around in part because I knew I would get the channels I felt were necessary (local broadcast channels, the two C-SPANs, the local PEG channels). I am a law student, and during the school year I live off of my student loans, so I cannot afford to subscribe to one of mediacom's more expensive packages. In order to keep C-SPAN2, I must now either pay over $30 more per month to subscribe to mediacom's family cable service, or I must get a satellite dish. I live in an apartment in which I cannot have a satellite dish installed, so really, I can either reward mediacom for their "bait and switch" by purchasing the more expensive package or by staying with my current package, which is worth much less but costs the same, or I can go without television all together. I think that besides the poor customer service I have experienced twice (I won't get into that here), and the abuse of monopoly power over mediacom's subscribers (they force subscribers to agree to the provision that mediacom reserves the right to change their channel lineup at any time without notice, but because they are the only game in town, we have to play with them), the most troubling aspect of mediacom's decision is lack of public service. Nothing is more important to a functioning democracy than an informed citizenry that can exercise their vote by being knowledgeable of the issues and candidates. Mediacom has injured the ability of Iowa City's basic cable subscribers to be informed and to exercise an informed vote. And for what cost? For the cost of adding one channel to their lowest tier service, or replacing one of their lowest tier channels with a channel which is important for citizens to watch, or at least have available. Considering that mediacom is given exclusive rights to provide cable to this city, I think it demonstrates a lack of the most basic public service dedication to take away an important channel from some of their subscribers. With the great power of providing information to the public, some duty arises to provide information which is helpful to people in governing themselves. Mediacom has decided to ignore this duty and I urge the City Council to consider mediacom's actions when their contract comes up for renewal. I also urge the City Council to use whatever power you have to influence mediacom to re-add C-SPAN2 to their basic cable lineup. Thank you. In regards to your point about Mediacom having exclusive rights in Iowa City, Mediacom has a nonexclusive contract with the City. Any other company is free to approach the City about a cable TV franchise, but none have. My office regularly sends out information and demographic packets to all cable TV over builders we can identify in the U.S. Unfortunately none have shown interest. You mention that you have experienced poor customer service from Mediacom in the past. Please keep in mind that my office is here in part to receive complaints from subscribers that are having difficulty in resolving a problem with Mediacom. While we cannot always help, many times we are able to reach a resolution. Each complaint I receive is documented and reported to the Iowa City Telecommunications Commission, whose minutes are forwarded to City Council. I know, my son is to be a sophomore at the U of I this fall and says it is so easy to drink in a bar in Iowa City. We, as parents, entrust you, the city leaders, with our young children at a time when they are learning to become an independent member of society and you won't take action to protect them. I feel that if a few bars close, so be it. The fewer the better. I would rather Iowa City be know for it's coffee shops, unique restaurants, entertainment, and shopping. Not the city With the most bars and underage drinking And the old argument is then there will be more house parties. Well, then the police can concentrate on that. Hopefully neighbors will help with those situations. It would be in your best interests. Pass the 21 only in bars. Ames did it. David Adams Cedar Rapids http ://www. standard, net/standard/58541 / Businesses sprout around Wal-Mart Sunday, August 7, 2005 By Jeff DeMoss Standard-Examiner staff Since Harrisville store's 2001 opening, 15 tenants have arrived HARRISVILLE -- A popular, casual restaurant chain and a pet-supply store will be the newest tenants this fall to join a crowd of retail businesses converging around the perpetually busy Wal-Mart Supercenter. Chili's plans to open one of its signature casual-dining restaurants on the Harrisville property in November, and Petco is expected to open in a new building on the northeast corner of the development in October. Chili's and Petco will join a growing list of well-known businesses on a 40-acre parcel wedged between Washington Boulevard and Harrisville Road, a prime retail location since Wal-Mart opened its 200,000-square- foot store there in 2001. Since the Wal-Mart opening, the plaza has gained 15 new tenants, including several this year. Project developer The Boyer Co. says more are on the way. "We knew that with the Wal-Mart there, we would see some adjacent growth," said Brad Galvez, project manager for Boyer. "It's been steady since then." Chili's spokesman Chris Barnes said the 5,700-square-foot restaurant will have 221 seas and feature a menu similar to the chain's other Top of Utah locations. He said it will employ about 150, and recruitment for j ob openings should begin in early October. Locating new restaurants near big-box stores is a formula that has proven successful for Chili's, Barnes said. 8/8/2005 Page 2 of 2 "They pull people from a wide area, and they ensure a great deal of traffic in and out of local communities," he said. "It makes sense for us to be in places like that from the standpoint of having gravity in a trade area." Two of the Ogden area's busiest streets border the plaza on the east and west, making the stores accessible from either side. About 53,000 cars pass the plaza daily, a traffic count comparable to that of Riverdale Road, Galvez said. He expects the new Chili's will result in even more traffic around the plaza. A traffic signal has already been approved for the intersection of Harrisville Road and North Street. "There is some pent-up demand for more restaurants north of Ogden, and even within Ogden city," Galvez said. Wal-Mart purchased about 20 acres of the development from the Boyer Co. in 2000. The remaining 20 acres are owned and leased to the various tenants by Boyer. The plaza has seen plenty of activity this year. Entertainment retailer Hastings in June moved its store from the nearby Five Points Plaza to a new 40,000-square-foot building it will share with Petco and two smaller tenants, and fast-food chain Weinerschnitzel opened a new free-standing restaurant in the spring. Harrisville has benefited from the development. The city's retail sales have skyrocketed from $13.2 million in 2000 to $119.3 million in 2004, according to the Utah State Tax Commission. Galvez said two areas of the plaza remain for future development -- an approximate five-acre parcel in the northwest corner, and a 1.5-acre parcel next to Chili's on the east side. A few of my fellew students and I ended up here in Los Angeles several years age but we always make a peint to spend seme time in Iewa City when we're back visiting in Iowa with our spouses/partners. We were all very disheartened te hear that the City Council has appreved of Wal'Mart building en the south side. Yeu may have heard about the veters in a local Seuthern Califernia city veting against letting Wal'Mart come into their area. I know other towns acress the country are stepping up and doing the same, but unfortunately, many ethers, like Iowa City, seem to think the meney that will come in will revitalize their cities. You are in an unenviable position. We have seen how Iowa City's uniqueness has been increasingly lest ever the past several years. Allowing a Wal'Mart inte the area will enly increase the blight in the city, I can assure you as I have seen many tewns acress the country affected by this retailer's tactics. Dear Council Members: My 16 year old son greatly appreciates the Iowa City Skateboard Park. He tells me that it has been recently vandalized and he (and his friends) are very disappointed that someone would intentionally deface this park, which he considers a personal gift from the city (!). I suggested, and they are very interested, that he organize a group of park users and friends and offer to clean up the vandalism. In addition, they could offer to clean up other park areas as well. Not only would this type of project directly help the city, but it would help these kids build a more respectable community opinion of their sport. My crews and I are responsible for the parks and in recent weeks have noticed quite an upswing of spray paint vandalism and general dumping of litter at the skate park. It is very discouraging for us especially when the garbage cans are regularly dumped from the racks and crushed as they are used for jumping obstacles. Regular pickup of the refuse would be a great help to us and might be one project for us to discuss. ,Just getting the word out that this type of problem is not helpful to the image of the park is of great assistance. Removing the spray paint is a distinctly more difficult task. It takes quite a bit of equipment and or chemicals to get the paint off of the concrete. From a liability perspective it would be quite difficult to have young adults participate in that type of work. I will be glad to discuss other projects with you and your son at any time.
