One was a bidder's conference, meeting with prospective bidders, they felt a little additional time might be helpful. There's some administrative issues initially which put this on the agenda closing the deal with Lori Alberhasky I think we wanted to buy some time on that. ALBERHASKY FOR CONDOMINIUM UNIT 1A IN THE TO-BE- CONSTRUCTED IOWA AVENUE MULTI-USE PARKING FACILITY AND TO DISPOSE OF UNIT 1A IN ACCORDANCE THEREWITH. Merle Trummel/ Okay I prepared for this from the earlier schedule so I came today. I guess I can be on TV if I want TV I'll come next time. Has to do with the situation at The Cottage and as I see it and I have no inside information I'm just going from the top of the head on this. I think that you all agree that, or many would agree at least, that The Cottage was a is a nice facility in that location and it just didn't happen. Someone come in and did it. And took the risk, whatever risk was involved, but did it. And those of you that are in business, and some of you are, know that risk is supposed to if it's met and things work out than presumably therc's a return on it. And that is one thing that exists there now as a value which ah, I don't know whether it's being considered in terms of the purchase or whatever it will be. The University is making a big point of entrepreneurship these days and I guess it's seeping into engineering now which is a little well it shouldn't be too surprising I guess but it's there. Ah and again there's suppose to be a reward for that. Ah as I see the proposal as I read it is that there will be some sort of agreement that ah Alberhasky would repurchase a unit in there which essentially is going back and buying her own business place again but she has lost 1 and This represents only a reasonably accurate transcription of the Iowa City council meeting of June 2, 1999. FO060299 #5 Page 4 Lehman/ Trummel/ Lehman/ Dilkes/ Lehman/ Dilkes/ a half or two years whatever the time is that it will take to make that transition which is worth a reward of some sort and also she's running an additional risk now of moving to a new location which ah I don't know what it is the paper had a story about the location over I think Dubuque Street. And then whenever the ramp is completed there be another move and another adjustment and another risk because the clientele which goes to The Cottage now will not be there maybe she'll be able to pull some more back from Dubuque Street. As I look at the purchase agreement it's sort of like you ah we all take this land, take is right tense, whether we're taking or negotiating and after two years, we use it it for bigger and better things and after two years or one and a half or two years which I estimate she'll be out of that location that ah that will have to be recouped. Now I know our Mayor spent I think a little time in the middle of Clinton Street is that correct? No, actually I didn't but the street was closed when I moved in to my present location. Okay, I remember getting my haircut in the middle of Clinton Street so I under-during that time. Ah and I'm sure it's a little bit of a test of the person. Anyway the City says then that you'll, and again I have no idea of what the values are here I have no way of knowing, that somehow you'll agree to buy this back and if it's a success that's great but if it's not a success I assume that'll be your problem. Ah she'll own a condo which may or may not have some value, well it will have value we don't know how much, which you can judge that better by the demand you're getting for other spaces. But ah anyway what I'm getting down to is that I think that the conversation may be underestimated and I think, I feel, that the agreement to rebuy if signed voluntarily that's done that's her business, or somebody's business, but ah I don't feel that ah let's see what I want to say that's that quite the right way to go. In any event that is another risk that might be in the future so ah I guess that I'm arguing and I have no idea of values but it's not a simple give and trade. Lot of other factors in there and I suspect you've already heard about them. Thank you. Thank you. And let me just say that this is of course a negotiated agreement which Ms. Alberhasky has entering into only because she believes it to be appropriate for her. We have changed the maps themselves but not the ordinance that corresponds to them. At what point do we get a 26th precinct? We will wait until after the 2000 Census. So we're not acquiring them for our housing program we're acquiring them for a municipal facility at some point in Sometime in the future. We use the parking impact fee. Okay. I'm delighted. FO060299 #8 Page 8 Item No. 8 CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR THE CONSTRUCTION OF THE IOWA RIVER DAM RENOVATION. Lehman/ We have the bids and the low bid on this one was almost $1.9 million and the Engineer' s estimate was $1.5 million and the staff does not recommend the awarding of this contract. So I would entertain a motion to approve the contract and voting it down would then deny it. Kubby/ So moved. Lehman/ Moved by Kubby. O'Donnell/ Second. Lehman/ Seconded by O'Donnell. Discussion? They're voting against them primarily I think because there are some complexities here but the bid is substantially higher than the estimate. Roll call. (all nays) Motion is defeated.
