Comment: This project includes the installation of a fire sprinkler system

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST THE RELEASE OF A SECURITY INTEREST AND A
NO-INTEREST PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 2254
RIVERSIDE DRIVE #25, IOWA CITY, IOWA, AND AUTHORIZING THE
MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT
BETWEEN THATCHER MOBILE HOME PARK OF IOWA CITY, IOWA AND THE
CITY OF IOWA CITY WHEREBY THE CITY OF IOWA CITY RELEASES ITS

Comment: The owner of the property received assistance from the City's
Housing Rehabilitation Program for the amount of ~ 1,469 on
August 1, 1997. The owner has passed away, and the City feels it is in its
best interest to forgive the balance of the loan and have the manufactured
home sold to a low-income household.
CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE
CITY OF IOWA CITY AND THE IOWA DEPARTMENT OF ECONOMIC
DEVELOPMENT FOR IOWA HOMELESS SHELTER OPERATIONS GRANT
PROGRAM FUNDING, AND AUTHORIZING THE CITY MANAGER TO
EXECUTE AND THE CITY CLERK TO ATTEST TO SAME.
Comment: The Iowa Department of Economic Development has agreed to
provide the City of Iowa City a maximum of ~140,220 in State funding for
the support of services for the homeless. These funds will be used in FY00
by the following local agencies: Domestic Violence Intervention Program
(~30,100), Four Oaks a.k.a. Youth Homes ($24,000), Emergency Housing
Project (~42,900), Table to Table (~22,000), Greater Iowa City Housing
Fellowship (~5,000), and Successful Living Inc. ($11,200). The award also
includes ~5,020 to reimburse the City for its expenses in administering this
grant. This Homeless Shelter Operations Grant Program funding represents a
14% decrease from the FY99 allocation.

CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF
AN APPLICATION FOR HAZARD MITIGATION GRANT PROGRAM THROUGH
IOWA EMERGENCY MANAGEMENT DIVISION TO THE FEDERAL
EMERGENCY MANAGEMENT AGENCY BY THE CITY OF IOWA CITY.
Comment: The City is seeking a Hazard Mitigation Grant to fund the last
phase of the Riverside Drive/Arts Campus Stormwater Project. This
resolution designates the City Engineer as the City's authorized
representative for the grant application and indicates that the City will make
the 25% local share available if the grant is awarded. The 25% local share
will be shared with The University of Iowa. Total estimated cost is
$808,000."

CONSIDER A RESOLUTION FIXING THE TIME AND PLACE FOR
RECEIPT OF BIDS AND DIRECTING THE CITY CLERK TO PUBLISH
ADVERTISEMENTS FOR BIDS FOR CONSTRUCTION OF THE IOWA CITY
TRANSIT FACILITY METHANE ABATEMENT PROJECT, PHASE I.
Comment: On March 2, 1999, the City Council approved the plans,
specifications, form of contract, and estimate of cost for construction of the
Iowa City Transit Facility Methane Abatement Project. This resolution
modifies the bid date for the project from March 30, 1999, to June 24,
1999. Various dates in the Advertisement for Bids have been modified to
reflect the new bid date. The estimated construction cost of Phase I is
$225,000. This project will be funded 80% by the Federal Transit
Administration and 20% with transit operating funds.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST THE FY2000 AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND THE CITY OF UNIVERSITY
HEIGHTS FOR THE PROVISION -OF TRANSIT SERVICE WITHIN
THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS.
Comment: This resolution approves the FY2000 agreement for provision of a
fixed route transit service within the corporate limits of the City of University
Heights. The total cost of the FY2000 contract is $28,050. This is a 2%
increase from the FY99 amount.

PUBLIC HEARING ON PROPOSED ROUTE CHANGES FOR IOWA CITY TRANSIT.
Comment: Comments on proposed route changes were received at a public meeting
in the Public Library on May 8, 1999, and at the May 18 City Council meeting.
However, Resolution 94-47 sets forth provisions for a public hearing authorized by
City Council. Correspondence included in Council packet. ~ ~

ITEM NO. 5. PLANNING AND ZONING MATTERS.
Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, Article E,
Commercial and Business Zones, Section 2, Neighborhood Commercial Zone, and
Article L, Provisional Uses, Special Exceptions, and Temporary Uses, to allow
pharmacies to have a drive-through facility in the Neighborhood Commercial (CN-1)
zone, and to adopt location, design, and size criteria for drive-through facilities
associated with pharmacies and financial institutions in the CN-1 zone.
Comment: At its May 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed amendments. Staff
recommended approval in a report dated April 30.

b. Public hearing on an ordinance conditionally changing the zoning designation of
approximately 7.46 acres from Medium Density Single-Family Residential (RS-8) to
Planned Development Housing Overlay (OPDH-8) and the approval of a preliminary
terminus of Court Street. (REZ99-0006)
Comment: At its May 6 meeting, by a vote of 5-2 with Bovbjerg and Ehrhardt
voting no, the Planning and Zoning Commission recommended approval of the
rezoning, subject to a condition that would limit full development of the property
until Arlington Drive is connected to Court Street. Staff recommended approval in
its report dated April 15. Correspondence included in Council packet:~
c. Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, Article O,
Sign Regulations, by changing the requirements regarding the number of
freestanding signs on lots with over 300 feet of frontage.

Commission recommended approval of the Northeast District Plan, as amended.

Consider an ordinance amending City Code Section 14-6, "Zoning Chapter,"
concerning definitions and parking requirements for carryout, delivery, and drive-
through restaurants. (Second consideration)
Comment: At its April 1 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed amendments. Staff
recommended approval in a memorandum dated March 22.
Action:
g. Consider an ordinance amending City Code subsections 14-5H, Site Plan Review,
and 14-6S, Performance Standards, regarding lighting standards. (Pass and adopt)
Comment: At its March 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the code amendments for lighting standards
as recommended by staff in a report dated November 25, 1998.

h. Consider a resolution approving a final plat of Country Club Estates First Addition,
a 10.4 acre, 20-lot residential subdivision located at the west terminus of Phoenix
Drive. (SUB98-0027)
Comment: At its March 4 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the final plat, subject to approval of legal
papers, prior to Council consideration. Construction drawings have been approved.
In a report dated March 4, staff recommended approval.
i. Consider a resolution approving a preliminary plat of ABCO 1st Addition, an 8'81-
acre, 5-lot, commercial subdivision located at the intersection of Naples Avenue
and Sierra Court. (SUB99-0011)
Comment: At its June 3 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the preliminary plat, subject to staff
approval of a revised plat prior to Council consideration, and subject to the legal
papers for this subdivision requiring construction fencing on Lot 5 around areas of
critical slopes prior to site development, Staff recommended approval in a report
dated June 3.

A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND LORA M.
ALBERHASKY FOR CONDOMINIUM UNIT 1A IN THE TO-BE-CONSTRUCTED IOWA
AVENUE MULTI-USE PARKING FACILITY AND AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST ANY DOCUMENT OF CONVEYANCE REQUIRED
BY SAID AGREEMENT.
Comment: The Iowa Avenue Multi-Use Parking Facility Project requires the acquisition
of Lora M. Alberhasky's property located at 14 S. Linn Street. The City and
Ms, Alberhasky have been negotiating an agreement whereby the City will purchase
said property and Ms. Alberhasky will in turn purchase a commercial condominium unit
in the new Iowa Avenue Multi-Use Parking Facility.

Consider a Resolution Approving
CONVEYANCE OF 2774 IRVING AVENUE.
Comment: The Iowa City Housing Authority is in the process of selling a free-standing
townhouse located at 2774 Irving Avenue as part of the Affordable Dream Home
Program ('ADHOP"). The closing on this townhouse is scheduled to occur on
June 15, 1999. Families who earn up to 80% of the median income may qualify for a
home under the ADHOP program. The Housing Authority has received an offer to
purchase 2774 Irving Avenue from a family which meets this income qualification.
The sale is conditioned on the family receiving a real estate loan from a local financial
institution, with the City carrying a second mortgage. This sale will provide the
opportunity for a low income family to obtain ownership of their own home.

PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE WILLOW CREEK TRAIL PHASE II IMPROVEMENT PROJECT.
Comment: This project entails the construction of a bicycle/pedestrian trail from the
intersection of Mormon Trek Boulevard/Westwinds Drive, through Willow Creek Park,
past Kiwanis Park and continuing on to Willow Creek Drive. It also includes the
reconstruction and some rerouting of the existing trail within Willow Creek Park,
between Teg Drive and Burry Drive.

CONSIDER A ORDINANCE AMENDING TITLE 14 ENTITLED "UNIFORM
DEVELOPMENT CODE," CHAPTER I ENTITLED "STREETS, SIDEWALKS, AND PUBLIC
RIGHT-OF-WAY GENERALLY," ARTICLE E ENTITLED "SIGNS IN PUBLIC PLACES,"
SECTION 4 ENTITLED "EXCEPTIONS" OF THE CITY CODE TO AMEND SIGNS IN
PUBLIC PLACES. (FIRST CONSIDERATION)
Comment: This ordinance amendment will allow for the installation and maintenance
of certain signs in the public right-of-way. The City Council has permitted The
University of Iowa and Mercy Hospital to install individual signs in the right-of-way.
The ordinance amendment will allow this practice to continue beyond the year 2003.
CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 8, CHAPTER 8, ENTITLED
"POLICE CITIZENS' REVIEW BOARD," SECTION 7, ENTITLED "DUTIES OF THE
BOARD; COMPLAINT REVIEW AND GENERAL DUTIES," REGARDING THE
IDENTIFICATION OF COMPLAINANT(S) AND/OR POLICE OFFICER(S) IN THE
BOARD'S PUBLIC REPORT OF A SUSTAINED COMPLAINT TO THE CITY COUNCIL.
(FIRST CONSIDERATION)
Comment: This ordinance amends Section 8-8-7B3 of the City Code to provide a
balancing test the Police Citizen's Review Board must use to determine whether it will
identify complainant(s) and/or police officer(s) in its public report of a sustained
complaint to the City Council. Staff memorandum included in Council packet.

CONSIDER AN ORDINANCE AMENDING TITLE 1, CHAPTER 9, SECTION 3,
"ELECTION PRECINCTS" OF THE CITY CODE OF IOWA CITY, IOWA, TO AMEND THE
BOUNDARIES OF THE VOTING PRECINCTS IN IOWA CITY, IOWA TO INCLUDE
PROPERTIES ANNEXED AND TO EXCLUDE PROPERTIES SEVERED SINCE 1995.
(SECOND CONSIDERATION)
ITEM NO. 13.
Comment: The City of Iowa City has annexed eleven areas and severed one area
since the voting precinct boundaries were amended in 1995. The proposed
amendment would add the annexed areas to adjacent precincts and subtract the
severed area from an existing precinct. Staff requests expedited consideration of this
item.

Comment: The proposed ordinance for wastewater service charges and fees
increases rates by 10%. The effective date is for billings on or after August 1, 1999.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST THE FIRST AMENDMENT TO THE 28E AGREEMENT BETWEEN
THE CITY OF CORALVILLE, THE CITY OF IOWA CITY AND JOHNSON COUNTY
PROVIDING FOR THE PRESERVATION OF THE OAKDALE BOULEVARD CORRIDOR.
Comment: There is an existing agreement between Coralville, Iowa City, and Johnson
County preserving the proposed Oakdale Boulevard corridor to between First Avenue,
Coralville and County Road W66 (Dubuque Street). This first amendment will extend
protection of the proposed Oakdale Boulevard corridor between County Road W66 and
Prairie du Chien Road. The Oakdale Boulevard corridor between County Road W66 and
Prairie du Chien Road was added to the JCCOG Arterial Street Plan by unanimous vote
at the May 26 meeting of the JCCOG Urbanized Area Policy Board.
CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO
SIGN AND CITY CLERK TO ATTEST CONTRACT FOR THE CONSTRUCTION OF THE
WESTMINSTER SANITARY SEWER IMPROVEMENT PROJECT.

CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHN F. AND VIRGINIA LEE
STAMLER FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY FOR A PORTION OF
MCLEAN STREET IN IOWA CITY, IOWA.
Comment: This agreement allows the property owner at 358 Lexington Avenue to
construct a driveway to their property utilizing the McLean Street right-of-way. This
portion of McLean Street is currently unimproved and not being utilized as a public
street and does not provide access to any other property. The agreement also
provides that if the City decides to utilize the right-of-way for any reason, the
driveway must be removed at owner's cost. Public Works and Engineering
recommend the approval of the Temporary Use of Right-of-Way Agreement.

212 S. Clinton Street. This agreement is requested in order to facilitate the safe
reconstruction of a building on the property which was destroyed by fire. The
effective date of the agreement is June 16, 1999, and shall end upon substantial
completion of the construction, but no later than December 31, 2000.

CONSIDER A RESOLUTION TEMPORARILY CLOSING A PORTION OF DUBUQUE
STREET RIGHT-OF-WAY AND AUTHORIZING THE EXECUTION OF AN AGREEMENT
FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA
CITY AND THE UNIVERSITY OF IOWA.
Comment: The University of Iowa desires to undertake maintenance and renovation
work at Mayflower Dormitory located on the east side of Dubuque Street. The
temporary use of City right-of-way along Dubuque Street is necessary during
construction to secure the construction site against pedestrian and vehicular traffic,
and to provide adequate space for construction. Closure includes the loading and
unloading lane adjacent to the Mayflower Residence Hall. The effective date of the
agreement is June 16, 1999, and shall end upon substantial completion of the
construction, but no later than August 31, 1999.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST A RESOURCE ENHANCEMENT AND PROTECTION FUND GRANT
AGREEMENT WITH THE DEPARTMENT OF NATURAL RESOUCES IN CONNECTION
WITH THE SOUTH SYCAMORE REGIONAL STORMWATER AND GREENSPACE
PROJECT.
Comment: The Department of Natural Resources has authorized a grant in the amount
of ~200,000.00 to assist the City in the acquisition and development of wetlands in
connection with the South Sycamore Regional Stormwater and Greenspace Project. A
copy of the grant agreement is on file in the City Clerk's office.
CONSIDER A RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF
IOWA CITY AND THE IOWA CITY LIBRARY BOARD OF TRUSTEES AND THE
AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES,
LOCAL #183, AFL-CIO, TO BE EFFECTIVE JULY 1, 1999, THROUGH JUNE 30, 2001.
Comment: This is a two-year collective bargaining agreement which provides for a
three percent across-the-board wage increase in each fiscal year and an increase in
shift differential pay of 5¢ per hour in each fiscal year for employees working evening
and overnight shifts. It includes numerous other language modifications involving
operational and contract administration issues. These latter provisions have minimal
economic impact. Staff recommends ratification of this agreement.

CLERK TO ATTEST A CHAPTER 28E AGREEMENT FOR EMERGENCY RADIO
COMMUNICATIONS BETWEEN THE CITY OF IOWA CITY, IOWA AND JOHNSON
COUNTY, IOWA.
Comment: The City currently owns and maintains a radio trunking system with
sufficient capacity to allow use by the Johnson County Ambulance Service of
Johnson County. As efficient emergency radio communications improve service and
are in the best interests of the citizens of Iowa City, Johnson County and the City
have negotiated an agreement for the sharing of costs associated with maintaining the
system. This Resolution authorizes the execution of the Chapter 28E Agreement for
emergency radio communications between the City and Johnson County, Iowa,

CONSIDER MOTION GRANTING A 60 DAY EXTENSION TO THE POLICE CITIZENS
REVIEW BOARD FOR THE FILING OF A REPORT WITH THE CITY COUNCIL ON
COMPLAINT #99-02.
Comment: Section 8-8 of the City Code establishes the Police Citizens Review Board
and sets forth reporting mechanisms for complaints. The Chapter also provides for
the City Council to grant extensions of the 45-day reporting requirement for good
cause. At their meeting of June 8, 1999, the Board unanimously requested a 60-day
extension for the reasons stated in the letter included in Council packet.
