COMMERCIAL URBAN REVITALIZATION PLAN FOR AN EXISTING URBAN
REVITALIZATION AREA IN THE CITY OF IOWA CITY, IOWA.
Comment: The proposed amendments to the Near Southside Commercial
Urban Revitalization Plan would make the property tax exemption eligibility
requirements in the Near Southside Urban Revitalization Area consistent with
those of the proposed Central Business District Urban Revitalization Plan and
Area.

CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
OCTOBER 12 ON INTENT TO PROCEED WITH A PUBLIC IMPROVEMENT
PROJECT AND TO ACQUIRE PROPERTY RIGHTS FOR THE IOWA AVENUE
STREETSCAPE IMPROVEMENTS PROJECT, DIRECTING CITY CLERK TO
PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER
TO PLACE DOCUMENTATION ON FILE FOR PUBLIC INSPECTION.
Comment: This project will include reconstruction of the 100, 200 & 300
blocks of Iowa Avenue to incorporate wider sidewalks and various
streetscape improvements as well as reconfiguration of the roadway and
parking. This project will also include reconstruction of a portion of the Beer
Creek storm sewer. Under the provisions of House File 476, enacted during
the 1999 legislative session, notice of the City's intent to proceed with the
project and acquire property therefore must be given to all property owners
whose properties may be affected. This notice will inform property owners
of their opportunity to present their views on the project and proposed
acquisition of property rights at the public hearing.

CONSIDER A RESOLUTION APPROVING THE PUBLIC
HOUSING MANAGEMENT ASSESSMENT (PHMAP) CERTIFICATION
OF THE IOWA CITY HOUSING AUTHORITY FOR FY99.
Comment: The Department of Housing and Urban Development (HUD)
requires housing authorities to certify fiscal year performance data as a
means of monitoring local activity. HUD will score the Iowa City Housing
Authority (ICHA) based on indicators and will identify areas of concern or
performance based on these indicators. The Public Housing Management
Assessment Program (PHMAP) certification, HUD-50072, shows a
preliminary score of 96% which designates the Iowa City Housing Authority
as a high performer.

CONSIDER A RESOLUTION AUTHORIZING APPLICATION ON BEHALF OF
THE CITY OF IOWA CITY WITH THE U.S. DOT FOR A GRANT UNDER 49
U.S.C. 5307 FOR TRANSIT OPERATING AND CAPITAL ASSISTANCE FOR
FY2000.
Comment: JCCOG is preparing the annual Federal Transit Administration
[FTA] Section 5307 application on behalf of Iowa City Transit. Funding in
the amount of $320,535 is being requested for FY2000 transit operations.
This is an increase of 6% from the FY99 FTA operating apportionment.

CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE SANITARY

Comment: At its August 19 meeting, by a vote of 5-0, the Planning and Zoning
Commission recommended approval of the proposed banner sign amendments.
Staff recommended approval in a memorandum dated July 29.
Action:
Consider a motion setting a public hearing for September 28 on an ordinance
amending Title 14, Chapter 6, Zoning, to amend the provisions relating to home

Comment: At its August 19 meeting, by a vote of 5-0, the Planning and Zoning

amending Title 14, Chapter 6, Zoning, to allow public utilities in commercial and
industrial zones.
Comment: At its September 2 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed amendments related to public
utilities. Staff recommended approval in a memorandum dated August 27.
Action:
Consider an ordinance conditionally changing the zoning designation from Medium
Density Single-Family Residential (RS-8) to Planned Development Housing Overlay
(OPDH-8), and approving a preliminary Planned Development Housing Overlay plan
for 24 townhouse-style dwelling units for approximately 7.72 acres located at the
northeast corner of Barrington Road and Huntington Drive. (REZ99-O007)

Comment: At its July 15 meeting, by a vote of 6-0, the Planning and Zoning
Commission recommended approval of the proposed rezoning and preliminary
development plan, subject to conditions. Staff recommended approval in a report
dated May 20. A summary of the revisions to the plan was contained in a staff
memorandum dated August 18.

Consider an ordinance conditionally changing the zoning designation of
approximately 7.46 acres from Medium Density Single-Family Residential (RS-8) to
Planned Development Housing Overlay (OPDH-8) and the approval of a preliminary
OPDH Plan for 72 residential dwelling units within the Windsor Ridge subdivision
located at the east terminus of Court Street. (REZ99-O006) (Second
consideration)
Comment: At its May 6 meeting, by a vote of 5-2 with Bovbjerg and Ehrhardt
voting no, the Planning and Zoning Commission recommended approval of the
rezoning, subject to a condition that would limit full development of the property
until Arlington Drive is connected to Court Street. Staff recommended approval in
its report dated April 15.

Consider an ordinance vacating an approximate 7,720 square foot unimproved
portion of Virginia Drive located between Lots 2 and 14 of North Hills Subdivision
immediately northeast of the intersection of Virginia Drive and Ridgewood Lane.
(VAC87-0001) (Second consideration)
Comment: At its July 1 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the street vacation, subject to a storm
sewer and drainage easement being maintained over the entire vacated area. Staff
recommended approval subject to the same condition in a July 1 report.
Consider an ordinance amending Title 14, Chapter 6, Zoning, by adding a definition
of "adult business" and changing separation requirements between adult
businesses and other uses. (Pass and adopt)
Comment: At its June 17 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the proposed amendments. Staff
recommended approval in a June 11 memorandum.
Action:

Comment: At its June 17 meeting, by a vote of 3-4 (with Ehrhardt, Gibson,
Shannon and Supple voting no), the Planning and Zoning Commission
recommended denial of the proposed amendment. This amendment addresses the
Oaknoll parking issue and was developed and forwarded to the Commission by
staff at the City Council's direction.

allow a veterinary clinic as a home business at 3005 Highway I NE in Johnson
County.
Comment: At its September 2 meeting, by a vote of 6-1 with Gibson voting no,
the Planning and Zoning Commission recommended that the requested conditional
use permit be approved, subject to conditions to limit the size of the business in a
non-commercial zone. This is generally consistent with the staff recommendation
cited in the memorandum dated August 27.

PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR
CONSTRUCTION OF THE IOWA CITY LANDFILL RECYCLING PROJECT, PHASE I,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING
CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND
PLACE FOR RECEIPT OF BIDS.
Comment: This project consists of replacing the landfill scale and installing a self-
contained hazardous material storage building unit. These items are necessary for the
upcoming construction of the new recycling center. The estimated construction cost
is $200,000 and will be funded by landfill user fees.

PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE OF COST FOR
CONSTRUCTION OF THE WETHERBY PARK REDEVELOPMENT PROJECT,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING
CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND
PLACE FOR RECEIPT OF BIDS.
Comment: This project consists of one phase of the re-development of Wetherby Park
as determined through a series of meetings with the Pepperwood and Wetherby
Neighborhood Associations. This phase entails grading playground and trail areas and
the installation of asphalt and crushed limestone trails, and a hard-surface basketball
court. Other phases will include new playground equipment, shelter rehab, prairie
plantings, other landscaping, an improved entryway and miscellaneous other items.
The parking lot has been resurfaced. The estimated construction cost is ~63,000.

RECONSTRUCTION OF THE MERCER PARK TENNIS COURTS, ESTABLISHING
AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK
TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR
RECEIPT OF BIDS.
Comment: This project consists of the complete reconstruction of the six existing
tennis courts in Mercer Park, including repairs to all cracks in the surface followed by
an asphalt overlay. After the overlay is completed, the courts will receive a new
colored surface, nets, posts, bank boards and fencing. If cold weather prevents the
asphalting from being completed this fall, the project will be undertaken next spring.
The estimated construction cost is ~65,000.

INTENT TO CONTINUE WITH A PUBLIC IMPROVEMENT PROJECT AND TO ACQUIRE
PROPERTY RIGHTS FOR THE SOUTH SYCAMORE REGIONAL STORMWATER AND
GREENSPACE PROJECT.
Comment: This project will enhance the drainage corridor south of Mt. Prospect,
Part 7 and Lakeside Subdivisions to the Snyder Creek Bottom Wetlands. This will
provide a regional storm water facility to be used by existing and future subdivisions.

AMENDING THE FY2000 OPERATING BUDGET.
Comment: This resolution amends the FY2000 budget to carry over budget authority
from FY99 to FY2000 for revenues and expenses that were either in process in FY99
and not completed by FY99 year end, or budgeted in FY99 and delayed until FY2000.
The City's policy is to amend the current budget at the beginning of each fiscal year
for the continuation of projects from the prior fiscal year.

Consider a Resolution Approving
CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE, THE HUMAN
RIGHTS ORDINANCE OF THE CITY OF IOWA CITY, IOWA, TO MAKE IT
SUBSTANTIALLY EQUIVALENT TO THE FAIR HOUSING AMENDMENTS ACT OF
1989. (FIRST CONSIDERATION)
Comment: In order to obtain funding from the United States Department of Housing
and Urban Development (HUD) designed to facilitate investigation of housing
discrimination claims, and to investigate claims of housing discrimination in Iowa City,
it is necessary that the Iowa City Human Rights Ordinance (ICHRO) be certified by
HUD to be substantially equivalent to the Fair Housing Amendments Act of 1989
(FHAA). By Ordinance No. 97-3785 the City of Iowa City amended the ICHRO in an
effort to make it substantially equivalent to the FHAA. HUD has subsequently
determined that additional minor changes are necessary in order to obtain substantial
equivalency. These changes are made by this ordinance.
Action:
CONSIDER AN ORDINANCE DESIGNATING AN AREA OF THE CITY OF IOWA CITY,
IOWA, AS AN URBAN REVITALIZATION AREA WHICH SHALL BE KNOWN AS THE
CENTRAL BUSINESS DISTRICT URBAN REVITALIZATION AREA. (SECOND
CONSIDERATION)
Comment: This ordinance would also repeal and replace the ordinance designating the
Block 62 Urban Revitalization Area. With the repeal of the Block 62 Plan and Area
Ordinance, the Citizen Building property tax exemption would continue until its
expiration. Any new projects on Block 62 applying for property tax exemption will
need to meet the eligibility requirements of the CBD Urban Revitalization Plan.

CONSIDER AN ORDINANCE AMENDING SECTION 6-4-5, CITY CODE, TO ALLOW
THE EMISSION OF SOUND ASSOCIATED WITH A CITY-APPROVED DEER
MANAGEMENT PLAN. (SECOND CONSIDERATION)
Comment: State law prohibits the use of sound suppressors by private citizens. If
Council approves a sharpshooting component of a deer management plan and the
activity is conducted by a private citizen, this ordinance will allow for the sound
associated with the discharge of a firearm and all other sounds associated with a City-
approved deer management plan.

CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS,"
CHAPTER 4, ENTITLED "ANIMAL CONTROL." (SECOND CONSIDERATION)
Comment: This ordinance provides for the microchipping of impounded dogs and cats.
Because many dogs and cats which are impounded have been previously impounded
and have no type of traceable identification, microchipping such animals will allow the
Animal Shelter to locate the animal's owner immediately and will reduce the number
of animals which must be euthanized because of overcrowding. This ordinance also
clarifies that "invisible" fences are not considered fences for the purposes of the
City's animal control ordinances, and that prohibited animals may take part in a
permitted circus. Correspondence included in Council packet. ~
Comment: The Iowa City Housing Authority has purchased a free standing townhouse
located at 2814 Irving Avenue as part of the Affordable Dream Home Program
("ADHOP") using funds received from the sale of public housing units. (The City is
required to reinvest such proceeds to expand affordable housing opportunities in Iowa
City.) Families who earn up to 80% of the median income may qualify for this home
under the ADHOP program. The Housing Authority has received an offer to purchase
2814 Irving Avenue from a family which meets this income qualification. The sale is
conditioned on the family receiving a real estate loan from a local financial institution,
with the City carrying a second mortgage. This sale will provide the opportunity for
below median income family to o. btain ownership of their own home.
