(1) CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF (;14,252,905.30 FOR THE PERIOD OF AUGUST I THROUGH AUGUST 31, 1999, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. (2) CONSIDER A MOTION TO APPROVE THE FY99 CONSOLIDATED ANNUAL PERFORMANCE AND EVALUATION REPORT (CAPER). Comment: As required by the U.S. Department of Housing and Urban Development (HUD) the City of Iowa City has completed the FY99 CAPER. This report describes the accomplishments of projects funded through Community Development Block Grant (CDBG) and HOME Investment Partnership programs. On September 16, the Housing and Community Development Commission recommended approval of this report. No citizen comments were submitted during the 30-day public comment period. e. Resolutions. (1) CONSIDER A RESOLUTION AUTHORIZING THE HISTORIC PRESERVATION COMMISSION TO APPLY FOR A PRESERVATION SERVICES FUND (PSF) GRANT FROM THE NATIONAL TRUST FOR HISTORIC PRESERVATION IN THE AMOUNT OF $2,500 TO ASSIST IN PLANNING FOR THE REHABILITATION OF THE MONTGOMERY-BUTLER HOUSE. Comment: The Historic Preservation Commission is interested in hiring a consultant to assist in planning for the future rehabilitation and reuse of the historic Montgomery-Butler House. The consultant hired would assist the Commission in identifying potential funding sources for the rehabilitation of the building, identifying preservation minded organizations that may potentially be interested in assisting with or being responsible for the rehabilitation and long-term use and maintenance of the structure, and to help organize and focus the Commission's efforts to find an appropriate long term use(s) for the building and site. The Commission intends to request approximately $2,500 in grant funds, which would require an equivalent local match. (2) CONSIDER A RESOLUTION APPROVING THE OFFICIAL FINANCIAL REPORT FOR CITY STREETS AND PARKING FOR THE FISCAL YEAR ENDING JUNE 30, 1999. Comment: The Iowa Department of Transportation requires all municipalities to submit this report annually on or before September 30. September 28, 1999 City of Iowa City Page 3 (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 755 OAKLAND AVENUE, IOWA CITY, IOWA. Comment: The owners of the property located at 755 Oakland Avenue received assistance through the City's Housing Rehabilitation Program for the amount of $11,000 on September 28, 1988. The financing was in the form of a low-interest loan. The loan was paid off on September 9, 1999; thus the lien can now be released. (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT FOR THE RELEASE AND SUBSTITUTION OF A PEDESTRIAN USE EASEMENT LOCATED WITHIN PLAZA CENTRE ONE, IOWA CITY, IOWA. Comment: The City currently possesses a pedestrian access/use easement over the courtyard abutting College Street within Plaza Centre One (in front of Hardee's). A prospective business wishes to make ground floor improvements on the courtyard area and is willing to construct a new secondary access within the Plaza Centre One Building to facilitate public ingress and egress through the property in a manner similar to that provided by the courtyard easement. This Resolution authorizes the execution of the Agreement for the Release and Substitution of a Pedestrian Use Easement, which releases the City's current easement and provides for the granting of a substituted easement by the Owners upon reconfiguration of the building. f. Comment: At its August 19 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the proposed banner sign amendments. Action: Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, to allow public utilities in commercial and industrial zones. Comment: At its September 2 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the proposed amendments related to public utilities. Staff recommended approval in a memorandum dated August 27. Action: September 28, 1999 City of Iowa City Page 5 qct - 3 qct Consider an ordinance conditionally changing the zoning designation from Medium Density Single-Family Residential (RS-8) to Planned Development Housing Overlay (OPDH-8), and approving a preliminary Planned Development Housing Overlay plan for 24 townhouse-style dwelling units for approximately 7.72 acres located at the northeast corner of Barrington Road and Huntington Drive. (REZ99-O007) (Second consideration) ~,(,,Jdr { ~ Comment: At its July 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning and preliminary development plan, subject to conditions. Staff recommended approval in a report dated May 20. A summary of the revisions to the plan was contained in a staff memorandum dated August 18. Action: d~/7~'-'/-'~ e. Consider an ordinance conditionally changing the fe zoning designation of approximately 7.46 acres from Medium Density Single-Family Residential (RS-8) to Planned Development Housing Overlay (OPDH-8) and the approval of a preliminary OPDH Plan for 72 residential dwelling units within the Windsor Ridge subdivision located at the east terminus of Court Street. (REZ99-O006) (Pass and ad(~t~) Comment: At its May 6 meeting, by a vote of 5-2 with Bovbjerg and Ehrhardt voting no, the Planning and Zoning Commission recommended approval of the rezoning, subject to a condition that would limit full development of the property until Arlington Drive is connected to Court Street. Staff recommended approval in its report dated April 15. Consider an ordinance vacating an approximate 7,720 square foot unimproved portion of Virginia Drive located between Lots 2 and 14 of North Hills Subdivision immediately northeast of the intersection of Virginia Drive and Ridgewood Lane. (VAC87-0001) (Pass and adopt) Comment: At its July 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of the street vacation, subject to a storm sewer and drainage easement being maintained over the entire vacated area. PUBLIC HEARING ON AN AMENDED NEAR SOUTHSIDE COMMERCIAL URBAN REVITALIZATION PLAN FOR AN EXISTING URBAN REVITALIZATION AREA IN THE CITY OF IOWA CITY, IOWA Comment: The proposed amendments to the Near Southside Commercial Urban Revitalization Plan would make the property tax exemption eligibility requirements in the Near Southside Urban Revitalization Area consistent with those of the proposed Central Business District Urban Revitalization Plan and Area. See September 14, 1999, Formal Agenda, Item #3e(1 ) for support documentation. Action: ITEM NO. 7. THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE LONGFELLOW-TWAIN PEDESTRIAN TUNNEL PROJECT. Comment: This project will provide a pedestrian crossing under the Iowa Interstate Railroad that will link the Longfellow and Twain neighborhoods. The preliminary design has identified two potential routes. Correspondence included in Council packet. a. Public Hearing b. Consider a Resolution Declaring ITEM NO. 8. THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE HIGHWAY 6 CORRIDOR IMPROVEMENTS PROJECT. Comment: This project will include the installation of a storm sewer system, curbs near intersections, construction of a trail/sidewalk, installation of shoulders and landscaping along Highway 6 between the Iowa River and Sycamore Street. a. THE CITY'S INTENT TO PROCEED WITH AND AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE MORMON TREK BOULEVARD IMPROVEMENTS, HIGHWAY I TO ABBEY LANE PROJECT. Comment: This project will upgrade Mormon Trek Boulevard, from Highway 1 to Abbey Lane, to a conventional four-lane cross section. It will also provide an improvement to the Highway 1 intersection geometry and traffic signals to enhance capacity and revel of service. a. Public Hearing ITEM NO. 10. be Consider a Resolution Declaring CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 2814 IRVING AVENUE. Comment: The Iowa City Housing Authority has purchased a free standing townhouse located at 2814 Irving Avenue as part of the Affordable Dream Home Program ('ADHOP") using funds received from the sale of public housing units. (The City is required to reinvest such proceeds to expand affordable housing opportunities in Iowa City.) Families who earn up to 80% of the median income may qualify for this home under the ADHOP program. The Housing Authority has received an offer to purchase 2814 Irving Avenue from a family which meets this income qualification. The amount of the sale will be the appraised price of the townhouse, which is 9111,900. The family has received a letter of commitment from a local financial institution for 984,320. The City will carry an additional mortgage on the property for the remaining 927,580. a. Public Hearing b. Consider a Resolution Authorizing September 28, 1999 City of Iowa City Page 8 ITEM NO. 11. ~-- 5~a5, CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND LEPIC- KROEGER REALTORS OF IOWA CITY, IOWA. ITEM NO. 12. Comment: This resolution authorizes the City to enter into an agreement with Lepic- Kroeger Realtors to market the approximately 27,000 square feet of commercial property which will be for sale in Tower Place and Parking. The property will be placed on the multiple listing service and may be sold by any real estate agent in the community. The agreement is for a one-year period. / CONSIDER A RESOLUTION AUTHORIZING A 28E AGREEMENT BETWEE$~ OF CORALVILLE AND THE CITY OF IOWA CITY PROVIDING FOR FUTURE ANNEXATIONS AND EXTRATERRITORIAL REVIEW OF SUBDIVISION PLATS, AND REPEALING RESOLUTION 99-30. Comment: This agreement has been negotiated between the City of Iowa City and the City of Coralville. It replaces a previous agreement which was voided by the annexation of the Iowa City water plant site by Iowa City, and by the annexation of the Barrington Heights subdivision by Coralville. The agreement establishes the division of review authority between Coralville and Iowa City for county subdivisions and rezonings in the overlapping two-mile area of extraterritorial jurisdiction between Coralville and Iowa City. This resolution also repeals Resolution 99-30, which had approved an earlier version of this agreement that was not approved by Coralville. o io.: / ITEM NO. 13. CONSIDER AN ORDINANCE AMENDING TITLE 8, POLICE, CHAPTER 6, ENTITLED "PERSONS UNDER EIGHTEEN YEARS OF AGE," SECTION 1, ENTITLED "SALE TO AND/OR POSSESSION OF TOBACCO PRODUCTS AND CIGARETTES: UNDERAGE PERSONS," SUBSECTION B, "EMPLOYEE EDUCATION - CIGARETTE SALES," TO ELIMINATE THE REQUIRMENT THAT EMPLOYEES SIGN AN AFFIDAVIT AND ADD A REQUIREMENT THAT BUSINESS/RETAILERS ENSURE THAT THEIR EMPLOYEES ARE EDUCATED ABOUT THE PROHIBITION ON SALES TO MINORS. (FIRST CONSIDERATION) Comment: At the request of Council this section has been modified to requir.e employee education by the business owner and omit the requirement for employee affidavits to be notarized and filed each year and kept on business premises. City of Iowa City Page 9 CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 3, ARTICLE B ENTITLED "PROJECT SPECIFIC TAP-ON FEES" TO REQUIRE PUBLIC NOTICE IN ACCORDANCE WITH IOWA CODE SECTION 384.38(3) AND TO ELIMINATE THE REQUIREMENT THAT NOTICE OF THE PUBLIC HEARING BE SENT BY ORDINARY MAIL TO OWNERS OF RECORD OF REAL PROPERTY WITHIN THE BENEFITED AREA. (FIRST CONSIDERATION) ITEM NO. 15. Comment: The last amendment to the City's project-specific tap-on fee ordinance was made without the benefit of Iowa Code Section 384.38(3) which specifically authorizes such tap-on fees and does not require that notice of the public hearing be sent by ordinary mail to owners of record of real property within the benefited area. The requirement of mailed notice is difficult in that by the time all costs can be determined with accuracy such that the project-specific tap-on fee ordinance can be put in place, some tap-on fees have typically been paid in connection with the subdivision process. In addition, there are some benefited properties which are exempt from the requirements of the tap-on fee ordinance by virtue of having been previously served by the utility constructed. The current ordinance requires that all property owners in the subject area be notified, whether exempt, subject to the ordinance but paid, or unpaid. Determining the property owners administratively prohibitive, as recognized by the Section 384.38(3). and their payment status is Iowa Legislature's passage of CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE, THE HUMAN RIGHTS ORDINANCE OF THE CITY OF IOWA CITY, IOWA, TO MAKE IT SUBSTANTIALLY EQUIVALENT TO THE FAIR HOUSING AMENDMENTS ACT OF 1989. (SECOND CONSIDERATION) Comment: In order to obtain funding from the United States Department of Housing and Urban Development (HUD) designed to facilitate investigation of housing discrimination claims, and to investigate claims of housing discrimination in Iowa City, it is necessary that the Iowa City Human Rights Ordinance (ICHRO) be certified by HUD to be substantially equivalent to the Fair Housing Amendments Act of 1989 (FHAA). By Ordinance No. 97-3785 the City of Iowa City amended the ICHRO in an effort to make it substantially equivalent to the FHAA. HUD has subsequently determined that additional minor changes are necessary in order to obtain substantial equivalency. These changes are made by this ordinance. CONSIDER AN ORDINANCE DESIGNATING AN AREA OF THE CITY OF IOWA CITY, IOWA, AS AN URBAN REVITALIZATION AREA WHICH SHALL BE KNOWN AS THE CENTRAL BUSINESS DISTRICT URBAN REVITALIZATION AREA. (PASS AND ADOPT) Comment: This ordinance would also repeal and replace the ordinance designating the Block 62 Urban Revitalization Area. With the repeal of the Block 62 Urban Revitalization Area Ordinance, the Citizen Building property tax exemption would continue until its expiration. Any new projects on Block 62 applying for the property tax exemption will need to meet the eligibility requirements of the CBD Urban Revitalization Plan. ITEM NO. 17. CONSIDER A RESOLUTION APPROVING THE CENTRAL BUSINESS DISTRICT URBAN REVITALIZATION PLAN AND REPEALING RESOLUTION NO. 93-334. Comment: This resolution would also repeal and replace the Block 62 Urban Revitalization Plan. See previous item, ITEM NO. 18. qq- 3 o/ CONSIDER AN ORDINANCE AMENDING SECTION 6-4-5, CITY CODE, TO ALLOW THE EMISSION OF SOUND ASSOCIATED WITH A CITY-APPROVED DEER MANAGEMENT PLAN. (PASS AND ADOPT) Comment: State law prohibits the use of sound suppressors by private citizens. Council approved sharpshooting by a private citizen as a component of the City's deer management plan. This ordinance will allow for the sound associated with the discharge of a firearm and all other sounds associated with a City-approved deer management plan. Action: p + ITEM NO. 19. CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 4, ENTITLED "ANIMAL CONTROL." (PASS AND ADOPT) Comment: This ordinance provides for the microchipping of impounded dogs and cats. Because many impounded dogs and cats have been previously impounded and have no type of traceable identification, microchipping such animals will allow the Animal Shelter to locate the animal's owner immediately and will reduce the number of animals which must be euthanized because of overcrowding. This ordinance also clarifies that "invisible" fences are not considered fences for the purposes of the City's animal control ordinances, and that prohibited animals may take part in a permitted circus. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR THE CONSTRUCTION OF THE IOWA CITY CHAUNCY SWAN FOUNTAIN PROJECT. Comment: The bid opening for this project was held on September 21, 1999, and the following bid was received: All American Concrete West Liberty, IA 9119,000 Engineer's Estimate 982,700 Staff does not recommend award of this contract. Public Works and Engineering will re-bid the project in late winter. Action: ITEM NO. 21. Comment: The City of Iowa City has agreed to purchase the train, carousel, and small airplane ride from the Drollingers effective the end of this season. ITEM NO. 25. tiff- 3q-~2 CONSIDER A RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF AN AGREEMENT WITH GENE, L.L.C., FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY FOR PORTIONS OF COURT AND LINN STREETS IN IOWA CITY, IOWA. Comment: This temporary use of right-of-way is to allow the abutting property owners to temporarily close and erect barricardes 10' west of the east curb line adjacent to their property along Linn Street, 5' north of the north curb line adjacent to their property along Court Street, and the west 10' feet of the adjacent alley. This agreement is requested in order to facilitate the safe construction of a new apartment building and to secure the construction site from pedestrian traffic. ITEM NO. 27. 5'( ~ ITEM NO. 28. CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF AN EASEMENT AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY AND GENE, L.L.C. Comment: This agreement is for the use of 5' of the Court Street right-of-way for the placement of planters along the south side of a proposed apartment building, steps to provide access to the building, a garage exhaust vent, and a 4" drain. The apartment building will be located at the corner of Court and Linn Streets, and construction is to begin this fall. Action: CONSIDER A RESOLUTION DECLARING INTENT TO TERMINATE THE CONSULTANT AGREEMENT BETWEEN THE CITY OF IOWA CITY AND WEHNER, PATTSCHULL & PFIFFNER P.C. FOR THE CIVIC CENTER PROJECT AND AUTHORIZING THE CITY ATTORNEY TO GIVE WRITTEN NOTICE OF TERMINATION. Comment: On June 17, 1998, the City contracted with the architectural firm of Wehner, Pattschull & Pfiffner P.C. ("WPP") for consulting services for the Civic Center project. The architect handling the job for WPP was John Shaw. Mr. Shaw has since left WPP but continues to perform said architectural services. Although both WPP and Mr. Shaw have indicated their agreement to this arrangement, there has been no formal written assignment and, therefore, it is necessary to terminate the agreement with WPP so that the City can enter into a formal agreement with Mr. Shaw for the remainder of the services. ITEM NO. 30. Comment: This contract is for design of a replacement for the Landfill scale house that was destroyed in the June 29, 1998, windstorm. Integrated into this new building will be the Household Hazardous Waste Facility. This contract is with John Shaw Architects of Iowa City for the sum of ~74,090 and will be funded by Landfill fees. Action: CONSIDER A RESOLUTION APPROVING PURCHASE AGREEMENT BETWEEN CITY OF IOWA CITY AND SOUTHGATE DEVELOPMENT COMPANY, INC. FOR PURCHASE OF PROPERTY ON BENTON STREET ACROSS FROM ROOSEVELT ELEMENTARY. ITEM NO. 31. Comment: City staff has negotiated a purchase agreement with Southgate Development Company, Inc, for property on the south side of Benton Street across from Roosevelt Elementary School.
